34) की धारा 16 केसाथ पठित धारा 92 की उपधारा (2) के खंड (ङ) द्वारा प्रित्त िजियों का प्रयोग करते हुए बनाने का प्रस्ट्ताव करता ह,ै इससे प्रभाजवत होने वाले संभाजवत सभी व् यजियों को सूचना िेने के जलए उि अजधजनयम की धारा 92 की उप-धारा (1) की अपेक्षा के अनुसार एतिद्वारा प्रकाजित दकया िाता ह ै और यह नोठिस दिया िाता ह ै दक उक्त प्रारूप जवजनयमों पर उस जतजथ से साि दिनों की अवजध समाप् त होने के बाि जवचार दकया िाएगा, जिस जतजथ को इस अजधसूचना को प्रकाजित करन े वाल ेरािपत्र की प्रजतयााँ िनता को उपलब्ध कराई िाएाँगी। आपजत्त अथवा सुझाव, यदि कोई हो, मुखय कायवकारी अजधकारी, भारतीय खाद्य सुरक्षा और मानक प्राजधकरण, एफडीए भवन, कोिला रोड, नई दिल् ली - 110002 को अथवा ईमले द्वारा regulation@fssai.gov.in पर भेिा िा सकता ह।ै आपजत्तयां अथवा सुझाव, िो दकसी भी व् यजि से उि प्रारूप जवजनयमों के संबंध में जवर्नवदिष् ि अवजध की समाजि से पहले प्राि दकए िाएाँग,े उन पर भारतीय खाद्य सुरक्षा और मानक प्राजधकरण द्वारा जवचार दकया िाएगा। 1455 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] प्रारूप जवजनयम

1. इन जवजनयमों को खाद्य सुरक्षा और मानक (खाद्य उत्पाि मानक और खाद्य सहयोज्य) संिोधन जवजनयम, 2026 कहा िा सकता ह।ै

2. खाद्य सुरक्षा और मानक (खाद्य उत्पाि मानक और खाद्य सहयोज्य) जवजनयम, 2011, (जिन्ह ें आग े इसी प्रकार संिर्भतव दकया गया ह)ै , -

(1) जवजनयम 2.1 में, (क) उप-जवजनयम 2.1.2 में, खंड (6) म ें

(i) िब्ि "लेबललंग" के स्ट्थान पर, िब्ि "लेबललंग और पैकेलिंग" प्रजतस्ट्थाजपत दकए िाएाँग;े

(ii) उप-खंड (ग) में, "खाद्य सुरक्षा और मानक (पैकेलिंग और लेबललगं ) जवजनयम, 2011"िब्ि और अंक के स्ट्थान पर, "खाद्य सुरक्षा और मानक (पैकेलिंग) जवजनयम, 2018 और खाद्य सुरक्षा और मानक (लबे ललंग और प्रििवन) जवजनयम, 2020" िब्ि और अकं प्रजतस्ट्थाजपत दकए िाएगाँ े। (ख) उप-जवजनयम 2.1.3 में, खंड (6) म ें

(i) "लेबललगं " िब्ि के स्ट्थान पर, "लेबललगं और पैकेलिगं " िब्ि प्रजतस्ट्थाजपत दकए िाएाँग;े

(ii) उप-खंड (ग) में, "खाद्य सुरक्षा और मानक (पैकेलिंग और लेबललगं ) जवजनयम, 2011"िब्ि और अंक के स्ट्थान पर, "खाद्य सुरक्षा और मानक (पैकेलिंग) जवजनयम, 2018 और खाद्य सुरक्षा और मानक (लबे ललंग और प्रििवन) जवजनयम, 2020" िब्ि और अकं प्रजतस्ट्थाजपत दकए िाएगाँ े। (ग) उप-जवजनयम 2.1.4 म,ें खडं (6) म ें

(i) “लेबललगं ” िब्ि के स्ट्थान पर “लेबललगं और पैकेलिंग” िब्ि प्रजतस्ट्थाजपत दकए िाएाँग;े

(k) in clause (15), in sub-clause (c), in item (vi), for the words and figures “Food Safety and Standards (Packaging and Labelling) Regulations, 2011”, the words and figures “Food Safety and Standards (Packaging) Regulations, 2018 and Food Safety and Standards (Labelling and Display) Regulations, 2020” shall be substituted.

(l) in clause (16), in sub-clause (h), for the words and figures “Food Safety and Standards (Packaging and Labelling) Regulations, 2011” the words and figures “Food Safety and Standards (Packaging) Regulations, 2018 and Food Safety and Standards (Labelling and Display) Regulations, 2020” shall be substituted.

(m) in clause (17), in sub-clause (i), for the words and figures “Food Safety and Standards (Packaging and Labelling) Regulations, 2011”, the words and figures “Food Safety and Standards (Packaging) Regulations, 2018 and Food Safety and Standards (Labelling and Display) Regulations, 2020” shall be substituted.

(n) in clause (23), in sub-clause (8), for the words and figures “Food Safety and Standards (Labelling and Display) Regulations, 2020”, the words and figures “Food Safety and Standards (Packaging) Regulations, 2018 and Food Safety and Standards (Labelling and Display) Regulations, 2020” shall be substituted.

(o) in clause (24), in sub-clause (12), for the words and figures “Food Safety and Standards (Labelling and Display) Regulations, 2020”, the words and figures “Food Safety and Standards (Packaging) Regulations, 2018 and Food Safety and Standards (Labelling and Display) Regulations, 2020” shall be substituted.

(6) in regulation 2.7,

(a) in sub-regulation 2.7.1, the provision starting with the words “Provided further that if artificial sweetener …….. Food Safety and Standards (Packaging and Labelling) Regulations, 2011” shall be substituted by the following, namely: - “Provided further that if sweetener has been added as provided in Appendix A, it shall be declared on the label as per schedule II of the Food Safety and Standards (Labelling and Display) Regulations, 2020 and Food Safety and Standards (Packaging) Regulations, 2018.”20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(b) in sub-regulation 2.7.2, the provision starting with the words “Provided that if artificial sweetener …….. Food Safety and Standards (Packaging and Labelling) Regulations, 2011” shall be substituted by the following, namely:- “Provided that if sweetener has been added as provided in Appendix A, it shall be declared on the label as per schedule II of the Food Safety and Standards (Labelling and Display) Regulations, 2020 and Food Safety and Standards (Packaging) Regulations, 2018.”

Food Safety and Standards (Packaging and Labelling) Regulations, 2011” shall be substituted by the following,

namely: - “Provided further that if sweetener has been added as provided in Appendix A, it shall be declared on the label as per schedule II of the Food Safety and Standards (Labelling and Display) Regulations, 2020 and Food Safety and Standards (Packaging) Regulations, 2018.”

(d) in sub-regulation 2.7.4, under sub-clause (4) the provision starting with the words “Provided that it may contain artificial sweeteners …….. Food Safety and Standards (Packaging and Labelling) Regulations, 2011” shall be substituted by the following, namely: - “Provided that it may contain sweeteners as provided in Appendix A, and shall have labelling declarations as per schedule II of the Food Safety and Standards (Labelling and Display) Regulations, 2020 and Food Safety and Standards (Packaging) Regulations, 2018.”

(7) in regulation 2.8,

(a) in sub-regulation 2.8.3, in clause (1), in sub-clause (VII), for the words and figures “Food Safety and Standards (Packaging and Labelling) Regulations, 2011”, the words and figures “Food Safety and Standards (Packaging) Regulations, 2018 and Food Safety and Standards (Labelling and Display) Regulations, 2020 respectively” shall be substituted.

(b) in sub-regulation 2.8.4, in clause (5) for the words and figures “Food Safety and Standards (Packaging and Labelling) Regulations, 2011”, the words and figures “Food Safety and Standards (Packaging) Regulations, 2018 and Food Safety and Standards (Labelling and Display) Regulations, 2020 respectively” shall be substituted.

(c) in sub-regulation 2.8.8, in clause (4) for the words and figures “Food Safety and Standards (Packaging and Labelling) Regulations, 2011”, the words and figures “Food Safety and Standards (Packaging) Regulations, 2018 and Food Safety and Standards (Labelling and Display) Regulations, 2020 respectively” shall be substituted.

(d) in sub-regulation 2.8.12, in clause (4) for the words and figures “Food Safety and Standards (Packaging and Labelling) Regulations, 2011”, the words and figures “Food Safety and Standards (Packaging) Regulations, 2018 and Food Safety and Standards (Labelling and Display) Regulations, 2020 respectively” shall be substituted.

(8) in regulation 2.9,

(a) in sub-regulation 2.9.30, in clause (6), in sub-clause (5), for the words and figures “Food Safety and Standards (Packaging and Labelling) Regulations, 2011” the words and figures “Food Safety and Standards (Packaging) Regulations, 2018 and Food Safety and Standards (Labelling and Display) Regulations, 2020” shall be substituted.

(b) in sub-regulation 2.9.31, in clause (5), for the words and figures “Food Safety and Standards (Packaging and Labelling) Regulations, 2011” the words and figures “Food Safety and Standards (Packaging) Regulations, 2018 and Food Safety and Standards (Labelling and Display) Regulations, 2020” shall be substituted.

(9) in regulation 2.10,

(a) in sub-regulation 2.10.1,

(i) in clause (1), in the proviso, following words shall be omitted, namely: -[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 21 “Tea containing added flavour shall bear proper label declaration as provided in regulation 2.4.5 (23) of Food Safety and Standards (Packaging and Labelling) Regulations, 2011.”

(ii) in clause (2), second proviso shall be omitted.

(iii) in clause (3), in the proviso, following words shall be omitted, namely: - “Tea containing added flavour shall bear proper label declaration as provided in regulation 2.4.5 (23) of Food Safety and Standards (Packaging and Labelling) Regulations, 2011.”

(b) in sub-regulation 2.10.4,

(i) in clause (1), for the words and figures “The percentage of coffee and chicory used shall be marked on the label as

provided in Regulation2.4.5 (1) (i) of Food Safety and Standards (Packaging and Labelling) Regulations, 2011”, the words and figures “The percentage of coffee and chicory used shall be marked on the label as provided in clause 2.2 (1) of Schedule-II of Food Safety and Standards (Labelling and Display) Regulations, 2020 and Food Safety and Standards (Packaging) Regulations, 2018” shall be substituted.

(ii) in clause (2), for the words and figures “The percentage of coffee and chicory used shall be marked on the label as

provided in Regulation2.4.5 (1) (ii) of Food Safety and Standards (Packaging and Labelling) Regulations, 2011”, the words and figures “The percentage of coffee and chicory used shall be marked on the label as provided in clause 2.2 (2) of Schedule-II of Food Safety and Standards (Labelling and Display) Regulations, 2020 and Food Safety and Standards (Packaging) Regulations, 2018.” shall be substituted.

(i) in clause (2), in sub-clause (V),

(A) for the word “labelling” the words “Labelling and packaging” shall be substituted;

(ii) in clause (3), in sub-clause (iv),

(A) for the word “labelling” the words “Labelling and packaging” shall be substituted;

(d) in sub-regulation 2.10.7, in clause (3), in sub-clause (d), for the words and figures “Regulation 2.1.2, 2.2.1 and

2.4.5 of Food Safety and Standards (Packaging and Labelling) Regulations, 2011”, the words and figures “Food Safety and Standards (Packaging) Regulations, 2018 and Food Safety and Standards (Labelling and Display) Regulations, 2020 respectively” shall be substituted.

(e) in sub-regulation 2.10.8, in clause (5), for the words and figures “Food Safety and Standards (Packaging and Labelling) Regulations, 2011” the words and figures “Food Safety and Standards (Packaging) Regulations, 2018 and Food Safety and Standards (Labelling and Display) Regulations, 2020” shall be substituted.22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(10) in regulation 2.11,
