(Amendment) Regulations 1986 Made - - - - 1st September 1986 Laid before Parliament 8th September 1986 Coming into Operation 29th September 1986 The Secretary of State for Transport, being a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the regulation of the type, description, construction or equipment of vehicles, and of components of vehicles, and in particular any vehicle type approval scheme, in exercise of the powers conferred by section 2(2) of that Act and of all other enabling powers, hereby makes the following Regulations:โ
1. These Regulations may be cited as the Motor Vehicles (Type Approval) (Amendment) Regulations 1986 and shall come into operation on 29th September 1986.
2. For Schedule 2 (Community Directives relating to the design, construction, equipment and marking of vehicles or vehicle components and Council Regulations on the harmonization of certain social legislation relating to road transport) to the Motor Vehicles (Type Approval) Regulations 1980(3) there is substituted the Schedule set out in the Schedule to these Regulations.
3.โ(1) Regulation 4 of the Motor Vehicles (Type Approval) (Amendment) Regulations 1982(4) is revoked.
(2) The Motor Vehicles (Type Approval) (Amendment) (No. 2) Regulations 1982(5), the Motor Vehicles (Type Approval) (Amendment) Regulations 1984(6) and the Motor Vehicles (Type Approval) (Amendment) Regulations 1985(7) are revoked.

EXPLANATORY NOTE (This Note is not part of the Regulations.) These Regulations amend the Motor Vehicles (Type Approval) Regulations 1980 by substituting a consolidated Schedule 2 for the existing Schedule 2, which has been four times amended since
1980. That Schedule is further amended by including in item 9 of Part I, alternatively to the existing requirements relating to the braking devices of certain categories of motor vehicles and their trailers, the requirements of Council Directive 71/320/EEC as amended by Commission Directives 74/132/EEC, 75/524/EEC, 79/489/EEC and 85/647/EEC. Part II of Schedule 2, which relates to the approval of recording equipment in road transport, is amended to refer to the requirements of Council Regulation 3821/85. References to spent directives and regulations have been deleted. Three of the amending instruments (S.I. 1982/1623, 1984/1927 and 1985/1072) are now spent, and are revoked
entirely: in the fourth amending instrument (S.I. 1982/7), the regulation which amended Schedule 2 is revoked.
