और उि रािपत्र की प्रजतयां िनता को 24 निंबर, 2020 को उपलब्ध करा िी गई थीं; और उि प्रारूप जिजनयमों के संबंध में िनता से प्राप्त आक्षेपों और सुझािों पर भारतीय खाद्य सुरक्षा और मानक प्राजधकरण द्वारा जिचार कर जलया गया है;

अत: अब उि अजधजनयम की धारा 31 के साथ पठठत धारा 92 की उप-धारा (2) के खंड (ण) द्वारा प्रित्त िजियों का प्रयोग करते हुए, भारतीय खाद्य सुरक्षा और मानक प्राजधकरण केंद्रीय सरकार के पूिच अनुमोिन से 'खाद्य सुरक्षा और मानक (खाद्य कारबार का अनुज्ञापन और रजिस्ट्रीकरण) जिजनयम, 2011' में और संिोधन करने के जलए जनम्नजलजखत जिजनयम बनाता है, अथाचत्:—

1. (1) इन जिजनयमों का संजक्षप्त नाम खाद्य सरु क्षा और मानक (खाद्य कारबार का अनज्ञु ापन और रजिस्ट्र ीकरण) सिं ोधन जिजनयम, 2026 ह।ै 1756 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(2) ये रािपत्र में इनके प्रकािन की तारीख से प्रिृत्त होंगे।

2. खाद्य सुरक्षा और मानक (खाद्य कारबार का अनुज्ञापन और रजिस्ट्रीकरण) जिजनयम, 2011 (जिसे इसमें इसके पश्चात 'उि जिजनयम' कहा गया ह)ै में, जिजनयम 1.2 के उप-जिजनयम 1.2.1 में, खंड (4) के स्ट्थान पर जनम्नजलजखत खंड रखा िाएगा, अथाचत्, —

4. “लघ ुखाद्य कारबार संचालक” से ऐसा कोई भी खाद्य कारबार संचालक अजभप्रेत ह,ै िो स्ट्ियं दकसी भी खाद्य पिाथच का जनमाणच या जिक्रय करता हो, या िो लघु खुिरा जिक्रेता, पथ खाद्य जिक्रेता, फेरीिाला, घुमंतू जिक्रेता, अस्ट्थायी स्ट्टॉल संचालक या फूड रक संचालक हो; या धार्मचक या सामाजिक आयोिनों में खाद्य पिाथों का जितरण करता हो (केटरर को छोड़कर); अथिा खाद्य कारबार से संबंजधत लघु-स्ट्तरीय, कुटीर या अन्य समान उद्योगों या सूक्ष्म खाद्य कारबार में संलग्न हो।”

3. उि जिजनयम के जिजनयम 2.1 में, — (क) उप-जिजनयम 2.1.1 में, —

(i) खंड (4) के परंतुक के पश्चात्, जनम्नजलजखत परंतुक अंतःस्ट्थाजपत दकया िाएगा, अथाचत्, — “परंतु यह और दक खाद्य प्राजधकरण आिश्यक िस्ट्तािेि प्रस्ट्तुत दकए िाने पर तत्काल रजिस्ट्रीकरण प्रमाणपत्र प्रिान कर सकता ह ैऔर खाद्य प्राजधकरण इस संबंध में आिेि द्वारा दकसी भी ितच या प्रदक्रया को जनर्िचष्ट कर सकता है।”

(ii) खंड (6) के पश्चात्, जनम्नजलजखत खंड रखा िाएगा, अथाचत्, — “(7) पथ खाद्य जिक्रेता, फेरीिाले, फूड रक, काटच तथा ऐसा अन्य कोई भी खाद्य कारबार, िो 'पथ जिक्रेता (िीजिका संरक्षण पथ जिक्रय जिजनयमन) अजधजनयम, 2014 (2014 का 7)' के अंतगचत पंिीकृत है, उसे खाद्य सुरक्षा और मानक अजधजनयम, 2006 के अंतगचत पंिीकृत माना िाएगा। परंतु छूट प्राप्त सजहत खाद्य कारबार संचालकों को अनुसूची 4 में िी गई स्ट्िच्छता और सफाई संबंधी आिश्यकताओं का पालन करना होगा। परंतु यह और दक खाद्य प्राजधकरण इस खंड के प्रयोिन के जलए इस संबंध में कोई ितच या प्रदक्रया जनर्िचष्ट कर सकेगा।” “(8) खाद्य प्राजधकरण समय-समय पर जिजभन्न खाद्य कारबार के जलए रजिस्ट्रीकरण प्रिान करने हते ु टनचओिर की सीमा अथिा दकसी अन्य िगीकरण मानिंड तथा रजिस्ट्रीकरण प्राजधकारी को जनर्िचष्ट कर सकेगा।” (ख) उप-जिजनयम 2.1.2 के खंड (5) के पश्चात् जनम्नजलजखत खंड अंतःस्ट्थाजपत दकया िाएगा, अथाचत्: - “(6) खाद्य प्राजधकरण समय समय पर जिजभन्न खाद्य कारबार के जलए पात्रता मानिंड या ितों के जलए, खाद्य कारबार और अनुज्ञजप्त प्राजधकारी को आरंभ करने या िारी करने के जलए जिजनर्िचष्ट कर सकेगा।” (ग) उप-जिजनयम 2.1.7 के स्ट्थान पर जनम्नजलजखत को रखा िाएगा, अथाचत्, — “2.1.7 रजिस्ट्रीकरण और अनुज्ञजप्त की जिजधमान्यता — (1) इन जिजनयमों के अधीन प्रिान दकया गया अनुज्ञजप्त अथिा रजिस्ट्रीकरण प्रमाणपत्र, िब तक दक उसे अन्यथा जनलंजबत, रद्द या अभ्यपचण न दकया िाए, जिजधमान्य एिं प्रभािी रहगे ा।

(2) यदि कोई खाद्य कारबार संचालक खाद्य प्राजधकरण द्वारा जनधाचठरत िार्षचक अनुज्ञजप्त फीस या रजिस्ट्रीकरण फीस का भुगतान करने में जिफल रहता ह,ै या िहााँ लागू हो िहााँ 'खाद्य सुरक्षा अनुपालन ठरटनच' प्रस्ट्तुत करने में जिफल रहता ह,ै तो उसकी अनुज्ञजप्त या रजिस्ट्रीकरण जनलंजबत माना िाएगा। िार्षचक फीस का भुगतान करने या उजचत िुमानच े सजहत ठरटनच प्रस्ट्तुत करने के पश्चात् जनलंबन रद्द कर दिया िाएगा। जनलंबन की अिजध के िौरान खाद्य कारबार संचालक दकसी भी खाद्य कारबार गजतजिजध में संलग्न नहीं होगा। जनलंबन अिजध के िौरान की गई दकसी भी खाद्य कारबार गजतजिजध को जनयमों का उल्लंघन माना िाएगा और अजधजनयम के अधीन िाजस्ट्त सजहत आगे की कारचिाई की िाएगी।

(3) कारबार बंि होने की जस्ट्थजत में, खाद्य कारबार संचालक ऐसे बंि होने की तारीख से तीस दिनों के भीतर संबंजधत अनुज्ञजप्त प्राजधकारी या रजिस्ट्रीकरण प्राजधकारी को यथाजस्ट्थजत, जलजखत में सूजचत करेगा और इन जिजनयमों के अधीन िारी दकया गया रजिस्ट्रीकरण प्रमाणपत्र या अनुज्ञजप्त का अभ्यपचण करेगा।

(4) इन जिजनयमों के अधीन संित्त दकसी फीस का कोई ठरफंड रजिस्ट्रीकरण प्रमाणपत्र या अनुज्ञजप्त के ऐसे अभ्यपचण पर अनुज्ञेय नहीं होगा।

(5) खाद्य प्राजधकरण इस उप जिजनयम के प्रयोिन के जलए कोई ितच या प्रदक्रया जिजनर्िचष्ट कर सकेगा।"; (घ) उप-जिजनयम 2.1.16 के पश्चात् जनम्नजलजखत उप-जिजनयम अंतःस्ट्थाजपत दकया िाएगा, अथाचत्, — “2.1.17 जनरीक्षण और संपरीक्षा — (1) खाद्य प्राजधकारी स्ट्ियं या इस उद्देश्य के जलए प्राजधकृत एिेंजसयों के माध्यम से खाद्य कारबारों का आिजधक जनरीक्षण और खाद्य सुरक्षा संपरीक्षा सुजनजश्चत करेगा।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3

(2) खाद्य प्राजधकरण खाद्य कारबार के आिजधक जनरीक्षण और खाद्य सुरक्षा संपरीक्षा की स्ट्कीम प्रिान कर सकेगा। जनरीक्षण की आिृजत्त और प्रकृजत का जनधाचरण गजतिील िोजखम-आधाठरत तंत्र, खाद्य कारबार के प्रकार, पूिच अनुपालन इजतहास, तृतीय-पक्ष संपरीक्षा पठरणामों और संबंजधत खाद्य पिाथों की िोजखम श्रेणी के आधार पर दकया िाएगा।

(3) खाद्य सुरक्षा आयुि अपनी-अपनी अजधकाठरता में खाद्य कारबारों के आिजधक जनरीक्षण के जलए खाद्य और प्रजतष्ठान से िुड़े िोजखमों के आधार पर योिनाएाँ तैयार करेंगे।

(4) अजधकाठरता िाला खाद्य सुरक्षा अजधकारी या इस प्रयोिन के जलए खाद्य सुरक्षा आयुि द्वारा जििेष रूप से प्राजधकृत कोई अजधकारी, रजिस्ट्रीकृत या अनुज्ञजप्त प्राप्त खाद्य कारबार संचालकों का आिजधक जनरीक्षण करेगा या खंड (3) के अधीन खाद्य सुरक्षा आयुि द्वारा यथा जनधाचठरत जनरीक्षण करेगा।

(5) खाद्य सुरक्षा आयुि या खाद्य प्राजधकरण के जनिेि पर, खाद्य कारबार संचालक को अपने खचच पर भारतीय खाद्य सुरक्षा और मानक प्राजधकरण द्वारा मान्यता प्राप्त तृतीय पक्ष संपरीक्षा एिेंसी या सपं रीक्षकों से खाद्य सुरक्षा संपरीक्षा करानी होगी। खाद्य कारबार संचालक संपरीक्षक के जलए उपलब्धता सुजनजश्चत करेगा और उनके द्वारा अनुरोजधत सभी अजभलेख उपलब्ध कराएगा।” राजित पुनहानी, मुखय कायचकारी अजधकारी [जिज्ञापन-III/4/असा./748/2025-26] ठटप्पणी—खाद्य सुरक्षा और मानक (खाद्य कारबार का अनुज्ञापन और रजिस्ट्रीकरण) जिजनयम, 2011 भारत के रािपत्र, असाधारण, भाग III, खंड 4 में अजध. संखया - फा. सं. 2-15015/30/2010, तारीख 1 अगस्ट्त, 2011 द्वारा प्रकाजित दकए गए थे और तत्पश्चात् अजधसूचना संखया फा.स.ं 2-15015/30/2021, तारीख 10 िून, 2014, फा.सं. 2-15015/30/2021, तारीख 13 िुलाई, 2016 और फा.सं. स्ट्टैंडर्डसच/ओ.एंड एफ./नोठटदफकेिन (6)/एफ.एस.एस.ए.आई., 2017, तारीख 24 अिूबर, 2017 द्वारा संिोजधत दकए गए थे। FOOD SAFETY AND STANDARDS AUTHORITY OF INDIA

NOTIFICATION New Delhi, the 10th March, 2026 No. RCD-01002/1/2021-Regulatory-FSSAI-Part(1).—Whereas a draft of the Food Safety and Standards (Licensing and Registration of Food Businesses) Amendment Regulations, 2020 was published, as required under sub-

section (1) of section 92 of the Food Safety and Standards Act, 2006 (34 of 2006), vide notification of the Food Safety and Standards Authority of India number F. No. 15(6)2017/FLRS/RCD/FSSAI, dated the 17th November, 2020, in the Gazette of India, Extraordinary, Part III, section 4,dated the 18th November,2020, inviting objections and suggestions from the persons likely to be affected thereby, before the expiry of the period of sixty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public;

And whereas the copies of the said notification were made available to the public on the 24h November, 2020;

And whereas, the objections and suggestions received from the public in respect of the said draft regulations have been considered by the Food Safety and Standards Authority of India;

Now, therefore, in exercise of the powers conferred by clause (o) of sub-section (2) of section 92 read with

section 31 of the said Act, the Food Safety and Standards Authority of India, with the previous approval of the Central Government, hereby makes the following regulations further to amend the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011, namely: -

1. (1) These regulations may be called the Food Safety and Standards (Licensing and Registration of Food Businesses) Amendment Regulations, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011 (hereinafter referred to as the said regulations), in regulation 1.2, in sub-regulation 1.2.1, for clause 4, the following clause shall be substituted, namely:-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] ‘4. Petty Food Business Operator” means any food business operator, who manufactures or sells any article of food himself or a petty retailer, street food vendor, hawker, itinerant vendor or temporary stall holder or food truck or distributes foods including in any religious or social gathering, except a caterer or such other food business including small scale or cottage or such other industries relating to food business or tiny food business.’;

3. In the said regulations, in regulation 2.1,-

(a) in sub-regulation 2.1.1,-

(i) in clause (4), after the proviso, the following proviso shall be inserted, namely:- “Provided further that the Food Authority may grant registration certificate instantly on submission of requisite documents and the Food Authority may specify any condition or procedure in this regard.”;

(ii) after clause (6), the following shall be substituted, namely:- “(7) Street food vendors, hawkers, food trucks, carts and any such other food businesses registered under the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 (7 of 2014) shall be deemed registered under the Food Safety and Standards Act,2006 (34 of 2006):

Provided that the food business operators, including those exempted shall comply with hygiene and sanitary requirements specified in Schedule 4:

Provided further that the Food Authority may specify any condition or procedure in this regard for the purpose of this clause;

(8) The Food Authority may specify turnover threshold or any other classification criteria and registering authority for granting registration for various food business from time to time.”;

(b) in sub-regulation 2.1.2, after clause (5), the following clause shall be inserted, namely:- “(6) The Food Authority may specify the eligibility criteria or conditions for commencing or carrying on food businesses and Licensing Authority for various food business from time to time.” ;

(c) for sub-regulation 2.1.7, the following shall be substituted, namely: - “2.1.7 Validity of Registration and License.- (1) A license and registration certificate granted under these regulations shall be valid and subsisting, unless otherwise suspended, cancelled or surrendered.

(2) Any food business operator fails to pay the annual license fee or registration fee as specified by the Food Authority or fails to submit the return on or before the due date, wherever applicable, the license or registration shall be deemed suspended. The License so suspended shall be revoked after payment of the due annual fee or submission of the return along with due penalty, as the case may be, and during such suspension the food business operator shall not involve in any food business activity. Any food business activity carried out during the suspension period shall be deemed non-compliant of the provision of the Act and the regulations shall attract subsequent action including penalty under the Act.

(3) In the event of closure of business, the food business operator shall, within thirty days from the date of such closure, inform the concerned Licensing Authority or Registering Authority, as the case may be, in writing and surrender the registration certificate or license issued under these regulations.

(4) No refund of any fee paid under these regulations shall be admissible upon such surrender of registration certificate or license

(5) The Food Authority may specify any condition or procedure for the purpose of this sub-regulation.”;

(d) after sub-regulation 2.1.16, the following sub-regulation shall be inserted, namely: - “2.1.17 Inspection and audit.- (1) The Food Authority shall ensure periodical inspection and food safety audit of the food businesses through its own or agencies authorised for this purpose by it.

(2) The Food Authority may provide a scheme of periodic inspection and food safety audit of the food businesses. Frequency and nature of inspections shall be determined through a dynamic risk-based mechanism, type of food business, past compliance history, third-party audit results and risk category of food handled.

(3) The Commissioner of Food Safety shall plans for periodic inspections of food businesses in the respective jurisdiction on the basis of risk associated with food and the establishment.

(4) The jurisdictional food safety officer or any officer specifically authorised by the Commissioner of Food[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 Safety for this purpose shall carry out inspection of the registered or licensed food business operators periodically or as decided by the Commissioner of Food Safety as specified under clause (3).

(5) The food business operator, on the direction of the Commissioner of Food Safety or the Food Authority, shall be required to get a food safety audit done by a third party auditing agency or auditors recognised by the Food Safety and Standards Authority of India, at its own cost. The food business operator shall grant access to the auditor and provide all records requested by them.”.
