1. इन जवजनयमों को खाद्य सुरक्षा और मानक (खाद्य व्यवसाय का अनज्ञु ापन और पंिीकरण) संिोधन जवजनयम, 2026 कहा िा सकता ह।ैं

2. खाद्य सुरक्षा और मानक (खाद्य व्यवसाय का अनुज्ञापन और पंिीकरण) जवजनयम, 2011 म,ें जवजनयम 2.1 म,ें- (क) खाद्य सुरक्षा अनुपालन टरिनव स े सम्बंजधत उप-जवजनयम 2.1.13 म,ें खडं 3 और 4 के स्ट्िान पर जनम्नजलजखत को रखा िाएगा, अिावत:् - “(3) प्रत्येक वष व 31 मई के बाि टरिन व िाजखल करन े म ें दकसी भी प्रकार की िेरी होन े पर िडं िये होगा तिा लगाया िाने वाला अजधकतम िडं जनम्नानुसार होगा:

i. 90 दिनों तक: वार्षवक िल्ु क का 2 गनु ा; ii. 91 स े 180 दिनों तक: वार्षकव िुल्क का 5 गुना।

(4) 181व ेंदिन तक खाद्य सुरक्षा अनुपालन टरिनव प्रस्ट्तुत न दकए िाने की जस्ट्िजत म ेंलाइसेंस जनलंजबत माना िाएगा। जनलंबन हिाए िान े स े पूवव िये िडं का भुगतान दकया िाना अजनवाय व होगा। जनलंबन की अवजध के िौरान खाद्य व्यवसाय संचालक दकसी भी प्रकार की खाद्य व्यवसाय गजतजवजध म ेंसंलग्न नहीं होगा। जनलंबन अवजध के िौरान की गई कोई भी खाद्य व्यवसाय गजतजवजध अननुपालक मानी िाएगी और उस पर खाद्य सुरक्षा और मानक अजधजनयम, 2006 के अंतगवत िडं सजहत आग े की कारववाई की िाएगी।” (ख) अनुसूची 2 म,ें “लाइसेंस की ितें” स े संबंजधत उपाबंध 2 म,ें क्रम संखया 14 के स्ट्िान पर जनम्नजलजखत को रखा िाएगा, अिावत:् - “14. उत्पािन तिा कच्च े माल के उपयोग का िैजनक अजभलेख पृिक रूप स ेबनाए रखें। परंत ु यह ितव गैर-जनमावण खाद्य व्यवसायों पर लाग ू नहीं होगी।” (ग) अनुसूची 4 म,ें “लाइसेंस हते ु आवेिन करने वाले सभी खाद्य व्यवसाय संचालकों द्वारा पालन की िान े वाली स्ट्वच्छ एव ं सैजनिरी प्रिाओं संबंधी सामान्य आवश्यकताएाँ” स ेसंबंजधत भाग 2 म,ें खंड 5.2.5 के स्ट्िान पर जनम्नजलजखत को रखा िाएगा, अिावत:् - “5.2.5 कच्चे माल, अवयवों, प्रगजत म ेंकाय व(वकव-इन-प्रोग्रेस) तिा प्रसंस्ट्कृत/पकाए गए या पैकेज्ड खाद्य उत्पािों के भंडारण म ें FIFO (फस्ट्ि व इन फस्ट्िव आउि) तिा FEFO (फस्ट्िव एक्सपायर फस्ट्िव आउि) जसद्ांतों का पालन दकया िाएगा। परंत ु यह प्रावधान खुिरा जवक्रेताओं पर लाग ू नहीं होगा।” राजित पुनहानी, मुखय कायवकारी अजधकारी [जवज्ञापन-III/4/असा./628/2025-26] नोि :- मुखय जवजनयम खाद्य सरु क्षा और मानक (खाद्य कारबार का अनुज्ञापन और रजिस्ट्रीकरण) जवजनयम भारत के रािपत्र, असाधारण, भाग III, खडं 4 में अजधसूचना संखया फा. स.ं 2-15015/30/2010, दिनांक 1 अगस्ट्त, 2011 द्वारा प्रकाजित दकए गए एवं आजखरी बार दिनांक 13 िलु ाई, 2016 की अजधसूचना फा. स. 2-15015/30/2012, द्वारा संिोजधत दकए गए ि े[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 FOOD SAFETY AND STANDARDS AUTHORITY OF INDIA

NOTIFICATION New Delhi, the 20th January, 2026 F. No. REG-11013/1/2026-Regulation-FSSAI.— The following draft of certain regulations further to amend the Food Safety and Standards (Licensing and Registration of Food Business) Regulations, 2011, which the Food Safety and Standards Authority of India, with previous approval of the Central Government, proposes to make in exercise of the powers conferred by clause (o) of sub-section (2) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006), is hereby published as required by the sub-section (1) of section 92 of the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft regulations will be taken into consideration after the expiry of the period of sixty days from the date on which copies of the Official Gazette in which this notification is published are made available to the public;

Objections or suggestions, if any, may be addressed to the Chief Executive Officer, Food Safety and Standards Authority of India, Food and Drug Administration Bhawan, Kotla Road, New Delhi- 110002 or sent on email at regulation@fssai.gov.in;

Objections and suggestions, which may be received with respect to the said draft regulations before the expiry of the period so specified, will be considered by the Food Authority.

Draft Regulations

1. These regulations may be called the Food Safety and Standards (Licensing and Registration of Food Business) Amendment Regulations, 2026.

2. In the Food Safety and Standards (Licensing and Registration of Food Business) Regulations, 2011, in regulation 2.1,

(a) in sub regulation 2.1.13 related to Food Safety Compliance Return, for the clause 3 and 4 the following shall be substituted, namely,- “(3) Any delay in filing return beyond 31st May of each year shall attract a penalty and the maximum penalty that

can be levied shall be as follows: i. Upto 90 days: 2 times the annual fees; ii. 91 to 180 days: 5 times the annual fees;

(4) In case of non-submission of Food Safety Compliance return on 181st day, license shall be deemed suspended. The penalty due shall be payable before the suspension is revoked. During such suspension Food Business Operator shall not involve in any food business activity. Any food business activity carried out during the suspension period shall be deemed non-compliant and shall attract subsequent action including penalty under the FSS Act, 2006.”

(b) in schedule 2, Annexure 2 related to Conditions of License, for S. No. 14, the following shall be substituted, namely,- “14. Maintain daily records of production, raw materials utilization separately.

Provided this condition shall not be applicable to non-manufacturing food businesses.”

(c) in schedule 4, part II, related to General Requirements on Hygienic and Sanitary Practices to be followed by all Food Business Operators applying for License, for clause 5.2.5, the following shall be substituted, namely,- “5.2.5 The storage of raw materials, ingredients, work-in-progress and processed /cooked or packaged food products shall be subjected to FIFO (First in First out), FEFO (First Expire First Out). Note:- The principal Food Safety and Standards (Licensing and Registration of Food Business) Regulations, 2011 were published in the Gazette of India, Extraordinary, Part III, Section 4, vide F. No. 2-15015/30/2010, dated the 1st August, 2011 and last amended vide notification F. No. 2-15015/30/2012, dated 13th July, 2016.
