1. सजं क्षि नाम और प्रारंभ (1) इन जनयमों को जिकजसत भारत – रोिगार और आिीजिका गारंटी जमिन (ग्रामीण): िीबी- िी राम िी (जिकजसत भारत - िी राम िी) योिना के लेखापरीक्षा जनयम, 2026 कहा िाएगा।

(2) इन जनयमों के प्रयोिनाथग, योिनाओं की लेखापरीक्षा म ेंसामाजिक अंकेक्षण को भी सजममजलत दकया िाएगा।

(3) य ेजनयम रािपत्र म ेंप्रकािन की जतजथ स ेलाग ू होंगे।

2. पररभािाए ाँ – इन जनयमों म,ें िब तक संिभ गमें अन्यथा अपेजक्षत न हो: (क) “2005 का अजधजनयम” से अजभप्राय महात्मा गांधी राष्ट्रीय ग्रामीण रोिगार गारंटी अजधजनयम, 2005 ह।ै (ख) “अजधजनयम” स े अजभप्राय जिकजसत भारत – रोिगार और आिीजिका गारंटी जमिन (ग्रामीण): िीबी-िी राम िी (जिकजसत भारत - िी राम िी) अजधजनयम, 2025 ह।ै (ग) “मामला” से अजभप्राय सामाजिक अंकेक्षण प्रदक्रया के माध्यम से पहचानी गई दकसी भी प्रकार की अजनयजमतता, जिचलन, चूक, उल्लंघन, गबन, अनपु ालनहीनता, जिकायत अथिा कमी से ह,ै साथ ही जिनमें सुधारात्मक, िडं ात्मक या िसूली-संबंधी कारगिाई अपेजक्षत ह।ै (घ) “जनधागररत जडजिटल पोटगल” से अजभप्राय केंद्र सरकार या राज्य सरकार, यथाजस्ट्थजत, द्वारा उपलब्ध कराया गया िह आजधकाररक िेब-आधाररत मंच या एकीकृत जडजिटल प्रणाली है, जिसका उद्देश्य इन जनयमों के अंतगगत सामाजिक अंकेक्षण के जनष्किों, कारगिाई प्रजतिेिनों, िसूली, उच् च स्ट्तर पर प्रिे ण, सािगिजनक प्रकटीकरण तथा इन जनयमों के अधीन संबंजधत अजभलेखों के रखरखाि, प्रकटीकरण, प्रबंधन, अनश्रु िण और जनगरानी करना ह।ै (ङ) “जिला कायगक्रम समन्ियक” स े अजभप्राय राज्य सरकार का िह अजधकारी ह ै जिसे अजधजनयम की धारा 17 की उपधारा (1) के अतं गतग जिल ेम ेंइस योिना के कायागन्ियन हते ु नाजमत दकया गया ह।ै (च) “मध्यिती स्ट्तर” से अजभप्राय ग्राम और जिला स्ट्तरों के बीच का स्ट्तर ह ैिैसा दक भारत के संजिधान के अनुच्छेि 243 के खंड (ि) म ेंजनर्िगष्ट ह।ै (छ) “कायगक्रम अजधकारी” स े अजभप्राय अजधजनयम की धारा 18 की उपधारा (1) के अतं गतग जनयुि खण्ड स्ट्तर का अजधकारी ह।ै (ि) “राज्य पररिि” से अजभप्राय राज्य ग्रामीण रोिगार गारंटी पररिि है, िो इस अजधजनयम की धारा 13 की उपधारा (1) के अतं गतग गरित की गई ह।ै (झ) “सामाजिक अंकेक्षण ग्राम सभा” से अजभप्राय ग्राम सभा की िह जििेि बैिक ह ै िो इन जनयमों के अधीन सामाजिक अंकेक्षण करन े के उद्देश्य स े बुलाई िाती ह,ै जिसम ें अजभलेखों का सत्यापन, जनष्किों पर सािगिजनक चचाग, गिाजहयों की सुनिाई और की गई कारगिाई के प्रजतिेिनों की समीक्षा सजममजलत होती ह।ै (ञ) “सामाजिक अंकेक्षण इकाई” से अजभप्राय िह स्ट्ितंत्र संस्ट्थागत तंत्र ह ै जिसे राज्य सरकार द्वारा इस अजधजनयम के अंतगतग सामाजिक अंकेक्षण के सुगमीकरण, समन्िय तथा पयिग ेक्षण करने के जलए जनधागररत या स्ट्थाजपत दकया िाता है, जिसमें इसका िासी जनकाय, जनिेिक, अजधकारी, कमगचारी और राज्य, जिला, खण्ड तथा ग्राम स्ट्तर पर कायगरत संसाधन व्यजि सजममजलत ह,ैं िैसे – राज्य संसाधन व्यजि (एसआरपी), जिला संसाधन व्यजि (डीआरपी), खण्ड संसाधन व्यजि (बीआरपी) और ग्राम संसाधन व्यजि (िीआरपी)।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (ट) “कारगिाई प्रजतिेिन” या “ए टी आर ” से अजभप्राय िह जलजखत, जडजिटल और सत्यापन योग्य प्रजतिेिन ह ैजिसे कायगक्रम अजधकारी या जिला कायगक्रम समन्ियक, द्वारा प्रस्ट्तुत दकया िाता है, जिसमें सामाजिक अंकेक्षण के जनष्किों पर की गई या प्रस्ट्ताजित सुधारात्मक, िंडात्मक, िसूली-संबंधी या प्रिासजनक कारगिाइयों का ब्यौरा होता ह।ै (ि) “पयगिेक्षक” से अजभप्राय जिला कायगक्रम समन्ियक या उनके द्वारा नाजमत उपयुि पि के अजधकारी से है, िो सामाजिक अंकेक्षण ग्राम सभा में सजममजलत होकर इस कायगिाही का सुचारु, जनष्पक्ष और पारििी रूप से संपन्न होना सुजनजश्चत करता ह।ै

3. खातों की लेखापरीक्षा: (1) इस अजधजनयम के अतं गगत प्रत्यके जिल े की योिना के खातों तथा योिना के अंतगगत दकए गए सभी व्ययों की िार्िगक लेखापरीक्षा जनिेिक स्ट्थानीय जनजध लखे ा परीक्षा या समकक्ष प्राजधकारी अथिा भारत के जनयंत्रक एि ं महालेखा परीक्षक द्वारा अजधमानतः सूचीबद्ध सनिी लेखाकार द्वारा की िाएगी।

(2) जनिेिक स्ट्थानीय जनजध लखे ा परीक्षा या समकक्ष प्राजधकारी अथिा सनिी लेखाकार, यथाजस्ट्थजत, योिना के लेखों सजहत अंकेक्षण प्रजतिेिन राज्य सरकार को प्रस्ट्ततु करेगा।

(3) प्रत्येक राज्य सरकार की योिनाओं के खातों, प्रमाजणत अकं ेक्षण प्रजतिेिन सजहत, राज्य सरकार द्वारा भारत के जनयंत्रक एिं महालेखा परीक्षक तथा केंद्र सरकार को अग्रेजित दकए िाएंगे। केंद्र सरकार ऐसे अंकेक्षण प्रजतिेिनों के प्राि होने के पश्चात यथािीघ्र इसे संसि के िोनों सिनों के समक्ष प्रस्ट्तुत करेगी।

(4) भारत के जनयंत्रक एिं महालेखा परीक्षक या उनके द्वारा इस प्रयोिन हते ु जनयुि दकसी भी व्यजि को, योिनाओं के खातों की ऐसे अंतरालों पर अंकेक्षण करने का अजधकार होगा िसै ा उसे उपयुि प्रतीत हो। ऐसे अंकेक्षण का क्षेत्र एिं जिस्ट्तार, जिसमें अनुपूरक अंकेक्षण, अनुपालन अंकेक्षण, काय-ग जनष्पािन अंकेक्षण तथा सूचना प्रौद्योजगकी अंकेक्षण सजममजलत ह,ैं भारत के जनयंत्रक एि ंमहालखे ा परीक्षक द्वारा जनधागररत दकया िाएगा।

4. सामाजिक अकं ेक्षण इन योिनाओं की लेखापरीक्षा का जहस्ट्सा होगा: (1) राज्य सरकार इस अजधजनयम के अतं गतग जलए गए कायों का सामाजिक अंकेक्षण प्रत्येक ग्राम पंचायत म ें कम स े कम छह माह म ें एक बार, इन जनयमों म ें जनर्िष्टग तरीके स े आयोजित करेगी।

(2) जित्तीय िि ग के िौरान संपन्न ऐसी सामाजिक अंकेक्षणों के जनष्किों का सारांि, राज्य सरकार द्वारा भारत के जनयंत्रक एिं महालेखा परीक्षक को प्रस्ट्ततु दकया िाएगा।

5. सामाजिक अकं ेक्षण का सगु मीकरण: (1) राज्य सरकार, अजधजनयम के अतं गतग एक स्ट्ितंत्र सगं िन (जिस े इसके पश्चात सामाजिक अंकेक्षण इकाई कहा िाएगा) की पहचान करेगी या स्ट्थापना करेगी तादक ग्राम सभाओं द्वारा सामाजिक अंकेक्षण के संचालन म ें सहायता प्रिान कर सके। परंत ु यह दक इसके अजतररि , 2005 के अजधजनयम के अतं गगत स्ट्थाजपत कोई भी सामाजिक अंकेक्षण इकाई को इस अजधजनयम के प्रयोिनाथग िारी रख सकती ह।ै परंत ु यह भी ह ै दक, ऐसी सभी जिद्यमान सामाजिक अंकेक्षण इकाइयााँ, केंद्र सरकार द्वारा जनर्िगष्ट अिजध के भीतर, इन जनयमों, अजधजनयम और केंद्र सरकार द्वारा िारी दकसी भी जनिेि के अतं गतग जनधागररत संस्ट्थागत, प्रदक्रयात्मक, जडजिटल और प्रजतिेिन संबंधी अपेक्षाओं का पूण ग रूप से अनुपालन करेगी।

(2) सामाजिक अंकेक्षण इकाई जनम्नजलजखत कायों के जलए उत्तरिायी होगी, नामत: — (क) ग्राम सभाओं की क्षमता का जनमागण करना तादक िे सामाजिक अंकेक्षण कर सकें; और इस उद्देश्य की पूर्तग हते ,ु प्राथजमक जहतधारकों एिं लोगों के अजधकारों के जलए कायग करने का ज्ञान एिं अनुभि रखन े िाल ेअन्य नागररक समाि संगिनों से संसाधन व्यजियों की पहचान करना, उन्ह ेंप्रजिजक्षत करना और ग्राम, ब्लॉक, खंड तथा राज्य स्ट्तर पर जनयुि करना।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सामाजिक अंकेक्षण इकाई के जलए न्यूनतम कार्मगक मानिंड, जिनमें िैजक्षक एि ं अनुभि संबंधी योग्यताएाँ, चयन की प्रदक्रया तथा कायगकाल िाजमल ह,ैं अंकेक्षण मानकों और योिना दििा-जनिेिों के समग्र िायरे के अनरूु प होंगे। (ख) स्ट्थानीय व्यजियों की सामाजिक अंकेक्षक के रूप में पहचान एिं प्रजिक्षण करना; ; तथा प्रत्येक ग्राम पंचायत के जलए सामाजिक अंकेक्षण के संचालन हते ु ग्राम पंचायत के बाहर के व्यजियों को सजममजलत करत े हुए प्रजिजक्षत सामाजिक अंकेक्षक िलों का गिन करना, बित े ग्राम स्ट्तर के सामाजिक अंकेक्षकों में कम-स-े कम 25 प्रजतित अनुसूजचत िाजत/अनुसूजचत िनिाजत पररिारों से हों। ऐसे व्यजियों द्वारा प्रिान की गई सेिाओं के जलए उन्ह ें मानिेय दिया िाएगा, जिसकी िर अजधजनयम के प्रािधानों के अतं गतग कुिल श्रजमकों को िेय मििरू ी से कम नहीं होगी। (ग) सामाजिक अंकेक्षण की प्रदक्रया के जलए सामाजिक अंकेक्षण प्रजतिेिन प्रारूप, संसाधन सामग्री, दििा-जनििे तथा मागगिर्िगकाएाँ तैयार करना। (घ) श्रजमकों म ेंउनके अजधकारों और अजधजनयम के अंतगगत जिजधक गारंरटयों के प्रजत िागरूकता उत्पन्न करना। (ङ) प्राथजमक जहतधारकों और कायग स्ट्थलों के साथ अजभलेखों के सत्यापन की प्रदक्रया को सुगम बनाना। (च) सामाजिक अंकेक्षण ग्राम सभाओं के सुचारू संचालन, जनष्किों के िाचन तथा जिचार-जिमिग के उपरांत जनणगयों के अंजतमकरण को सुगम बनाना;

(छ) सामाजिक अंकेक्षण प्रजतिेिनों तथा कारगिाई प्रजतिेिनों को सािगिजनक डोमेन म ेंउपलब्ध कराना।

(3) सामाजिक अकं ेक्षण इकाई का िासी जनकाय — प्रत्येक सामाजिक अंकेक्षण इकाई का नते ृत्ि एक िासी जनकाय द्वारा दकया िाएगा, िो समय-समय पर इकाई के काय ग और कायग-जनष्पािन की िेखरेख करन े तथा आिश्यकता पड़न े पर इकाई को रणनीजतक मागगििनग , परामिग और दििा प्रिान करन े के जलए उत्तरिायी होगा।

(4) िासी जनकाय की सरं चना — िासी जनकाय म ेंन्यूनतम रूप से जनम्नजलजखत सिस्ट्य िाजमल होंगे, नामत: — (क) राज्य के प्रधान महालेखाकार इसके अध्यक्ष होंग;े (ख) ग्रामीण जिकास जिभाग या पंचायती राि के प्रधान सजचि;

(ग) सामाजिक अंकेक्षण इकाई के जनिेिक; (घ) नागररक समाि संगिनों, िैक्षजणक या प्रजिक्षण संस्ट्थानों के पााँच प्रजतजनजध होंग े जिनके पास पारिर्ितग ा, ििाबिेही और िनभागीिारी स ेसंबंजधत कायों का िीघगकाजलक अनुभि हो और इनम ेंसे कम स ेकम िो मजहलाएाँ होंगी;

(ङ) ऐस े अन्य जििेि आमंजत्रत सिस्ट्य, िो उन जिभागों स े हों िो अपन े कायगक्रमों म ें सामाजिक अंकेक्षण कर रह े हों, िैसा आिश्यक समझा िाए।

(5) सामाजिक अंकेक्षण इकाई का जनिेिक – सामाजिक अंकेक्षण इकाई के जनिेिक का चयन, जनयुजि, कायगकाल और सेिा की ितें केंद्र सरकार द्वारा जनर्िष्टग की िाएगं ी।

(6) संयोिक – सामाजिक अंकेक्षण इकाई का जनिेिक िासी जनकाय के संयोिक के रूप म ेंकायग करेगा ।

(7) स्ट्ितंत्रता के जलए प्रािधान – कायागन्ियन एिेंजसयों से सामाजिक अंकेक्षण इकाई की स्ट्ितत्रं ता सुजनजश्चत करने के जलए, ग्रामीण जिकास या पंचायती राि के प्रधान सजचि िासी जनकाय की अध्यक्षता नहीं करेंगे।

6. सामाजिक अकं ेक्षण की पूिपग ेक्षाएाँ - (1) सामाजिक अंकेक्षण एक ऐसी प्रदक्रया होगी िो योिना की कायागन्ियन एिेंसी द्वारा की िान े िाली दकसी भी प्रदक्रया स ेस्ट्ितंत्र होगी।

(2) कायागन्ियन एिेंसी दकसी भी समय सामाजिक अंकेक्षण के संचालन में हस्ट्तक्षेप नहीं करेगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5

(3) उप-जनयम (2) में जनजहत दकसी भी बात के बाििूि, योिना की कायागन्ियन एिेंसी आिश्यक िानकारी कायगक्रम अजधकारी को उपलब्ध कराएगी, तादक िह उसे सामाजिक अकं ेक्षण इकाई को सामाजिक अंकेक्षण प्रारंभ होने की जतजथ स े कम से कम पंद्रह दिन पूिग उपलब्ध कराया िा सके।

(4) दकसी पंचायत म ें सामाजिक अंकेक्षण के संचालन म ें सहायता हते ुतैनात दकए गए ससं ाधन व्यजि उसी पंचायत के जनिासी नहीं होंगे।

7. सामाजिक अकं ेक्षण की प्रदक्रया - (1) सामाजिक अंकेक्षण इकाई, िि ग के प्रारंभ म,ें प्रत्येक ग्राम पंचायत म ें एक िार्िगक कैलेंडर तैयार करेगी, जिसके अनुसार प्रत्येक ग्राम पंचायत म ें प्रत्येक छह माह म ें कम-स-े कम एक सामाजिक अंकेक्षण कराया िाएगा, तथा उि कैलडें र की प्रजत आिश्यक व्यिस्ट्थाए ाँ सुजनजश्चत करने हते ु सभी जिला कायक्रग म समन्ियकों को प्रेजित की िाएगी।

(2) सामाजिक लखे ापरीक्षा के जलए सत्यापन: ग्राम सभा द्वारा सामाजिक अंकेक्षण को सुगम बनाने के जलए, सामाजिक अंकेक्षण इकाई द्वारा तनै ात दकए गए संसाधन व्यजि, प्राथजमक जहतधारकों के साथ जमलकर, जनम्नजलजखत का सत्यापन करेंगे—

(i) मस्ट्टर रोल, जनर्िगष्ट अिजध के िौरान की गई प्रजिजष्टयााँ और दकए गए भगु तान, जिसमें उन श्रजमकों स े सत्यापन भी सजममजलत होगा जिनके नाम मस्ट्टर रोल म ेंअंदकत ह;ैं

(ii) काय ग स्ट्थल तथा अजभलेखों के संिभग म ें काय ग की मात्रा और साथ ही गणु ित्ता का मूल्यांकन

(iii) रोकड़ बही, बैंक जििरजणयों तथा अन्य जित्तीय अजभलेखों का परीक्षण तादक जित्तीय प्रजतिेिन की िुद्धता और जिश्वसनीयता का सत्यापन दकया िा सके;

(iv) सामग्री की खरीि स े संबंजधत इनिॉइस, जबल, िाउचर या अन्य संबंजधत अजभलेखों की िााँच करना, तादक यह प्रमाजणत दकया िा सके दक ऐसी खरीि प्राकलन के अनुसार, जनधागररत प्रदक्रया के अनुसार और जमतव्ययी थी;

(v) योिना जनजधयों स ेकायागन्ियन एिेंसी द्वारा दकए गए दकसी भी अन्य दकसी भी भुगतान ।

(3) िन भागीिारी और ग्राम सभा- पूणग भागीिारी सुजनजश्चत करने के जलए, श्रजमकों और ग्रामीण समुिाय को संसाधन व्यजियों के साथ-साथ कायगक्रम अजधकारी द्वारा सामाजिक अंकेक्षण आयोजित करन े िाली ग्राम सभा के संबंध म ें सूजचत दकया िाएगा।

(4) सामाजिक अंकेक्षण की प्रदक्रया के संचालन हते ु एक ग्राम सभा आयोजित की िाएगी, जिसम ें सत्यापन काय ग के जनष्किों पर चचा ग की िाएगी और पारिर्िगता एि ं ििाबिेही के अनुपालन, श्रजमकों की गारंरटयों की पूर्तगतथा जनजधयों के समुजचत उपयोग की समीक्षा की िाएगी।

(5) अजधजनयम के तहत योिनाओं के कायागन्ियन म ें िाजमल पंचायतों के सभी जनिागजचत सिस्ट्य और कमगचारी ग्राम सभा म ें उपजस्ट्थत रहगें े तथा प्रश्नों का उत्तर िगें े।

(6) ग्राम सभा सभी ग्रामीणों को कायागन्ियन स े संबंजधत सभी व्यजियों स े आिश्यक िानकारी प्राि करने तथा उनके प्रश्नों के उत्तर पान े का अिसर प्रिान करेगी। यह ऐसे दकसी भी व्यजि को भी एक मंच प्रिान करेगी जिसके पास योगिान िने े और प्रस्ट्तुत करन ेके जलए प्रासंजगक िानकारी हो।

(7) जिला कायगक्रम समन्ियक एक पयगिेक्षक के रूप म ें ग्राम सभा की बैिक म ें भाग लगें े या इस उद्देश्य के जलए उपयुि स्ट्तर के दकसी अजधकारी को नाजमत करेंगे, जिससे ग्राम सभा की कायगिाही का सुचारु एि ं पारििी संचालन सुजनजश्चत दकया िा सके।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(8) सामाजिक अंकेक्षण इकाई सामाजिक अंकेक्षण प्रजतिेिन स्ट्थानीय भािा म ें तैयार करेगी और यह सुजनजश्चत करेगी दक उसे ग्राम पंचायत के सूचना पट्ट पर प्रिर्िगत दकया िाए। सामाजिक अंकेक्षण के जनष्किों और उससे संबंजधत कारगिाई प्रजतिेिनों को जडजिटल रूप स े प्रिर्ितग दकया िाएगा तथा जनर्िगष्ट पोटगल पर खोि योग्य, मिीन पिनीय और डाउनलोड योग्य प्रारूप म ेंउपलब्ध कराया िाएगा।

(9) सामाजिक अंकेक्षण के जनष्किों के अनुसरण म ें प्रस्ट्तुत की गई सभी कारगिाई प्रजतिेिन (एटीआर) को उनकी पयागिता, पणू गता और संतोििनकता की समीक्षा के जलए मध्यिती-स्ट्तर पर आयोजित िन सुनिाई के समक्ष रखा िाएगा, िो कम-स-े कम प्रत्येक माह म ें एक बार आयोजित की िाएगी।

(10) जपछले सामाजिक अंकेक्षण के जनष्किों स े संबंजधत कारगिाई प्रजतिेिन तथा मध्यिती-स्ट्तर की िन सुनिाई के िौरान िि ग की गई रटप्पजणयों, यदि कोई हो, प्रत्येक सामाजिक अंकेक्षण ग्राम सभा की बिै क के प्रारंभ म ें पढकर सुनाई िाएाँगीऔर उन पर चचा ग की िाएगी।

(11) सामाजिक अंकेक्षण के संचालन की प्रदक्रया को जनर्िगष्ट जडजिटल पोटगल के माध्यम स े सगु म बनाया िाएगा।

8. सामाजिक अकं ेक्षणके सबं धं म ें कुछ व्यजियों का िाजयत्ि- (1) कायगक्रम अजधकारी यह सुजनजश्चत करेंग े दक सभी कायागन्ियन एिेंजसयों की सभी आिश्यक िानकारी और अजभलेख िैसे— ग्रामीण रोिगार गारंटी काडग रजिस्ट्टर, रोिगार रजिस्ट्टर, काय ग रजिस्ट्टर, ग्राम सभा का प्रस्ट्ताि, स्ट्िीकृजतयों (प्रिासजनक या तकनीकी या जित्तीय) की प्रजतयां, काय ग प्राक्कलन, काय ग प्रारंभ आििे , मस्ट्टर रोल िारी जनगगमन और प्राजि रजिस्ट्टर, मस्ट्टर रोल, मििरू ी भगु तान संजितरण ि आिेि, सामग्री के जबल और िाउचर (प्रत्येक काय ग के जलए), माप पुजस्ट्तकाए ं (प्रत्येक काय ग के जलए), पररसंपजत्त रजिस्ट्टर, पूिगिती सामाजिक अंकेक्षण पर की गई कारगिाई प्रजतिेिन, जिकायत रजिस्ट्टर, तथा कोई भी अन्य िस्ट्तािेि िो सामाजिक अंकेक्षण इकाई को सामाजिक अंकेक्षण प्रदक्रया के संचालन के जलए आिश्यक हों— िे जनधागररत प्रारूपों म ें समुजचत रूप स े संकजलत दकए िाए;ं उि अजभलेखों की प्रजतयों सजहत इन्ह ें सामाजिक अंकेक्षण ग्राम सभा की जनधागररत जतजथ स े कम-स-े कम पंद्रह दिन पूिग सामाजिक अंकेक्षण इकाई को उपलब्ध करा दिया िाए, तादक सामाजिक अंकेक्षण का सुचारु संचालन सुजनजश्चत दकया िा सके।

(2) उप-जनयम (1) म ें संिर्भगत िानकारी उसी समय सािगिजनक रूप स े उपलब्ध कराई िाएगी, और उसकी प्रजतयां नाममात्र िुल्क पर उपलब्ध की िाएंगी। पारिर्ितग ा, सुगम उपलब्धता और सािगिजनक िांच सुजनजश्चत करन े के जलए ऐस े सभी अजभलेखों को जनर्िगष्ट पोटगल के माध्यम स े खोि योग्य, मिीन - पिनीय और डाउनलोड योग्य प्रारूप म ें सािगिजनक डोमेन म ेंभी रखा िाएगा।

(3) प्रत्येक जिला कायगक्रम समन्ियक या उनकी ओर स ेकोई भी अजधकृत अजधकारी — (क) यह सुजनजश्चत करेंगे दक सामाजिक अंकेक्षण के संचालन के जलए सभी अजभलेख कायगक्रम अजधकारी के माध्यम स े कायागन्ियन एिेंजसयों द्वारा सामाजिक अंकेक्षण इकाई को उपलब्ध कराए िाए;ं (ख) यह सुजनजश्चत करेंगे दक सामाजिक अंकेक्षण प्रजतिेिन पर सुधारात्मक कारगिाई की िाए;

(ग) गबन की गई या अनुजचत रूप स े प्रयुि राजि की िसूली के जलए किम उिाएगं े और इस प्रकार िसूल की गई राजि के जलए रसीिें या पािजतयां िारी करेंगे; (घ) राजि की िसूली करेंग े और केंद्र सरकार के जहस्ट्स े को ितगमान सामान्य जित्तीय जनयमों तथा इस संबंध म ें केंद्र सरकार द्वारा िारी प्रासंजगक जनिेिों के अनुसार केंद्र सरकार को िमा कराएगा; और (ङ) राजि की िसूली करेंगे और राज्य सरकार के अंि को ितमग ान राज्य जित्तीय जनयमों तथा इस संबंध म ें िारी लाग ू जनिेिों के अनुसार राज्य सरकार को िमा कराएगा ।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (च) यह सुजनजश्चत करेंग े दक उस व्यजि या व्यजियों के िग ग या उन लोगों के जिरुद्ध उपयिु कारगिाई (जिसम ें आपराजधक और िीिानी कायगिाही िुरू करना या सेिाओं की समाजि िाजमल ह)ै िुरू की िाए, जिन्होंने इस अजधजनयम के तहत योिनाओं के जलए जनधागररत राजि का िरुु पयोग या गबन दकया ह।ै (छ) कारगिाई प्रजतिेिनों की लंजबत जस्ट्थजत की जनयजमत रूप स ेसमीक्षा करेंगे और आिश्यक कारगिाई करेंगे।

(4) राज्य सरकार सामाजिक अकं ेक्षण के जनष्किों पर अनुिती कारगिाई करने के जलए उत्तरिायी होगी।

(5) राज्य ग्रामीण रोिगार गारंटी पररिि, राज्य सरकार द्वारा की गई कारगिाई की जनगरानी करेगी और राज्य सरकार द्वारा राज्य जिधानमडं ल के समक्ष प्रस्ट्तुत की िाने िाली िार्िगक ररपोटग म ें कारगिाई प्रजतिेिन को िाजमल करेगी।

9. समय-सीमा के भीतर सधु ारात्मक कारगिाई और प्रकटीकरण- (1) सामाजिक अंकेक्षण इकाई यह सुजनजश्चत करेगी दक सामाजिक अंकेक्षण के जनष्किग, हस्ट्ताक्षररत संयुि प्रजतिेिन और ग्राम सभा की चचागओं के कायगिृत्त के साथ, सामाजिक अंकेक्षण ग्राम सभा की बैिक की जतजथ स ेसात दिनों के भीतर जनर्िगष्ट जडजिटल पोटगल पर अपलोड दकए िाए,ं और पोटगल के माध्यम स े उन पयगिेक्षकों, पंचायतों के जनिागजचत सिस्ट्यों और कायागन्ियन म ें िाजमल उन कमगचाररयों को उपलब्ध कराए िाए ं िो बैिक म ें उपजस्ट्थत थे।

(2) बैिक म ें उपजस्ट्थत रह े पयगिक्षे क, पंचायतों के जनिागजचत सिस्ट्य और योिनाओं के कायागन्ियन म ें िाजमल कमगचारी ऐसी अपलोडडगं की जतजथ स ेसात दिनों की अिजध के भीतर उसम ें दकसी भी त्रुरट, चूक या अिुजद्धयों को इंजगत कर सकेंगे। बित ें यह दक यदि उि अिजध के भीतर ऐसी कोई रटप्पजणयां प्राि नहीं होती ह,ैं तो अपलोड की गई ररपोटग को अंजतम माना िाएगा और अपलोड की जतजथ स े िस दिनों की अिजध पूण ग होने पर जनर्िष्टग जडजिटल पोटगल के माध्यम स े कायगक्रम अजधकारी को स्ट्िचाजलत रूप स ेअग्रेजित कर दिया िाएगा।

(3) सामाजिक अंकेक्षण के अंजतम जनष्किों को सामाजिक अंकेक्षण इकाई द्वारा सामाजिक अकं ेक्षण ग्राम सभा की बैिक की जतजथ स े इक्कीस दिनों के भीतर आग े की कारगिाई और कारगिाई प्रजतिेिन प्रस्ट्तुत करन े के जलए कायगक्रम अजधकारी को अग्रेजित दकया िाएगा।

(4) कायगक्रम अजधकारी आिश्यकतानुसार सुधारात्मक और िंडात्मक कारगिाई करेंग,े और जनष्किग प्राि होने की जतजथ स े तीस दिनों के भीतर सामाजिक अंकेक्षण इकाई को कारगिाई प्रजतिेिन प्रस्ट्तुत करेंगे। बितें यह दक यदि कायगक्रम अजधकारी तीस दिनों की उि अिजध के भीतर एटीआर प्रस्ट्तुत करने म ें जिफल रहते ह,ैं तो यह मामला जनर्िगष्ट जडजिटल पोटगल पर स्ट्ितः जिला कायगक्रम समन्ियक को अग्रेजित हो िाएगा, और जिला कायगक्रम समन्ियक आगामी तीस दिनों की अिजध के भीतर कारगिाई प्रजतिेिन एटीआर प्रस्ट्ततु करेंगे।

(5) सामाजिक अंकेक्षण इकाई को प्राि कारगिाई प्रजतिेिन, एटीआरकी प्राजि की जतजथ स े तीस दिनों के भीतर चचा ग के जलए अगली मध्यिती-स्ट्तरीय िन सुनिाई के समक्ष रखा िाएगा, और सामाजिक अंकेक्षण इकाई आग े की आिश्यक कारगिाई करेगी।

(6) सामाजिक अंकेक्षण इकाई, मध्यिती-स्ट्तरीय िन सुनिाई म ें जिजधित जिचार-जिमि ग के बाि, यथाजस्ट्थजत, कायगक्रम अजधकारी या जिला कायगक्रम समन्ियक द्वारा प्रस्ट्ततु कारगिाई प्रजतिेिन स े संतुष्ट होने पर दकसी मामले का जनस्ट्तारण कर सकती ह,ै और ऐसी जस्ट्थजत म ें िन सुनिाई की जतजथ स े पंद्रह दिनों के भीतर अपने जनणगय को अजभजलजखत करेगी।

(7) सभी मामलों म,ें जनष्किों, अनुिती कारगिाई, कारगिाई प्रजतिेिन की प्रस्ट्तुजत, उच्च स्ट्तर पर प्रिे ण, यदि कोई हो, िन सुनिाई समीक्षा और मामला जनस्ट्तारण करन े की सपं ूणग प्रदक्रया को सामाजिक अंकेक्षण ग्राम सभा की बैिक की जतजथ स े सात महीन े की अिजध के भीतर परू ा दकया िाएगा।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(8) सामाजिक अंकेक्षण के मामलों का एक जनजश्चत अनुपात अजनिाय ग रूप से तथा यािजृ च्छक आधार पर सामाजिक अंकेक्षण इकाई के खण्ड, जिला एि ं राज्य स्ट्तर के संसाधन व्यजियों द्वारा जनरीक्षण हते ु चयजनत दकया िाएगा।ऐस े जनरीक्षण का तरीका एि ं अनुपात केन्द्रीय सरकार अथिा राज्य सरकार, यथाजस्ट्थजत, द्वारा जिजनर्िगष्ट दकया िाएगा। सामाजिक अंकेक्षण इकाई, इस अजधजनयम के प्रािधानों के तहत दकए गए सामाजिक अंकेक्षण की गुणित्ता, सटीकता और सत्यजनष्ठा को सत्याजपत करने के जलए जनयजमत रूप स े परीक्षण अंकेक्षण और जििेि अंकेक्षण आयोजित करेगी।

(9) सामाजिक अंकेक्षण के जनष्किों की जस्ट्थजत और उस पर की गई कारगिाई को जनर्िगष्ट जडजिटल पोटगल के माध्यम स े सािगिजनक डोमेन म ेंउपलब्ध कराया िाएगा।

10. िसलू ी और ििाबिेही- (1) िरुु पयोग के रूप म ें जचजननत की गई सभी राजियां सामाजिक अंकेक्षण ग्राम सभा की जतजथ स े पांच महीने की अिजध के भीतर िसूल की िाएगं ी। राज्य सरकार िसूली प्रदक्रया को पूरा करना सुजनजश्चत करने और ऐसी िसूजलयों का जडजिटल रूप स े जमलान और सत्यापन योग्य अजभलेख बनाए रखने के जलए जिममेिार होगी।

(2) धोखाधड़ी, िरुु पयोग, या गंभीर जित्तीय अजनयजमतताओं के जलए जिममेिार पाए िाने िाले व्यजियों या जिक्रेताओं पर लाग ू कानूनों और जनयमों के अनुसार आिश्यक सुधारात्मक और िडं ात्मक कारगिाई की िाएगी।

11. साििग जनक प्रकटीकरण और पारिर्ितग ा — (1) एक सािगिजनक जडजिटल डैिबोडग पर उपयोगकताअग नुकूल, खोि योग्य और डाउनलोड योग्य प्रारूप म ेंजनम्नजलजखत िानकारी प्रिर्िगत की िाएगी, अथागत्: — (क) सामाजिक अंकेक्षण के जनष्किग और मामले;

(ख) सामाजिक अंकेक्षण ग्राम सभा की बैिकों का कायगिृत्त; (ग) यथाजस्ट्थजत, कायगक्रम अजधकारी या जिला कायगक्रम समन्ियक द्वारा प्रस्ट्तुत की गई कारगिाई प्रजतिेिन (एटीआर); (घ) प्रत्येक मामले के संबंध में की गई सधु ारात्मक और िडं ात्मक कारगिाई का जििरण;

(ङ) िरुु पयोग की गई राजियों की िसूली की जस्ट्थजत, यदि कोई हो; (च) जिकायतों, अपीलों और उनके जनस्ट्तारण की जस्ट्थजत; तथा (छ) कोई अन्य िानकारी, िैसा दक केंद्र सरकार द्वारा जनधागररत की िाए।

(2) राज्य सरकार यह सुजनजश्चत करने के जलए उत्तरिायी होगी दक उप-जनयम (1) म ें जनर्िगष्ट सभी िानकारी जनर्िष्टग जडजिटल पोटगल पर समयबद्ध और सटीक तरीके स े अपलोड, अद्यतन और संधाररत की िाए, और उि सूचनाओं तक िनता की जनरंतर पहुचं सक्षम करने के जलए ऐस ेप्रिासजनक और तकनीकी व्यिस्ट्थाए ाँ भी सुजनजश्चत करेगी िो आिश्यक हों।

(3) सुलभता सुजनजश्चत करन े के जलए सामाजिक अंकेक्षण इकाई स्ट्थानीय भािा म ें सामाजिक अंकेक्षण प्रजतिेिन तैयार करेगी। इसके अनुिादित संस्ट्करणों को मूल प्रजतिेिनों के साथ जनर्िगष्ट जडजिटल पोटगल पर प्रकाजित दकया िाएगा और इन्ह ें सािगिजनक प्रकटीकरण, नागररक सहभाजगता और सािगिजनक संिीक्षा के उद्देश्यों के जलए प्रामाजणक माना िाएगा।

(4) समुिाय की िानकारी के जलए और सतत िन-जनगरानी सुजनजश्चतकरने के जलए, सामाजिक अंकेक्षण के सभी जनष्किों और उनस े संबंजधत कारगिाई प्रजतिेिन' को ग्राम पंचायत, मध्यिती और जिला स्ट्तर पर सािाजहक सािगिजनक प्रकटीकरण बैिकों म ें चचा ग के जलए उपलब्ध कराया िाएगा।

(5) सामाजिक अंकेक्षण इकाई अपने द्वारा की िाने िाली सभी गजतजिजधयों का जडजिटल प्रकटीकरण सुजनजश्चत करेगी, जिसम ें अंकेक्षणों की जस्ट्थजत, कारगिाई प्रजतिेिनों (एटीआर) की लंजबत जस्ट्थजत और आरंभ की गई कारगिाइयां िाजमल ह।ैं सामाजिक अंकेक्षण इकाई जनर्िगष्ट जडजिटल पोटगल पर सामाजिक अंकेक्षण के संचालन, जनष्किों, अनुिती कारगिाइयों और[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 मामलों के जनस्ट्तारण संबंजधतसमेदकत त्रैमाजसक और िार्िगक प्रजतिेिन भी तैयार करेगी तथा उन्ह ें नाजमत जडजिटल पोटगल पर प्रकाजित करेगी।

(6) राज्य ग्रामीण रोिगार गारंटी पररिि, राज्य सरकार द्वारा की गई कारगिाई की जनगरानी करेगी और राज्य सरकार द्वारा राज्य जिधानमंडल के समक्ष रखी िान े िाली िार्िगक प्रजतिेिन म ें कारगिाई प्रजतिेिन को िाजमल करेगी। राज्य सरकार, राज्य जिधानमडं ल के समक्ष उि प्रजतिेिन रखे िाने के बाि, उसे सािगिजनक अजभगम एि ं परीक्षण हते ु जनर्िगष्ट जडजिटल पोटगल पर सािगिजनक डोमेन म ेंप्रकाजित करेगी।

12. सामाजिक अकं ेक्षण इकाई का जित्तपोिण- (1) सामाजिक अंकेक्षण इकाई की स्ट्थापना और सामाजिक अंकेक्षण के संचालन पर होने िाला व्यय, समय-समय पर िारी जनिेिों के अनुसार, अजधजनयम की धारा 22 म ें दिए गए प्रािधानों के तहत और 'जिकजसत भारत - रोिगार एि ं आिीजिका गारंटी जमिन (ग्रामीण): जिकजसत भारत -िी राम िी - प्रिासजनक व्यय जनयम, 2026' म ें जनर्िष्टग 'प्रिासजनक व्यय' के िीि ग के अतं गगत केंद्र सरकार द्वारा िहन दकया िाएगा।

(2) क्षमता जनमागण, प्रजिक्षण, क्षेत्रीय सत्यापन, िन-सुनिाई, प्रजतिेिन तैयार करना और प्रकटीकरण सजहत सामाजिक अंकेक्षण की गजतजिजधयों पर होने िाल े व्यय का प्रािधान प्रिासजनक और क्षमता जनमाणग लागत के अंि के रूप म ें दकया िाएगा, िो कुल व्यय के अजधकतम एक प्रजतित (1%) की सीमा के अध्यधीन होगा:

(2) of section 20 and clause (e) of section 24 and sub-section (1) of section 26 of the Viksit Bharat - Guarantee for Rozgar and Ajeevika Mission (Gramin): VB – G RAM G (विकवित भारत - जी राम जी) Act, 2025 (36 of 2025), on or after the date of coming into force of the Act, are hereby published for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of 30 days from the date on which copies of this notification as published in Official Gazette, are made available to the public;

DRAFT RULES

1. Short title and commencement. - (1) These rules may be called the Viksit Bharat - Guarantee for Rozgar and Ajeevika Mission (Gramin): VB- G RAM G (विकवित भारत – जी राम जी) Audit of Schemes Rules, 2026.

(2) For the purposes of these rules, the audit of schemes shall include social audit.

(3) They shall come into force on the date of their publication in the Official Gazette.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

2. Definitions. - In these rules, unless the context otherwise requires, -

(a) “Act of 2005” means the Mahatma Gandhi National Rural Employment Guarantee Act, 2005;

(b) “Act” means the Viksit Bharat – Guarantee for Rozgar and Ajeevika Mission (Gramin): VB-G RAM G (विकवितभारत - जीरामजी) Act, 2025;

(c) “case” means any instance of irregularity, deviation, omission, violation, misappropriation, non- compliance, grievance, or deficiency identified through the social audit process, including those requiring corrective, punitive, or recovery-related action;

(d) “designated digital portal” means the official web-based platform or integrated digital system

provided by the Central Government or the State Government, as the case may be, for the purposes of hosting, disclosing, managing, tracking, and monitoring social audit findings, Action Taken Reports, recoveries, escalations, public disclosures, and related records under these rules;

(e) “District Programme Coordinator” means an officer of the State Government designated as such officer under sub-section (1) of section 17 of the Act for the implementation of the Scheme in a district;

(f) “intermediate level” means a level between the village and district levels as specified under clause

(c) of Article 243 to the Constitution of India;

(g) “Programme Officer” means an officer at the Block level appointed under sub-section (1) of section 18 of the Act;

(h) “State Council” means the State GraminRozgar Guarantee Council constituted under sub-section (1) of section 13 of the Act;

(i) “Social Audit Gram Sabha” means a special meeting of the Gram Sabha convened for the purpose of conducting social audit under these rules, including verification of records, public discussion of findings, hearing of testimonies, and review of Action Taken Reports;

(j) “Social Audit Unit” means the independent institutional mechanism identified or established by the State Government under the Act for facilitating, coordinating, and overseeing social audits, and includes its Governing Body, Director, officers, staff, and resource persons at the State, district, block, and village levels, namely State Resource Persons (SRPs), District Resource Persons (DRPs), Block Resource Persons (BRPs), and Village Resource Persons (VRPs);

(k) “Action Taken Report” or “ATR” means a written, digital, and verifiable report submitted by the Programme Officer or the District Programme Coordinator, as the case may be, detailing the corrective, punitive, recovery-related, or administrative actions taken or proposed to be taken on the findings of a social audit;

(l) “Observer” means the District Programme Coordinator or an officer of appropriate rank nominated by him for the purpose of attending the Social Audit Gram Sabha to ensure the smooth, fair, and transparent conduct of the proceedings.

3. Audit of accounts.- (1) The audit of the accounts of a scheme under the Act for each district, as well as all expenditure under the Scheme, shall, for each year, be carried out by the Director, Local Fund Audit, or equivalent authority or by Chartered Accountants, preferably empanelled with the Comptroller and Auditor General of India.

(2) The Director, Local Fund Audit, or equivalent authority, or the Chartered Accountant, as the case may be, shall submit accounts of the scheme together with the audit report thereon to the State Government.

(3) The accounts of the schemes of every State Government, as certified together with the audit report thereon shall be forwarded to the Comptroller and Auditor General of India and the Central Government by the State Government. The Central Government shall cause the audit report to be laid, as soon as may be after they are received, before each House of Parliament.

(4) The Comptroller and Auditor General of India, or any person appointed by him in this behalf, shall have the right to conduct audit of the accounts of schemes at such intervals as he may deem fit.

The scope and extent of such audit, including supplementary audit of accounts, compliance audit, performance audit, and information technology audit, shall be determined by the Comptroller and Auditor General of India.

4. Social audit to be part of audit of schemes.-(1) The State Government shall facilitate conduct of social audit of the works taken up under the Act in every Gram Panchayat at least once in six months in the manner prescribed under these rules.

(2) A summary of findings of such social audits conducted during a financial year shall be submitted by the State Government to the Comptroller and Auditor General of India.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11

5. Social audit facilitation.-(1) The State Government shall identify or establish, under the Act, an independent organisation (hereinafter referred to as the Social Audit Unit) to facilitate the conduct of social audit by Gram Sabhas.

Provided that any Social Audit Unit established under the Act of 2005 may be continued for the purposes of this Act.

Provided further that all such existing Social Audit Units shall, within such period as may be specified by the Central Government, transition to and fully comply with the institutional, procedural, digital, and reporting requirements prescribed under these rules, the Act, and any instructions issued by the Central Government thereunder.

(2) The Social Audit Unit shall be responsible for the following, namely: —

(a) build capacities of Gram Sabhas for conducting social audit; and towards this purpose, identify, train and deploy suitable resource persons at village, block, district and State level, drawing from primary stakeholders and other civil society organisations having knowledge and experience of working for the rights of the people. The minimum staffing norms for the Social Audit Unit, including education and experience qualifications, mode of selection, and tenure shall be within the overall ambit of Auditing Standards and Scheme guidelines.

(b) identification, training of local people as social auditors; and formation of trained social auditor teams for each Gram Panchayat with people from outside the Gram Panchayat to conduct social audit, provided that at least 25% of village social auditors are from SC/ST households. For services rendered by such people, each of them shall be paid an honorarium at a rate not less than the remuneration payable to the skilled labour under the provisions of the Act.

(c) prepare social audit reporting formats, resource material, guidelines and manuals for the social audit process;

(d) create awareness amongst the labourers about their rights and legal guarantees under the Act;

(e) facilitate verification of records with primary stakeholders and work sites;

(f) facilitate smooth conduct of social audit Gram Sabhas for reading out and finalising decisions after due discussions;

(g) host the social audit reports, including action taken reports, in the public domain.

(3) Governing Body of the Social Audit Unit. — Every Social Audit Unit shall be headed by a Governing Body, which shall be responsible for overseeing the functioning and performance of the Unit on a periodic basis and for providing strategic guidance, advice and direction to the Unit, as and when required.

(4) Composition of the Governing Body. —The Governing Body shall, at a minimum, consist of the following members, namely: —

(a) the Principal Accountant General (Audit) of the State shall be the Chairperson;

(b) the Principal Secretary, Department of Rural Development or Panchayati Raj;

(c) the Director, Social Audit Unit;

(d) five representatives from civil society organisations, academic or training institutions, having long- standing experience in issues relating to transparency, accountability, and people’s participation, of whom at least two shall be women;

(e) such other special invitees from Departments undertaking social audits in their programmes, as may be considered necessary.

(5) Director of the Social Audit Unit – The selection, appointment, tenure, and terms and conditions of service of the Director of the Social Audit Unit shall be such as may be specified by the Central Government.

(6) Convener. —The Director, Social Audit Unit shall act as the Convener of the Governing Body.

(7) Safeguards for independence. — The Principal Secretary, Department of Rural Development or Panchayati Raj shall not chair the Governing Body, in order to ensure the independence of the Social Audit Unit from the implementing agencies.

6. Social audit pre-requisites.-(1) The Social Audit shall be a process independent of any process undertaken by the implementing agency of the scheme.

(2) The implementing agency shall at no time interfere with the conduct of the social audit.

(3) Notwithstanding anything contained in sub-rule (2), the implementing agency of the Scheme shall provide the requisite information to the Programme Officer for making it available to the Social Audit Unit at least fifteen days prior to the date of commencement of the social audit.12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(4) The resource persons deployed for facilitating social audit in a Panchayat shall not be residents of the same Panchayat.

7. Process for Conducting Social Audit. - (1) The Social Audit Unit shall, at the beginning of the year, frame an annual calendar to conduct at least one social audit in each Gram Panchayat every six months, and a copy of the calendar shall be sent to all the District Programme Coordinators for making necessary arrangements.

(2) Verification for Social Audit: For facilitating the conduct of social audit by the Gram Sabha, the resource persons deployed by the Social Audit Unit, along with primary stakeholders, shall undertake verification of—

(i) muster rolls, entries and payments made during the specified period, including verification with wage seekers whose names appear on the muster rolls;

(ii) the work site and assess the quantity with reference to records and also quality of work done;

(iii) the cash book, bank statements and other financial records to verify the correctness and reliability of financial reporting;

(iv) the invoices, bills, vouchers, or other related records used for procurement of materials to testify that such procurement was as per the estimate, as per the procedure laid down and was economical;

(v) any other payments made by the implementing agency from funds of the Scheme.

(3) Public Participation and Gram Sabha- The labourers and the village community shall be informed about the Gram Sabha conducting social audit by the resource persons as well as the Programme Officer, to ensure full participation.

(4) To conduct the social audit process, a Gram Sabha shall be convened to discuss the findings of the verification exercise and also to review the compliance with transparency and accountability, fulfilment of the guarantees of labourers and proper utilization of funds.

(5) All elected members of Panchayats and staff involved in implementing the schemes under the Act shall be present at the Gram Sabha and respond to queries.

(6) The Gram Sabha shall provide a platform to all villagers to seek and obtain further information and responses from all involved in the implementation. It will also provide a platform to any person who has any contribution to make and relevant information to present.

(7) The District Programme Coordinator shall attend the Gram Sabha meeting as an observer or nominate an official of appropriate level to do so, for ensuring the smooth and transparent conduct of the Gram Sabha.

(8) The Social Audit Unit shall prepare the social audit reports in the local language and ensure that the same are displayed on the notice board of the Gram Panchayat. The findings of the social audit and the corresponding Action Taken Reports shall be digitally displayed and made available on the designated portal in a searchable, machine-readable, and downloadable format.

(9) All Action Taken Reports (ATRs) submitted pursuant to social audit findings shall be placed before a public hearing at the intermediate-level, to be convened at least once every month, for review of their adequacy, completeness, and satisfactory nature.

(10) The Action Taken Report (ATR) relating to the findings of the previous social audit, along with the remarks, if any, recorded during the intermediate-level public hearing, shall be read out and discussed at the beginning of the meeting of each Social Audit Gram Sabha.

(11) The process of conducting Social Audit shall be facilitated through the designated digital portal.

8. Obligation of certain persons in relation to social audit.- (1) The Programme Officer shall ensure that all the required information and records of all implementing agencies such as, GraminRozgar Guarantee Card register, Employment register, work Register, Gram Sabha Resolution, Copies of the sanctions (Administrative or Technical or Financial), Work Estimate, Work Commencement Order, Muster-roll issue and receipt register, muster Rolls, wage Payment Acquittance& order, Materials – Bills and vouchers (for each work), Measurement Books (for each work), Asset Register, Action Taken Report on previous social audits, grievance or complaints register, any other documents that the Social Audit Unit requires to conduct the social audit process are properly collated in the requisite formats;

and provided, along with photocopies, to the Social Audit Unit for facilitating conduct of social audit at least fifteen days in advance of the scheduled date of meeting of the Gram Sabha conducting social audit.

(2) The information referred to in sub-rule (1) shall be made publicly available at the same time, and photocopies thereof shall be provided at a nominal cost. All such records shall also be placed in the public domain through the designated portal in a searchable, machine-readable, and downloadable format to ensure transparency, accessibility, and public scrutiny.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 13

(3) Every District Programme Coordinator or any official on his behalf, shall, —

(a) ensure that all records for the conduct of social audit are furnished to the Social Audit Unit by implementing agencies through the Programme Officer;

(b) ensure that corrective action is taken on the social audit report;

(c) take steps to recover the amount embezzled or improperly utilised and issue receipts or acknowledgements for amounts so recovered;

(d) recover the amount and remit the Central Government’s share to the Central Government in accordance with the extant General Financial Rules and the relevant instructions issued in this regard by the Central Government;

and

(e) recover the amount and remit the State Government’s share to the State Government in accordance with the extant State Financial Rules and the applicable instructions issued in this regard.

(f) ensure that appropriate action (including initiating criminal and civil proceedings or termination of services) is initiated against the individual or class of individuals or persons who misutilised or embezzled the amount meant for the schemes under the Act.

(g) review the pendency of ATR regularly and take necessary action.

(4) The State Government shall be responsible to take follow-up action on the findings of the social audit.

(5) The State GraminRozgar Guarantee Council shall monitor the action taken by the State Government and incorporate the Action Taken Report in the annual report to be laid before the State Legislature by the State Government.

9. Time-bound Corrective Action and Disclosure.— (1) The Social Audit Unit shall ensure that the findings of the social audit, along with the signed joint report and the minutes of the Gram Sabha discussions, are uploaded on the designated digital portal within seven days from the date of the Social Audit Gram Sabha meeting, and are made available through the portal to the Observer, elected members of the Panchayats, and staff involved in implementation who were present at the meeting.

(2) The Observer, elected members of the Panchayats, and staff involved in the implementation of the schemes who were present at the meeting shall have a period of seven days from the date of such upload to point out any errors, omissions, or inaccuracies therein.

Provided that where no such observations are received within the said period, the uploaded report shall be deemed to be final and shall be automatically forwarded to the Programme Officer through the designated digital portal at the end of ten days from the date of upload.

(3) The finalised findings of the social audit shall be forwarded by the Social Audit Unit to the Programme Officer within twenty-one days from the date of the Social Audit Gram Sabha meeting for further action and for submission of the Action Taken Report.

(4) The Programme Officer shall take necessary corrective and punitive action, as applicable, and shall submit the Action Taken Report to the Social Audit Unit within thirty days from the date of receipt of the findings.

Provided that where the Programme Officer fails to submit the ATR within the said period of thirty days, the matter shall stand automatically escalated to the District Programme Coordinator on the designated digital portal, and the District Programme Coordinator shall submit the ATR within a further period of thirty days.

(5) The Action Taken Reports so submitted to the Social Audit Unit shall be placed for discussion before the next intermediate-level public hearing within thirty days from the date of receipt of the ATR, and the Social Audit Unit shall take further necessary action.

(6) The Social Audit Unit may close a case upon being satisfied with the Action Taken Report (ATR) submitted by the Programme Officer or the District Programme Coordinator, as the case may be, after due discussion of the same in the intermediate-level public hearing, and shall record its decision within fifteen days from the date of such public hearing.

(7) In all cases, the entire process of findings, follow-up action, submission of the Action Taken Report

(ATR), escalation, if any, public hearing review, and closure shall be completed within a period of seven months from the date of the Social Audit Gram Sabha meeting.

(8) A fixed proportion of the social audit cases shall be mandatorily and randomly selected for inspection by the Block, District, and State-level resource persons of the Social Audit Unit, in such manner and proportion as may be specified by the Central Government or the State Government, as the case may be. The Social Audit Unit shall regularly conduct test audits and special audits to verify the quality, accuracy, and integrity of social audits conducted under the provisions of the Act.14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(9) The status of the social audit findings and the action taken thereon shall be made available in the public domain through the designated digital portal.

10. Recovery and Accountability. - (1) All amounts identified as misappropriated shall be recovered within a period of five months from the date of the Social Audit Gram Sabha. The State Government shall be responsible for ensuring completion of the recovery process and for maintaining digitally reconciled and verifiable records of such recoveries.

(2) Individuals or vendors found responsible for fraud, misappropriation, or serious financial irregularities shall be subject to necessary corrective and punitive action in accordance with applicable laws and rules.

11. Public Disclosure and Transparency. — (1) A public-facing digital dashboard shall display, in a user-friendly, searchable, and downloadable format, the following information, namely: —

(a) social audit findings and cases;

(b) minutes of the Social Audit Gram Sabha meetings;

(c) Action Taken Reports (ATRs) submitted by the Programme Officer or the District Programme Coordinator, as the case may be;

(d) details of corrective and punitive action taken in respect of each case;

(e) recovery status of misappropriated amounts, if any;

(f) status of grievances, appeals, and their disposal; and

(g) any other information as may be determined by the Central Government.

(2) The State Government shall be responsible for ensuring that all information referred to in sub-rule (1) is uploaded, updated, and maintained on the designated digital portal in a timely and accurate manner, and for taking such administrative and technical measures as may be necessary to enable continuous public access thereto.

(3) The Social Audit Unit shall prepare the social audit report in the local language to ensure accessibility.

The translated versions thereof shall be published on the designated digital portal alongside the original reports and shall be treated as authentic for the purposes of public disclosure, citizen engagement, and public scrutiny.

(4) All social audit findings and the corresponding Action Taken Reports (ATRs) shall be made available for discussion in weekly public disclosure meetings at the Gram Panchayat, intermediate, and District level, for the information of the community and to enable continuous public oversight.

(5) The Social Audit Unit shall ensure digital disclosure of all activities undertaken by it, including the status of audits, pendency of Action Taken Reports (ATRs), and actions initiated. The Social Audit Unit shall also prepare and publish consolidated quarterly and annual reports on the conduct of social audits, findings, follow-up actions, and case closures on the designated digital portal.

(6) The State Gramin Rozgar Guarantee Council shall monitor the action taken by the State Government and incorporate the Action Taken Report in the annual report to be laid before the State Legislature by the State Government. The State Government shall, after the laying of such report before the State Legislature, publish the same in the public domain on the designated digital portal for public access and scrutiny.

12. Funding of Social Audit Unit. - (1) The expenditure towards the establishment of the Social Audit Unit and the conduct of social audits shall be borne by the Central Government, in accordance with the instructions issued from time to time, under the head of Administrative Expenses as provided in Section 22 of the Act and as specified in the Viksit Bharat – Guarantee for Rozgar and Ajeevika Mission (Gramin): VB-G RAM G (विकवित भारत - जी राम जी) - Administrative Expenses Rules, 2026

(2) Expenditure on social audit activities, including capacity-building, training, field verification, public hearings, reporting, and disclosure, shall be provided for as part of administrative and capacity-building costs, subject to a ceiling not exceeding one per cent (1%) of the total expenditure:
