और उि रािपत्र की प्रजतयां िनता को 7 अक्टूबर, 2024 को उपलब्ध करा िी गई थी; और उि जिजनयमों के प्रारूप के संबंध में िनता स े प्राप्त आक्षपे ों और सुझािों पर भारतीय खाद्य सुरक्षा और मानक प्राजधकरण द्वारा जिचार कर जलया गया ह ै । 7189 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] अत:, अब, केंद्रीय सरकार के पूि िअनुमोिन से भारतीय खाद्य सुरक्षा और मानक प्राजधकरण, खाद्य सुरक्षा और मानक अजधजनयम, 2006 (2006 का 34) की धारा 92 की उपधारा (2) के खडं (ङ) द्वारा प्रित् िजियों का प्रयोग करत े हुए खाद्य सुरक्षा और मानक (आयात) जिजनयम, 2017 में और संिोधन करने के जलए जनम्नजलजखत जिजनयम बनाता ह,ै अथाित:् -

1. (1) इन जिजनयमों का संजक्षप्त नाम खाद्य सुरक्षा और मानक (आयात) प्रथम संिोधन जिजनयम, 2025 ह।ै

(2) य ेतारीख 1 मई, 2026 को प्रिृत होंगे ।

2. खाद्य सुरक्षा और मानक (आयात) जिजनयम, 2017 के, जिजनयम 10 म,ें -

(i) उप-जिजनयम (4) म,ें खंड (ख) के स्ट्थान पर जनम्नजलजखत खंड रखा िाएगा, अथाित:् - “(ख) खाद्य िस्ट्तओंु के नमनू ों के जिश्लेषण के जलए प्राजधकरण द्वारा समय – समय पर संिोजधत या अपनाई गई जिश्लेषण पद्धजत की जनयम पुजस्ट्तका (मैनुअल) का उपयोग दकया िाएगा। तथाजप, दकसी मानिंड का जिश्लेषण करन े की पद्धजत इन जनयम पुजस्ट्तका (मैनुअल) म ें उपलब्ध ना होन े की ििा म,ें खाद्य प्रयोगिाला एओएसी/ आईएसओ/ जपयसिन/िैकब/आईयपू ीएसी/खाद्य रसायन कोडेक्स/ बीआईएस/ कोडेक्स एजलमेंटेररयस/ िुडमेन/विंटन– विंटन/िोसजलन या अन्तराष्ट्रीय स्ट्तर पर मान्यता प्राप्त दकसी जिजनयामक अजभकरण द्वारा जिजहत जिजधमान्य जिश्लेषण पद्धजत अपना सकती ह।ै ”;

(ii) उप–जिजनयम (5) के स्ट्थान पर, जनम्नजलजखत उप-जिजनयम रखा िाएगा, अथाित:् - “(5) अजधसूजचत प्रयोगिाला या रेफरल प्रयोगिाला, प्रयोगिाला जिश्लेषण ररपोटि को, नमूना प्राजप्त की तारीख से पााँच दिन के भीतर प्रारूप-2 में यथा जस्ट्थजत, उसके खाद्य जिश्लेषक या जनिेिक द्वारा सम्यक रूप से हस्ट्ताक्षररत कर प्रिान करेगी ।‘’। राजित पुनहनी, मख्ु य कायिकारी अजधकारी [जिज्ञापन-III/4/असा./424/2025-26] रटप्पण: मूल जिजनयम, भारत के रािपत्र, असाधारण भाग III खंड 4 म,ें अजधसूचना संख्या फा. सं. 1/2008/आयात संरक्षा/एफएसएसएआई, तारीख 9 माच,ि 2017 के द्वारा प्रकाजित दकए गए और तत्पश्चात जनजम्न्लजखत अजधसूचना संख्याओं द्वारा संिोजधत दकए गए: -

1. फा. स.ं रेग./11/25/आयात सिं ोधन/एफएसएसएआई-2017, तारीख 7 फरिरी, 2018;

2. फा. स.ं 1-1275/एफएसएसएआई/आयात/2015, तारीख 20 अिूबर, 2020;

3. फा. स.ं 4067/एमओसी-रेड/आरईिी-एफ.एस.एस.ए.आई/2017(पाटि-1), तारीख 3 निम्बर, 2021; और

4. फा. स.ं 1605/ एफएसएसएआई/आयात/2016(पाटि-2), तारीख 14 फरिरी, 2022 ।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 FOOD SAFETY AND STANDARDS AUTHORITY OF INDIA

NOTIFICATION New Delhi, the 27th October, 2025 F. No. QA/11023/31/2022-QA-FSSAI(1).—Whereas a draft of the Food Safety and Standards (Import) Amendment Regulations, 2024, were published vide notification of the Food Safety and Standards Authority of India number F. No. QA/11023/31/2022-QA-FSSAI(1), dated the 3rd October, 2024, in the Gazette of India, Extraordinary, Part III, Section 4 as required under sub- section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of

2006), inviting objections and suggestions from persons likely to be affected thereby, within a period of sixty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public;

And whereas, the copies of the said Gazette were made available to the public on the 7th October, 2024;

And whereas the objections and suggestions received from the public in respect of the said draft regulations have been considered by the Food Safety and Standards Authority of India.

Now, therefore, in exercise of the powers conferred by clause (e) of sub- section (2) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006), the Food Safety and Standards Authority of India, with the previous approval of the Central Government hereby makes the following regulations, further to amend the Food Safety and Standards (Import) Regulations, 2017, namely: -

1. (1) These regulations may be called the Food Safety and Standards (Import) First Amendment Regulations, 2025.

(2) They shall come into force on 1st May, 2026.

2. In the Food Safety and Standards (Import) Regulations, 2017, in regulation 10, -

(i) in sub-regulation (4), for clause (b), the following clause shall be substituted, namely: - “(b) The manuals of the method of analysis, as amended or adopted by the Authority from time to time, shall be used for analysing the samples of food articles. However, in case the method for analysing any parameter is not available in these manuals, the Food Laboratory may adopt a validated method of analysis prescribed by AOAC/ ISO / Pearson’s/ Jacob/ IUPAC/ Food Chemicals CODEX/ BIS/ Codex Alimentarius/ Woodmen/ Winton-Winton/ Joslyn or any other internationally recognized regulatory agencies.”;

(ii) for sub-regulation (5), the following sub-regulation shall be substituted, namely:- “(5) The notified laboratory or referral laboratory shall provide the laboratory analysis report duly signed by its Food Analyst or Director, as the case may be, in FORM - 2 within five days from the date of receipt of the sample.”.
