Whereas:

(1) On 30 April 2026, the European Commission (‘the Commission’) announced, by a notice published in the Official Journal of the European Union(2), the reopening of an anti-dumping proceeding with regard to imports into the Union of lysine originating in the People’s Republic of China.

(2) This initiation followed a request lodged on 20 March 2026 by a Union producer representing more than 25 % of the total Union production of lysine.

(3) The absorption investigation aims to establish whether the anti-dumping measures imposed by Commission Implementing Regulation (EU) 2025/1330(3) on imports of lysine originating in the People’s Republic of China have had an effect on export prices, resale prices or subsequent selling prices in the Union.

1. PRODUCT SUBJECT TO REGISTRATION

(4) The product subject to registration (‘the product concerned’) is lysine and its esters, salts thereof, and feed additives, consisting of dry weight basis of 68 % or more, but not more than 80 % of L-lysine sulphate, and not more than 32 % of other components such as carbohydrates and other amino acids originating in the People’s Republic of China. The Chemical Abstracts Service (CAS) registry number for L-lysine hydrochloride is 657-27-2, for aqueous solution of lysine is 56-87-1, and for lysine sulphate is 60343-69-3 and 94195-18-3

2. REGISTRATION

(5) Under Article 14(5) of the basic Regulation, in connection with Article 12(5) of the basic Regulation, imports of the product concerned may be made subject to registration, where an absorption reinvestigation involves a re-examination of normal values. One of the exporting producers sampled in the abovementioned investigation has, on 15 June 2026, submitted a request for the recalculation of the normal value duly substantiated by evidence.

(6) The purpose of registration is to ensure that anti-dumping duties, if any, can be levied retroactively on the imports subject to registration in accordance with the applicable legal provisions, if the necessary conditions are met.

(7) The Commission has decided to make imports of the product concerned subject to registration on its own initiative under Article 14(5) of the basic Regulation. The conditions for retroactive collection of duties will be assessed in the regulation concluding the anti-absorption investigation.

(8) Any future liability would emanate from the findings of the anti-absorption investigation.

(9) The calculations provided in the request for the reopening of the anti-dumping investigation estimate that the dumping margins have increased from 53,1 % in the original investigation period (1 January 2023 to 31 December

2023) to 88,4 % in the absorption investigation period from 1 April 2025 to 31 March 2026. According to Article 12(3) of the basic Regulation the amount of the anti-dumping duty imposed as a result of the absorption investigation shall not exceed twice the amount of the duty imposed initially.

(10) However, at this stage the Commission is not in a position to estimate the amount of possible future liability. Thus, the amounts mentioned in the request are only for information purposes and cannot create any expectations as to the actual level of liability which will be established as a result of the investigation.

3. PROCESSING OF PERSONAL DATA

(11) Any personal data collected in the context of this registration will be treated in accordance with Regulation

(EU) 2018/1725 of the European Parliament and of the Council(4)on the protection of natural persons with regard to the processing of personal data by the Union institutions, bodies, offices and agencies and on the free movement of such data ,

HAS ADOPTED THIS REGULATION:

Article 1

1. The customs authorities are hereby directed, under Article 14(5) of Regulation (EU) 2016/1036, to take the appropriate steps to register imports into the Union of lysine and its esters, salts thereof, and feed additives, consisting of dry weight basis of 68 % or more, but not more than 80 % of L-lysine sulphate, and not more than 32 % of other components such as carbohydrates and other amino acids, usually falling under Chemical Abstracts Service’s (CAS) registration number 657-27-2 for L-lysine hydrochloride, 56-87-1 for aqueous solution of lysine, and 60343-69-3 and 94195-18-3 for lysine sulphate, currently classified under CN codes ex 2309 90 31, ex 2309 90 96, and 2922 41 00 (TARIC codes: 2309 90 31 51, 2309 90 31 59, 2309 90 31 61, 2309 90 31 69, 2309 90 96 51, 2309 90 96 59, 2309 90 96 61, 2309 90 96 69), and originating in the People’s Republic of China.

2. Registration shall expire seven months following the date of entry into force of this Regulation.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
