L.-33004/99 सी.जी.-के.ए.-अ.-01112025-267315 xxxGIDHxxx CG-KA-E-01112025-267315 xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 698] नई दद्ली, बहृ स्ट् पजतवार, अक्त ूबर 30, 2025/ कार्तकक 8, 1947 No. 698] NEW DELHI, THURSDAY, OCTOBER 30, 2025/ KARTIKA 8, 1947 केनरा बकैं (मानव ससं ाधन व िन सपं कक जवभाग) (प्रधान कार्ाला र्) अजधसचू ना बेंगलरुू , 30 अक् तूबर, 2025 फा. स.ं एचआरएडं पीआरडब्ल्य ू आईआरवी आईआरएंडपीएस 228ए पीपी 1543 2025 (ई).—बकैं कंग कंपनी (उपक्रमों का अिकन और अंतरण) अजधजनयम, 1970 (1970 का 5) की धारा 19 की उपधारा (2) के खंड (एफ) द्वारा प्रदत्त िजियों का प्रयोग करत े हुए, केनरा बैंक के जनदेिक मडं ल ने भारतीय ररज़वक बैंक से परामिक के बाद और भारत सरकार, जवत्त मंत्रालय, जवत्तीय सेवाएँ जवभाग के पत्र सं. 4/2/1/2022-IR ददनांक 13 माचक, 2024 की पूवाकनुमजत स,े 1 नवम्बर, 2022 से लेकर इस अजधसूचना के रािपत्र म ें प्रकािन की जतजि तक भारत सरकार के अनुसरण में की गई या न की गई बातों के संबंध में, जनम्नजलजखत जवजनयम बनाता है, िो केनरा बैंक (कमकचाररयों का) पेंिन जवजनयम, 1995 में संिोधन करने हते ु ह;ैं अिाकत्: –
1. (1) इन जवजनयमों को केनरा बकैं (कमकचारी) पेंिन (संिोधन) जवजनयम, 2025 कहा िाएगा। 7224 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
(2) य े जवजनयम रािपत्र म ेंप्रकािन की जतजि स े प्रभावी होंगे।
2. केनरा बैंक (कमकचारी) पेंिन जवजनयम, 1995 (जिसे आग ेउि जवजनयम कहा िाएगा) म,ें जवजनयम 2 म,ें खंड (डब्ल्य)ू के बाद जनम्नजलजखत खडं िोडा िाएगा, अिाकत:् - “(डब्ल्यूए) 'त्यागपत्र देने वाला पूवक कमकचारी' स ेतात्पयक ऐसे कमकचारी होगा, िो -
(a) 1 िनवरी, 1986 को या उसके बाद बैंक की सेवा म ेंिा;
(b) 1 अप्रैल, 2010 से पूवक बैंक म ेंिाजमल हुआ िा;
(c) 26 अप्रैल, 2010 को या उससे पूवक बैंक की सेवाओं स े त्यागपत्र दे चकु ा हो ; और
(d) अन्यिा बैंक की सेवा म ेंरहते हुए पेंिन योिना म ें िाजमल होन े के जलए पात्र िा।"
3. उि जवजनयमों के जवजनयम 3 म,ें उप-जवजनयम (14) के बाद जनम्नजलजखत को िोडा िाएगा, अिाकत्:- ““(15) वह कमकचारी, िो जवजनयम 2 के खंड (डब्ल्यूए) म ें पररभाजित ‘त्यागपत्र देने वाला पूव क कमचक ारी’ की पररभािा को पूरा करता ह ै और जिसन े बैंक को वह सम्पणू क भजवष्य जनजध में बकैं का अिं दान (उस पर सजं चत ब्लयाि सजहत), िो उसे इस्ट्तीफा देने के समय या बाद में प्राप्त हुआ िा, वापस करने पर सहमजत दी ह,ै तिा बैंक द्वारा जनधाकररत प्रारूप में, बैंक द्वारा जनर्दकष्ट समय के भीतर एक वचनबधं ददया ह।ै ”
4. उक्त विवियम ोंके विवियम 22 में, उप-विवियम (1) में, विम्नविखित परोंतुक क ज ड़ा ज़ाएग़ा, अऱ्ाात्:- “यह उपबंजधत दकया िाता ह ै दक यदद कोई ‘त्यागपत्र देने वाला पूवक कमकचारी’, िैसा दक जवजनयम 2 के खंड (डब्ल्यूए) में पररभाजित ह ै और िो जवजनयम 3 के उपजवजनयम (15) में जनजहत ितों को पूरा करता है, तो उसका त्यागपत्र उसकी पूव क सवे ा के िब्लती का कारण नहीं बनेगा।”
5. उि जवजनयमों के जवजनयम 29 म,ें -
(i) उप-जवजनयम (1) में, तृतीय परंतुक के पश्चात,् जनम्नजलजखत परंतुक िोडा िाएगा, अिाकत:् - “यह भी उपबंजधत दकया िाता ह ै दक ‘त्यागपत्र देने वाला पूवक कमकचारी’, िैसा दक जवजनयम 2 के खंड (डब्ल्यूए) म ें पररभाजित ह ै और िो जवजनयम 3 के उपजवजनयम (15) म ें उज्लजखत ितों का पालन करता है, वह भी पेंिन का हकदार होगा, यदद उसने आवश्यक सेवा अवजध परू ी की हो।”
(ii) उप-जवजनयम (5) में, जनम्नजलजखत परंतुक िोडा िाएगा, अिाकत:् - “यह उपबंजधत दकया िाता ह ै दक जवजनयम 2 के खंड (डब्ल्यूए) में पररभाजित ‘त्यागपत्र दने े वाला पूवक कमकचारी’ ऐसी सेवा अवजध की वृजि के लाभ के जलए पात्र नहीं होगा।”
6. उि जवजनयमों के जवजनयम 36 म,ें खंड (िी) के बाद जनम्नजलजखत खंड को िोडा िाएगा, अिाकत्:- “(एच) पाँच हज़ार पचहत्तर रुपये प्रजतमाह ऐसे कमकचारी के संबंध में िो 1 नवम्बर, 2022 या उसके बाद सेवाजनवृत्त हुआ हो (आंजिक समय कमकचारी को छोडकर); एक-जतहाई वेतनमान पर काय क करन े वाल े अंिकाजलक[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 कमकचारी के जलए 1,700 रुपय े प्रजतमाह; आध े वेतनमान पर कायक करने वाल े अिं काजलक कमकचारी के जलए 2,547 रुपय ेप्रजतमाह; और तीन-चौिाई वेतनमान पर कायक करन ेवाल ेअिं काजलक कमकचारी के जलए 3,820 रुपय ेप्रजतमाह, बिते दक अिं काजलक कमकचारी ने 1 नवम्बर, 2022 या उसके बाद सेवाजनवृत्त हुआ हो।”
7. उि जवजनयमों के जवजनयम 39 म,ें उप-जवजनयम (1) म,ें खंड (सी) म,ें परंतुक के बाद जनम्नजलजखत परंतुक को िोडा िाएगा, अिाकत:् - “यह भी उपबंजधत दकया िाता ह ैदक यदद कोई ‘त्यागपत्र दने े वाला पूव क कमकचारी’, िैसा दक जवजनयम 2 के खंड (डब्ल्यूए) में पररभाजित ह,ै जिसकी मृत्यु हो गई ह,ै तो उसके पररवार को पाररवाररक पिें न के जलए पात्र होगा, बित े दक उि कमकचारी ने जवजनयम 29 के उपजवजनयम (1) के अंतगकत आवश्यक सेवा अवजध पूरी की हो और (मृत्य ु स े पूवक) उसने या उसके पररवार के दकसी सदस्ट्य ने बैंक को भजवष्य जनजध में बैंक का संपूणक अंिदान (सजं चत ब्लयाि सजहत), िो त्यागपत्र देते समय या बाद में प्राप्त हुआ िा, वापस करने पर सहमजत दी हो और बैंक द्वारा जनधाकररत प्रारूप म ेंवचनबंध दी हो।”
8. उि जवजनयमों के जवजनयम 40 के उप-जवजनयम (1) म,ें –
(i) खंड (बी) म,ें प्रिम परंतुक के स्ट्िान पर जनम्नजलजखत प्रजतस्ट्िाजपत दकया िाएगा अिाकत्: – “यह उपबंजधत दकया िाता ह ै दक यदद पुत्र या पुत्री (जिसमें जवधवा या तलाकिुदा पुत्री िाजमल ह)ै सरकारी या जनिी क्षेत्र की नौकरी या स्ट्वरोिगार से 18,000 रुपये प्रजतमाह से अजधक अर्िकत करने लगत े ह,ैं तो उन्ह ेंपाररवाररक पेंिन दये नहीं होगी।”
(ii) खंड (सी) के स्ट्िान पर जनम्नजलजखत खडं प्रजतस्ट्िाजपत दकया िाएगा, अिाकत्: – “(सी) माता-जपता के मामले में, यदद माता-जपता म ें स े दकसी एक की या दोनों की संयिु आय सरकारी या जनिी क्षेत्र की नौकरी या स्ट्वरोिगार आदद स े 18,000 रुपय े प्रजतमाह से अजधक हो िाती है, तो पाररवाररक पेंिन देय नहीं होगी।”
9. उि जवजनयमों के जवजनयम 41 म,ें उप-जवजनयम (1) म,ें परंतुक के बाद जनम्नजलजखत परंतुक को िोडा िाएगा, अिाकत:्- “यह भी उपबंजधत दकया िाता ह ैदक ‘त्यागपत्र देन ेवाला पूवक कमकचारी’, िैसा दक जवजनयम 2 के खंड (डब्ल्यूए) में पररभाजित ह ै और िो जवजनयम 3 के उपजवजनयम (15) की ितों का पालन करता ह,ै अपनी पेंिन का संरािीकरण प्राप्त करन े के जलए पात्र नहीं होगा।”
10. जवजनयम 55 म,ें “अध्यक्ष एव ंप्रबंध जनदेिक” िब्लदों के स्ट्िान पर “प्रबंध जनदेिक एव ंमुख्य कायककारी अजधकारी” िब्लद प्रजतस्ट्िाजपत दकए िाएंगे।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
11. उि जवजनयमों म,ें पररजिष्ट–II के स्ट्िान पर जनम्नजलजखत पररजिष्ट प्रजतस्ट्िाजपत दकया िाएगा; अिाकत्:– “पररजिष्ट-II” (जवजनयम 37 देख)ें मूल पेंिन पर महगं ाई राहत इस प्रकार होगी:
(1) उन कमकचाररयों के मामले म ेंिो कामगार संवगक म ेंि ेऔर िो 1 िनवरी, 1986 को या उसके बाद, लेदकन 1 नवंबर, 1992 स े पहले सेवाजनवृत्त हुए ि,े और उन कमकचाररयों के मामले म,ें िो अजधकारी संवगक म ें ि े और िो 1 िनवरी, 1986 को या उसके बाद, लेदकन 1 िलु ाई, 1993 स ेपहले सवे ाजनवृत्त हुए ि,े महगं ाई राहत, 1960 = 100 श्ृंखला म ें औद्योजगक श्जमकों के जलए अजखल भारतीय औसत उपभोिा मू्य सूचकांक के त्रैमाजसक औसत म ें 600 अंकों स े अजधक प्रत्येक 4 अंकों की प्रत्यके वृजि या जगरावट (िैसा भी मामला हो) के जलए वसूली योग्य होगी। प्रत्येक उि 4 अंकों के जलए महगं ाई राहत म ें ऐसी वृजि या जगरावट की गणना जनम्नजलजखत ताजलका म ें प्रदान की गई जवजध से की िाएगी, अिाकत:- ताजलका क्र.स.ं प्रजत माह मलू पिें न का मलू पिें न के प्रजतित के रूप म ेंमहगं ाई राहत की दर वते नमान

(4) 1 मई, 2005 को या उसके बाद सेवाजनवृत्त होन े वाल े कमकचाररयों के संबंध म,ें 1960=100 श्ृंखला म ें औद्योजगक श्जमकों के जलए अजखल भारतीय औसत उपभोिा म्ू य सूचकांक के जतमाही औसत म ें 2288 अंकों स े ऊपर प्रत्येक 4 अंकों की प्रत्येक वृजि के जलए महगं ाई राहत दये होगी या प्रत्येक जगरावट के जलए वसूली योग्य होगी। प्रत्येक उि 4 अंकों के जलए महगं ाई राहत म ेंऐसी वृजि या कमी की गणना मूल पिें न के 0.18 प्रजतित की दर स े की िाएगी:
परंतु 1 मई, 2005 से, 1 नवंबर, 2002 को या उसके बाद दकन्तु 30 अप्रैल, 2005 को या उसस े पहले सेवाजनवृत्त हुए कमकचाररयों के संबंध में, इस खंड के अनुसार महगं ाई राहत देय होगी: बिते दक 1 नवंबर, 2007 को या उसके बाद सेवाजनवृत्त हुए कमकचाररयों के संबंध म,ें 1960=100 श्ृंखला म ें औद्योजगक श्जमकों के जलए अजखल भारतीय औसत उपभोिा मू्य सूचकांक के जतमाही औसत म ें2836 अंकों स े ऊपर प्रत्येक 4 अंकों की प्रत्येक वृजि के जलए महगं ाई राहत दये होगी या प्रत्येक जगरावट के जलए वसूली योग्य होगी। उि प्रत्येक 4 अंकों के जलए महगं ाई राहत म ेंऐसी वृजि या कमी मलू पिें न के 0.15 प्रजतित की दर स ेगणना की िाएगी:

(5) महगं ाई राहत 1 फरवरी स े प्रारंभ होकर 31 िलु ाई को समाप्त होने वाली छमाही के जलए जपछल े विक के अक्टूबर, नवंबर और ददसंबर माह के जलए प्रकाजित सूचकांक आंकडों के त्रैमाजसक औसत पर दये होगी और 1 अगस्ट्त स े प्रारंभ होकर 31 िनवरी को समाप्त होने वाली छमाही के जलए उसी विक के अप्रलै , मई और िनू माह के जलए प्रकाजित सूचकांक आंकडों के त्रैमाजसक औसत पर दये होगी।
(6) पाररवाररक पेंिन, अिि पेंिन और अनुकंपा भत्त े के मामल े म,ें महगं ाई राहत ऊपर उज्लजखत दरों के अनुसार दये होगी।
(7) पेंिन के संरािीकरण के बाद भी पूरी मलू पेंिन पर महगं ाई राहत देय होगी।
(8) अजतररि पेंिन पर महगं ाई राहत दये नहीं होगी।
(9) ऐसे पेंिनभोगी जिनकी मलू पिें न न्यूनतम पिें न स े कम ह,ै लेदकन मलू पेंिन और अजतररि पेंिन का योग न्यूनतम पेंिन स ेअजधक ह,ै उन्ह ेंन्यूनतम पेंिन पर लाग ू महगं ाई राहत दी िाएगी।”
12. उि जवजनयमों म,ें पररजिष्ट-III के स्ट्िान पर जनम्नजलजखत पररजिष्ट प्रजतस्ट्िाजपत दकया िाएगा, अिाकत्: - “पररजिष्ट-III (जवजनयम 39 देख)ें 1 अप्रलै , 2021 स े पाररवाररक पेंिन की सामान्य दरें जनम्नानुसार होंगी:

In theCanara Bank (Employees’) Pension Regulations, 1995 (hereinafter referred to as the said regulations), inregulation 2, after clause (w), the following clause shall be inserted,namely:– “(wa) ‘resigned former employee’ means an employee, who – a. was in the services of the Bank on or after the 1st January, 1986;
b. joined the Bank before the 1st April, 2010; c. has resigned from the services of the Bank on or before the 26th April, 2010; and d. was otherwise eligible to join the pension scheme while in service of the Bank;”.
3. In regulation 3 of the said regulations, after sub-regulation (14), the following shall be inserted, namely:– “(15) qualifies the definition of resigned former employee defined in clause (wa) of regulation 2 and has agreed to refund to the Bank the entire Banks’ contribution to Provident Fund (along with accumulated interest thereon) received by him at the time of resignation or later, from the Bank and has given an undertaking as per the draft
provided by the Bank within the time as stipulated by the Bank.”.
4. In regulation 22 of the said regulations, in sub-regulation (1), after the proviso, the following proviso shall be inserted, namely:–14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] “Provided further that resignation by a resigned former employee defined in clause (wa)of regulation 2, and who also conforms to the conditions contained in sub-regulation (15) of regulation 3, shall not entail forfeiture of the past service.”.
5. In regulation 29 of the said regulations, –
(i) in sub-regulation (1), after the third proviso, the following proviso shall be inserted, namely:– “Provided also that a resigned former employee as defined in clause (wa) of regulation 2 and conforming to the conditions specified in sub-regulation (15) of regulation 3, shall also be entitled for pension provided he has completed such qualifying service.”;
(ii) in sub-regulation (5), the following proviso shall be inserted, namely: – “Provided that the resigned former employee defined in clause (wa) of regulation 2 shall not be eligible for the benefit of increase of such qualifying service.”.
6. In regulation 36 of the said regulations, after clause (g), the following clause shall be inserted, namely: – “(h) rupees five thousand and seventy-five per month in respect of an employee, other than a part-time employee, where the employee retired on or after the 1stNovember, 2022,rupees one thousand seven hundred per month in respect of a part-time employee drawing 1/3 scale of wages, rupees two thousand five hundred and forty seven per month in respect of part-time employee drawing ½ scale wages, and rupees three thousand eight hundred and twenty per month in respect of a part-time employee drawing ¾ scale wages, where the part-time employee retired on or after the 1stNovember, 2022.”.
7. In regulation 39 of the said regulations, in sub-regulation (1), in clause (c), after the proviso, the following proviso shall be inserted,namely: – “Provided further that family of a deceased resigned former employee as defined in clause (wa) of regulation 2 shall also be eligible for family pension provided that the deceased resigned former employee has completed required qualifying service in the Bank under sub-regulation (1) of regulation 29, subject to the condition that the deceased resigned former employee (before his death) or family member has agreed to refund to the Bank the entire Bank’s contribution to Provident Fund (along with accumulated interest thereon) received at the time of resignation or later, from the Bank and has given an undertaking as per the draft provided by the Bank within the time as stipulated by the Bank.”.
8. In regulation 40 of the said regulations, in sub-regulation (1),–
(i) in clause (b), for the first proviso, the following proviso shall be substituted, namely:– “Provided that the family pension payable to son ordaughter (including widowed ordivorced) shall be discontinued ornot be admissible when the eligible son ordaughter starts earning a sum in excess of rupees eighteen thousand per month from employment in Government orPrivate Sector orself–employment etc.:”;
(ii) for clause (c), the following clause shall be substituted,namely: – “(c) in the case of parents, the family pension shall be discontinued ornot be admissible, if the income of one of the parents or the aggregate income of both the parents from employment in Government orPrivateSector or self–employment, etc. exceeds rupees eighteen thousand per month.”.
9. In regulation 41 of the said regulations, in sub-regulation (1), after the proviso, the following proviso shall be inserted, namely:– “Provided further that a resigned former employee as defined in clause (wa) of regulation 2 and who conforms to conditions contained in sub-regulation (15) of regulation 3, shall not be eligible for commutation of his pension.”.
10. In regulation 55 of the said regulations, for the words “The Chairman and Managing Director”, the words “The Managing Director and Chief Executive Officer” shall be substituted.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 15
11. In the said regulations, for Appendix – II, the following Appendix shall be substituted, namely:– “Appendix-II (See regulation 37)
Dearness relief on basic pension shall be as under:
(1) In the case of employees who were in the workmen cadre and who retired on or after the 1stJanuary, 1986, but before the 1stNovember, 1992, and in the case of employees, who were in the officers’ cadre and who retired on or after the 1stJanuary, 1986, but before the 1stJuly, 1993, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 600 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960 = 100. Provided further that in respect of employees who retired on or after the 1stNovember, 2007, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 2836 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.15 percent. of basic pension:
Provided also that in respect of employees who retired on or after the 1stNovember, 2012, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 4440 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.10 percent. of basic pension:
Provided also that in respect of employees who retired on or after the 1stNovember, 2017, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 6352 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.07 percent. of basic pension:18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
Provided also that in respect of employees who retired on or after the 1stNovember, 2022, dearness relief shall be payable at 1 per cent. per percentage point of Index on the Basic pension for every variation of rise or fall over 123.03 points in the quarterly average of the All India Consumer Price Index for Industrial Workers Base 2016=100.
(5) Dearness relief shall be payable for the half year commencing from the 1stFebruary and ending with the 31stJuly on the quarterly average of the index figures published for the months of October, November and December of the previous year and for the half year commencing from the 1st August and ending with the 31stJanuary on the quarterly average of the index figures published for the months of April, May and June of the same year.
(6) In the case of family pension, invalid pension and compassionate allowance, dearness relief shall be payable in accordance with the rates mentioned above.
(7) Dearness relief will be allowed on full basic pension even after commutation.
(8) Dearness relief is not payable on additional pension.
(9) Pensioner whose basic pension is less than minimum pension but the aggregate of basic pension and additional pension is more than the minimum pension shall draw dearness relief as applicable to minimum pension.”.
12. In the said regulations, for Appendix-III, the following Appendix shall be substituted, namely: — “Appendix-III (Seeregulation 39) On and from the 1stApril, 2021, the ordinary rates of family pension shall be as under:

3. Above Rs.8420 30 per cent. of the pay shall be the basic family pension and additional 30 per cent. of allowances, which are counted for making contributions to provident fund but not for dearness allowance, shall be the additional family pension:
Provided that the aggregate of basic and additional family pension shall be subject to a minimum of Rs.1687 per month.
(d) In respect of employees (both officers and workmen) other than part-time employees retiring on or after the 1stMay, 2005:– Scale of pay Sl. No. Amount of monthly family pension per month

Provided that the aggregate of basic and additional family pension shall be subject to minimum of Rs. 1715 per month.
3. Above Rs. 30 per cent. of the pay shall be the basic family pension and additional 30 per 11,440 cent. of allowances, which are counted for making contributions to provident fund but not for dearness allowance, shall be the additional family pension:
Provided that the aggregate of basic and additional family pension shall be subject to a minimum of Rs .2292/- per month:

2. Rs. 20,221 to 30 per cent. of the pay shall be the basic family pension and additional 30 per cent. of allowances, which are counted for making contribution to Rs. 40,440 provident fund but not for dearness allowance, shall be the additional family
pension:

3. Above 30 per cent. of the pay shall be the basic family pension and additional 30 per cent. of allowances, which are counted for making contribution to Rs. 40,440 provident fund but not for dearness allowance, shall be the additional

Provided that the aggregate of basic and additional family pension shall be subject to a minimum of Rs. 8105 per month.”.

EXPLANATORY MEMORANDUM The seregulations which have been given retrospective effect are as per the agreed terms and conditions of the settlements and Joint Notes signed between the Indian Banks’ Association on behalf of member banks on the basis of specific mandate given by the respective banks in this regard and apex level workmen Unions and Officers’ Associations of the banks. Therefore, interests of no person shall be adversely affected by such retrospective effect.
