STATUTORY INSTRUMENTS 2026 No. 838 ELECTRONIC COMMUNICATIONS The Wireless Telegraphy Act 2006 (Directions to OFCOM) (Revocation) Order 2026 Made - - - - 15th July 2026 Coming into force - - 16th July 2026 The Secretary of State makes this Order in exercise of the powers conferred by section 5 of the Wireless Telegraphy Act 2006(1).
In accordance with section 6(2) of that Act, the Secretary of State has consulted OFCOM and such other persons as the Secretary of State thinks fit.
In accordance with section 6(3A) of that Act, the Secretary of State has taken due account of the desirability of not favouring one form of electronic communications network, electronic communications service or associated facility or one means of providing or making available such a network, service or facility, over another.
In accordance with section 6(4) of that Act, a draft of this Order was laid before Parliament and approved by resolution of each House of Parliament.
Citation, commencement and extent
1.โ(1) This Order may be cited as the Wireless Telegraphy Act 2006 (Directions to OFCOM)
(Revocation) Order 2026.
(2) This Order shall come into force on the day after the day on which it is made.
(3) This Order extends to England and Wales, Scotland and Northern Ireland.

2. The Wireless Telegraphy Act 2006 (Directions to OFCOM) Order 2010(2) is revoked.

EXPLANATORY NOTE (This note is not part of the Order) This Order revokes the Wireless Telegraphy Act 2006 (Directions to OFCOM) Order 2010 (โ2010
Orderโ), through which the Secretary of State gave a number of directions to the Office of Communications (โOFCOMโ). The directions were to vary wireless telegraphy licences, to amend spectrum trading regulations to allow the trading of licences, to amend regulations setting charges for the grant of a licence and to make regulations to set the rules for an auction of licences to use frequencies. The purposes of the 2010 Order are served, and the 2010 Order is now redundant.
These purposes were, as set out in article 2 of the 2010 Order as amended by article 4(2) of the Radio Spectrum (EU Exit) Regulations 2018, to ensure the release of additional electromagnetic spectrum for use by providers of next generation wireless mobile broadband, to allow early deployment and maximising the coverage of those services and to create greater investment certainty for operators.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
