2. आवेदकों न े आरोप लगाया ह ै दक कजथत पारटत आयातों के कारण घरेल ू उद्योग को वास्ट्तजवक क्षजत हो रही ह,ै जो संबद्ध देिों म ें मूल रूप स े या वहा ं स े जनयाचत दकए गए ह ैं और उन्होंने संबद्ध वस्ट्तुओं के आयातों पर एंटी-डंहपग िल्ु क लगान े का अनुरोध दकया ह।ै क. जवचाराधीन उत्पाद

3. वतचमान जांच के जलए जवचाराधीन उत्पाद 'सोजडयम सायनाइड' ह ै जो मामूली रूप स े मजबूत बेस ह।ै यह NaCN सूत्र वाला एक जहरीला यौजगक ह।ै यह सफेद रंग का होता ह ैऔर पानी म ें घलु निील ठोस होता ह।ै साइनाइड केिन म ें धातुओं के जलए एक उच्च संबधं ह,ै इस प्रकार, इस आधार के जलए उच्च जवषाक्तता का श्रेय ददया जाता ह।ै

4. प्रयोग: सोजडयम सायनाइड का उपयोग उनके संबंजधत अयस्ट्कों स े सोने और चांदी की जनकासी के जलए दकया जाता ह,ै इलेक्ट्रोप्लेटटग म,ें धातुओं के ताप उपचार (केस हाडचहनग), कीटनािकों, रंगों, जपगमेंट, थोक दवाओं के जनमाचण और कई काबचजनक संश्लषे णों, एग्रोकेजमकल्स, नायलॉन इंटरमीजडएट्स, जेहलग यौजगकों अयस्ट्क प्लवनिीलता और दवा मध्यवती म ें दकया जाता ह।ै

5. टैररफ वगीकरण: जवचाराधीन उत्पाद को सीमा िुल्क टैररफ अजधजनयम, 1975 के अध्याय 28 के तहत सीमा िुल्क टैररफ वगीकरण के उपिीषचक 283711 के तहत वगीकृत दकया गया ह।ै हालांदक, अतीत म,ें पीयूसी को अन्य उप- िीषों के तहत भी आयात दकया गया ह,ै जैसे दक 28371990, 28372090, 28372040, 28391100 और 28371910 |

6. जांच के पक्षकार पीयूसी पर अपनी रटप्पजणयां प्रदान कर सकते ह ैं और एंटी-डंहपग एजप्लकेिन के गरै -गोपनीय संस्ट्करण के संचलन के 15 ददनों के भीतर पीसीएन, यदद कोई हो, का प्रस्ट्ताव कर सकते ह।ैं ख. समान वस्ट्त ु

7. आवेदकों न े कहा ह ै दक आवेदकों द्वारा उत्पाददत वस्ट्त ु और संबद्ध देिों स े जनयाचजतत वस्ट्त ु म ें कोई महत्वपूणच अंतर नहीं ह ै। आवेदकों द्वारा उत्पाददत और संबद्ध देिों स े आयाजतत वस्ट्त ु भौजतक और रासायजनक जविेषताओं, जनमाचण प्रदक्रया और प्रौद्योजगकी, कायों और उपयोगों, उत्पाद जवजनदेिों, मूल्य जनधाचरण, जवतरण और जवपणन और संबद्ध वस्ट्तओंु के टैररफ वगीकरण के संदभच म ें तलु नीय ह।ै संबद्ध सामान और आवेदक द्वारा जनर्भमत वस्ट्त ु तकनीकी और व्यावसाजयक रूप स े प्रजतस्ट्थापन योग्य ह।ैं आवेदक न े दावा दकया ह ै दक संबद्ध वस्ट्तुओं के उपभोक्ता संबद्ध वस्ट्तओंु और आवेदकों द्वारा जवजनर्भमत वस्ट्त ु का परस्ट्पर उपयोग कर रह े ह ैं । इस प्रकार, वतचमान जांच के प्रयोजनों के जलए, आवेदकों द्वारा उत्पाददत वस्ट्तु को चीन जन.गण., यूरोपीय संघ, जापान और कोररया आरपी स ेआयात दकए जा रह े उत्पाद के समान वस्ट्तु माना गया ह।ै ग. सबं द्ध दिे

8. आवेदन मूल रूप स े चीन जनवादी गणराज्य, जापान और कोररया जनवादी गणराज्य म ें मूलताः या वहा ं स े जनयाचजतत संबद्ध वस्ट्तुओं के कजथत पाटन के संबंध म ें दायर दकया गया था। तत्पश्चात, प्रथम दष्टृ या जांच के दौरान, डीजीसीआईएंडएस के आंकडों के आधार पर जांच दल न े यह सुजनजश्चत दकया दक जमचनी स े आयात भी न्यूनतम सीमा स े अजधक ह ै और घरेलू बाजार म ें पारटत कीमतों पर प्रवेि कर रह े ह।ैं इसजलए वतचमान जांच के प्रयोजन के जलए संबद्ध दिे चीन जनवादी गणराज्य, यूरोपीय संघ, जापान और कोररया जनवादी गणराज्य ह।ैं घ. जाचं की अवजध (पीओआई)

9. वतचमान जांच के जलए जांच की अवजध (इसके बाद पीओआई के रूप म ें संदर्भभत) 1 अक्ट्टूबर 2021 - 30 जसतंबर 2022 (12 महीने) ह।ै इसके अलावा, क्षजत जांच अवजध 1 अप्रलै 2019- 31 माच च 2020, 1 अप्रैल 2020- 31 माच च 2021, 1 अप्रलै 2021- 31 माचच 2022 और पीओआई के रूप में प्रस्ट्ताजवत की गई ह।ै ड. घरेल ू उद्योग और उसकी जस्ट्थजत

10. आवेदन हहदस्ट्ु तान केजमकल कंपनी और यनू ाइटेड फॉस्ट्फोरस जलजमटेड द्वारा दायर दकया गया ह।ै आवेदकों द्वारा प्रदान की गई सूचना के अनुसार, वे भारत म ेंसमान वस्ट्त ु के केवल उत्पादक ह।ैं

11. आवेदकों ने आधार वषच और उसके बाद के वषच म ें संबद्ध वस्ट्तु का आयात दकया था । तथाजप, दकसी भी आवेदक ने जांच की अवजध म ें या ठीक जपछल े वषच म ें संबद्ध वस्ट्तओंु का आयात नहीं दकया ह।ै इसके अलावा, कोई भी आवेदक संबद्ध देिों म ें दकसी भी उत्पादक/जनयाचतक या भारत म ेंसंबद्ध वस्ट्तु के कदकसी आयातक स े सबं ंजधत नहीं ह।ै[भाग I—खण् ड 1] भारत का राजपत्र : असाधारण 3

12. इसजलए, आवेदक घरेलू उत्पादक एडी जनयमावली, 1995 के जनयम 2(बी) के तहत पररभाजषत घरेल ू उद्योग का गठन करत े ह ैंऔर आवेदन एडी जनयमावली, 1995 के जनयम 5(3) की आवश्यकताओं को पूरा करता ह।ै च. कजथत पाटन का आधार

13. सामान्य मल्ू य I. चीन पीआर i. आवेदकों ने यह प्रस्ट्ततु दकया ह ै दक चीन जन गण को एक गैर बाजार अथचव्यवस्ट्था के रूप म ें माना जाना चाजहए और चीन जन गण के उत्पादकों को यह प्रदर्भित करने के जलए जनदेजित दकया जाना चाजहए दक संबद्ध वस्ट्तुओं के उत्पादन और जबक्री के संबंध म ें उद्योग म ें बाजार अथव्यच वस्ट्था की जस्ट्थजत प्रबल ह ै । जब तक चीन जन . गण . के उत्पादक यह न दिाचए ं दक ऐसी बाजार अथचव्यवस्ट्था की जस्ट्थजत प्रबल ह ै , उनका सामान्य मल्ू य पाटनरोधी जनयमावली, 1995 के अनुबंध - I के पैरा 7 के अनुसार जनधाचररत दकया जाना चाजहए । ii. इसजलए, उजचत लाभ मार्भजन के साथ, जबक्री, सामान्य और प्रिासजनक व्यय के साथ जवजधवत समायोजजत आवेदकों की उत्पादन लागत के अनुमानों के आधार पर सामान्य मूल्य का जनमाचण दकया गया ह।ै II. यरू ोपीय सघं , जापान और कोररया आरपी i. आवेदकों न े दावा दकया ह ै दक यूरोपीय संघ, जापान और कोररया आरपी म ें कीमत स े संबंजधत डेटा सावचजजनक डोमेन म ें उपलब्ध नहीं ह।ै यह भी नोट दकया जाता ह ै दक तीसरे देिों स े अन्य दिे ों को संबद्ध वस्ट्तुओं की जनयाचत कीमत भी सावचजजनक डोमेन म ेंउपलब्ध नहीं ह।ै ii. इसजलए, िुरूआत के प्रयोजन के जलए, उजचत लाभ मार्भजन के साथ, जबक्री, सामान्य और प्रिासजनक व्यय के साथ जवजधवत समायोजजत आवेदकों की उत्पादन लागत के अनुमानों के आधार पर सामान्य मूल्य का जनमाचण दकया गया ह।ै प्राजधकारी जांच के दौरान सामान्य मल्ू य के जनधाचरण के जलए जहतबद्ध पक्षकारों और आवेदकों द्वारा उपलब्ध कराए गए साक्ष्यों की आग े जांच करेंग े ।

14. जनयातच कीमत i. संबद्ध वस्ट्तुओं के जलए जनयाचत मूल्य की गणना आवेदकों द्वारा प्रस्ट्ततु दकए गए डीजीसीआईएंडएस प्रकाजित आयात डेटा के आधार पर की गई ह,ै जजसम ें समुद्री भाडा, समुद्री बीमा, कमीिन, अंतदिे ीय भाडा, बंदरगाह व्यय और बैंक िल्ु क िाजमल ह,ैं तादक िुद्ध जनयाचत मूल्य जनकाला जा सके।

15. पाटन मार्भजन i. सामान्य मूल्य और जनयाचत कीमत की तुलना कारखाना बाह्य स्ट्तर पर की गई ह,ै जजससे प्रथम दष्टृ या यह स्ट्थाजपत होता ह ै दक पाटन मार्भजन न्यूनतम स्ट्तर स े ऊपर ह ै और संबद्ध देिों स े जवचाराधीन उत्पाद के संबंध म ें महत्वपूण च ह।ै इस प्रकार, प्रथम दष्टृ या इस बात के पयाचप्त साक्ष्य ह ैं दक सबं द्ध देिों स े जवचाराधीन उत्पाद को संबद्ध देिों के जनयाचतकों द्वारा भारत के घरेलू बाजार म ें पारटत दकया जा रहा ह।ै छ. क्षजत और कारणात्मक सबं धं

16. आवेदक न े पारटत आयातों के कारण घरेलू उद्योग को हुई क्षजत के संबंध म ें प्रथम दष्टृ या साक्ष्य प्रदान दकया ह।ै संबद्ध देिों स े संबद्ध आयातों की मात्रा जनरपेक्ष रूप स े और साथ ही सापेक्ष दजृ ष्ट स े महत्वपूण च ह।ै समग्र रूप स े संबद्ध दिे ों स े कीमत म ें कटौती सकारात्मक और अत्यजधक ह ै । घरेल ू उद्योग के उत्पादन म ें जगरावट आई ह।ै घरेल ू उद्योग के क्षमता उपयोग म ें जगरावट आई ह।ै पारटत आयातों के कारण कीमतों में ह्रास और ह्रास घरेल ू उद्योग को परू ी लागत वसूल करने और प्रजतलाभ की उजचत दर प्राप्त करन े के जलए अपनी कीमतें बढाने स े रोक रह े ह ैं । घरेलू उद्योग का बाजार जहस्ट्सा उस मांग स े कम ह ै जजसे वह पूरा कर सकता ह।ै संबद्ध आयातों का घरेलू उद्योग के लाभप्रदता मानदडं ों पर प्रजतकूल प्रभाव पडा ह ै जजसके कारण नकद लाभ, पीबीआईटी और आरओसीई म ें भारी जगरावट दजच की गई ह।ै घरेल ू उद्योग के मालसूची स्ट्तरों म ें भी उल्लेखनीय वृजद्ध हुई ह।ै आवेदकों की उत्पादकता उत्पादन म ें बदलाव के साथ आग े बढी ह।ै आवेदक की वृजद्ध मात्रा के साथ-साथ मल्ू य मापदडं ों के संदभच म ेंनकारात्मक रही ह।ै

17. संबद्ध आयातों का आयात मूल्य जबक्री की लागत म ें वृजद्ध के अनुरूप नहीं बढा ह,ै जजससे मांग और आपूर्भत म ें कोई अंतर न होने के बावजूद संबद्ध देिों स े जनरंतर आयात की अनुमजत जमलती ह।ै आयात की लगातार कम कीमत न े आवेदकों को अपनी क्षमता का इष्टतम स्ट्तर तक उपयोग करने की अनुमजत नहीं दी ह।ै पररणामस्ट्वरूप, आवेदक जनजरक्रय क्षमताओं के साथ काम कर रह े ह।ैं ज. पाटनरोधी जाचं की िरूु आत

18. घरेलू उद्योग द्वारा दायर जवजधवत रूप स े साक्ष्य ांदकत जलजखत आवेदन के आधार पर और संबद्ध दिे के मूल के अथवा वहा ं स े जनयाचजतत जवचाराधीन उत्पाद के पाटन, घरेलू उद्योग को क्षजत और कजथत पाटन और क्षजत के बीच कारणात् मक संबंध के बारे म ें प्रस्ट् तुत प्रथमदरृ ट या साक्ष्य स े स्ट् वयं को संतुरट करन े के बाद तथा जनयमावली के जनयम 5 के साथ परठत अजधजनयम की धारा 9क के अनुसार प्राजधकारी एतद्द्वारा संबंध दिे के मलू के अथवा वहा ं स े जनयाचजतत जवचाराधीन उत्पाद के संबंध म ें दकसी कजथत पाटन की मौजूदगी, मात्रा और प्रभाव का जनधाचरण करन े और पाटनरोधी िल्ु क की ऐसी राजि की जसफाररि करने जजसे यदद लगाया जाए तो वह घरेल ू उद्योग को हुई क्षजत को समाप् त करने के जलए पयाचप् त होगी, के जलए जांच की िुरूआत करते ह।ैं झ. प्रदक्रया

19. एडी जनयमावली, 1995 के जनयम 6 के अन्तगतच यथावर्भणत जसद्धांतों का वतचमान जांच म ेंपालन दकया जाएगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] ञ. सचू ना प्रस्ट्त तु करना

20. जनर्ददर ट प्राजधकारी को भेज े जाने वाले सभी पत्र ई-मेल पतों dd11-dgtr@gov.in और dd16-dgtr@gov.in पर तथा उनकी एक प्रजत adg14-dgtr@gov.in और adv13-dgtr@gov.in को भेजी जानी चाजहए । यह सुजनजश्चत दकया जाना चाजहए दक अनुरोध का वणचनात् मक जहस्ट्स ा पीडीएफ/एमएस वल् ड च फामेट म ें और आंकडों की फाइल एम एस एक्ट् सल फामेट म ेंखोजे जाने योग् य हो ।

21. संबद्ध दिे म ें ज्ञात उत्पादकों/जनयाचतकों, भारत म ें संबद्ध दिे के दतू ावास के ज़ररए उसकी सरकार भारत म ें संबद्ध वस्ट्तु स े संबंजधत समझ े जाने वाले आयातक और प्रयोक्ताओं को अलग स े सूजचत दकया जा रहा ह ै तादक वे इस जांच िुरुआत अजधसूचना उजल्लजखत समय-सीमा के भीतर समस्ट्त संगत सूचना प्रस्ट्तुत कर द।ें ऐसी समस्ट्त सूचना इस जांच िुरुआत अजधसूचना, एडी जनयमावली, 1995 और प्राजधकारी द्वारा जारी लागू व्यापार सूचनाओं द्वारा यथाजवजहत पद्धजत और ढंग स े प्रस्ट्तुत की जानी चाजहए।

22. कोई अन्य जहतबद्ध पक्षकार भी वतचमान जांच स े सगं त अनुरोध इस जांच पररणाम अजधसूचना म ें उजल्लजखत समय सीमा के भीतर जांच िुरुआत अजधसूचना, एडी जनयमावली, 1995 और प्राजधकारी द्वारा जारी लागू व्यापार सूचनाओं द्वारा यथाजवजहत ढंग और तरीके स ेप्रस्ट्तुत कर सकता ह।ै

23. प्राजधकारी के समक्ष कोई गोपनीय अनरु ोध करन े वाले दकसी पक्षकार को अन् य जहतबद्ध पक्षकारों को उपलब् ध कराए जाने के जलए उसका एक अगोपनीय अंि प्रस्ट्त ुत करना अपेजक्षत ह।ै

24. इच्छुक पार्टटयों को आग े जनदेजित दकया जाता ह ै दक व े व्यापार उपचार महाजनदिे ालय की आजधकाररक वेबसाइट (https://www.dgtr.gov.in/ ) को जनयजमत रूप स े देखते रह ें और जानकारी के साथ-साथ आगे की जााँच पडताल प्रदक्रयाओं स े अवगत रह।ें ट. समय-सीमा

25. वतचमान जांच स े संबंजधत कोई सूचना जनर्ददष्ट प्राजधकारी को ईमेल पतों dd11-dgtr@gov.in और dd16- dgtr@gov.in तथा adg14-dgtr@gov.in और adv13-dgtr@gov.in को एक प्रजत के साथ प्राजधकारी द्वारा आवेदक के आवेदन के गैर-गोपनीय संस्ट्करण को पररचाजलत दकए जाने अथवा एडी जनयमावली के जनयम 6(4) के अनुसार जनर्ददष्ट प्राजधकारी द्वारा जनयाचतक दिे के उजचत राजनजयक प्रजतजनजध को प्रेजषत दकए जाने की तारीख स े 30 ददनों के भीतर इमले के माध्यम स े भेजी जानी चाजहए। यदद जवजहत समय सीमा के भीतर कोई सूचना प्राप् त नहीं होती ह ै या प्राप् त सूचना अधूरी होती ह ै तो प्राजधकारी एडी जनयमावली, 1995 के अनुसार ररकॉडच म ें उपलब् ध तथ्य ों के आधार पर अपन े जांच पररणाम दजच कर सकते ह।ैं

26. सभी जहतबद्ध पक्षकारों को एतद्द्वारा वतचमान मामले म ेंअपने जहत (जहत के स्ट् वरूप सजहत) की सूचना देने और इस अजधसूचना म ें यथाजनधाचररत उपयुचक्ट् त समय सीमा के भीतर प्रश् नावली का उत् तर दने े की सलाह दी जाती ह ै।

27. जहा ं कोई जहतबद्ध पक्षकार अनुरोध करने के जलए अजतररक्त समय मांगता ह,ै वहा ं उसे एडी जनयमावली, 1995 के जनयम 6(4) के अनुसार ऐसे समय जवस्ट्तार का पयाचप्त कारण बताना चाजहए और ऐसा अनुरोध इस अजधसूचना म ें जनधाचररत समय सीमा के भीतर दकया जाना चाजहए। ठ. गोपनीय आधार पर सचू ना प्रस्ट्ततु करना

28. जहा ं वतचमान म ें कोई पक्षकार गोपनीय अनुरोध करता ह ै या प्राजधकारी के समक्ष गोपनीय आधार पर सूचना देता ह,ै वहा ं उसे एडी जनयमावली के जनयम 7(2) के अनुसार और इस संबंध म ें प्राजधकारी द्वारा जारी की गई संगत व्यापार सूचनाओं के अनुसार ऐसी सूचना का अगोपनीय अिं साथ म ेंप्रस्ट्तुत करना अपेजक्षत ह।ै

29. ऐसे अनरु ोध पर प्रत्येक पष्ठृ पर ‘गोपनीय’ या ‘अगोपनीय’ स्ट्पष्ट रूप स े अंदकत होना चाजहए। ऐसे अंकन के जबना प्राजधकारी को दकए गए दकसी अनुरोध को प्राजधकारी द्वारा ‘’अगोपनीय’’ सूचना माना जाएगा और प्राजधकारी को अन्य जहतबद्ध पक्षकारों को ऐस ेअनुरोध का जनरीक्षण करन े की अनुमजत देने की स्ट्वतंत्रता होगी।

30. जहतबद्ध पक्षकारों द्वारा प्रस्ट्ततु सूचना के अगोपनीय अंि को अजनवाय च रूप स े गोपनीय अंि की अनुकृजत होना चाजहए जजसम ें ‘’गोपनीय सूचना’’ अजधमानत: सूचीबद्ध या ररक्त छोडी गई (जहां सूचीबद्ध करना संभव न हो) होनी चाजहए और ऐसी सूचना को जजस सूचना के गोपनीय होन े का दावा दकया गया ह,ै उस पर जनभचर रहते हुए उजचत और पयाचप्त रूप स े सारांिीकृत होना चाजहए।

31. अगोपनीय सारांि पयाचप्त जवस्ट्ततृ होना चाजहए जजससे गोपनीय आधार पर प्रस्ट्तुत सूचना की पयाचप्त तकचसगं त समझ बन सके। तथाजप, आपवाददक पररजस्ट्थजतयों म ें गोपनीय आधार पर सूचना देन े वाला पक्षकार इंजगत कर सकता ह ै दक ऐसी सूचना का सारांि संभव नहीं ह ै और प्राजधकारी की संतजु ष्ट के स्ट्तर तक एडी जनयमावली, 1995 के जनयम 7 और प्राजधकारी द्वारा जारी उजचत व्यापार सूचनाओं के अनुसार ऐस े कारणों को पयाचप्त और पूणच रूप स े स्ट्पष्ट करन े वाला एक जववरण प्रस्ट्ततु कर सकता ह ैदक सारांिीकरण क्ट्यों संभव नहीं ह।ै

Subject: Initiation of anti-dumping investigation concerning imports of ‘Sodium Cyanide (NaCN)’ originating in or exported from China PR, European Union, Japan and Korea RP.

F. No. 6/03/2023-DGTR.—An application has been filed by Hindusthan Chemical Company and United Phosphorous Limited (hereinafter referred to as the ‗applicants‘), before the Designated Authority, in accordance with the Customs Tariff Act, 1975 (hereinafter referred to as the ‗Act‘) as amended in 1995 and thereafter, and the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, as amended from time to time (hereinafter referred to as the ‗AD Rules, 1995‘), for the initiation of an anti-dumping investigation and the imposition of appropriate anti-dumping duty on imports of ―Sodium Cyanide (NaCN)‖ (hereinafter referred to as the ‗subject goods‘ or the ‗product under consideration‘) originating in or exported from China PR, European Union (hereinafter referred to as ―EU‖), Japan and Korea RP (hereinafter referred to as the ‗subject countries‘)

2. The applicants have alleged that material injury is being caused to the domestic industry due to the alleged dumped imports, originating in or exported from the subject countries and have requested for the imposition of anti- dumping duties on the imports of the subject goods from the subject countries.

A. PRODUCT UNDER CONSIDERATION

3. The product under consideration for the present investigation is ‗Sodium Cyanide‘ which is a moderately strong base. It is a poisonous compound with the formula NaCN. It is white in colour and is a water-soluble solid.

Cyanide cation has a high affinity for metals, thus, attributing high toxicity to this base.

4. Uses: Sodium Cyanide is used for extraction of gold and silver from their respective ores, in electroplating, heat treatment of metals (case hardening), manufacturing insecticides, dyes, pigments, bulk drugs and in many organic syntheses, agrochemicals, nylon intermediates, gelating compounds, ore flotation and pharmaceutical intermediates.

5. Tariff classification: The product under consideration is classified under Chapter 28 of the Customs Tariff Act, 1975 under subheading 283711 of the Customs Tariff Classification. However, in the past, the PUC has also been imported under other sub-headings as well, such as 28371990, 28372090, 28372040, 28391100 and 28371910.

6. The parties to the investigation may provide their comments on the PUC and propose PCNs, if any, within 15 days of circulation of non-confidential version of the anti-dumping application.

B. LIKE ARTICLE

7. The applicants have stated that there are no significant differences in the article produced by the applicants and exported from the subject countries. The article produced by the applicants and imported from the subject countries are comparable in terms of physical and chemical characteristics, manufacturing process and technology, functions and uses, product specifications, pricing, distribution and marketing, and tariff classification of the subject goods. The subject goods and the article manufactured by the applicants are technically and commercially substitutable. The applicants have claimed that consumers of the subject goods are using the subject goods and the article manufactured by the applicants interchangeably. Thus, for the purposes of the present investigation, the article produced by the applicants has been considered as like article to the product being imported from China PR, EU, Japan and Korea RP.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] C. SUBJECT COUNTRIES

8. The application was originally filed in respect of the alleged dumping of the subject goods originating in or exported from China PR, Japan, and Korea RP. Thereafter, during the prima facie examination, the investigation team on the basis of the DGCI&S data ascertained that imports from Germany are also above de minimis limit and are entering into the domestic market at dumped prices. Hence the subject countries for the purpose of the present investigation are China PR, EU, Japan and Korea RP.

D. PERIOD OF INVESTIGATION (POI)

9. The period of investigation (hereinafter referred to as the POI) for the present investigation is 1st October 2021 – 30th September 2022 (12 months). Further, the injury investigation period has been proposed as 1st April 2019- 31st March 2020, 1st April 2020- 31st March 2021, 1st April 2021- 31st March 2022 and the POI.

E. DOMESTIC INDUSTRY AND STANDING

10. The application has been filed by Hindusthan Chemical Company and United Phosphorous Limited. As per the information provided by the applicants, they are only the producers of the like article in India.

11. The applicants had imported the subject goods in the base year and the year subsequent to it. However, none of the applicants has imported the subject goods in the POI or in the immediately previous year. Further, none of the applicants is related to any of the producer/exporters in the subject countries or any importers of the subject goods in India.

12. Therefore, the applicant domestic producers constitute domestic industry as defined under Rule 2(b) of the AD Rules, 1995 and the application satisfies the requirements of Rule 5(3) of the AD Rules, 1995.

F. BASIS OF ALLEGED DUMPING

13. Normal value I. China PR i. The applicants have submitted that China PR should be treated as a non-market economy, and that producers from China PR should be directed to demonstrate that market economy conditions prevail in the industry with regard to the production and sales of the subject goods. Unless the producers from China PR show that such market economy conditions prevail, their normal value should be determined in accordance with Para 7 of Annexure – I to the Anti-Dumping Rules, 1995.

ii. Therefore, the normal value has been constructed based on the estimates of cost of production of the applicants duly adjusted with selling, general and administrative expenses, along with a reasonable profit margin.

II. EU, Japan and Korea RP i. The applicants have claimed that the data relating to price in EU, Japan and Korea RP is not available in the public domain. It is also noted that the export price of the subject goods from third countries to other countries is also not available in the public domain.

ii. Therefore, for purpose of initiation, the normal value has been calculated based on the cost of production of the applicants duly adjusted with selling, general and administrative expenses, along with a reasonable profit margin. The Authority will further examine the evidence provided by the interested parties and the applicants for the determination of normal value during the investigation.

14. Export Price i. The export price for the subject goods has been computed based on the DGCI&S published import data submitted by the applicants with due adjustments for ocean freight, marine insurance, commission, inland freight, port expenses and bank charges to arrive at the net export price.

15. Dumping Margin i. The normal value and the export price have been compared at the ex-factory level, which prima facie establishes that the dumping margin is above the de-minimis level and is significant in respect of the product under consideration from the subject countries. Thus, there is sufficient prima facie evidence that the product under consideration from the subject countries is being dumped in the domestic market of India by the exporters from the subject countries.

G. INJURY AND CAUSAL LINK

16. The applicants have provided prima facie evidence with respect to the injury suffered by the domestic industry because of the dumped imports. The volume of the subject imports from the subject countries is significant in[भाग I—खण् ड 1] भारत का राजपत्र : असाधारण 7 absolute as well as relative terms. The price undercutting from the subject countries as a whole is positive and significant. The production of the domestic industry has declined. The capacity utilisation of the domestic industry has declined. The price suppression and depression caused by the dumped imports have been preventing the domestic industry from increasing its prices to recover the full cost and achieve reasonable rate of returns. The market share of the domestic industry is below the demand which it can cater. The subject imports have had an adverse impact on the profitability parameters of the domestic industry due to which the cash profits, PBIT, and ROCE have registered a very significant decline. There has also been a significant increase in the inventory levels of the domestic industry.

The productivity of applicants has moved in tandem with the changes in the production. The growth of the applicants have been negative in terms of volume as well as price parameters.

17. The import price of the subject imports has not increased in line with the increase in the cost of sales allowing continuous imports from the subject countries despite no demand and supply gap. The continuous low priced imports have not allowed the applicants to utilize its capacity to optimum level. Resultantly, the applicants are operating with idle capacities.

H. INITIATION OF ANTI-DUMPING INVESTIGATION

18. On the basis of the duly substantiated written application submitted by the applicants and having reached satisfaction based on the prima facie evidence submitted by the applicants concerning the dumping of the product under consideration originating in or exported from the subject countries, the consequential injury to the domestic industry as a result of the alleged dumping of the subject goods and the causal link between such injury and the dumped imports, and in accordance with Section 9A of the Act read with Rule 5 of the AD Rules, the Authority, hereby, initiates an anti-dumping investigation to determine the existence, degree and effect of the dumping with respect to the product under consideration originating in or exported from the subject countries and to recommend the appropriate amount of anti-dumping duty, which if levied, would be adequate to remove the injury to the domestic industry.

I. PROCEDURE

19. The principles as stipulated under Rule 6 of the AD Rules, 1995 shall be followed in the present investigation.

J. SUBMISSION OF INFORMATION

20. All communication should be sent to the Designated Authority via email at email addresses dd11- dgtr@gov.in and dd16-dgtr@gov.in with a copy to adg14-dgtr@gov.in and adv13-dgtr@gov.in. It must be ensured that the narrative part of the submission is in searchable PDF/MS-Word format and data files are in MS-Excel format.

21. The known producers/exporters in the subject countries, the Governments of the subject countries through their Embassies in India, the importers and users in India who are known to be associated with the subject goods are being informed separately to enable them to file all the relevant information within the time limits mentioned in this initiation notification. All such information must be filed in the form and manner as prescribed by this initiation

notification, the AD Rules, 1995 and the applicable trade notices issued by the Authority.

22. Any other interested party may also make submission relevant to the present investigation in the form and manner as prescribed by this initiation notification, the AD Rules, 1995 and the applicable trade notices issued by the Authority within the time limits mentioned in this initiation notification.

23. Any party making any confidential submission before the Authority is required to make a non-confidential version of the same available to the other interested parties.

24. Interested parties are further directed to keep regularly visit the official website of the Directorate General of Trade Remedies (https://www.dgtr.gov.in/) to stay updated and apprised with the information as well further processes related to the investigation.

K. TIME LIMIT

25. Any information relating to the present investigation should be sent to the Designated Authority via email at email address dd11-dgtr@gov.in and dd16-dgtr@gov.in with a copy to adg14-dgtr@gov.in and adv13-dgtr@gov.in within 30 days from the date on which the non-confidential version of the application filed by the domestic industry would be circulated by the Designated Authority or transmitted to the appropriate diplomatic representative of the exporting countries as per Rule 6(4) of the AD Rules. If no information is received within the stipulated time limit or the information received is incomplete, the Authority may record its findings based on the facts available on record and in accordance with the AD Rules, 1995.

26. All the interested parties are hereby advised to intimate their interest (including the nature of interest) in the instant matter and file their questionnaire responses within the above time limit as stipulated in this notification.8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1]

27. Where an interested party seeks additional time for filing of submissions, it must demonstrate sufficient cause for such extension in terms of Rule 6 (4) of the AD Rules, 1995 and such request must come within the time stipulated in this notification.

L. SUBMISSION OF INFORMATION ON CONFIDENTIAL BASIS

28. Where any party to the present investigation makes confidential submissions or provides information on a confidential basis before the Authority, it is required to simultaneously submit a non-confidential version of such information in terms of Rule 7(2) of the AD Rules and in accordance with the relevant trade notices issued by the Authority in this regard.

29. Such submissions must be clearly marked as ―confidential‖ or ―non-confidential‖ at the top of each page.

Any submission which has been made to the Authority without such markings shall be treated as ―non-confidential‖ information by the Authority, and the Authority shall be at liberty to allows other interested parties to inspect such submissions.

30. The non-confidential version of the information filed by the interested parties should essentially be a replica of the confidential version with the confidential information preferably indexed or blanked out (where indexation is not possible) and such information must be appropriately and adequately summarized depending upon the information on which confidentiality is claimed.

31. The non-confidential summary must be in sufficient detail to permit a reasonable understanding of the substance of the information furnished on confidential basis. However, in exceptional circumstances, the party submitting the confidential information may indicate that such information is not susceptible to summary, and a statement of reasons containing a sufficient and adequate explanation in terms of Rule 7 of the AD Rules, 1995 and appropriate trade notices issued by the Authority, as to why such summarization is not possible, must be provided to the satisfaction of the Authority.

32. The interested parties can offer their comments on the issues of confidentiality claimed by the domestic industry within 7 days of the receipt of the non-confidential version of the application.

33. Any submission made without a meaningful non-confidential version thereof or without a sufficient and adequate cause statement in terms of Rule 7 of the AD Rules, 1995 and appropriate trade notices issued by the Authority, on the confidentiality claim shall not be taken on record by the Authority.

M. INSPECTION OF PUBLIC FILE

34. A list of registered interested parties will be uploaded on the DGTR's website along with the request therein to all of them to email the non-confidential version of their submissions to all other interested parties.

N. NON-COOPERATION

35. In case any interested party refuses access to and otherwise does not provide necessary information within a reasonable period or within the time stipulated by the Authority in this initiation notification, or significantly impedes the investigation, the Authority may declare such interested party as non-cooperative and record its findings based on the facts available and make such recommendations to the Central Government as deemed fit.
