STATUTORY INSTRUMENTS 2026 No. 962 NATIONAL HEALTH SERVICE, ENGLAND AND WALES The Personal Injuries (NHS Charges) (Information Provision and Amounts) (Amendment) Regulations 2026 Made - - - - 1st September 2026 Laid before Parliament 3rd September 2026 Coming into force Regulations 1, 3 and 4 1st October 2026 Regulation 2 6th April 2027 The Secretary of State makes these Regulations in exercise of the powers conferred by sections 151(9), 153(2) and (5)(a), (b) and (d), 160(1) and (2), 167(1)(a) and 195(1) and (2) of the Health and Social Care (Community Health and Standards) Act 2003(1).
In accordance with section 195(3) of that Act, the Secretary of State has consulted with the Welsh Ministers(2).
Citation, commencement and extent
1.—(1) These Regulations may be cited as the Personal Injuries (NHS Charges) (Information Provision and Amounts) (Amendment) Regulations 2026.
(2) Subject to paragraph 3, these Regulations come into force on 1st October 2026.
(3) Regulation 2 comes into force on 6th April 2027.
(4) These Regulations extend to England and Wales.
(1) 2003 c. 43. By virtue of section 167(1)(a), the powers are exercisable in relation to England and Wales by the Secretary of State. See section 168 for the definition of “prescribed”. Amendments to section 160 and section 195 are not relevant to the power as exercised in these Regulations.
(2) Functions conferred or imposed on the National Assembly for Wales immediately before the first appointment of a First Minister under section 46 of the Government of Wales Act 2006 (c. 32) (“GOWA”) by an enactment contained in an Act were transferred to the Welsh Ministers by section 162(1) of, and paragraph 30 of Schedule 11 to, GOWA.Document Generated: 2026-09-03

Amendment of the Personal Injuries (NHS Charges) (General) and Road Traffic (NHS Charges) (Amendment) Regulations 2006
2.—(1) The Personal Injuries (NHS Charges) (General) and Road Traffic (NHS Charges)
(Amendment) Regulations 2006(3) are amended as follows.
(2) In regulation 1(3) (citation, commencement, application and interpretation)—
(a) for“1977(3).” substitute “1977(3);”;
(b) after the definition of “hospital” insert— ““NHS number” means the number, consisting of 10 numeric digits, which serves as the national unique identifier used for the purpose of safely, accurately and efficiently sharing information relating to a registered patient across the whole of the health services in England and Wales;”.
(3) In regulation 2(1)(b) (application for a certificate of NHS charges), after “number” insert “and NHS number”.
(4) In regulation 5(3) (information to be provided in relation to an injured person), after sub- paragraph (c) insert the following sub-paragraph— “(ca) the NHS number of the injured person;” Amendment of the Personal Injuries (NHS Charges) (Amounts) Regulations 2015 3 In the Personal Injuries (NHS Charges) (Amounts) Regulations 2015(4), in Schedule 1 (Amount of NHS Charges), for the existing table, substitute the following table— “Amount of NHS Charges

EXPLANATORY NOTE (This note is not part of the Regulations) These Regulations amend the Personal Injuries (NHS Charges) (General) and Road Traffic (NHS Charges) (Amendment) Regulations 2006 (S.I. 2006/3388) (“the 2006 Regulations”) and the Personal Injuries (NHS Charges) (Amounts) Regulations 2015 (S.I. 2015/295) (“the 2015 Regulations”). The 2006 and 2015 Regulations form part of the legislative framework of the injury cost recovery scheme under Part 3 of the Health and Social Care (Community Health and Standards) Act 2003 (c. 43).
The 2006 Regulations make provision about the operation of the scheme. Regulation 2 of these Regulations amends the 2006 Regulations to require the provision of the NHS number of the injured person, where known, by persons who are liable for charges under the scheme. It also enables the Compensation Recovery Unit to request the injured person’s NHS number from specified persons.
The 2015 Regulations make provision about the charges payable under the scheme. Regulation 3 of these Regulations amends the 2015 Regulations by substituting the table in Schedule 1. This table provides for increased charges in respect of injuries which occur on or after 1st October 2026.
Regulation 4 of these Regulations revokes the Personal Injuries (NHS Charges) (Amounts)
(Amendment) Regulations 2025 (S.I. 2025/986).
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
