Decision of the EEA Joint Committee No 94/2026 of 20 March 2026 amending Annex IX (Financial services) to the EEA Agreement [2026/1289]

Whereas:

(1) Commission Delegated Regulation (EU) 2025/791 of 23 April 2025 supplementing Directive 2013/36/EU of the European Parliament and of the Council with regard to regulatory technical standards specifying the general conditions for the functioning of supervisory colleges, and repealing Commission Delegated Regulation

(EU) 2016/98(1)is to be incorporated into the EEA Agreement.

(2) Commission Implementing Regulation (EU) 2025/790 of 23 April 2025 laying down implementing technical standards for the application of Directive 2013/36/EU of the European Parliament and of the Council with regard to the operational functioning of colleges of supervisors(2)is to be incorporated into the EEA Agreement.

(3) Delegated Regulation (EU) 2025/791 repeals Commission Delegated Regulation (EU) 2016/98(3), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(4) Annex IX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex IX to the EEA Agreement is amended as follows:

1. The following is inserted after point 14v (Commission Delegated Regulation (EU) 2024/857): ‘14w. 32025 R 0790: Commission Implementing Regulation (EU) 2025/790 of 23 April 2025 laying down implementing technical standards for the application of Directive 2013/36/EU of the European Parliament and of the Council with regard to the operational functioning of colleges of supervisors (OJ L, 2025/790,

8.8.2025).

14x. 32025 R 0791: Commission Delegated Regulation (EU) 2025/791 of 23 April 2025 supplementing Directive 2013/36/EU of the European Parliament and of the Council with regard to regulatory technical standards specifying the general conditions for the functioning of supervisory colleges, and repealing Commission Delegated Regulation (EU) 2016/98 (OJ L, 2025/791, 8.8.2025).

The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following

adaptation:

In Articles 3(3) and 25(3), the following point shall be added: “(e) the EFTA Surveillance Authority, for the purpose of enabling it to carry out its duties under Directive 2013/36/EU, Regulation (EU) No 575/2013, and under Regulation (EU) No 1093/2010.”’

2. The text of point 14e (Commission Delegated Regulation (EU) 2016/98) is deleted.

Article 3 This Decision shall enter into force on 21 March 2026, provided that all the notifications under Article 103(1) of the EEA Agreement have been made(*).

Article 4 This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
