ऐस े आ्ेपों और सुझावों पर, िो तीस किनों की पूवोजि अवजध के समाि होने स े पहले उि प्रारूप जनयमों के संबंध म,ें ककसी व्यजि स े प्राि हो सकेंगे, केंद्रीय सरकार द्वारा जवचार ककया िाएगा; उि प्रारूप जनयमों के संबंध म ें आ्ेपों और सुझावों को संयिु सजचव (पौध संर्ण) कृजि एव ं ककसान कल्याण मंत्रालय, कृजि एव ं ककसान कल्याण जवभाग, कृजि भवन, नई किल्ली – 110001 अिवा jspp-dac@gov.in पर ईमले के माध्यम स े भेि े िा सकते ह।ैं प्रारूप जनयम

1. संज्ि नाम और प्रारंभ:- (1) इन जनयमों का संज्ि नाम कीटनािी संिोधन (नौवां संिोधन) जनयम, 2023 ह।ै

(2) यह रािपत्र म ें इनके अंजतम प्रकािन की तारीख को प्रवृ्त होंगे।

2. कीटनािी जनयम, 1971 (इसके पश्चात ् उि जनयम के रूप म ें संिर्भित) जनम्नजलजखत में संिोधन ककया िाएगा, अिाित-्

(1) जनयम 9 के उप-जनयम (1) के स्ट्िान पर जनम्नजलजखत प्रजतस्ट् िाजपत ककया िाएगा, अिाित:्- “(1) ककसी भी कीटनािक के जनमािण के जलए लाइसेंस िेन े के जलए लाइसेंससंग अजधकारी को जडजिटल रूप म ें [फॉमि II] में आवेिन ककया िाएगा और प्रत्येक कीटनािक के जलए िो हिार रुपय े का िुल्क और उन सभी कीटनािकों के जलए जिनके जलए लाइसेंस का आवेिन ककया गया ह ै अजधकतम बीस हिार रुपये का िुल्क िेना होगा।”

(2) जनयम 10 के उप-जनयम (1) के जलए, जनम्नजलजखत प्रजतस्ट्िाजपत ककया िाएगा अिाित:् - “(1) कीटनािकों को बेचन,े स्ट्टॉक करन े या जबक्री के जलए प्रिर्िित करन े या जवतररत करन े के जलए लाइसेंस िेन े के जलए आवेिन लाइसेंससंग अजधकारी को जडजिटल रूप म ें [फॉमि II] ककया िाएगा और उप-जनयम (2) में जनर्िष्टि िुल्क के साि सलं ग्न ककया िाएगा।”

(3) जनयम 15 म,ें

(i) उप-जनयम (2) में, वाकयांि “कीटनािक के अनुसार, एक रजिस्ट्टर में (या तो भौजतक रूप में या जडजिटल रूप में) ििि ककया िाएगा” को “जडजिटल रूप में कीटनािक के अनसु ार ििि ककया िाएगा” द्वारा प्रजतस्ट्िाजपत ककया िाएगा।”

(ii) उप-जनयम (3) में, वाकयांि “(या तो भौजतक रूप म ें या जडजिटल रूप में)” को “जडजिटल रूप म”ें द्वारा प्रजतस्ट्िाजपत ककया िाएगा।”

(iii) उप-जनयम (4) के स्ट्िान पर जनम्नजलजखत प्रजतस्ट्िाजपत ककया िाएगा, अिाित:्- “प्रत्येक जनमािता या आयातक तकनीकी ग्रेड कीटनािकों और फामूिलेिन कीटनािकों की जबक्री, जनमािण या आयात को जडजिटल रूप में बनाए रखगे ा और लाइसेंससंग अजधकारी को माजसक जववरण या ररटनि महीने की समाजि से 15 किनों के भीतर क्रमिः फॉमि III का पररजिष्ट डी 1 और फॉमि III का पररजिष्ट डी 2 में िमा करेगा ।”[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3

(4) जनयम 24 म;ें

(i) उप जनयम (3) में, िब्ि “तीन प्रजतयों म”ें को हटा किया िाएगा।

(ii) उप-जनयम (3) के बाि, जनम्नजलजखत उप-जनयम (4) डाला िाएगा; “(4) उप-जनयम (1) और (3) में बताए अनुसार ररपोटि की प्राजि और आपूर्त ि जडजिटल रूप म ेंकी िाएगी।”

(5) जनयम 25 म,ें उप-जनयम 25(2) के बाि, जनम्नजलजखत प्रावधान रख ेिाएंग:े - “परन्द्तु यह कक िल्ु क का भगु तान जडजिटल रूप म ें ककया िा सकता ह।ै ”

(6) जनयम 27 के उप-जनयम (6) के स्ट्िान पर जनम्नजलजखत को प्रजतस्ट्िाजपत ककया िाएगा, अिाित्:- “(6) नमूने लेने और स्ट्टॉक िब्त करन े सजहत अपने कतिव्यों के प्रिििन म ें उनके द्वारा ककए गए सभी जनरी्णों और की गई कारिवाई का जडजिटल ररकॉडि बनाए रखना और ऐसे ररकॉडि को लाइसेंससंग अजधकारी को प्रस्ट्तुत करना ।”

(7) जनयम 30 के स्ट्िान पर जनम्नजलजखत को प्रजतस्ट्िाजपत ककया िाएगा अिाित्:- “30. स्ट्टॉक का जनपटान न करन े के आििे का प्रपत्र - कीटनािक जनरी्क द्वारा एक आिेि जिसमें ककसी व्यजि को अपने कब्ि े म ें ककसी भी स्ट्टॉक का जनपटान न करन े की आवश्यकता होती है, वह भौजतक या जडजिटल रूप म ें फॉमि V (क) में होगा।”

(8) जनयम 32 के स्ट्िान पर जनम्नजलजखत को प्रजतस्ट्िाजपत ककया िाएगा अिाित्:- “32. िब्त ककए गए कीटनािक के जलए रसीि का फॉम-ि िब्त ककए गए ककसी भी कीटनािक के स्ट्टॉक के जलए कीटनािक जनरी्क द्वारा रसीि फॉमि V (ख) भौजतक या जडजिटल रूप म ेंहोगी।”

(9) जनयम 33 के स्ट्िान पर जनम्नजलजखत को प्रजतस्ट्िाजपत ककया िाएगा अिाित्:- “33. नमनू े लने े के प्रयोिन के जलए सचू ना का प्रपत्र- िहां एक जनरी्क परी्ण या जवश्लेिण के प्रयोिन के जलए कीटनािक का एक नमूना लते ा ह,ै वह उस व्यजि को फॉमि v (ग) म ें जलजखत रूप में ऐस े उद्देश्य की सूचना िेगा, जिस व्यजि से वह इस ेभौजतक या जडजिटल रूप में लेता ह ै।”

NOTIFICATION New Delhi, the 24th November, 2023 G.S.R. 868(E).—The Central Government aims for development of Integrated Pesticide Management System (herein after referred to as IPMS) at National level through the Directorate of Plant Protection, Quarantine and Storage, Department of Agriculture & Farmers Welfare, Ministry of Agriculture & Farmers Welfare, Government of India. The IPMS will help overcome the current gaps and issues faced in the pesticide value chain. Further, it will support the efforts of Government of India by enabling real-time monitoring of the supply chain of insecticides.

Whereas, the proposal for the development of IPMS at National level has been presented in the 65th Central Insecticides Board meeting. The Central Government is of the opinion that circumstances have arisen, which render it necessary to make the rules as per the proposal consulted with the Central Insecticide Board.

The following draft rules further to amend the Insecticides Rules, 1971, which the Central Government proposes to make in exercise of the powers conferred by section 36 of the Insecticides Act, 1968 (46 of 1968), is hereby published, as required by the said section, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which copies of this notification as published in the Gazette of India are made available to the public;

The Objections or suggestions which may be received from any person in respect of the draft rules before the expiry of the aforesaid period of thirty days shall be considered by the Central Government.

Objections and suggestions in respect to the said draft rule may be forwarded to the Joint Secretary (Plant Protection), Ministry of Agriculture and Farmers Welfare, Department of Agriculture and Farmers Welfare, Krishi Bhawan, New Delhi-110 001 or through email at jspp-dac@gov.in.

DRAFT RULES

1. Short title and Commencement: (1) These rules may be called the Insecticides (Ninth Amendment) Rules, 2023.

(2) They shall come into force on the date of their final publication in the official Gazette.

2. In the Insecticides Rules, 1971 (hereinafter referred to as the said rules), the following shall be amended, namely-

(1) For sub-rule (1) of rule 9, following shall be substituted namely :- “(1) Application for the grant of a licence to manufacture any insecticide shall be made in digital form [Form II] to the licensing officer and shall be accompanied by a fee of rupees two thousand for every insecticide and a maximum of rupees twenty thousand for all insecticides for which the licence is applied.”

(2) For sub-rule (1) of rule 10, following shall be substituted namely :- “(1) Applications for the grant of a licence to sell, stock or exhibit for sale or distribute insecticides shall be made in digital form [Form II] to the licensing officer and shall be accompanied by the fees specified in sub-

rule (2).”

(3) In rule 15,

(i) In Sub-rule (2), the word phrase “shall be entered insecticide wise, in a register (either in physical form or digital Form)” shall be substituted by “shall be made insecticide wise in digital form.”

(ii) In Sub-rule (3), the word phrase “(either in physical from or digital Form)” shall be substituted by “in digital form”.

(iii) For Sub-rule (4), following shall be substituted namely :- “Every manufacturer or importer shall maintain in digital form of such sale, manufacture or import of technical Grade Insecticide and formulated Insecticide and submit the monthly statement or return to the licensing officer, in Appendix D1 to Form III and Appendix D2 to Form III respectively within 15 days from the closing of the month.”

(4) In Rule 24;

(i) In sub rule (3), the word “in triplicate” shall be omitted.

(ii) After Sub-rule (3), the following sub-rule (4) shall be inserted;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 “(4) The receipt and supply of report as stated in sub-rule (1) and (3) shall be made in digital form.”

(5) In Rule 25, after Sub-rule 25(2), the following proviso shall be inserted ; “Provided further, the fee may be paid in the digital form.”

(6) For sub-rule (6) of rule 27, following shall be substituted namely :- “(6) to maintain digital record of all inspections made and action taken by him in the performance of his duties including the taking of samples and seizure of stocks and to submit such record to the licensing officer.”

(7) For Rule 30, following shall be substituted namely:- “30. Form of order not to dispose of stock.- An order by the Insecticide Inspector requiring a person not to dispose of any stock in his possession shall be in Form V(A) either in physical or digital form.”

(8) For Rule 32, following shall be substituted namely:- “32. Form of receipt for seized insecticide.- A receipt by an Insecticide Inspector for the stock of any insecticide seized shall be in Form V(B) either in physical or digital form.”

(9) For Rule 33, following shall be substituted namely:- “33. Form of intimation for purpose of taking samples.- Where an Inspector takes a sample of an insecticide for the purpose of test or analysis, he shall intimate such purpose in writing in Form V(C) to the person from whom he takes it either in physical or digital form.”

(10) In Rule 34, after Sub-rule 34(1) the following proviso shall be inserted; “Provided form of intimation for test or analysis may be issued in the digital form.” [F. No. 12032/02/2023-PP-I] ASHISH KUMAR SRIVASTAVA, Jt. Secy. (PP)
