1.1 आन जिजनयमों को “संयुक्त जिद्युत जिनयामक अयोग,केंद्र िाजसत प्रदेि जम्मू और कश्मीर ि केंद्र िाजसत प्रदिे लद्दाख (ईपभोक्ता जिकायत जनिारण फोरम, जिधयुत लोकपाल और ईपभोक्ता िकालत) जिजनयम, 2023" कहा जाएगा। 1955 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

1.2 ये जिजनयम जम्म ू और कश्मीर के संघ िाजसत प्रदेि और लद्दाख के संघ िाजसत प्रदेि म ें ईनके संबंजधत लाआसेंस प्राप्त क्षेत्रों में काम कर रह ेलाआसेंसधाठरयों / फ्रेंचाआजी पर लाग ूहोंग।े

1.3 ये जिजनयम राजपत्र म ेंईनके प्रकािन की जतजथ से लाग ूहोंगे।

2. ईद्देश्य, काय च क्षत्रे और प्रयोग:

2.1. ऄजधजनयम की धारा 42 के ऄतं गचत प्रदत ऄजधकारों के ऄलािा एक ईपभोक्ता के ऄजधकारों के साथ भेदभाि के जबना, ईक्त धारा 42 के ऄनसु ार प्रत्येक जितरण लाआसेंसधारी को अयोग के कदिा जनदिे ों के ऄनुसार एक ईपभोक्ता जिकायत जनिारण फोरम को स्ट्थाजपत करन े की अिश्यकता ह ैऔर कोइ भी ईपभोक्ता ऄपनी जिकायत का जनिारण फोरम से नहीं करािा पाता ह ै तो िह ऄपनी जिकायत लोकपाल को कर सकता है, जजसे अयोग के द्वारा जनयुक्त या मनोनीत ककया जाता ह,ै जजसे ईपभोक्ता की जिकायत को राज्य अयोग द्वारा जनर्ददष्ट समय सीमा और तरीके स ेजनपटाया जाना ह।ै

2.2. आन जिजनयमों का ईद्देश्य ऄजधजनयम की धारा 42 की धारा (5) के तहत ईपभोक्ता जिकायत जनिारण फोरम की स्ट्थापना के जलए कदिा-जनदेिों/जनदेिों/जिजनदेिों को जनधाचठरत करना ह ै और आसके जलए समय सीमा और तरीके को जनर्ददष्ट करना ह ै जजसके द्वारा ईपभोक्ता जिकायत जनिारणफोरमऔर ऄजधजनयम की धारा 42 की ईप-धारा

(6) के तहत जनयुक्त ककया जाने िाला लोकपाल ईपभोक्ताओं की जिकायतों का जनपटारा करेगा।

2.3. ये जिजनयम जम्मू और कश्मीर के संघ िाजसत प्रदेि और लद्दाख के संघ िाजसत प्रदेिों में ईनके संबंजधत लाआससें प्राप्त क्षेत्रों में काम कर रह ेलाआसेंसधाठरयों / फ्रेंचाआजी पर लागू होंगे।

2.4. आन जिजनयमों म ें जनजहत कुछ भी, स्ट्पष्ट रूप स े या जनजहत रूप स,े ईनके जलए ईपलब्ध ईपभोक्ताओं के ऄजधकारों और जििेषाजधकारों को प्रजतबंजधत नहीं करेगा।

3. पठरभाषाएँ आन जिजनयमों म,ें यकद संदभच के ऄनुसार ऄन्यथा अिश्यक नहीं है: (क) "ऄजधजनयम" का ऄथ चह ैजिद्युत ऄजधजनयम, 2003 (2003 का संख्या 36); (ख) "अपर्तू त का क्षत्रे '' का ऄथच िह क्षेत्र ह ै जजसके ऄंदर जितरण लाआसेंसधारी (फ्रेंचाआजी क्षेत्र सजहत) जबजली की अपूर्तत के जलए ऄपने लाआसेंस द्वारा ऄजधकृत ह;ै (ग) "ऄनलु ग्नक" का ऄथच ह ैजिजनयमों के साथ कदय ेगए ऄनुलग्नक ह;ै (घ) "ऄध्यक्ष" का ऄथच ह ैफोरम का ऄध्यक्ष;

(ङ) "अयोग" का ऄथ च ह ै जम्मू और कश्मीर संघ राज्य क्षेत्र और लद्दाख संघ राज्य क्षेत्र के जलए सयं ुक्त जिद्युत जनयामक अयोग; (च) जिकायतकता/च ईपभोक्ता का ऄथच ह ैऔर आसम ेंजनम्न िाजमल हैं:

(i) कोइ जबजली ईपभोक्ता या ईपभोक्ता जजसमें ईनके कानूनी ईत्तराजधकारी या िाठरस िाजमल ह,ैं जजनके पास लाआसेंसधारी के जिरुद्ध जिकायत ह ै और जो आसे सीध े या ऄपने प्रजतजनजधयों के माध्यम से दज च करता ह,ै

(ii) कोइ स्ट्िैजच्छक/पंजीकृत ईपभोक्ता, सोसाआटी/संघ या एक से ऄजधक संघ, जो आस ितचमान में लागू कानून के तहत पंजीकृत ह ैऔर ईपभोक्ताओं के व्यापक सामान्य या समान जहत म ेंजिकायत करते ह।ैं

(iii) कोइ भी व्यजक्त जजसका जबजली कनेक्िन काट कदया गया ह,ै

(iv) जबजली की अपूर्तत के जलए एक नए कनेक्िन के जलए एक अिदे क;

(v) ऄजधजनयम की धारा 2 के खडं 15 के तहत पठरभाजषत एक ईपभोक्ता

(vi) कोइ ऄपंजीकृत सघं या ईपभोक्ताओं का समूह जहां ईनके समान जहत हों; (छ) "जिकायत" का ऄथ च ह ैककसी जिकायतकताच द्वारा जलजखत रूप में, इ-मेल और फैक्स सजहत, या मौजखक रूप से फोन पर की गइ कोइ जिकायत, यकद ऐसे नंबर लाआसेंसधारी द्वारा जिकायत दजच करने के जलए जनर्ददष्ट ककए गए हैं, या[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 3 व्यजक्तगत रूप से ऐस े कायाचलयों में जाकर, जजसे लाआसेंसधारी द्वारा लाआसेंसधारी को जिकायत दज च करन े के जलए नाजमत ककया गया ह,ै जिकायत करना, जजसम ें जबना ककसी सीमा के, जनम्नजलजखत से संबंजधत जिकायतें िाजमल हो सकती ह:ैं

(i) ककसी लाआसेंस और/या ककसी ऄनुबंध या समझौते के ऄनुसरण म ें या जिद्युत अपूर्तत संजहता के ऄंतगचत या अयोग द्वारा जनर्ददष्ट लाआसेंसधाठरयों के प्रदिनच के मानकों के सबं ंध में;

(ii) कोइ ऄनुजचत व्यापार, कारोबार या प्रजतबंधात्मक व्यापार प्रथा जजसे लाआसेंसधारी द्वारा जिद्युत सेिा प्रदान करने म ेंऄपनाया जाता ह;ै

(iii) जबजली सेिाएं जो कक सुरक्षा कोड, जनयमों और जिजनयमों सजहत ककसी भी लागू कानून के प्रािधानों के ईल्लघं न में जनता के ईपयोग के जलए पेि की जा रही हैं, जैसा कक संबंजधत कानूनों के तहत सक्षम ऄजधकाठरयों द्वारा जनधाचठरत ककया जाता ह ै या जििेकपूणच ईद्योग प्रथाओं के माध्यम स े स्ट्थाजपत ककया जाता ह,ै और जजसके पठरणामस्ट्िरूप मानि, पिुधन या संपजत्त के जीिन और सुरक्षा को जोजखम और खतरे म ें पड़ जाते ह।ैं बिते कक जनम्नजलजखत को जिकायत के रूप म ेंनहीं माना जाएगा, ऄथाचत ्

(iv) ऄजधजनयम की धारा 126,127, 135 से 139, 142, 143, 149, 152 और 161 के लाग ू होन े से ईत्पन्न कोइ जिकायत;

(v) ककसी भी न्यायालय, या प्राजधकरण (लाआसेंसधारी के जनयंत्रण में एक प्राजधकरण को छोड़कर) या फोरम के समक्ष लंजबत या जनणचय जलया गया कोइ भी मामला, और

(vi) बकाया राजि की िसूली के संबधं में कोइ जिकायत जहां जबल की राजि जििाकदत नहीं है (ज) आन जिजनयमों के प्रयोजन के जलए "ईपभोक्ता" का ऄथ च ह ै ऄजधजनयम की धारा 2 की ईप-धारा 15 के तहत पठरभाजषत ईपभोक्ता और आसमें नए कनेक्िन के जलए अिेदन करन े िाला व्यजक्त भी िाजमल होगा। (झ) "जितरण लाआसेंसधारी" का ऄथच ह ै अपूर्तत के लाआसेंस प्राप्त क्षेत्र में ईपभोक्ताओं को जबजली की अपूर्तत के जलए जितरण प्रणाली को संचाजलत करने और बनाए रखने के जलए ऄजधकृत लाआसेंसधारी;

(ञ) "जिद्यतु सिे ा" म ें जििेष रूप से और िब्द की व्यापकता के पूिाचग्रह के जबना जिद्युत उजाच की अपूर्तत, जबललग, मीटररग और रखरखाि और कोइ ऄन्य सहायक सेिा भी िाजमल ह ै जो लाआसेंस के ऄनुसार या ककसी लागू कानून के तहत एक लाआसेंसधारी द्वारा ईपभोक्ता को प्रदान करना अिश्यक ह ै (ट) "जिद्युत लोकपाल" का ऄथ च ह ै ऄजधजनयम की धारा 42 की ईप-धारा (6) के तहत अयोग द्वारा जनयुक्त या नाजमत एक प्राजधकरण, जजसके पास ककसी भी ऐसे ईपभोक्ता द्वारा प्रजतजनजधत्ि ककया जा सकता है, जो कक फोरम द्वारा ईसकी जिकायत का जनिारण न होने से व्यजथत है;

(ठ) "फोरम" का ऄथ च ह ै'जबजली ईपभोक्ता जिकायत जनिारण फोरम', जजसे ऄजधजनयम की धारा 42 की ईप-धारा (5) के ऄनुसार प्रत्येक लाआसेंसधारी द्वारा गठठत ककया गया ह;ै (ड) "फ्रैंचाआजी" का ऄथच ह ै जितरण लाआसेंसधारी द्वारा अपूर्तत के ऄपने क्षेत्र के ऄंदर ककसी जििेष क्षेत्र में जबजली जितठरत करन े के जलए ऄजधकृत व्यजक्त;

(ढ) "जिकायत" का ऄथ च ह ै गणु ित्ता, प्रकृजत और प्रदिचन के तरीके में कोइ त्रुठट, ऄपूणतच ा, कमी या ऄपयाचप्तता, जजसे ईपभोक्ता द्वारा लाआसेंस, ऄनुबधं , समझौते या जबजली अपूर्तत के तहत जितरण लाआसेंसधारी द्वारा जनपापाकदत करन े के जलए प्रस्ट्तुत ककया जाता ह ै जैसा की संजहता या जितरण लाआसेंसधाठरयों के प्रदिचन के मानकों के संबंध म ें अयोग द्वारा जनर्ददष्ट ककया गया ह ै और आसमें ऄन्य बातों के साथ-साथ अयोग के ककसी भी अदेि का ऄनुपालन न करने या ईसके ऄनुसरण में की जाने िाली ककसी कारचिाइ के संबंध में जिकायतें िाजमल हैं, जो फोरम या जबजली लोकपाल, जैसा भी मामला हो के ऄजधकार क्षेत्र में ह।ैं हालांकक, ऄजधजनयम के जनम्नजलजखत प्रािधानों में स े ककसी के दायरे म ेंअने िाल ेमामल े आन जिजनयमों के तहत जिकायत नहीं ह:ैं

(i) ऄजधजनयम की धारा 126 के तहत जबजली का ऄनजधकृत ईपयोग;

(ii) ऄजधजनयम की धारा 135 से 139 के तहत ककए गए ऄपराध और दंड;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(iii) ऄजधजनयम की धारा 161 के तहत जबजली के जितरण, अपूर्तत या ईपयोग में दघु चटना से संबंजधत मुअिजा; तथा

(iv) बकाया की िसूली जहां जबल राजि जििाकदत नहीं ह;ै (ण) "अंतठरक जिकायत जनिारण प्रकोष्ठ" या "अइजीअर सले " का ऄथ च ह ै ईप-जिभाग, जिभाग या सकचल या जजला स्ट्तर पर जितरण लाआसेंसधारी द्वारा ऄजधसूजचत पहला प्राजधकरण जहां ईपभोक्ता ऄपनी जिकायत के जनिारण के जलए संपकच करता ह।ै (त) "लाआसेंसधारी" का ऄथ चह ैजितरण लाआसेंसधारी, जैसा कक ऄजधजनयम के तहत पठरभाजषत ककया गया ह;ै (थ) "सदस्ट्य" का ऄथ चह ैफोरम का सदस्ट्य; तथा (द) "प्रोज्युमर" का ऄथ च ह ै एक व्यजक्त जो जग्रड से जबजली का ईपभोग करता ह ै और अपूर्तत के समान लबद ु का ईपयोग करके जितरण लाआसेंसधारी के जलए जग्रड म ेंजबजली भी डाल सकता ह।ै (ध) "प्रजतजनजधत्ि" का ऄथच एक जिकायतकताच द्वारा लोकपाल को ककया गया प्रजतजनजधत्ि है, जो फोरम के अदिे (अंजिक या पणू च बखाचस्ट्तगी अदेि सजहत) से व्यजथत ह,ै या जनर्ददष्ट समय के ऄंदर फोरम द्वारा ईसकी जिकायतों का जनिारण नहीं ककया जाता ह,ै या फोरम द्वारा जारी अदेि से ऄसंतुष्ट ह ै या जनर्ददष्ट समय के ऄंदर लाआसेंसधारी द्वारा फोरम के अदेि को लाग ूनहीं करने पर व्यजथत ह;ै आन जिजनयमों में प्रयुक्त और पठरभाजषत नहीं ककए गए िब्दों और ऄजभव्यजक्तयों का ऄथच, लेककन जजन्ह ें ऄजधजनयम में पठरभाजषत ककया गया ह,ै ऄजधजनयम में जनर्ददष्ट ककए गए ऄथच के समान होगा, और आसके ऄभाि में, ईनका ऄथ च िही होगा जसै ा की जबजली अपूर्तत ईद्योग में अमतौर पर समझा जाता ह।ै

4. व्याख्या:-आन जिजनयमों को जिद्युत अपूर्तत संजहता और जिद्युत ऄजधजनयम 2003 की धारा 181 की ईप-धारा (2) के खंड (एक्स) और (जेडए) के प्रािधानों के ऄंतगचत अयोग द्वारा जनर्ददष्ट जितरण लाआसेंसधाठरयों के प्रदिचन के मानकों के ऄनुरूप माना जाएगा। । आन जिजनयमों के साथ ककसी भी ऄसंगजत के मामले में, जितरण लाआसेंसधाठरयों के प्रदिचन के मानक और जिद्युत अपूर्तत कोड मान्य होंगे। ऄध्याय II अतं ठरक जिकायत जनिारण फोरम

5. अतं ठरक जिकायत जनिारण फोरम का गठन

1. जितरण लाआसेंसधारी के पास समयबद्ध तरीके से जिकायतों को दजच करने और ईनका जनिारण करने के जलए जिजभन्न अंतठरक जिकायत जनिारणफोरम (अइजीअर) होंग।े जितरण लाआसेंसधारी का अइजीअर फोरम ईप- जिभाग, जिभाग, सकचल और क्षत्रे (जोन) स्ट्तर की जरूरतों को पूरा करेगा। प्रत्येक स्ट्तर पर फोरम में लाआसेंसधारी के ऄजधकारी और दो ईपभोक्ता/प्रोज्यूमर प्रजतजनजध होने चाजहए। नॉन-मॉनीटरी ईपभोक्ताओं की जिकायतों का समय पर जनिारण सुजनजित करने के जलए स्ट्तर I और स्ट्तर II के जलए सीमाएं जनधाचठरत की जा सकती ह।ैं लेिल III और लेिल IV संबंजधत ऄपीलीय प्राजधकारी हो सकते ह।ैं सभी स्ट्तरों के जलए जनगरानी की सीमा तय की जा सकती ह।ै

2. ऄपन ेक्षेत्र म ेंफ्रेंचाआजी के पास भी ऐसे अइजीअर फोरम होन े चाजहए।

3. अइजीअर फोरम केिल लाग ू जिजनयमों के प्रािधानों को ध्यान म ें रखत े हुए, मौजखक अदेि जारी करेगा और यह सुजनजित करेगा कक जिकायत दजच करने के ककसी भी मामले में 30 कदनों की ऄिजध के ऄंदर जनिारण करेगा और 45 कदनों से ऄजधक नहीं होन े चाजहए।

6. ईप-जिभाग/जिभाग/सकचल/क्षत्रे स्ट्तरीय मचं ों की सख्ं या, स्ट्थान और बठै कें क) प्रदिचन के मानकों, जजसके जलए जितरण लाआसेंसधारी द्वारा मुअिज े का भुगतान करना अिश्यक ह,ै में जनम्नजलजखत िाजमल ह,ैं लेककन आन तक सीजमत नहीं ह:ैं -

1. अयोग द्वारा जनर्ददष्ट की जान े िाली एक जििेष ऄिजध स ेऄजधक ईपभोक्ता को कोइ अपूर्तत नहीं;

2. अयोग द्वारा जनर्ददष्ट सीमा से ऄजधक अपूर्तत में रुकािटों की संख्या;[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 5

3. कनेक्िन जोड़न,े कनेक्िन काटने, कनेक्िन पनु ः जोड़न,े स्ट्थानांतरण के जलए जलया गया समय;

4. ईपभोक्ता श्रेणी, लोड में पठरितचन के जलए जलया गया समय;

5. ईपभोक्ता जििरण म ेंपठरितचन के जलए जलया गया समय;

6. खराब मीटरों को बदलने म ेंलगने िाला समय;

7. समयािजध जजसके ऄंदर जबलों की तामील की जानी ह;ै

8. िोल्टेज संबंधी जिकायतों के समाधान की समयािजध; तथा

9. जबल संबंधी जिकायतें। ख) चूंकक ये सभी सेिाएं सामान्य रूप से ईप-जिभाग/जिभाग स्ट्तर से संबंजधत ह,ैं साप्ताजहक/माजसक बैठक ईप- जिभाग/जिभाग स्ट्तर पर अयोजजत की जा सकती ह।ै सर्दकल/मुख्य ऄजभयंता स्ट्तर की बैठकें अिश्यकता के अधार पर ऄजधमानतः जतमाही अधार पर होंगी।

7. ईप-जिभाग/जिभाग/सकचल/क्षत्रे स्ट्तरीय फोरम के सदस्ट्य

1. ईप-जिभाग स्ट्तर के अइजीअर फोरमके संगठन में जनम्न िाजमल होंगे: क. ऄध्यक्ष - संबंजधत ईपखंड के सहायक कायचकारी ऄजभयंता (एइइ) ख. सदस्ट्य सजचि- ईप-जिभाग कायाचलय में एइ/जेइ. ग. सदस्ट्य-संबंजधत फीडर प्रबंधक घ. सदस्ट्य- संबंजधत एइइ द्वारा नाजमत दो ईपभोक्ता/प्रोज्यूमर प्रजतजनजध

2. जिभाग स्ट्तरीय अइजीअर फोरममें जनम्न िाजमल होंगे: क) ऄध्यक्ष - संबंजधत प्रभाग के कायचकारी ऄजभयंता (एक्सइएन) ख) सदस्ट्य- संबंजधत ईप-जिभाग के सहायक कायचकारी ऄजभयंता (एइ) ग) सदस्ट्य- संबंजधत एक्सइएन द्वारा नाजमत दो ईपभोक्ता प्रजतजनजध घ) सदस्ट्य सजचि - कायचकारी ऄजभयंता कायाचलय म ेंजेइ / एएओ सदस्ट्य सजचि के रूप म ें

3. सर्दकल स्ट्तर के अइजीअर के फोरम में जनम्न िाजमल होंगे: क) ऄध्यक्ष-संबंजधत सकचल के ऄधीक्षक़ ऄजभयंता (एसइ) ख) सदस्ट्य- सबं ंजधत जिभाग के कायचकारी ऄजभयंता। ग) सदस्ट्य- संबंजधत एसइ द्वारा नाजमत दो ईपभोक्ता/प्रोज्यूमर प्रजतजनजध घ) एसइ कायाचलय में सदस्ट्य सजचि, एइ/जेइ

4. क्षेत्र स्ट्तरीय अइजीअर फोरममें जनम्नजलजखत िाजमल होंगे: क) ऄध्यक्ष - संबंजधत लिग के मख्ु य ऄजभयंता (सीइ) ख) सदस्ट्य-संबंजधत सकचल के ऄधीक्षक़ ऄजभयंता ग) सदस्ट्य- संबंजधत सीइ द्वारा नाजमत दो ईपभोक्ता/प्रोज्यूमर प्रजतजनजध घ) सीइ के कायाचलय म ेंसदस्ट्य सजचि-सीएओ/एइइ

8. सदस्ट्य सजचि, कमचच ारी एि ंईप जिभाग/जिभाग/सकचल/क्षत्रे स्ट्तरीय मचं ों के कामकाज संबंजधत मंचों के ऄध्यक्ष, अदिे द्वाराऄपने ककसी ऄधीनस्ट्थ ऄजधकारी या कमचचारी को ऄनुबंध I के ऄनुसार अिेदन प्राप्त करने और ईसकी पािती जारी करन े के जलए ऄजधकृत कर सकते ह।ैं ऄध्यक्ष के कायाचलय में तनै ात ककसी भी ऄजधकारी को सदस्ट्य सजचि के रूप म ेंनाजमत ककया जाना चाजहए।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

9. मनोनीत सदस्ट्यों की पात्रता फोरम में एइइ / एक्सइएन / एसइ / सीइ के लाआसेंसधारी के सदस्ट्य और ऄन्य सदस्ट्य िाजमल होंगे और सदस्ट्य सजचि भी ईपयुक्त िठरष्ठता के लाआससें धारी के ऄजधकारी होंगे। नामांककत ईपभोक्ता/प्रोज्यूमर प्रजतजनजध जपछल े 3 िषों स े लगातार लाआसेंसधारी और मौजूदा श्रेणी के तहत पंजीकृत ईपभोक्ता होंगे, जजनका पूिचिृत्त ऄच्छा होगा और जजनका जबजली का कोइ बकाया नहीं ह।ै

10. मचं ों की कायिच ाही नाजमत ऄजधकारी या ऄजधकृत कोइ भी ऄजधकारी जिकायतकताच को ऄनलु ग्नक I के साथ संलग्न प्रारूप में पािती दगे ा और यकद कोइ दस्ट्तािेज अिेदन के साथ संलग्न नहीं ककया गया है, तो ईसका स्ट्पष्ट रूप स े पािती पर ईल्लेख ककया जाएगा। बिते कक यकद सभी अिश्यक दस्ट्तािेज अिेदक के साथ संलग्न हैं, तो आस े जितरण लाआसेंसधारी के प्रदिचन के मानक म ें जनर्ददष्ट समय-सीमा के ऄनुसार जनपटाना होगा।

11. जिकायतों के जलए मचं ों का पदानक्रु म

1. गैर-मौकद्रक/सामान्य प्रकृजत की जिकायतें जैसे अपूर्तत की गणु ित्ता, सेिा में दोष और जितरण लाआसेंसधारी द्वारा प्रदिनच के मानक से संबंजधत: क. संभाग स्ट्तर - संभाग के एलटी अपूर्तत ईपभोक्ताओं की जिकायत ख. संभाग स्ट्तर - संभाग के एचटी/इएचटी अपूर्तत ईपभोक्ताओं की जिकायत ग. सकचल स्ट्तर - सकचल के एलटी अपूर्तत ईपभोक्ताओं की जिकायत घ. क्षेत्र स्ट्तर - लिग के एचटी/इएचटी अपूर्तत ईपभोक्ताओं की जिकायत

2. ऄजधजनयम की धारा 126 और 135 के ऄंतगचत अने िाल े मामलों को छोड़कर जबजली जबलों, बकाया की िसूली, लाआसेंसधारी द्वारा ईठाइ गइ मांग के भगु तान से संबंजधत मौकद्रक प्रकृजत की जिकायत: क. ईप-जिभाग स्ट्तर - 1,00,000/- रुपय ेकी मौकद्रक सीमा;

ख. जिभाग स्ट्तर - 7,50,000/- रुपये की मौकद्रक सीमा; ग. सर्दकल (जजला) स्ट्तर - 30,00,000/- रुपय ेकी मौकद्रक सीमा; घ. क्षेत्र स्ट्तर - 50,00,000/- रुपय ेकी मौकद्रक सीमा;

12. जिकायत जनिारण की प्रकक्रया

(1) जिकायत के साथ एक ईपभोक्ता आन जिजनयमों के ऄनुबंध I में पंजीकृत डाक/इमेल/ऑनलाआन मोड के माध्यम स े जलजखत रूप म ेंऐसी जिकायत के बारे में अइजीअर फोरम को सूजचत कर सकता ह।ै

(2) बिते कक जहां ऐसी जिकायत जलजखत रूप में नहीं की जा सकती है, अइजीअर फोरम मौजखक रूप से जिकायत करने िाल ेव्यजक्त को जलजखत रूप में ईसे पुन: प्रस्ट्ततु करने के जलए सभी ईजचत सहायता प्रदान करेगा।

(3) अइजीअर फोरम का कायाचलय जिकायत प्राप्त होने की जतजथ से 24 घंटे के ऄंदर ईपभोक्ता को जिकायत की प्राजप्त की पािती जारी करेगा। जहां जिकायत व्यजक्तगत रूप से प्रस्ट्ततु की गइ है, प्रस्ट्ततु करन े के समय पािती प्रदान की जाएगी।

(4) बिते कक जहा ं जिकायत अइजीअर फोरम को इमेल द्वारा प्रस्ट्तुत की जाती ह,ै ईपभोक्ता को जिकायत की प्राजप्त की पािती जल्द से जल्द ठरटनच इमेल द्वारा प्रदान की जाएगी।

(5) बित े यह भी कक जहा ं जिकायत इमले द्वारा प्रस्ट्तुत की जाती है, ईसकी हाडच कॉपी को ऄलग से अइजीअर फोरम पर जमा करन े की अिश्यकता नहीं होगी।

(6) बिते यह भी कक अइजीअर फोरम ऐसे आलेक्रॉजनक ठरकॉड च को असानी स े प्राप्त करन े के जलए हाड च कॉपी के रूप में रखेगा।[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 7

(7) ईप-खंड (क़) के प्रािधानों के बािजूद, संबंजधत कायाचलय में जितरण लाआसेंसधारी के ऄजधकाठरयों द्वारा प्रदान की गइ जिकायत की जलजखत पािती (जो अइजीअर फोरम का जहस्ट्सा हो सकती ह ै या नहीं भी हो सकती) को आन अदेिों के प्रयोजनों के जलए पािती माना जाएगा।

(8) ईपभोक्ता जिकायत करन े की जतजथ स े 1 िष च के ऄंदर जिकायत के जनिारण के जलए अइजीअर फोरम स े संपकच कर सकता ह।ै

13. अइ जी अर मचं ों का व्यापक प्रचार

(1) ईप-जिभाग/जिभाग/सकचल/मुख्य ऄजभयंता स्ट्तर के अइजीअर मंचों के नाम, पते, इ-मेल और टेलीफोन नंबरों को लप्रट और आलेक्रॉजनक मीजडया के माध्यम से और जितरण लाआसेंसधारी के सभी कायाचलयों के नोठटस बोड च पर व्यापक रूप से प्रचाठरत ककया जाएगा,और ईपभोक्ताओं को ईनके जबजली जबलों के माध्यम से सूजचत ककया जाएगा।

(2) जितरण लाआसेंसधारी आन जिजनयमों के लागू होन े के तीन (3) महीनों के ऄंदर, ऄपनी िेबसाआटों पर अइजीअर मंचों के बारे में जानकारी प्रदान करेगा, जजसके माध्यम से ईपभोक्ता अइजीअर मंचों के संपकच जििरण, अइजीअर फोरम द्वारा जारी अदिे और जनदेि,और ऄगली सुनिाइ की जतजथ अकद को प्राप्त कर सकते ह।ैं

14. ठरपोर्टटग अिश्यकताए ँ

(1) जितरण लाआसेंसधारी/कॉपोरेट स्ट्तर के सीजीअरएफ, अयोग और लोकपाल को जिकायतों के जनपटान पर अइजीअर मंचों की एक त्रैमाजसक ठरपोटच प्रस्ट्तुत करेंगे। ठरपोटच जजस जतमाही से संबंजधत है, ईसकी समाजप्त के 15 कदनों के ऄंदर प्रस्ट्तुत की जानी चाजहए।

(2) त्रैमाजसक ठरपोटच ऄनुलग्नक-II में जनर्ददष्ट प्रारूप के ऄनुसार प्रस्ट्ततु की जानी चाजहए।

(3) जितरण लाआसेंसधारी जित्तीय िषच के दौरान अइजीअर मंचों की गजतजिजधयों की सामान्य समीक्षा िाली एक िार्तषक ठरपोटच अयोग और लोकपाल को भी प्रस्ट्तुत करेगा।

(4) ठरपोटच जजस जित्तीय िषच से संबंजधत ह,ै ईसकी समाजप्त के 45 कदनों के ऄदं र प्रस्ट्ततु की जानी चाजहए। अयोग द्वारा ईपरोक्तानुसार प्राप्त प्रजतिेदनों को अयोग की िेबसाआट पर डाला जाएगा। अयोग समय-समय पर अइजीअर मंचों के प्रदिनच की समीक्षा भी कर सकता ह।ै ऄध्याय III ईपभोक्ता जिकायत जनिारण फोरम (सीजीअरएफ)

15. फोरम की स्ट्थापना

(1) ऄजधजनयम की धारा 42 की ईप-धारा (5) के ऄनुसार, प्रत्येक जितरण लाआसेंसधारी, आन जिजनयमों की ऄजधसूचना की जतजथ या लाआसेंस देने की जतजथ या ठरकॉडच पर लेने की जतजथ के छह महीने के ऄंदर जितरण लाआसेंसधारी की जस्ट्थजत को ठरकॉड च करेगा। डीम्ड जडस्ट्रीब्यूिन लाआसेंसधाठरयों के मामले में, जो भी बाद म ें हो, कंपनी स्ट्तर पर जबजली ईपभोक्ता जिकायत जनिारण फोरम की स्ट्थापना करेगा ताकक आन जिजनयमों में जनर्ददष्ट समय सीमा के ऄंदर और आन जनयमों के तहत जनधाचठरत कदिाजनदेिों के ऄनसु ार जिकायतकताचओं की जिकायतों का जनिारण सुजनजित ककया जा सके। जिजनयम अिश्यकता के अधार पर, फोरम को भजिपाय म ें अइजीअर सेल के स्ट्थान पर जोनल (क्षत्रे ), सकचल, जिभाग, ईप-जिभाग स्ट्तर तक बढाया जा सकता ह।ै

(2) ऐसा फोरम प्राकृजतक न्याय के जसद्धांतों का पालन करेगा, जजसमें ऄन्य बातों के साथ-साथ जनम्नजलजखत िाजमल ह:ैं (क) िे ईपभोक्ताओं के जहतों की रक्षा करेंग;े (ख) िे ईपभोक्ताओं को ईनके ऄजधकारों के बारे म ेंसूजचत करेंगे;

(ग) िे जिकायतों के जनिारण को सगु म और तेज करेंग;े (घ) िे यह सुजनजित करेंग े कक जितरण लाआसेंसधारी की ओर स े ईनकी जिकायतों के जनिारण में जिफलता या देरी की जस्ट्थजत म ेंईपभोक्ताओं के पास एक ईपाय भी हो।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(3) केंद्र िाजसत प्रदेि जम्म ूऔर कश्मीर के जलए, संबंजधत जितरण लाआसेंसधारी के कंपनी स्ट्तर पर ईपभोक्ता जिकायत जनिारण फोरम की स्ट्थापना की जाएगी। आसी तरह, केंद्र िाजसत प्रदिे लद्दाख के जलए, जितरण लाआसेंसधारी के कंपनी स्ट्तर पर ईपभोक्ता जिकायत जनिारण फोरम की स्ट्थापना की जाएगी।

(4) ये फोरम ईपभोक्ताओं की जिकायतों को सामान्य रूप स े 30 कदनों की ऄिजध के ऄंदर और ककसी भी मामल े म ें 45 कदनों से ऄजधक दरे ी नहीं करेंगे।

(5) यह सुजनजित करने के जलए कक सभी जिकायतों को जनर्ददष्ट समय-सीमा के ऄंदर जनपटाया जाता ह ै और ईपभोक्ताओं को फोरम तक पहुचं ने म ें असानी होती ह,ै अयोग समय-समय पर लाआसेंसधारी को मंचों की संख्या बढाने की मांग कर सकता ह।ै

(6) जिकायतों के जनपटान में तेजी लान े के जलए, फोरम ऄपन े ऄजधकार क्षेत्र के ऄंदर ऐसे स्ट्थानों पर भी बैठकें अयोजजत कर सकता ह,ै जजन्ह ेंफोरम द्वारा अिश्यक और ईजचत समझा जाता ह;ै

(7) फोरम एक महीने में आतनी बैठकें अयोजजत करेगा ताकक जांच को यथासंभि िीघ्रता से पूरा ककया जा सके और जिजनयमों में जनर्ददष्ट ऄजधकतम ऄिजध के ऄंदर ईजचत अदेि पाठरत ककया जा सके; बिते कक फोरम हर महीने कम से कम एक बैठक अयोजजत करेगा, जब तक कक कोइ लंजबत मामला न हो;

(8) आन जिजनयमों के तहत आस प्रकार स्ट्थाजपत ईपभोक्ता जिकायत जनिारण फोरम, ऄजधजनयम के प्रािधानों, बनाए गए जनयमों और जिजनयमों और अयोग द्वारा समय-समय पर जारी जनदेिों के ऄनुसार कायच करेगा। मंचों के स्ट्ितंत्र कायच में ककसी भी प्रकार की ऄनजु चत बाधा की सूचना अयोग को दी जा सकती ह।ै

(9) फोरम ऐसे सामान्य जनदिे ों का पालन करेगा जो अयोग समय-समय पर जिकायतों के कुिल और प्रभािी जनिारण के जहत में समय-समय पर और िीघ्रता से जारी कर सकता ह।ै

16. फोरम का मख्ु यालय

(1) फोरम का मुख्यालय ऐस े स्ट्थान पर होगा जैसा की लाआसेंसधारी ऄजधसूजचत कर सकता ह।ै हालाँकक, फोरम ऄपन े मुख्यालय के ऄलािा ऐसे ऄन्य स्ट्थानों पर भी ऄपनी बैठकें अयोजजत कर सकता है, ताकक यह सुजनजित ककया जा सके की समग्र ईद्देश्य के ऄनरूु प जिकायतों की सुनिाइ और आन जिजनयमों में जनर्ददष्ट समय सीमा के ऄंदर जनपटारा ककया जाता ह।ै

17. फोरम का गठन और ईसके सदस्ट्यों की जनयजु क्त

(1) फोरम में लाआसेंसधारी के ऄजधकारी िाजमल होंग े और ईपभोक्ता और ऄजभयोजक प्रजतजनजधयों के रूप में चार से ऄजधक सदस्ट्य नहीं होंगे। अयोग एक ईपयुक्त स्ट्ितंत्र सदस्ट्य को नाजमत करेगा जो ईपभोक्ता मामलों से पठरजचत हो। फोरम का नेतृत्ि ईपयक्तु िठरष्ठता के लाआसेंसधारी के एक ऄजधकारी द्वारा ककया जाएगा, जजसे फोरम के ऄध्यक्ष के रूप में नाजमत ककया जाएगा। कंपनी स्ट्तर के फोरम के सदस्ट्य/ऄध्यक्ष की संरचना और योग्यता जनम्नानुसार होगी: - i) ऄध्यक्ष: फोरम का नेतृत्ि लाआसेंसधारी के एमडी द्वारा ककया जाएगा। ii) जनयुक्त होने िाला एक सदस्ट्य जित्त जनदेिक होगा। iii) स्ट्ितंत्र सदस्ट्य एक व्यजक्त होगा जजसके पास आंजीजनयररग (आलेजक्रकल / मैकेजनकल / आलेक्रॉजनक्स / कंप्यूटर) / कानून / लोक प्रिासन / पत्रकाठरता / ऄथचिास्त्र / राजनीजत जिज्ञान या समकक्ष में न्यनू तम स्नातक की जडग्री हो या जबजली क्षेत्र से संबंजधत मामलों म ें कम से कम 5 िष च का ऄनुभि हो। स्ट्ितंत्र सदस्ट्य केंद्र िाजसत प्रदेि जम्म-ू कश्मीर के ऄजतठरक्त सजचि स्ट्तर का सेिाजनिृत्त जसजिल सेिक/ भारत सरकार में ईप सजचि स्ट्तर (ऄथाचत् स्ट्तर 12 का) या एक सेिाजनिृत्त आलेजक्रकल आंजीजनयर होगा जो ऄधीक्षण ऄजभयतं ा के पद से नीचे का नहीं होगा और और जजसे जबजली जितरण का ऄनुभि होगा।कायचकाल प्रारंभ म ें एक िष च के जलए होगा जजसे अगे चार िषों तक या 65 िष च की अय ु प्राप्त करने तक, जो भी पहले हो, बढाया जा सकता ह।ै हालांकक, अयोग द्वारा ककए गए प्रदिचन की समीक्षा के बाद एक और िषच के जलए बढाया जाएगा।सीजीअरएफ के ऄध्यक्ष की पूिच स्ट्िीकृजत लेने के बाद एक स्ट्ितंत्र सदस्ट्य एक कैलडें र िषच म ें 12 कदनों की अकजस्ट्मक छुट्टी का लाभ ईठा सकता ह।ै[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 9 फोरम के स्ट्ितंत्र सदस्ट्य की जनयुजक्त की प्रकक्रया अयोग द्वारा िरूु की जाएगी। स्ट्ितंत्र सदस्ट्य के पद का जिज्ञापन अयोग की िेबसाआट और प्रेस में ककया जाएगा और चयन ईम्मीदिार के साथ व्यजक्तगत बातचीत करन े के बाद ककया जाएगा। जितरण लाआसेंसधारी अयोग द्वारा जनर्ददष्ट जतजथ से अयोग द्वारा चयजनत स्ट्ितंत्र सदस्ट्य की जनयुजक्त करेगा। iv) सदस्ट्य और ईपभोक्ता प्रजतजनजध के रूप में लाआसेंसधारी द्वारा अयोग की सहमजत से जनयुक्त ककया जाएगा, जो न्यूनतम 35 िष च की अय ु प्राप्त कर चुके ह ैं और जो लाआसेंसधाठरयों के ईपभोक्ता/प्रेज्यूमर रह े ह।ैं िह जबजली के जबलों का चूककताच नहीं होना चाजहए और कभी भी जिद्युत ऄजधजनयम 2003 की धारा 135 के तहत दोषी नहीं ठहराया गया ह ैऔर ईसके जिरुद्ध ककसी भी न्यायालय में कोइ अपराजधक मामला लंजबत नहीं ह।ै

18. सदस्ट्यों को पद स ेहटाना कोइ भी व्यजक्त यकद जनम्न के कारण से ऄयोग्य हो जाता ह ै तो ईसे जनयुक्त नहीं ककया जाएगा और/या सदस्ट्य के रूप म ें बने रहन ेका हकदार नहीं होगा: (क) कदिाजलया घोजषत ककया गया ह;ै या (ख) नैजतक ऄधमता से जड़ु े ऄपराध के जलए दोषी ठहराया गया ह;ै या (ग) ऐसे सदस्ट्य के रूप में कायच करन े में िारीठरक या मानजसक रूप से ऄक्षम हो गया ह;ै या (घ) ईजचत कारण के जबना कम से कम तीन महीने की ऄिजध के जलए ऄपने कायों का जनिचहन करने से आंकार कर कदया ह ैया जिफल रहा ह;ै या (ङ) सदस्ट्य के रूप म ेंऄपनी जनयुजक्त की ककसी भी ितच को पूरा नहीं करता ह;ै या (च) ने ऐसा जित्तीय या ऄन्य जहत ऄर्तजत ककया ह ै जो एक सदस्ट्य के रूप में ईसके कामकाज को प्रजतकूल रूप स े प्रभाजित कर सकता ह;ै या (छ) खुद को आस तरह से संचाजलत ककया ह ै या ऄपन े पद का आस तरह दरुु पयोग ककया ह ै कक ईसके पद पर बन े रहने स ेसािचजजनक जहत और ऄजधजनयम के ईद्देश्योंपर प्रजतकूल प्रभाि पड़ा ह।ै (ज) साजबत कदाचार का दोषी पाया गया ह।ै (झ) ऄपन ेकतचव्यों के प्रजत लापरिाही करता ह।ै बिते कक फोरम के ककसी भी सदस्ट्य को जिजनयम 9 म ें जनर्ददष्ट अधारों पर ईसके कायाचलय से तब तक नहीं हटाया जाएगा जब तक ऐस े सदस्ट्य को अयोग द्वारा जनयुक्त जांच ऄजधकारी के समक्ष ऄपना बचाि करन े का ऄिसर नहीं कदया जाता ह ै और जांच ऄजधकारी की ठरपोटच अयोग को ईपलब्ध नहीं करा दी जाती ह।ै जजस व्यजक्त के जिरुद्ध कायचिाही की जानी प्रस्ट्ताजित ह,ै जांच ऄजधकारी की जनयुजक्त करत े समय अयोग यह भी जनर्ददष्ट करेगा कक स्ट्ितंत्र सदस्ट्य पूछताछ के दौरान फोरम की कायचिाही में भाग ल ेसकता ह ैया नहीं।

19. फोरम के पीठासीन ऄजधकारी

(1) फोरम का ऄध्यक्ष फोरम का पीठासीन ऄजधकारी होगा और सदस्ट्यों / कमचचाठरयों सजहत ऄपने कायाचलय पर ऄधीक्षण और प्रिासजनक जनयत्रं ण की सामान्य िजक्तयों का प्रयोग करेगा और कायाचलय के व्यिसाय के संचालन के जलए जजम्मेदार होगा।

(2) यकद ऄध्यक्ष मौजूद नहीं ह,ै तो ऄन्य सदस्ट्य जो लाआसेंसधारी का ऄगला िठरष्ठ ऄजधकारी ह ै और ईसके बाद अयोग द्वारा नाजमत स्ट्ितंत्र सदस्ट्य ऄध्यक्ष के रूप म ेंकायच करेगा और ईसका मत जनणाचयक होगा।

20. सदस्ट्य का कायकच ाल

(1) ईपभोक्ता और संभाजित प्रजतजनजध के रूप म ें स्ट्ितंत्र सदस्ट्य/सदस्ट्य एक िषच के जलए पद धारण करेंग े जजसे अग े चार िषच तक या 65 िषच की अयु प्राप्त करने तक, जो भी पहले हो, बढाया जा सकता ह।ै हालांकक, अयोग द्वारा ककए गए प्रदिनच की समीक्षा के बाद प्रत्येक जिस्ट्तार को एक िषच के जलए बढाया जा सकता ह।ै बिते कक ऐसा सदस्ट्य ऄभी भी फोरम की पात्रता मानदंड की ितों को पूरा करता हो।

(2) बिते कक कोइ भी स्ट्ितंत्र सदस्ट्यजो ईपभोक्ता और ऄजभयोजक के जहत का प्रजतजनजधत्ि करता हो, पांच (5) िषच से ऄजधक या पैंसठ (65) िषच की अयु प्राप्त करन े के बाद, जो भी पहले हो, के जलए पद धारण नहीं करेगा।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(3) फोरम का एक सदस्ट्य जो जितरण लाआसेंसधारी के रोजगार में है, ईसके स्ट्थानांतरण / त्यागपत्र / सेिाजनिृजत्त या सेिाओं से जनलंबन / समाजप्त पर फोरम का सदस्ट्य नहीं रहगे ा।

(4) एक जितरण लाआसेंसधारी के सीजीअरएफ के ईपभोक्ता के प्रजतजनजधयों के रूप में एक स्ट्ितंत्र सदस्ट्य के रूप म ें जनयुजक्त के अधार पर, व्यजक्त ईस जितरण लाआसेंसधारी के स्ट्थायी कमचचारी होने का दािा नहीं करेगा।

(5) स्ट्ितंत्र सदस्ट्य, ईपभोक्ता और जप्रज्यूमर प्रजतजनजध के रूप में, अयोग को कम से कम तीन (3) महीने की जलजखत सूचना देकर ऄपना त्यागपत्र द ेसकते ह,ैं जजसे अयोग द्वारा ऐसा करने पर छूट दी जा सकती ह।ै

21. मतदान और अम सहमजत

(1) फोरम बैठक के जलए गणपूर्तत तीन की होगी। प्रत्येक सदस्ट्य का एक मत होगा और ककसी मुद्दे या प्रस्ट्ताि पर मतों की समानता के मामल े म,ें ऄध्यक्ष का मत जनणाचयक होगा। कोरम मौजूद नहीं होन े की जस्ट्थजत म;ें फोरम ऄगले कायच कदिस के जलए स्ट्थजगत कर कदया जाएगा;

बिते कक यकद स्ट्थजगत बैठक में भी कोरम मौजूद नहीं ह,ै तो ईपजस्ट्थत सदस्ट्य कोरम माना जाएगा।

22. पाठरश्रजमक

(1) फोरम के स्ट्ितंत्र सदस्ट्य को 30,000/- रुपय े प्रजत माह के समके कत पाठरश्रजमक का भगु तान ककया जाएगा।स्ट्ितंत्र सदस्ट्य ऄपन े द्वारा अयोजजत और सीजीअरएफ के ऄध्यक्ष द्वारा जिजधित ऄनुमोकदत ककसी भी अजधकाठरक दौरे के जलए टीए/डीए (जम्म-ू कश्मीर केंद्र िाजसत प्रदिे के 12िें स्ट्तर के ऄजधकारी के जलए लागू) के हकदार होंगे।

(2) फोरम के सदस्ट्य की सेिा के जनयम और ितें जो जितरण लाआसेंसधारी के रोजगार म ें हैं, ऐसे लाआसेंसधारी के साथ ईनके रोजगार के जनयमों और ितों / सेिा जनयमों द्वारा िाजसत होंगे।

(3) ईपभोक्ताओं/जप्रज्यूमर के बीच जनयुक्त सदस्ट्य केिल मानद सदस्ट्य होंगे। ईन्ह ें लाआसेंसधाठरयों द्वारा फोरम की बैठकों/सुनिाइ/बैठकों में भाग लेन े के जलए यात्रा व्यय का भगु तान ककया जाएगा।

(4) स्ट्ितंत्र सदस्ट्य सजहत सभी सदस्ट्यों के पाठरश्रजमक सजहत फोरम के व्यय का िहन संबंजधत लाआसेंसधारी द्वारा ककया जायेगा।

23. ठरजक्तया ं

(1) लाआसेंसधारी यह सुजनजित करेगा कक कोइ भी पद 30 कदनों स ेऄजधक समय तक ठरक्त न रह।े

(2) ककसी फोरम के स्ट्ितंत्र सदस्ट्य के कायचकाल की समाजप्त के मामले में, प्रेस और अयोग की िेबसाआट पर जिज्ञापन के माध्यम से कायचकाल की समाजप्त से कम से कम तीन (3) महीने पहल े अिेदन अमंजत्रत ककए जाएंगे और चयन व्यजक्तगत साक्षात्कार के बाद ककया जाएगा:

बिते कक मृत्य,ु त्यागपत्र या हटाने के कारण ककसी फोरम के स्ट्ितंत्र सदस्ट्य के पद के जलए फोरम में कोइ ठरजक्त होने की जस्ट्थजत मेंऐसी ठरजक्त के बाद अिेदन की जतजथ से एक (1) महीने के ऄदं र अिेदन अमंजत्रत ककए जाएंगे।

24. सजचिालय

(1) जितरण लाआसेंसधारी, अयोग के ऄनुमोदन स,े मानि संसाधन और कायाचलय के स्ट्थान को जनर्ददष्ट करेगा। लाआसेंसधारी द्वारा अिश्यक मानि संसाधन और स्ट्थान ईपलब्ध कराया जाएगा।

(2) जितरण लाआसेंसधारी, फोरम के जलए अिश्यक मानि संसाधन और कायाचलय स्ट्थान हर समय ईपलब्ध कराएगा। जितरण लाआसेंसधारीफोरम पर ऄपन े कमचचाठरयों की प्रजतजनयजु क्त के माध्यम से अिश्यक सजचिीय सहायता भी प्रदान करेगा।

(3) लाआसेंसधारी के सेिारत ऄजधकाठरयों में से जनयुक्त सदस्ट्य फोरम के सदस्ट्य सजचि के रूप में कायच करेगा। फोरम का एक ऄलग कायाचलय होगा और फोरम के कमचचारी पणू चकाजलक अधार पर काम करेंगे।

(4) फोरम के कमचचारी जनम्न काय चकरेंगे: क) जिकायतें प्राप्त करना; ख) ककसी भी ऄन्य दस्ट्तािेज को प्राप्त करना जजसे फोरम में दायर करन े की अिश्यकता हो सकती है;[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 11 ग) कायचिाही का ठरकॉडच बनाए रखना;

घ) फोरम के सदस्ट्यों को जनदेि और ईजचत अदेि के जलए मामलों को प्रसाठरत करना; ङ) फोरम द्वारा जारी अदिे ों के ऄनुपालन में ऄन्य सभी कायच और गजतजिजधयां करना; तथा च) फोरम के कामकाज और कायचिाही के जलए अिश्यक ऄन्य सभी कायच और चीजें करना।

(5) फोरम का कायाचलय सभी कायच कदिसों में खुला रहगे ा और लाआसेंसधारी के काम के घंटों का पालन करेगा।

(6) लाआसेंसधारी सीजीअरएफ की सभी लागतों और खचों को परू ा करेगा, जजसमें आन जिजनयमों के तहत ऄपने कायों के जनिचहन म ें फोरम की सहायता करन े के जलए स्ट्थापना और स्ट्टाफ की लागत िाजमल ह।ै लाआसेंसधारी आन लागतों के जलए एक ऄलग ठरकॉडच रखेगा। आन लागतों को लाआसेंसधारी द्वारा ईनकी िार्तषक राजस्ट्ि अिश्यकता के माध्यम से िसूल ककया जाएगा।

25. फोरम का जििरण व्यापक रूप स ेप्रकाजित ककया जाएगा

(1) फोरम का नाम, स्ट्थान, इ-मेल पता, टेलीफोन और फैक्स नंबर, संबंजधत जितरण लाआसेंसधारी द्वारा समय-समय पर समाचार पत्रों के माध्यम से प्रत्येक जतमाही में कम से कम एक बार व्यापक रूप से प्रकाजित ककया जाएगा, और अयोग के कायाचलय सजहत जितरण लाआसेंसधारी के सभी कायाचलयों में संबंजधत जितरण लाआसेंसधाठरयों की िेबसाआट पर प्रदर्तित ककया जाता ह।ै ऐसे ब्यौरे जबजली जबलों के माध्यम से ईपभोक्ताओं को उजाच जबलों पर ईजचत स्ट्थान पर अिश्यक संदिे लप्रट करके भी सूजचत ककए जाएंगे। जितरण लाआसेंसधारी आलेक्रॉजनक मीजडया के माध्यम से आन जििरणों का व्यापक प्रचार भी करेगा। आसके ऄलािा जितरण लाआसेंसधारी ईपभोक्ताओं के जलए एक मैनुऄल भी प्रकाजित करेगा जजसमें ईपभोक्ता जिकायतों से जनपटन े के जलए जिस्ट्तृत प्रकक्रया का ईल्लेख होगा और आसे लाआसेंसधारी के सभी कायाचलयों में ईपलब्ध करान े के साथ-साथ आसकी िेबसाआट से डाईनलोड करन े योग्य भी होगा। ऄध्याय IV फोरम स े सपं कच करन े का ऄजधकार

26. फोरम स ेसपं कच करन ेका ऄजधकार

(1) एक जिकायतकताच जनम्नजलजखत जस्ट्थजतयों में फोरम से संपकच कर सकता ह:ै क) यकद लाआसेंसधारी/अइजीअर प्रकोष्ठ जिकायत दज चकरने म ेंजिफल रहता ह;ै या ख) यकद लाआसेंसधारी अयोग द्वारा जनर्ददष्ट प्रदिचन के मानकों के ऄनुसार ऄपने अंतठरक जिकायत जनिारण तंत्र के माध्यम से ककसी जिकायत को हल करन े में जिफल रहता ह;ै या ग) यकद ईपभोक्ता/जिकायतकताच संभाग प्रमुख/सकचल प्रमुख या ईपयुक्त अइजीअर सेल के स्ट्तर पर मामल े को ईठाने के बाद भी जिकायत के जनिारण (बखाचस्ट्तगी सजहत) से संतुष्ट नहीं ह।ै

(2) ईपभोक्ता फोरम के कायाचलय में जिकायत के साथ सीध े फोरम स े संपकच कर सकता है, जजसे फोरम अिश्यक कारचिाइ के जलए लाआसेंसधारी को ऄग्रेजषत कर सकता ह।ै मद्दु े की तात्काजलकता के मामले में, फोरम ऄपने स्ट्तर पर जिकायत को संबोजधत करन े की प्रकक्रया िुरू कर सकता ह।ै ऄध्याय V जिकायतों को प्रस्ट्ततु करन े और ईनके जनिारण के जलए प्रकक्रया

27. जिकायत ेंप्रस्ट्ततु करना

(1) जिकायतकताच ऄपनी जिकायत या तो व्यजक्तगत रूप से या डाक, इ-मेल या फैक्स के माध्यम से ऄपनी जिकायत का जििरण देत े हुए प्रस्ट्तुत कर सकता ह,ै जैसा कक ऄनुबंध- I में जनर्ददष्ट ह:ै बिते कक फोरम मामल े की योग्यता के अधार पर प्रस्ट्ततु ककसी भी जिकायत का संज्ञान लेगा और ककसी भी जिकायत को जनर्ददष्ट प्रारूप में प्रस्ट्तुत नहीं ककए जान े के एकमात्र कारण स ेऄस्ट्िीकार नहीं करेगा;12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] बिते यह भी कक जितरण लाआसेंसधारी, ऄपनी िेबसाआट पर, ऄनुबंध-I में जनधाचठरत प्रारूप को आन जिजनयमों म ें िब्द रूप म ें ऄपलोड करेगा ताकक ईपभोक्ता ऄपन े जिकल्प पर आलेक्रॉजनक रूप म ें ऄपनी जिकायत प्रस्ट्तुत कर सकें;

बिते यह भी कक आलेक्रॉजनक रूप म ें प्रस्ट्तुत ऐसी जिकायत के सभी संलग्नक स्ट्कैन ककए गए रूप म ें प्रस्ट्तुत ककए जाएंगे; बिते यह भी कक आलेक्रॉजनक रूप म ें जिकायत प्रस्ट्तुत करना अयोग द्वारा समय-समय पर जनधाचठरत जनयमों और प्रकक्रयाओं के ऄनुसार होगा।

(2) जिकायतकताच जितरण लाआसेंसधारी द्वारा स्ट्थाजपत जिकायत प्रकोष्ठ/कॉल सेंटर, यकद कोइ हो, सजहत संबंजधत जितरण लाआसेंसधारी के जनकटतम कायाचलय में भी ऄपनी जिकायत प्रस्ट्तुत कर सकता है, जहां जनगरानी के जलए नोडल ऄजधकारी के रूप म ें कायच करने िाला एक नाजमत ऄजधकारी होगा और सुजनजित करेगा कक संबंजधत कायाचलयों में प्राप्त जिकायतों को आन जिजनयमों के तहत जनर्ददष्ट समय-सीमा के ऄनुसार फोरम को ऄग्रेजषत ककया जाता ह।ै

(3) जितरण लाआसेंसधारी के प्रत्यके संबंजधत कायाचलय में नाजमत नोडल ऄजधकारी फोरम के ऄजधकार क्षेत्र म ें अने िाले जिकायतकताचओं की जिकायतों को स्ट्िीकार करेगा और आस प्रकार प्राप्त ऄन्य सहायक दस्ट्तािेजों के साथ जिकायतों को संबंजधत फोरम को सबसे तेज़ ईपलब्ध साधनों के माध्यम से ऄगल े 2 (दो) कायच कदिस म ें ऄग्रेजषत करेगा।

(4) जिकायतकताच को संबंजधत कायाचलय द्वारा जिकायत की प्राजप्त की पािती, क्रम संख्या और जतजथ के साथ जारी की जाएगी, बिते कक जिकायत प्राप्त होने की जस्ट्थजत में: (क) व्यजक्तगत रूप स,े पािती तुरंत जारी की जाएगी;

(ख) डाक, इ-मेल या फैक्स द्वारापािती ऄगल े2 (दो) कायच कदिसों तक भेज दी जाएगी: बिते कक संबंजधत कायाचलय में जिकायत प्राप्त होन े की जस्ट्थजत में, ऄगले कायच कदिस तक पािती के साथ ईपयुक्त फोरम के संपकच जििरण प्रदान ककए जाएगं े;

बिते यह भी कक जहां जिकायत फोरम को इमेल द्वारा प्रस्ट्तुत की जाती है, जिकायत की प्राजप्त की पािती जजतनी जल्दी हो सके इमेल द्वारा भेजी जाएगी, लेककन दो (2) कायच कदिसों से ऄजधक की दरे ी नहीं होनी चाजहए।

28. जिकायतों की प्राथजमकता

(1) जहां तक संभि और व्यािहाठरक हो, जिकायतों के जनिारण के जलए जनम्नजलजखत प्राथजमकता क्रम के अधार पर प्राथजमकता दी जाएगी: - i. अपूर्तत न होना ii. अपूर्तत का बंद होना iii. नया सर्तिस कनेक्िन iv. मीटर से संबंजधत मद्दु े v. जबललग संबंधी मुद्दे vi. ऄन्य मामल;े बिते कक यह सुजनजित ककया जाना चाजहए कक सभी जिकायतों का जनपटारा आन जिजनयमों के तहत जनर्ददष्ट समय सीमा के ऄंदर ककया जाता ह।ै

29. जिकायत प्रस्ट्ततु करन े के जलए सीमाएं/पिू च ित ें - (1) एक जिकायतकताच जनम्नजलजखत में से ककसी भी मामले में फोरम से संपकच करन े का हकदार नहीं होगा: i. ऐसे मामलों म ें जहा ं एक ही मामल े के संबंध म ें और एक ही जिकायतकताच और लाआसेंसधारी के बीच जििाद ककसी ऄदालत, न्यायाजधकरण, मध्यस्ट्थ या ककसी ऄन्य प्राजधकरण के समक्ष लंजबत ह,ैं या एक जडक्री या[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 13 पुरस्ट्कार या ऄंजतम अदिे पहले ही ककसी न्यायालय, न्यायाजधकरण, मध्यस्ट्थ या प्राजधकरण द्वारा पाठरत ककया जा चुका ह;ै ii. ऄजधजनयम की धारा 126, 127, 135 से 139, 152 और 161 के ऄंतगचत अने िाल ेमामलों म;ें iii. ऐसी जिकायतें जो:

क) तुच्छ, कष्टप्रद, दभु ाचिनापूणचह;ैं ख) जबना ककसी पयाचप्त कारण के ह;ैं ग) जिकायतकताच को प्रथम दष्टृ या कोइ नुकसान या क्षजत या ऄसुजिधा नहीं हुइ ह।ै बिते कक कोइ भी जिकायत/जिकायत तब तक खाठरज नहीं की जाएगी जब तक कक जिकायतकताच को सुनिाइ का ऄिसर नहीं कदया गया हो।

(2) जिकायतकता,च या तो सीध े या ऄपन े जिजधित ऄजधकृत प्रजतजनजध के माध्यम से, ऄपनी जिकायत ईपयक्तु फोरम को प्रस्ट्तुत कर सकता ह,ै जजसके ऄजधकार क्षेत्र म ें ईसका कनेक्िन मौजूद ह ै या जहा ं ईसने कनक्े िन के जलए अिेदन ककया गया ह।ै

(3) आस जिजनयमािली के जिजनयम 15 के ईप-जिजनयम (1) के तहत की गइ जिकायत प्राप्त होने पर, फोरम जिकायतकताच को सूचना के तहत अदेि द्वारा जिकायत को अगे बढन े या खाठरज करन े की ऄनुमजत द ेसकता है: बिते कक कोइ भी जिकायत तब तक खाठरज नहीं की जाएगी, जब तक कक जिकायतकताच को सुनिाइ का ऄिसर नहीं कदया गया हो। जहां जिजनयम 15 के ईप-जिजनयम (1) के तहत जिकायत पर कारचिाइ की ऄनमु जत है, फोरम आन जिजनयमों के तहत प्रदान ककए गए तरीके से जिकायत के साथ अगे बढेगा।

30. प्रकक्रया

(1) फोरम जिकायत की एक प्रजत जितरण लाआसेंसधारी द्वारा नाजमत नोडल ऄजधकारी को जिकायत प्राप्त होन े के तीन

(3) कायच कदिसों के ऄंदर, जनिारण के जलए या जिकायत पर ऄपना जिाब दाजखल करने के जलए ऄग्रेजषत करेगा।

(2) नोडल ऄजधकारी फोरम और/या जिद्युत लोकपाल के समक्ष ईत्तर दाजखल करने, प्रस्ट्तुजतया ँ करन,े जिकायत पर मुद्दे-िार ठटप्पजणयाँ प्रदान करने, ऄनुपालन जस्ट्थजत/ठरपोटच प्रस्ट्तुत करने अकद के जलए समन्ियक के रूप में कायच करेगा, जैसा कक मामला हो सकता ह।ै

(3) नोडल ऄजधकारी सात (7) कायच कदिसों (अपूर्तत न करन,े कनेक्िन, पुन: कनेक्िन या अपूर्तत के जिच्छेदन स े संबंजधत जिकायत के जलए) या पंद्रह (15) कायच कदिसों के ऄंदर जिकायत पर फोरम को परै ाग्राफ-िार ठटप्पजणया ं प्रस्ट्तुत करेगा। फोरम से जिकायत की प्रजत प्राप्त होन े के कदन (ऄन्य सभी जिकायतें) या ऐसे ऄन्य समय के ऄंदर जैसा कक जनदेजित ककया जा सकता ह,ै ऐसा न करन े पर फोरम ठरकॉड च पर ईपलब्ध सामग्री के अधार पर अग े बढेगा;

बिते कक फोरम लाआसेंसधारी को जिजभन्न मामलों के अधार पर ईत्तर प्रस्ट्तुत करने के जलए ऄजधकतम सात (7) कदनों का जिस्ट्तार प्रदान कर सकता है, अपूर्तत न करन,े कनेक्िन, पुन: कनेक्िन या अपूर्तत के बंद होने से संबंजधत जिकायतों को छोड़कर, जजसमें ईत्तर प्रस्ट्ततु करन े के जलए कोइ जिस्ट्तार प्रदान नहीं ककया जा सकता ह।ै

(4) फोरम प्रजतिादी पक्ष या जिकायतकताच से ककसी भी ठरकॉड च की मांग कर सकता ह ै जो जिकायत की जांच और जनपटान के जलए प्रासंजगक ह,ै और दोनों पक्ष ऐसी जानकारी, दस्ट्तािेज या ठरकॉड च प्रदान करने के जलए बाध्य होंग े जजसकी फोरम मांग कर सकता ह ै ;

बिते कक जहा ं कोइ पक्ष ऐसी जानकारी, दस्ट्तािेज या ठरकॉड च प्रस्ट्तुत करन े म ें जिफल रहता ह ै और फोरम संतष्टु ह ै कक ठरकॉडच रखने िाला पक्ष जानबूझकर आसे रोक रहा ह,ै यह प्रजतकूल जनपाकष च जनकाल सकता ह।ै

(5) फोरम ऄपन े जििेक के ऄधीन ककसी भी प्रजतजनजध को ककसी भी मामल े में, जलजखत रूप म ें दजच ककए जान े िाल े कारणों के जलए, ईपक्रम की ितों के ईल्लंघन या कदाचार या फोरम को ईजचत सहायता प्रदान करन े म ें जिफलता के कारण ईसके सामन ेईपजस्ट्थत होने की ऄनुमजत से आंकार कर सकता ह।ै14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(6) प्रजतजनजध के माध्यम स े ईपजस्ट्थत होन े िाला कोइ भी पक्ष, ऐसे प्रजतजनजध के कृत्यों या चकू के जलए जजम्मेदार होगा; बिते कक ऐस े प्रजतजनजध को पाटी की ओर स े ककसी जिकायत या दािे या ईसके ककसी जहस्ट्स े को जबना पाटी की जलजखत सहमजत के िापस लेन ेकी ऄनुमजत नहीं दी जाएगी।

(7) कोइ भी पक्ष ककसी भी प्रजतजनजध के कायच स े बाध्य नहीं होगा, जहां यह फोरम की संतष्टु ह ै कक प्रजतजनजध न े धोखाधड़ी का कोइ कायच ककया ह,ै जजससे संबंजधत पाटी के जहत पर प्रजतकूल प्रभाि पड़ा ह।ै

(8) फोरम प्राकृजतक न्याय के जसद्धांतों द्वारा जनदेजित होगा।

(9) फोरम समय-समय पर लाग ू जसजिल प्रकक्रया संजहता, 1908 (1908 का 5) या भारतीय साक्ष्य ऄजधजनयम, 1872 (1872 का 1) से बाध्य नहीं होगा।

(10) अयोग संबंजधत फोरम को जलजखत रूप में और कारणों सजहत ककसी भी मामले को ईठाने का जनदेि द े सकता है, बिते कक िह फोरम के ऄजधकार क्षेत्र में अता हो।

(11) फोरम, ऄपने जििेक स,े ककसी ऐसे व्यजक्त को नाजमत कर सकता ह ैजजसे फोरम ईपयुक्त समझे, -

(i) एक ऐसे पक्ष का मामला प्रस्ट्ततु कर सकता ह ै जो ऄपने प्रजतजनजध को जनयुक्त करने का जोजखम नहीं ईठा सकता, या

(ii) फोरम की कायचिाही में सहायता करने के जलए न्याय जमत्र के रूप में कायच कर सकता ह।ै

31. जनरीक्षण

(1) फोरम जिकायतकता च के ऄनुरोध और जनरीक्षण करन े और एक स्ट्ितंत्र ठरपोट च प्राप्त करन े के जलए तीसरे पक्ष (लाआसेंसधारक के ऄलािा) को भी िाजमल कर सकता ह;ै बिते कक फोरम ऐसे तीसरे पक्ष के जनरीक्षण की अिश्यकता के कारणों को दज च करेगा, जजसका अमतौर पर और ककसी मामले की जििेष पठरजस्ट्थजतयों को ध्यान में रखत े हुए सहारा जलया जाना चाजहए;

बिते यह भी कक जिकायतकताच के ऄनरु ोध पर जनरीक्षण के खचच को छोड़कर ऐस े तीसरे पक्ष के जनरीक्षण का खच च लाआसेंसधारी द्वारा िहन ककया जाएगा, और जहां तक ईजचत और न्यायोजचत ह,ै ऐसे खचों को पास-थ्रू खच च के रूप में ऄनुमजत दी जाएगी;

बिते यह भी कक यकद जिकायतकताच के ऄनुरोध पर जनरीक्षण ककया जाता ह,ै तो खच च ईसके द्वारा ऄजग्रम रूप स े जमा ककया जाएगा, जजसे लाआसेंसधारी द्वारा िापस ककया जा सकता ह ै या नहीं, यह आस बात पर जनभचर करता ह ै कक जिकायत िास्ट्तजिक ह ैया नहीं।

32. सलु ह द्वारा जनपटान को बढािा देना

(1) फोरम ईपयुक्त मामलों में लाआसेंसधारी के नाजमत ऄजधकारी या संबंजधत ऄजधकारी को, जैसा भी मामला हो, बातचीत के जलए ऄपन े समक्ष दायर जिकायत के जनिारण के जलए बुला सकता ह ै और यकद मामला बातचीत के माध्यम से सुलझाया जाता ह,ै तो यह जनणचय के रूप में दजच ककया जा सकता ह ै और फोरम के अदेि द्वारा जिकायतकताच और लाआसेंसधारी को ऄिगत कराया जा सकता ह।ै मामल े के ऐस े जनपटारे के बाद, ईपभोक्ता को ईस मामले म ेंलोकपाल को ऄभ्यािेदन दायर करन े का कोइ ऄजधकार नहीं होगा।

33. ऄभ्यािदे न की सनु िाइ

(1) जहां फोरम आस जनपाकष च पर पहुचं ता ह ै कक जिकायतकता च और नाजमत ऄजधकारी या लाआसेंसधारी के संबंजधत ऄजधकारी, जैसा भी मामला हो, को सुलह प्रकक्रया की जिफलता के कारण जिकायत के जनिारण के जलए सुनना अिश्यक ह,ै फोरम जिकायतकताच और नाजमत ऄजधकारी या संबंजधत ऄजधकारी, जैसा भी मामला हो, मामल े के जििरण और दस्ट्तािेजों, यकद कोइ हो, जो अिश्यक हो, के साथ कॉल करेगा।

(2) जहां जिकायतकताच या लाआसेंसधारी या ईनका प्रजतजनजध सुनिाइ के जलए जनधाचठरत जतजथ पर फोरम के समक्ष ईपजस्ट्थत होने म ेंजिफल रहता ह,ै फोरम जिकायत पर एकतरफा जनणचय ले सकता ह;ै[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 15 बिते कक जब तक पयाचप्त कारण नहीं कदखाया जाता ह ै और फोरम द्वारा स्ट्थगन के कारणों को जलजखत रूप म ें दजच नहीं ककया जाता ह,ै तब तक फोरम द्वारा कोइ स्ट्थगन नहीं कदया जाएगा;

बिते यह भी कक फोरम स्ट्थगन के कारण हुइ लागत के बारे में अदिे द े सकता है, जजसे चूककताच पक्ष द्वारा गैर-चूककताच पाटी और/या फोरम को भगु तान ककया जाना ह।ै

34. ऄतं ठरम अदेि

(1) जिजनयमों के प्रािधानों के बािजूद, जिकायतकताच के ऄनुरोध पर, जिकायत पर ऄंजतम जनणयच लंजबत रहन े तक, फोरम ऐसे ऄतं ठरम अदेि पाठरत कर सकता ह;ै

(2) बिते कक फोरम के पास ककसी भी कायचिाही, सुनिाइ या मामले में ऐसा ऄंतठरम अदिे पाठरत करने की िजक्तया ं होंगी, जैसा कक िह ईजचत समझे, यकद जिकायतकताच फोरम को संतष्टु करता ह ै कक प्रथम दष्टृ या, जितरण लाआसेंसधारी ने धमकी दी ह ै या जबजली कनेक्िन हटाने या जडस्ट्कनेक्ट करने की संभािना है, और ऄजधजनयम के ककसी भी प्रािधान या ईसके तहत बनाए गए ककसी भी जनयम और जिजनयम या अयोग के ककसी अदिे का ईल्लघं न करन े की संभािना ह,ै बिते कक ऐसे मामलों पर फोरम का ऄजधकार क्षेत्र हो;

बिते यह भी कक ऐसा ऄंतठरम अदेि जिकायत प्राप्त होने के 10 कदनों के ऄदं र जारी ककया जाएगा; बिते यह भी कक जबललग जििाद से संबंजधत जडस्ट्कनेक्िन के मामले में, फोरम जितरण लाआसेंसधारी को अपूर्तत को जडस्ट्कनेक्ट न करने का जनदेि देकर ईपभोक्ता को ऄंतठरम राहत प्रदान कर सकता है, यकद ईपभोक्ता जििाकदत राजि का 50 प्रजतित जमा करता ह;ै परन्त ु यह भी कक, जब तक ऐसा प्रतीत होता ह ै कक ऄंतठरम अदेि पाठरत करन े का ईद्देश्य जिलंब स े जिफल हो जाएगा, तब तक ऐसा कोइ ऄतं ठरम अदेि तब तक पाठरत नहीं ककया जाएगा जब तक कक जिरोधी पक्ष को सुनिाइ का ऄिसर न कदया गया हो।

35. अदेि जारी करना

(1) जिकायतकताच द्वारा प्रस्ट्तुत जिकायत पर जिचार करन े के बाद, जितरण लाआसेंसधारी द्वारा प्रस्ट्तुत जिकायत पर जारी की गइ ठटप्पजणयों और ऄन्य सभी ईपलब्ध ऄजभलेखों पर जिचार करन े के बाद, और पार्टटयों को सुनिाइ का ईजचत ऄिसर दने े के बाद, फोरम कायचिाही परू ी करेगा और जिजनयमों म ें जनर्ददष्ट समय के ऄदं र जिकायत के जनिारण के जलए ईजचत अदेि पाठरत करेगा।

(2) यकद कायचिाही पूरी होने के बाद, फोरम मतदान के बाद संतुष्ट हो जाता ह ै कक जिकायत में जनजहत कोइ भी अरोप सही ह,ै तो िह जितरण लाआससें धारी को जनम्नजलजखत म ें से एक या ऄजधक चीजों को करन े का जनदेि समयबद्ध तरीके से जारी करेगा। ऄथातच ्:

(क) प्रश्न म ेंजिकायत के कारण को हटा देना; (ख) जिकायतकताच द्वारा भगु तान ककए गए ऄनुजचत िल्ु क को लोटना और बाद के जबलों म ें आसे समायोजजत करना,जिकायतकताच द्वारा भुगतान ककए गए ऄनुजचत िुल्क को ब्याज सजहत िापस लौटना, और यह ब्याज दर प्रासंजगक ऄिजध के जलए भारतीय ठरज़िच बैंक द्वारा घोजषत ब्याज दर /जित्तीय िषच के 1 ऄप्रलै को भारतीय स्ट्टेट बैंक की ऄल्प ऄिजध की प्रमुख ईधार दर के बराबर होगी, और यह ब्याज ईस ऄिजध के जलए देय होगा जजसके जलए लाआसेंसधारी द्वारा ऄनुजचत रूप से जििाकदत राजि को ऄपन ेपास रखा गया था। (ग) जितरण लाआसेंसधाठरयों के प्रदिचन के मानकों में अयोग द्वारा जनर्ददष्ट जिकायतकताच को मअु िजे के रूप म ें ऐसी राजि का भुगतान करेगा;

बिते कक ककसी भी मामले म ें कोइ भी जिकायतकताच ऄप्रत्यक्ष, पठरणामी, अकजस्ट्मक, दंडात्मक, या ऄनुकरणीय नुकसान, लाभ या ऄिसर की हाजन का हकदार नहीं होगा; (घ) मामले के तथ्यों और पठरजस्ट्थजतयों में ईपयुक्त समझा जाने िाला कोइ ऄन्य अदेि;

बिते कक फोरम जिकायतकता च को ईजचत औजचत्य के साथ जिजधित दजच ईजचत पठरजस्ट्थजतयों में अंजिक राहत का अदेि दे सकता ह।ै16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(3) फोरम द्वारा ककया गया प्रत्येक अदेि लहदी या ऄग्रं ेजी म ें एक तकचसंगत अदिे होगा और कायचिाही करने िाल े सदस्ट्यों द्वारा हस्ट्ताक्षठरत होगा; बिते कक जहां सदस्ट्य ककसी लबद ुया मत पर जभन्नता रखत े हों, बहुमत की राय फोरम का अदिे होगा;

परन्त ु बित े कक ऄल्पसंख्यक सदस्ट्यों की राय ऄजभजलजखत की जाएगी और अदेि का भाग बनेगी और बहुमत द्वारा पाठरत अदिे के साथ जारी की जाएगी।

(4) फोरम द्वारा पाठरत अदिे की प्रमाजणत प्रजत ऐस े अदिे के तीन कदनों के ऄंदर पक्षों को सूजचत की जाएगी। फोरम द्वारा पाठरत प्रत्येक अदेि की एक प्रमाजणत प्रजत पक्षकारों और जिद्युत लोकपाल को दी जाएगी। अदिे लाआसेंसधारी की िेबसाआट पर भी ऄपलोड ककए जाएगं े।

(5) जनर्ददष्ट ऄजधकतम ऄिजध के बाद ककसी जिकायत का जनपटारा होन े की जस्ट्थजत में, फोरम जलजखत रूप म,ें लोकपाल को सूजचत करत े हुए ईक्त जिकायत का जनपटारा करत े समय ईसके कारणों को दज चकरेगा।

(6) फोरम यह सुजनजित करेगा कक सभी अदेि अयोग के जिजनयमों और अदेिों के ऄनरूु प हों; बिते कक फोरम द्वारा जारी अदेि म ें जििेष रूप स े लागू जिजनयमों और अदेिों का ईल्लेख होगा जजनके अधार पर आसका अदेि पाठरत ककया गया ह;ै बिते यह भी कक फोरम स्ट्ियं लागू जिजनयमों और अदेिों से ऄजधक व्याख्या और प्रिासन नहीं करेगा।

(7) यकद कोइ मुद्दा अयोग के जिजनयमों या अदेिों म ें परू ी तरह स े िाजमल नहीं है, तो आस मद्दु े को अयोग के मागचदिचन के जलए ऄजनिायच रूप से संदर्तभत ककया जाएगा।

(8) फोरम के ककसी भी कायच या कायचिाही को केिल फोरम के गठन म ें ककसी दोष के कारण या आसके सदस्ट्यों के बीच एक ठरजक्त के ऄजस्ट्तत्ि के कारण ऄमान्य नहीं माना जाएगा।

(9) जितरण लाआसेंसधारी सजहत फोरम के ककसी अदेि से व्यजथत कोइ भी व्यजक्त, अदेि की जतजथ के तीस (30) कदनों के ऄंदर, ईसी फोरम म,ें जनम्नजलजखत पठरजस्ट्थजतयों म,ें ऐसे अदिे की समीक्षा के जलए अिेदन कर सकता है: (क) जहां कोइ ऄपील या प्रजतजनजधत्ि नहीं ककया गया है;

(ख) ठरकॉडच में ककसी स्ट्पष्ट गलती या त्रुठट के कारण; (ग) एक नए और महत्िपूणच मामले या प्रमाण के पता चलने पर, जो ईजचत पठरश्रम के बाद ईसके संज्ञान में नहीं था या ईस समय ईसके द्वारा प्रस्ट्तुत नहीं ककया जा सका जब अदेि पाठरत ककया गया था या गलती या त्रुठट रेकॉडच से स्ट्पष्ट पता चलती ह।ै

(10) आस मामले की समीक्षा करन े के जलए एक अिेदन में ईस मामले या प्रमाण के बारे म ें स्ट्पष्ट रूप से िणचन ककया जाएगा, जो ईजचत पठरश्रम के बाद ईसके संज्ञान में नहीं था या ईस समय ईसके द्वारा प्रस्ट्ततु नहीं ककया जा सका जब अदेि पाठरत ककया गया था या गलती या त्रुठट रेकॉडच से स्ट्पष्ट पता चलती ह।ै

(11) समीक्षा करने के जलए अिेदन के साथ ऐसे दस्ट्तािेज़, सलाहकारों की ठरपोटच होगी जैसा कक फोरम जनधाचठरत कर सकता ह।ै

(12) समीक्षा ईसी पीठ द्वारा सुनी जाएगी जजसने मलू अदेि जारी ककया ह ैजो समीक्षा के ऄधीन है बिते कक मूल अदेि पाठरत करन े िाल े सदस्ट्य/सदस्ट्यों की सिे ाजनिृजत्त/पदत्याग के कारण ककसी ऄन्य पीठ द्वारा समीक्षा की सुनिाइ की जानी है, तो समीक्षा अिेदन पर जिद्युत लोकपाल की ऄनुमजत प्राप्त करने के बाद ही कारचिाइ की जाएगी।

(13) जब फोरम को यह प्रतीत होता ह ै कक समीक्षा के जलए पयाचप्त अधार नहीं है, तो फोरम ऐसे समीक्षा अिेदन को ऄस्ट्िीकार कर दगे ा; बिते कक कोइ भी अिेदन तब तक ऄस्ट्िीकृत नहीं ककया जाएगा जब तक कक अिेदक को सुनिाइ का ऄिसर न द ेकदया गया हो।

(14) जब फोरम की राय हो कक समीक्षा अिेदन मंजूर ककया जाना चाजहए, तो िह ईसे मंजूर करेगा;[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 17 बिते कक ऐसा कोइ भी अिेदन जबना जिरोधी पक्ष को पूिच सूचना कदये जबना स्ट्िीकार नहीं ककया जाएगा,ताकक िह ईस अदेि के समथचन में ईपजस्ट्थत हो सकें और ईसकी सुनिाइ की जा सके, जजसकी समीक्षा के जलए अिेदन ककया गया ह।ै

36. फोरम के अदिे का ऄनपु ालन

(1) फोरम द्वारा जारी अदिे या जनदेि जितरण लाआसेंसधारी या अदेि या जनदिे के जलए अिश्यक व्यजक्त द्वारा अदेि प्राप्त होने की जतजथ से 60 कदनों के ऄंदर या ऐसी कम ऄिजध के ऄंदर जैसा कक फोरम द्वारा ककए गए अदेि द्वारा जनदेजित ककया जा सकता है, लागू या ऄनुपालन ककया जाएगा। ईपयुक्त मामलों में, मामले की प्रकृजत पर जिचार करते हुए, फोरम, लाआसेंसधारी के ऄनरु ोध पर, ऄपन े अदिे के ऄनुपालन की ऄिजध को ऄजधकतम तीन महीने तक बढा सकता ह।ै

(2) लाआसेंसधारी का संबंजधत ऄजधकारी ऄनपु ालन की जतजथ स े सात कदनों के ऄंदर फोरम के अदिे की ऄनुपालन ठरपोटच फोरम और जिकायतकताच को प्रस्ट्ततु करेगा। फोरम ऄपने अदेिों के ऄनपु ालन का ठरकॉडच रखेगा और हर महीने ईसकी समीक्षा करेगा।

(3) ऄपन े अदिे ों का पालन न करने की जस्ट्थजत में, फोरम ऄनुपालन के जलए लाआसेंसधारी के ईच्च ऄजधकाठरयों के साथ मामले को ईठाएगा। बिते कक ऄनुपालन की जतजथ से सात (7) कायच कदिसों के ऄंदर आस तरह के ऄनुपालन की सूचना फोरम और जिकायतकताच को दी जाएगी।

(4) फोरम के अदेि का पालन न करना अयोग के जिजनयमों का ईल्लघं न माना जाएगा और तदनसु ार ऄजधजनयम की धारा 142 और 146 के तहत कारचिाइ के जलए ईत्तरदायी होगा।

37. फोरम के अदिे के जिरुद्ध ऄभ्यािदे न

(1) जिकायतकताच जनम्नजलजखत पठरजस्ट्थजतयों में अयोग द्वारा जनयक्तु /नाजमत लोकपाल के समक्ष ऄभ्यािेदन प्रस्ट्तुत कर सकता ह:ै- (क) यकद जिकायतकताच जनर्ददष्ट ऄिजध के ऄंदर फोरम द्वारा जिकायत का जनिारण न करन े से व्यजथत है, (ख) यकद जिकायतकताच फोरम द्वारा पाठरत अदेि से संतुष्ट नहीं है, और (ग) यकद जिकायतकताच लाआसेंसधारी द्वारा फोरम के अदेि के गरै -कायाचन्ियन से व्यजथत ह ै

(2) फोरम ककसी भी जिकायत को ईसके समक्ष कायचिाही के ककसी भी चरण म ें पार्टटयों के बीच हुए समझौते के संदभ च में सुलझा सकता ह ैऔर ऐसे अदेि के जिरुद्ध लोकपाल के समक्ष प्रजतजनजधत्ि का कोइ ऄजधकार नहीं होगा।

38. ठरपोर्टटग सबं धं ी अिश्यकताए ं

(1) जितरण लाआसेंसधारी जिकायत जनिारण की जनगरानी के जलए एक तंत्र स्ट्थाजपत करेगा।

(2) फोरम जजस जतमाही से संबंजधत है, ईसकी समाजप्त के 7 कदनों के ऄंदर, लाआसेंसधारी, अयोग और लोकपाल को जिकायतों के जनपटान पर एक त्रैमाजसक ठरपोटच प्रस्ट्तुत करेगा।

(3) त्रैमाजसक ठरपोटच ऄनुबंध IIमें जनर्ददष्ट प्रारूप या समय-समय पर अयोग द्वारा जनधाचठरत ककसी ऄन्य प्रारूप के ऄनुसार प्रस्ट्तुत की जानी चाजहए।

(4) फोरम, जजस जित्तीय िषच से सबं ंजधत ह,ै ईसकी समाजप्त के 45 कदनों के ऄंदर, लाआसेंसधारी, लोकपाल और अयोग को जित्तीय िषच के दौरान फोरम की गजतजिजधयों की सामान्य समीक्षा िाली एक िार्तषक ठरपोट चभी प्रस्ट्ततु करेगा।

(5) फोरम समय-समय पर (हर जतमाही में कम से कम एक बार) ईपभोक्ता जागरूकता के साथ-साथ सािचजजनक संपकच कायचक्रम भी अयोजजत करेगा, जजसमें ईपभोक्ताओं को लाआसेंसधारी द्वारा सेिा प्रदान ककए गए ईपभोक्ताओं के रूप म ें ईनके ऄजधकारों की व्याख्या की जाएगी। लाआसेंसधारी भी ऐसे कायचक्रम म ें भाग लगे ा और फोरम को सुजिधा प्रदान करेगा तथा ऐसे कायचक्रमों की व्यिस्ट्था में व्यय को िहन करेगा।18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] ऄध्याय VI लोकपाल

39. योग्यताए,ं जनयुजक्त की ित ेंऔर लोकपाल को हटाना

(1) अयोग समय-समय पर ऄजधजनयम की धारा 42 की ईप-धारा (7) के तहत कायों के जनिचहन के जलए ऐसे व्यजक्त या व्यजक्तयों को अयोग जिद्युत लोकपाल या लोकपाल के रूप म ें जनयुक्त या ऄन्यथा नाजमत कर सकता ह ै जजन्ह ें ईपयुक्त समझे।

(2) अयोग प्रत्येक लाआसेंसधारी या एक सामान्य जबजली लोकपाल या दो या ऄजधक जितरण लाआसेंसधाठरयों के जलए ऄलग-ऄलग जिद्युत लोकपाल या ऄलग-ऄलग लोकपाल जनयुक्त या नाजमत कर सकता है, जैसा कक प्राप्त ऄभ्यािेदन की संख्या, जनर्ददष्ट समय सीमा के ऄंदर ऄभ्यािेदन का जनपटान, असानी ईपभोक्ताओं और भौगोजलक क्षेत्र के जलए पहुचं जैसे कारणों से ऄजनिायच हो सकता ह।ै

(3) अयोग लोकपाल की जनयुजक्त के जलए सािचजजनक जिज्ञापन के माध्यम से अिेदन अमंजत्रत करेगा, और अयोग द्वारा लोकपाल की जनयुजक्त के जलए नामों की जसफाठरि करने के जलए जनम्नजलजखत सदस्ट्यों की एक चयन सजमजत भी बनाएगा:

क) संबंजधत लोकपाल के जलए प्रत्यके ईपयोजगता से एक सदस्ट्य एमडी होगा; ख) सबं ंजधत लोकपाल के जलए प्रत्यके ईपयोजगता से एक सदस्ट्य जनदेिक जित्त होगा; ग) एक सदस्ट्य जम्म-ू कश्मीर और केंद्र िाजसत प्रदिे लद्दाख के जलए जेइअरसी का सजचि होगा। बिते कक जिद्युत लोकपाल की सेिाजनिृजत्त या कायचकाल की समाजप्त के मामले में, सेिाजनिृजत्त की जतजथ या कायकच ाल की समाजप्त से कम से कम छह (6) महीन े पहल,े जैसा भी मामला हो, अिेदन अमजं त्रत ककए जाएंगे:

परंतु मृत्य,ु त्यागपत्र या हटाए जाने के कारण जिद्युत लोकपाल के पद के जलए ठरजक्त होन े की जस्ट्थजत में, ऐसी ठरजक्त होने की जतजथ स ेएक (1) महीने के ऄंदर अिेदन अमंजत्रत ककए जाएंगे।

(4) अयोग द्वारा जनयुक्त लोकपाल सत्यजनष्ठ, प्रजतजष्ठत और जबजली क्षेत्र में ऄनुभि रखने िाल े व्यजक्त होंगे, जजनके पास कानून, प्रबंधन, आंजीजनयररग, जित्त, ऄथचिास्त्र, िाजणज्य, लोक प्रिासन जैस े ककसी भी क्षेत्र में ऄनुभि ह,ै भारत सरकार के संयुक्त सजचि स्ट्तर या समकक्ष या ऄजतठरक्त जजला न्यायाधीि या भारत सरकार / राज्य सरकार / राज्य जबजली ईपयोजगताओं में ऄधीक्षण ऄजभयंता या समकक्ष या महाप्रबंधक के रूप म ें ऄनुसूची 'क' केंद्रीय सािचजजनक क्षेत्र के ईपक्रम (सीपीएसय)ू में या ककसी भी सािचजजनक या जनजी क्षेत्र के ईपक्रम या गरै -सरकारी संगठन म ेंसेिा की ह,ै जजसे अयोग की राय में ऄनुभि के स्ट्तर को पूिोक्त के समकक्ष माना जा सकता ह।ै

(5) ईपरोक्त के बािजूद, अयोग ऄपने ककसी भी ऄजधकारी को लोकपाल के रूप में कायच करन े के जलए नाजमत कर सकता ह।ै

(6) जनयुक्त/नाजमत जिद्युत लोकपाल ऄपने कायाचलय में कायचभार ग्रहण करने की जतजथ से 3 िषच की ऄिजध के जलए पद पर बना रहगे ा। जनयुजक्त की ऄिजध अयोग के जििेक पर 3 िषच तक और बढाइ जा सकती ह।ै बिते कक पैंसठ िष च की अय ु प्राप्त करन े के बाद जनयक्तु /पदनाजमत कोइ भी जिद्युत लोकपाल आस रूप म ें पद धारण नहीं करेगा।

(7) लोकपाल, ऄपने कायाचलय में प्रिेि करने से पहले, अयोग के ऄध्यक्ष के समक्ष, पद और गोपनीयता की िपथ ऐसे तरीके और रूप में लगे ा, जो अयोग द्वारा जनधाचठरत ककया जा सकता ह।ै

(8) जनयुक्त जिद्युत लोकपाल को 60000/- रुपय े प्रजतमाह का जनजित िल्ु क कदया जा सकता ह।ै आसके ऄजतठरक्त, जिद्युत लोकपाल केंद्र सरकार में संयुक्त सजचि के पद के श्रणे ी I के ऄजधकाठरयों के पात्र के रूप में ड्यूटी पर रहत े हुए टीए / डीए के जलए हकदार होगा।

(9) जिद्युत लोकपाल 10,000 रुपये प्रजत माह के िाहन भत्त ेऔर ऄजधकतम 2500 रुपये प्रजत माह तक के टेलीफोन भत्ते के हकदार होंगे और िास्ट्तजिक जबल के ऄनुसार प्रजतपूर्तत की जाएगी। जिद्युत लोकपाल अयोग का पूिच ऄनुमोदन प्राप्त करन े के ईपरान्त कलण्ै डर िषच में 12 कदन के अकजस्ट्मक ऄिकाि के जलए पात्र होगा।[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 19

(10) लोकपाल का पद एक पणू चकाजलक पद होने के कारण, िह ऄपना पूरा समय लोकपाल के कायाचलय के मामलों के जलए समर्तपत करेगा, और ऄपन ेकायचकाल के दौरान ककसी भी लाभ के पद पर नहीं रहगे ा।

(11) जिद्युत लोकपाल अयोग को जलजखत में नोठटस देकर या तीन महीने की समेककत पठरलजब्धयों का भुगतान करके ऄपना पद छोड़ सकता ह।ै आसी प्रकार, यकद अयोग द्वारा लोकपाल को हटा कदया जाता ह,ै तो अयोग लोकपाल को कम से कम तीन (3) महीने की जलजखत पूिच सूचना देगा।

40. लोकपाल का कायालच य

(1) लोकपाल का कायाचलय अयोग द्वारा जनधाचठरत स्ट्थान पर होगा। बिते कक ईसके समक्ष प्राप्त ऄभ्यािेदनों के जनपटान म ें तेजी लाने के जलए लोकपाल ऄपन े ऄजधकार क्षेत्र के ऄंदर जिजभन्न स्ट्थानों पर सुनिाइ या कायचिाही कर सकता ह।ै

(2) प्रत्येक जिद्युत लोकपाल को 3 कर्तमयों का एक सजचिालय प्रदान ककया जाएगा जैसा कक नीचे दी गइ ताजलका म ें कदखाया गया ह,ै जजन्ह ें केंद्र िाजसत प्रदेि सरकार/ राज्य सरकार/ केंद्र सरकार / सरकारी ईपक्रमों या सािचजजनक ईपयोजगताओं से प्रजतजनयुजक्त पर जलया जाता ह।ै आस पर होने िाले खचच को संबंजधत लाआसेंसधारी के बजट में िाजमल ककया जाएगा। सजचिालय की स्ट्थापना केंद्र िाजसत प्रदेि सरकार के ऄनुमोदन के ऄधीन होगी, आसके जलए ऄजधकारी/कमचचारी लाआसेंसधाठरयों के मौजूदा कमचचाठरयों से जलए जाएगं े और ईन्ह ें लोकपाल के कायाचलय म ें ड्यूटी पर रखा जाएगा। ऐस े कमचचाठरयों का िेतन संबंजधत लाआसेंसधारी द्वारा िहन ककया जाएगा। आस मामले म ें अयोग द्वारा अिश्यक जनदिे जारी ककए जाएंगे। लोकपाल कायालच य म ें कमचच ारी कमचचारी के पद का नाम संख्या िेतनमान सहायक जनदिे क (तकनीकी) 1 50700-160600 क्लकच एिं कम्प्युटर संचालक 1 29200-92300 अदिे िाहक 1 14800-47100

(3) लोकपाल का नाम, स्ट्थान, इमेल पता और टेलीफोन नंबर समाचार पत्रों के माध्यम से व्यापक रूप स े प्रचाठरत ककया जाएगा और िेबसाआटों और लाआसेंसधाठरयों और अयोग के कायाचलयों पर प्रदर्तित ककया जाएगा और ईपभोक्ताओं को जबजली जबलों के माध्यम स े सूजचत ककया जाएगा। आन्ह ें आलेक्रॉजनक मीजडया के माध्यम स े भी प्रचाठरत ककया जा सकता ह।ै

(4) कोइ भी व्यजक्त जनयुक्त नहीं ककया जाएगा और/या एक लोकपाल के रूप में बने रहने का हकदार नहीं होगा यकद िह जनम्न के कारण ऄयोग्य हो जाता ह:ै (क) कदिाजलया घोजषत ककया गया ह;ै या (ख) नैजतक ऄधमता से जड़ु े ऄपराध के जलए दोषी ठहराया गया ह;ै या (ग) ऐसे लोकपाल के रूप म ेंकायच करने म ेंिारीठरक या मानजसक रूप से ऄक्षम हो गया ह;ै या (घ) ईजचत कारण के जबना कम से कम तीन महीन े की ऄिजध के जलए ऄपन े कायों का जनिचहन करन े से आंकार कर कदया ह ैया जिफल रहा ह;ै या (ङ) लोकपाल के रूप म ेंऄपनी जनयजु क्त की ककसी भी ित च को पूरा करना बंद कर दते ा ह;ै या (च) ऐसा जित्तीय या ऄन्य जहत ऄर्तजत ककया ह ै जो लोकपाल के रूप म ें ईसके कामकाज को प्रजतकूल रूप स े प्रभाजित कर सकता ह;ै या (छ) खुद को आस तरह से संचाजलत ककया ह ै या ऄपन े पद का आस तरह दरुु पयोग ककया ह ै कक ईसके पद पर बन े रहने स ेसािचजजनक जहत या ऄजधजनयम के ईद्देश्यों और पर प्रजतकूल प्रभाि पड़ा ह।ै (ज) जसद्ध हो चुके कदाचार का दोषी ह।ै20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] बिते कक जिद्युत लोकपाल को ईसके कायाचलय से तब तक नहीं हटाया जाएगा, जब तक कक अयोग, अयोग द्वारा की गइ जांच पर, यह जनपाकषच न जनकाल ले कक जिद्युत लोकपाल को ऐसे अधार पर हटा कदया जाना चाजहए।

41. जिद्यतु लोकपाल को प्रजतजनजधत्ि

(1) आन जिजनयमों के ऄधीन, जिद्युत लोकपाल को कदया जान े िाला एक ऄभ्यािेदन ऄनुबंध III के ऄनुसार होगा और आसमें जनम्नजलजखत िाजमल होंग े- (क) जलजखत रूप म ेंहो, (ख) ईपभोक्ता द्वारा हस्ट्ताक्षठरत, (ग) ईपभोक्ता/लाआसेंसधारी के नाम और पता, (घ) लाआसेंसधारी के जिकायत जनिारण फोरम के जनणचय सजहत जिकायत का जििरण;और (ङ) ककसी ऄन्य प्राजधकारी/न्यायालय म ें की गइ जिकायतका जििरण।

(2) जिद्युत लोकपाल ऐस े ऄभ्यािेदन को स्ट्िीकार कर सकता ह ै जो ईसके जििेक पर जिजनयमों का पालन नहीं करता ह।ै

(3) लोकपाल जनम्नजलजखत तरीके स ेऄभ्यािेदन प्राप्त होन े कक पािती प्रदान करेगा: क) प्रस्ट्तुत करन े पर तत्काल यकद प्रजतजनजधत्ि व्यजक्तगत रूप से कदया जाता ह;ै या ख) यकद ऄभ्यािेदन डाक/कूठरयर/इमेल के माध्यम से प्राप्त होता ह ै तो दो (2) कायच कदिसों के ऄंदर डाक/इमेल द्वारा।

(4) लोकपाल, पािती जारी करते समय, ईसके द्वारा स्ट्िीकार ककए गए प्रत्येक ऄभ्यािेदन को एक जिजिष्ट मामला संख्या और जतजथ जनर्ददष्ट करेगा।

(5) लोकपाल समय-समय पर प्राप्त सभी ऄभ्यािेदनों का सही ठरकॉडच रखेगा।

42. जिकायतकताच के प्रजतजनजधत्ि के जलए पूिच-ितें/सीमाए ं

(1) लोकपाल द्वारा ऄभ्यािेदन पर तभी जिचार ककया जा सकता ह ैजब जनम्नजलजखत सभी ितें संतष्टु हों: - (क) यह जिकायतकताच द्वारा पीजड़त ईपभोक्ता या ईपभोक्ता का प्रजतजनजधत्ि करने िाल े संघ द्वारा दायर ककया गया ह;ै (ख) जिकायतकताच न,े लोकपाल को ऄभ्यािेदन दने े स े पहले, ऄपनी जिकायत के जनिारण के जलए ऄजधजनयम की धारा 42 की ईप-धारा (5) के तहत गठठत फोरम से संपकच ककया ह;ै (ग) जिकायतकताच द्वारा एक ही जिकायत के संबंध में प्रजतजनजधत्ि, ककसी भी ऄदालत, न्यायाजधकरण या मध्यस्ट्थ या ककसी ऄन्य प्राजधकरण के समक्ष ककसी भी कायचिाही में लंजबत नहीं ह ै या कोइ जडक्री या पुरस्ट्कार या ऄंजतम अदेि ककसी ऐसे न्यायालय, न्यायाजधकरण, मध्यस्ट्थ या प्राजधकरण द्वारा पाठरत नहीं ककया गया ह;ै (घ) ऄभ्यािेदन कारचिाइ के ईसी कारण के संबंध म ें नहीं ह ै जो ककसी भी जपछली कायचिाही में लोकपाल द्वारा जनपटाया गया था या योग्यता के अधार पर जनपटाया गया था, चाह े एक ही जिकायतकता च से या एक या ऄजधक जिकायतकताचओं या एक या ऄजधक के साथ प्राप्त हुअ हो या नहीं कारचिाइ के कारण से संबंजधत पक्ष;

(ङ) जिकायतकताच फोरम द्वारा ऄपनी जिकायत के जनिारण से संतष्टु नहीं ह ैया फोरम ने जिकायत को खाठरज कर कदया ह ै या जनर्ददष्ट समय-सीमा के ऄंदर अदेि पाठरत नहीं ककया है; या लाआसेंसधारी न े फोरम के अदेि को लाग ूनहीं ककया ह;ै (च) जिकायतकताच न े फोरम के जनणयच की प्राजप्त की जतजथ से 30 कदनों के ऄंदर या ईस ऄिजध की समाजप्त की जतजथ से 30 कदनों के ऄंदर लोकपाल के समक्ष ऄभ्यािेदन दायर ककया ह ै जजसके ऄंदर फोरम को जनणचय लने े की अिश्यकता थी या समाजप्त की जतजथके बाद ईस ऄिजध जजसके ऄंदर दायर ककया ह ै जजसमें जितरण लाआसेंसधारी को फोरम के अदिे को लाग ूकरन े की अिश्यकता थी, जो भी लागू हो:[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 21 बिते कक लोकपाल तीस कदनों की ईक्त ऄिजध की समाजप्त के बाद एक ऄभ्यािेदन पर जिचार कर सकता ह ै यकद लोकपाल संतुष्ट ह ैकक ईस ऄिजध के ऄंदर आसे दाजखल नहीं करने के जलए पयाचप्त कारण है;

(छ) जिकायतकताच का प्रजतजनजधत्ि ऄजधजनयम की धारा 126, 127, 135 स े 139, 152 और 161 के ऄंतगचत नहीं अता ह।ै

(2) ऄजधजनयम और आस जिजनयम के प्रािधानों के ऄधीन, लोकपाल का जनणचय कक क्या ऄभ्यािेदन ईपयक्तु ह ै और आसके द्वारा जिचार ककए जान ेके जलए ईजचत ह ैया नहीं, ऄंजतम होगा।

(3) लोकपाल ककसी भी स्ट्तर पर ऄभ्यािेदन को ऄस्ट्िीकार कर सकता ह ै यकद ईसे ऐसा प्रतीत होता ह ै कक ऄभ्यािेदन में जनम्न कजमयाँ ह-ैं (क) तुच्छ, कष्टप्रद, दभु ाचिनापूणच ह;ै (ख) जबना ककसी पयाचप्त कारण के ककया गया ह;ै (ग) जिकायतकताच को कोइ प्रथम दष्टृ या नुकसान या क्षजत या ऄसुजिधा नहीं हुइ है:

बिते कक आस संबंध म ें लोकपाल का जनणचय ऄंजतम और जिकायतकता च और जितरण लाआससें पर बाध्यकारी होगा: बिते यह भी कक ईपधारा (क), (ख) और (ग) के संबंध म ें ककसी भी ऄभ्यािेदन को तब तक खाठरज नहीं ककया जाएगा जब तक कक जिकायतकताच को सनु िाइ का ऄिसर नहीं कदया गया हो।

(4) ऄभ्यािेदन के जनपटान की सुजिधा के ईद्देश्य से, लोकपाल ऐसी प्रकक्रयाओं का पालन कर सकता है, जैसा िह ईजचत समझे।

(5) जब लोकपाल की मध्यस्ट्थता के माध्यम से एक ऄभ्यािेदन का जनपटारा ककया जाता है, तो लोकपाल एक जसफाठरि करेगा जो िह मामल े की पठरजस्ट्थजतयों म ें ईजचत समझे और जसफाठरि की प्रजतयां जिकायतकताच और लाआसेंसधारी को भेजेगा।

(6) यकद जिकायतकताच और लाआससें धारी लोकपाल की जसफाठरिों को स्ट्िीकार करते ह,ैं तो िे जसफाठरिों की प्राजप्त की जतजथ के 15 कदनों के ऄदं र जलजखत रूप म ें एक संचार भजे ेंगे, जजसमें स्ट्पष्ट रूप से कहा जाएगा कक संप्रेजषत समझौता ईन्ह ें स्ट्िीकायच ह,ै समग्र रूप में ह,ै लोकपाल द्वारा की गइ जसफाठरिों के संदभच म ें ह,ै और प्रजतजनजधत्ि के पूणच और ऄंजतम जनपटान में ह।ैं

(7) लोकपाल ऄपन ेअदेि में आस तरह के समझौते का ठरकॉडच बनाएगा और ईसके बाद मामल े को बंद कर दगे ा।

43. क्षत्रे ाजधकार

(1) लोकपाल का क्षेत्रीय ऄजधकार क्षेत्र जम्म-ू कश्मीर के केंद्र िाजसत प्रदेि और लद्दाख के केंद्र िाजसत प्रदिे के परू े या ककसी भी जहस्ट्से तक जिस्ट्ताठरत होगा। बिते कक जहां अयोग, अदेि द्वारा, एक से ऄजधक लोकपाल जनयुक्त करता ह ैया नाजमत करता ह,ै िह ऐसे अदेि में प्रत्येक लोकपाल के क्षत्रे ीय क्षेत्राजधकार को पठरभाजषत करेगा।

44. ईपभोक्ताओं की जिकायतों के जनिारण के जलए लोकपाल की िजक्त और कायच

(1) लोकपाल के पास जनम्नजलजखत िजक्तयां और कतचव्य होंगे: क) ऄभ्यािेदन प्राप्त करने के जलए, ऐसे ऄभ्यािेदन पर जिचार करना और लाआसेंसधारी और जिकायतकताच के बीच सुलह और मध्यस्ट्थता के माध्यम स े समझौते द्वारा जनपटान की सुजिधा प्रदान करना, और जहा ं ऐसा समझौता नहीं हुअ ह ैिहाँ आन जिजनयमों के ऄनुसार एक अदिे पाठरत करना। ख) लोकपाल पहल े मामले म ें एक परामिचदाता और मध्यस्ट्थ के रूप म ें कायच करेगा जो प्रजतजनजधत्ि की जिषय िस्ट्तु ह।ै ग) लोकपाल ऄपने कायाचलय पर ऄधीक्षण और जनयंत्रण की सामान्य िजक्तयों का प्रयोग करेगा और िहा ं कारोबार के संचालन के जलए जजम्मेदार होगा। घ) लोकपाल 30 कदनों की जनधाचठरत ऄिजध की समाजप्त के बाद भी एक ऄभ्यािेदन पर जिचार कर सकता है, यकद लोकपाल संतष्टु ह ै कक ईस ऄिजध के ऄंदर आसे दाजखल नहीं करने के जलए पयाचप्त कारण ह।ै ऐसे मामलों म ें लोकपाल ऄपन ेअदेि में ऄभ्यािेदन पर जिचार करने के कारणों को दजच करेगा।22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] ङ) जिकायतकताच के ऄनरु ोध पर, लोकपाल ऄभ्यािेदन के जनपटान के दौरान ककसी भी स्ट्तर पर ऐसे ऄंतठरम अदेि जारी कर सकता ह ैजो िह अिश्यक समझे।

45. सलु ह द्वारा जनपटान को बढािा देना

(1) यथािीघ्र ऐसा करना व्यािहाठरक हो सकता है, लेककन ऄभ्यािेदन प्राप्त होने की जतजथ से सात कदनों के ऄंदर, लोकपाल एक प्रजत के साथ ऄभ्यािेदन में नाजमत लाआसेंसधारी के संबंजधत ऄजधकारी को सलु ह या मध्यस्ट्थता के माध्यम से जिकायतकताच और लाआसेंसधारी के बीच अपसी समझौते द्वारा प्रजतजनजधत्ि के जनपटारे को बढािा देन े के जलए प्रजतजनजधत्ि और प्रयास। नोठटस देगा।

(2) ईपरोक्त जिजनयम 36 (1) के तहत कदए गए लाआसेंसधारी को नोठटस ईस समय ऄिजध को जनर्ददष्ट करेगा जजसके ऄंदर लाआसेंसधारी को प्रजतजनजधत्ि का जिाब देना अिश्यक ह,ै और यह समय ऄिजध ऐसी होगी कक ऄभ्यािेदन प्राप्त होने की जतजथ से 30 कदनों के ऄंदर सुलह या मध्यस्ट्थता के द्वारा लोकपाल को मामले को जनपटाने की ऄनुमजत जमल सके।

46. ऄभ्यािदे न की सनु िाइ

(1) ऄभ्यािेदन दजच करने के बाद, लोकपाल, पंजीकरण के सात कदनों के ऄंदर, संबंजधत फोरम से प्रजतजनजधत्ि से संबंजधत ठरकॉडच मांगेगा और सबं ंजधत फोरम ऐसे नोठटस की प्राजप्त की जतजथ से सात कदनों के ऄंदर परू े ठरकॉडच को लोकपाल के कायाचलय म ेंभेज दगे ा।

(2) लोकपाल लाआसेंसधारी या लाआसेंसधारी के ककसी भी ऄजधकारी, प्रजतजनजधयों या एजेंटों को दस्ट्तािेज, बहीखाते, सूचना और डेटा प्रस्ट्तुत करन े की अिश्यकता हो सकती ह ै जैसा कक प्रजतजनजधत्ि का फैसला करन े के जलए अिश्यक हो सकता ह ैऔर लाआसेंसधारी लोकपाल की ऐसी अिश्यकताओं का जिजधित पालन करेगा। .

(3) जहां ऄभ्यािेदन प्राप्त होन े की जतजथ से 30 कदनों की ऄिजध के ऄंदर या ऐसी जिस्ट्ताठरत ऄिजध के ऄंदर समझौते द्वारा प्रजतजनजधत्ि का जनपटान नहीं ककया जाता है, तो लोकपाल जनर्ददष्ट समग्र समय सीमा पर जिचार करते हुए, तो लोकपाल तरीके, स्ट्थान, जतजथ और मामले की सुनिाइ के समय का जनधाचरण कर सकता ह ै जैसा कक लोकपाल ईजचत समझे।

(4) लोकपाल पक्षकारों को सुन सकता ह ैऔर पक्षकारों को मामल ेमें जलजखत बयान या जनिेदन प्रस्ट्तुत करने का जनदेि दे सकता ह।ै

(5) एक जिकायतकता,च जितरण लाआसेंसधारी या कोइ ऄन्य व्यजक्त, जो लोकपाल के समक्ष ककसी भी कायचिाही का एक पक्ष ह,ै तो िह व्यजक्तगत रूप से ईपजस्ट्थत हो सकता ह ै या ककसी व्यजक्त को ऄपना मामला लोकपाल के समक्ष प्रस्ट्तुत करन े के जलए और सभी या कोइ भी कायच करन ेके जलए ऄजधकृत कर सकता ह।ै

(6) जहां जिकायतकताच या लाआसेंसधारी या ईनका प्रजतजनजध लगातार दो से ऄजधक ऄिसरों पर सुनिाइ के जलए जनधाचठरत जतजथ पर लोकपाल के समक्ष ईपजस्ट्थत होन े म ें ऄसमथच ह,ै लोकपाल, दजच ककए जान े िाल े कारणों के जलए, ऐसे व्यजक्त की ईपजस्ट्थजत को समाप्त कर सकता ह ै और,ऄभ्यािेदन को एकपक्षीय रूप स े ऄस्ट्िीकार कर सकता ह ै या जनणचय ल ेसकता ह।ै

(7) कोइ भी स्ट्थगन सामान्यतया लोकपाल द्वारा तब तक स्ट्िीकृत नहीं ककया जाएगा जब तक कक पयाचप्त कारण न दिाचया गया हो और स्ट्थगन देन े के कारणों को लोकपाल द्वारा जलजखत रूप म ेंदज चनहीं ककया गया हो।

(8) लोकपाल स्ट्थगन के कारण हुइ लागत के संबंध म ें ऐसे अदेि द े सकता है, जो चूककताच पक्ष द्वारा गरै -चूककताच पक्ष और/या लोकपाल को भुगतान ककया जाना ह।ै

47. लोकपाल को ऄंतठरम अदेि जारी करन े की िजक्त

(1) जिकायतकताच के ऄनुरोध पर, लोकपाल ऄभ्यािेदन के जनपटान के दौरान ककसी भी स्ट्तर पर ऐसे ऄंतठरम अदेि जारी कर सकता ह ैजो िह अिश्यक समझे: क) बिते कक लोकपाल के पास ईसके समक्ष ककसी भी कायचिाही, सुनिाइ या मामल े म ें ऐसा ऄंतठरम अदेि पाठरत करने की िजक्त होगी, जैसा कक िह ईजचत समझे यकद जिकायतकताच लोकपाल को सतं ष्टु करता ह ै कक प्रथम दष्टृ या जितरण लाआसेंसधारी ने जबजली कनेक्िन हटाने कक धमकी दी ह ैया संभािना है, और ऄजधजनयम के ककसी भी प्रािधान या ईसके तहत बनाए गए ककसी भी जनयम और जिजनयम या अयोग के ककसी भी अदेि का ईल्लंघन करने की सभं ािना ह,ै बिते कक ऐस ेमामलों पर लोकपाल का ऄजधकार क्षत्रे हो:[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 23 ख) परन्त ुबिते कक जहां ऐसा प्रतीत होता ह ैकक जिलंब करन े से ऄतं ठरम अदेि पाठरत करन े का ईद्देश्य जिफल हो जाएगा, को छोड़कर, ऐसा कोइ ऄंतठरम अदेि तब तक पाठरत नहीं ककया जाएगा जब तक कक जिरोधी पक्ष को सुनिाइ का ऄिसर न कदया गया हो।

(2) लोकपाल को प्राकृजतक न्याय के जसद्धांतों द्वारा जनदेजित ककया जाएगा, और आन जिजनयमों के ऄन्य प्रािधानों के ऄधीन, लोकपाल के पास ऄपनी प्रकक्रया को जिजनयजमत करन ेकी िजक्त होगी।

(3) कोइ भी पक्ष लोकपाल द्वारा पाठरत अदेि के जिरुद्ध अयोग के समक्ष ऄपील दायर नहीं कर सकता ह।ै हालांकक, यह जिकायतकताच और लाआसेंसधारी के ऄजधकारों पर प्रजतकूल प्रभाि डाले जबना िह ईपयक्तु जनकायों के समक्ष लोकपाल द्वारा पाठरत अदेि के जिरुद्ध ईजचत ईपाय तलाि सकता ह।ै

(4) लोकपाल, ककसी भी समय, सुनिाइ का ऄिसर प्रदान करने के बाद, ऄपने अदेि की समीक्षा, या तो स्ट्ियं के प्रस्ट्ताि पर या कायचिाही के ककसी भी पक्ष के अिेदन पर, अदेि के 30 कदनों के ऄदं र जनम्न के अधार पर करेगा - क) नए साक्ष्य और महत्िपूण च मामल े की खोज, जो ईजचत पठरश्रम के ऄभ्यास के बाद, ईसके ज्ञान म ें नहीं था, या अदेि कदए जान े के समय ईसके द्वारा प्रस्ट्तुत नहीं ककया जा सकता था;

ख) ठरकॉडच में ककसी स्ट्पष्ट गलती या त्रुठट के कारण; ग) ककन्हीं ऄन्य पयाचप्त कारणों से।

(5) लोकपाल समीक्षा अिेदन प्राप्त होने या लोकपाल द्वारा स्ट्ित समीक्षा िुरू करने की जतजथ से 45 कदनों की ऄजधकतम ऄिजध के ऄंदर समीक्षा अदिे पाठरत करेगा: बिते कक उपर जनर्ददष्ट ऄजधकतम ऄिजध के बाद समीक्षा अदेि जारी करन े की जस्ट्थजत में, लोकपाल को जलजखत रूप म ेंसमीक्षा अदिे म ेंदेरी के कारणों को दजच करना चाजहए।

(6) लोकपाल ऐस े कारकों द्वारा जनदेजित होगा जो लोकपाल की राय में न्याय के जहत में अिश्यक ह ैं और प्राकृजतक न्याय के जसद्धांतों के ऄनुपालन में ऄपनी िजक्तयों का प्रयोग और ऄपन े कायों का जनिचहन करत े समय पारदर्तिता सुजनजित करेगा:

(7) बिते कक लोकपाल समय-समय पर लागू जसजिल प्रकक्रया संजहता, 1908 (1908 का 5) या भारतीय साक्ष्य ऄजधजनयम, 1872 (1872 का 1) से बाध्य नहीं होगा।

48. अदेि जारी करना

(1) लोकपाल ऄपने सभी जनपाकषों के जलए कारण बताते हुए एक जलजखत अदेि पाठरत करेगा और अदेि के ऄनुसार राहत की प्रकृजत का ईल्लेख करेगा जजसके जलए जिकायतकताच हकदार ह।ै

(2) लेककन ककसी भी मामल े म,ें ऄभ्यािेदन प्राप्त होने की जतजथ से 45 कदनों के ऄंदर लोकपाल यथािीघ्र एक अदिे पाठरत करेगा और जहां ईक्त ऄिजध के ऄंदर ऄभ्यािेदन के जनपटान में देरी होती ह ै तो लोकपाल आस तरह की दरे ी के कारण ठरकॉडच करेगा।

(3) लोकपाल द्वारा पाठरत अदेि जनम्न को जनधाचठरत करेगा - (क) मुद्दे-िार जनणचय; (ख) अदेि पाठरत करन े के कारण; (ग) जिजनयम 36 के तहत ककए गए ऄंतठरम अदिे , यकद कोइ हो, को समाप्त करने के कारण और ईसके प्रभाि; (घ) जितरण लाआसेंसधारी या जिकायतकताच को जनदेि, यकद कोइ हो, और (ङ) मामले के तथ्यों और पठरजस्ट्थजतयों में ईपयुक्त समझा जाने िाला कोइ ऄन्य अदेि।

(4) अदेि की एक प्रजत पक्षकारों और संबंजधत फोरम को भी ऐसे अदेि की जतजथ से एक सप्ताह के ऄंदर सूचनाथ च भेजी जाएगी।

49. ठरपोर्टटग अिश्यकताए ं

(1) लोकपाल, जजस ऄिजध स े िह संबंजधत ह,ै ईसकी समाजप्त के 7 कदनों के ऄंदर, अयोग को ईसके समक्ष दायर सभी ऄभ्यािेदनों पर एक त्रैमाजसक ठरपोटच प्रस्ट्तुत करेगा।

(2) ठरपोटच में जनम्न िाजमल होगा- (क) ऄभ्यािेदन के तथ्य; (ख) संक्षेप में पार्टटयों की प्रजतकक्रयाएं;24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ग) लाआसेंसधारी द्वारा जितरण प्रदिचन मानकों के ऄनपु ालन पर लोकपाल की राय;

(घ) अदेि में लाआसेंसधारी और/या ईपभोक्ता को जारी ककए गए प्रमुख जनदेि; तथा (ङ) लाआसेंसधारी और/या ईपभोक्ता द्वारा अदेि का ऄनपु ालन।

(3) लोकपाल आन जिजनयमों के ऄनबु ंध-IV के ऄनुसार अयोग को एक त्रैमाजसक ठरपोटच भी प्रस्ट्ततु करेगा।

(4) लोकपाल जजस जित्तीय िषच से संबंजधत है, ईसकी समाजप्त के 45 कदनों के ऄंदर अयोग और राज्य सरकार को जित्तीय िषच के दौरान लोकपाल के कायाचलय की गजतजिजधयों की सामान्य समीक्षा िाली एक िार्तषक ठरपोट च भी प्रस्ट्तुत करेगा। ईपरोक्त खडं 7.54, 7.55 और 7.56 के ऄनुसार अयोग को प्राप्त ठरपोटच अयोग की िेबसाआट पर डाली जाएगी।

50. ऄजभलखे ों का जनरीक्षण और प्रमाजणत प्रजतयों की अपर्तू त

(1) जिकायतकताच और लाआसेंसधारी, ऄभ्यािेदन के संबंध में लोकपाल द्वारा कदए गए अदेिों, जनणचयों, जनदेिों ईसके समथचन म ेंकारणों की प्रमाजणत प्रजतयां प्राप्त करने के हकदार होंगे।

(2) कोइ भी व्यजक्त/ईपभोक्ता लोकपाल के अदेिों की एक प्रजत प्राप्त करने का हकदार होगा, जो ईजचत लागत के भुगतान और ऄन्य ितों के ऄनपु ालन के ऄधीन होगा, जैसा कक लोकपाल जनदेि द ेसकता ह।ै

51. िेबसाआट पर सचू ना

(1) लोकपाल के बारे में जानकारी और ऄन्य जििरण जैसे कक ऄगली सुनिाइ की जतजथ, ईपभोक्ताओं / जिकायतकताचओं के जलए लोकपाल द्वारा पाठरत अदेि अकद अयोग की िेबसाआट पर ईपलब्ध होंगे। लोकपाल ऐसी सभी सूचनाओं को समय-समय पर ऄपडेट करता रहगे ा।

52. सचू ना मागं न ेकी िजक्त

(1) ऄपने कतचव्यों को परू ा करने के ईद्देश्य से, लोकपाल को ककसी भी पक्ष को प्रजतजनजधत्ि की जिषय िस्ट्तु से संबंजधत ककसी भी जानकारी या ककसी दस्ट्तािेज़ की प्रमाजणत प्रजतया ं प्रस्ट्ततु करन े का अदिे द े सकता ह,ै जजसका ईन्ह ेज्ञान ह ैया जो ईनके कब्जे में ह।ैं बिते कक जबना ककसी पयाचप्त कारण के मागं का ऄनुपालन करने म ें लाआसेंसधारी की जिफलता की जस्ट्थजत में, लोकपाल, यकद िह ईजचत समझे, ईपलब्ध ठरकॉड च के अधार पर मामल े को जनपटान े के जलए अग े बढ सकता ह।ै लोकपाल आस प्रश्न के संबंध में अयोग को सूजचत करेगा।

(2) लोकपाल लाआसेंसधारी को जनरीक्षण करने का जनदिे दे सकता ह ै या ककसी तीसरे पक्ष को ऐसा जनरीक्षण करन े के जलए जनयुक्त कर सकता ह,ै जैसा कक प्रजतजनजधत्ि के त्िठरत जनपटान और जिकायत के जनिारण के जलए अिश्यक ह।ै

53. अयोग की स्ट्ित: िजक्तया ं

(1) अयोग के पास ऐसे ककसी भी मामले का स्ट्ित: संज्ञान लेने की िजक्त होगी जो लोकपाल के समक्ष लंजबत ह ैया ईसका जनपटारा ककया जा चुका ह,ै जहां िह ऐसा करना ईजचत समझता ह।ै अयोग, जहां िह आस जिजनयम के तहत ऄपनी िजक्तयों का प्रयोग करता ह,ै लोकपाल के अदेिों को ईलटन ेके अदेि पाठरत कर सकता है:

बिते कक अयोग लोकपाल के अदेिों को ईलट न द े या लोकपाल के समक्ष लंजबत ककसी जििाद का संज्ञान तब तक न ले जब तक कक िह ईस अिय का जलजखत में तकचपूण च अदिे न दे। जहां अयोग ईपरोक्त खंड (i) के तहत लोकपाल के समक्ष लंजबत जििाद का संज्ञान लेता है, िहां लोकपाल मामले के संबंध में कोइ और अदेि पाठरत नहीं करेगा, और मामला अयोग द्वारा ऄंजतम रूप से तय ककया जाएगा।

(2) ककसी भी मामले के संबंध में अयोग के पास आन जिजनयमों के तहत लोकपाल के समान ऄजधकार और काय च होंगे, जजस पर िह स्ट्ित: संज्ञान लेता ह।ै बिते कक अयोग अदिे द्वारा ऄपन े अप को ऄजतठरक्त िजक्तयां प्रदान कर सकता ह ै जो आसके जलए अिश्यक हो सकता ह ै कक िह ककसी भी मामले को प्रभािी ढंग से तय कर सके, जजसका ईसने आस जिजनयमन के तहत स्ट्ित:

54. आन जिजनयमों की प्रजतयों की अपर्तू त ऄनुरोध प्राप्त होन े पर, जितरण लाआसेंसधारी यह सुजनजित करेगा कक आन जिजनयमों की प्रजतयां ईपभोक्ताओं को एक लागत के भगु तान पर ईपलब्ध कराइ जाती ह,ैं जो कक फोटोकॉपी की लागत से ऄजधक नहीं होगी।

55. ठरपोटच प्रस्ट्ततु करना फोरम और जिद्युत लोकपाल समय-समय पर ईनके द्वारा प्राप्त सभी जिकायतों और ऄभ्यािेदनों का सही और ईजचत ठरकॉडच बनाए रखेंग े और अयोग द्वारा जनरीक्षण के जलए ऐसे ठरकॉडच ईपलब्ध कराएगं े जजनकी अयोग को अिश्यकता हो सकती ह।ै

56. मचं ों और जिद्यतु लोकपाल की भाषा जिकायत/प्रजतिेदन और फोरम और जिद्युत लोकपाल की कायचिाही ऄंग्रेजी या लहदी म ेंदज चकी जाएगी।

57. एक ईपभोक्ता समथनच प्रकोष्ठ

1. ईपभोक्ता जागरूकता बढान े के जलए कायचिालाओं, प्रजिक्षण, संगोजष्ठयों और त्रैमाजसक पजत्रकाओं को जारी करके ईपभोक्ता प्रजतजनजधयों और सीजीअरएफ की क्षमता जनमाचण के जलए प्रत्येक जिद्युत लोकपाल कायाचलय में अयोग द्वारा एक ईपभोक्ता िकालत प्रकोष्ठ स्ट्थाजपत और जित्त पोजषत ककया जा सकता ह।ै

2. प्रत्येक जिद्युत लोकपाल के कायाचलय में ईपभोक्ता िकालत प्रकोष्ठ संबंजधत जिद्युत लोकपाल के पयचिेक्षण और अयोग के ऄदं र स्ट्थाजपत मौजूदा ईपभोक्ता िकालत प्रकोष्ठ के समग्र पयचिेक्षण के तहत कायच करेगा।

3. अयोग ऄप्रैल से िुरू होने िाले जित्तीय िषच के जलए प्रत्येक िषच माचच महीने में प्रत्येक जिद्युत लोकपाल के कायाचलय में ईपभोक्ता िकालत प्रकोष्ठ के जलए एक ईपयुक्त बजट अिंठटत करेगा।

4. प्रत्येक जिद्युत लोकपाल, ऄन्य बातों के साथ-साथ कायचिालाओं, प्रजिक्षण, संगोजष्ठयों और त्रमै ाजसक पजत्रकाओं को जारी करके ईपभोक्ता जागरूकता में सुधार के जलए ऄपन े ऄजधकार क्षेत्र में प्रत्येक फोरम को अिंठटत बजट के ऄंदर से ईजचत धन ईपलब्ध कराएगा।

5. अयोग के ऄदं र स्ट्थाजपत ईपभोक्ता सहायता प्रकोष्ठ जनम्नजलजखत ऄजतठरक्त कायच भी करेगा: (क) त्रैमाजसक अधार पर जिजभन्न मंचों और जिद्युत लोकपाल के प्रदिचन का मूल्यांकन, जिजनयम 50 के ऄनुसार त्रैमाजसक ठरपोटच में प्रस्ट्ततु जििरण के ऄनुसार;

(ख) फोरम और जबजली लोकपाल द्वारा प्रस्ट्ततु जिकायतों, ऄभ्यािेदन और ठरपोटों की ऄध-च िार्तषक समीक्षा; (ग) अयोग को फोरम और जबजली लोकपाल द्वारा प्रस्ट्ततु ठरपोटों की समीक्षा और जितरण लाआसेंसधाठरयों द्वारा समय-समय पर ककए गए ईपभोक्ता संतुजष्ट सिेक्षण के पठरणामों के अधार पर जनयमों म ें ककए जान े िाल े सुधारों पर सलाह दने ा;

(घ) जितरण लाआसेंसधाठरयों के प्रदिचन के मानकों के संबंध म ें प्राप्त प्रदिनच के स्ट्तर के संबंध में जितरण लाआसेंसधारी द्वारा प्रस्ट्ततु ठरपोटच का जिश्लेषण; (ङ) संबंजधत फोरम के प्रदिचन पर ईपभोक्ताओं की प्रजतकक्रया लेना;

(च) जिकायत प्रस्ट्ततु करने के जलए िेब-अधाठरत पोटचल के जनमाचण पर जितरण लाआसेंसधारी को सलाह देना; (छ) जितरण लाआसेंसधारी को प्रत्येक दो (2) िषों में एक बार ककए जाने िाले ईपभोक्ता संतुजष्ट सिेक्षण पर सलाह देना। ऄध्याय VIII जिजिध

58. अयोग की ऄधीक्षण और जनयत्रं ण की िजक्त

(1) अयोग के पास फोरम और लोकपाल पर ऄधीक्षण और जनयत्रं ण की सामान्य िजक्तयाँ होंगी और आस ईद्देश्य के जलए िह फोरम / जितरण लाआसेंसधारी / लोकपाल से कोइ ठरकॉडच मांग सकता ह ै और ईस पर ईजचत अदेि / जनदेि जारी कर सकता ह।ै फोरम/जितरण लाआसेंसधारी/लोकपाल ऐसे जनदेिों का जिजधित पालन करेगा जो अयोग समय-समय पर जारी कर सकता ह।ै26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

59. बाधाओं को दरू करन ेकी िजक्तयाँ

(1) यकद आन जिजनयमों के ककसी भी प्रािधान को प्रभािी करने में कोइ कठठनाइ ईत्पन्न होती है, तो अयोग स्ट्ितः संज्ञान ले सकता ह ै और सामान्य या जििेष अदेि द्वारा, जिद्युत ऄजधजनयम, 2003 के ऄसंगत न होते हुए, लाआसेंसधारी को ईपयुक्त कारचिाइ करन े का जनदेि द े सकता हजै ो कठठनाआयों को दरू करन े के ईद्देश्य स े अिश्यक या समीचीन प्रतीत होता ह।ै

(2) लाआसेंसधारी अयोग को एक अिेदन कर सकता ह ै और आन जिजनयमों के ऄनुसार फोरम की स्ट्थापना में अन े िाली ककसी भी कठठनाइ को दरू करने के जलए ईपयुक्त अदिे मांग सकता ह।ै

60. ऄभ्यास जनदेि जारी करन ेकी िजक्त

(1) ऄजधजनयम के प्रािधानों के ऄधीन, अयोग समय-समय पर अदेि जारी कर सकता ह ै और आन जिजनयमों को अग े बढाने के जनदेि द ेसकता ह।ै

61. सिं ोधन करन ेकी िजक्त

(1) अयोग, ककसी भी समय, आन जिजनयमों के ककसी प्रािधान में पठरितचन, बदलाि, या संिोधन कर सकता ह।ै

62. जनरसन और छूट

(1) आन जिजनयमों म ें कुछ भी ऐसे अदेि देन े के जलए अयोग की ऄतं र्तनजहत िजक्त को सीजमत या ऄन्यथा प्रभाजित करने िाला नहीं माना जाएगा जो न्याय के ईद्देश्यों को परू ा करने या अयोग की प्रकक्रया के दरुु पयोग को रोकन े के जलए अिश्यक हो।

(2) आन जिजनयमों में कुछ भी अयोग को ऄजधजनयम के प्रािधानों के ऄनुरूप एक प्रकक्रया ऄपनान े स े नहीं रोकेगा, जो आन जिजनयमों के ककसी भी प्रािधान स े जभन्न ह,ै यकद अयोग, ककसी मामले या मामलों की श्रेणी की जििेष पठरजस्ट्थजतयों को देखते हुए और जलजखत रूप में दजच ककए जान ेिाले कारणों स,े ऐसे मामले या के श्रेणी से जनपटने के जलए आस ेअिश्यक या समीचीन समझता ह।ै

(3) आन जिजनयमों में कुछ भी, स्ट्पष्ट रूप से या जनजहत रूप से, अयोग को ककसी भी मामल े से जनपटने या ऄजधजनयम के तहत ककसी भी िजक्त का प्रयोग करन े से नहीं रोकेगा, जजसके जलए कोइ जिजनयम नहीं बनाया गया ह,ै और अयोग ऐसे मामलों, िजक्तयों और कायों से आस तरह स ेजनपट सकता ह ैजैसा की यह ठीक समझता ह।ै

(4) आन जिजनयमों में जनजहत कुछ भी ईपभोक्ता संरक्षण ऄजधजनयम, 2019 (2019 का 35) और संिोधन/पठरितचन सजहत ककसी भी ऄन्य कानून के तहत ईपभोक्ता के ऄजधकारों और जििेषाजधकारों को प्रभाजित नहीं करेगा।

NOTIFICATION Jammu, the 1st March, 2023 F. No. JERC-JKL/REG/2023/ 05.—Whereas, in exercise of the powers conferred under clauses {r},{s} and {zp} of Sub-section (2) of Section 181 read with Sub-sections (5) (6) (7) and (8) of Section 42 of the Electricity Act 2003 (36 of 2003) read with the Electricity (Rights of Consumers) Rules, 2020 notified by Government of India and all powers enabling it in this behalf, the Joint Electricity Regulatory Commission (for the UT of Jammu & Kashmir and UT of Ladakh) hereby makes the following regulations for providing guidelines/directions to the distribution licensees of its jurisdiction for establishing Forum(s) for redressal of grievances of consumers and for the appointing/designating of Electricity Ombudsman by the Commission.

CHAPTER I SHORT TITLE, COMMENCEMENT, SCOPE, DEFINITION AND INTERPRETATION

1. Short title, extent and commencement: -

1.1. These Regulations shall be called the Joint Electricity Regulatory Commission for UT of Jammu & Kashmir and UT of Ladakh (Consumer Grievances Redressal Forum, Electricity Ombudsman and Consumer Advocacy) Regulations, 2023.

1.2. These Regulations shall be applicable to the Licensees/Franchisees operating in the UT of Jammu & Kashmir and UT of Ladakh in their respective licensed areas.

1.3. These Regulations shall come into force from the date of their publication in the official Gazette.

2. Objectives, Scope and application: -

2.1. Without prejudice to right which a consumer may have apart from the rights conferred upon him under

section 42 of the Act, the said section 42 requires every distribution licensee to establish a Consumer Grievance Redressal Forum as per the guidelines of the Commission and any consumer who is aggrieved by non-redressal of his grievance by the forum, may make a representation for the redressal of his grievance to an authority to be known as Ombudsman, to be appointed or designated by the Commission, who is to settle the grievance of the consumer within such time and in such manner as may be specified by the State Commission.

2.2. The objective of these Regulations is to lay down the guidelines/directions/instructions for setting up the Consumer Grievance Redressal Forum under section (5) of section 42 of the Act and the time limits within which and the manner in which the Consumer Grievance Redressal Forum and the Ombudsman, to be appointed under sub-section (6) of section 42 of the Act, shall settle the grievances of the consumers.

2.3. These Regulations shall be applicable to the Licensees/Franchisees operating in the UT of Jammu & Kashmir and UT of Ladakh in their respective licensed areas.

2.4. Nothing contained in these Regulations shall, expressly or impliedly, restrict the rights and privileges of the consumers available to them.

3. DEFINITIONS: - In these Regulations, unless the context otherwise requires:

(a) "Act” means the Electricity Act, 2003 (No.36 of 2003);

(b) 'Area of supply' means the area within which a distribution licensee (including franchisee area) is authorized by his/her/their licence to supply electricity;

(c) “Annexure” means the annexure to these Regulations;

(d) “Chairperson” means the Chairperson of the Forum;

(e) "Commission" means the Joint Electricity Regulatory Commission for UT of Jammu & Kashmir and UT of Ladakh;

(f) Complainant /Consumer means and includes[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 33

(i) any electricity consumer or consumers including their legal heirs or successors, having a grievance/complaint against a licensee and lodging the same either directly or through their representatives,

(ii) any voluntary/registered consumer society/association or associations, registered under the law for the time being in force and making the complaints in the larger common or similar interest of the consumers,

(iii) any person whose electricity connection is disconnected,

(iv) an applicant for a new connection for the supply of electricity;

(v) A consumer as defined under clause 15 of Section 2 of the Act

(vi) Any unregistered association or group of consumers where they have common or similar interests;

(g) “Complaint” means any complaint made by a Complainant, either in writing, including e-mail and facsimile modes, or verbally over phone if such numbers are specified by a Licensee for lodging complaints, or by visiting personally to such offices of the Licensee which are designated by the Licensee for registering the complaints, to a Licensee, which may, without limitation, include

complaints relating to:

(i) any fault, imperfection, shortcoming or inadequacy in the quality, nature and manner of performance which has been undertaken to be performed by the Licensee in pursuance of a licence and/or any contract or agreement or under the Electricity Supply Code or in relation to Standards of Performance of Licensees, as specified by the Commission;

(ii) any unfair trade practice or restrictive trade practice which has been adopted by the Licensee in providing Electricity Service;

(iii) Electricity Services which are being offered for use to the public in contravention of the provisions of any applicable law including safety code, rules and regulations, as prescribed by the competent authorities under the relevant laws or established through prudent industry practices, and as a result whereof the life and safety of the human beings, livestock or property is put at risk and endangered.

Provided that the following shall not be considered as the complaint namely:

(iv) any grievances arising out of application of Sections 126,127, 135 to 139, 142, 143, 149, 152 and 161 of the Act;

(v) any matter pending before, or decided by, any court of law, or authority (except an authority under the control of the licensee) or the Forum, and

(vi) any complaint in regard to recovery of arrears where the billed amount is not disputed

(h) ―Consumer‖ means for the purpose of these Regulations shall be a consumer as defined under sub-

section 15 of Section 2 of the Act and shall also include a person applying for new connection.

(i) "Distribution Licensee " means a licensee authorised to operate and maintain a distribution system for supplying electricity to the consumers in its licensed area of supply;

(j) “Electricity Service” in particular and without prejudice to the generality of the term includes supply, billing, metering and maintenance of electrical energy to the Consumer and all attendant sub-services and also any other service which a Licensee is required to provide pursuant to his licence or under any applicable law.

(k) “Electricity Ombudsman” means an authority appointed or designated by the Commission, under Sub-section (6) of Section 42 of the Act, to whom a representation may be made by any consumer, who is aggrieved by non-redressal of his Grievance by the Forum;

(l) “Forum” means „Electricity Consumers Grievances Redressal Forum‟, constituted by each licensee in terms of Sub-section (5) of Section 42 of the Act;

(m) “Franchisee” means a person authorised by a Distribution Licensee to distribute electricity on its behalf in a particular area within his area of supply;

(n) “Grievance” means any fault, imperfection, shortcoming or inadequacy in the quality, nature and manner of performance, which has been undertaken to be performed by a Distribution Licensee in pursuance of a licence, contract, agreement or under the Electricity Supply Code or in relation to Standards of Performance of Distribution Licensees as specified by the Commission and includes34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] inter alia Grievances in respect of non-compliance of any Order of the Commission or any action to be taken in pursuance thereof, which are within the jurisdiction of the Forum or Electricity Ombudsman, as the case may be. However, the matters falling within the purview of any of the

following provisions of the Act will not form a grievance under these Regulations:

(i) Unauthorised use of electricity as provided under Section 126 of the Act;

(ii) Offences and penalties as provided under Sections 135 to 139 of the Act;

(iii) Compensation related to accident in the distribution, supply or use of electricity as

provided under Section 161 of the Act; and

(iv) Recovery of arrears where the bill amount is not disputed;

(o) “Internal Grievance Redressal Cell‖ or ―IGR Cell” means such first authority to be contacted by the consumer for redressal of his/her Grievance as notified by the Distribution Licensee at the Sub-divisional, Divisional, Circle or District level as the case may be.

(p) “Licensee” means the Distribution Licensee, as defined under the act;

(q) “Member” means a Member of the Forum; and

(r) “Prosumer” means a person who consumes electricity from grid and can also inject electricity into the grid for distribution licensee, using same point of supply.

(s) “Representation” means the representation made to the Ombudsman by a complainant, who is aggrieved by the order of the Forum (including the partial or full dismissal order), or non-redressal of his grievances by the Forum within the specified time or dissatisfaction with the order issued by the Forum or non- implementation of the Forum‟s order by the licensee within the specified time;

The words and expressions used and not defined in these Regulations but defined in the Act shall have the meanings assigned to them in the Act and in absence thereof, the meanings as commonly understood in the electricity supply industry.

4. Interpretation: - These Regulations shall be construed harmoniously with the Electricity Supply Code and Standards of Performance of Distribution Licensees specified by the Commission under the provisions of clause (x) and (za) of Sub-section (2) of Section 181 of the Electricity Act, 2003. In case of any inconsistency with these Regulations, the Standards of Performance of Distribution Licensees and the Electricity Supply Code shall prevail.

CHAPTER-II INTERNAL GRIEVANCE REDRESSAL FORA

5. Constitution of Internal Grievance Redressal Fora

1. The Distribution Licensee shall have various Internal Grievance Redressal (IGR) Fora to record and redress Grievances in a timely manner. The IGR Fora of the Distribution Licensee shall cater the needs of the Sub-division, Division, Circle and Region (Zone) level. At each level the Fora should consists of officer of the licensee and two consumers‟/prosumers representatives. For ensuring the timely redressal of non-monitory consumers‟ grievances limits may be fixed for level I and level II.

Level III and Level IV may be the corresponding appellate authority. Monitory limits may be decided for all the levels.

2. The franchisee in their area should also have such IGR fora.

3. IGR fora shall issue speaking order and ensure that the grievances are redressed, within a period of 30 days and not exceeding 45 days in any case of filing of the grievance, keeping in view the provisions of applicable Regulations only.

6. Number, Locations and Sittings of Sub-division/Division/ Circle/ Region Level fora a. The standards of performance for which the compensation is required to be paid by the distribution licensee include, but are not limited to, the following, namely: -

1. no supply to a consumer beyond a particular duration, to be specified by the Commission;

2. number of interruptions in supply beyond the limits as specified by the Commission;

3. time taken for connection, disconnection, reconnection, shifting;

4. time taken for change in consumer category, load;

6. time taken for replacement of defective meters;

7. time period within which bills are to be served;

8. time period of resolving voltage related complaints; and

9. bill related complaints. b. As all these services normally pertains to Sub-division/ Division level weekly/ monthly meeting may be held at, Sub-division/ Division level. Sittings of Circle/ Chief Engineer level shall be on need based preferably on quarterly basis.

7. Members of Sub-division/Division/ Circle/ Region Level fora

1. The following shall constitute the Sub-Division Level IGR fora: a. Chairman - Assistant Executive Engineer (AEE) of the concerned Sub-division b. Member Secretary- AE/JE in the sub-division Office. c. Member-Concerned Feeder Manager/Managers d. Members- Two Consumers/ Prosumers representatives nominated by Concerned AEE

2. The following shall constitute the Divisional level IGR fora: a. Chairman - Executive Engineer (XEN) of the concerned Division b. Member- Assistant Executive Engineer (AE) of the concerned Sub-division c. Members- Two Consumers/ Prosumers representatives nominated by Concerned XEN d. Member Secretary – JE/ AAO in the o/o Executive Engineer as Member Secretary

3. The following shall constitute the Circle level IGR fora: a. Chairman -Superintending Engineer (SE) of the concerned Circle b. Member- Executive Engineer of the concerned Division. c. Members- Two Consumers/ Prosumers representatives nominated by Concerned SE d. Member Secretary, AE/JE in the Office of SE

4. The following shall constitute the Region level IGR fora: a) Chairman - Chief Engineer (CE) of the concerned Wing b) Member -Superintending Engineer of the concerned Circle c) Members- Two Consumers/ Prosumers representatives nominated by Concerned CE d) Member Secretary-CAO/AEE in the Office of the CE

8. Member Secretary, Staff and functioning of the Sub-division/Division/ Circle/ Region Level fora The Chairman of the respective fora may, by order. Authorize any of his subordinate officer or employee to receive the application as per Annexure I and to issue the acknowledgement thereof. Any officer posted in the office of the chairman should be designated as Member Secretary.

9. Eligibility of Nominated Members The fora shall consist of members of licensee of AEE/ XEN/ SE/ CE and other Members and Member secretary are also officers of licensee of appropriate seniority. The Consumers/ Prosumers representatives nominated shall be registered consumers of the licensee and under existing category continuously for last 3 years, having good antecedents and has no outstanding dues of electricity.

10. Proceedings of fora The designated officer or any official authorized shall give acknowledgement to the complainant in format appended with Annexure I and in case any document have not been annexed with the application, the same shall be clearly mentioned on the acknowledgement.

Provided that if all necessary documents are annexed with the applicant, it has to be disposed off as per timeline in the standard of performance for the distribution licensee.

11. Hierarchy of Fora for complaints

1. Grievances of Non-monetary/general nature such as relating to quality of supply, defects in service &

Standard of Performance by the Distribution Licensee: a. Divisional level - Grievance of LT supply consumers of the Division b. Divisional level - Grievance of HT/EHT supply consumers of the Division c. Circle level - Grievance of LT supply consumers of the Circle36 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] d. Region level - Grievance of HT /EHT supply consumers of the Wing

2. Grievance of Monetary nature relating to electricity bills, recovery of arrear, payment of demand raised by the licensee except the cases covered U/s 126 & 135 of the Act: a) Sub-divisional level - Monetary limit of Rs. 1,00,000/-;

b) Divisional level - Monetary limit of Rs. 7,50,000/-; c) Circle (District) level - Monetary limit of Rs. 30,00,000/-; d) Region level - Monetary limit of Rs. 50,00,000/-.

12. Procedure for Grievance Redressal

(1) A consumer with a Grievance may intimate the IGR fora of such Grievance in writing including through registered post/email/online mode in Annexure I of these regulations.

(2) Provided that where such Grievance cannot be made in writing, the IGR fora shall render all reasonable assistance to the person making the Grievance orally to reproduce the same in writing.

(3) The office of the IGR fora shall issue acknowledgement of the receipt of the Grievance to the consumer within 24 hrs from the date of receipt of a Grievance. Where the Grievance has been submitted in person, the acknowledgement shall be provided at the time of submission.

(4) Provided that where the Grievance is submitted by email to the IGR fora acknowledgement of the receipt of the Grievance to the consumer shall be provided by return email as promptly as possible.

(5) Provided further that where the Grievance is submitted by email hard copies of the same shall not be required to be submitted separately to the IGR fora.

(6) Provided also that the IGR fora shall keep such electronic records in hard form for ease of retrieval.

(7) Notwithstanding sub-clause (a), the written acknowledgement of receipt of grievance provided by officials of the Distribution Licensee at the concerned office (who may or may not be the part of the IGR fora) shall be deemed to be the acknowledgement for the purposes of these Orders.

(8) The consumer may approach IGR fora for redressal of grievance within 1 year from the date of cause of grievance.

13. Wide publicity of IGR fora

(1) The name, address, e-mail and telephone numbers of the Sub-division/ Division/ Circle/ Chief Engineer Level IGR Fora shall be widely publicised through print and electronic media and at notice boards of all the offices of the Distribution Licensee and shall be intimated to the Consumers through their Electricity Bills.

(2) Distribution Licensee shall within three (3) months of coming into force of these regulations, provide, information about the IGR Fora on its websites through which Consumers may retrieve information such as the contact details of the IGR fora, the orders and directions (if any) issued by the IGR fora and the date of the next hearing.

14. Reporting Requirements

(1) The Distribution Licensee / Corporate Level CGRF shall submit a quarterly report of IGR Fora on disposal of Complaints/Grievances to the Commission and Ombudsman. The report should be submitted within 15 days of close of the quarter to which it relates.

(2) The quarterly report should be submitted in accordance with the format as specified in Annexure-II.

(3) The Distribution Licensee shall also furnish a yearly report containing a general review of activities of the IGR Fora during the financial year to the Commission and Ombudsman.

(4) The report should be submitted within 45 days of close of the financial year to which it relates. Reports received by the Commission as above shall be placed on the Commission‟s website. Commission may also review the performance of IGR fora from time to time.

CHAPTER III CONSUMER GRIEVANCE REDRESSAL FORUM (CGRF)

15. Establishment of the Forum

(1) In terms of Sub-section (5) of Section 42 of the Act every Distribution Licensee shall, within six months of the date of notification of these Regulations or date of grant of licence or date of taking on record the Distribution Licensee status in case of Deemed Distribution Licensees, whichever is later,[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 37 establish Electricity Consumers Grievances Redressal Forum(s) at the company level to ensure redressal of the Grievances of the Complainants within the time frame specified in these Regulations and in accordance with the guidelines laid under these Regulations. Depending upon the need, the forum may further be extended to Zonal (Region), Circle, Division, Sub-division level in place of IGR cell in future.

(2) Such Forum(s) shall follow the principles of natural justice, including, inter alia, the following:

(a) they shall protect the interest of consumers;

(b) they shall inform consumers of their rights;

(c) they shall facilitate and expedite the redressal of Grievances;

(d) they shall ensure that consumers can also have a remedy in the event of failure or delay on the part of the Distribution Licensee in redressing their complaints.

(3) For UT of Jammu & Kashmir, Consumers Grievances Redressal Forum shall be established at company level of the respective Distribution Licensee. Similarly, for the UT of Ladakh, Consumers Grievances Redressal Forum shall be established at company level of the Distribution Licensee.

(4) These Forum(s) shall settle the Grievances of the consumers within a period of 30 days normally and not exceeding 45 days in any case.

(5) In order to ensure that all Grievances are disposed within the specified time-limit and enhance the ease of consumers to reach the Forum, the Commission may, from time to time, require the Licensee to increase the number of Forums and also increase the reach of the Forums for the convenience of the consumers.

(6) In order to expedite disposal of Grievances, the Forum may also hold sittings at such places within its area of jurisdiction as may be considered necessary and proper by the Forum;

(7) The Forum shall hold such number of sittings in a month so as to complete the enquiry as expeditiously as possible and to pass appropriate order within the maximum period specified in Regulations;

Provided that the Forum shall hold at least one sitting every month, unless there are no pending cases;

(8) The Consumers Grievances Redressal Forum(s) so established under these regulations, shall function as per the provisions of the Act, Rules and Regulations framed and directions issued by the Commission from time to time. Any undue hindrance in the independent functioning of the Forums can be reported to the Commission.

(9) The Forum shall comply with such general directions as the Commission may issue from time to time in the interest of efficient and effective redressal of Grievances in a timely and expeditious manner.

16. Headquarter of Forum

(1) The Headquarter of the Forum shall be at such a place as the Licensee may notify. The Forum may, however, conduct its sittings at such other places also besides its Headquarter, in consonance with the overall objective of ensuring that Complaints / Grievances are heard and disposed of within the time limit specified in these Regulation.

16. Constitution of Forum and Appointment of its Members

(1) The forum shall consist of officers of the licensee and have not more than four members as consumer and prosumer representatives. The Appropriate Commission shall nominate one independent member who is familiar with the consumer affairs. The forum shall be headed by an officer of the licensee of appropriate seniority who shall be designated as Chairperson of the forum. The composition and qualification of the member/Chairperson of the Company level forum shall be as under: - i) Chairperson: The Forum shall be headed by MD of licensee.

ii) One member to be appointed shall be Director Finance. iii) Independent Member shall be an individual possessing minimum bachelor‟s degree preferably in Engineering ( Electrical /Mechanical/ Electronics/ Computer ) / Law/ Public Administration/ Journalism/ Economics / Political Science or equivalent having at least 5 years of experience in power sector related matters. The Independent Member shall be a retired civil servant of Additional secretary level of UT of J&K / Deputy Secretary level in Govt. of India ( i.e. of Level 12) or a retired Electrical Engineer not below the rank of Superintending Engineer having experience in distribution of electricity. The tenure will be initially for one year which shall be extendable up to further four years or till attaining the age of 65 years whichever is earlier. However, each extension shall be accorded for one year after performance review done by the Commission. The independent38 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] member can avail 12 days Casual Leave in a calendar year after taking prior approval of the Chairman of CGRF.

The process of the appointment of the Independent Member of the Forum shall be initiated by the Commission. The post of the Independent Member shall be advertised in the press and the website of the Commission and selection shall be done after conducting personal interaction with the candidate. The Distribution Licensee shall appoint the Independent Member selected by the Commission with effect from the date as indicated by the Commission.

iv) Members as consumer and prosumer representatives shall be appointed by Licensee with the consent of the Commission who have attained minimum age of 35 years and who have been consumers /prosumers of Licensees. She/he should not be defaulter of electricity bills and has not been ever convicted under section 135 of the Electricity Act 2003 and that there is no criminal case pending against him in any Court.

17. Removal of Members No person shall be appointed and/or be entitled to continue as a member if he/ she stands disqualified on account of his/her:

(a) has been adjudged as insolvent; or

(b) has been convicted of an offence involving moral turpitude; or

(c) has become physically or mentally incapable of acting as such member; or

(d) has without reasonable cause refused or failed to discharge his functions for a period of at least three months; or

(e) ceases to fulfil any of the conditions of his appointment as member; or

(f) has acquired such financial or other interest that can prejudicially affect his functioning as a member; or

(g) has conducted himself in a manner or has so abused his position as to render his continuance in office prejudicial to the public interest or to the objects and purposes of the Act.

(h) has been guilty of proved misbehaviour.

(i) has negligence towards his duties is established.

Provided that No Member of the Forum shall be removed from his office on the grounds specified in Regulations 9 until such Member is given an opportunity to defend himself before an Enquiry Officer appointed by the Commission and report of the Enquiry Officer has been made available to the person proposed to be proceeded against. While appointing the Enquiry Officer, the Commission will also specify whether the Independent Member can or can‟t participate in proceedings of the Forum during the course of enquiry.

18. Presiding officer of the forum

(1) The Chairperson of the Forum shall be the presiding officer of the Forum and shall exercise general powers of superintendence and administrative control over his office including Members / Staff and shall be responsible for the conduct of business of the office.

(2) In case the Chairperson is not present, the other Member who is next senior officer of licensee and thereafter independent member nominated by the Commission shall act as Chairperson and shall have a casting vote.

19. Tenure of Member

(1) The Independent Member/ Members as consumer and prosumer representatives shall hold office for one year which shall be extendable up to further four years or till attaining the age of 65 years whichever is earlier. However, each extension shall be accorded for one year after performance review done by the Commission. , provided such Member still fulfils the conditions of eligibility criterion of the Forum.

(2) Provided further that no independent Member/ Members representing interest of consumer and prosumer shall hold office for more than five (5) years or after attaining the age of sixty-five (65) years, whichever is earlier.

(3) A member of the Forum who is in the employment of the Distribution Licensee shall cease to be member of the Forum on his transfer / resignation / superannuation or suspension / termination from the services.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 39

(4) By virtue of an appointment as an Independent Member/ Members as consumer and prosumer representatives of the CGRF of a Distribution Licensee, the person shall not claim to be a permanent employee of that Distribution Licensee.

(5) The Independent Member/ Members as consumer and prosumer representatives of the Forum may tender his resignation, by giving not less than three (3) months‟ notice in writing to the Commission, which if so decided by the Commission can be relaxed.

20. Voting and consensus

(1) The quorum for the Forum meeting shall be three. Each member shall have one vote and in case of equality of votes on any issue or resolution, the Chairperson shall have a casting vote.

In the event the quorum is not present; the Forum shall be adjourned to the next working day;

Provided that if at the adjourned meeting also, the quorum is not present, the Member present shall be the quorum.

21. Remuneration

(1) The Independent Member of the Forum shall be paid consolidated remuneration of Rs 30,000/- per month . Independent member shall be entitled for TA/DA (as applicable to the level – 12 officer of UT of J&K) for any official tour conducted by him and duly approved by the Chairman of CGRF.

(2) The terms and conditions of service of a member of the Forum who is in the employment of the Distribution Licensee shall be governed by the terms and conditions / service regulations of his employment with such Licensee.

(3) The member appointed amongst consumers/prosumers shall be honorary members only. They shall be paid travelling expenses for attending sittings/hearings/meetings of forum by licensees.

(4) The expenses of the Forum, including remuneration to all the members including the independent member shall be borne by the concern licensee.

22. Vacancies

(1) The Licensee shall ensure that none of the posts is kept vacant for more than 30 days.

(2) In case of end of tenure of the Independent Member of any Forum, applications shall be invited at least three (3) months prior to the end of tenure through advertisement in press and website of Commission and

selection shall be done after conducting personal interaction with the candidate:

Provided that in case of occurrence of any vacancy in the Forum for the post of the Independent Member of any Forum, by reason of death, resignation or removal, the applications shall be invited, within one (1) month from the date of occurrence of such vacancy.

23. Secretariat

(1) The Distribution licensee shall, with the approval of the Commission, specify the human resource and office space requirement. Necessary human resource and space shall be provided by the Licensee.

(2) The Distribution licensee shall, at all times, provide human resource and office space required to the forum. Distribution Licensee shall also provide the required secretarial assistance by way of deputation of its staff to the forum.

(3) The member appointed from the serving officers of the licensee shall act as the member secretary of the Forum. There shall be a separate office of the forum and the staff of the forum shall work on full time basis.

(4) The staff of the Forum shall: a) receive Grievances and Complaints; b) receive any other documents which may be required to be filed with the Forum; c) maintain record of proceedings; d) circulate matters to members of the Forum for directions and proper orders;

e) do all other acts and deeds in compliance with orders issued by the Forum; and f) do all other acts and things require for the functioning and the proceedings of the Forum.

(5) The office of the Forum shall remain open on all working days and shall observe the working hours of the Licensee.40 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(6) The Licensee shall meet all the costs and expenses of the CGRFs including the cost of establishment and staff required to assist the Forum in the discharge of its functions under these Regulations. The Licensee shall keep a separate record for these costs. These costs shall be recovered by the Licensee through their Annual Revenue Requirement.

24. Particulars of the Forum to be widely published

(1) The name, location, e-mail address, telephone and fax numbers of the Forum (s), shall be widely published by the respective Distribution Licensee through newspapers from time to time, at least once in each quarter, and shall be displayed on the website of the respective Distribution Licensees as well at all the offices of the Distribution Licensee including the office of the Commission. Such particulars shall also be intimated to the consumers through electricity bills by printing necessary message at appropriate place on the energy bills. The Distribution Licensee shall also give wide publicity to these particulars through electronic media. Further the Distribution licensee shall also publish a manual for consumers indicating detailed procedure for handling consumer grievances and make it available in all offices of the licensee as well as downloadable from its website.

CHAPTER IV RIGHT TO APPROACH THE FORUM

25. Right to approach the Forum

(1) A Complainant can approach the Forum in the following events: a) If the Licensee/IGR Cell fails to register a Complaint; or b) If the Licensee fails to resolve a Complaint through their Internal Grievance Redressal Mechanism in accordance with the Standards of Performance specified by the Commission; or c) If the Consumer/Complainant is not satisfied with the Redressal of the Complaint (including dismissal) even after taking up the issue at the level of division head/circle head or appropriate IGR Cell.

(2) The Consumer may directly approach the Forum with a Complaint/Grievance at the office of the Forum, which the Forum may forward to the Licensee for the necessary action. In case of urgency of the issue involved, the Forum may initiate the procedure of addressing the Complaint/Grievance at its level.

CHAPTER V PROCEDURE FOR SUBMISSION AND REDRESSAL OF GRIEVANCES

26. Submission of Grievances

(1) The Complainant can submit his grievance either in person or through post, e-mail or fax giving the particulars of his grievance preferably as specified in ANNEXURE – I:

Provided that the Forum shall take cognizance of any grievance submitted based on the merit of the case and will not reject any grievance for the sole reason of its not having been submitted in the specified format;

Provided further that the Distribution Licensee shall, in its website, upload the format set out in ANNEXURE – I to these Regulations in word form so as to enable consumers, at their option, to submit their Grievance in electronic form;

Provided also that all enclosures to such Grievance submitted in electronic form shall be submitted in scanned form;

Provided also that submission of Grievance in electronic form shall be as per the rules and procedures as may be laid down by the Commission from time to time.

(2) The Complainant may also submit his grievance at the nearest office of the concerned Distribution Licensee, including Complaint Cell / Call Centre, if any, set up by the Distribution Licensee, where there would be a designated officer officiating as nodal officer to monitor and ensure that the complaints received in respective offices are forwarded to the Forum as per timelines specified under these Regulations.

(3) The designated Nodal Officer at each of the respective office of the Distribution Licensee shall accept the grievances from complainants falling within the jurisdiction of the Forum and the grievances along with other supporting documents, so received, shall forward to the relevant Forum within the next 2

(4) The Complainant shall be issued acknowledgement of the receipt of grievance, bearing a serial number and date, by the respective office, provided that in case of receipt of grievance:

(a) in person, the acknowledgement shall be issued immediately;

(b) by post, e-mail or fax, the acknowledgement shall be despatched latest by the next 2 (two)

working days:

Provided further that in case of receipt of grievance in the respective office, the contact details of the appropriate Forum shall be supplied along with the acknowledgement by the next working day;

Provided also that where the Grievance is submitted by email to the Forum, acknowledgement of the receipt of the Grievance shall be by return email as promptly as possible, but not later than two (2) working days.

27. Prioritization of complaints

(1) As far as is possible and practical, the grievances shall be prioritized for redressal based on the

following priority order: - i. non-supply ii. disconnection of supply iii. new service connection iv. meter-related issues v. billing-related issues vi. other issues;

Provided that it should be ensured that all grievances are disposed of within the timelines specified under these Regulations.

28. Limitations/ pre-conditions for submission of grievance –

(1) A Complainant shall not be entitled to approach the Forum in any of the following cases: i) In cases where proceedings in respect of the same matter and between the same Complainant and the Licensee, are pending before any court, tribunal, arbitrator or any other authority, or a decree or award or a final order has already been passed by any such court, tribunal, arbitrator or authority;

ii) In cases which fall under Sections 126, 127, 135 to 139, 152 and 161 of the Act; iii) Complaints/Grievances which are: a) frivolous, vexatious, malafide; b) without any sufficient cause; c) there is no prima facie loss or damage or inconvenience caused to the Complainant.

Provided that no Complaint/Grievance shall be rejected unless the Complainant has been given an opportunity of being heard.

1. The Complainant, either directly or through his duly authorised representative, can submit his / her Grievance to the appropriate Forum under whose jurisdiction his / her connection exists or a connection has been applied for.

2. On receipt of complaint made under sub-regulation (1) of regulation 15 of this Regulation, the Forum may, by order under intimation to the Complainant, allow the complaint to be proceeded with

or rejected:

Provided that no grievance shall be rejected, unless the Complainant has been given an opportunity of being heard.

Where a complaint is allowed to be proceeded with under sub-regulation (1) of regulation 15, the Forum shall proceed with the complaint in the manner provided under these Regulations.

29. Process

(1) The Forum shall forward a copy of the Grievance to the Nodal Officer designated by the Distribution Licensee, within three (3) working days of receipt of the Grievance, for redressal or to file its reply to the Grievance.

(2) The Nodal Officer shall act as the co-ordinator for filing of reply, making submissions, providing issue-wise comments on the Grievance, submitting compliance status/reports, etc., before the Forum and/or the Electricity Ombudsman, as the case may be.

(3) The Nodal Officer shall furnish paragraph-wise comments to the Forum on the Grievance within seven (7) working days (for Grievance related to non-supply, connection, re-connection or disconnection of supply) or42 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] fifteen (15) working days (all other Grievances) of receipt of the copy of Grievance from the Forum or within such other time as it may be directed, failing which the Forum shall proceed on the basis of the material available on record;

Provided that the Forum may grant extension of maximum seven (7) days to the Licensee for submission of reply on case-to-case basis, except in case of Grievance related to non-supply, connection, re- connection or disconnection of supply, wherein no extension may be granted for submission of reply.

(4) The Forum may call for any record from the respondent party or from the Complainant as is relevant for examination and disposal of the Grievance, and both the parties shall be under obligation to provide such information, document or record as the Forum may call for;

Provided that where a party fails to furnish such information, document or record and the Forum is satisfied that the party in possession of the record is withholding it deliberately, it may draw an adverse inference.

(5) The Forum may within its discretion disallow any representative to appear before it in any case, for reasons to be recorded in writing, on account of breach of the terms of the undertaking or misconduct or failure in providing proper assistance to the Forum.

(6) Any party appearing through a representative, shall be bound by the acts or omissions of such representative;

Provided that such representative shall not be permitted to withdraw any complaint or claim or any part thereof on behalf of the party without producing written consent from the party allowing him for withdrawal of the complaint or claim or part thereof.

(7) Any party shall not be bound by an act of any representative where it is shown to the satisfaction of the Forum that the representative committed any act of fraud, which adversely affected interest of the party concerned.

(8) The Forum shall be guided by the principles of natural justice.

(9) The Forum shall not be bound by the Code of Civil Procedure, 1908 (5 of 1908) or the Indian Evidence Act, 1872 (1 of 1872) as in force from time to time.

(10) The Commission may direct the concerned Forum, in writing and with reasons, to take up any matter,

provided that the same falls within the jurisdiction of the Forum.

(11) The Forum may, at its discretion, designate any person whom the Forum considers appropriate to, -

(i) Present the case of a party which cannot afford to engage its representative, or

(ii) act as amicus curiae to assist the Forum in its proceedings.

30. Inspection

(1) The Forum can also engage a third-party (other than the Licensee) at the instance and request of the Complainant, to undertake inspection and obtain an independent report;

Provided that the Forum shall record the reasons for the need for such third-party inspection, which should generally be resorted to rarely and keeping in view the special circumstances of a case;

Provided further that the expenses of such third-party inspection, except expenses of inspection at the request of the Complainant, shall be borne by the Licensee, and to the extent reasonable and justifiable, such expenses shall be allowed as pass-through expense in the determination of tariff in accordance with the relevant Regulations of the Commission;

Provided also that in case inspection is taken up at the request of the Complainant, the expenses shall be deposited in advance by him, which may or may not be refunded by the Licensee depending on whether the Grievance is found to be of substance or not.

31. Promotion of settlement by conciliation

(1) The Forum may in appropriate cases call the designated officer or the concerned officer of the licensee, as the case may be, for negotiations in order to seek redressal of the grievance filed before it and if the matter is settled through negotiations, it may be recorded as a decision and conveyed to the Complainant and the licensee by the order of the Forum. Subsequent to such settlement of case, the consumer shall have no right to file a representation to the Ombudsman in that matter.

32. Hearing of representations

(1) Where the Forum comes to the conclusion that the Complainant and the designated officer or the concerned officer of the licensee, as the case may be, are required to be heard for redressal of a grievance due to failure of conciliation process, the Forum shall call the Complainant and the designated officer or the concerned officer, as the case may be, with the details of the case and documents, if any, as may be necessary.

(2) Where the Complainant or the Licensee or their representative fails to appear before the Forum on the date fixed for hearing, the Forum may decide the Grievance ex-parte;[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 43

Provided that no adjournment shall ordinarily be granted by the Forum unless sufficient cause is shown and the reasons for the grant of adjournment have been recorded in writing by the Forum;

Provided also that the Forum may make an order as to the cost, occasioned by the adjournment, to be paid by the defaulting party to the non-defaulting party and / or to the Forum.

33. Interim Order

(1) Notwithstanding the provisions of Regulations, the Forum may pass such interim Orders, pending the final decision on the Grievance, on the request of the Complainant;

(2) Provided that the Forum shall have the powers to pass such interim Order in any proceeding, hearing or matter before it as it may consider appropriate, if the Complainant satisfies the Forum that prima facie, the Distribution Licensee has threatened or is likely to remove or disconnect the electricity connection, and has or is likely to contravene any of the provisions of the Act or any Rules and Regulations made there under or any Order of the Commission, provided that, the Forum has jurisdiction on such matters;

Provided further that such interim Order shall be issued within 10 days of receipt of Grievance;

Provided also that in case of disconnection related to billing dispute, the Forum may provide interim relief to the consumer by directing the Distribution Licensee not to disconnect the supply, only if the consumer deposits 50 percent of the disputed amount;

Provided also that, except where it appears that the object of passing the interim Order would be defeated by delay, no such interim Order shall be passed unless the opposite party has been given an opportunity of being heard.

34. Issuance of Order

(1) After considering the Grievance submitted by the Complainant, issue-wise comments on the Grievance submitted by the Distribution Licensee and all other records available, and after affording reasonable opportunity of being heard to the parties, the Forum shall complete the proceedings and pass appropriate

order for redressal of the Grievance within the time specified in Regulations.

(2) If, after the completion of the proceedings, the Forum is satisfied after voting that any of the allegations contained in the Grievance is correct, it shall issue an order to the Distribution Licensee directing it to do one or more of the following things in a time bound manner, namely:

(a) Remove the cause of Grievance in question;

(b) Return to the Complainant the undue charges paid by the Complainant and same to be adjusted in subsequent bills return to the Complainant the undue charges paid by the Complainant along with interest, at the rate equal to Bank Rate declared by the Reserve Bank of India prevailing during the relevant period / Short Term Prime Lending Rate of the State Bank of India as on 1st April of the financial year for the period for which the undue disputed amount was withheld by the licensee;

(c) Pay such amount as may be awarded by it as compensation to the Complainant as specified by the Commission in the standards of performance of Distribution Licensees;

Provided that in no case shall any Complainant be entitled to indirect, consequential, incidental, punitive, or exemplary damages, loss of profits or opportunity;

(d) Any other order, deemed appropriate in the facts and circumstances of the case;

Provided that the Forum may order partial relief to the Complainant under appropriate circumstances, duly recorded with proper justification.

(3) Every Order made by the Forum shall be a reasoned Order either in Hindi or English and signed by the Members conducting the proceedings;

Provided that where the Members differ on any point or points, the opinion of the majority shall be the

Order of the Forum;

Provided further that the opinion of the minority shall however, be recorded and form part of the Order, and shall be issued along with the Order passed by the majority.

(4) A certified copy of the Order passed by the Forum shall be communicated to the parties within three days of such Order. A certified copy of every order passed by the Forum shall be delivered to the parties and Electricity Ombudsman. (5) In the event of a grievance being disposed of after the specified maximum period, the Forum shall record, in writing, the reasons for the same at the time of disposing the said grievance under intimation to the Ombudsman.

(6) The Forum shall ensure that all Orders are consistent with the Commission‟s Regulations and Orders;

Provided that the Order issued by the Forum shall specifically mention the applicable Regulations and Orders based on which its Order has been passed;

Provided further that the Forum on its own shall not interpret and rule beyond the applicable Regulations and Orders.

(7) In case any issue is not fully covered in the Commission‟s Regulations or Orders, the issue shall necessarily be referred to the Commission for its guidance.

(8) No act or proceeding of the Forum shall be deemed to be invalid by reason only of some defect in the constitution of the Forum or by reason of the existence of a vacancy among its Members.

(9) Any person aggrieved by an order of the Forum, including the Distribution Licensee, may apply for a review of such Order within thirty (30) days of the date of the order to the same Forum, under the

following circumstances:

(a) Where no appeal or Representation has been preferred;

(b) on account of some mistake or error apparent from the face of the record;

(c) upon the discovery of new and important matter or evidence which, after the exercise of due diligence, was not within his knowledge or could not be produced by him at the time when the order was passed.

(10) An application for such review shall clearly state the matter or evidence which, after the exercise of due diligence, was not within his knowledge or could not be produced by him at the time when the

order was passed or the mistake or error apparent from the face of the record.

(11) The review application shall be accompanied by such documents, supporting data and statements as the Forum may determine.

(12) The review shall be heard by the same bench that has issued the original Order that is subject to review;

Provided that in case the review has to be heard by a different bench, on account of retirement / demission of office of Member/s who passed the original Order, the review application shall be processed only after obtaining the permission of the Electricity Ombudsman.

(13) When it appears to the Forum that there is no sufficient ground for review, the Forum shall reject such review application;

Provided that no application shall be rejected unless the applicant has been given an opportunity of being heard.

(14) When the Forum is of the opinion that the review application should be granted, it shall grant the same;

Provided that no such application will be granted without previous notice to the opposite side or party to enable him to appear and to be heard in support of the order, the review of which is applied for.

35. Compliance of the order of the forum

(1) The Order passed or direction issued by the Forum shall be implemented or complied by the Distribution Licensee or the person required by the order or direction to do so within 60 days or within such shorter period as may be directed by an order made by the Forum, from the date of receipt of the order. In appropriate cases, considering the nature of the case, the Forum, upon the request of the licensee, may extend the period for compliance of its order up to a maximum of three months.

(2) The concerned officer of the licensee shall furnish a compliance report of the order of the Forum within seven days from the date of compliance, to the Forum and to the complainant. The Forum shall keep a record of the compliance of its orders and review the same every month.

(3) In case of non-compliance of its orders, the Forum shall take up the matter with the higher authorities of the licensee for compliance.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 45

Provided that intimation of such compliance shall be made to the Forum and the Complainant within seven (7) working days from the date of compliance.

(4) Non-compliance of the Order of the Forum shall be treated as violation of the Regulations of the Commission and accordingly liable for action under Sections 142 and 146 of the Act.

36. Representation against the Forum’s order

(1) A complainant may prefer a representation before the Ombudsman appointed/ designated by the

Commission under the following circumstances: -

(a) if the complainant is aggrieved by the non-redressal of the grievance by the Forum within the period specified,

(b) if the complainant is not satisfied with the order passed by the Forum, and

(c) if the complainant is aggrieved by the non-implementation of the Forum‟s order, by the licensee

(2) The Forum may settle any grievance in terms of an agreement reached between the parties at any stage of the proceedings before it and there shall be no right of representation before the Ombudsman against such an order.

37. Reporting requirements

(1) The distribution licensee shall set up a mechanism for monitoring of the grievance Redressal.

(2) The Forum shall, within 7 days of the close of the quarter to which it relates, submit a quarterly report on disposal of grievances to the licensee, Commission and Ombudsman.

(3) The quarterly report should be submitted in accordance with the format as specified in ANNEXURE II or any other format as prescribed by the Commission from time to time.

(4) The Forum shall, within 45 days of the close of the financial year to which it relates, also furnish a yearly report containing a general review of the activities of the Forum during the financial year to the licensee, Ombudsman and the Commission.

(5) The forum shall also conduct from time to time (at least once in every quarter) consumer awareness vis-à- vis public interaction programme, explaining to the consumers their rights as consumers serviced by the licensee. The Licensee shall also participate in such programme and facilitate the Forum and bear the expenditure in arranging such programmes.

Chapter VI OMBUDSMAN

38. Qualifications, terms of appointment and removal of Ombudsman

(1) The Commission may from time to time appoint or otherwise designate such person or persons as the Commission may consider appropriate as the Electricity Ombudsman or Ombudsmen to discharge the functions under Sub-section (7) of Section 42 of the Act.

(2) The Commission may appoint or designate Electricity Ombudsman or Ombudsmen separately for each Licensee or a Common Electricity Ombudsman or Ombudsmen for two or more Distribution Licensees considering factors such as the number of representations received, disposal of representations within the specified time limit, ease of access for the consumers and the geographical area.

(3) The Commission shall invite applications through public advertisement for the appointment of the Ombudsman, and shall also form a Selection Committee of following members: a) One member to be MD from each utility for respective Ombudsman;

b) One member to be Director Finance from each Utility for respective Ombudsman; c) One member to be Secretary of JERC for UTs of J&K and UT of Ladakh. for recommending names for the appointment of the Ombudsman by the Commission.

Provided that in case of superannuation or end of tenure of the Electricity Ombudsman, applications shall be invited at least six (6) months prior to the date of superannuation or the end of tenure, as the case may be:

Provided further that in case of occurrence of vacancy for the post of Electricity Ombudsman, by reason of death, resignation or removal, the applications shall be invited, within one (1) month from the date of occurrence of such vacancy.46 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(4) The Ombudsman appointed by the Commission shall be a person of integrity, repute and standing preferably in the electricity sector having experience in any of the areas viz Law, Management, Engineering, Finance, Economics, Commerce, Public Administration who has served at the level of Joint Secretary to the Government of India or equivalent or as Additional District Judge or Superintending Engineer in the Government of India / State Government/State Power utilities or equivalent or General Manager in Schedule „A‟ Central Public Sector Undertaking (CPSU) or equivalent in any public or private sector undertaking or a non-governmental organization whose level of experience in the opinion of the Commission can be treated as comparable to the aforesaid.

(5) Notwithstanding anything above, the Commission may designate any of its Officers to act as the Ombudsman.

(6) The Electricity Ombudsman appointed/ designated shall remain in office for a period of 3 years from the date he joins his office. The period of appointment may be extended further up to 3 years at the discretion of the Commission.

Provided that no Electricity Ombudsman appointed/designated shall hold Office as such after he has attained the age of sixty-five years.

(7) The Ombudsman shall, before entering upon his office, make and subscribe to, before the Chairperson of the Commission, an oath of office and secrecy in such manner and form as may be determined by the Commission.

(8) The Electricity Ombudsman appointed may be paid a fixed fee of Rs 60000/- per month. Additionally, the Electricity Ombudsman shall be entitled for TA/DA while out on duty as eligible to Class I officers of the rank of Joint Secretary in the Central Government.

(9) The Electricity Ombudsman shall be entitled for the Conveyance Allowance of Rs 10,000 - /per month and Telephone allowance up to a maximum of Rs 2500/ per month and shall be reimbursed as per actual bill. The Electricity Ombudsman shall be entitled for 12 days Casual Leave in calendar year after taking prior approval of the Commission.

(10) The post of Ombudsman being a full-time post, he shall devote his whole time to the affairs of the Office of the Ombudsman, and shall not hold any office of profit during his tenure.

(11) The Electricity Ombudsman may relinquish his office by giving in writing to the Commission a notice or paying three months consolidated emoluments. Similarly, if the Ombudsman is removed by the Commission, the Commission shall give prior notice in writing of not less than three (3) months to the Ombudsman.

39. Office of Ombudsman

(1) The Ombudsman‟s Office shall be located at such place as may be decided by the Commission.

Provided that the Ombudsman may hold hearings or proceedings at various places, within his jurisdiction, in order to expedite the disposal of representations received before him.

(2) The Electricity Ombudsman shall be provided with a Secretariat of 3 personnel as shown in table below, taken on deputation from UT Government/ State Government / Central Government / Government Undertakings or public utilities. Expenses on this shall be included in the concerned licensee‟s budget.

The establishment of the Secretariat shall be subject to the approval of the UT Government pending which officers / staff for this will be drawn from the existing staff of the licensees and placed on duty in the Office of the Ombudsman. The salary of such staff shall continue to be borne by the concerned licensee. Necessary instructions on this matter shall be issued by the Commission.

(3) The name, location, email address and telephone numbers of the Ombudsmen shall be widely publicised through newspapers and displayed on the websites and the offices of the licensees and the Commission, and shall be intimated to the consumers through electricity bills. These may also be publicised through electronic media.

(4) No person shall be appointed and/or be entitled to continue as an Ombudsman if he/ she stands disqualified on account of his/her

(a) has been adjudged as insolvent; or[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 47

(b) has been convicted of an offence involving moral turpitude; or

(c) has become physically or mentally incapable of acting as such Ombudsman; or

(d) has without reasonable cause refused or failed to discharge his functions for a period of at least three months; or

(e) ceases to fulfil any of the conditions of his appointment as Ombudsman; or

(f) has acquired such financial or other interest that can prejudicially affect his functioning as Ombudsman; or

(g) has conducted himself in a manner or has so abused his position as to render his continuance in office prejudicial to the public interest or to the objects and purposes of the Act.

(h) has been guilty of proven misbehaviour.

Provided that the Electricity Ombudsman shall not be removed from his office, unless the Commission, has, on an enquiry, held by the Commission concludes that the Electricity Ombudsman ought, on such ground or grounds, be removed.

40. Representation to the Electricity Ombudsman

(1) Subject to these Regulations, a representation to be made to the Electricity Ombudsman shall be as per Annexure III and shall contain –

(a) be in writing,

(b) be signed by the consumer,

(c) disclose the name and address of the Consumer/ Licensee,

(d) contain the details of the Grievance including the award of the Grievance Redressal Forum of the Licensee, and

(e) contain details of Complaint/Grievance made to any other authority/ court of law.

(2) The Electricity Ombudsman may accept a representation that does not comply with Regulations at his discretion.

(3) The Ombudsman shall acknowledge the receipt of the Representation in the following manner: a) Immediately on submission if the Representation is delivered personally; or b) By Post / email within two (2) working days of receipt of the Representation if the same is received through post / courier / email.

(4) The Ombudsman, while issuing acknowledgement, shall assign a unique case number and date to each Representation accepted by it.

(5) The Ombudsman shall maintain true and correct records of all Representations received from time to time.

41. Pre-conditions/limitations for entertaining complainant’s representation

(1) The representation may be entertained by the Ombudsman only if all of the following conditions are

satisfied that: -

(a) it has been filed by the complainant being the aggrieved consumer or the association representing the consumer/s;

(b) the complainant has, before making a representation to the Ombudsman, approached the Forum constituted under sub-section (5) of section 42 of the Act, for redressal of his grievance;

(c) the representation by the complainant, in respect of the same grievance, is not pending in any proceedings before any court, tribunal or arbitrator or any other authority or a decree or award or a final

order has not been passed by any such court, tribunal, arbitrator or authority;

(d) the representation is not in respect of the same cause of action which was settled or dealt with on merits by the Ombudsman in any previous proceedings whether or not received from the same complainant or along with one or more complainants or one or more of the parties concerned with the cause of action;

(e) the complainant is not satisfied with the redressal of his grievance by the Forum or the Forum has rejected the grievance or has not passed the order within the time-limit specified; or the licensee has not implemented the Forum‟s Order;

(f) the complainant has filed the representation before the Ombudsman within 30 days from the date of receipt of the decision of the Forum or the date of expiry of the period within which the Forum was required to take the decision or the date of expiry of the period within which the distribution licensee was required to implement Forum‟s order whichever is applicable:

Provided that the Ombudsman may entertain a representation after the expiry of the said period of thirty days if the Ombudsman is satisfied that there is sufficient cause for not filing it within that period;48 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(g) the representation of the complainant does not fall under sections 126, 127, 135 to 139, 152 and 161 of the Act.

(2) Subject to the provisions of the Act and this Regulation, the Ombudsman‟s decision as to whether the representation is fit and proper for being considered by it or not, shall be final.

(3) The Ombudsman may reject the representation at any stage if it appears to him that the representation is -

(a) frivolous, vexatious, malafide;

(b) without any sufficient cause;

(c) there is no prima facie loss or damage or inconvenience caused to the complainant:

Provided that the decision of the Ombudsman in this regard shall be final and binding on the complainant

and the distribution license:

Provided further that no representation shall be rejected in respect of sub-clauses (a), (b) and (c) unless the complainant has been given an opportunity of being heard.

(4) For the purpose of facilitating settlement of the representation, the Ombudsman may follow such procedures, as he may consider appropriate.

(5) When a representation is settled through mediation of the Ombudsman, the Ombudsman shall make a recommendation which he thinks fair in the circumstances of the case and shall send the copies of the recommendation to the complainant and the licensee.

(6) If the complainant and the licensee accept the recommendations of the Ombudsman, they will send a communication in writing, within 15 days of the date of receipt of the recommendations, stating clearly that the settlement communicated is acceptable to them, in totality, in terms of the recommendations made by the Ombudsman, and are in full and final settlement of the representation.

(7) The Ombudsman shall make a record of such an agreement in his order and thereafter close the case.

42. Jurisdiction

(1) The territorial jurisdiction of the Ombudsman shall extend to the whole or part of the UT of J&K and UT of Ladakh. Provided that where the Commission, by order, appoints or designates more than one Ombudsman, it shall define the territorial jurisdiction of each Ombudsman in such order.

43. Power and Functions of the Ombudsman for redressal of grievances of consumers

(1) The Ombudsman shall have the following powers and duties: a) To receive Representations, consider such Representations and facilitate settlement by agreement, through conciliation and mediation between the Licensee and Complainant, and pass an order in accordance with these Regulations where such conciliation is not reached.

b) The Ombudsman shall in the first instance act as a counsellor and mediator in matters which are the subject matter of the Representation. c) The Ombudsman shall exercise general powers of superintendence and control over its office and shall be responsible for the conduct of business thereat.

d) Ombudsman may also entertain a representation after the expiry of the prescribed period of 30 days, if the Ombudsman is satisfied that there is sufficient cause for not filing it within that period. In such cases the Ombudsman shall record the reasons for entertaining the representations in its order.

e) Upon request of the Complainant, the Ombudsman may issue such interim orders at any stage during the disposal of the representation as it may consider necessary.

44. Promotion of settlement by conciliation

(1) As soon as it may be practicable to do so, but not later than seven days from the date of receipt of the representation, the Ombudsman shall serve a notice to the concerned officer of the licensee named in the representation along with a copy of the representation and endeavour to promote a settlement of the representation by mutual agreement between the complainant and the licensee through conciliation or mediation.

(2) The notice to the Licensee served under Regulation 36 (1) above shall specify the time period within which the Licensee is required to respond to the Representation, and this time period shall be such as to allow the Ombudsman to settle the matter by conciliation or mediation within 30 days from the date of receipt of the Representation.

45. Hearing of representations[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 49

(1) After registering the representation, the Ombudsman, within seven days of registration, shall call for records relating to the representation from the concerned Forum and the concerned Forum shall send the entire records, within seven days from the date of receipt of such notice, to the office of the Ombudsman.

(2) The Ombudsman may require the licensee or any of the officials, representatives or agents of the licensee to furnish documents, books, information and data as may be required to decide the representation and the licensee shall duly comply with such requirements of the Ombudsman.

(3) Where the representation is not settled by agreement within a period of 30 days from the date of receipt of the representation or within such extended period as the Ombudsman may deem fit duly considering the overall time limit specified, the Ombudsman may determine the manner, the place, the date and the time of the hearing of the matter as the Ombudsman considers appropriate.

(4) The Ombudsman may hear the parties and may direct the parties to submit written statements or submissions in the matter.

(5) A complainant, distribution licensee or any other person, who is a party to any proceedings before the Ombudsman, may either appear in person or authorise any person to present his case before the Ombudsman and to do all or any of the acts for the purpose.

(6) Where the complainant or the licensee or their representative is unable to appear before the Ombudsman on the date fixed for hearing on more than two occasions consecutively the Ombudsman may, for reasons to be recorded, dispense with the presence of such person and, reject or decide the representation ex-parte.

(7) No adjournment shall ordinarily be granted by the Ombudsman unless sufficient cause is shown and the reasons for grant of adjournment have been recorded in writing by the Ombudsman.

(8) The Ombudsman may make such orders as to the cost, occasioned by the adjournment, to be paid by the defaulting party to the non-defaulting party and/or to the Ombudsman.

46. Ombudsman Power to issue Interim Order

(1) Upon the request of the complainant, the Ombudsman may issue such interim orders at any stage during

the disposal of the representation as it may consider necessary: a. Provided that the Ombudsman shall have the power to pass such an interim order in any proceeding, hearing or matter before it, as it may consider appropriate if the complainant satisfies the Ombudsman that prima facie the distribution licensee has threatened or is likely to remove or disconnect the electricity connection, and has or is likely to contravene any of the provisions of the Act or any rules and regulations made thereunder or any order of the Commission, provided that, the Ombudsman has

jurisdiction on such matters: b. Provided further that, except where it appears that the object of passing the interim order would be defeated by delay, no such interim order shall be passed unless the opposite party has been given an opportunity of being heard.

(2) The Ombudsman shall be guided by the principles of natural justice, and subject to the other provisions of these Regulations, the Ombudsman shall have power to regulate its own procedure.

(3) No party can file an appeal before the Commission against the order passed by the Ombudsman.

However, this is without prejudice to the rights of the complainant and the licensee to seek appropriate remedy against the order passed by the Ombudsman before appropriate bodies.

(4) The Ombudsman may, at any time, after affording an opportunity of being heard, review his Order, either on his own motion or on an application of any of the parties to the proceedings, within 30 days of the

Order on – a) the discovery of new and important matter of evidence which, after the exercise of due diligence, was not within his knowledge, or could not be produced by him at the time the order was made;

b) on account of some mistake or error apparent from the face of record; c) for any other sufficient reasons.

(5) The Ombudsman shall pass the review order within a maximum period of 45 days from the date of receipt of the review application or initiation of Suo- Moto review by the Ombudsman:

Provided that in the event of issuance of review order after the maximum period specified above, the Ombudsman should record in writing, the reasons for the delay in the review order.

(6) The Ombudsman shall be guided by such factors which in the opinion of the Ombudsman are necessary in the interest of justice and shall ensure transparency while exercising its powers and discharging its

functions in compliance with the principles of natural justice:

Provided that the Ombudsman shall not be bound by the Code of Civil Procedure, 1908 (5 of 1908) or the Indian Evidence Act, 1872 (1 of 1872) as in force from time to time.

47. Issuance of Order50 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(1) The Ombudsman shall pass a written speaking order giving reasons for all his findings and stating the nature of the reliefs to which the complainant is entitled as per the order.

(2) The Ombudsman shall pass an order as early as possible, but in any case, within 45 days from the date of receipt of the representation and where there is delay in the disposal of a representation within the said period, the Ombudsman shall record the reasons for such delay.

(3) The order passed by the Ombudsman shall set out -

(a) issue-wise decisions;

(b) reasons for passing the order;

(c) reasons for vacation of the interim Order, if any, made under regulation 36 and its impact;

(d) directions, if any, to the distribution licensee or complainant, and

(e) any other order, deemed appropriate in the facts and circumstances of the case.

(4) A copy of the order shall be sent to the parties and also to the concerned Forum for information within one week from the date of such order.

48. Reporting requirements

(1) The Ombudsman shall, within 7 days of the close of the period to which it relates, submit to the Commission a quarterly report on all the representations filed before it.

(2) The report shall cover-

(a) facts of the representations;

(b) responses of parties in brief;

(c) opinion of the Ombudsman on the compliance of Distribution Performance Standards by the licensee;

(d) key directions issued to the licensee and/ or to the consumer in the order; and

(e) compliance of order by the licensee and/ or to the consumer.

(3) The Ombudsman shall also furnish a quarterly report to the Commission as per Annexure-IV of these Regulations.

(4) The Ombudsman shall within 45 days of the close of the financial year to which it relates also furnish a yearly report containing a general review of the activities of the Ombudsman‟s office during the financial year to the Commission and the State Government.

Reports received by the Commission as per Clause 7.54, 7.55 and 7.56 above shall be placed on the Commission‟s website.

49. Inspection of Records and Supply of Certified Copies

(1) The Complainant and the Licensee shall be entitled to obtain certified copies of the orders, decisions, directions and reasons in support thereof given by the Ombudsman in respect of the Representation.

(2) Any person/Consumer shall be entitled to a copy of the orders of the Ombudsman subject to the payment of reasonable cost and compliance with other terms, as the Ombudsman may direct.

50. Information on Website

(1) The information about the Ombudsman and other details such as the date of next hearings, the order(s) passed by the Ombudsman for the consumers/ complainants etc. shall be available on the Commission‟s website. The Ombudsman shall keep all such information updated from time to time.

51. Power to Call for Information

(1) For the purpose of carrying out its duties, the Ombudsman may require either party to furnish any information or certified copies of any document relating to the subject matter of the Representation, which is or is alleged to be in the knowledge or possession of such party, within 30 days of such request:

Provided that in the event of failure of a Licensee to comply with the requisition without any sufficient cause, the Ombudsman may, if he deems fit, proceed to settle the case on the basis of available records.

Ombudsman shall notify the Commission regarding the query.

(2) The Ombudsman may also direct the Licensee to undertake an inspection or engage a third party to undertake such inspection, as may be required for expeditious disposal of the Representation and redressal of the Grievance.

52. Suo Moto Powers of the Commission

(1) The Commission shall have the power to take Suo moto cognisance of any matter that is pending before or has been disposed of by the Ombudsman, where it deems fit to do so. The Commission may, where it exercises its powers under this Regulation, pass orders reversing the orders of the Ombudsman:

Provided that the Commission shall not reverse the orders of the Ombudsman or take cognisance of a dispute pending before the Ombudsman unless it makes a reasoned order in writing to that effect.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 51 Where the Commission takes cognizance of a dispute pending before the Ombudsman under clause (i) above, the Ombudsman shall not pass any further orders in regard to the matter, and the matter shall be decided finally by the Commission.

(2) The Commission shall have the same powers and functions as the Ombudsman under these Regulations in relation to any matter over which it takes Suo moto cognizance.

Provided, however, that the Commission may by order confer upon itself additional powers as may be necessary for it to effectively decide any matter of which it has taken Suo moto cognizance under this Regulation.

CHAPTER VII Consumer Advocacy

53. Supply of copies of these Regulations Upon receiving a request, the Distribution Licensee shall ensure that copies of these Regulations are made available to the consumers on payment of a cost, which shall not be more than the cost of photocopying.

54. Submission of Report The Fora and Electricity Ombudsman shall maintain true and correct records of all Grievances and representations received by them from time to time and make available such records for inspection by the Commission as the Commission may require.

55. Language of the Fora and Electricity Ombudsman The filing of the Grievance/representation and the proceedings of the Fora and of the Electricity Ombudsman shall be in English or in Hindi.

56. A Consumer Advocacy Cell

1. A Consumer Advocacy Cell may be instituted and funded by the Commission at each Electricity Ombudsman‟s office for capacity building of Consumer Representatives and CGRF by conducting workshops, training, seminars and issue of quarterly magazines for enhancing consumer awareness.

2. The Consumer Advocacy Cell at each Electricity Ombudsman‟s office shall function under the supervision of the respective Electricity Ombudsman and overall supervision of the existing Consumer Advocacy Cell established within the Commission.

3. The Commission shall allocate an appropriate Budget for the Consumer Advocacy Cell at each Electricity Ombudsman‟s office in March month of each Year for the Financial Year commencing from April of that year.

4. Each Electricity Ombudsman shall provide the appropriate funds from within the allocated budget to each Forum within his jurisdiction for improving consumer awareness by inter-alia, conducting workshops, training, Seminars and issue of quarterly magazines.

5. The Consumer Advocacy Cell established within the Commission shall also perform the following

additional functions:

(a) Evaluate the performance of the various Fora and Electricity Ombudsman on quarterly basis, in terms of details submitted in the quarterly Reports in accordance with Regulation 50;

(b) Half-yearly review of grievances, representations and reports submitted by the Fora and the Electricity Ombudsman;

(c) Advise the Commission on improvements to be made in the Regulations based on review of reports submitted by the Fora and Electricity Ombudsman and the results of the consumer satisfaction survey conducted periodically by the Distribution Licensees;

(d) Analysis of reports submitted by the Distribution Licensee with regard to levels of performance achieved with respect to Standards of Performance of Distribution Licensees;

(e) Taking feedback of the consumers on the performance of the respective Forum;

(f) Advise the Distribution Licensee on the creation of the web-based portal for submission of Grievances;

(g) Advise the Distribution Licensee on the consumer satisfaction survey to be undertaken once in every two (2) years.

Chapter VIII MISCELLANEOUS

57. Commission’s Power of Superintendence & Control52 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(1) The Commission shall have the general powers of superintendence and control over the Forum and Ombudsman and for this purpose may call for any record from the Forum/Distribution Licensee/Ombudsman and issue appropriate orders/directions thereupon. The Forum/Distribution Licensee/Ombudsman shall duly comply with such directions as the Commission may issue from time to time.

58. Powers to remove difficulties

(1) If any difficulty arises in giving effect to any of the provisions of these Regulations, the Commission may initiate Suo moto and by general or special order, direct the Licensee to take suitable action, not being inconsistent with the Electricity Act, 2003, which appears to it to be necessary or expedient for the purpose of removing difficulties.

(2) The Licensee may make an application to the Commission and seek suitable orders to remove any difficulties that may arise in the establishment of the Forum as per these Regulations.

59. Power to issue practice directions

(1) Subject to the provisions of the Act, The Commission may from time-to-time issue orders and practice directions in furtherance of these Regulations.

60. Power to Amend

(1) The Commission may, at any time, vary, alter, modify or amend any provision of these Regulations.

61. Repeal and Savings

(1) Nothing in these Regulations shall be deemed to limit or otherwise affect the inherent power of the Commission to make such orders as may be necessary to meet the ends of justice or to prevent abuses of the process of the Commission.

(2) Nothing in these Regulations shall bar the Commission from adopting in conformity with the provisions of the Act a procedure, which is at variance with any of the provisions of these Regulations, if the Commission, in view of the special circumstances of a matter or class of matters and for reasons to be recorded in writing, deems it necessary or expedient for dealing with such a matter or class of matters.

(3) Nothing in these Regulations shall, expressly or impliedly, bar the Commission dealing with any matter or exercising any power under the Act for which no Regulations have been framed, and the Commission may deal with such matters, powers and functions in a manner it thinks fit.

(4) Nothing contained in these Regulations shall affect the rights and privileges of the consumer under any other law for the time being in force, including under the Consumer Protection Act, 2019 (35 of 2019) and amendments /revision.

(5) On and from notification of these regulations, adopted, Joint Electricity Regulatory Commission (For The State of Goa and Union Territories) Consumer Grievances Redressal Forum and Ombudsman Regulations, 2019, along with amendments as carried out thereto, shall stand repealed.
