और उक्त प्रारूप जिजनयमों के संबंध म ें िनता स े प्राप् त आक्षेपों और सुझािों पर भारतीय खाद्य सुरक्षा और मानक प्राजधकरण द्वारा जिचार कर जलया गया ह;ै अत: अब भारतीय खाद्य सुरक्षा और मानक प्राजधकरण, उक्त अजधजनयम की धारा 23 के साथ पठठत धारा 92 की उपधारा (2) के खंड (ट) द्वारा प्रित् त िजियों का प्रयोग करते हुए, भारत सरकार के पूिानच ुमोिन स,े खाद्य सुरक्षा और मानक (लेबललंग और प्रििनच ) जिजनयम, 2020 म ेंऔर संिोधन करने के जलए जनम्न जलजखत जिजनयम बनाती ह,ै अथाचत्,- 2147 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] जिजनयम

1. (1) इन जिजनयमों का संजक्षि नाम ‘खाद्य सुरक्षा और मानक (लेबललगं और प्रििचन) पहला संिोधन जिजनयम, 2026 ह।ै

(2) य ेजिजनयम 1 िुलाई,2027 को प्रिृत होंगे l

2. खाद्य सुरक्षा और मानक (लेबललंग और प्रििचन) जिजनयम, 2020 ( जिसे इसम ें इसके पश्चात ् उक्त जिजनयम कहा गया ह)ै , के,- (क) जिजनयम 5 के उप-जिजनयम (3) म,ें-

(i) खंड (ख) के उप खंड (iv) म,ें परंतुक के पश्चात,् जनम्न जलजखत परंतुक को अंत: स्ट्थाजपत दकया िाएगा, अथाचत,् - ‘’परंतु यह और दक अनुसंजसत आहार भत्ते (आरडीए) को प्रजत परोसे प्रजतित (%) अंििान तथा प्रजत पैक परोसों की सख्ं या जििु पोषण उत् पािों के जलए न िी िाए, िैसा दक खाद्य सुरक्षा और मानक (जिि ु पोषण के जलए खाद्य) जिजनयम, 2020 में पठरभाजषत दकया गया ह ै l”

(ii) खंड (ग) के,- (अ) उप खडं (i) के स्ट्थान पर, जनम्न जलजखत रखा िाएगा, अथाचत्, - “(i) न् यनू तम प्रसंस्ट् कृत कच् च े कृजष उत् पाि िैसे दक गेह,ाँ चािल, धान्य , िाल,ें फल और सजब्ियााँ और/या एकल संघटक िाले उत् पाि। स्ट् पष्ट ीकरण : न् यूनतम प्रसंस्ट् कृत खाद्य िह खाद्य होत े ह,ैं जिन् ह ें पठररक्षण के मुख्य प्रयोिन के जलए थोडा सा बिला िाता ह,ै ककंतु जिससे खाद्य के पोषण अंि में साथचक पठरितचन नहीं होता ह।ै इसम ें सफाई तथा अखाद्य या अिांछनीय जहस्ट्स ों को छाटना, पीसना, ठंडा करना, पाश्‍ च् यरु ीकरण करना, दकजण्ित करना, प्रिीजतत करना, और जनिाचत्-पैककंग करना िाजमल हो सकता ह ै l” (आ) उप खंड (ii) का लोप दकया िाएगा l

(i) उप खंड (xiii) के स्ट्थान पर, जनम् नजलजखत उपखण्ड रखा दकया िाएगा अथाचत्,- “(xiii) ऊिाच के स्रोतों का महत्ि न होने पर, सूक्ष्म पोषक तत्ि ों के संबंध में, टेबलेट, जपल्स और कैप् सूल कें रूप में, स्ट् िास्ट् ् य अनपु ूरक, न् यरु ास्ट् युठटकलस तथा जििेष आहार उपयोग के जलए खाद्य (एफएसडीयू) l” (ख) जिजनयम 8 के,उप जिजनयम (1) (क) को पुनः (1 क) संक्यंदकत दकया िाएगा और इसप्रकार पुनः दकएगए उप जिजनयम (1 क) के पश्चात, जनम्नजलखत उप-जिजनयम अंत: स्ट्थाजपत दकया िाएगा, अथाचत्,- “(1आ ) खाद्य सुरक्षा और मानक जिजनयमों के अधीन अजधसूजचत लोगो उस जस्ट्थजत म ें नहीं दिया िा सकता ह ै िब पैकेि का सतही क्षेत्र 100 िग च सेंटीमटर स े अजधक न हो, ककंत ु यह सूचना बहु-इकाई पैकेिों पर िी िाएगी l” (ग) जिजनयम 10 में,-

(i) उप जिजनयम (1) के स्ट्थान पर जनम्न जलजखत को रखा दकया िाएगा, अथाचत्,:- “ (1) गैर-खुिरा जबक्री के जलए रखगे ए प्रत् यके पैकेिबंि खाद्य के संबंध म ें जनम्न जलजखत अजनिाय च सूचना या तो उसके पात्र पर िी िाए या उसके साथ लगे लेबल पर िी िाए, अथाचत,् :- (क) खाद्य का नाम;

(ख) एफ.एस.एस.ए.आई लोगो और अनुज्ञजि संख् या; (ग) उत् पाि की सुरक्षा और अखंडता के जलए आिश्‍ यक होन े पर, तारीख की मार्किंग और भंडारण अनिु ेि;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 (घ) लोर संख् या/खेप संख् या/कोड सख्ं या, और (ङ) जिजनमाचता या पैकर का नाम और पता (आयाजतत पैकेिों के मामले म ें मलू िेि के नाम सजहत)। परंत ु यह और बहु दकस्ट् मों के खाद्य िाले गरै -खुिरा पात्र की ििा म ें अजनिायच सूचना उसमें अन्ताजिजष्ट प्रत् यके प्रकार के खाद्य के जलए िी िाएगी। परंतु यह भी दक जिस गैर-खुिरा पात्र में जिजनयम 10 के उप-जिजनयम (1) में अपेजक्षत संपूणच सूचना गैर-खुिरा पात्र के अंिर पूिच पैकेिबंि खाद्यों के लेबल पर सुगम्य रूप स े प्रिान करता ह,ै उस ििा में जिजनयम 10 के उप-जिजनयम (1) में जनधाचठरत सूचना नहीं ह।ै

(ii) उप जिनयम (2) के स्ट्थान पर जनम्न जलजखत रखा िाएगा, अथाचत,् :- “ (2) जनम्न जलजखत सूचना यदि लेबल पर उपबंजधत न हो तो उसके संलग् न िस्ट्तािेिों म ें िी िाए: (क) संघटकों की सूची; (ख) िाकाहार या मांसाहार संबंधी घोषणा, और (ग) िुद्ध पठरमाण। परंत ु यह दक जिजनयम 10 के उप-जिजनयम (2) म ें अपेजक्षत सचू ना गैर-खुिरा पात्र के खाद्य तक खोिी िाएगी। परंतु यह और दक यिी जिजनयम 10 के उप-जिजनयम (2) अधीन अपेजक्षत सभी सूचना गोर खुिरा पात्र के भीतर पूि च पैकेि खाद्य या गौर खाद्य पैकेि लबे ल पर उपलब्ध करिाई िाती ह ै यिी, जिजनयम 10 के उप-जिजनयम (2) लाग ूनहीं होता ह।ै परंतु यह भी दक खाद्य पठरिहन यूजनट के रूप म ें प्रयुक् त ऐसे गैर-खुिरा पात्र की ििा म,ें जिस पर लेबल न लगाया िा सके, जिजनयम 10 के उप-जिजनयम (1) और उप-जिजनयम (2) के अधीन अपेजक्षत सभी सूचना संलग् न िस्ट्तािेिो में िी िाए या दकसी अन् य उपयक्ु त माध् यम स ेिी िाए (उिाहारणथच खाद्य कारोबारों के बीच इलेक्र ॉजनक रूप में) तथा उसे ऐसे पात्र के खाद्य के संबंध में आसानी स ेखोिा िा सके।

(iii) उप जिनयम (4) के स्ट्थान पर जनम्न जलजखत रखा िाएगा, अथाचत,् :- “ (4) गरै -खुिरा जबक्री के प्रत् यके पैकेि की आसानी स े पहचान की िा सके। यदि पात्र गैर-खुिरा पात्र के रूप म ेंआसानी स ेन पहचाना िा सकने िाला हो, तो - (क) उसके साथ यह उपिर्िचत करने का जििरण हो दक उसका खाद्य उपभोक्त ा का सीधे बेचे िाने के जलए आिजयत नहीं ह ै या उसे गैर-खुिरा पात्र के रूप म ें आसानी स े पहचाना िा सकने िाला बनाया िाए। ऐसे जििरण के कुछ उिाहरण ह:ैं

(i) गैर-खुिरा पात्र;

(ii) गुर-खुिरा पात्र – उपभोक्त ा को सीधे जबक्री के जलए नहीं; या (ख) उस पर कोई ऐसा अन् य जचह्न अंदकत हो जिससे यह उपिर्िचत हो दक पात्र सीधे उपभोक्त ा को बेचे िाने के जलए आज्ञाजपत नहीं ह।ै “;

(iv) उप जिनयम (4) के पश्चात ्, जनम्न जलजखत उप जिजनयम अतं : स्ट्थाजपत दकया िाएगा, अथाचत्,:- “(5) साधारण सूचना: (क) इस जिजनयम या दकसी अन् य जिजनयम के आधार पर लेबल पर अपेजक्षत सूचना और जििरण साफ, िश्‍ृ यमान तथा सुपाठ्य हो और ऐसी रीजत म ें िी िाए दक उससे छेड- छाड का पता लग िाए।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ख) लेबल पर जिजनयम 10 के उप-जिजनयम (1) के अधीन अपेजक्षत अजनिायच सूचना गरै - खुिरा पात्र के प्रमुख स्ट्थ ान पर हो तथा उसे पात्र के प्रहस्ट् तन एिं प्रयोग की आम जस्ट्थजतयों में आसानी से िेखा िा सके l” (घ) उि जिजनयम में, अनुसूची-1 के पैरा (1) के स्ट्थान पर, जनम्न जलजखत पैरा रखा िाएगा , अथाचत,् - “(1) खाद्य सुरक्षा और मानक (िढृ ीकृत खाद्य) जिजनयम, 2018 के अनुसार पौजष्टकीकृत खाद्य के प्रत् येक पैकेि के लेबल पर “……………… (पोषक तत्ि का नाम) से पौजष्टकीकृत’’ िब् ि तथा जनम्न -जिजनर्िचष् ट लोगो दिया िाए तथा लोगो के नीचे “संपूण च पोषण स्ट् िस्ट् थ िीिन” प्रचार िाकय भी हो सकता ह।ै ’’ (ङ) उि जिजनयम में, अनुसूची 2 के,- (क) पैरा 1 के उप-पैरा िीष च (3) की सारणी में,- (अ) क्रम संख् या 1 के जलए, ‘’घोषणा’’ िीषच से संबंजधत स्ट्तंभ (3) के अधीन, जिद्यमान प्रिृजष्ट के पश्चात ्, जनम्न जलजखत ठटप्पण को अंत: स्ट्थाजपत दकया िाएगा, अथाचत्, - ‘’ठटप् पण: चेतािनी का यह जििरण पान मसाला से संबंजधत जिज्ञापनों में स्ट्पष्टरूप रूप स े सुपाठ्य या सुश्रव् य हो’’। (आ) क्रम संख् या 3 के जलए, ‘’घोषणा’’ िीषच स े संबंजधत स्ट्तंभ (3) के अधीन, खंड (iv) के स्ट्थान पर जनम्नजलदकत रखा िीषच िाएगा, अथाचत,् - ‘’(iv) दफनॉयलकेटोन् युठरक्स; बच् चों; गभचिती या स्ट् तनपायी मजहलाओं के जलए अनुिंजसत नहीं (एस्ट् पाटेम-एजससल् फेम लिण या एस्ट् पाटेम और एजससल् फेम पोटाजियम के अजधजमश्रण या जमश्रण की ििा में)’’ (ख) पैरा 1 के उप-पैरा (4) की सारणी के,-

(i) क्रम संख् या 1 के जलए, ‘’घोषणा’’ िीषच से संबंजधत स्ट्तंभ (3) के अधीन, खडं (iv) के स्ट्तन पर जनम्न जलजखत रखा िीषच िाएगा, अथाचत,् - ’(iv) दफनॉयलकेटोन् युठरक्स; बच् चों; गभचिती या स्ट्त नपायी मजहलाओं के जलए अनुिंजसत नहीं (एस्ट् पाटेम-एजससल् फेम लिण या एस्ट् पाटेम और एजससल् फेम पोटाजियम के अजधजमश्रण या जमश्रण की ििा म)ें ’’

(ii) क्रम संख् या 2 के जलए, ‘’घोषणा’’ िीषच से संबंजधत स्ट्तंभ (3) के अधीन, परंतुक के पश्चात, जनम्न जलजखत परंतुक अतं : स्ट्थाजपत दकया िाएगा, अथाचत्, - ‘’परंत ु यह और दक जमठासकारकों के सजम्मश्रणों के जलए सूचना की पनु रािृजत्त की आिश्‍ यकता नहीं हो सकेगी” (ग) ‘’गभचिती और स्ट् तनपायी माताओं’’ िब् ि, िहााँ कहीं आत े ह ै , के स्ट्थानपर जनम्न जलजखत िब् ि रखे िाएंग,े अथाचत,् - ‘’गभचिती या स्ट् तनपायी मजहलाओं’’ राजित पुनहनी, मख्ु य कायचकारी अजधकारी [जिज्ञापन-III/4/असा./785/2025-26] ठटप्प ण.- मलू जिजनयम भारत के रािपत्र, असाधारण, भाग 3, खडं 4 म ें अजधसचू ना संख् या फा0 सं0 1- 94/एफ.एस.एस.ए.आई/एसपी(लेबललगं )/2014(भाग 2), तारीख 17 निंबर, 2020 द्वारा प्रकाजित दकए गए थ े और अंजतम संिोधन फा. स.ं एसएस–टी017/1/2023-मानक-एफएसएसएआई. तारीख 08 अगस्ट्त 2025 द्वारा दकया[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 FOOD SAFETY AND STANDARDS AUTHORITY OF INDIA

NOTIFICATION New Delhi, the 24th March, 2026 F. No. STD/SP-08/A1.2022/N-01.—Whereas a draft of the Food Safety and Standards (Labelling and Display) Amendment Regulations, 2022 were published as required by sub-section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006) vide notification of the Food Safety and Standards Authority of India number F.

No. Std/SP-08/A1.2022/N-01, dated the 30th November, 2022 in the Gazette of India, Extraordinary, Part III, section 4, inviting objections and suggestions from the persons likely to be affected thereby, before the expiry of the period of sixty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public;

And whereas the copies of the said Gazette were made available to the public on the 5th December, 2022;

And whereas the objections and suggestions received from the public in respect of the said draft regulations have been considered by the Food Safety and Standards Authority of India;

Now, therefore, in exercise of the powers conferred by clause (k) of sub-section (2) of section 92 read with

section 23 of the said Act, the Food Safety and Standards Authority of India, with the previous approval of the Central Government, hereby makes the following regulations further to amend the Food Safety and Standards (Labelling and Display) Regulations, 2020, namely: - Regulations

1. (1) These regulations may be called the Food Safety and Standards (Labelling and Display) First Amendment Regulations, 2026.

(2) They shall come into force on 1st July,2027.

2. In the Food Safety and Standards (Labelling and Display) Regulations, 2020 (herein after referred to as the said regulations), -

(a) in regulation 5, in sub-regulation (3), -

(i) in clause (b), in sub-clause (iv), after the proviso, the following proviso shall be inserted, namely :- “Provided further that per serve percentage (%) contribution to Recommended dietary allowances (RDA) and number of servings per pack may not be given for Infant Nutrition products as defined under the Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020.”;

(ii) in clause (c), -

(A) for sub-clause (i), the following shall be substituted, namely:- “(i) Raw agricultural minimally processed products such as wheat, rice, cereals, pulses, fruits and vegetables and/or products that comprise a single ingredient.

Explanation. - Minimally processed foods are the ones that are slightly altered for the main purpose of preservation but which do not substantially change the nutritional content of the food, which may involve cleaning and removing inedible or unwanted parts, grinding, refrigeration, pasteurization, fermentation, freezing, and vacuum-packaging.”;

(B) sub-clause (ii) shall be omitted;

(C) for sub-clause (xiii), the following sub-clause shall be substituted, namely :- “(xiii) Health supplements, Nutraceuticals and Foods for Special Dietary Uses (FSDU) in tablet, pills and capsule format, with respect to macronutrients, when sources of energy are insignificant.”

(b) in regulation 8, sub-regulation (1) (a) shall be renumbered as (1A) and after sub-regulation (1A) as so renumbered, the following sub-regulation shall be inserted, namely :- “(1B) The logos notified under Food Safety and Standards Regulations may not be given where the surface area of the package is not more than 100 square centimetres, but this information shall be given on the multi- unit packages.”

(c) in regulation 10, -

(i) for sub-regulation (1), the following shall be substituted, namely :- “(1) Every packaged food meant for non-retail sale shall provide the following mandatory information

either on the container or pasted on the label thereto:6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(a) Name of the food;

(b) FSSAI Logo and License number;

(c) Date marking and storage instructions, when required for the safety or integrity of the product;

(d) Lot number or Batch number or Code number; and

(e) Name and address of the manufacturer or packer (including country of origin for imported packages)

Provided that in case of non-retail container containing multiple types of food, the mandatory

information shall be provided for all the types of foods contained therein:

Provided further that non-retail container, which provides access to all the information required by sub-regulation (1) of regulation 10 on the label of pre-packaged foods within the non-retail container, the information stipulated in sub-regulation (1) of regulation 10 is not required.”;

(ii) for sub-regulation (2), the following shall be substituted, namely:- “(2) The following information if not provided on the label shall be provided in the accompanying

documents:

(a) List of ingredient;

(b) Declaration regarding Veg or Non-Veg and

(c) Net Quantity

Provided that the information required under sub-regulation (2) of regulation 10 shall be traceable to the food in non-retail container:

Provided further that if all information required under sub-regulation (2) of regulation 10 is made available on the label of non-retail container or pre-packaged foods within the non-retail container, sub- regulation (2) of sub-regulation 10 does not apply:

Provided also that in the case of a non-retail container used as a food transportation unit that is not amenable to possess a label, all the information required under sub-regulations (1) and (2) of regulation 10 shall be provided in the accompanying documents or through appropriate other means (e.g. electronically between food businesses) and shall be effectively traceable to the food in such containers.”;

(iii) for sub-regulation (4), the following shall be substituted, namely:- “(4) Every package meant for non-retail sale shall be clearly identifiable as such. If the container is not clearly identifiable as a non-retail container, the container shall-

(a) bear a statement to indicate that the food is not intended to be sold directly to the consumer or to clearly identify it as a non-retail container. Some examples of such statements are:

(i) NON-RETAIL CONTAINER;

(ii) NON-RETAIL CONTAINER - NOT FOR DIRECT SALE TO CONSUMER; or

(b) carry any other mark that indicates that the container is not intended to be sold directly to the consumer.”;

(iv) after sub-regulation (4), the following sub-regulation shall be inserted, namely :- “(5) General Information:

(a) Information and the statements required to appear on the label by virtue of these Regulations or any other Regulations shall be clear, prominent, readily legible and applied in such a manner that any tampering with it will be evident.

(b) The mandatory information required on the label under sub-regulation (1) of regulation 10 shall appear in a prominent position on the non-retail container and shall be readily accessible under normal handling and use of the container.’’

(d) in the said regulations, in Schedule-I, for the paragraph (1), the following paragraph shall be substituted, namely :- “(1) Every package of food fortified as per Food Safety and Standards (Fortification of Foods) Regulations, 2018, shall carry the words “fortified with ………… (name of the fortificant)” and the logo, as specified below, on the label and may also carry a tag line “Sampoorna Poshan Swasth Jeevan” under the logo.”;

(e) in the said regulations, in Schedule-II, -[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7

(i) in paragraph 1, in sub-paragraph (3), in the Table,-

(A) against serial number 1, under column (3) with the heading “Declarations”, after the existing entry, the following note shall be inserted, namely :- “Note: This warning statement shall be clearly legible or audible in advertisements related to Pan Masala”.

(B) against serial number 3, under column (3) with the heading “Declarations”, for clause (iv), following shall be substituted, namely :- “(iv) Not recommended for phenylketonurics; for children; pregnant or lactating women (in case of Aspartame-Acesulfame salt or admixture or combination of Aspartame and Acesulfame Potassium)”.

(ii) in paragraph 1, in sub-paragraph (4), in the Table, -

(A) against serial number 1, under column (3) with the heading “Declarations”, for clause (iv) the following clause shall be substituted, namely :- “(iv) Not recommended for phenylketonurics; for children; pregnant or lactating women (in case of Aspartame-Acesulfame salt or admixture or combination of Aspartame and Acesulfame Potassium).”;

(B) against serial number 2, under column (3) with the heading “Declarations”, after the proviso, the following proviso shall be inserted, namely :- “Provided further that the repetition of information may not be required for combination of sweeteners.”;

(iii) for the words “pregnant and lactating mothers”, wherever they occur, the words “pregnant or lactating women” shall be substituted.
