Council Decision (CFSP) 2026/1333 of 15 June 2026 amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine

Official Journal EN of the European Union L series 2026/1333 15.6.2026 COUNCIL DECISION (CFSP) 2026/1333 of 15 June 2026 amending Decision 2014/145/CFSP concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty on European Union, and in particular Article 29 thereof, Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

(1) On 17 March 2014, the Council adopted Decision 2014/145/CFSP(1).

(2) In order to ensure the diversification of supply chains for Union operators, it is appropriate to introduce new temporary derogations from the asset freeze and the prohibition on making funds or economic resources available to a designated entity, allowing for the wind-down of operations, contracts and other agreements concluded with that entity and for industry purchases of critical components manufactured by that entity. Operators are expected to adopt and implement appropriate diversification plans prior to the expiry of that derogation, with a view to enabling a transition towards alternative sources of supply.

(3) Decision 2014/145/CFSP should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1 In Article 2 of Decision 2014/145/CFSP, the following paragraph is added: ‘36. By way of derogation from paragraphs 1 and 2 of this Article, the competent authorities of a Member State may authorise the release of certain frozen funds or economic resources belonging to the entity listed under entry number 692 under the heading “Entities” in the Annex to this Decision, or the making available of certain funds or economic resources to that entity, under such conditions as they deem appropriate and after having determined that such funds or economic

resources are strictly necessary for:

(a) the termination by 31 December 2026, of operations, contracts or other agreements concluded with the entity listed under entry number 692 before 23 April 2026 and provided that the release or making available of funds or economic resources is completed by 31 December 2026; or

(b) industry purchases of critical components manufactured by and for corresponding payments to that entity with a view to enabling a transition towards alternative sources of supply provided that the release or making available of funds or economic resources is completed by 16 March 2027.’.
