L.-33004/99 सी.जी.-डी.एल.-अ.-01112024-258404 CG-DxLxx-GEI-D01H1x1x2x 024-258404 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 617] नई ददल्ली बधु िार, अक्त बू र 30, 2024/ कार्तकव 8, 1946 No. 617] NEW DELHI, WEDNESDAY, OCTOBER 30, 2024/KARTIKA 8, 1946 सचं ार मत्रं ालय (दरू सचं ार जिभाग) अजधसचू ना नई ददल्ली, 29 अक् तूबर, 2024 सा. का. जन.675(अ).—दरू संचार (एमेचर स्ट्टेिन प्रचालक) जनयम, 2024 का प्रारूप, जिसे केंद्रीय सरकार दरू संचार अजधजनयम, 2023 (2023 का 44) की धारा 56 की उप-धारा (2) के खडं (यझ) के साथ पठित धारा 47 द्वारा प्रदत्त िजियों का प्रयोग करत े हुए बनाने का प्रस्ट्ताि करती ह,ै को उि अजधजनयम की धारा 56 की उप-धारा (1), की अपेक्षानुसार, भारत सरकार के संचार मंत्रालय, दरू संचार जिभाग की अजधसूचना संख्या सा.का.जन. 447(अ), तारीख 24 िुलाई, 2024 द्वारा भारत के रािपत्र, असाधारण, भाग 2, खंड 3, उप-खडं (i), तारीख 24 िुलाई, 2024 म ें प्रकाजित दकया गया था, जिसमें इससे प्रभाजित होने िाल े व्यजियों से उि अजधसूचना िाल े रािपत्र की प्रजतयां िनसाधारण को उपलब्ध कराए िान े की तारीख से तीस ददन की अिजध के अिसान से पूिव आपजत्तयां और सुझाि आमंजत्रत दकए गए थे;

और उि रािपत्र की प्रजतयां तारीख 25 िलु ाई, 2024 को िनसाधारण को उपलब्ध करा दी गई थीं; और केंद्रीय सरकार द्वारा उि प्रारूप जनयमों के संबंध में िनसाधारण से प्राप्त आपजत्तयों और सुझािों पर सम्यक रूप से जिचार कर जलया गया ह;ै अतः अब केंद्रीय सरकार, दरू संचार अजधजनयम, 2023 (2023 का 44) की धारा 56 की उप-धारा (2) के खडं (यझ), के साथ पठित धारा 47 द्वारा प्रदत्त िजियों का प्रयोग करते हुए और भारतीय बेतार टेलेग्राफ्स (एमेचर सेिा) जनयम, 1978 को, उन बातों के जसिाय अजधक्ांत करत े हुए, जिन् ह ें ऐसे अजधक्मण स े पूिव दकया गया ह ै या करने का लोप दकया गया 7080 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ह ै और उन जनयमों के अधीन अिसान जिद्यमान व्यिस्ट्थाओं के जनबंधन और ितों को अध्यारोजहत दकए जबना, िो ऐसी व्यिस्ट्थाओं के अिसान की तारीख तक लाग ूरहगें ी, जनम्नजलजखत जनयम बनाती ह,ै अथावत:-

1.सजं क्षप्त नाम और प्रारंभ — (1) इन जनयमों का संजक्षप्त नाम दरू संचार (एमेचर सेिा) जनयम, 2024 ह।ै

(2) य ेरािपत्र में उनके प्रकािन की तारीख को प्रिृत्त होंगे।

2. पठरभाषाएं — (1) इन जनयमों में, िब तक दक संदभ वसे अन्यथा अपेजक्षत न हो, - (क) “अजधजनयम” स ेदरू संचार अजधजनयम, 2023 (2023 का 44) अजभप्रेत ह;ै (ख) “एमेचर रेजडयो उपस्ट्कर” से एमेचर स्ट्टेिन के प्रचालन के जलए अपेजक्षत रेजडयो उपस्ट्कर अजभप्रेत ह;ै (ग) “एमेचर सेिाएं” से स्ट्ि-प्रजिक्षण, अतं रसंचार और तकनीकी अन्िेषण के प्रयोिन के जलए रेजडयो संचार सेिाए ं अजभप्रेत ह ै िो दक रेजडयो तकनीक म ें रुजच रखन े िाल े सम्यक रूप से प्राजधकृत व्यजि द्वारा केिल व्यजिगत उद्देश्य से और जबना दकसी धनीय जहत के हो ;

(घ) “एमेचर स्ट्टेिन” से एमेचर सेिाओं के जलए दकसी एमेचर द्वारा प्रचाजलत रेजडयो स्ट्टेिन अजभप्रेत है; (ङ) “एमेचर स्ट्टेिन प्रचालक प्रमाण-पत्र” या “एएसओसी” से जनयम 3 के उप-जनयम (2) के अधीन यथा जिजनर्दष्टव एएसओसी (साधारण) और एएसओसी (प्रजतजषद्ध) अजभप्रेत ह ैऔर “एएसओसी धारक” से िह व्यजि जिसे जनयम 6 के उप-जनयम (1) के अधीन ऐसा प्रमाण-पत्र अनुदत्त दकया गया ह,ै अजभप्रते ह;ै (च) "अंतरावष्ट्रीय दरू संचार अजभसमय " स े 1992 म ें िेनेिा में हस्ट्ताक्षठरत अंतराष्ट्रव ीय दरू सचं ार संघ अजभसमय या तत्पश्चात दकया गया कोई पनु रीक्षण या उपांतरण अजभप्रेत है, जिस े भारत सरकार न े अनसु मर्थवत या स्ट्िीकृत दकया ह;ै (छ) "पोटवल" स े केन्द्रीय सरकार द्वारा इन जनयमों के जनयम के 15 के अधीन अजधसूजचत दकये िान े िाला पोटवल अजभप्रेत ह;ै और (ि) "रेजडयो जिजनयम" से जिश्व रेजडयो संचार सम्मेलन (िने ेिा 1995) द्वारा अगं ीकृत दकए गए जिजनयम अजभप्रेत ह ै और उसम ें दकया गया प्रत्येक पनु रीक्षण या उपांतरण िाजमल है, जिस े भारत सरकार न े अनसु मर्थवत या स्ट्िीकृत दकया ह;ै

(2) उन िब्दों और अजभव्यजियों, िो इसमें प्रयिु ह ैं और पठरभाजषत नहीं ह ैं दकन्तु अजधजनयम में पठरभाजषत हैं, के िही अथ वहोंगे िो उनके उस अजधजनयम में ह।ै

3. कायक्षव त्रे — (1) कोई भी व्यजि, इन जनयमों के अधीन अनुदत्त एएसओसी के जनबंधन और ितों के अनुसरण म ें या अधीन के जसिाय एमेचर स्ट्टेिन स्ट्थाजपत या प्रचाजलत नहीं करेगा।

(2) एएसओसी की जनम्नजलजखत दो प्रिगव होंगे, जिन्ह ेंकेंद्रीय सरकार जनयम 6 के उप-जनयम (1) के अधीन अनुदत्त कर सकेगी, अथावत:् (क) एमेचर स्ट्टेिन प्रचालक प्रमाण-पत्र (साधारण), या एएसओसी (साधारण); और (ख) एमेचर स्ट्टेिन प्रचालक प्रमाण-पत्र (प्रजतजषद्ध), या एएसओसी (प्रजतजषद्ध)।

4. एमचे र स्ट्टेिन प्रचालक प्रमाण-पत्र अजभप्राप्त करन े के जलए पात्रता ित ें — (1) जनयम 6 के उप-जनयम (1) के अधीन यथाजस्ट्थजत, एएसओसी (साधारण) या एएसओसी (प्रजतजषद्ध), उस व्यजि को अनुदत्त दकया िाएगा िो भारत का नागठरक ह,ै िो :

(क) बारह िषव स ेकम आय ुका नहीं हो; और (ख) जिसन े एएसओसी अनुदत्त करने के जलए जनयम 5 के अधीन जिजनर्दवष्ट परीक्षा उत्तीण व की हो। परन्त ु दक केंद्रीय सरकार प्रिासजनक अनुमजत और समय-समय पर जिजनर्दवष्ट ऐसे जनबंधन और ितों के अधीन रहत े हुए, दकसी ऐसे व्यजि को, िो भारत का नागठरक नहीं है, एएसओसी अनुदत्त करन े पर जिचार करन े के जलए जनयम 5 के[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 अधीन परीक्षा दने े की अनुमजत दे सकती ह ै या उपजनयम (2) के उपबंधों के अधीन रहत े हुए, उसे प्रमाण-पत्र अनुदत्त कर सकती ह ै ।

(2) केन्द्रीय सरकार, जिदेि मत्रं ालय की जनबंधन तथा ितों और प्रिासजनक अनुमजत के अधीन रहते हुए, दकसी भी व्यजि को, िो भारत का नागठरक नहीं ह,ै तथा जिसके पास उस देि के सक्षम प्राजधकारी द्वारा िारी प्रमाण-पत्र ह,ै िो जनयम 6 के अधीन अनदु त्त प्रमाण-पत्र के समान ह,ै इन जनयमों के अधीन एएसओ प्रमाण-पत्र अनुदत्त करने के जलए, इस प्रयोिन के जलए जिजनर्दवष्ट प्रारूप म,ें एक हिार रुपए के फीस के साथ पोटवल पर आिेदन करने की अनुज्ञा दे सकती ह।ै

(3) केन्द्रीय सरकार ऐसे राष्ट्रों की सूची जिजनर्दवष्ट करेगी जिनके द्वारा अनुदत्त प्रमाण-पत्रों पर उप-जनयम (2) के अधीन एएसओसी अनुदत्त करन े के जलए जिचार दकया िाएगा।

5. एमचे र स्ट्टेिन प्रचालक परीक्षा — (1) जनयम 4 के अधीन घोजषत यथा लागू पात्रता मानदडं ों को पूरा करन े िाला कोई भी व्यजि एएसओसी अजधप्राप्त करने हते ु एमेचर स्ट्टेिन प्रचालक की परीक्षा म ें िाजमल होने के जलए केंद्रीय सरकार को, इस प्रयोिन के जलए जिजनर्दवष्ट प्ररूप में पोटवल पर ऐसी परीक्षा की तारीख से एक मास पहले आिेदन कर सकता ह।ै

(2) उप-जनयम (1) के अधीन दकसी भी आिेदन के साथ एक सौ रुपये का परीक्षा फीस देना होगा।

(3) केन्द्रीय सरकार दकसी भी प्रिगव में एएसओसी अजधप्राप्त करने के जलए परीक्षा का पाठ्यक्म, स्ट्थान, रीजत, तारीख और समय प्रकाजित करेगी, िसै ा दक जनयम 3 के उप-जनयम (2) के अधीन जिजनर्दवष्ट ह,ै जिसमें ऐसी परीक्षा के पठरणामों की घोषणा की तारीख भी िाजमल होगी।

(4) ऐसी परीक्षा की भाषा अग्रं ेिी होगी, तथा एएसओसी (साधारण) के जलए परीक्षा म ें केन्द्रीय सरकार द्वारा जिजनर्दवष्ट मोसव कोड में प्रिीणता भी अपेजक्षत होगी।

(5) इस जनयम के अधीन परीक्षा म ें सफलतापूिवक उत्तीण व होन े के जलए एएसओसी के प्रत्येक प्रिगव म ें कुल अंकों का न्यूनतम चालीस प्रजतित लाना अपेजक्षत ह।ै

6. एमचे र स्ट्टेिन प्रचालक प्रमाण पत्र का अनदु त्त तथा जिजधमान्यता - (1) केंद्रीय सरकार, जनयम 5 के अधीन परीक्षा के सफलतापूिवक पूण व होन े पर एमेचर स्ट्टेिन प्रचालकों के जलए नीच े यथा जिजनर्दवष्ट फीस के संदाय के अध्यधीन रहत े हुए, अनन्य कॉल साइन के साथ जनम्नजलजखत प्रिगों के प्रमाण पत्र िारी कर सकेगी:

प्रमाण पत्र के प्रिग व फीस एएसओसी (साधारण) (i) बीस िषव की जिजधमान्य अिजध के जलए एक हिार रुपये; एएसओसी (प्रजतजषद्ध) (ii) आिीिन जिजधमान्य के जलए दो हिार रुपये। स्ट्पष्टीकरण - इस उप -जनयम के प्रयोिनों के जलए, अजभव्यजि "आिीिन" स े एएसओसी धारक के अस्ट्सी िष व की आय ु प्राप्त करन े तक अजभप्रेत ह।ै

(2) आिेदक द्वारा परीक्षा सफलतापूिवक पूणव करने पर, दकसी भी प्रिग व के एएसओसी के अनुदत्त के जलए संदाय, जनयम 5 के अधीन परीक्षा के पठरणाम की घोषणा की तारीख से दो िषव की अिजध के भीतर दकया िाएगा, जिसके न हो सकन े पर ऐसे आिेदक को कोई प्रमाण पत्र अनुदत्त नहीं दकया िाएगा:

परतुंक दक ऐसा आिेदक, िो एएसओसी अनुदत्त के जलए अपात्र हो िाता ह,ै उि प्रमाण पत्र के अनदु त्त के जलए जनयम 5 में जनर्दवष्ट परीक्षा में पुनः उपजस्ट्थत होने के जलए आिेदन कर सकेगा।

(3) जनयम 4 के उप-जनयम (2) के अधीन एएसओसी अनदु त्त करन े के जलए आिेदनों के संबंध म,ें केन्द्रीय सरकार ऐसे आिेदनों पर जिचार करन े के पश्चात,् ऐस े व्यजि के िीजा की अिजध के साथ सहजिस्ट्तारी अिजध के जलए या बारह महीन े की अिजध के जलए, िो भी कम हो, एएसओसी अनुदत्त कर सकती ह।ै

7. एमचे र स्ट्टेिन प्रचालक के जलए लाग ूसाधारण ित ें- (1) एएसओसी धारक फ्रीक्वेन्सी बैंड और एजमिन पर एमेचर स्ट्टेिनों का प्रचालन करेगा और एएसओसी के प्रत्येक प्रिग व के संबंध म ें केंद्रीय सरकार द्वारा यथा जिजनर्दवष्ट पािर पारेजषत करेगा और एएसओसी (साधारण) के धारक को िसै ा दक उसके एएसओसी म ें जिजनर्दवष्ट दकया िाए, एएसओसी (प्रजतजषद्ध) के धारक की तलु ना म ें अजधक एजमिन टाइप और उच्च पािर के उपयोग की अनुज्ञा दी िाएगी।

(2) प्रत्येक एमेचर स्ट्टेिन को एएसओसी म ें जिजनर्दवष्ट स्ट्थान पर जनम्नानुसार स्ट्थाजपत और प्रचाजलत दकया िाएगा,-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (क) यथा लाग,ू अजधजनयम के उपबंध और उसके अधीन बनाए गए जनयम;

(ख) इन जनयमों के उपाबंध क म ें जिजनर्दवष्ट जनबंधन और ित;ें और (ग) अतं राष्ट्रव ीय दरू संचार अजभसमय या रेजडयो जिजनयमों के उपबंध।

(3) एएसओसी धारक को एमेचर रेजडयो उपस्ट्कर के आयात के जलए एक पथृ क प्राजधकार की अपक्षे ा नहीं होगी।

(4) केंद्रीय सरकार दकसी भी समय एएसओसी धारक को जलजखत रूप म ें जिजनर्दविष्ट नोठटस द्वारा या उि नोठटस को पोटवल पर अपलोड करन े के द्वारा, एएसओसी की दकसी भी ित व को उपांतरठरत, पठरिर्तवत, रद्द या िापस कर सकती ह।ै

(5) एएसओसी धारक, एएसओसी की ितों म ें दकसी भी पठरितवन को प्रभािी करन े के जलए दकसी भी व्यय का दािा नहीं करेगा, िैसा केंद्रीय सरकार द्वारा अजधसूजचत दकया िाए।

(6) एएसओसी धारक, एक हिार रुपय े की फीस के संदाय पर करके अपन े एएसओसी की एक अनुजलजप िारी करन े या एमेचर स्ट्टेिन के स्ट्थान को बदलन े के जलए आिेदन कर सकता ह।ै

(7) एएसओसी धारक, प्राकृजतक जिपदा और आपदाओं के दौरान केंद्रीय सरकार या राज्य सरकार या केंद्रीय सरकार और राज्य सरकार द्वारा इस जनजमत जििेष रूप स े प्राजधकृत दकसी अजधकारी के अनुरोध पर जबना दकसी फीस या प्रभार के एमेचर सेिा फ्रीक्वेंसी बैंड म ेंरेजडयो संचार सेिाए ं प्रदान करेगा।

(8) एएसओसी धारक को भारत म ें रजिस्ट्रीकृत पोत पर एमचे र स्ट्टेिन स्ट्थाजपत करन े और प्रचाजलत करन े के जलए केंद्रीय सरकार द्वारा इस प्रयोिन हते ु पोटवल पर जिजनर्दवष्ट प्ररूप म ेंएक जिजनर्दवष्ट अनुरोध करन े के पश्चात अनुज्ञा दी िा सकती ह।ै

8. एमचे र स्ट्टेिन प्रचालक प्रमाण पत्र का निीनीकरण- (1) एएसओसी धारक जनयम 6 के उप-जनयम (1) म ें जिजनर्दवष्ट फीस के संदाय के साथ इस प्रयोिन के जलए पोटवल पर जिजनर्दवष्ट प्ररूप म ें इस ऐस े प्रमाण पत्र के अिसान की तारीख स े कम स े कम बारह मास पहल े आिेदन िमा करके अपन े एएसओसी के निीनीकरण के जलए आिेदन कर सकता ह।ै परंतुक दक ऐसी समय अिजध के अिसान के पश्चात और ऐसे अिसान की तारीख के दो िष व पश्चात तक निीनीकरण के जलए कोई आिेदन करना हो तो एक हिार रुपय ेके जिलंब फीस के संदाय पर आिेदन दकया िा सकता है;

परंतुक यह भी दक निीनीकरण के जलए एएसओसी के अिसान की तारीख से दो िष व के पश्चात प्राप्त होन े िाल े दकसी भी आिेदन पर जिचार नहीं दकया िाएगा।

(2) आिीिन प्रमाण पत्र की जिजधमान्यता िाले एएसओसी को इस प्रयोिन के जलए जिजनर्दवष्ट प्ररूप म ें एएसओसी धारक द्वारा दकए गए जिजनर्दष्टव अनुरोध पर जबना दकसी अजतठरि फीस के एक बार म ेंदस िष व के जलए बढाया िा सकता ह।ै

9. एएसओसी का जनलबं न या रद्दकरण – केंद्रीय सरकार दकसी एएसओसी को जनलंजबत या रद्द कर सकती ह ै यदद यह राय ह ैदक, एएसओसी धारक: (क) इन जनयमों के अधीन अनदु त्त एएसओसी के जनबंधनों और ितों या रेजडयो उपस्ट्कर के प्रचालन के संबंध म ें लाग ू जनयमों या अजधजनयम के दकसी अन्य उपबंध का पालन करन े म ें जिफल रहा ह;ै या (ख) अतं राष्ट्रव ीय दरू संचार अजभसमय या रेजडयो जिजनयमों के लाग ू उपबंधों का पालन करन ेम ें जिफल रहा ह,ै या (ग) िानबूझकर केंद्रीय सरकार को गलत या असत्य सूचना प्रस्ट्तुत की ह।ै परंतुक दक इस जनयम के अधीन जनलंबन या रद्दकरण का कोई आदेि तब तक नहीं ददया िाएगा िब तक दक एएसओसी धारक को ऐस े जनलंबन या रद्दकरण के जिरुद्ध अभ्यािेदन देन े या सुनिाई का युजक्त युक् त अिसर नहीं दे ददया गया हो।

10. फीस का प्रजतदाय नहीं - दकसी भी कारण स े एएसओसी के जनलंबन या रद्दकरण या एएसओसी के जनबंधनों और ितों के दकसी भी उपांतरण, पठरितवन, रद्दकरण या िापसी के पठरणामस्ट्िरूप कोई प्रजतकर या प्रजतदाय लाग ू नहीं होगा।

11. एएसओसी का अतं रण या अभ्य पणव - (1) एएसओसी गैर-अतं रनीय ह।ै

(2) एएसओसी धारक को दकसी भी समय पर ऐस े एएसओसी का अभ् यपणव करन े की अनुज्ञा होगी, परंतु दक ऐसे अभ् यपणव के जलए फीस का प्रजतदाय अनदु त् त नहीं दकया िाएगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5

12. एमचे र सोसायटी की दक्याकलापों के जलए एएसओसी का उपयोग-(1) कम स े कम चार एएसओसी धारकों का एक समूह एमेचर स्ट्टेिन की स्ट्थापना और प्रचालन के प्रयोिन के जलए एमेचर सोसायटी बनाने के जलए इस प्रयोिन हते ु पोटवल पर जिजनर्दवष्ट प्ररूप म ेंआिेदन तथा दो हिार रुपय े के फीस का संदाय कर सकता ह।ै

(2) उप-जनयम (1) के अधीन आिेदन म ें एएसओसी धारकों म ें स े एक आिेदक को प्रस्ट्ताजित एमेचर सोसायटी के अजभरक्षक के रूप म ें जिजनर्दवष्ट दकया िाएगा और ऐसी सोसायटी के भीतर ऐसी एमेचर सोसायटी की अजभरक्षता को पठरिर्तवत कर दकसी अन्य एएसओसी धारक को ददए िान े की सूचना इस प्रयोिन के जलए पोटवल पर जिजनर्दवष्ट प्ररूप म ें ऐस े पठरितनव के तीस ददन की अिजध के भीतर केंद्रीय सरकार को दी िाएगी।

(3) उपजनयम (1) के अधीन आिेदन प्राप्त होन े पर, केंद्रीय सरकार एमेचर सोसायटी के जलए एक जिजिष्ट कॉल साइन के साथ, जनबंधन और ितों के अधीन िैसा जिजनर्दवष् ट दकया िाए अनज्ञु ा दे सकती ह,ै िो बीस िषव की अिजध के जलए जिजधमान् य होगी या ऐसी एमेचर सोसायटी के अजभरक्षक के एएसओसी की जिजधमान् यता, िो भी कम हो, के साथ सहजिस्ट् तारी होगी।

(4) यदद उप-जनयम (1) के अधीन आिेदक में से कोई भी एमेचर सोसायटी छोड़ता है, तो उसके द्वारा ऐसी सोसायटी को छोड़न े से तीस ददनों के भीतर इस प्रयोिन के जलए पोटवल पर जनर्दवष्ट प्ररूप में केंद्रीय सरकार को ससं ूजचत दकया िाएगा।

(5) इस जनयम के अधीन दी गई अनुज्ञा तब तक जिजधमान्य बनी रहगे ी िब तक दक उप) जनयम-1) के अधीन आिेदक एएसओसी धारकों में स ेकम से कम चार एमेचर सोसायटी के सदस्ट्य बने रहत ेह।ैं

13. जिजनर्दष्टव आयोिनों के जलए जििषे कॉल साइन िारी करना - (1) केन्द्र ीय सरकार, पोटवल पर इस प्रयोिन के जलए यथा जिजनर्दवष्ट प्ररूप में आिेदन प्राप्त होने और दो सौ रुपये की फीस का संदाय करने पर एएसओसी धारकों और जनयम 12 के तहत गठित एमेचर सोसाइठटयों को दकसी जिजिष्ट आयोिन के जलए एक जििेष कॉल साइन समनुदेजित कर सकती ह।ै

(2) उप-जनयम (1) म ेंजनर्दवष् ट आिेदन, जिजिष्ट आयोिन से कम से कम नब् बे ददन पहल े प्रस्ट्त ुत दकया िा सकता ह।ै

(3) उप जनयम (1) के अधीन एक जििेष कॉल साइन जिजनर्दवष् ट आयोिन के प्रारंभ होन े की तारीख स े नब् ब े ददनों की अिजध तक जिजधमान् य होगा। परंतुक दक यदद जिजनर्दवष् ट आयोिन उक्त नब् बे ददनों की अिजध से आगे बढाया िाता है, तो एएसओसी धारक या एमेचर सोसायटी उप जनयम (1) के अधीन जििेष कॉल साइन के जलए नए आिेदन कर सकते ह।ैं

14. अजभलखे ों का जनरीक्षण और सचू ना मागं ना - प्रत्येक एएसओसी धारक का यह कतवव्य होगा दक िह जनरीक्षण के जलए अजभलेखों के साथ साथ एमेचर रेजडयो-उपस्ट् कर प्रस्ट्तुत करे और उसके संबंध म ें केंद्रीय सरकार द्वारा इस प्रयोिन हते ु प्राजधकृत अजधकारी द्वारा अपेजक्षत कोई अन्य सूचना प्रदान कर सके।

15. इन जनयमों का जडजिटल कायान्व ियन - केंद्रीय सरकार, अजधजनयम की धारा 53 को आग े बढाते हुए, आिेदन प्रस्ट्ततु करने, पाठ्यक्म, परीक्षा का स्ट्थान, रीजत, तारीख और समय का प्रकािन, परीक्षाओं के पठरणामों की घोषणा और इन जनयमों के अधीन यथा जिजनर्दवष्ट एएसओसी और अन्य अनुज्ञाएं प्रदान करन े सजहत इन जनयमों के जडजिटल कायावन्ियन के जलए एक पोटवल अजधसूजचत करेगी। उपाबधं क (जनयम 7(2)(ख) देजखए) एमचे र स्ट्टेिन की स्ट्थापना और प्रचालन के जलए जनबधं न और ित ें

1. एमचे र स्ट्टेिन का उपयोग- एमेचर स्ट्टेिन का उपयोग, प्राजधकृत फ्रीक्वेंसी बैंड के भीतर एमेचर स्ट्टेिन के प्रचालन को सुकर बनाने के जलए मानक फ्रीक्वेंसी और टाइम जसग्नल सर्िवस में पारेषण को प्राप् त करन े करन े के प्रयोिन के जलए उपयोग म ें जलया िा सकता ह।ै

2. सदं ेि -(1) (क) रेजडयो संचार का आदान-प्रदान अन्य प्राजधकृत एमेचर स्ट्टेिनों के साथ दकया िा सकता ह।ै एमेचर स्ट्टेिन उन देिों के एमेचर स्ट्टेिनों के साथ संचार नहीं करेंग े जिनके प्रिासन ने ऐस े रेजडयो संचार पर अपनी आपजत्त के बारे म ें अंतरराष्ट्रीय दरू संचार अजभसमय को अजधसूजचत दकया ह।ै (ख) पारेषण सरल भाषा म ेंदकया िाएगा तथा तकनीकी प्रकृजत के संदेिों तक सीजमत होगा।

(2) प्राजधकृत अजस्ट् तत् ि जनम्नजलजखत संदेि पारेजषत नहीं करेगी:6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ब्रॉडकास्ट्ट कायवक्मों (क) , टेप ठरकॉर्डिंग या मनोरंिन के साधन या संगीत के पारेषण का पनु :उत् पादन;

(ख) झूिे या भ्रामक कॉल, जसग्नल्स, समाचार, जिज्ञापन, कारबार की संसूचानाएं, रािनीजतक या औद्योजगक जििाद के जिषयों पर कथन, या तीसरे पक्ष के संदेि; या (ग) अभद्र, अश्लील, आपजत्तिनक भाषा या संकेतों का उपयोग।

(3) सामान्य दरू संचार सुजिधाओं की जिफलता की दिा में एएसओसी धारक को केन् द्रीय सरकार या राज्य सरकार द्वारा प्राकृजतक या मानि जनर्मवत आपदाओं से संबंजधत थड व पाटी के सेदेिों को संभालन े की अनज्ञु ा दी िा सकती ह,ै िो सक्षम जसजिल प्राजधकारी अथावत् जिला मजिस्ट्रेट या उपायुि या जिला कलेक्ट र या उनके द्वारा प्राजधकृत दकसी अन्य अजधकारी द्वारा ददये गए हों और संबोजधत ह।ैं

3. फ्रीक्वेंसी, उत्स िनव और पॉिर - एमेचर स्ट्टेिन का प्रचालन उन फ्रीक्वेंसी पर दकया िाएगा िो संबंजधत प्रिगव के प्रमाण पत्र के जलए प्राजधकृत फ्रीक्वेंसी बैंड के भीतर ह ैं और उत् सिवन और पॉिर की ऐसी प्रिग व पर ह ै िो दक केन्द्र ीय सरकार द्वारा यथा जिजनर्दवष् ट ह।ै

4. फ्रीक्वेंसी जनयत्रं ण और माप-(1) रांसजमटटंग साजधत्र को यथा संभि सटीक रूप स ेट्यनू दकया िाएगा तादक यह सुजनजश्चत दकया िा सके दक प्राजधकृत फ्रीक्वेंसी बैंड की सीमाओं के बाहर दकसी भी फ्रीक्वेंसी पर दकसी उिा व का जिदकरण ना हो।

(2) एएसओसी धारक के पास प्राजधकृत एमेचर स्ट्टेिन पर फ्रीक्वेंसी को मापन े िाला एक जिश्वसनीय उपस्ट् कर होगा तादक प्रत्येक बार रांसमीटर की फ्रीक्वेंसी बदलने पर और िब भी यह िांचना आिश्यक हो दक रांसजमटेड फ्रीक्वेंसी में उत् सिवन प्राजधकृत फ्रीक्वेंसी बैंड के भीतर ह ै को सत्याजपत दकया िा सके। एएसओसी धारक फ्रीक्वेंसी मापने िाले उपस्ट् कर की सटीकता बनाए रखन े के जलए सभी आिश्यक कदम उिाएगा।

(3) एमेचर स्ट्टेिन के जलए यथा लागू फ्रीक्ि ेंसी आिंटन हते ु स्ट्थ ायी सलाहकारी सजमजत (एसएसीएफए) की अनुमजत अपेजक्षत होगी।

5.हस्ट्त क्षपे जिजहन -(1) एमेचर स्ट् टेिन को इस तरह से जडिाइन, जनर्मवत, स्ट्थाजपत, अनुरजक्षत और कायरव त बनाया िाएगा दक दकसी भी प्राजधकृत रेजडयो संचार सेिा में कोई हस्ट्त क्षपे न हो।

(2) स्ट्टेिन द्वारा हस्ट्त क्षपे दकए िाने की जस्ट्थजत म ें एएसओसी धारक केंद्रीय सरकार या दकसी लैंड स्ट्टेिन के अनुरोध पर उपस्ट् कर के लंजबत समायोिन तक पारेषण को बंद कर देगा या प्रजतजबद कर दगे ा।

(3) एएसओसी धारक केन् द्रीय सरकार द्वारा यथा जिजनर्दवष् ट ऐसे उत् सिवन का ( डैम्प्ड िेि) उपयोग नहीं करेगा।

6. रेजडयो सिे ा की लॉग डायरी- (1) एमेचर स्ट्टेिन स े आने िाल े या प्राप्त होने िाले सभी पारेषणों का कालानुक्जमक अजभलेख बाउंड बुक (नॉट लूि- लीफ) म ेंरखा िाएगा, जिसम ेंजनम्नजलजखत दिावया िाएगा नामत: (क) प्रत्येक पारेषण की तारीख और समय;

(ख) आदान-प्रदान दकए गए सचं ार का सार; (ग) दकए गए प्रयोगों और परीक्षणों का संजक्षप्त जििरण; (घ) उन स्ट्टेिनों या स्ट्टेिनों का कॉल साइन, जिनके साथ संदिे ों का आदान-प्रदान दकया गया ह ै प्रत्येक मामल े म ें दकए गए पारेषण का समय और प्रकार;

(ङ) एमेचर स्ट्टेिन के खलु ने और बंद होन े का समय; और (च) पोटेबल या मोबाइल एमेचर स्ट्टेिन की दिा म ेंअस्ट्थायी स्ट्थान की जिजिजष्ट यां।

(2) लॉग म ेंसभी समय भारतीय मानक समय म ेंजलख े िाएंगे।

(3) लॉग म ें प्रजिजष्टयों के बीच कोई स्ट् थान नहीं छोड़ा िाएगा और उन्ह ें प्राजप् त और पारेषण के समय तैयार और दि व दकया िाएगा।

(4) एएसओसी धारक लॉग को नष्ट करने स े पहल े उसम ें अंजतम प्रजिजष्ट की तारीख स े एक िषव की अिजध के जलए संरजक्षत रखेगा: परंतुक दक दकसी भी लॉग को ऐसी अजतठरि अिजध के जलए नष्ट नहीं दकया िाएगा िैसा दक केंद्रीय सरकार जनदेजित करे।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7

7. एमचे र रेजडयो उपस्ट्क र- (1) एमेचर स्ट्टेिन ग्रहण के साथ-साथ पारेषण के परंतुक दक दकसी भी लॉग को ऐसी अजतठरि अिजध के जलए नष्ट नहीं दकया िाएगा िैसा दक केंद्रीय सरकार जनदेजित करे। जलए भी तैयार होगा।

(2) एएसओसी धारक द्वारा उपयोग दकए िाने िाले या उपयोग दकए िाने के जलए आिजचत एमेचर रेजडयो उपस्ट् कर और अन्य उपसाधन इस तरह से सव्यु िजस्ट्थत दकए िाएंग े तादक दकसी व्यजि की सुरक्षा को खतरा न हो औरया दकसी भी सेिा में / बाधा न आए।

(3) इन एमेचर रेजडयो उपस्ट् कर को सुरजक्षत जस्ट्थजत म ेंऔर ऐसी रीजत रखा िाएगा जिससे दक अनाजधकृत व्यजियों की उस तक पहुचं न हो।

(4) प्रत्येक एएसओसी धारक को उसके द्वारा उपयोग दकए िाने िाले एमेचर रेजडयो उपस्ट् कर का अजभलेख नीच े जिजनर्दवष्ट प्ररुप के अनुसार रखना होगा: क्. स.ं उपस्ट् कर की जिजिजष्ट यां जिस व्यजि स े प्राप्त दकया गया ह ै प्राजप्त या उसका नाम और पता (यदद प्राजधकृत असेम्बल की मेक मॉडल और क्म स.ं संस्ट्था द्वारा असेम्बल दकया गया हो तारीख टाइप तो स्ट्िजनर्मवत जलखें)

(1) (2) (3) (4) क्य की दिा म ें उस व्यजि का नाम और पता जिसे जिक्य जिक्य या क्ेता के नाम पर ठटप्पणी रसीद संख्या द ें या अतं ठरत दकया गया ह।ै अतं रण की िारी प्रमाण पत्र- और जिक्ेता का तारीख की जिजिजष्ट यां प्रमाणपत्र- संख्या बताए ं

8. पत्राचार की गोपनीयता - यदद कोई ऐसा संदेि जिसे एएसओसी धारक प्राप्त करने का हकदार नहीं ह,ै तो ऐसा एएसओसी धारक इसकी जिषय-िस्ट्तु, इसके स्रोत या गंतव्य, इसकी जिद्धमानता या इसकी प्राजप्त के तथ्य को दकसी व्यजि (केन्द्रीय सरकार या दकसी न्यायालय द्वारा इस प्रयोिन के जलए प्राजधकृत अजधकारी से जभन् न) को नहीं बताएगा या बतान े की अनुमजत नहीं दगे ा और ऐसे एएसओसी धारक ऐसे संदेि का जलजखत रूप म ें जलजखत तैयार करन,े प्रजत बनाने या उपयोग नहीं करेंग,े या जलजखत रूप म ेंतैयार करने, प्रजत बनाने या उपयोग करन े की अनुमजत नहीं दगें े।

9. साधारण रेजडयो सचं ार प्रदक्या-(1)(क) पारेषण स े पूिव, स्ट्टेिन को यह सुजनजश्चत करन े के जलए सािधानी बतेगा दक उनके उत् सिवन के कारण पहले स े चल रह े पारेषण म ें हस्ट् तक्षेप न हो। यदद ऐसे दकसी हस्ट्त क्षपे की संभािना होती ह ै तो पारेषण को तब तक िुरू नहीं दकया िाएगा िब तक दक चल रह ेसंचार म ेंसमुजचत जनयंत्रण न हो। (ख) प्रमाण-पत्र म ें अंदकत कॉल साइन को पारेषण की प्रत्येक अिजध के आरंभ और अंत म ें पहचान के जलए भेिा िाएगा। िब पारेषण की अिजध दस जमनट स े अजधक हो िाती ह ैतो कॉल साइन को दोहराया िाएगा। एएसओसी धारक जबना पहचान के या गलत पहचान के साथ पारेषण नहीं करेग।ें (ग) लम्बी कॉल और पारेषण स े बचा िाएगा। (घ) िब कॉल साइन, कजतपय अजभव्यजिया,ाँ कठिन िब्द, संजक्षप्ताक्षरी, आकड़ ें आदद का उच्चारण करना आिश्यक हो, तो अंतराष्ट्रव ीय दरू संचार अजभसमय म ें ददए गए ध्िन्यात्मक िणवमाला और दफगर कोड का उपयोग दकया िाएगा।

(2) कॉल और उत्तर की प्रदक्या:

(a) कॉल म ें कॉल दकए गए स्ट्टेिन का कॉल साइन होगा, िो दक तीन बार स े अजधक कॉल नहीं दकया िाएगा; िब्द डीई (मोस व पारेषण की दिा म)ें और िब्द "ददस इस" (टेलीफोनी की दिा में) कॉल करने िाले स्ट्टेिन का कॉल साइन तीन बार स ेअजधक नहीं होगा।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) कॉल के उत्तर म ें जनम्नजलजखत बातें िाजमल होंगी- कॉल करने िाले स्ट्टेिन का कॉल साइन, तीन बार स े अजधक नहीं;

िब्द डीई (मोस व पारेषण की दिा म)ें और िब्द "ददस इस" (टेलीफोनी की दिा म)ें । कॉल दकए गए स्ट्टेिन का कॉल साइन, तीन बार स ेअजधक नहीं। (ग) कॉल दो जमनट के अंतराल पर तीन बार भेिी िा सकेगी; उसके पश् चात ् इस े 10 जमनट के अतं राल तक दोहराया नहीं िाएगा जिसके दौरान प्रचालक उस फ्रीक्वेन्सी म ें सुनगे े जिस पर कॉल की गई ह।ै (घ) सभी स्ट्टेिनों पर साधारण कॉल की दिा म ें जसग्नल 'सीक्यू' (रेजडयोटेलीग्राफी की दिा म)ें और िब्द 'हलै ो आल स्ट्टेिन' या जसग्नल 'सीक्यू' (रेजडयोटेलीफोनी की दिा म)ें कॉललगं प्रदक्या म ें कॉल दकए गए स्ट्टेिन के कॉल साइन का स्ट्थान लगें े।

(3) पारेषण और काय व की समाजप्त: (क) संदेि का पारेषण जसग्नल एआर (मोस व पारेषण की दिा म)ें और िब्द 'ओिर' (टेलीफोनी की दिा में) द्वारा समाप्त दकया िाएगा। (ख) दो स्ट्टेिनों के बीच काय व की समाजप्त को उनम ें स े प्रत्येक द्वारा संकेत िीए (मोसव पारेषण की दिा म)ें के माध्यम स े और रेजडयोटेलीफोनी की दिा म ें 'आउट' िब्द (या िीए जिसे जिक्टर अल्फा बोला िाता ह)ै द्वारा उपदर्िवत दकया िाएगा।

(4) परीक्षण: (क) िब रांसमीटर या ठरसीिर के समायोिन या दकसी प्रयोग के जलए परीक्षण संकेत बनाना आिश्यक हो तो ऐस े संकेतों को 30 सेकंड स े अजधक समय तक िारी नहीं रखा िाएगा और यह िीिीिी की सीरीि से बना होगा जिसके बाद परीक्षण जसग्नल उत् सर्िवत करन े िाल े स्ट्टेिन का कॉल साइन होगा। रेजडयोटेलीफोनी की दिा म ें िीिीिी की सीरीि को दफगर कोड म ेंबोले गए 1,2,3,4... अंकों स े प्रजतस्ट्थाजपत दकया िाएगा। (ख)30 सेकंड स े अजधक के परीक्षण के जलए आर्टवदफिल एठरयल का उपयोग दकया िाएगा। एएसओसी (ग)धारक केठरयर िेि का उत् सिवन नहीं करेगें िब तक दक ऐस े केठरयर िेि इंटेजलजिबल मॉड्यलू ेिन के अधीन न हो।

10. जनरीक्षण-

(1) केन्द्रीय सरकार द्वारा जलजखत रूप म ें जनरीक्षण करन े के जलए प्राजधकृत कोई भी अजधकारी दकसी भी साजधत्र की जनरीक्षण, िांच या परीक्षण कर सकता ह ै तथा जनरीक्षण अजधकारी द्वारा िांच के जलए एएसओसी धारक प्रमाण- पत्र, स्ट्टेिन लॉग या अन्य ठरकॉडव उपलब्ध करिाएगा।

(2) केन्द्रीय सरकार द्वारा िब एएसओसी धारक को ऐसा करन े के जलए कहा िाएगा तो िह प्रमाण-पत्र, लॉग बुक या कोई अन्य अजभलेख या डाटा, केन्द्रीय सरकार द्वारा िांच के जलए भेिन े की व्यिस्ट्था करेग।ें

NOTIFICATION New Delhi, the 29th October, 2024 G.S.R. 675(E).— Whereas a draft of the Telecommunications (Amateur Station Operator) Rules, 2024, which the Central Government proposes to make in exercise of the powers conferred by section 47 read with clause (zi) of sub-section (2) of section 56 of the Telecommunications Act, 2023 (44 of 2023), was published as required by sub-section (1) of section 56 of the said Act vide notification of the Government of[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 India in the Ministry of Communications, Department of Telecommunications number G.S.R. 447(E), dated the 24th July, 2024, in the Gazette of India, Extraordinary, Part II, section 3, sub-section (i) dated the 24th July, 2024, inviting objections and suggestions from the persons likely to be affected thereby, before the expiry of the period of thirty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public;

And whereas copies of the said Official Gazette were made available to the public on the 25th July, 2024;

And whereas the objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government;

Now, therefore, in exercise of the powers conferred by section 47 read with clause (zi) to sub-section

(2) of section 56 of the Telecommunications Act, 2023 (44 of 2023), and in supersession of the Indian Wireless Telegraphs (Amateur Service) Rules, 1978, except as respects things done or omitted to be done before such supersession and without overriding the terms and conditions of existing arrangements under those rules till the date of expiry of such arrangements, the Central Government hereby makes the following rules, namely:–

1. Short title and commencement. – (1) These rules may be called the Telecommunications (Amateur Services) Rules, 2024.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions. – (1) In these rules, unless the context otherwise requires, -

(a) “Act” means the Telecommunications Act, 2023 (44 of 2023);

(b) “amateur radio equipment” means a radio equipment required for operating an amateur station;

(c) “amateur services” means radio communication services for the purpose of self-training, intercommunication and technical investigations carried out by an amateur, that is, by a duly authorised person interested in radio technique, solely with a personal aim and without any pecuniary interest;

(d) “amateur station” means a radio station operated by an amateur for amateur services;

(e) “Amateur Station Operator Certificate” or ASOC, means the ASOC (General) or the ASOC

(Restricted), as specified under sub-rule (2) of rule 3, and an “ASOC holder” means the person who has been granted such certificate under sub-rule (1) of rule 6;

(f) “International Telecommunication Convention” means the Convention of the International Telecommunication Union signed at Geneva in 1992 or any subsequent revision or modification thereof, which the Government of India has ratified or accepted;

(g) “portal” means the portal to be notified by the Central Government under rule 15 of these rules; and

(h) “Radio Regulations” means the regulations adopted by the World Radiocommunication Conference (Geneva 1995) and includes every revision or modification thereof, which the Government of India has ratified or accepted;

(2) Words and expressions used and not defined herein but defined in the Act, shall have the meanings respectively assigned to them in the Act.

3. Scope. – (1) No person shall install or operate an amateur station except under and in accordance with the terms and conditions of an ASOC granted under these rules.

(2) There shall be the following two categories of ASOC, which may be granted by the Central Government under sub-rule (1) of rule 6, namely,-

(a) Amateur Station Operator Certificate- General, or ASOC (General); and

(b) Amateur Station Operator Certificate- Restricted, or ASOC (Restricted).

4. Eligibility conditions for obtaining an Amateur Station Operator Certificate. – (1) The ASOC

(General) or the ASOC (Restricted), as the case may be, shall be granted under sub-rule (1) of rule 6 to10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] any person, being a citizen of India, who,-

(a) is not less than twelve years of age; and

(b) qualifies the examination specified under rule 5 for the grant of an ASOC:

Provided that the Central Government may, subject to administrative clearance and such terms and conditions as it may specify from time to time, permit a person, not being a citizen of India, to undertake the examination under rule 5 for consideration of the grant of an ASOC, or grant him such certificate, subject to the provisions of sub-rule (2).

(2) The Central Government may, subject to the terms and conditions and administrative clearance of the Ministry of External Affairs, permit any person, not being citizen of India, who holds a certificate issued by a competent authority of that country similar to that granted under rule 6, to apply for grant of ASO Certificate under these rules, in the form as may specified for this purpose in the portal along with a fee of one thousand rupees.

(3) The Central Government may specify the list of countries, the certificates granted by which, may be considered for grant of ASOC under sub-rule (2).

5. Amateur station operator examination. – (1) Any person satisfying the eligibility criteria set forth under rule 4, as may be applicable, may make an application for appearing in the amateur station operator examination for obtaining the ASOC, to the Central Government, in the form specified for this purpose in the portal, one month before the date of such examination.

(2) An application under sub-rule (1) shall be accompanied by examination fee of one hundred rupees.

(3) The Central Government shall publish the syllabus, place, manner, date and time for the examination for obtaining the ASOC in either category as specified under sub-rule (2) of rule 3, including the date of announcement of the results of such examination.

(4) The language of such examination shall be English, and examination for ASOC (General) shall also require such proficiency in Morse Code as may be specified by the Central Government.

(5) The successful completion of the examination under this rule shall require a minimum of forty per cent of the total marks in respect of each category of ASOC.

6. Grant and validity of the Amateur Station Operator Certificate. – (1) The Central Government shall, upon successful completion of the examination under rule 5, issue any of the following categories of certificate, as applied for, along with unique call signs for amateur station operators, subject to payment of fees as specified below,- Category of certificate Fees ASOC (General) (i) One thousand rupees for validity period of twenty years;

(ii) Two thousand rupees for lifetime validity.

ASOC (Restricted)

Explanation. - For the purposes of this sub-rule, the expression “lifetime” means till the ASOC holder attains the age of eighty years.

(2) On successful completion of the examination by the applicant, payment for the grant of ASOC of either category shall be made within a period of two years from the date of declaration of results of the examination under rule 5, failing which no certificate shall be granted to such applicant:

Provided that such applicant, who becomes ineligible for grant of ASOC may apply for reappearing in the examination referred to in rule 5 for grant of the said certificate.

(3) In respect of applications for grant of ASOC under sub-rule (2) of rule 4, the Central Government may, after consideration of such applications, grant an ASOC for a duration that is co-terminus with the duration of the visa of such person, or for a period of twelve months, whichever is lesser.

7. General conditions applicable to an amateur station operator. – (1) An ASOC holder shall operate amateur stations on such frequency bands and emissions and transmit power as specified by the Central[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 11 Government in respect of each category of ASOC, and the holder of ASOC (General) shall be permitted use of more emission types and higher power as may be specified in his ASOC, than the holder of ASOC

(Restricted).

(2) Every amateur station shall be installed and operated at the location specified in the ASOC in accordance with,-

(a) the provisions of the Act and any rules made thereunder, as may be applicable;

(b) the terms and conditions specified in Annexure A to these rules; and

(c) the provisions of the International Telecommunication Convention or Radio Regulations.

(3) An ASOC holder shall not require a separate authorisation for the import of amateur radio equipment.

(4) The Central Government may modify, vary, cancel or revoke any of the conditions of the ASOC at any time either by specific notice in writing to the ASOC holder, or by uploading the said notice in the portal.

(5) The ASOC holder shall not claim any expense to give effect to any variations in the conditions of the ASOC as may be notified by the Central Government.

(6) The ASOC holder may apply for issuance of a duplicate of his ASOC or apply to change the location of the amateur station, upon payment of fees of one thousand rupees.

(7) The ASOC holder shall provide radio communication services in amateur services frequency band, at the request of the Central Government, or a State Government, or any officer specially authorised in this behalf by the Central Government or a State Government, during natural calamities and disasters, without any fees or charge.

(8) The ASOC holder may be permitted to install and operate an amateur station on board a ship registered in India, upon placing a specific request in the form as may be specified for this purpose in the portal, by the Central Government.

8. Renewal of Amateur Station Operator Certificate. – (1) An ASOC holder may apply for renewal of his ASOC by making an application in the form specified for this purpose in the portal, at least twelve months prior to the date of expiry of such certificate, along with payment of fees as specified in sub-rule

(1) of rule 6:

Provided that any application for renewal after the expiry of such time period and up to two years after the date of such expiry, may be made upon payment of late fees of one thousand rupees:

Provided further that no application for renewal shall be considered if received after two years from the date of expiry of the ASOC.

(2) An ASOC with lifetime validity may be extended for ten years at a time, without any additional fees, upon specific request made by the ASOC holder in the form specified for this purpose.

9. Suspension or cancellation of ASOC. – The Central Government may suspend or cancel an ASOC, if in its opinion, the ASOC holder has, -

(a) failed to comply with the terms and conditions of the ASOC granted under these rules, or the rules applicable in respect of operation of radio equipment, or any other provision of the Act; or

(b) failed to comply with the applicable provisions of the International Telecommunication Convention or the Radio Regulations; or

(c) wilfully furnished incorrect or false information to the Central Government:

Provided that no order of suspension or cancellation under this rule shall be made unless the ASOC holder has been given a reasonable opportunity of making a representation and being heard against such suspension or cancellation.

10. No refund of fees. – No compensation or refund of fees shall be applicable as a result of any suspension or cancellation of the ASOC for any reason whatsoever, or for any modification, variation, cancellation or revocation of terms and conditions of the ASOC.12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

11. Transfer or surrender of ASOC. – (1) The ASOC shall be non-transferable.

(2) The ASOC holder shall be permitted to surrender such ASOC at any point of time, provided that no refund of fees shall be granted for such surrender.

12. Use of ASOC for activities of an amateur society. – (1) A group, comprising a minimum of four ASOC holders may submit an application in the form specified for this purpose in the portal, and payment of fees of two thousand rupees, to form an amateur society, for the purpose of installation and operation of an amateur station.

(2) The application under sub-rule (1) shall specify one of the applicant ASOC holders as the custodian of the proposed amateur society and any change of custodianship of such amateur society to any other ASOC holder within such society, shall, within a period of thirty days of such change, be communicated to the Central Government in such form as may be specified for this purpose in the portal.

(3) Upon receipt of the application under made sub-rule (1), the Central Government may grant permission subject to such terms and conditions as it may specify for the amateur society, along with a unique call sign, which shall be valid for a period of twenty years, or co-terminus with the validity of the ASOC of the custodian of such amateur society, whichever is lesser.

(4) If any of the applicant under sub-rule (1) leaves the amateur society, the same shall be communicated within a period of thirty days from the date of leaving such society to the Central Government in the form specified for this purpose in the portal.

(5) The permission granted under this rule shall continue to remain valid so long as at least four of the applicant ASOC holders under sub-rule (1) continue as members of the amateur society.

13. Issue of special call signs for specific events. – (1) The Central Government may assign a special call sign for a specific event to ASOC holders and to the amateur societies constituted under rule 12, on receipt of an application in such form as may be specified for this purpose in the portal, and on payment of fees of two hundred rupees.

(2) The application referred to in sub-rule (1) may be submitted at least ninety days before the specific event.

(3) A special call sign assigned under sub-rule (1) shall be valid for a period of ninety days from the date of

commencement of the specific event:

Provided that where the specific event extends beyond the said period of ninety days, the ASOC holder or the amateur society may apply for the special call sign by making a fresh application under sub-rule (1).

14. Inspection of records and calling for information. – It shall be the duty of every ASOC holder to produce for inspection, records, as well as, amateur radio equipment, and to give any other information in connection therewith as may be required by an officer authorised for this purpose by the Central Government.

15. Digital implementation of these rules. – The Central Government shall, in furtherance of section 53 of the Act, notify a portal for the digital implementation of these rules, including for submission of applications, publication of syllabus, place, manner, date and time of examination, declaration of results of examinations, and grant of ASOC and other permissions as specified under these rules.

Annexure A (See rule 7(2)(b)) Terms and conditions for the installation and operation of amateur station

1. Use of the amateur station. - The amateur station may be used for the purpose of receiving transmissions in the Standard Frequency and Time Signal Service to facilitate operation of the amateur station within the authorised frequency bands.

2. Messages. - (1) (a) Radio communications may be exchanged with other authorised amateur stations.

The amateur stations shall not communicate with amateur stations of countries whose administrations have notified the International Telecommunication Convention of their objection to such radio communications;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 13

(b) Transmissions shall be made in plain language and limited to messages of a technical nature.

(2) The authorised entity shall not transmit messages containing, -

(a) reproduction of broadcast programmes, tape recordings or transmissions of entertainment value or music;

(b) false or misleading calls, signals, news, advertisements, communications of business, statements on topics of political or industrial controversy, or third party messages; or

(c) use of indecent, obscene, offensive language, or signals.

(3) In case of failure of normal telecommunication facilities, an ASOC holder maybe permitted by the Central Government or State Government to handle third party messages pertaining to natural or manmade calamities, originating from and addressed to a competent civil authority namely, District Magistrates or Deputy Commissioners or Collectors of the district or any other officer authorised by them.

3. Frequencies, emissions and power. - The amateur station shall be operated on frequencies that are within the frequency bands authorised to respective categories of certificates and on such classes of emissions and power as specified by the Central Government.

4. Frequency control and measurement. – (1) The transmitting apparatus shall be tuned as accurately as possible to ensure that no energy is radiant on any frequency outside the limits of the authorised frequency bands.

(2) The ASOC holder shall have at the authorised amateur station, a reliable frequency measuring equipment to verify, each time the frequency of the transmitter is changed and whenever it is necessary to check that the emissions in the transmitted frequency, are within the authorised frequency bands. The ASOC holder shall take all steps necessary to maintain the accuracy of the frequency measuring equipment.

(3) The Standing Advisory Committee for Frequency Allocation (SACFA) clearance shall be required for an amateur station, as applicable.

5. Non-Interference. - (1) The amateur station shall be so designed, constructed, erected, maintained and worked so as not to cause interference with any authorised radio communication service.

(2) In the event of interference being caused by the station, the ASOC holder shall discontinue, or restrict transmissions, pending adjustment of the equipment, on request from the Central Government or any land station.

(3) The ASOC holder shall not use such emissions (damped waves) as may be specified by the Central Government.

6. Log diary of the radio service. – (1) A chronological record of all transmissions emanating from or received at the amateur station shall be kept in bound book (not loose-leaf) showing the following,

namely: -

(a) date and time of each transmission;

(b) summary of the communications exchanged;

(c) brief description of the experiments and tests undertaken;

(d) call sign of station or stations with which messages have been exchanged, times and type of emission employed in each case;

(e) time of opening and closing down the amateur station; and

(f) in case of portable or mobile amateur station, the particulars of temporary location.

(2) All times in the log shall be stated in the Indian Standard Time.

(3) No gaps shall be left between entries in the log, and they shall be made at the time of receiving and transmitting.

(4) ASOC holder shall preserve the log for a period of one year from the date of last entry therein before it14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

is destroyed:

Provided that no log shall be destroyed for such further period as the Central Government may direct.

7. Amateur radio equipment – (1) The amateur station shall be equipped for reception as well as transmission.

(2) The amateur radio equipment and other accessories used or intended to be used by the ASOC holder shall be so arranged as not to endanger the safety of any person or interrupt any services.

(3) The amateur radio equipment shall be kept in a safe condition and housed in such manner as to preclude access to unauthorised persons.

(4) Each ASOC holder shall maintain records of amateur radio equipment used by such holder in the form

specified below:

8. Secrecy of correspondence. - If any message which a ASOC holder is not entitled to receive, is received, such ASOC holder shall not make known or allow to be made known its contents, its origin or destination, its existence or the fact of its receipt to any person (other than to an officer duly authorised for this purpose by the Central Government or a court of law) and such ASOC holder shall not reproduce in writing, copy or make any use of such message or allow the same to be reproduced in writing, copied or made use of.

9. General radiocommunication procedure. - (1)(a) Before transmitting, the station shall take precautions to ensure that its emissions will not interfere with transmissions already in progress. If such interference is likely, the transmission shall not commence till there is an appropriate break in the communications in progress.

(b) The call sign endorsed in the certificate shall be sent for identification at the beginning and at the end of each period of transmission. When the period of transmission exceeds ten minutes the call sign shall be repeated. ASOC holder shall not make transmission without identification or with false identification.

(c) Prolonged calls and transmissions shall be avoided.

(d) When it is necessary to spell out call sign, certain expressions, difficult words, abbreviations, figures etc., the phonetic alphabet and figure code given in the International Telecommunication Convention shall be used.

(2) Call and Reply Procedure:

(a) The call shall consist of the call sign of the station called not more than three times; the word DE (in case of Morse transmission) and the words "This is" (in case of telephony), the call sign of the calling station, not more than three times.

(b) The reply to call shall consist of - the call sign of the calling station not more than three times; the word DE (in case of a Morse transmission) and the words "This is" (in case of telephony), the call sign of the station called, not more than three times.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 15

(c) The call may be sent three times at intervals of two minutes; thereafter it shall not be repeated until an interval of 10 minutes during which the operator shall listen in the frequency band in which the call has been made.

(d) In case of general call to all stations the signal ‘CQ' (in case of radiotelegraphy) and the words ‘Hello all stations’ or the signal ‘CQ' (in case of radiotelephony) shall replace the call sign of the station called in the calling procedure.

(3) End of Transmission and Work:

(a) Transmission of a message shall be terminated by the signal AR (in case of Morse transmission) and the word ‘Over’ (in case of telephony).

(b) The end of work between two stations shall be indicated by each of them by means of signal VA (in case of Morse transmission) and by the word ‘OUT' (or VA spoken as Victor Alfa) in case of radiotelephony.

(4) Tests:

(a) When it is necessary to make test signals either for the adjustment of a transmitter or a receiver or for any experiment, such signals shall not be continued for more than 30 seconds and shall be composed of series of VVV followed by the call sign of the station emitting the test signals. In case of radiotelephony, series of VVV shall be replaced by the figures 1,2,3,4... spoken in the figure code.

(b) For tests exceeding 30 seconds, an artificial aerial shall be used.

(c) The ASOC holder shall not emit carrier wave unless such carrier wave is subjected to intelligible modulation.

10. Inspection. - (1) Any officer authorised by the Central Government in writing, to carry out an inspection, may inspect, examine, or test any apparatus, and the ASOC holder shall produce the certificate, the station log or other records for examination by the inspecting officer.

(2) The ASOC holder when called upon to do so by the Central Government shall arrange to forward the certificate, the log book, or any other record or data for examination by the Central Government.

The ASOC holder shall indemnify the Central Government against all actions, claims and demands which may be brought or made by any person in respect of any injury arising from any act permitted by the certificate.
