Commission Delegated Regulation (EU) 2026/1160 of 28 May 2026 amending Delegated Regulation (EU) 2022/127 supplementing Regulation (EU) 2021/2116 of the European Parliament and of the Council, as regards payments of advances for interventions in the wine sector

(EU) No 1306/2013(1), and in particular Article 44(5) thereof,

Whereas:

(1) Commission Delegated Regulation (EU) 2022/127(2)supplements Regulation (EU) 2021/2116 with rules on paying agencies and other bodies, financial management, clearance of accounts, securities and use of euro.

(2) The wine sector is currently facing significant market volatility across several Member States, with red and rosé market segments being most acutely affected. This situation has been acknowledged in the political compromise reached by the three Union institutions during the legislative negotiations on the Proposal for a Regulation(3) amending Regulations (EU) No 1308/2013(4), (EU) 2021/2115(5) and (EU) No 251/2014(6) of the European Parliament and of the Council as regards certain market rules and sectoral support measures in the wine sector and for aromatised wine products, and Regulation (EU) 2024/1143 of the European Parliament and of the Council(7)as regards certain labelling rules for spirit drinks. Therefore, in order to improve the efficacy of the implementation of the new sectoral interventions included in that Proposal and to facilitate the implementation of wine sectoral interventions within the CAP Strategic Plans, Article 15a of Delegated Regulation (EU) 2022/127 should be amended to increase from 80 % to 90 % the maximum rate of the forecasted expenditure of interventions, referred to in Article 58 of Regulation (EU) 2021/2115, that can be paid in advance to the beneficiaries. This amendment is aimed to improve the payment of advances in respect of wine sectoral interventions and to increase the uptake of such necessary measures and interventions by easing their financing by beneficiaries.

(3) Delegated Regulation (EU) 2022/127 should therefore be amended accordingly.

(4) In order to allow Member States to apply the increased rate relating to payment of advances for interventions to be implemented ahead of the new harvest, this Regulation should enter into force on the day following that of its publication in the Official Journal of the European Union,

HAS ADOPTED THIS REGULATION:

Article 1 Amendments to Delegated Regulation (EU) 2022/127 In Article 15a of Delegated Regulation (EU) 2022/127, paragraph 1 is replaced by the following: ‘1. The payment of advances referred to in Article 44(3a) of Regulation (EU) 2021/2116 shall not exceed 80 % of the Union financial contribution to the estimated costs of interventions referred to in Articles 47, 55, 61, 64 and 67 of Regulation (EU) 2021/2115.

The payment of advances referred to in Article 44(3a) of Regulation (EU) 2021/2116 shall not exceed 90 % of the Union financial contribution to the estimated costs of the interventions referred to in Article 58 of Regulation (EU) 2021/2115.’.

Article 2 Entry into force This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
