1. सजं िप्त नाम और प्रारंभ- (1) इन जनयमों का संजिप्त नाम श्रम और रोिगार मंत्रालय, महाजनिेिालय, कारखाना सलाह सेिा और श्रम संस्ट्थान जनिेिक (औद्योजगक स्ट्िस्ट्थ िृत), उप जनिेिक (औद्योजगक स्ट्िस्ट्थ िृत) और सहायक जनिेिक (औद्योजगक स्ट्िस्ट् थिृत), समूह ‘क’ पि भती जनयम, 2023 ह।ै

(2) ये रािपत्र में इनके प्रकािन की तारीख को प्रिृत्त होंगे।

2. आििे न- ये जनयम इन जनयमों से उपाबद्ध अनुसूची के स्ट् तंभ (1) म ेंयथाजिजनर्िवष्ट पिों पर लागू होंगे।

3. पिों की सख्ं या, िगीकरण और िते न मट्रै रक्स म ें स्ट्तर– उि पिों की संख्या, उनका िगीकरण और िेतन मैट्ररक्स में स्ट्तर िे होंग ेिो उि अनुसूची के स्ट्तंभ (2) से स्ट्तंभ (4) में जिजनर्िवष्ट ह।ैं 3331 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

4. भती की पद्धजत, आय ुसीमा, अन्य अहतव ाएं, आदि – उक्त पि पर भती की पद्धजत, आय ु सीमा, अहतव ाए ं और उससे संबंजधत अन्य बातें िे होंगी िो उि अनुसूची के स्ट्तंभ (5) से स्ट्तंभ (13) म ेंजिजनर्िवष्ट ह।ैं

5. जनरहतव ा: िह व्यजि- (क) जिसन े ऐसे व्यजि, जिसका पजत या जिसकी पत्नी िीजित ह,ैं जििाह दकया ह,ै या जििाह की संजििा की ह;ै या (ख) जिसने अपन े पजत या अपनी पत्नी के िीजित रहत े हुए दकसी अन्य व्यजि से जििाह दकया ह ै या जििाह की संजििा की ह ैउि पिों पर जनयजु ि का पात्र नहीं होगा :— परन् त ु यदि केन्र ीय सरकार का यह समाधान हो िाता ह ै दक ऐसा जििाह ऐसे व्यजि और जििाह के अन्य पिकार को लागू स्ट्िीय जिजध के अधीन अनुज्ञेय ह ै और ऐसा करन े के जलए अन्य आधार ह ैं तो िह दकसी व्यजि को इस जनयम के प्रितवन से छूट िे सकेगी।

6. जिजथल करन े की िजि: िहां केन्रीय सरकार की यह राय ह ै दक ऐसा करना आिश्यक या समीचीन है, िहा ं िह उसके जलए िो कारण ह,ैं उन्ह ें लेखबद्ध और संघ लोक सेिा आयोग स े परामि व करके, इन जनयमों के दकसी उपबंध को दकसी िगव या प्रिगव के व्यजियों की बाबत, आिेि द्वारा जिजथल कर सकेगी।

7. व्यािजृ त्त: इन जनयमों की कोई बात, ऐसे आरिण, आय-ु सीमा में छूट और अन्य ट्ररयायतों पर प्रभाि नहीं डालगे ी, जिनका केन्रीय सरकार द्वारा इस संबंध में समय–समय पर िारी दकए गए आििे ों के अनुसार अनुसूजचत िाजतयों, अनुसूजचत िनिाजतयों, अन्य जपछड़ े िगों, भूतपूि व सैजनकों और अन्य जििेष प्रिग व के व्यजियों के जलए उपबंध करना अपेजित ह।ै अनसु चू ी पि का नाम पि की संख्य ा िगीकरण िेतन मैट्ररक्स में स्ट्तर चयन पि या अचयन पि है।

1. जनिेिक 3* (2024) साधारण केंरीय सेिा िते न मैट्ररक्स में स्ट्तर चयन। (औद्योजगक * कायवभार के आधार पर समूह-‘क’, रािपजत्रत, 12 (78800 रुपये – स्ट्िस्ट्थ िृत) पट्ररितवन दकया िा सकता ह।ै अननुसजचिीय। 209200 रुपये) सीधे भती दकए सीधे भती दकए िाने िाले सीधे भती दकए िाने िाले व् यजक् तयों के जलए पट्ररिीिा की अिजध, यदि िाने िाले व्यजियों व् यजियों के जलए अपेजित जिजहत आयु और िजै िक अहतव ाएं प्रोन् नत व् यजक् तयों कोई हो। के जलए आयु सीमा। िैजिक और अन् य अहतव ाएं। की ििा में लागू होंगी।

(10) (11) प्रोन् नजत द्वारा जिसके न हो सकने पर प्रोन् नजत द्वारा: प्रजतजनयुजि द्वारा जिसके अंतगवत िेतन मैट्ररक्स के स्ट् तर-11 (67700-208700 रुपये) में ऐसे उप-जनिेिक (औद्योजगक अल्पकाजलक संजििा भी है। स्ट्िस्ट्थ िृत) जिन् होंने उसमें पांच िषव की जनयजमत सेिा की है और व्यािसाजयक सुरिा और स्ट्िास्ट््य में िो सप्ताह का प्रजििण पूरा दकया ह।ै ट्रटप्प ण: िहां ऐसे कजनष् ठ व् यजियों के संबंध में, जिन् होंने अपनी अहकव या पात्रता सेिा पूरी कर ली ह,ै प्रोन् नजत के जलए जिचार दकया िा रहा हो, िहां उनके ज् येष् ठ व् यजियों के संबंध में भी जिचार दकया िाएगा परन् तु यह तब िब दक उसके द्वारा की गई ऐसी अहवक या पात्रता सेिा, अपेजित अहकव या पात्रता सेिा के आधे से अजधक से या िो िषव से, इनमें से िो भी कम हो, कम न हो और उन् होंने अपने ऐसे कजनष् ठ व् यजियों सजहत, जिन् होंने ऐसी अहकव या पात्रता सेिा पहले ही पूरी कर ली है, अगली उच् चतर श्रेणी में प्रोन् नजत के जलए[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 अपनी पट्ररिीिा की अिजध सफलतापूिवक पूरी कर ली हो। प्रजतजनयुजि (जिसके अंतगवत अल्पकाजलक संजििा भी ह)ै केंरीय सरकार या राज्य सरकारों या संघ राज्य िेत्र के प्रिासजनक स्ट्िािासी या कानूनी संगठन या पजललक सेक्टर उपक्मों या मान्यता प्राप्त जिश्वजिद्यालय या मान्यता प्राप्त अनुसंधान संस्ट्था के ऐसे अजधकाट्ररयों में से (क) (i) िो मूल काडर या जिभाग में जनयजमत आधार पर सििृ पि धारण दकए हुए हैं; या

(ii) जिन्होंने मूल काडर या जिभाग में िेतन मैट्ररक्स के स्ट्तर-11 (67700-208700 रुपये) या समतुल्य पि पर जनयजमत आधार पर जनयुजि के पश्चात उस श्रेणी में पांच िषव की सेिा की ह;ै और (ख) िो जनम्नजलजखत िैजिक अहतव ाएं और अनुभि रखते हैं,—

(i) दकसी मान्यता प्राप्त जिश्वजिद्यालय से रसायन जिज्ञान या िैि रसायन या औद्योजगक स्ट्िस्ट्थ िृत में स्नातकोत्तर जडग्री या बायोकेजमकल इंिीजनयररंग में स्नातक जडग्री और

(ii) दकसी अनुसंधान संस्ट्था में नमनू ों के रासायजनक जिश्लेषण में औद्योजगक स्ट्िस्ट्थ िृत में िस िषव का अनुभि। ग) िांछनीय: दकसी मान्यता प्राप्त जिश्वजिद्यालय से उपरोि आिश्यक अहताव के जलए सुसंगत डॉक्टरेट की जडग्री। ट्रटप्पण 1: पोषक प्रिगव के ऐसे जिभागीय अजधकारी, िो प्रोन्नजत की सीधी पंजि में है, प्रजतजनयुजि पर जनयजु ि के जलए जिचार दकए िाने के पात्र नहीं होंगे। इसी प्रकार प्रजतजनयुजि व्यजि प्रोन्नजत द्वारा जनयुजि के जलए जिचार दकए िाने के पात्र नहीं होंगे। ट्रटप्पण 2: प्रजतजनयुजि जिसके अंतगवत अल्पकाजलक संजििा भी ह,ै की अिजध, जिसके अंतगवत केंरीय सरकार के उसी या दकसी अन्य संगठन या जिभाग में इस जनयुजि से ठीक पहले धाट्ररत दकसी अन्य काडर बाह्य पि पर प्रजतजनयुजि जिसके अंतगवत अल्पकाजलक संजििा भी ह,ै की अिजध ह ैसाधारणतया 4 िषव से अजधक नहीं होगी। ट्रटप्पण 3: प्रजतजनयुजि जिसके अंतगवत अल्पकाजलक संजििा भी ह,ै द्वारा जनयुजि के जलए अजधकतम आयु सीमा आिेिन प्राप्त होने की अंजतम तारीख को 56 िषव से अजधक नहीं होगी। यदि जिभागीय प्रोन्नजत सजमजत है, तो उसकी संरचना भती करने में दकन पट्ररजस्ट्थजतयों में संघ लोक सेिा आयोग से परामि व दकया िाएगा।

(12) (13) जिभागीय प्रोन्नजत सजमजत (प्रोन्नजत के संबंध में जिचार प्रजतजनयुजि (जिसके अंतगवत् अल्पकाजलक संजििा भी ह)ै पर दकसी करने के जलए) जिसमें जनम्नजलजखत होंगे:- अजधकारी की जनयुजि करते समय संघ लोक सेिा आयोग से परामिव करना

1. अध्यि या सिस्ट्य, संघ लोक सेिा आयोग- अध्यि; आिश्यक है।

2. अपर सजचि या संयुि सजचि या जनिेिक, श्रम और रोिगार मंत्रालय - सिस्ट्य;

3. महाजनिेिक या उप महाजनिेिक, कारखाना सलाह सेिा और श्रम संस्ट्थान- सिस्ट्य।

(i) दकसी मान्यता प्राप्त जिश्वजिद्यालय से रसायन जिज्ञान (केंरीय सरकार द्वारा िारी या िैि रसायन या औद्योजगक स्ट्िस्ट्थ िृत में स्नातकोत्तर आयु: लागू नहीं है। सीधी भती दकए गए अनुिेिों या आिेिों के या बायोकेजमकल इंिीजनयररंग में स्नातक जडग्री। िैजिक अहतव ा: हां। दकए िाने िाले अनुसार सरकारी कमवचाट्ररयों

(ii) अनुसंधान संस्ट्थान म ें नमूनों के रासायजनक जिश्लेषण व्यजियों के के जलए पांच िषव की आयु तक जलए एक िषव। में औद्योजगक स्ट्िस्ट् थिृत में पांच िषव का अनुभि। जिजथल की िा सकती ह)ै । ट्रटप्पण: पट्ररिीिा को ट्रटप्पण 1: अहतव ाएं, अन्यथा सुअर्हतव अभ्यर्थवयों की ििा ट्रटप्पण 1: आयु-सीमा सफलतापूिवक में संघ लोक सेिा आयोग के जििेकानुसार जिजथल की अिधाट्ररत करने की जनणावयक पूरा करने के िा सकती ह।ै तारीख िह होगी िो संघ लोक जलए केंरीय सेिा आयोग द्वारा जिज्ञाजपत सरकार द्वारा की िाए। ट्रटप्पण 2: अनुभि संबंधी अहवताएं संघ लोक सेिा यथाजिजहत आयोग के जििेकानुसार अनुसूजचत िाजतयों और कम से कम िो अनुसूजचत िनिाजतयों के अभ्यर्थवयों की ििा में तब सप्ताह की जिजथल की िा सकती ह ै िब चयन के दकसी प्रक्म पर अिजध का संघ लोक सेिा आयोग की यह राय ह ै दक उनके जलए प्रिेि प्रजििण आरजित ट्ररजियों को भरने के जलए अपेजित अनुभि पूरा करना रखने िाले उन समुिायों के अभ्यर्थवयों के पयावप्त संख्या अजनिायव में उपललध होने की संभािना नहीं ह।ै होगा। िांछनीय: दकसी मान्यता प्राप्त जिश्वजिद्यालय से उपरोि उजल्लजखत आिश्यक अहतव ा के जलए डॉक्टरेट की जडग्री।

(i) चालीस प्रजतित प्रोन्नजत: जिभागीय प्रोन्नजत सीधी भती करते समय और सीधी भती द्वारा; और िेतन मैट्ररक्स के स्ट्तर-10 (56100-177500 रु.) म ें सजमजत (प्रोन्नजत के प्रजतजनयुजि (जिसके अंतगवत ऐसे सहायक जनिेिक (औद्योजगक स्ट्िस्ट्थ िृत ) जिन्होंने संबंध में जिचार अल्पकाजलक संजििा भी ह)ै

(ii) साठ प्रजतित उस श्रेणी में पांच िषव की जनयजमत सेिा की है और करने के जलए) पद्धजत पर अजधकारी की प्रोन्नजत द्वारा जिसके व्यािसाजयक सुरिा और स्ट्िास्ट््य में िो सप्ताह का जिसमें जनम्नजलजखत जनयुजि करते समय संघ न हो सकने पर प्रजििण प्राप्त दकया हो। होंग:े- लोक सेिा आयोग से प्रजतजनयुजि द्वारा ट्रटप्प ण: िहां ऐसे कजनष् ठ व् यजियों के संबंध में, 1. सजचि, श्रम और परामिव करना आिश्यक है। जिसके अंतगवत जिन् होंने अपनी अहकव या पात्रता सेिा पूरी कर ली है, रोिगार मंत्रालय - अल्पकाजलक संजििा प्रोन् नजत के जलए जिचार दकया िा रहा हो, िहां उनके अध्यि ;

भी ह।ै ज्य ेष् ठ व् यजियों के संबंध में भी जिचार दकया िाएगा 2. अपर सजचि या परन् तु यह तब िब दक उसके द्वारा की गई ऐसी अहवक संयुि सजचि या या पात्रता सेिा, अपेजित अहकव या पात्रता सेिा के जनिेिक, श्रम और आधे से अजधक से या िो िषव से, इनमें से िो भी कम रोिगार मंत्रालय - हो, कम न हो औश्र उन् होंने अपने ऐसे कजनष् ठ व् यजियों सिस्ट्य ;

केंरीय सरकार, राज्य सरकारों, संघ राज्य िेत्र, जिभागीय पुजष्ट प्रिासनों स्ट्िािासी या कानूनी सगं ठन, पजललक सेक्टर सजमजत (पुजष्ट के उपक्मों, मान्यता प्राप्त जिश्वजिद्यालय या मान्यता प्राप्त संबंध में जिचार अनुसंधान संस्ट्थाओं के ऐसे अजधकाट्ररयों से; क र न े क े ज ल ए ) (क) (i) जिन्होंने मूल काडर या जिभाग में जनयजमत जिसमें जनम्नजलजखत आधार पर सििृ पि धारण दकए हुए ह;ै या होंग:े-[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5

(ii) जिन्होंने मूल काडर या जिभाग में िेतन मैट्ररक्स के 1. अपर सजचि या स्ट्तर-10 (56100-177500 रुपए) या समतल्ु य म ें संयुि सजचि, श्रम जनयजमत आधार पर जनयजु ि के पश्चात उस श्रणे ी म ें और रोिगार पांच िषव की जनयजमत सेिा की हो; और मंत्रालय – अध्यि;

(ख) िो स्ट्तंभ संख्या (7) के अधीन सीधी भती दकए 2. जनिेिक या उप िाने िाले व्यजियों के जलए जिजहत िैजिक अहवताएं सजचि, श्रम और और अनुभि रखते ह।ै रोिगार मंत्रालय- सिस्ट्य; ट्रटप्प ण 1: पोषक प्रिगव के ऐसे जिभागीय अजधकारी 3. महाजनिेिक या िो प्रोन्नजत की सीधी पंजि में हैं, प्रजतजनयुजि पर उप महाजनिेिक, जनयुजि के जलए जिचार दकए िाने के पात्र नहीं होंगे। कारखाना सलाह इसी प्रकार, प्रजतजनयुि व्यजि प्रोन्नजत द्वारा जनयुजि सेिा और श्रम के जलए जिचार दकए िाने के पात्र नहीं होंगे। स ंस्ट्थान – सिस्ट्य। ट्रटप्प ण 2: प्रजतजनयुजि (जिसके अंतगवत अल्पकाजलक संजििा भी ह)ै की अिजध, जिसके अंतगवत केन्रीय सरकार के उसी या दकसी अन्य संगठन/जिभाग में इस जनयुजि से ठीक पहले धाट्ररत दकसी अन्य काडर बाह्य पि पर प्रजतजनयुजि (जिसके अंतगवत अल्पकाजलक संजििा भी ह)ै की अिजध ह,ै साधारणतया तीन िषव से अजधक नहीं होगी। ट्रटप्प ण 3: प्रजतजनयुजि (जिसके अंतगवत अल्पकाजलक संजििा भी ह)ै द्वारा जनयुजि के जलए अजधकतम आयु सीमा आिेिन प्राप्त होने की अंजतम तारीख को 56 िषव से अजधक नहीं होगी।

NOTIFICATION New Delhi, the 31st May, 2024 G.S.R 305(E).—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Directorate General, Factory Advice Service and Labour Institutes (Group ‘A’ and Group ‘B’ Posts) Recruitment Rules, 1989, in so far as they relate to the posts of Director (Industrial Hygiene), Deputy Director (Industrial Hygiene) and Assistant Director (Industrial Hygiene), except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Director (Industrial Hygiene), Deputy Director (Industrial Hygiene) and Assistant Director (Industrial Hygiene) in the Directorate General, Factory Advice Service and Labour Institutes, Mumbai under the Ministry of Labour and Employment, namely:-

1. Short title and commencement.- (1) These rules may be called the Ministry of labour and Employment, Directorate General, Factory Advice Service and Labour Institutes Director (Industrial Hygiene), Deputy Director (Industrial Hygiene) and Assistant Director (Industrial Hygiene), Group ‘A’ Posts Recruitment Rules, 2024.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.- These rules shall apply to the posts as specified in column (1) of the schedule annexed to these rules.

3. Number of posts, classification and level in pay matrix.- The number of the said posts, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age – limit, qualifications, etc. – The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.

5. Disqualification.- No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage with any person, shall be

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person form the operation of this rule.

6. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.- Nothing in these rules shall affect reservation, relaxation of age - limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the other Backward Classes, the Ex- servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

(b) possessing the following educational qualifications and experience,- i) Master Degree in Chemistry or Biochemistry or Industrial Hygiene or Bachelor Degree in Biochemical Engineering from a recognised University and ii) Ten years experience in Industrial hygiene in chemical analysis of samples in a research institution.

c) Desirable: Doctorate degree relevant to essential qualification above from a recognised University.

Note 1: The departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

Note 2: The period of deputation (including short - term contract) including the period of deputation (including short – term contract) in another ex-cadre post held immediately preceding appointment in the same or some other organization or department of the Central Government shall not exceed four years.
