1. जवषय-क्षत्रे यह दििाजनिेि: • केवल खाद्य अनुप्रयोगों के जलए उपयोग दकए गए ऐसे उपभुि (पोस्ट्ट-कंज्यूमर) पीईटी को खाद्य संपकस सामग्री (एफसीएम-आरपीईटी) रेजिन के रूप म ें बिलने की पनु चसिण प्रदिया/संचालन से संबंजधत हैं, िो खाद्य संपकस सामग्री बनाने के जलए उपयिु हों। • खाद्य संपकस सामग्री में (एफसीएम-आरपीईटी) रेजिन के उपयोग के जलए स्ट्वीकृजत मानिंड की िानकारी प्रिान करते ह।ैं 3383 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] • केवल एफएसएसएआई द्वारा अनुमोदित पुनचसिण प्रौद्योजगकी पर लाग ूहोते ह।ैं • गैर-खाद्य ग्रडे उपभोिा अनप्रु योगों के जलए रेजिन के उत्पािन पर लाग ूनहीं होत े ह।ैं

2. पररभाषाए ं इस दििाजनििे के प्रयोिन के जलए—

2.1 खाद्य प्राजधकरण - का अर्स ह ै खाद्य सुरक्षा और मानक अजधजनयम, 2006 की धारा 4 के तहत स्ट्र्ाजपत भारतीय खाद्य सुरक्षा और मानक प्राजधकरण (एफएसएसएआई)।

2.2 जनमातस ा - का अर् सह ैएफएसएसएआई द्वारा अनुमोदित पनु चसिण प्रौद्योजगकी के अनुसार खाद्य संपकस सामग्री के रूप में पनु चसदित पॉलीईर्ाईलीन टेरेफ्र्ले ेट (पीईटी) का जनमासता औरया/ पनु चसिण प्रदिया का संचालक।

2.3 सामग्री

(1) वर्िनस पीईटी (वीपीईटी) – ईर्ाईलीन से प्राप्त ईर्ाईलीन ग्लाइकॉल और परै ा-जाइलीन से प्राप्त टेरेफ्र्ैजलक एजसड के प्रारंजभक मोनोमसस के रूप म ेंबहु-संघनन अजभदिया द्वारा जनर्मसत।

(2) उपभिु खाद्य ग्रडे पीईटी - वीपीईटी और एफसीएम- आरपीईटी खाद्य पैकेजिंग सामग्री िो घरों से या वाजणजज्यक, औद्योजगक और संस्ट्र्ागत सुजवधाओं स,े जिन्होंने उत्पाि का अंजतम उपयोगकतास के रूप में उपयोग दकया हो, एकत्र की िाती ह,ैं जिसमें जवतरण श्ृंखला से वापस की गई सामग्री भी िाजमल ह।ै

(3) पीईटी रेजिन - उपभिु पीईटी/पूवस-उपभोग औद्योजगक पीईटी की जपसाई और धुलाई से प्राप्त टुकडों का एक संग्रह जिसका खाद्य अनप्रु योगों के जलए उपयोग दकया िा सके।

(4) पनु चदस ित पॉलीइजर्लीन टेरेफ्र्ले टे (एफसीएम- आरपीईटी) - उपभुि खाद्य ग्रडे पीईटी रेजजन जिसे एक मान्य जवसंिषू ण प्रदिया द्वारा भोिन के सीधे संपकस म ें रखने के संबंध में जनर्िष्टस िुद्धता प्रिान करन े के जलए राष्ट्रीय या अंतराष्ट्रस ीय जनयामक प्राजधकरण(णों) द्वारा जनर्िष्टस आवश्यकताओं के अनुसार तैयार दकया गया हो।

2.4 पनु चिस ण प्रदियाएँ पुनचसदित पीईटी का खाद्य संपकस सामग्री के रूप में उत्पािन करने म ें सक्षम जनम्नजलजखत म ें से कोई भी एक पुनचसिण प्रदिया अपनाई िा सकती ह।ै अपनाई गई पनु चसिण प्रदिया में कम से कम एक जवसंिषू ण चरण होना चाजहए जिसके द्वारा खाद्य संपकस के जलए उपयुि िुद्धता के स्ट्तर तक िजू षत पिार्ों को हटाया िा सके:

(1) सपु र-क्लीन पनु चिस ण प्रदिया - एक पारंपररक पुनचसिण प्रदिया िो एक एकीकृत जवसंिषू ण चरण [िैसा दक एफएसएसएआई या दकसी अन्य जनयामक जनकाय द्वारा जनर्िसष्ट हो] के सार् उन्नत की गई हो तादक जनयंजत्रत वातावरण में सतह उपचार, उच्च गमी और/या उच्च जनवासत के संयोिन के माध्यम स े अविोजषत िजू षत पिार्ों को हटाया िा सके, जिसके बाि आउटपुट का उपयोग सीधे खाद्य संपकस के जलए दकया िा सके।

(2) मल्े ट-इन पनु चिस ण प्रदिया - वर्िसन पीईटी (वी पीईटी) उत्पािन की एक संचालन प्रदिया िो पीईटी फ्लेक्स को जपघले हुए रूप में समाजवष्ट करने की क्षमता के सार् उन्नत होती ह,ै जिन्ह ें उच्च गमी और उच्च जनवासत के संयोिन से जवसंिजू षत दकया िाता ह।ै

(3) पस्ट्े ट-इन पनु चिस ण प्रदिया - एक वर्िसन पीईटी (वी पीईटी) उत्पािन प्रदिया िो पीईटी फ्लेक्स को आंजिक ग्लाइकोजलजसस के माध्यम स ेपेस्ट्ट के रूप म ेंसमाजवष्ट करने की क्षमता के सार् उन्नत होती ह ैऔर रासायजनक आसवन, वैक्यूम जडगैजसंग आदि के माध्यम स ेअविोजषत िजू षत पिार्ों को हटाने की एकीकृत प्रणाली स े लैस होती ह।ै

(4) रासायजनक पनु चिस ण प्रदिया - पायरोजलजसस या पीईटी फ्लेक्स को िुद्ध ईर्ाईलीन ग्लाइकॉल और टेरेफ्र्ेजलक एजसड (या डाइजमर्ाइल टेरेफ्र्ले ेट), या बीआईएस(2-हाइड्रॉक्सीएजर्लटेरेफ्र्ेलेट) में परू ी तरह से डीपोजलमराइि करन े की एक रासायजनक अजभदिया प्रदिया। आईएसओ 15270 दििाजनिेिों के अनुसार, िुद्ध डीपोजलमराइज्ड मोनोमर का उपयोग वर्िसन गणु वत्ता के बहुलक का उत्पािन करने के जलए[भाग III—खण्‍ड 4] भारत का रािपत्र : असाधारण 3 दकया िा सकता ह।ै रासायजनक पुनचसिण प्रदिया का उपयोग करके एफसीएम-आरपीईटी का जनमासता प्रपत्र I के अनुसार खाद्य प्राजधकरण को आवेिन और प्रासंजगक डोजियर िमा करेगा। इस दििाजनिेि के प्रयोिन के जलए, पारंपररक पनु चिस ण प्रदिया को इस प्रकार पररभाजषत दकया गया ह ै – एक यांजत्रक पुनचसिण प्रदिया जिसमें पीईटी फ्लेक्स को धोया िाता है, जपघलाया िाता ह,ै जनिःस्त्राजवत और पेलेटाइज दकया िाता ह,ै जिसमें िजू षत पिार्ों को हटान े के जलए कोई प्रदिया चरण नहीं होता ह।ै ऐसी प्रदियाओं का उपयोग खाद्य संपकस सामग्री के जनमासण के जलए नहीं दकया िाना चाजहए क्योंदक इसमें जवसंिषू ण प्रदिया चरण नहीं होता ह।ै

2.5 परीक्षण

(1) चलै िें परीक्षण - एक प्रमाणीकरण परीक्षण जिसमें वर्िसन पीईटी या पुनचसदित खाद्य संपकस सामग्री पीईटी को परू ी पनु चसिण प्रदिया के िौरान जनर्िसष्ट स्ट्तरों पर जवजभन्न आणजवक भार और ध्रुवीयता वाले रसायनों के जमश्ण के संपकस में लाया िाता ह ै और अवजिष्ट सांद्रता का मात्रात्मक जवश्लेषण दकया िाता ह।ै प्रदिया, प्रदिया मापिंडों या इनपुट फीड में पररवतसन होने की जस्ट्र्जत में चलै ेंि टेस्ट्ट को िोहराया िाना आवश्यक ह।ै

(2) जनष्कषणस परीक्षण - पनु चसदित पॉलीईर्ाईलीन टेरेफ्र्ेलेट (पीईटी) म ें खाद्य संपकस सामग्री (एफसीएम-आर-पीईटी) के रूप में मौिूि पिार्ों का एक मात्रात्मक जवश्लेषण।

(3) माइग्रिे न (अतं रण) परीक्षण – वीपीईटी या एफसीएम-आरपीईटी रेजिन कंटेनरों से भोिन में स्ट्र्ानांतररत होन े वाल े पिार्ों पर एक मात्रात्मक जवश्लेषण और खाद्य उत्पािों के संपकस म ें आने वाली प्लाजस्ट्टक सामग्री के जलए जनर्िष्टस समग्र और जवजिष्ट अंतरण सीमाओं के पालन से संबंजधत जवश्लषे ण। पुनचसदित पॉलीईर्ाईलीन टेरेफ्र्ेलेट (पीईटी) का खाद्य संपकस सामग्री (एफसीएम-आरपीईटी) के रूप म ें एनएबीएल/आईएलएसी प्रत्याजयत लैब में आईएस: 12252, आईएस: 9845, आईएस: 9833 और उनके संिोधनों, यदि कोई हों, के अनपु ालन के संबंध म ेंपरीक्षण दकया िाएगा।

3. प्रदिया आवश्यकताएं जनम्नजलजखत आवश्यकताएँ अनुभाग 2.4 म ेंउजल्लजखत पनु चिस ण प्रदियाओं के संचालन से सबं ंजधत ह।ैं

3.1 प्रदिया इनपटु प्रदिया इनपुट एफसीएम-आरपीईटी रेजिन पर न्यूनतम गुणवत्ता मानक के अनुसार प्राप्त दकया िाएगा। इनपुट सामग्री को चुनौती परीक्षण के जनष्पािन द्वारा जनधासररत प्रदिया प्रमाणीकरण मानिडं ों के आधार पर जनयंजत्रत दकया िाएगा।

3.2 प्रदिया प्रमाणीकरण स्ट्वीकृजत मानिंडों के प्रयोिन के जलए दकसी भी राष्ट्रीय या अतं रासष्ट्रीय जनयामक जनकाय में यर्ाजनर्िसष्ट, उपयोग की िाने वाली प्रौद्योजगकी के आधार पर, िहा ँलागू हो, जनम्नजलजखत परीक्षण दकए िाएंगे:

चैलेंि टेस्ट्ट द्वारा प्रत्येक सरोगेट संिषू क के जलए रेजिन में जवसंिषू ण का स्ट्तर 220 µg/kg सीमा से नीचे होना चाजहए; या माइग्रेिन परीक्षण द्वारा प्रत्यके सरोगेट संिषू क के जलए खाद्य या खाद्य अनुकार में जवसंिषू ण का स्ट्तर 10 µg/kg सीमा से नीचे होना चाजहए। खाद्य संपकस सामग्री के रूप म ें पुनचसदित पॉलीईर्ाईलीन टेरेफ्र्ले ेट ( एफसीएम पीईटी), पॉलीईर्ाईलीन टेरेफ्र्ेलेट (पीईटी) से संबंजधत जवजनिेिों यानी आईएस: 12252 के अनुरूप होना चाजहए।

3.3 प्रदिया आउटपटु प्रदिया का आउटपुट एक जनगरानी कायसिम के अधीन होगा जिसके तहत समय-समय पर पुनचदस ित खाद्य संपकस सामग्री पीईटी गणु वत्ता की जनरंतरता सुजनजित की िाती ह।ै कायसिम में प्रदिया संचालक द्वारा एक रासायजनक जवश्लेषण दकया िाएगा। रासायजनक जवश्लेषण म ेंया तो पनु चसदित खाद्य संपकस सामग्री पीईटी आउटपुट पर एक4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] जनष्कषसण परीक्षण दकया िाएगा या एफसीएम-आरपीईटी स े बनी बीवरेि बोतलों या खाद्य धारकों पर एक माइग्रेिन परीक्षण दकया िाएगा। खाद्य संपकस सामग्री के रूप में पनु चसदित पॉलीइर्ाइलीन टेरेफ्र्ेलेट (एफसीएम-आरपीईटी) , पॉलीइर्ाइलीन टेरेफ्र्ले ेट (पीईटी) से संबंजधत जवजनिेिों यानी आईएस: 12252 के अनरूु प होन े चाजहए। एफसीएम-आरपीईटी का संवेिी जवश्लेषण आईएसओ 13302 या समकक्ष के अनुसार दकया िाएगा।

3.4 प्रदिया सचं ालन एव ंप्रबधं न पुनचसिण प्रदिया अच्छी जनमाणस रीजतयों के जसद्धांतों के अनुसार संचाजलत की िाएगी, जिसमें जनमासता द्वारा स्ट्र्ाजपत गुणवत्ता आश्वासन कायसिम का अनुप्रयोग दकया िाएगा। जवसंिषू ण प्रदिया की प्रभाविीलता जसद्ध करने के जलए महत्वपूण सगणु वत्ता मापिंड पररभाजषत दकए िाएगँ े। उत्पाि अनुरेखणीयता और सुरक्षा अनपु ालन सुजनजित करन े में सहायता के जलए जनमासता द्वारा आपूर्त स श्ृंखला ररकॉड स और गुणवत्ता आश्वासन डेटा बनाए रखा िाएगा।

4. एफसीएम-आरपीईटी रेजजन के जलए स्ट्वीकृजत मानिंड इन दििाजनिेिों के अनुभाग 3.2 और 3.3 म ेंउजल्लजखत के अनुसार।

5. अकं न और लबे जलगं

5.1 एफसीएम-आरपीईटी रेजजन से बनी खाद्य संपकस सामग्री पर जनम्नजलजखत िानकारी उपलब्ध होनी चाजहए:

(1) नीचे दिखाया गया प्रतीक; और/या X – उपयोग दकए गए पुनचसदित रेजजन का प्रजतित r- रीसाइदकल्ड FCM- फूड कॉन्टेक्ट मेटीररयल PET- पॉलीइजर्लीन टेरेफ्र्ले ेट लेबल पर िानकारी इस प्रकार हो: - पैकेजिंग सामग्री पनु चसदित पीईटी से बनी ह।ै

(2) राष्ट्रीय जवजनयमों म ेंजनर्िसष्ट दकसी अन्य आवश्यकता का भी अनपु ालन दकया िाएगा।

(3) पुनचसदित सामग्री का जनधासरण पुनचसिण और पुनप्रासजप्त (आईएस: 14534:2023) के दििाजनिेिों के अनुसार दकया िाएगा।

6. िस्ट्तावजे ीकरण एफसीएम-आरपीईटी जनमासता, कनवटसर, बीवरेि बॉटलर, खाद्य पैकर, एफबीओ (खाद्य व्यवसाय संचालक) इस खडं में जनर्िसष्ट प्रासंजगक िस्ट्तावेज बनाए रखगें े और मागं े िाने पर अपन े संबंजधत डाउनस्ट्रीम ग्राहक (कनवटसर, बीवरेि बॉटलर, खाद्य पैकर/एफबीओ) और खाद्य प्राजधकरण को प्रिान करेंगे। क) अनपु ालन की घोषणा - जनमासता द्वारा िारी एक बयान जिसमें घोजषत दकया गया हो दक एफसीएम-आरपीईटी, पॉलीइर्ाइलीन टेरेफ्र्ेलेट (पीईटी) के जवजनिेिों यानी आईएस: 12252 के अनरूु प ह।ै[भाग III—खण्‍ड 4] भारत का रािपत्र : असाधारण 5 ख) जवजनयामक राय - एक मान्यता प्राप्त, सक्षम प्राजधकारण द्वारा िारी एक अनापजत्त प्रमाण पत्र (एनओसी)/अनापजत्त पत्र (एनओएल) जिसम ें उपभुि खाद्य ग्रडे पीईटी रेजजन को एफसीएम-आरपीईटी म ें पुनचसदित करने के जलए एक जनजित प्रदिया की क्षमता की सूचना िी गई हो। ग) खाद्य श्ृंखला के प्रत्येक स्ट्तर पर उत्पाि अनुरेखणीयता और सुरक्षा अनुपालन पर गुणवत्ता आश्वासन डेटा स े संबंजधत आपर्ू त सश्खृं ला ररकॉडस।

7. अजधकृजतकरण जनमासता अनलु ग्नक प्रपत्र - I के अनुसार आवश्यक िानकारी प्रस्ट्तुत करके पुनचसिण प्रदिया की अजधकृजत प्राप्त करन े के जलए खाद्य प्राजधकरण को आवेिन करेगा। आर-पीईटी रेजिन के जनमासता को जवजनमासण संयंत्र का वार्षसक लेखा- परीक्षण कराना होगा। खाद्य प्राजधकरण:

क) मूल्यांकन के आधार पर, प्रपत्र- II के अनुसार, या तो आवेिन को प्राजधकृत या अस्ट्वीकार करेगा। ख) समय-समय पर एफएसएसएआई की वेबसाइट पर पुनचसिण प्रदिया के प्राजधकृत जनमातस ाओं/एफसीएम- आर-पीईटी के जनमासताओं का पिं ीकरण करेगा। ग) पनु चसिण प्रदिया के मान्य जनमासता/एफसीएम-आरपीईटी के जनमासताओं से कोई भी िानकारी मांगने का अजधकार रखेगा। प्रपत्र - I एफसीएम-आरपीईटी जनमातस ा के प्राजधकरण के जलए आविे न ि.स.ं जवषय जववरण/िस्ट्ताविे

1. जनमासता नाम, पररसर # का पता जिसके जलए आवेिन प्रस्ट्ततु दकया िा रहा ह,ै प्राजधकृत कार्मसक, आदि।

2. संचालन से संबंजधत लाइसेंस सभी लाइसेंस - कारखाना, श्म, प्रिषू ण, िीएसटी आदि।

3. पुनचसिण प्रौद्योजगकी क) पुनचसिण प्रौद्योजगकी का जववरण और जविेता (प्रौद्योजगकी और मिीन आपूर्तसकतास) के सार् दकए गए िय या समझौत ेसे संबंजधत िस्ट्तावेि। ख) संयंत्र/मिीनरी, मेक, जनमासण सामग्री और क्षमता, पूण स प्रदिया प्रवाह चाटस और परीक्षण उपकरण आदि का जववरण।

4. * वैजश्वक जवजनयामक अनुमोिन एनओएल (NOL) /एनओसी (NOC) /सुरक्षा आकलन

5. भारतीय एफसीएम-आरपीईटी के क) सक्षम प्राजधकारी द्वारा उत्पािन पररसर का अनुमोिन/स्ट्वीकृजत सार् दकया गया प्रमाणीकरण ख) एफसीएम-आरपीईटी रेजजन बनाने के जलए प्रौद्योजगकी की उपयुिता और िक्षता प्रिर्ितस करन े वाली जविेता और आतं ररक िाँच की ररपोटें

6. गुणवत्ता और सरु क्षा से संबंजधत दििाजनिेिों में जनर्िष्टस ानुसार एफसीएम-आरपीईटी की गुणवत्ता और डेटा सुरक्षा की पुजष्ट करन े वाली परीक्षण ररपोटें। (ररपोटस एनएबीएल द्वारा प्रत्याजयत प्रयोगिाला की होनी चाजहए)

7. एफसीएम-आरपीईटी के संबंध म ें एफसीएम-आरपीईटी की गणु वत्ता और सुरक्षा की पुजष्ट करने वाली एफएसएस (पैकेजिंग) जवजनयम, परीक्षण ररपोटस (ररपोटस एनएबीएल द्वारा प्रत्याजयत प्रयोगिाला की 2018 और इन दििाजनिेिों सजहत होनी चाजहए)।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] अन्य राष्ट्रीय मानकों का अनुपालन क) एफएसएस (पैकेजिगं ) जवजनयम 2018 - प्लाजस्ट्टक से संबंजधत सामान्य आवश्यकता और जवजिष्ट आवश्यकता [जवजनयम 4(4) का संिभस ले] ख) आईएसओ 13302 या समकक्ष के अनुसार संवेिी जवश्लेषण िीएमपी/क्यूएमएस प्रमाणपत्र आदि।

8. जनमासता द्वारा घोषणा क) यह घोषणा दक एफसीएम-आरपीईटी रेजजन बनान े के जलए केवल उपभुि खाद्य पैकेजिगं सामग्री का ही उपयोग दकया िाता ह ै और हर बैच/लॉट के स्त्रोत, कच्चे माल की प्रकृजत और उसके अपेजक्षत प्रयोग (कन्वटसर, बीवरेि बॉटलर, फूड पैकर, एफबीओ) का ररकॉडस/िानकारी रखना। [यह िानकारी एफसीएम-आरपीईटी जनमासता को रखनी होगी] ख) दििाजनिेिों में जनर्िष्टस ानुसार एफसीएम-आरपीईटी का जनमासण करन े की प्रौद्योजगकी और मिीनरी की क्षमता जसद्ध करन ेके जलए हर साल एक ऑजडट ररपोटस प्रिान करना। ग) खाद्य प्राजधकरण द्वारा मागं े िाने पर आवश्यक कागिात/ररपोटें/ प्रमाण-पत्र/एफसीएम-आरपीईटी प्रतीक अनुपालन का घोषणा-पत्र प्रिान करना। घ) कठोर प्लाजस्ट्टक कंटेनरों (FCM) पर FCM rPET प्रतीक को उभारने और/या लचील े प्लाजस्ट्टक पाउचों पर FCM rPET प्रतीक की घोषणा करनी होगी I * रासायजनक पुनचसिण प्रदिया के माध्यम स ेएफसीएम-आरपीईटी का उत्पािन करन ेवाली जवजनमासण सुजवधाओं पर वैजश्वक जवजनयामक अनुमोिन लाग ू नहीं होता ह।ै # एफसीएम-आरपीईटी के जवजनमासण का प्राजधकार जवजनमासण सुजवधा के जवजिष्ट पररसर और उत्पािन पद्धजतयों के आधार पर प्रिान दकया िाता ह।ै रटप्पण: खाद्य प्राजधकरण के पास दकसी भी समय पुनचसिणकतास स े कोई भी िानकारी/कोई अन्य पूछताछ करने का अजधकार ह।ै प्रपत्र – II एफसीएम- आरपीईटी का प्राजधकरण/अस्ट्वीकृजत आविे न सख्ं या:

NOTIFICATION New Delhi, the 23rd May, 2025 F. No. SSDIVI-PF0SP20(16)/1/2025-Standard-FSSAI.—In exercise of powers conferred under clause (e) of sub-regulation (4) of regulation 4 of the Food Safety and Standards (Packaging) Regulations, 2018, the Food Safety and Standards Authority of India (FSSAI) hereby notify the following guidelines, namely: — Guidelines for acceptance of recycled Polyethylene terephthalate (PET) as Food Contact Material (FCM-rPET)

1. SCOPE

This guideline: ● pertains only to the recycling process/operation of transforming post-consumer PET used for food applications into recycled PET as Food Contact Material (FCM-rPET) resins suitable for making Food Contact Materials.

● covers the acceptance criteria for using (FCM-rPET) resin in Food Contact Materials. ● applies only to recycling technology approved by FSSAI. ● does not apply to production of resins for non-food grade consumer applications.

2. DEFINITIONS For the purpose of this guideline—

2.1 Food Authority – means the Food Safety and Standards Authority of India (FSSAI) established under section 4 of the Food Safety and Standards Act, 2006.

2.2 Manufacturer – means the operator of a recycling process and/or manufacturer of recycled Polyethylene terephthalate (PET) as Food Contact Materials as per the recycling technology approved by FSSAI.

2.3 Materials

(1) Virgin PET (vPET) – Formed by poly-condensation reaction of ethylene glycol derived from ethylene and terephthalic acid derived from para-xylene as the starting monomers.

(2) Post-Consumer food grade PET – vPET and FCM-rPET Food Packaging material collected from households or by commercial, industrial and institutional facilities in their role as end-users of the product including returns of material from the distribution chain.

(3) PET Resin- an aggregate of fragments from grinding and washing of post-consumer PET/pre consumer industrial PET intended to be used for food applications.

(4) Recycled Polyethylene terephthalate (FCM-rPET) – Post consumer food grade PET resin that has undergone a validated decontamination process (as per requirements specified by national or international Regulatory Authority(s) to achieve specified purity for directly holding food.

2.4 Recycling Processes Any one of the following recycling processes capable of producing Recycled PET as Food Contact Materials may be adopted. The recycling process adopted shall have at least one decontamination step capable of

removing contaminants to a level of purity suitable for food contact:

(1) Super-Clean Recycling Process – a Conventional Recycling Process enhanced with an integrated decontamination step [as specified by FSSAI or any other Regulatory Body] to remove absorbed contaminants through a combination of surface treatment, high heat, and/or high vacuum in a controlled environment such that the output can be used for direct food contact.

(2) Melt-in Recycling Process- a virgin PET (v PET) production operation enhanced with the ability of incorporating PET Flakes in the molten form which is decontaminated through a combination of high heat and high vacuum.[भाग III—खण्‍ड 4] भारत का रािपत्र : असाधारण 9

(3) Paste-in Recycling Process - a virgin PET (v PET) production operation enhanced with the ability of incorporating PET Flakes in the paste form via partial glycolysis and equipped with an integrated system of removing absorbed contaminants via chemical distillation, vacuum degassing, etc.

(4) Chemical Recycling Process - a chemical reaction operation of pyrolysis or fully depolymerizing PET Flakes into purified ethylene glycol and terephthalic acid (or dimethyl terephthalate), or bis(2- hydroxyethylterephthalate). As per ISO 15270 guidelines, the purified depolymerized monomer can be deployed to produce polymer of virgin quality. The manufacturer of FCM-rPET using chemical recycling process shall submit application and relevant dossier to the Food Authority as per Form I.

For the purpose of this guideline, Conventional Recycling Process is defined as – a mechanical recycling operation where PET Flakes are washed, melted, extruded, and pelletized without a process step to remove contaminants. Such processes should not be used for manufacturing food contact materials as it does not have the decontamination process step.

2.5 Testing

(1) Challenge Test - a validation test in which virgin PET or Recycled Food Contact Material PET exposed to a mixture of chemicals of different molecular weight and polarity at specified levels, through the entire recycling process, and analyzed quantitatively for the residual concentrations. Challenge test needs to be repeated in case of changes in process, process parameters or input feed.

(2) Extraction Test - a quantitative analysis of substances present in recycled Polyethylene terephthalate (PET) as Food Contact Material (FCM-rPET).

(3) Migration Test - a quantitative analysis on the substances migrating from the vPET, or FCM- rPET resin containers into the food and shall adhere to the overall and specific migration limits specified for plastic materials intended to come in contact with food products.

Recycled Polyethylene terephthalate (PET) as Food Contact Materials (FCM-rPET) shall be tested in NABL/ILAC accredited Lab in compliance with IS: 12252, IS 9845, IS 9833 and amendments or latest versions thereof.

3. PROCESS REQUIREMENTS The following requirements pertain to the operation of recycling processes mentioned in section 2.4.

3.1 Process Input The process input shall be sourced in accordance with the minimum quality standard on FCM-rPET Resin.

Input materials shall be controlled based on process validation criteria as identified by performance of the challenge test.

3.2 Process Validation For the purpose of acceptance criteria following test shall be performed where applicable depending on the technology used, as specified in any national or international regulatory body:

The level of decontamination shall be below the 220 µg/kg limit in the resin for each surrogate contaminant by a challenge test; or The level of decontamination shall be below the 10 µg/kg limit in the food or food simulant for each surrogate contaminant by a migration test. The recycled Polyethylene terephthalate (PET) as Food Contact Material (FCM-rPET) shall conform to the specifications for polyethylene terephthalate (PET) i.e IS:

12252.

3.3 Process Output The process output shall be subject to a monitoring program that ensures the continuity of Recycled Food Contact Material PET quality over time. The program shall include a chemical analysis by the process operator. The chemical analysis shall include either an extraction test on the Recycled Food Contact Material PET output or a migration test on the beverage bottles or food containers made with the FCM- rPET. The recycled Polyethylene terephthalate (PET) as Food Contact Material (FCM-rPET) shall conform to the specifications for polyethylene terephthalate (PET) i.e IS: 12252. The sensory analysis of FCM-rPET shall be conducted in accordance with ISO 13302 or equivalent.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

3.4 Process Operation & Management The recycling process shall operate under the principles of Good Manufacturing Practices, including the application of a quality assurance program as established by the manufacturer. Critical quality parameters must be defined to demonstrate the effectiveness of the decontamination process. Supply chain records and quality assurance data shall be maintained by the manufacturer to support product traceability and safety compliance.

4. ACCEPTANCE CRITERIA FOR FCM-RPET RESIN As referred in section 3.2 and 3.3 of these guidelines.

5. MARKING & LABELLING

5.1 Food Contact Materials made of FCM-rPET resin shall carry the following:

(1) Symbol as shown below; and/or X - percentage of recycled resin used r- recycled FCM- Food Contact Material PET-polyethylene terephthalate

Information on the label as: - The packaging material is made with recycled PET.

(2) Any other requirement specified in national regulations shall also be complied with.

(3) The determination of recycled content shall be as per guidelines for recycling and recovery (IS:

14534:2023).

6. DOCUMENTATION The FCM-rPET manufacturer, converters, beverage bottlers, food packers, FBOs (Food Business Operators) shall maintain and provide relevant documentation as specified in this section to their relevant downstream customer (converters, beverage bottlers, food packers/FBOs) & to the Food Authority as and when asked for.

a) Declaration of Compliance – a statement issued by the manufacturer declaring the FCM-rPET confirms to the specifications for polyethylene terephthalate (PET) i.e IS: 12252. b) Regulatory Opinion - a NOC (No Objection Certificate)/NOL (No Objection Letter) issued by a recognized, competent authority addressing the capability of a given process to recycle post- Consumer Food Grade PET resin into FCM-rPET.

c) Supply chain records on product traceability and quality assurance data on safety compliance at each level of the food chain.

7. AUTHORIZATION The manufacturer shall apply for authorization of the recycling process to the food authority by submitting necessary information as per FORM – I annexed. The manufacturer of r-PET resins shall be subjected to the annual audit of the manufacturing plant.

The Food Authority shall; a) either authorize or reject the application, as per FORM-II, on the basis of the assessment, b) register the authorized manufacturer of a recycling process/manufacturers of FCM-rPET from time to time on FSSAI’s website.

c) reserve the right to call for any information from the recognized manufacturer of a recycling process/manufacturers of FCM-rPET[भाग III—खण्‍ड 4] भारत का रािपत्र : असाधारण 11 Form - I Application for authorization of FCM-rPET manufacturer S.No. Particulars Details/Documents

FCM-rPET compliance to Test reports to confirm the quality & safety of the FCM- rPET FSS(Packaging) regulations (Report shall be from a NABL accredited lab) 2018 including these guidelines, a) FSS(Packaging) regulations 2018 – General requirement& other national standards Specific requirement pertaining to plastics [Refer to Regulation 4(4)] b) sensory analysis as per ISO 13302 or equivalent GMP/QMS certificates etc.

8. Declaration by the manufacturer a) To declare that only post-consumer food packaging materials are used to manufacture FCM-rPET resin and to maintain records/details of the source, nature of feedstock along with the intended application (converters, beverage bottlers, food packers, FBOs) for every batch/lot. [Shall be maintained by FCM-rPET manufacturer] b) To provide an audit report annually to demonstrate the capability of the technology & machinery to manufacture FCM-rPET as specified in Guidelines.

c) To provide necessary documents/reports/ certificates/ FCM- rPET symbol compliance declaration as and when required by the Food Authority. d) Declaration to emboss the FCM rPET symbol on rigid plastic containers (FCM) and/or imprint the FCM rPET symbol on the flexible plastic pouches.

* Global regulatory approval does not apply to manufacturing facilities producing FCM-rPET through the chemical recycling through monomer cycle process. # Authorization for manufacturing FCM-rPET is granted based on the specific premises and production lines of the manufacturing facility.

(iii) The applicant shall maintain all documents/records/details/certificates/audit & test reports as specified in the ‘Guidelines for acceptance of recycled Polyethylene terephthalate (PET) as Food Contact Material (FCM-rPET)’.

This issues with the approval of the Competent Authority.
