2. यतः जिर्ााचकों का रजिजस्ट्रकरण जियम, 1960 का जियम 28 जिर्ााचि आयोग को, इस दजृ ि से दक जिर्ााचकों के प्रजतरुपण का जिर्ारण हो सके तथा मतदाि के समय उिकी पहचाि को सरल बिाया िा सके, जिर्ााचको को राज्य की लागत पर फोटोयुक्त जिर्ााचक फोटो-पहचाि पत्र िारी करि े के जलए जिदेि दिे े की िजक्त प्रदाि करता है; तथा

3. यतः, जिर्ााचिों का संचालि जियम, 1961 के जियम 49 ि(3) और 49 ट(2) (ख) म ेंयह उपबंजधत ह ैदक िहा ाँदकसी जिर्ााचि क्षेत्र के जिर्ााचकों को जिर्ााचक रजिजस्ट्रकरण जियम, 1960, के जियम 28 के उक्त उपबधं ों के अधीि जिर्ााचक फोटो पहचाि-पत्र ददए गए ह,ैं र्हां जिर्ााचकों को मतदाि केन्द्र म ें अपिा जिर्ााचक फोटो पहचाि-पत्र ददखािा होगा तथा उिकी ओर स े उि जिर्ााचक फोटो पहचाि पत्रों को िहीं ददखाए िािे या ददखाि े में असमथ ा होि े पर उन्द्ह ें मत डालि े की अिुमजत देिे से इन्द्कार दकया िा सकता ह;ै तथा 6905 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(iii)]

4. यतः, उक्त अजधजियम, और जियमों के उपयक्तुा उपबंधों को जमलाकर एर्ं सामंिस्ट्यपूण ा ढंग से उिके अध्ययि स े यह स्ट््षट होता ह ैदक यद्यजप मत देिे का अजधकार जिर्ााचक िामार्ली में िाम के होिे से ही होता हैं, यह जिर्ााचि आयोग द्वारा राज्य की लागत पर, मतदाि के समय उिकी पहचाि सुजिजित करिे के साधि के रुप में प्रदाि करर्ाए गए जिर्ााचक फोटो पहचाि पत्र के प्रयोग पर भी जिभार करता ह,ै तथा दोिों का एक साथ प्रयोग करिा होता ह;ै तथा

5. यतः, जिर्ााचि आयोग िे एक समयबद्ध कायाक्रम के अिुसार सभी जिर्ााचकों को जिर्ााचक फोटो पहचाि-पत्र ई0पी0आई0सी0 िारी करि े का जिदेि दते े हुए 28 अगस्ट्त, 1993 को एक आदेि िारी दकया ह;ै तथा

6. यतः, तजमलिाडू, पडु ुचेरी, पजिम बंगाल और असम राज्यों मे लगभग 100% जिर्ााचकों को जिर्ााचक फोटो पहचाि पत्र िारी दकए िा चुके ह ैं,तथा

7. अत: अब, सभी संबद्ध कारकों तथा जर्जधक एर्ं तथ्यात्मक जस्ट्थजतयों को, ध्याि में रखते हुए, जिर्ााचि आयोग, एतद्द्वारा, यह जिदेि दते ा ह ै दक ददिाकं 09.09.2026 को अजधसजू चत होि े र्ाल े तजमलिाडू के 35-मदरु ाटं कम (अ.िा.) और 101- धारापरु म (अ.िा.) जर्धािसभा जिर्ाचा ि क्षत्रे ों, पडु ुचरे ी की 09-थट्टािचार्ाडी जर्धािसभा जिर्ाचा ि क्षत्रे , पजिम बगं ाल के 70-रेिीिगर और 210-िन्द्दीग्राम जर्धािसभा जिर्ाचा ि क्षत्रे ों और असम की 09-िगार्ं लोकसभा जिर्ाचा ि क्षत्रे के उपचुिार्ो के जलए सभी जिर्ााचकों को जिन्द्ह ेंजिर्ााचक फोटो पहचाि पत्र िारी दकए गए हैं, से अपक्षे ा की िाती ह ैदक र्े मतदाि स्ट्थल पर अपिा मत डालिे से पहले अपिी पहचाि सुजिजित करि ेहते ु अपिा जिर्ााचक फोटो पहचाि पत्र ददखाएंगे। ऐसे जिर्ााचक िो अपिा जिर्ााचक फोटो पहचाि पत्र प्रस्ट्ततु िहीं कर पात े हैं, उन्द्ह ें अपिी पहचाि स्ट्थाजपत करि े के जलए जिम्नजलजखत र्ैकजल्पक फोटो पहचाि दस्ट्तार्ेिों में से कोई एक प्रस्ट्तुत करिा होगा:- i. आधार काडा। ii. मिरेगा िॉब काड,ा iii. बैंको / डाकघरों द्वारा िारी दकए गए फोटोयुक्त पासबुक, iv. श्रम मंत्रालय की योििा के अन्द्तगात िारी स्ट्र्ास्ट्थ्य बीमा स्ट्माटा काडा/आयुष्माि भारत हल्ै थ काडा v. ड्राइवर्ंग लाइसेन्द्स, vi. पैि काड,ा vii. एिपीआर के अंतगात आरिीआई द्वारा िारी दकए गए स्ट्माटा काडा, viii. भारतीय पासपोटा;

ix. फोटोयुक्त पेंिि दस्ट्तार्ेि, x. केन्द्र/ राज्य सरकार/ लोक उपक्रम/पजललक जलजमटेड कंपजियों द्वारा अपि े कमाचाररयों को िारी दकए गए फोटोयुक्त सेर्ा पहचाि पत्र, xi. सांसदो/ जर्धायकों / जर्धाि पररषद ्सदस्ट्यों को िारी दकए गए सरकारी पहचाि पत्र,और xii. यूजिक जडसएजबजलटी आईडी (यूडीआईडी) कार्डा, सामाजिक न्द्याय एर्ं अजधकाररता मंत्रालय, भारत सरकार।

8. एजपक के संबंध म,ें लेखि अिुजद्ध, र्तिा ी की अिुजद्ध इत्यादद को ििरअदं ाि कर देिा चाजहए बित ें जिर्ााचक की पहचाि एजपक से सुजिजित की िा सके। यदद कोई जिर्ााचक फोटो पहचाि पत्र प्रदजित ा करता है, िो दक दकसी अन्द्य सभा जिर्ााचि-क्षेत्र के जिर्ााचक रजिस्ट्रीकरण अजधकारी द्वारा िारी दकया गया हैं, ऐसे एजपक भी पहचाि स्ट्थाजपत करिे हते ू स्ट्र्ीकृत दकए िाएंग े बितें उस जिर्ााचक का िाम िहा ं र्ह मतदाि करि े आया ह ै उस मतदाि केंर से संबंजधत जिर्ााचक िामार्ली में उपललध हो। यदद फोटोग्राफ इत्यादद के बेमेल होिे के कारण जिर्ााचक की पहचाि सुजिजित करिा संभर् ि हो तब जिर्ााचक को उपयुाक्त पैरा 7 में र्र्णात दकसी एक र्ैकजल्पक फोटो दस्ट्तार्ेि को प्रस्ट्तुत करिा होगा।[भाग II—खण् ड 3(iii)] भारत का रािपत्र : असाधारण 3

9. उक्त पैरा 7 में दकसी बात के होते हुए भी, प्रर्ासी जिर्ााचकों को िो अपिे पासपोटा में जर्र्रणों के आधार पर लोक प्रजतजिजधत्र् अजधजियम, 1950 की धारा 20क के अधीि जिर्ाचा क िामार्जलयों म ेंपंिीकृत हैं, मतदाि केन्द्र म ें केर्ल उिके मूल पासपोटा (तथा कोई अन्द्य पहचाि दस्ट्तार्ेि िहीं) के आधार पर ही पहचािा िाएगा । [फा. स.ं 3/4/आईडी/2026/एसडीआर/खण्ड-II] आदेि स,े एस.बी. िोिी, प्रधाि सजचर् ELECTION COMMISSION OF INDIA

ORDER New Delhi, the 8th September, 2026 O.N. 34(E).— Whereas, Section 61 of the Representation of the People Act, 1951 provides that with a view to preventing personation of electors, so as to make the right of genuine electors to vote under section 62 of that Act more effective, provisions may be made by rules under that Act for use of Electors Photo Identity Card for electors as the means of establishing their identity at the time of polling; and

2. Whereas, Rule 28 of the Registration of Electors Rules, 1960, empowers the Election Commission to direct, with a view to preventing personation of electors and facilitating their identification at the time of poll, issue of Electors’ Photo Identity Card to electors bearing their photographs at State cost; and

3. Whereas, Rules 49H (3) and 49K (2) (b) of the Conduct of Elections Rules, 1961, stipulate that where the electors of a constituency have been supplied with Electors’ Photo Identity Card under the said provisions of Rule 28 of the Registration of Electors Rules, 1960, the electors shall produce their Elector Photo Identity Card at the polling station and failure or refusal on their part to produce those Elector Photo Identity Card may result in the denial of permission to vote; and

4. Whereas, a combined and harmonious reading of the aforesaid provisions of the said Act and the Rules, makes it clear that although the right to vote arises by the existence of the name in the electoral roll, it is also dependent upon the use of the Elector Photo Identity Card, where provided by the Election Commission at State cost, as the means of establishing their identity at the time of polling and that both are to be used together; and

5. Whereas, the Election Commission made an Order on the 28th August, 1993, directing the issue of Electors’ Photo Identity Card (EPIC) to all electors, according to a time bound programme; and

6. Whereas, Electors’ Photo Identity Card have been issued to approximately 100% electors in the States of Tamil Nadu, Puducherry, West Bengal and Assam; and

7. Now, therefore, after taking into account all relevant factors and the legal and factual positions, the Election Commission hereby directs that for the current bye-elections to the 35-Madurantakam (SC) and 101-Dharapuram

(SC) Assembly Constituencies in Tamil Nadu, 09-Thattanchavady Assembly Constituency in Puducherry, 70- Rejinagar and 210-Nandigram Assembly Constituencies in West Bengal and 09-Nagaon Parliamentary Constituency in Assam to be notified on 09th September, 2026, all electors who have been issued EPIC are expected to produce the EPIC for their identification at the polling stations before casting their votes. Those electors who are not able to produce the EPIC shall produce one of the following alternative photo identity documents for establishing their

identity: - i. Aadhaar Card; ii. MGNREGA Job Card; iii. Passbooks with photograph issued by Bank/Post Office; iv. Health Insurance Smart Card issued under the scheme of Ministry of Labour/Ayushman Bharat Health Card;

v. Driving License;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(iii)] vi. PAN Card; vii. Smart Card issued by RGI under NPR; viii. Indian Passport; ix. Pension document with photograph; x. Service Identity Cards with photograph issued to employees by Central/State Govt./PSUs/Public Limited Companies;

xi. Official identity cards issued to MPs/MLAs/MLCs and xii. Unique Disability ID (UDID) Card, M/o Social Justice & Empowerment, Government of India

8. In the case of EPIC, clerical errors, spelling mistakes, etc. should be ignored provided that the identity of the elector can be established by the EPIC. If an elector produces an EPIC which has been issued by the Electoral Registration Officer of another Assembly Constituency, such EPIC shall also be accepted for identification provided that the name of that elector finds place in the electoral roll pertaining to the polling station where the elector has turned up for voting. If it is not possible to establish the identity of the elector on account of mismatch of photograph, etc. the elector shall have to produce one of the alternative photo documents mentioned in Para 7 above.

9. Notwithstanding anything in Para 7 above, overseas electors who are registered in the electoral roll under

Section 20A of the Representation of the People Act, 1950, based on the particulars in their Indian Passport, shall be identified on the basis of their original passport only (and no other identity document) at the polling station.
