1. संजक्षप्त नाम और प्रारंभ.- (1) आन जनयमों का संजक्षप्त नाम हररयाणा प्रिासजनक ऄजधकरण (प्रदिया) जनयम, 2023 ह ै।

(2) ये राजपत्र म ेंआनके प्रकािन की तारीख को प्रिृत्त होंग े।

2. पररभाषाए.ं - (1) आन जनयमों म,ें जब तक संदभा स ेऄन्द्यथा ऄपेजक्षत न हो,-- (क) “ऄजधजनयम” से प्रिासजनक ऄजधकरण ऄजधजनयम, 1985 (1985 का 13) ऄजभप्रेत ह ै ; (ख) “ऄजभकता”ा से दकसी पक्षकार द्वारा ईसकी ओर स े ऄजधकरण के समक्ष कोइ अिेदन, जलजखत ईत्तर, प्रत्युत्तर या कोइ ऄन्द्य दस्ट्तािेज प्रस्ट्तुत करन े के जलए सम्यक् रूप से प्राजधकृत कोइ व्यजि ऄजभप्रेत ह ै;

(ग) “अिेदक” से ऄजधजनयम की धारा 19 के ऄधीन ऄजधकरण को अदेिन करने िाला व्यजि ऄजभप्रेत ह ै;

(ङ) “प्राजधकृत ऄजधकारी” से रजजस्ट्रार, ईप रजजस्ट्रार, फाआललग संिीक्षा ऄजधकारी और ऄजधकरण का ऐसा कोइ ऄन्द्य ऄजधकारी जो, ऄध्यक्ष द्वारा प्राजधकृत दकया जाए, ऄजभप्रेत ह ै ; (च) “आलैक्राजनक पोटाल” से जनयम 5 के ऄधीन ऄजधकरण के ईपयोग के जलए आलैक्राजनक पोटला ऄजभप्रेत ह,ै ;

(छ) “प्ररूप” से आन जनयमों म ें संलग्न प्ररूप और आसम ें ऄजधकरण के आलैक्राजनक पोटाल पर ईपलब्ध करािाया गया प्ररूप भी िाजमल ह ै; (ज) “जिजधक व्यिसायी” का िही ऄथ ा होगा, जो ऄजधििा ऄजधजनयम, 1961 (1961 का 25) में ह ै;

(झ) “जिजधक प्रजतजनधी” से ऐसा व्यजि, जो जिजध की दजृ ि म ें मृतक व्यजि की संपदा का प्रजतजनजधत्ि करता ह ै तथा आसमें ऐसा व्यजि या ऐसे व्यजि भी िाजमल ह ैं जजसमें/जजनमें पेंिनरी, सेिाजनिृजत्त, सेिांत या ऄन्द्य लाभ या कुटुंब पेंिन प्राप्त करन े का ऄजधकार जनजहत ह/ैह,ैं ऄजभप्रेत ह ै;

(ञ) ऄजधकरण के संबंध म ें “रजजस्ट्रार” से प्रधान न्द्यायपीठ के जलए जनयुि रजजस्ट्रार और ऄजधकरण की प्रत्येक ऄन्द्य न्द्यायपीठों के संबंध में“रजजस्ट्रार” से ऄजभप्राय होगा, जिजिि न्द्यायपीठ के जलए जनयिु रजजस्ट्रार या कोइ ऄन्द्य ऄजधकारी, जजसे जनयम 31 के ईपजनयम

(2) और ईपजनयम (3) के ऄधीन रजजस्ट्रार की िजियां और कृत्य प्रत्यायोजजत दकए जाएं, ऄजभप्रेत ह ै; (ट) “रजजस्ट्री” से ऄजभप्राय ह,ै ऄजधकरण या ऄजधकरण के न्द्यायपीठ की रजजस्ट्री, जैसी भी जस्ट्थजत हो ; (ठ) “धारा” से ऄजधजनयम की धारा ऄप्रजभप्रेत ह ै;

(ड) “ऄंतररत अिेदन” से िाद या ऄन्द्य कायािाजहयां, जो ऄजधजनयम की धारा 29 की ईपधारा

(1) या ईपधारा (2) के ऄधीन ऄजधकरण को ऄतं ररत की गइ ह ै ; (ढ) “ऄजधकरण” से ऄजधजनयम की धारा 4 की ईपधारा (2) के ऄधीन स्ट्थाजपत हररयाणा राज्य प्रिासजनक ऄजधकरण, ऄजभप्रेत ह ै।

(2) ईन िब्दों और पदों के, जो आसमें प्रयुि ह ै और पररभाजषत नहीं ह ै दकन्द्तु ऄजधजनयम में पररभाजषत ह,ै िही ऄथ ाहोंगे जो ईस ऄजधजनयम में ह ै।

3. ऄजधकरण की भाषा.- (1) ऄजधकरण की भाषा ऄग्रं ेजी होगी: परन्द्त ु पक्षकार ऄजधकरण के समक्ष दकसी कायािाही में लहदी में तैयार दस्ट्तािेज दायर कर सकते ह,ैं यदद िे ऐसा चाहते ह:ैं परन्द्त ुयह और दक न्द्यायपीठ— (क) दकसी कायािाही में लहदी के ईपयोग को ऄनुज्ञात कर सकती ह ैं ;

(ख) मामले की सुनिाइ म,ें दायर दकये जान े िाले ऄजभिचनों या दस्ट्तािेजों का ऄंग्रजी ऄनुिाद का जनदेि द ेसकती ह ै; (ग) ऄंजतम अदेि या तो लहदी या ऄंग्रजी म ेंकर सकती ह ैं।

(2) ईपजनयम (1) म ें ऄन्द्तर्मिि दकसी बात के होते हुए भी, जहां कोइ ऄंजतम अदिे लहदी में दकया जाता है, तो ईसका प्राजधकृत ऄग्रं ेजी ऄनुिाद साथ-साथ तैयार दकया जाएगा और ऄजभलेख में रखा जाएगा ।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3

4. अिदे न फाआल करन े के जलए प्रदिया .- (1) अिेदक द्वारा ऄजधकरण को अिेदन प्ररूप 1 में व्यजिगत रूप से या दकसी ऄजभकताा द्वारा या जिजधित रूप से प्राजधकृत जिजध व्यिसायी द्वारा रजजस्ट्रार या ईसे प्राप्त करन े के जलए रजजस्ट्रार द्वारा जलजखत म ें प्राजधकृत दकसी ऄन्द्य ऄजधकारी को प्रस्ट्तुत दकया जाएगा या सम्बद्ध न्द्यायपीठ के रजजस्ट्रार को जिजधित रूप स ेसंबोजधत पािती सजहत रजजस्ट्रीकृत डाक से भेजा जाएगा:

परन्द्त ु आलैक्राजनक रूप से अिदे न दायर करन े की दिा में, ईसे आलैक्राजनक पोटला पर यथा ईपबंजधत प्ररूप में फाआल दकया जाएगा ।

(2) ईपजनयम (1) के ऄधीन अिेदन तीन प्रजतयों म ेंजनम्नजलजखत दो संकलनों म ेंप्रस्ट्तुत दकया जाएगा—

(i) संकलन संख्या 1—प्रजतिाद अदेि, यदद काइ हो, के साथ अिदे न ;

(ii) संकलन संख्या 2—पेपर बुक के रूप म ेंअिेदन म ेंजनर्ददि सभी ऄन्द्य दस्ट्तािेज और ऄनुबधं ; परन्द्त ुआलैक्राजनक रूप से अिदे न दायर करने की दिा म,ें अिेदन की तीहरी प्रजतयों की अिश्यकता नहीं ह ै।

(3) जहां प्रजतिाददयों की संख्या एक से ऄजधक ह,ै िहां प्रजतिाददयों की संख्या के बराबर अिेदन की पेपर बुक के रूप में ऄजतररि प्रजतयां और ईतनी ही संख्या में ऄनप्रयिु फाआल के अकार के जलफाफे में, जजस पर प्रत्येक प्रजतिादी का पूरा पता हो, अिेदक द्वारा प्रस्ट्तुत दकए जाएंगे :

परन्द्त ु जहां प्रजतिाददयों की संख्या पांच से ऄजधक ह,ै िहां रजजस्ट्रार अिेदक को प्रजतिाददयों को नोरटस जारी करन े के समय अिेदन की ऄजतररि प्रजतयां फाआल करन ेकी ऄनुज्ञा दे सकता ह:ै परन्द्त ु यह और दक आलैक्राजनक रूप से अिेदन दायर करन े की दिा में, पता जलखे हुए जलफाफे और अिेदन की ऄजतररि प्रजतयों की अिश्यकता नहीं ह ै लेदकन अिेदक को प्रजतिाददयों के इ-मेल का पता देना होगा ।

(4) अिेदक ऄपन े अिेदन के साथ प्ररूप-2 म ें प्राजप्त पची सलं ग्न कर सकता और प्रस्ट्ततु कर सकता ह,ै जजस पर रजजस्ट्रार द्वारा या रजजस्ट्रार की ओर से अिेदन प्राप्त करने िाले ऄजधकारी द्वारा अिदे न की प्राजप्त की ऄजभस्ट्िीकृजत पर हस्ट्ताक्षर दकए जाएंगे ।

(5) (क) ईपजनयम (1) से ईपजनयम (3) में ऄन्द्तर्मिि बात के होते हुए भी, ऄजधकरण, यदद ईसको समाधान हो जाता ह,ै प्राथाना में दकए गए ऄनुतोष के हते ुक और प्रकृजत को ध्यान में रखते हुए दक मामले में ईन सब का सामान्द्य जहत ह,ै एक से ऄजधक व्यजियों को एक साथ सामूजहक होन े और एकल अिेदन दायर करने की ऄनुज्ञा दे सकता ह ै; या (ख) ऐसी ऄनुमजत, व्यजियों का प्रजतजनजधत्ि करने िाले दकसी संघ को, जो एकल अिेदन में सजम्मजलत होना चालत े ह,ैं भी प्रदान की जा सकती ह ै । ऐस े मामल े में, अिेदन म ें िग ा या प्रिग ा ऄथिा व्यजियों का प्रकटन दकया जाएगा जजनकी ओर स े यह दायर दकया गया ह ै तथा ऐसे अिेदन म ें कम से कम एक प्रभाजित व्यजि िाजमल होगी ।

5. आलक्ै राजनक पोटाल की स्ट्थापना करना और अिदे न फाआल करना. - (1) ऄजधकरण, अिेदनों और दसतािेजों को फाआल करने के जलए आलैक्राजनक पोटाल स्ट्थाजपत कर सकता ह ै।

(2) ऄजधकरण को अिेदनों और याजचकाओं को, रजजस्ट्रार या प्राजधकृत ऄजधकारी को, ऐसे आलक्ै राजनक पोटाल के माध्यम से, जिजहत जडजजटल फामेट में, प्रस्ट्तुत दकए जाऐगे: परन्द्त ु जडजजटाआजेिन की पारगमन ऄिजध म ें ऄथिा यदद दकसी भी कारण से, आलैक्राजनक पोटाल तक पहुचं ईपलब्ध नहीं होती ह,ै तब अिेदक या प्रजतिादी अिेदन ऄथिा याजचकाओं को ऄजधजनयम की धारा 19 के ऄनुसार ऄजभलेख पुजस्ट्तका के रूप में फाआल कर सकता ह ै और ऐस े मामलों में, अिेदक ईसकी एक साफ्ट कापी भी प्रस्ट्ततु करेगा और तब रजजस्ट्री अिेदन और दस्ट्तािेजों को स्ट्कैन करेगी और आलक्ै राजनक पोटाल पर ऄपलोड करेगी ।

(3) एक बार ऄजधकरण का आलैक्राजनक पोटाल स्ट्थाजपत हो जाता ह,ै तब ऄजधकरण के सक्षम ईपजस्ट्थत होने िाल े जिजधक व्यिसायी और ईनके जलजपक स्ट्िंय को आलैक्राजनक पोटालें पर दजा करिायेंग े ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(4) आलैक्राजनक पोटाल तक पहुचं बनाने के जलए, सभी ईपयोगकताा स्ट्ियं को आलैक्राजनक पोटाल पद दजा करिाएंग े और एक यूज अइ डी और पासिडा प्राप्त करेंग े।

6. अिदे नों का प्रस्ट्ततु ीकरण और संिीक्षा.- (1) जनयम 4 के ईपजनयम (1) के ऄधीन रजजस्ट्रार या ईसके द्वारा प्राजधकृत ऄजधकारी प्रत्येक अिेदन पर ईस जतजथ को पष्ृ ांदकत करेगा जजसको िह प्रस्ट्तुत दकया गया ह ैया ईस जनयम के ऄधीन प्रस्ट्तुत दकया गया समझ गया ह ैऔर पष्ृ ांकन पर हस्ट्ताक्षर करेगा ।

(2) यदद संिीक्षा करने पर अिेदन सही पाया जाता है, तो ईसे सम्यक् रूप से रजजस्ट्रीकृत दकया जाएगा और कम संख्या प्रदान की जाएगी ।

(3) यदद संिीक्षा करने पर अिेदन त्रुरटपूणा पाया जाता ह ैऔर पाइ गइ त्रुरट औपचाररक प्रकृजत की ह,ै तो रजजस्ट्रार अिेदक को ईसकी ईपजस्ट्थजत म ेंईसे ठीक करने के जलए ऄनुज्ञात कर सकता ह ैऔर यदद ईि त्रुरट ऄनौपचाररक प्रकृजत की ह,ै तो रजजस्ट्रार अिदे क को त्रुरट को सही करन े के जलए तीस ददन का समय ऄनज्ञु ात कर सकता ह ै।

(4) जब कोइ अिेदन रजजस्ट्रीकृत डाक से प्राप्त होता ह,ै तो अिदे क को त्रुरटयां, यदद कोइ हों, सूजचत की जाएंगी और रजजस्ट्रार द्वारा अिेदक या ईसके प्राजधकृत ऄजभकताा को सूचना की जतजथ से तीस ददन से ऄनजधक ऄिजध के भीतर ईससे ईन्द्ह ेंठीक करने की ऄपेक्षा की जाएगी ।

(5) यदद अिेदक, ईपजनयम (3) और ईपजनयम (4) के ऄधीन ऄनुज्ञात समय के भीतर त्रुरट को ठीक करने म ें ऄसफल रहता ह,ै तो रजजस्ट्रार अदेि द्वारा और कारणों को लेखबद्ध करत े हुए अिेदन को रजजस्ट्टर करने स े आनकार कर सकता ह ैतथा समुजचत अदेिों के जलए मामले को न्द्यायपीठ के समक्ष प्रस्ट्ततु करेगा:

परंतु यह दक आलैक्राजनक रुप से फाआल दकए गए सभी अिेदनों की रजजस्ट्री में संिीक्षा की जाएगी और यदद कोइ कमी ह,ै तो इ-मेल के माध्यम से अिेदक को ऐसी समय-सीमा के भीतर जो रजजस्ट्रार द्वारा जनयत की जाए, सुधार हते ु संसूजचत दकया जाएगा और रजजस्ट्रार ईजचत और पयााप्त कारणों हते ु कजमयों को पूरा करने के जलए समय- जिस्ट्तार, जो िह ठीक समझे, कर सकेगा । परंतु ऄजधकतम ऄिजध 30 ददन से ऄजधक नहीं होगी और यदद ऐसे समय के भीतर कजमयों को पूरा नहीं दकया गया तो रजजस्ट्रार ऄजधकरण की संबद्ध न्द्यायपीठ के समक्ष ईजचत अदेि हते ु मामले को रख सकेगा।

7. अिदे न फाआल करन ेका स्ट्थान .- (1) कोइ अिेदन, दकसी अिदे क द्वारा न्द्यायपीठ के रजजस्ट्रार के समक्ष ऄजधकाररता के भीतर सामान्द्यत: िहां फाआल दकया जाएगा जहां, -

(i) तत्समय अिेदक तैनात ह;ै या

(ii) िाद का कारण, पूणात: या भागत: ईदभूत हुअ ह:ै परंतु यह दक ऄध्यक्ष की ऄनुमजत से अिेदन प्रधान न्द्यायपीठ के रजजस्ट्रार के पास फाआल दकया जा सकेगा और धारा 25 के ऄधीन अदेिों के ऄध्यधीन ऐसा अिेदन ऐसी न्द्यायपीठ के द्वारा सुना और जनपटाया जाएगा जजसके पास मामले पर ऄजधकाररता ह।ै

(2) ईपजनयम (1) में ऄंतर्मिि दकसी बात के होते हुए भी, ऐसे व्यजि जो सेिाजनिृजत्त, हटाए जाने या सेिाजनिृजत्त के कारण सेिा म ें नहीं बने रहत े ह ैं तो ईनके जिकल्प पर ऐसी न्द्यायपीठ के रजजस्ट्रार के पास अिेदन फाआल कर सकेगा जजसकी ऄजधकाररता में सामान्द्य रुप से अिेदन फाआल करते समय ऐसा व्यजि जनिास कर रहा ह।ै

8. अिदे न की फीस. - (1) प्रत्येक अिेदन रजजस्ट्रार के पास 50 रुपये की फीस के साथ या तो दकसी राष्ट्रीय बैंक पर दये मांग पत्र के रुप म ें संबद्ध न्द्यायपीठ के रजजस्ट्रार के पक्ष म ें और ईस बैंक की मुख्य िाखा पर देय जहा ं ईि िाखा का स्ट्थान ऄिजस्ट्थत ह ै या संबद्ध न्द्यायपीठ के रजजस्ट्रार के पक्ष में भारतीय पोस्ट्टल अडार के माध्यम से संदत्त और ईस न्द्यायपीठ जहां डाकघर ऄिजस्ट्थत ह,ै पर संदेय होगा:

परंत ु जहां ऄजधकरण या तो एक से ऄजधक व्यजियों या दकसी संगम द्वारा एक ही अिेदन फाआल करना ऄनुज्ञात करती ह ैिहां संदेय फीस 50 रुपये होगी: परंत ु यह और दक जहां ऄजधकरण का यह समाधान हो जाता ह ै दक कोइ अिेदक जनधानता के अधार पर जिजहत फीस का संदाय करने म ेंऄसमथा ह ैिहां िह ऐसे अिेदक को फीस के संदाय से छूट द ेसकेगा।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 5

(2) आलैक्राजनक रुप स े अिेदन फाआल करन े की दिा में फीस का संदाय आलैक्राजनक रुप से दकया जाएगा और आलैक्राजनक पोटला पर अिेदन की फीस और ऄन्द्य प्रभारों के ऑन-लाआन संदाय हते ु प्रसुजिधाएं होंगी: पंरत ु जहा ं दकसी कारण के जलए ऐसी सुजिधाएं ईपलब्ध नहीं ह ै िहां अिेदक को अिेदन फीस और िकालतनामा, ऄपेजक्षत स्ट्टांप चस्ट्पा सजहत, हते ु न्द्यायालय फीस स्ट्टांप की स्ट्कैन प्रजत ऄपलोड करनी होगी:

परंत ु यह और दक अिेदक को अिेदन की जांच के ऄंजतम होने से पूिा रजजस्ट्री म ें मूल रुप में अिेदन फीस के जलए िकालतनामा और स्ट्टांप प्रस्ट्तुत करना होगा ।

9. अिदे न की ऄतं िस्ट्ा त.ु- (1) आन जनयमों के ऄधीन फाआल दकए गए प्रत्येक अिेदन में ऐस े अिेदन हते ु अधारों को जभन्न जभन्न िीषों के ऄधीन संजक्षप्त रुप म ें लेखबद्ध दकया जाएगा और ऐसे अधारों को िमानुसार संख्यांदकत दकया जाएगा ।

(2) प्रत्येक अिेदन, जजसके ऄंतगता कोइ प्रकीण ा अिेदन भी ह,ै ऄच्छी गणु ित्ता के मोटे कागज पर एक ओर डबल स्ट्पेस म ेंटाआप दकया जाएगा : परंतु यह दक अिेदन को आलक्ै राजनक रुप में फाआल दकए जाने की दिा में अिेदन फाआल करने के अधारों को आलैक्राजनक पोटाल पर ईपलब्ध स्ट्तंभ म ेंप्रत्यक्षत: प्रजिि दकया जाएगा ।

(3) यदद मूल अिेदन में िही ऄनुरोध दकया गया ह ै तो दकसी ऄंतररम अदेि या जनदेि की िांछा हते ु पथृ क अिेदन प्रस्ट्ततु करना अिश्यक नहीं होगा ।

(4) आन जनयमों के ऄधीन कोइ अिेदन फाआल करने के पश्चातिती दकसी ऄंतररम अदेि या जनदेि हते ु कोइ अिेदन फाआल दकया जा सकेगा और ऐसा अिेदन प्ररुप 3 म ें होगा ।

(5) जहां कोइ अिेदन जिलंब को माफ करने के जलए ह,ै िहां िह िपथ पत्र द्वारा समर्मथत पथृ क अिेदन फाआल करेगा ।

10. अिदे न के साथ सलं ग्न दकए जान े िाल े दस्ट्तािजे . -(1) प्रत्येक अिेदन के साथ एक पेपर बुक संलग्न की जाएगी, जजसमें जनम्नजलजखत दस्ट्तािेज ऄंतर्मिि होंग,े ऄथाात् :-

(i) ऐसे अदेि की प्रमाजणत सही प्रजत जजसके जिरुद्ध अिेदन फाआल दकया गया ह;ै

(ii) अिेदक द्वारा जिश्वास रख ेजाने िाले और अिेदन म ेंजनर्ददि दस्ट्तािेजों की प्रजतयां;

(iii) दस्ट्तािेजों की ऄनुिमजणका ।

(2) ईपजनयम (1) में जनर्ददि दस्ट्तािेज या तो स्ट्ि:प्रमाजणत या दकसी जिजध व्यिसायी द्वारा प्रमाजणत या दकसी राजपजत्रत ऄजधकारी द्वारा प्रमाजणत दकए जा सकेंग े और प्रत्येक दस्ट्तािेज िम रुप स े ईपाबंध क1, ईपाबंध क2, ईपाबंध क3 और आसी प्रकार जचजन्द्हत दकए जाएंग े ।

(3) जहा ं कोइ अिेदन दकसी ऄजभकताा द्वारा फाआल दकया जाता ह ै तो िहां ईसे ऄजभकताा के रुप में काया करने हते ु प्राजधकृत करन े िाल ेदस्ट्तािेज भी अिेदन के साथ सलं ग्न दकए जाएंगे : परंत ु जहां कोइ अिेदन दकसी जिजध व्यिसायी द्वारा फाआल दकया गया ह ै या दकया जाता ह ै िहां आसके साथ सम्यक रुप से जनष्पाददत “िकालतनामा” संलग्न दकया जाएगा । परंत ु यह और दक आलैक्राजनक रुप स े अिेदन फाआल करन े की दिा म ें अिेदन या याजचका के साथ फाआल दकए जान े िाल े दस्ट्तािेज पक्षकारों द्वारा आलैक्राजनक पोटाल के माध्यम स े स्ट्कैलनग करके और ऄपलोड करके फाआल दकए जाएंगे ।

11. बहु-ईपचार.- कोइ अिेदन एकलिाद कारण पर अधाररत होगा और यदद ि े एक दसू रे के पररणामी ह ै तो एक या ऄजधक ईपचार मांग ेजा सकेंग े।

12. नोरटस की तामील और ऄजधकरण द्वारा जारी अदेजिकाएं । (1) ऄजधकरण द्वारा जारी दकए जाने िाल े नोरटस और अदेजिकाओं की तामील जनम्नजलजखत म ेंसे दकसी एक पद्धजत द्वारा की जा सकेगी –

(i) पक्षकार द्वारा स्ट्ियं तामील के िपथ पत्र और ऄजभस्ट्िीकृजत सजहत;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(ii) प्रोसेस सिार के माध्यम से हस्ट्त पररदान (दस्ट्ती) द्वारा;

(iii) सम्यक ऄजभस्ट्िीकृजत सजहत रजजस्ट्रीकृत डाक द्वारा;

(iv) ईपरोि खडं (i) स े खंड (iii) म ें जनर्ददि दकसी एक या ऄजधक पद्धजतयों द्वारा संबद्ध जिभागाध्यक्ष के माध्यम से । पंरतु यह दक यदद ऄजधकरण तामील की पद्धजत जिजनर्ददि नहीं करता ह ै तो नोरटस “सम्यक ऄजभस्ट्िीकृजत सजहत” रजजस्ट्रीकृत डाक द्वारा भेजा जा सकेगा और तामील की ऐसी पद्धजत को जसजिल प्रदिया संजहता, 1908 (केंरीय ऄजधजनयम, 1908 का 5) की प्रथम ऄनुसूची के अदिे 5 के जनयम 19क के ईपजनयम (2) के ईपबंध लाग ू होंगे ।

(2) जब ऄजधकरण द्वारा जारी नोरटस की पक्षकार द्वारा स्ट्िय ं दस्ट्ती तामील की जाती ह ै तब िह तामील के िपथ पत्र के साथ ऄजभस्ट्िीकृजत रजजस्ट्री के पास फाआल करेगा ।

(3) ईपजनयम (1) में ऄंतर्मिि दकसी बात के होते हुए भी, ऄजधकरण प्रत्यर्मथयों की संख्या और ईनके जनिास के स्ट्थानों तथा ऄन्द्य पररजस्ट्थजतयों को ध्यान म ें रखत े हुए जनदेि द े सकेगा दक अिेदन के नोरटस की दकसी ऄन्द्य रीजत में जो ऄजधकरण को न्द्यायोजचत और सुजिधाजनक प्रतीत हो, प्रत्यर्मथयों पर तामील की जाएगी जजसके ऄंतगता कोइ पररिर्मतत तामील की रीजत भी ह ै।

(4) ईपजनयम (1) म ें ऄंतर्मिि दकसी बात के होत े हुए भी, ऄजधकरण मामल े की प्रकृजत और ऄत्यािश्यकता को जिचार में लेत े हुए, ऄपन े जििेकानुसार, हररयाणा सरकार के दकसी जिभाग या संगठन या हररयाणा सरकार द्वारा जनयंजत्रत या ईसके स्ट्िाजमत्ि म ें दकसी प्राजधकरण, दकसी जनगम, दकसी जनकाय के जलए तामील स्ट्िीकार करन े के जलए प्राजधकृत स्ट्थायी ऄजधििा पर नोरटस की तामील करने के जनदेि दे सकेगा ।

(5) ऄजधकरण द्वारा जारी प्रत्येक नोरटस के साथ, जब तक ऄन्द्यथा अदेि न दकया जाए, अिेदन की एक प्रजत और जििाददत अदेि की एक प्रजत तथा पेपर बुक की एक प्रजत संलग्न की जाएगी ।

(6) प्रत्येक अिेदक दकसी अिेदन के संबंध में अदेजिकाओं के जनष्पादन की तामील के जलए फीस का संदाय, जहां प्रत्यर्मथयों की संख्या पांच से ऄजधक हो, जनम्न प्रकार करेगा :-

(i) पांच से ऄजधक प्रत्यर्मथयों के जलए प्रत्येक प्रत्यथी हते ु पांच रुपये की राजि ; या

(ii) जहां तामील ऐसी रीजत म ें ह ै जो ऄजधकरण ईप जनयम (3) के ऄधीन जनदेि करे िहां तामील को प्रभािी करने म ें ऄसल में ईपगत हुए प्रभायों से ऄजधक ऐसी राजि न हो, जो ऄजधकरण द्वारा ऄिधाररत की जाए ।

(7) ईपजनयम (3) के ऄधीन अदेजिकाओं के जनष्पादन या तामील के जलए फीस, ऐसी फीस ऄिधाररत करने की तारीख स े एक सप्ताह के भीतर जनयम 8 में जिजहत रीजत म ें प्रेजषत की जाएगी या ऐसी जिस्ट्ताररत समय सीमा के भीतर जो रजजस्ट्री ऄनज्ञु ात करे ।

(8) ईपजनयम (1) से ईपजनयम (4) में ऄंतर्मिि दकसी बात के होते हुए भी, यदद ऄजधकरण का यह समाधान हो जाता ह ै दक सभी प्रत्यर्मथयों पर अिेदन के नोरटस की तामील युजियिु रुप से व्यिहाया नहीं है, तो यह लेखबद्ध दकए जान े िाल े कारणों के जलए जनदेि द े सकेगी दक अिेदन कुछ प्रत्यर्मथयों पर अिेदन की नोरटस की तामील के न होत े हुए भी अिेदन की सनु िाइ की जाएगी :

परंत ु कोइ अिेदन तब तक नहीं सुना जाएगा, जब तक,--

(i) अिेदन की नोरटस केन्द्रीय सरकार या राज्य सरकार को तामील करा दी गइ है, यदद ऐसी सरकार प्रत्यथी ह ै;

(ii) अिेदन की सूचना प्राजधकरण को तामील कर दी गइ ह,ै जजसने ऐसा अदेि पाररत दकया था, जजसके जिरुद्ध अिेदन फाआल दकया गया ह ै ; और

(iii) प्राजधकरण संतिु ह ै दक प्रत्यथी के जहत में, जजस पर अिेदन की सूचना की तामील नहीं की गइ ह,ै ऄभ्यर्मथयों द्वारा यथोजचत और पयााप्त रूप से प्रजतजनजधत्ि दकया गया है, जजस पर अिेदन की नोरटस तामील की गइ ह ै।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 7

(9) आस जनयम में ऄंतर्मिि दकसी बात के होते हुए भी, अिेदन को आलैक्रॉजनक रूप में फाआल करने की दिा में, ऄजधकरण द्वारा जारी कोइ नोरटस या अदेजिका, जहां तक संभि हो, आलैक्रॉजनक रूप में तामील की जाएगी ; जब आलैक्रॉजनक डॉक का पता ज्ञात न हो, तब नोरटस या अदेजिका की तामील ईपजनयम (1) के ऄनुसार की जाएगी ।

13. प्रत्यर्मथयों द्वारा ईत्तर या ऄन्द्य दस्ट्तािजे ों का फाआल दकया जाना.- (1) अिेदन का प्रजतिाद करने का अिय रखन े िाले प्रत्येक प्रत्यथी, ईस पर अिेदन के नोरटस की तामील एक महीने के भीतर, रजजस्ट्री के साथ, पेपर बुक प्ररूप म,ें ईस पर जिश्वास दकए गए अिदे न और दस्ट्तािेज के ईत्तर को तीन प्रजतयों म ेंफाआल करेगा :

परंत ु आलैक्रॉजनक रूप म ें फाआल दकए जान े की दिा में, प्रत्यर्मथयों द्वारा फाआल दकए गए ईत्तरों और कथन तथा आसके साथ फाआल दकए जाने िाले दस्ट्तािेजों को, यदद कोइ हों, ऐस े ईत्तरों को आलैक्रॉजनक पोटाल के माध्यम से फाआल दकए जाएंगे और ऐसी दिा म,ें ऐसे ईत्तर के फाआल दकए जान े के सबं ंध म ें संदेि, रजजस्ट्री के द्वारा अिेदकों और प्रत्यर्मथयों को ददए जाएंगे और आसके पश्चात् अिेदक और ऄन्द्य प्रत्यथी आलैक्रॉजनक पोटाल से ईत्तर तक पहुचं सकते ह ैं।

(2) ईपजनयम (1) के ऄधीन फाआल दकए गए ईत्तर में, प्रत्यथी जििेष रूप से अिेदक द्वारा ऄपन े अिेदन म ें कजथत तथ्यों को स्ट्िीकार करेगा, ऄस्ट्िीकार करेगा या ईनका स्ट्पिीकरण दगे ा और ऐसे ऄन्द्य ऄजतररि तथ्यों का कथन भी कर सकता ह,ै जो मामले के न्द्यायसंगत जिजनश्चय के जलए अिश्यक समझे जाएं ।

(3) ये जसजिल प्रदिया संजहता, 1908 (1908 का 5) के जनयम 15, अदेि 6 में यथा ईपबंजधत ईसी रीजत में जलजखत में प्रजतिादी या ईसके द्वारा सम्यक् रूप से प्राजधकृत दकसी ऄन्द्य व्यजि द्वारा जलजखत कथन के रूप म ें हस्ट्ताक्षररत और सत्याजपत दकए जाएंगे ।

(4) ईपजनयम (1) में जनर्ददि दस्ट्तािेजों को भी ईत्तर के साथ फाआल दकया जाएगा और ईन्द्ह ें अर 1, अर 2, अर 3 और आसी प्रकार जचन्द्हांदकत दकया जाएगा ।

(5) प्रत्यथी, ईपजनयम (1) म ें यथा ईजल्लजखत दस्ट्तािेजों के साथ ईत्तर की एक प्रजत, यथाजस्ट्थजत, अिेदक या ईसके ऄजभकताा या जिजध व्यिसायी को, यदद कोइ हो, तामील करेगा और ऐस े तामील के सबूत को रजजस्ट्री म ें फाआल करेगा ।

(6) ऄजधकरण, जिजहत ऄिजध की समाजप्त के पश्चात,् ईत्तर को फाआल करने को ऄनज्ञु ात कर सकता है ।

(7) ऄजधकरण, पक्षकारों को ऄजभिचन को संिोजधत करने के जलए ईसी रीजत में, जैसा जसजिल प्रदिया संजहता, 1908 (1908 का 5) के अदेि 6, जनयम 17 के ऄधीन यथा ईपबंजधत ह,ै ऄनुज्ञात कर सकता ह ै।

14. अिदे क द्वारा प्रत्यत्तु र और दस्ट्तािजे ों का फाआल दकया जाना.- आलैक्रॉजनक रूप म ें फाआल दकए जाने की दिा म,ें अिेदक द्वारा फाआल दकए गए प्रत्युत्तर और आसके साथ फाआल दकए जाने िाले दस्ट्तािेज को, यदद कोइ हो, ऐसे प्रत्युत्तरों को, आलैक्रॉजनक पोटला के माध्यम स े फाआल दकए जाएंगे और ऐसी दिा में, ऐसे प्रत्युत्तर फाआल दकए जान े के संबंध में संदेि, रजजस्ट्री द्वारा प्रत्यर्मथयों को ददए जाएंगे और आसके पश्चात ् प्रत्यथी आलैक्रॉजनक पोटाल से ईत्तर तक पहुचं सकते ह ैं।

15. सनु िाइ की तारीख और स्ट्थान का ऄजधसजू चत दकया जाना.- ऄजधकरण, पक्षकारों को अिेदन की सुनिाइ की तारीख और स्ट्थान को ऐसी रीजत से ऄजधसूजचत करेगा, जैसे ऄध्यक्ष साधारण या जििेष अदिे द्वारा जनदेि करे ।

16. ऄजधकरण की बठै क.- ऄजधकरण, अम तौर पर ऄपनी बैठक पचं कुला में करेगी : परंत ु यदद दकसी समय, ऄजधकरण का ऄध्यक्ष संतिु ह ै दक ऐसी पररजस्ट्थजतयां जिद्यमान हैं, जजसमें ऄजधकरण की बैठक पंचकुला के ऄजतररि दकसी स्ट्थान पर करना अिश्यक ह,ै तब ऄध्यक्ष हररयाणा राज्य म ेंदकसी ऄन्द्य ईजचत स्ट्थान पर बैठक करने को जनदेजित कर सकता ह ै।

17. मामलों का कैलडें र.- (1) प्रत्येक न्द्यायपीठ ऄंतररत मामलों की सुनिाइ के जलए कैलडें र बनाएगी और जहां तक संभि हो, मामलों की सनु िाइ और जिजनश्चय कैलडें र के ऄनुसार करेगी ।

(2) प्रत्यके अिेदन की सुनिाइ और जिजनश्चय, जहा ं तक संभि हो, ईसके रजजस्ट्रीकरण की तारीख स े छह मास के भीतर दकया जायेगा ।

(3) ऄजधकरण को स्ट्थगन अदेि को मना करने और मौजखक तका के जलए समय सीजमत करन े की भी िजि होगी ।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

18. अिदे क के व्यजतिम के जलए अिदे न पर कारािाइ.- (1) जहां दकसी अिेदन की सुनिाइ के जलए जनयत तारीख को या दकसी ऄन्द्य तारीख को, जजसको ऐसी सुनिाइ स्ट्थजगत की जाए, अिेदक ईपजस्ट्थत नहीं होता ह,ै तो अिेदन पर सुनिाइ और जिजनश्चय कर सकेगा । जब सुनिाइ के जलए समय मांगा जाता है, तो िहां ऄजधकरण ऄपन े जििेक से या तो व्यजतिम के जलए अिेदन खाररज कर सकता ह.ै मैररट पर सुन सकता ह ैया जिजनश्चय कर सकता ह ै।

(2) जब दकसी अिेदन को व्यजतिम के जलए खाररज कर ददया गया ह ै और अिेदक न े खाररज करने की -तारीख से तीस ददन की ऄिजध के भीतर अिेदन दायर दकया ह ै और ऄजधकरण का यह समाधान कर ददया ह ै दक जब अिेदन पर सुनिाइ की जानी थी, तब ईसके ऄनुपजस्ट्थत होने के पयााप्त कारण थे, तो ऄजधकरण अदेि को खाररज करने के अदेि को ऄपास्ट्त करने का अदिे करेगा और अिेदन को पुन: बहाल करेगा :

परन्द्तु मामले को गणु ािगणु के अधार पर जनपटाए जाने की दिा में, जिजनश्चय पर, पुनरीक्षण के जसिाय, पुनः जिचार नहीं दकया जायेगा ।

19. एकपक्षीय सनु िाइ और अिदे न का जनपटान.- (1) जब अिेदन की सुनिाइ के जलए जनयत तारीख को या दकसी ऄन्द्य तारीख को, जजसके जलए सुनिाइ स्ट्थजगत की जाए, अिेदक ईपजस्ट्थत होता ह ै और प्रजतिादी तब ईपजस्ट्थत नहीं होता ह,ै जब अिेदन पर सुनिाइ की जानी ह,ै तब ऄजधकरण ऄपन ेजििेक से सुनिाइ को स्ट्थजगत कर सकता ह ै या अिेदन एकपक्षीय रूप से सुन सकता ह ैतथा जिजनश्चय कर सकता ह ै।

(2) जब दकसी अिेदन पर दकसी प्रजतिादी या प्रजतिाददयों के जिरुद्ध एकपक्षीय रूप से सुनिाइ की गइ हैं, तब प्रजतिादी अदेि की तारीख से तीस ददन के भीतर ऄजधकरण को ईस े ऄपास्ट्त करन े का अदिे करन े के जलए अिेदन कर सकता ह ै और यदद ऐसा प्रजतिादी ऄजधकरण का यह समाधान कर देता ह ै दक नोरटस की सम्यक् रूप से तामील नहीं की गइ थी या दक ईसे या ईन्द्ह ें दकसी पयााप्त कारण से ईपजस्ट्थत होने से जनिाररत दकया गया था, जब अिेदन पर सुनिाइ की जानी थी, तो ऄजधकरण ईनके जिरुद्ध एकपक्षीय अदिे को ऐसे जनबंधनों पर, जो िह ईजचत समझ,े ऄपास्ट्त करन े का अदिे कर सकता ह ै और अिेदन पर कायािाही करन े के जलए कोइ ददन जनयत कर सकता ह ै:

परन्द्त ु दकसी अिेदन पर एकपक्षीय अदिे ऐसी प्रकृजत का ह ै दक आस े केिल एक प्रजतिादी के जिरुद्ध ऄपास्ट्त नहीं दकया जा सकता ह ैतो आसे सभी या दकन्द्हीं ऄन्द्य प्रजतिाददयों के जिरुद्ध भी ऄपास्ट्त दकया जा सकता ह ै:

परन्द्त ु यह और दक जनयम 12 के ईपजनयम (8) म ें अन े िाल े मामलों की दिा में, ऄजधकरण केिल आस अधार पर दकसी अिेदन पर दकए गए एकपक्षीय अदेि को ऄपास्ट्त नहीं करेगा दक आसकी प्रजतिादी या प्रजतिाददयों पर तामील नहीं की गइ थी ।

20. पनु रीक्षण के जलए अिदे न.- (1) पुनरीक्षण के जलए दकसी अिेदन को तब तक ग्रहण नहीं दकया जाएगा, जब तक ईस े ईस अदेि, जजसके जिरुद्ध पुनरीक्षण की मांग की गइ ह,ै की प्रजत के प्राप्त होने की तारीख से तीस ददन के भीतर फाआल नहीं दकया गया ह।ै

(2) साधारणतया दकसी पुनरीक्षण अिेदन की सुनिाइ ईसी न्द्यायपीठ दारा की जाएगी, जजसने अदिे पाररत दकया ह,ै जब तक दक ऄध्यक्ष कारणों को लेखबद्ध करत े हुए ईसकी दकसी ऄन्द्य न्द्यायपीठ द्वारा सुनिाइ का जनदेि न करें ।

(3) जब तक संबंजधत न्द्यायपीठ द्वारा ऄन्द्यथा अदेि न दकए गए हों, दकसी पुनरीक्षण अिेदन का जनपटान पररचालन द्वारा दकया जाएगा और न्द्यायपीठ या तो अिेदन को खाररज कर देगी या जिरोधी पक्ष को नोरटस देने का जनदिे करेगी ।

(4) जब दकसी न्द्याय जनणाय या अदेि के पुनरीक्षण के जलए अिदे न दकया गया ह ै और ईसका जनपटान कर ददया गया ह.ै तो ईसी रीजत म ेंपुनरीक्षण के जलए दकसी और अिेदन पर जिचार नहीं दकया जाएगा ।

(5) पुनरीक्षण के जलए दकसी अिदे न पर तब तक जिचार नहीं दकया जाएगा, जब तक िह सम्यक् रूप से सिपथ िपथपत्र द्वारा समर्मपत न हो, जजसमे जानकारी के स्रोत, िैयजिक या ऄन्द्यथा और िह अधार भी ऄंतर्मिि हों, जो जिजधक सलाह पर सिपथ अधाररत हो ।

(6) पुनरीक्षण अिेदन म ें प्रजत िपथपत्र सम्यक् रूप से सिपथ िपथपत्र भी होगा, जब कभी दकसी तथ्य का कोइ प्रमाण जििाददत हो ।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 9

21. जिजधक प्रजतजनजधयों को प्रजतस्ट्थापन.- (1) ऄजधकरण के समक्ष लंजबत कायािाजहयों के दौरान दकसी पक्षकार की मृत्य ु की दिा म,ें मृतक पक्षकार के जिजधक प्रजतजनजध ऐसी मृत्यु की तारीख से नब्बे ददन के भीतर अिश्यक पक्षकार के रूप में ऄजभलेख पर लाए जाने के जलए अिेदन कर सकत े ह ैं।

(2) जहां ईपजनयम (1) म े जिजनर्ददि ऄिजध के भीतर जिजधक प्रजतजनजधयों से कोइ अिेदन प्राप्त नहीं होता है, िहां मृतक पक्षकार के जिरुद्ध कायािाजहयों का ईपिमन हो जाएगा : परन्द्त ु ऄच्छे और पयााप्त कारणों से ऄजधकरण दकसी अिेदन पर ईपिमन के अदेि को ऄपास्ट्त कर सकता ह ैऔर जिजधक प्रजतजनजधयों का प्रजतस्ट्थापन कर सकता ह ै।

22. सनु िाइ का स्ट्थगन. - ऄजधकरण, यदद सुनिाइ के दकसी प्रिम पर पयााप्त कारण ईपदर्मित दकए जाते है तो, पक्षकारों या ईनमें स े दकसी पक्षकार को समय प्रदान कर सकता ह ै तथा अिेदन की सुनिाइ को स्ट्थजगत कर सकता ह ै । ऄजधकरण स्ट्थगन द्वारा काररत लागत की बाबत ऐसा अदेि कर सकता ह,ै जो िह ठीक समझे ।

23. अदेि पर हस्ट्ताक्षर होना और तारीख होना.- (1) ऄजधकरण के प्रत्येक अदेि पर ईस न्द्यायपीठ का गठन करने िाले सदस्ट्य या सदस्ट्यों द्वारा हस्ट्ताक्षर दकए जाएंगे, जजसने अदेि सुनाया था: परंतु जब अदेि जडजजटल प्रारूप में तैयार दकए जाते हैं, तो ईस पर ऐसे सदस्ट्यों द्वारा जडजजटल हस्ट्ताक्षर का ईपयोग करके हस्ट्ताक्षर दकए जाएंगे।

(2) अदेि खुले न्द्यायालय में सुनाया जायेगा।

(3) सभी मामलों में ऄजधकरण द्वारा पाररत ऄंजतम अदेि और ऄंतररम अदेि सािाजजनक डोमेन में आलेक्रॉजनक पोटाल में प्रकाजित दकए जाएंगे।

24. अदेिों का प्रकािन.- (1) ऄजधकरण ऄपने जिजनश्चय प्रकाजित कर सकता ह ै जो "आंजडयन लॉ ररपोटा हररयाणा प्रिासजनक ऄजधकरण …..20..." नामक ररपोटा में प्रकािन के जलए ईपयुि समझा गया हैं।

(2) ऄजधकरण के ऐसे अदेि जो दकसी ऄन्द्य अजधकाररक ररपोटा या प्रेस में प्रकािन के जलए ईपयुि समझे जाएं, ऐसे जनबंधन और ितों पर प्रकािन के जलए जारी दकए जा सकते हैं, जैसा दक ऄध्यक्ष साधारण या जििेष अदेि द्वारा जनर्ददि कर सकते ह।ैं

25. पक्षकारों के जलए अदेिों की ससं ूचना.- (1) ऄंतररम राहत और ऄंजतम अदेि देने या ऄस्ट्िीकार करने या ईपांतररत करने िाला प्रत्येक ऄंतररम अदेि अिेदक और संबंजधत प्रजतिादी या ईनके परामिा देने िालों को, या तो हाथ से या डाक द्वारा, जनःिुल्क भेजा जाएगा:

परंतु जब तक दकसी न्द्यायपीठ द्वारा ऄन्द्यथा अदेि न ददया जाए, ऄंजतम अदेि की प्रजत दकसी भी प्रजतिादी को भेजने की अिश्यकता नहीं ह ैजजसने ईपजस्ट्थजत में प्रिेि नहीं दकया ह:ै परंतु यह और दक जब ऄजधकरण के अदेि जडजजटल प्रारूप में जारी दकए जाने हैं, ईन्द्ह ें ऄजधकृत ऄजधकारी द्वारा ऄपने जडजजटल हस्ट्ताक्षर करने के पश्चात पक्षकारों को आलेक्रॉजनक रूप से सूजचत दकया जाएगा और ईपरोि के रूप में आलेक्रॉजनक रूप से हस्ट्ताक्षररत और संप्रेजषत अदिे ों को माना जाएगा जैसा दक अदेि की ऄजधप्रामाजणक प्रजत और ऄजधकरण और ऄन्द्य प्राजधकाररयों के समक्ष अगे के कदम ईठाने के जलए पयााप्त होगी और यह भी दक ऑडार में ददए गए आलेक्रॉजनक ललक पर जक्लक करके ऑडार की प्रामाजणकता को कोइ भी प्राप्तकताा या प्राजधकारी आसे सत्याजपत कर सकता ह ै।

(2) यदद अिेदक या दकसी कायािाही के प्रजतिादी को दकसी दस्ट्तािेज़ या कायािाही की एक प्रजत की अिश्यकता है, तो ईसे ऐसी फीस के भुगतान पर ऐसे जनबंधन और ितों पर प्रदान की जाएगी, जैसा दक ऄध्यक्ष के साधारण या जििेष अदेि द्वारा तय दकया जा सकता है।

26. ररकॉडा का जनरीक्षण.- (1) दकसी भी मामले के पक्षकारों या ईनके परामिा देने िालों को रजजस्ट्रार को जलजखत रूप में अिेदन करने पर मामले के ररकॉडा का जनरीक्षण करने की ऄनुमजत दी जा सकती है।

(2) ऐसे जनबंधन और ितों के ऄधीन, जो ऄध्यक्ष द्वारा साधारण या जििेष अदेि द्वारा जनर्ददि दकए जा सकते हैं, एक व्यजि जो कायािाही में एक पक्ष नहीं है, ईसे भी रजजस्ट्रार की जलजखत ऄनुमजत प्राप्त करने के पश्चात कायािाही का जनरीक्षण करने की ऄनुमजत दी जा सकती है।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

27. कजतपय मामल े म ें अदेि और जनदेि.- ऄजधकरण ऐसे अदेि दे सकता ह ै या ऐसे जनदेि दे सकता है, जो ईसके अदेि को प्रभािी बनाने या ईसकी प्रदिया के दरुु पयोग को रोकने या न्द्याय के ईद्देश्य को सुरजक्षत करने के जलए अिश्यक या समीचीन हो।

28. जिजधक व्यिसायी के जलजपक का रजजस्ट्रीकरण.- (1) जिजधक व्यिसायी द्वारा जनयोजजत कोइ भी जलजपक ऄजधकरण में ऐसे काया नहीं करेगा या ईसे ररकॉडा तक पहुंचने और ऄजधकरण की ईस न्द्यायपीठ के अदेिों की प्रजतयां प्राप्त करने की ऄनुमजत नहीं दी जाएगी जजसमें जिजधक व्यिसायी साधारणतया प्रैजक्टस करता ह ै जब तक दक ईसका नाम आसमें दजा नहीं दकया जाता है, ईि न्द्यायपीठ द्वारा बनाए गए जलजपकों का रजजस्ट्टर रखरखाि दकया जाएगा और ऐसे जलजपक को रजजस्ट्रीकृत जलजपक के रूप में जाना जाएगा।

(2) ऄपने जलजपक को रजजस्ट्रीकृत करने का आच्छुक जिजधक व्यिसायी से प्ररूप 4 में रजजस्ट्रार को एक अिेदन करने की िांछा की जाएगी और रजजस्ट्रार द्वारा ऐसे अिेदन की ऄनुमजत ददए जाने पर, ईसका नाम जलजपकों के रजजस्ट्टर में दजा दकया जाएगा।

(3) जलजपक के रजजस्ट्रीकरण के पश्चात, रजजस्ट्रार ईसे एक पहचान पत्र जारी करने का जनदेि देगा जो गैर- हस्ट्तातं रणीय होगा और आस संबंध में ऄजधकृत ऄजधकरण के दकसी ऄजधकारी या ऄन्द्य कमाचारी के ऄनुरोध पर धारक द्वारा प्रस्ट्तुत दकया जाएगा और पहचान पत्र संबंजधत न्द्यायपीठ के ईप रजजस्ट्रार के हस्ट्ताक्षर के ऄधीन जारी दकया जाएगा।

(4) ईप-जनयम (3) के ऄधीन रजजस्ट्रीकृत सभी जलजपकों का एक रजजस्ट्टर प्रत्येक न्द्यायपीठ के रजजस्ट्रार के कायाालय में रखा जाएगा

(5) एक जिजधक व्यिसायी के पास एक समय में दो से ऄजधक रजजस्ट्रीकृत जलजपक नहीं होंगे, जब तक दक साधारण या जििेष अदेि द्वारा रजजस्ट्रार ऄन्द्यथा ऄनुमजत न दे।

(6) जब भी एक जिजधक व्यिसायी एक रजजस्ट्रीकृत जलजपक को जनयुि करना बंद कर देता है, िह रजजस्ट्री द्वारा ऄपने जलजपक को जारी दकए गए पहचान पत्र के साथ एक पत्र के माध्यम से रजजस्ट्रार को तुरंत तथ्य सूजचत करेगा, और ऐसे पत्र की प्राजप्त पर, ईि रजजस्ट्रीकृत जलजपक का नाम रजजस्ट्टर से हटा ददया जाएगा।

29. ऄजधकरण के काय ा घटं े.- िजनिार, रजििार और ऄन्द्य सािाजजनक ऄिकािों को छोड़कर, ऄजधकरण का कायाालय, ऄध्यक्ष द्वारा दकए गए दकसी भी अदेि के ऄधीन, सुबह 9.00 बजे से िाम 5.00 बजे तक खुला रहगे ा।

30. ऄजधकरण के बठै न े के घटं े.- ऄजधकरण के बैठने के घंटों (एक ऄिकाि न्द्यायपीठ सजहत) के साधारणतया सुबह

10.00 बजे से दोपहर 1.00 बजे तक और दोपहर 2.00 बजे से िाम 4.30 बजे तक ऄध्यक्ष द्वारा दकए गए दकसी भी साधारण या जििेष अदेि के ऄधीन हो।

31. रजजस्ट्रार की िजिया ं और काया.- (1) रजजस्ट्रार के पास ऄजधकरण के ऄजभलेखों की ऄजभरक्षा होगी और आन जनयमों के ऄधीन या ऄध्यक्ष या संबंजधत न्द्यायपीठ के ईपाध्यक्ष या पृथक अदेि द्वारा ईसे सौंपे गए ऄन्द्य कायों का प्रयोग करेगा।

(2) ऄध्यक्ष या संबंजधत न्द्यायपीठ के ईपाध्यक्ष के ऄनुमोदन से, आन जनयमों के जलए अिश्यक कोइ काया या िजि, जो रजजस्ट्रार द्वारा जनष्पाददत या प्रयोग करने के जलए अिश्यक है,

(3) रजजस्ट्रार,ईप-रजजस्ट्रार, या कोइ भी ऄन्द्य ऄजधकारी,की ऄनुपजस्ट्थजत में यथाजस्ट्थजत, जजनके पास ऄध्यक्ष या ईपाध्यक्ष द्वारा प्रत्यायोजजत की जाती हैं, रजजस्ट्रार द्वारा िजियों और कृत्यों का प्रयोग कर सकते ह।ैं (4 ) अजधकाररक मुहर रजजस्ट्रार की ऄजभरक्षा में रखी जाएगी।

(5) ऄध्यक्ष द्वारा दकसी भी साधारण या जििेष जनदेि के ऄधीन, ऄजधकरण की मुहर दकसी भी ऄन्द्य अदेि, समन या ऄन्द्य प्रदिया के जलए रजजस्ट्रार या ईप रजजस्ट्रार के जलजखत रूप में प्राजधकरण के ऄनुसार नहीं होनी चाजहए।

(6) ऄजधकरण की मुहर रजजस्ट्रार या ईप- रजजस्ट्रार द्वारा जलजखत रूप में प्राजधकरण के ऄधीन जारी की गइ प्रमाजणत प्रजत जनयत नहीं की जाएगी।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 11

32. रजजस्ट्रार की ऄजतररि िजिया ं और कतव्या .- आन जनयमों ऄन्द्यत्र प्रदत्त िजियों के ऄजतररि,रजजस्ट्रार के पास जनम्नजलजखत िजियां और कताव्य होंगे, जो संबंजधत न्द्यायपीठ के ऄध्यक्ष के या ईपाध्यक्ष के दकसी भी साधारण या जििेष अदेि ऄधीन होंगे, ऄथाता ् :-

(i) प्रत्येक अिेदन और ऄन्द्य दस्ट्तािेज प्राप्त करने के जलए जजसमें स्ट्थानांतररत अिेदन सजम्मजलत है;

(ii) अिेदन के रजजस्ट्रीकृत होने से पहले ईसकी संिीक्षा से ईत्पन्न प्रत्येक प्रश्न का जिजनश्चय करना;

(iii) ऄजधकरण में प्रस्ट्तुत दकसी भी अिेदन को ऄजधजनयम और जनयमों के ऄनुसार संिोजधत करने की अिश्यकता है;

(iv) अिेदनों या ऄन्द्य कायािाही की तारीख या पहली सुनिाइ तय करने और संबंजधत न्द्यायपीठों के जनदेि के ऄधीन, ईसके नोरटस जारी करने के जलए:

(v) ऄजभलेखों के दकसी भी औपचाररक संिोधन को जनदेजित करने के जलए;

(vi) कायािाही के पक्षकारों को दस्ट्तािेजों की प्रजतयों की प्रजतयां प्रदान करने का अदेि देना;

(vii) ऄजधकरण के ऄजभलेखों का जनरीक्षण करने के जलए ऄिकाि देना;

(viii) नोरटस या ऄन्द्य प्रदियाओं की सेिा से संबंजधत सभी मामलों का जनपटान करना, नए नोरटस जारी करने के जलए अिेदन या ऐसे अिेदन फाआल करने के जलए समय बढाने के जलए, ईत्तर फाआल करने के जलए तीस ददन से ऄजधक का समय नहीं देना या यदद कोइ हो, और मामले को न्द्यायपीठ के समक्ष ईजचत के जलए रखना पुिोि ऄिजध की समाजप्त के पश्चात अदेि;

(ix) दकसी न्द्यायालय या ऄन्द्य प्राजधकारी की ऄजभरक्षा स ेऄजभलेख का ऄनुरोध करना ;

(x) अिेदन के लंजबत रहने के दौरान मतृ पक्षकारों के जिजधक प्रजतजनजधयों के प्रजतस्ट्थापन हते ु मत्ृ यु की तारीख से नब्बे ददन के भीतर अिेदन प्राप्त करना ;

(xi) जसिाए िहां, जहां प्रजतस्ट्थापन में ईपिमन के दकसी अदेि को ऄपास्ट्त करना ऄंतिाजलत नहीं है, प्रजतस्ट्थापन के जलए अिेदन प्राप्त करना और ईनका जनपटारा करना ;

(xii) दस्ट्तािेजों की िापसी के जलए पक्षकारों द्वारा अिेदन प्राप्त करना और ईनका जनपटारा करना ; और

(xiii) ऄध्यक्ष के ऄनुमोदन स,े समय-समय पर, अिेदन फाआल करन े के जलए ऄनुसरण की जाने िाली प्रदियाओं, नोरटस या अदेजिका जारी करन,े ईत्तर कथन और प्रत्युत्तर फाआल करने, सुनिाइ के जलए मामलों का कलेंडर सृजजत करने, अदेिों की संसूचनाओं, ईपयोिाओं का आलैक्रॉजनक रजजस्ट्रीकरण करन े से संबंजधत तकनीकी पहलओंू पर गौण पररितान, यदद कोइ हों, करना ।

33. प्रधान न्द्यायपीठ के रजजस्ट्रार की ऄजतररि िजियां.- प्रधान न्द्यायपीठ के रजजस्ट्रार को साधारण या जििेष अदेिों के ऄधीन, जो ऄध्यक्ष द्वारा समय-समय पर जारी दकए जाए,ं सूचना और ऄजभलेख मंगाने, ऄन्द्य न्द्यायपीठों की रजजस्ट्टरी का जनरीक्षण करन े या जनरीक्षण करिान े की िजि होगी ।

34. मरु ा और प्रतीक.- ऄजधकरण की िासकीय मुरा और प्रतीक ऐसे होंगे, जो केन्द्रीय सरकार, जिजनर्ददि करे ।

35. ऄजधकरण के सदस्ट्यों और कमचा ाररिन्द्ृ द की पोिाक.- ऄजधकरण के सदस्ट्यों (ऄध्यक्ष और ईपाध्यक्ष सजहत) और ऄजधकरण के कमाचाररिृन्द्द के सदस्ट्यों की पोिाक ऐसी होगी, जो ऄध्यक्ष जिजनर्ददि करे ।

36. पक्षकारों की पोिाक.- यथाजस्ट्थजत, कोइ जिजधक व्यिसायी या प्रस्ट्तुजत ऄजधकारी, ऄपनी िृजत्तक पोिाक म,ें यदद कोइ हो, ऄजधकरण के समक्ष प्रकट होगा, और यदद ऐसी कोइ पोिाक नहीं ह,ै--

(i) यदद पुरूष हो तो बंद, कॉलरयुि कोट और राउजर या लाईंज सूट में ;

(ii) यदद स्त्री हो तो सौम्य रंग की साड़ी या दकसी ऄन्द्य पारम्पररक पोिाक म ें।

NOTIFICATION New Delhi, the 30th October, 2023 G.S.R. 806(E).—In exercise of the powers conferred under section 35 of the Administrative Tribunals Act, 1985 (13 of 1985), the Central Government hereby makes the following rules, namely :-

1. Short title and commencement. - (1) These rules may be called the Haryana Administrative Tribunal (Procedure) Rules, 2023.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions - (1) In these rules, unless the context otherwise requires,-

(a) ―Act‖ means the Administrative Tribunals Act, 1985 (13 of 1985);

(b) ―agent‖ means a person duly authorized by a party to present an application, written reply, rejoinder or any other document on his behalf before the Tribunal;

(c) ―applicant‖ means a person making an application to the Tribunal under section 19 of the Act;

(d) ―application‖ means an application made to the Tribunal under section 19 or an application filed through the electronic portal of the Tribunal;

(e) ―authorized officer‖ means the Registrar, Deputy Registrar, Filing Scrutiny Officer and such other officer of the Tribunal, as may be authorized by the Chairperson;

(f) ―electronic portal‖ means the electronic portal of the Tribunal under rule 5;

(g) ―Form‖ means a Form annexed to these rules and also include the form provided on the electronic portal of the Tribunal;

(h) ―legal practitioner‖ shall have the same meaning as is assigned to it in the Advocates Act, 1961 (25 of 1961);

(i) ―legal representative‖ means a person who in law represents the estate of the deceased person and includes a person or persons in whom the right to receive pensionary, retirement, terminal or other benefits or family pension vests;

(j) ―Registrar‖ in relation to the Tribunal means the Registrar appointed in the Principal Bench and in relation to each of the other Benches of the Tribunal shall mean the Registrar appointed to the particular Bench or any officer to whom the powers and functions of the Registrar may be delegated under sub-rules (2) and (3) of rule 31;

(k) ―registry‖ means the Registry of the Tribunal or of the Bench of the Tribunal, as the case may be;

(l) ―section‘ means the sections of the Act;

(m) ―transferred application‖ means the suit or other proceeding which has been transferred to the Tribunal under sub-section (1) or sub-section (2) of section 29 of the Act;

(n) ―Tribunal‖ means the Haryana Administrative Tribunal established under sub-section (2) of

section 4 of the Act;

(2) Words and expression used and not defined in these rules, but defined in the Act shall have the same meaning respectively assigned to them in the Act.

3. Language of Tribunal - (1) The language of the Tribunal shall be English:

Provided that the parties to a proceeding before the Tribunal may file documents drawn up in Hindi, if they

so desire:

Provided further that the Bench may-

(a) permit the use of Hindi in any proceeding;

(b) direct English translation of pleading or document to be filed;

(2) Notwithstanding anything contained in sub-rule (1), where a final order is made in Hindi, an authenticated English translation thereof shall simultaneously be prepared and kept on record and provided to the parties free of cost.

4. Procedure for filing applications. - (1) An application to the Tribunal shall be presented in FORM I, by the applicant in person or by an agent or by a duly authorized legal practitioner to the Registrar or any other officer authorized in writing by the Registrar to receive the same or be sent by Registered Post with acknowledgement

duly addressed to the Registrar of the Bench concerned:

Provided that in the case of electronic filling of the application, the same shall be filed in the Form as

provided in the Electronic Portal.

(2) The application under sub-rule (1) shall be presented in triplicate in the following two compilations-

(i) Compilation number 1.- application along with the impugned order, if any;

(ii) Compilation number 2.- all other documents and annexure referred to in the application in a paper

book form:

Provided that in the case of electronic filing of the application, triplicate sets of application are not required.

(3) Where the number of respondents are more than one, as many extra copies of the application in paper-book form as there are respondents together with unused file size envelope bearing the full

address of each respondent shall be furnished by the applicant:

Provided that where the number of respondents is more than five, the Registrar may permit the

applicant to file the extra copies of the application at the time of issue of notice to the respondents:

Provided further that in the case of electronic filing of the application, envelopes bearing address and extra copies of application are not required but the applicant shall furnish the e-mail address of the respondents.

(4) The applicant may attach to and present with his application a receipt slip in FORM II which shall be signed by the Registrar or the authorised officer receiving the application on behalf of the Registrar, in acknowledgement of the receipt of the application.

(5) Notwithstanding anything contained in sub-rules (1) to (3), the Tribunal may permit (a) more than one person to join together and file a single application if it is satisfied, having regard to the cause and the nature of relief prayed for that they have a common interest in the matter, or (b) an association

representing the persons desirous of joining in a single application:

Provided, that the application shall disclose the class or grade or categories or persons on whose behalf it has

been filed:

Provided further that at least one affected person join the application.

5. Setting up of electronic Portal and filing of application. - (1) The Tribunal may set up an electronic portal for filing of applications and documents.

(2) The applications and petitions to the Tribunal shall be presented in the prescribed digital format to the Registrar

or authorised officer through such electronic portal:

Provided that in the transition period of digitization or if, for any reason, the access to the electronic portal is not available, the applicant or respondent may file the applications or petitions in paper book form as per section 19 of the Act and in such cases, the applicant shall also submit a soft copy of the same and then the registry shall scan and upload the application and documents to the electronic portal.

(3) Once the electronic portal of the Tribunal is established, the legal practitioner appearing before the Tribunal and their clerks shall register themselves in the electronic portal.

(4) For accessing the electronic portal, all users shall register themselves in the electronic portal and obtain a user identity and password.

6. Presentation and scrutiny of applications. - (1) The Registrar or the officer authorized by him under sub-rule (1) of rule 4, shall endorse on every application, the date on which it is presented or deemed to have been presented under that rule and shall sign the endorsement.

(2) If, the application, on scrutiny, is found to be in order, it shall be duly registered and given a serial number.

(3) If the application, on scrutiny, is found to be defective and the defect noticed is formal in nature, the Registrar may allow the applicant or his authorized agent to correct the same in his presence, and if the said18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] defect is not formal in nature, the Registrar may allow the applicant a period of thirty days to rectify the defect.

(4) Where an application is received by registered post, the applicant shall be informed of the defects, if any, and he shall be required to rectify the same within a period of not exceeding thirty days from the date of information to the applicant or his authorized agent by the Registrar.

(5) If the applicant fails to rectify the defect, within the time allowed under sub-rules(3), and rule (4), the Registrar may, by order and for reasons to be recorded in writing, decline to register the application and place

the matter before the Bench for appropriate orders:

Provided that all applications filed electronically shall be scrutinised in the Registry, and defects if any, shall be intimated to the applicant through e-mail for rectification within such time fixed by the Registrar and the Registrar may for good and sufficient reasons, extend the time for rectifying the defects as he may deem fit, provided, the total period does not exceed thirty days and that if the defects are not cured within such time, the Registrar shall place the matter before the Tribunal Bench concerned for appropriate orders.

7. Place of filing applications. - (1) An application shall ordinarily be filed by an applicant with the Registrar of the Bench within the jurisdiction where-

(i) the applicant is posted for the time being; or

(ii) the cause of action, wholly or in part, has arisen:

Provided that with the leave of the Chairperson, the application may be filed with the Registrar of the Principal Bench and subject to the orders under section 25 of the Act, such application shall be heard and disposed of, by the Bench which has jurisdiction over the matter.

(2) Notwithstanding anything contained in sub-rule (1), persons, who have ceased to be in service by reason of retirement, dismissal or termination of service, may at his option, file an application with the Registrar of the Bench within whose jurisdiction such person is ordinarily residing at the time of filing of the application.

8. Application fee. -(1) Every application filed with the Registrar shall be accompanied by a fee of fifty rupees to be remitted either in the form of crossed demand draft drawn on a nationalized bank in favour of the Registrar of the concerned Bench and payable at the main Branch of that bank at the station where the seat of the said Bench situates, or remitted through a crossed Indian Postal Order drawn in favour of the Registrar of the concerned Bench

and payable at the post office of the station where the said Bench is situated:

Provided that where the Tribunal permits a single application to be filed, either by more than one person or by an Association, the fee payable shall be rupees fifty:

Provided further that where the Tribunal is satisfied that an applicant is unable to pay the prescribed fee on ground of indigence, it may exempt such an applicant from the payment of fee.

(2) In the case of electronic filing of the application, the fee shall be remitted electronically and the electronic portal

shall have the facilities for online payment of application fees and other charges:

Provided that where such facilities are not available for any reason, the applicant has to upload the scanned

copy of the court fee stamp towards application fee and Vakalatnama affixed with requisite stamps:

Provided further that the applicant has to produce the Vakalatnama and the stamp for application fee in original in the Registry before the finalization of scrutiny of the application.

9. Contents of application. - (1) Every application filed under these rules shall set forth concisely under distinct heads, the grounds for such application and such grounds shall be numbered consecutively.

(2) Every application including any miscellaneous application shall be typed in double space on one side on thick

paper of good quality:

Provided that in case of electronic filing of application, the grounds for filing application shall be entered directly in the column provided in the Electronic Portal.

(3) It shall not be necessary to present a separate application to seek an interim order or direction, if in original application the same is prayed for.

(4) An applicant may, subsequent to the filing of an application under these rules apply for an interim order or direction and such application shall be in FORM III.

(5) Where the applicant seeks condonation of delay, he shall file a separate application supported by an affidavit.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 19

10. Documents to accompany application. -(1) Every application shall be accompanied by a paperbook containing the following documents, namely:

(i) an attested true copy of the order against which the application is filed;

(ii) copies of the documents relied upon by the applicant and referred to in the application;

(iii) an index of the documents.

(2) The documents referred in sub-rule (1) may be either self attested or attested by a legal practitioner or by a Gazetted Officer and each document shall be marked serially as Annexure A1, A2, A3 and so on.

(3) Where an application is filed by any agent, documents authorizing him to act as an agent shall also be

appended to the application:

Provided that where an application is filed by a legal practitioner, it shall be accompanied by a duly executed ‗Vakalatnama‘:

Provided further that in the case of electronic filing of the application, the document to be filed along with the application or petition shall be filed by the parties through the electronic portal, by scanning and uploading the same.

11. Plural remedies. - An application shall be based upon a single cause of action and may seek one or more reliefs, if they are consequential to one another.

12. Service of notice and processes issued by Tribunal. - (1) Notices or processes to be issued by the Tribunal may be served by any of the following modes–

(i) service by the party himself together with an acknowledgement and an affidavit of service;

(ii) by hand delivery (dasti) through process server;

(iii) by registered post with acknowledgement due;

(iv) through the concerned head of the Department by any one or more of the modes referred to in clauses (i) to (iii) above:

Provided that if the Tribunal does not specify the mode of service, notice may be sent by registered post ‗with acknowledgement due‘ and the provision of sub-rule (2) of rule 19A of Order V of First Schedule to the Code of Civil Procedure, 1908 (Central Act 5 of 1908), shall apply to such mode of service.

(2) Where notice issued by the Tribunal is served by the party himself by hand delivery‘ (Dasti), he shall file with the Registry, the acknowledgement together with an affidavit of service.

(3) Notwithstanding anything contained in sub-rule (1), the Tribunal may, taking into account the number of respondents and their places of residence or work and other circumstances, direct the notice of the application shall be served upon the respondents in any other manner, including any manner of substituted service, as it appears to the Tribunal just and convenient.

(4) Notwithstanding anything contained in sub-rule (1), the Tribunal may, in its discretion, having regard to the nature and urgency of the case, direct the service of the notice on the Standing Counsel, authorized to accept the service, for any Department or Organization of the Government of Haryana, or an authority, a corporation, a body owned or controlled by the Haryana Government.

(5) Every notice issued by the Tribunal shall, unless otherwise ordered, be accompanied by a copy of the application and a copy of the impugned order and copy of paperbook.

(6) Every applicant shall pay a fee for the service of execution of processes, in respect of an application where the number of respondents exceeds five, as under:-

(i) a sum of five rupees for each respondent in excess of five respondents; or

(ii) where the service is in such a manner as the Tribunal may direct under sub-rule (3) such a sum not exceeding the actual charges incurred in effecting the service, as may be determined by the Tribunal.

(7) The fee for the service or execution of processes under sub-rule(3) shall be remitted in the manner prescribed in rule 8 within one week of the date of the order determining the fee or within such extended time as the Registrar may permit.

(8) Notwithstanding anything contained in sub-rules (1) to (4), if the Tribunal is satisfied that it is not reasonably practicable to serve notice of application upon all the respondents, it may, for reasons to be recorded in writing, direct that the application shall be heard notwithstanding that some of the

respondents have not been served with notice of the application:20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

Provided that no application shall be heard unless –

(i) notice of the application has been served on the Central Government or the state Government, if such Government is a respondent;

(ii) notice of the application has been served on the authority which passed the order against which the application has been filed; and

(iii) the Tribunal is satisfied that the interest of the respondents on whom notice of the application has not been served are adequately and sufficiently represented by the respondents on whom notice of the application has been served.

(9) Notwithstanding anything contained in this rule, in the case of electronic filing of application, any notice or process to be issued by the Tribunal shall, as far as possible, be served through electronic means, when electronic mailing address is not known, the service of notice or process may be done as per sub-rule (1).

13. Filing of reply and other documents by respondents. - (1) Each respondent intending to contest the application, shall file in triplicate the reply to the application and the document relied upon, in paper book form with the Registry, within one month of the service of notice of the application on him:

Provided that in case of electronic filing, the replies and statement to be filed by the respondents and the accompanying documents, if any, to be filed with such replies shall be filed through the electronic portal and in such case, a message regarding the filing of such reply shall be given to the applicant and other respondent by the Registry and thereafter the applicant and the other respondents can access the reply from the electronic portal.

(2) In the reply filed under sub rule (1), the respondent shall specifically admit, deny or explain the facts stated by the applicant in his application and may also state such additional facts as may be found necessary for the just decision of the case.

(3) The reply shall be signed and verified as a written statement by the respondent or any other person duly authorized by him in writing in the same manner as provided for in Order VI, rule 15 of the Code of Civil Procedure, 1908 (5 of 1908).

(4) The documents referred in sub-rule (1) shall also filed alongwith the reply and the same shall be marked as R1, R2, R3 and so on.

(5) The respondent shall also serve a copy of the reply alongwith documents as mentioned in sub-rule (1) on the applicant or his agent or his legal practitioner, if any, as the case may be, and file proof of such service in the Registry.

(6) The Tribunal may allow filing of the reply after the expiry of the prescribed period.

(7) The Tribunal may allow the parties to amend the pleadings in the same manner as provided under Order 6, Rule 17 of the Code of Civil Procedure, 1908 (5 of 1908).

14. Filing of rejoinder and documents by the applicant. -In case of electronic filing, the rejoinder to be filed by the applicant and the accompanying documents, if any, to be filed with such rejoinder, shall be filed through the electronic portal and in such cases, a message regarding the filing of such rejoinder shall be given to the respondents by the Registry and thereafter the respondents can access the rejoinder from the electronic portal.

15. Date and place of hearing to be notified. - The Tribunal shall notify to the parties the date and the place of hearing of the application in such manner as the Chairperson may by general or special order direct.

16. Sitting of Tribunal. - The Tribunal shall ordinarily hold its sitting at Panchkula:

Provided that, if at any time, the Chairperson of the Tribunal is satisfied that circumstances exist which render it necessary to have sittings of the Tribunal at any place other than Panchkula, the Chairperson may direct to hold the sitting at any other appropriate place in the state of Haryana.

17. Calendar of cases. - (1) Each Bench shall draw up a calendar for the hearing of transferred cases and, as far as possible, hear and decide the cases according to the calendar.

(2) Every application shall be heard and decided as far as possible, within six months from the date of its registration.

(3) The Tribunal shall have the power to decline an adjournment and also to limit the time for oral arguments.

18. Action on application for applicants’ default. - (1) Where on the date fixed for hearing of the application or on any other date to which such hearing may be adjourned, the applicant does not appear when the application is called for hearing, the Tribunal may in its discretion, either dismiss the application for default or hear and decide it on merit.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 21

(2) Where an application has been dismissed for default and the applicant files an application within thirty days from the date of dismissal and satisfies the Tribunal that there was sufficient cause for his non appearance when the application was called for hearing, the Tribunal shall make an order setting aside the order

dismissing the application and restore the same:

Provided that where the case was disposed of on merits, the decision shall not be re-opened except by way of review.

19. Ex-parte hearing and disposal of application. - (1) Where on the date fixed for hearing the application or on any other date to which the hearing may be adjourned, the applicant appears and the respondent does not appear when the application is called for hearing, the Tribunal may, in its discretion adjourn the hearing, or hear and decide the application ex-parte.

(2) Where an application has been heard ex-parte against a respondent or respondents, such respondent or respondents may apply within thirty days from the date of order, to the Tribunal for an order to set it aside and if such respondent or respondents satisfy the Tribunal that the notice was not duly served, or that he or they were prevented by any sufficient cause from appearing when application was called for hearing, the Tribunal may make an order setting aside the ex-parte order as against him or them upon such terms, as it thinks fit, and shall appoint a day for proceeding with the application:

Provided that where the ex-parte order of the application is of such nature that it cannot be set aside as against one respondent only, it may be set aside as against all or any of the other respondents also:

Provided further that in cases covered by sub-rule (8) of rule 12, the Tribunal shall not set aside ex-parte

order of an application merely on the ground that it was not served upon a respondent or respondents.

20. Application for review. - (1) No application for review shall be entertained unless it is filed within thirty days from the date of receipt of copy of the order sought to be reviewed.

(2) A review application shall ordinarily be heard by the same Bench which has passed the order, unless the Chairperson may, for reasons to be recorded in writing, direct it to be heard by any other Bench.

(3) Unless otherwise ordered by the Bench concerned, a review application shall be disposed of by circulation and the Bench may either dismiss the application or direct notice to the opposite party.

(4) When an application for review of any judgment or order has been made and disposed of, no further application for review shall be entertained in the same manner.

(5) No application for review shall be entertained unless it is supported by a duly sworn affidavit indicating therein the source of knowledge, personal or otherwise, and also those which are sworn on the basis of the legal advice.

(6) The counter affidavit in review application shall also be by a duly sworn affidavit, wherever any averment of fact is disputed.

21. Substitution of legal representatives. - (1) In the case of death of a party during the pendency of the proceedings before the Tribunal, the legal representatives of the deceased party may apply within ninety days of the date of death for being brought on record as necessary parties.

(2) Where no application is received from the legal representatives within the period specified in sub-rule (1), the

proceedings against the deceased party shall abate:

Provided that on good and sufficient reasons, the Tribunal, on an application, may set aside the order of abatement and substitute the legal representatives.

22. Adjournment of hearing. - The Tribunal may, if sufficient cause is shown at any stage of proceedings grant time to the parties or any of them, and adjourn the hearing of the application. The Tribunal may make such order, as it thinks fit, with respect to the costs occasioned by the adjournment.

23. Order to be signed and dated.- (1) Every order of the Tribunal shall be signed by the Member or Members constituting the Bench, which pronounced the order:

Provided that when the orders are prepared in digital format, the same shall be signed by such Members by using digital signature.

(2) The order shall be pronounced in the open Court.

(3) The final orders and interim orders passed by the Tribunal in all cases shall be published in the electronic portal in public domain.

24. Publication of orders. - (1) The Tribunal may publish its decision which are deemed fit for publication, in a report entitled ―Indian Law Report Haryana Administrative Tribunal .......20...‖.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(2) Such of the order of the Tribunal as are deemed fit for publication in any other authoritative report or the press may be released for publication on such terms and conditions, as the Chairperson may specify, by general or special order.

25. Communication of order to parties. - (1) Every interim order granting or refusing or modifying interim relief and final order shall be communicated to the applicant and to the concerned respondent or to their Counsels, either by hand delivery or by post, free of cost:

Provided that unless ordered otherwise by a Bench, a copy of the final order need not be sent to any

respondent who has not entered appearance:

Provided further that when the orders of the Tribunal are to be issued in digital format, the same shall be electronically communicated to the parties by the authorised officer after affixing his digital signature and that the orders electronically signed and communicated as above shall be considered as the authentic copy of the order and shall be sufficient for taking further steps thereon before the Tribunal and other authorities and also that any recipient or authority can verify the authenticity of the order by clicking on the electronic link provided in the order.

(2) If the applicant or the respondent to any proceeding requires a copy of any document or proceeding, the same shall be supplied to him on such terms and conditions on payment of such fees, as may be fixed by the Chairperson by general or special order.

26. Inspection of the records. - (1) The parties to any case or their counsel may be allowed to inspect the record of the case on making an application in writing to the Registrar.

(2) Subject to such terms and conditions as may be specified by the Chairperson by a general or special order a person who is not a party to the proceeding, may also be allowed to inspect the proceedings after obtaining the permission of the Registrar in writing.

27. Order and directions in certain cases. - The Tribunal may make such orders or give such directions, as may be necessary or expedient to give effect to its order or to prevent abuse of its process or to secure the ends of justice.

28. Registration of legal practitioner’s clerk. - (1) No clerk employed by a legal practitioner shall act as such in the Tribunal or be permitted to have access to the records and obtain copies of the orders of the Bench of the Tribunal in which the legal practitioner ordinarily practises unless his name is entered in the register of clerks maintained by the said Bench and such clerk shall be known as a registered clerk.

(2) A legal practitioner desirous of registering his clerk shall make an application to the Registrar in Form IV and on such application being allowed by the Registrar, his name shall be entered in the register of clerks.

(3) After registration of the clerk, the Registrar shall direct the issue of an identity card to him which shall be non-transferable and shall be produced by the holder upon request by an officer or other employee of the Tribunal authorized in this behalf and the identity card shall be issued under the signature of the Deputy Registrar of the Bench concerned.

(4) A register of all the clerks registered under sub-rule (3) shall be maintained in the office of the Registrar of each Bench.

(5) A legal practitioner shall have at a time not more than two registered clerks, unless the Registrar by general or special order otherwise allows.

(6) Whenever a legal practitioner ceases to employ a registered clerk, he shall notify the fact at once to the Registrar by means of a letter enclosing therewith the identity card issued to his clerk by the registry, and on receipt of such letter, the name of the said registered clerk shall be struck off from the register.

29. Working hours of Tribunals. - Except on Saturdays, Sundays, and other public holidays, the office of the Tribunal shall, subject to any order made by the Chairperson remain open from 9.00 a.m. to 5 p.m.

30. Sitting hours of Tribunal. - The sitting hours of the Tribunal (including a vacation Bench) shall ordinarily be from 10.00 a.m. to 1.00 p.m. and 2.00 p.m. to 4.30 p.m. subject to any general or special order made by the Chairperson.

31. Powers and functions of Registrar. - (1) The Registrar shall have the custody of the records of the Tribunal and shall exercise such other functions as are assigned to him under these rules or by the Chairperson or the Vice- Chairperson of the Bench concerned by separate order.

(2) The Registrar may, with the approval of the Chairperson or of the Vice-Chairperson of the Bench concerned, delegate to the Deputy Registrar, any function or power required by these rules to be performed or exercised by the Registrar.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 23

(3) In the absence of the Registrar, the Deputy Registrar or any other officer to whom the powers and functions of the Registrar are delegated by the Chairperson or Vice-Chairperson, as the case may be, may exercise the powers and functions of the Registrar.

(4) The official seal shall be kept in the custody of the Registrar.

(5) Subject to any general or special direction by the Chairperson, the seal of the Tribunal shall not be affixed to any order, summons or other process save under the authority in writing of the Registrar or the Deputy Registrar.

(6) The seal of the Tribunal shall not be affixed to any certified copy issued by the Tribunal save under the authority in writing by the Registrar or the Deputy Registrar.

32. Additional powers and duties of Registrar. - In addition to the powers conferred, elsewhere in these rules, the Registrar shall have the following powers and duties subject to any general or special order of the Chairperson or the Vice-Chairperson of the Bench concerned, namely :-

(i) to receive every application and other document including transferred application;

(ii) to decide every question arising out of the scrutiny of the application before they are registered;

(iii) to require any application presented to the Tribunal to be amended in accordance with the Act and the rules;

(iv) to fix the date or first hearing of the applications or other proceedings and issue notices thereof, subject to the direction of the respective Benches;

(v) to direct any formal amendment of records;

(vi) to order grant of copies of documents to parties to the proceedings;

(vii) to grant leave to inspect the records of the Tribunal;

(viii) to dispose of all matters relating to the service of notices or other processes, applications for the issue of fresh notices or for extending the time for filing such applications, to grant time not exceeding thirty days for filing a reply or rejoinder if any, and to place the matter before the Bench for appropriate orders after the expiry of the aforesaid period;

(ix) o request records from the custody of any court of other authority;

(x) to receive applications within ninety days from the date of death for substitution of legal representatives of the deceased parties during the pendency of the application;

(xi) to receive and dispose of applications for substitution, except where the substitution does not involve setting aside an order of abatement;

(xii) to receive and dispose of applications by parties for return of documents; and

(xiii) With the approval of the Chairperson, notify from time to time, minor changes, if any, on the technical aspects in the procedures to be followed for filing of application, issue of notices or process, filing of reply statement and rejoinder, generation of calendar of cases for hearing, communication of orders, electronic registration of users.

33. Additional powers of Registrar of the Principal Bench. - The Registrar of Principal bench shall have the power to call for information and records and to inspect or cause to be inspected the registry of the other Benches under general or special orders, as may be issued by the Chairperson from time to time.

34. Seal and emblem.-The official seal and emblem of the Tribunal shall be such, as the Central Government may specify.

35. Dress of Members and staff of the Tribunal. - The dress for the Members of the Tribunal (including Chairperson and Vice-Chairperson) and Members of the staff of the Tribunal shall be such, as the Chairperson may specify.

36. Dress of parties. - A legal practitioner or a presenting officer, as the case may be, shall appear before the Tribunal in his professional dress, if any, and if there is no such dress,-

(i) if a male, in a closed, collared coat and trousers or in a lounge suit;

37. Hearing through video conferencing. - The hearing of the cases may, at the discretion of the Tribunal, be held by making use of electronic facilities such as video conferencing and the Chairperson may notify the procedure to be followed in this regard.
