NOTIFICATION Sachivalaya, Gandhinagar, 20th February, 2026.

GUJARAT REGISTRATION OF MARRIAGES ACT, 2006.

No. GHY/02/HFWD/102026/5/B1:- The following draft Notification proposed to be made in exercise of the powers conferred by Section 21 of the Gujarat Registration of Marriages Act, 2006 (Gujarat Act No. 16 of 2006), is hereby published as required under section 21 of the said Act for inviting objections and suggestions from all persons likely to be affected thereby.

Notice is hereby given that the said draft Rules shall be taken into consideration by the Government of Gujarat after the expiry of thirty (30) days from the date of publication of this Notification in the Official Gazette.

Any objection or suggestion which may be received by the Additional Chief Secretary to the Government of Gujarat, Health and Family Welfare Department, New Sachivalaya, Gandhinagar, within the aforesaid period of thirty

(30) days, shall be duly considered by the Government.

IV-B Ex.-41 41-141-2 GUJARAT GOVERNMENT GAZETTE, EX., 20-02-2026 [ PART IV-B DRAFT NOTIFICATION GUJARAT REGISTRATION OF MARRIAGES ACT, 2006.

No. GHY/02/HFWD/102026/5/B1:- In exercise of the powers conferred by section 21 of the Gujarat Registration of Marriages Act, 2006, the Government of Gujarat hereby makes the following Rules further to amend the Gujarat Registration of Marriages Rules, 2006, namely:—

1. Short Title and Commencement. - (1) These Rules may be called the Gujarat Registration of Marriages

(Amendment) Rules, 2026.

(2) They shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.

2. Amendment of rule 2. - In Gujarat Registration of Marriages Rules, 2006 (hereinafter called “the Rules”), in rule 2, in sub-rule (1), after clause (a), the following clause shall be inserted, namely:—

(aa) “Assistant Registrar” means the Assistant Registrar appointed by the State Government under these Rules.

3. Substitution of rule 4. – In the said Rules, for rule 4, the following rule shall be substituted, namely:— “4. Procedure for Registration of Marriage. – (1) Every memorandum for registration of marriage shall be submitted to the jurisdictional Assistant Registrar in the manner and form specified in the Schedule to the Act and shall be accompanied by an application in Form ‘I’ appended to these rules.

(2) The memorandum shall be submitted in duplicate, duly signed by both parties to the marriage and by two witnesses, and shall be accompanied by such fee as may be prescribed by the State Government from time to time.

(3) The memorandum shall be accompanied by the following documents, duly notarized:—

(a) Copy of photo identity card of the parties and the witnesses, such as Driving Licence, Passport, or any photo identity document issued by the Central Government or the State Government;

(b) Copy of Aadhaar Card of the bride, the bridegroom and the witnesses;

(c) Birth Certificate or School Leaving Certificate of the bride and the bridegroom;

(d) Marriage invitation card, if any.

(4) The memorandum shall further be accompanied by:—

(a) Two recent passport-size photographs each of the bride and the bridegroom (separately);

(b) Two recent passport-size photographs each of the two witnesses; and

(c) One photograph of the bride and bridegroom taken at the time of solemnization of the marriage.

(5) The memorandum shall be accompanied by a declaration by the bride and bridegroom stating whether their parents, as the case may be, have or have not been informed of the marriage.

(6) At the time of submission of the memorandum, both the bride and the bridegroom shall furnish the

following particulars relating to their parents:—

(a) Aadhaar Card of father and mother, if available;

(b) Full name of father;

(c) Ordinary place of residence of father, along with full address;

(d) Mobile number of father;

(e) Full name of mother;

(f) Ordinary place of residence of mother, along with full address; and

(7) The Assistant Registrar, upon being satisfied that the memorandum is complete in all respects, shall, as expeditiously as practicable and in any case within ten (10) working days, send an intimation of such memorandum to the parents of the bride and bridegroom by Speed Post or in such form and manner as may be separately prescribed by the State Government, including electronic or physical means. The Assistant Registrar shall also forward the memorandum to the Registrar of Marriages having jurisdiction over the concerned Taluka or District.

(8) The Registrar shall, upon being satisfied of compliance with sub-rules (1) to (7), register the marriage after the expiry of thirty (30) days from the date of receipt of the memorandum from the Assistant Registrar.

(9) The Registrar shall cause the particulars of every registered marriage to be uploaded and/or published on such online portal as may be developed by the State Government for this purpose, including the Serial Number, Page, and Volume of the Register of Marriages maintained under the Act.

(10) Upon completion of registration, the Registrar shall issue a Certificate of Registration of Marriage in Form ‘II’, either in person or by post, to the parties to the marriage.”

4. Substitution of Form I. - For Form ‘I’ appended to the said Rules, the following Form shall be substituted,

namely:— FORM ‘I’ [See sub-rule (1) of Rule 4] Application for Memorandum of Marriage To, The Assistant Registrar,

Subject: Registration of Marriage Sir/Madam, A marriage has been solemnized between us on __________ at __________.

We hereby request that the following particulars of our marriage be entered in the Register of Marriages and that a Certificate of Registration of Marriage be issued to us.

We hereby solemnly declare that:

1. A valid marriage has been solemnized between us and the same is capable of being registered under Section 11 of the Gujarat Registration of Marriages Act, 2006 (Gujarat Act No. 16 of 2006);

2. The conditions prescribed under the applicable personal law governing the marriage have been duly satisfied;

3. The particulars stated herein are true and correct to the best of our knowledge and belief;

4. Our parents (if alive) have / have not been informed of the marriage;

5. A memorandum of marriage duly filled in (in duplicate), along with prescribed fees and supporting documents, is enclosed herewith.
