1. (1)ये िविनयम स34ल ब(cid:9)क ऑफ़ इंिडया (कम(cid:24)चारी) प3शन (संशोधन) िविनयम 2017 कहलाएंगे ।

(2)इन िविनयम(cid:20) म3 अ>यथा GपHतया उपलIध को छोड़कर, ये सरकारी राजपL म3 अपने ,काशन क$ तारीख से लागू ह(cid:20)गे ।

2. स34ल ब(cid:9)क ऑफ़ इंिडया (कम(cid:24)चारी) प3शन िविनयम, 1995 म3 (इसके बाद कहे गये िविनयम(cid:20) के Mप म3 संदNभ(cid:24)त), -िविनयम 2,,,, के खंड (एस) म3 उपखंड (सी) के बाद िनCांOकत उप खंड जोड़ा जाए,,,, अथा(cid:24)त:- (डी) मई 2005 के ,थम Oदवस या उसके बाद सेवा म3 रहते 2ए सेवािनवृ. या मृSयु होने परOकसी कम(cid:24)चारी के संबंध म3, ब(cid:9)क म3 अपनी सेवा के िपछले दस महीन(cid:20) के दौरान कम(cid:24)चारी +ारा आह:रत, िनयत वेतन वृिV सिहत मूल वेतन, यOद कोई हो, और िवशेष वेतन, Wातक वेतन, Xावसाियक योYयता वेतन, िनयत काNम(cid:24)क वेतनका वेतन वृिV घटक और Gथानाप\ वेतन, यOद कोई हो,:

परंतु 01 मई 2005 से ,भावी इस खंड के ,ावधान(cid:20) म3 अ,ैल 1998 के ,थम Oदवस पर या उसके बाद लेOकन 30 अ,ैल 2005 से पहले सेवा म3 सेवािनवृ. या मृSयु हो जाने वाले Oकसी कम(cid:24)चारी के संबंध म3 ,भाव पड़गे ा।

3. उ0 िविनयम(cid:20) के िविनयम 3 के उप – िविनयम (4) म3, िनCिलिखत उप-िविनयम को ,ितGथािपत Oकया जाएगा, अथा(cid:24)त:- “(4) (क) अिधसूिचत ितिथ के बाद और 31 माच(cid:24) 2010 को या उससे पहले ब(cid:9)क क$ सेवा म3 सेवारत हो:” (ख) उप – िविनयम 10 के बाद, िनCिलिखत उप-िविनयम(cid:20) को सि(cid:3)मिलत Oकया जायेगा, अथा(cid:24)त :- 5792 GI/2017 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(11) जो ब(cid:9)क क$ सेवा म3 29 िसत(cid:3)बर 1995 से पहले थे और 27 अ,ैल 2010 तक ब(cid:9)क क$ सेवा म3 सेवारत रह ेह(cid:20), बशत‘ Oक ऐसे कम(cid:24)चारी िनपटान म3 िनधा(cid:24):रत आवbयकताc को पूरा और शतd का पालन करत ेह(cid:20);

(12) जो ब(cid:9)क क$ सेवा म3 29 िसत(cid:3)बर 1995 से पहले थे तथा उस ितिथ से और 27 अ,ैल 2010 से पहले सेवािनवृ.

2ए ह(cid:20),बशत‘ Oक ऐसे कम(cid:24)चारी िनपटान म3 िनधा(cid:24):रत आवbयकताc को पूरा और शतd का पालन करते ह(cid:20);

(13) जो ब(cid:9)क क$ सेवा म3 29 िसतंबर 1995 से पहले थे और उस ितिथ के बाद सेवािनवृ. 2ए और मृSयु हो गई हो, ऐसे मामल(cid:20) म3 जैसा Oक इन िविनयम(cid:20) के अधीन यथािGथित, उनके प:रवार को प3शन या उनके प:रवार प3शन के हकदार ह(cid:20)ग,े यOद मृतक का प:रवार िनपटान म3 िनधा(cid:24):रत आवbयकताc को पूरा और शतd का पालन करताहो;

(14) जो ब(cid:9)क क$ सेवा म3 29 िसतंबर 1995 से पहले थे,और उस ितिथ के बाद ब(cid:9)क क$ सेवा म3 रहते 2ए मृSयु हो गई हो, ऐसे मामल(cid:20) म3 जैसा Oक इन िविनयम(cid:20) के अधीन यथािGथित, उनके प:रवार को प3शन या उनके प:रवार, प3शन के हकदार ह(cid:20)ग,े यOद मृतक का प:रवार िनपटान म3 िनधा(cid:24):रत आवbयकताc को पूरा और शतd का पालन करता हो;

4. उ0 िविनयम(cid:20) के िविनयमन 28 म3, ,ावधान(cid:20) के बाद, िनCिलिखत ,ावधान सि(cid:3)मिलत Oकए जाएंगे, अथा(cid:24)त -: "परंतु यह भी Oक कम(cid:24)चारी जो सेवािनवृि. क$ आयु ,ाe करने से पहले Gवैिfछक सेवािनवृि. के कारण 29 िसत(cid:3)बर 1995 को या उसके बाद सेवा म3 नहg थे, लेOकन 15 वष(cid:24) क$ >यूनतम सेवा के उपरांत इस संबंध म3 बोड+(cid:24) ारा तैयार क$ गई योजना के अनुसार एवं सरकार +ारा अनुमोOदत, योजना म3 उिiलिखत िनयम(cid:20) और शतd के अनुपालन के अधीन प3शन फंड म3 शािमल होन े के हकदार ह(cid:20)गे ।"

5. उ0 िविनयम(cid:20) के िविनयमन 36 म3, - (क) खंड (सी) म3 िनCिलिखत ,ावधान शािमल Oकए जाएंगे, अथा(cid:24)त :- "परंतु 1 मई 2005 को, या से,अंशकािलक कम(cid:24)चारी के अलावा Oकसी कम(cid:24)चारी के संबंध म3 जो 1 अ,ैल 1998 को, या उसके पkात, परंतु 31 अlटूबर 2002 से पहले सेवािनवृ. 2ए,उनक$ >यूनतम प3शन एक हजार साठ mपये ,ितमाह और अंशकािलक कम(cid:24)चारी के संबंध म3 जो 1 अ,ैल 1998 को, या उसके बाद, सेवािनवृ. 2ए एक ितहाई वेतनमान पाने वाले अंशकािलक कम(cid:24)चारी क$ तीन सौ पचपन mपये ,ितमाह, आधा वेतनमान पाने वाले अंशकािलक कम(cid:24)चारी क$ पाँच सौ तीस mपये ,ितमाहतथा तीन चौथाई वेतनमान पाने वाले अंशकािलक कम(cid:24)चारी क$ सात सौ पंचानवे mपय े,ितमाह होगी । (ख) खंड (सी) के बाद िनCिलिखत खंड (डी) शािमल Oकया जायेगा, अथा(cid:24)त : - (डी) अंशकािलक कम(cid:24)चारी के अलावा Oकसी कम(cid:24)चारी के संबंध म3 जो 1 मई 2005 को, या उसके बाद सेवािनवृ.

2ए उनको एक हजार चार सौ प(cid:9)तीस mपये ,ितमाह और अंशकािलक कम(cid:24)चारी के संबंध म3 जो 1 मई 2005 को, या उसके बाद सेवािनवृ. 2ए एक ितहाई वेतनमान पाने वाले अंशकािलक कम(cid:24)चारी क$ चार सौ अGसी mपये ,ितमाह, आधा वेतनमान पाने वाले अंशकािलक कम(cid:24)चारी क$ सात सौ बीस mपये ,ितमाह तथा तीन चौथाई वेतनमान पान े वाले अंशकािलक कम(cid:24)चारी क$ एक हजार अGसी mपये ,ितमाह होगी । परंतु 1 मई 2005 के ,थम Oदवस से, इस खंड के ,ावधान अंशकािलक कम(cid:24)चारी सिहत Oकसी भी कम(cid:24)चारी पर लागू ह(cid:20)गे,जो 1 नव(cid:3)बर 2002 को या उसके बाद लेOकन 30 अ,ैल 2005 को या उससे पहले सेवािनवृ. 2ए । (ई) अंशकािलक कम(cid:24)चारी के अलावा Oकसी कम(cid:24)चारी के संबंध म3 जो नब(cid:3)बर2007 माह के ,थम Oदवस को, या उसके बाद सेवािनवृ. 2ए उनको एक हजार सात सौ उ>यासी mपय े ,ितमाह और अंशकािलक कम(cid:24)चारी के संबंध म3 जो नब(cid:3)बर2007 माह के ,थम Oदवस को, या उसके बाद सेवािनवृ. 2ए एक ितहाई वेतनमान पाने वाले अंशकािलक कम(cid:24)चारी क$ पाँच सौ पंचानवे mपये ,ितमाह, आधा वेतनमान पाने वाले अंशकािलक कम(cid:24)चारी क$ आठ सौ बानबे mपये ,ितमाह तथा तीन चौथाई वेतनमान पाने वाले अंशकािलक कम(cid:24)चारी क$ एक हजार तीन सौ उ>तािलस mपये ,ितमाह होगी ।¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3

6. उ0 िविनयम(cid:20) के िविनयम 40 के उप-िविनयम (4) म3,-

(i) खंड (ए) म3, उप-खंड (III) के बाद,िनCिलिखत ,ावधान एवं खंड शािमल Oकए जाएंगे, अथा(cid:24)त-: ‘परंतु यह Oक मई 2005 के ,थम Oदवस पर और से, िविनयम(cid:20) के इस उप-खंड म3 ,भावी जैसेOक शIद(cid:20) “छह हजार सात सौ pqपन” को शIद “सात हजार और चािलस” से ,ितGथािपत Oकया गया ह ै।

(iv) 1मई 2005 को या उसके बाद सेवािनवृ. या मृतकम(cid:24)चा:रय(cid:20) के संबंध म3 केवल नौ हजार पाँच सौ प(cid:9)सठ mपए ,ित माह, दोन(cid:20) अिधका:रय(cid:20) और कामगार(cid:20) के िलये;

(v) 1 नव(cid:3)बर 2007 को या उसके बाद सेवािनवृ. या मृत कम(cid:24)चा:रय(cid:20) के संबंध म3 केवल Yयारह हजार आठ सौ छqपन mपए ,ित माह, दोन(cid:20) अिधका:रय(cid:20) और कामगार(cid:20) के िलये;

(ii) खंड (बी) म3, उप-खंड (iii) के बाद, िनCिलिखत ,ावधान एवं खंड शािमल Oकए जाएंगे, अथा(cid:24)त:- ‘परंतु यह Oक मई 2005 के ,थम Oदवस पर और से, िविनयम(cid:20) के इस उप-खंड म3 ,भावी जैसेOक शIद(cid:20) “छह हजार सात सौ pqपन” को शIद “सात हजार और चािलस” से ,ितGथािपत Oकया गया ह ै।

(iv) 1 मई 2005 को या उसके बाद सेवािनवृ. या मृत कम(cid:24)चा:रय(cid:20) के संबंध म3 केवल नौ हजार पाँच सौ प(cid:9)सठ mपए ,ित माह, दोन(cid:20) अिधका:रय(cid:20) और कामगार(cid:20) के िलये;

(v) 1 नव(cid:3)बर 2007 को या उसके बाद सेवािनवृ. या मृत कम(cid:24)चा:रय(cid:20) के संबंध म3 केवल Yयारह हजार आठ सौ छqपन mपए ,ित माह, दोन(cid:20) अिधका:रय(cid:20) और कामगार(cid:20) के िलये;

(iii) खंड (सी) म3, उप-खंड (iii) के बाद, िनCिलिखत ,ावधान एवं खंड शािमल Oकए जाएंगे, अथा(cid:24)त:- ‘परंतु यह Oक मई 2005 के ,थम Oदवस पर और से, िविनयम(cid:20) के इस उप-खंड म3 ,भावी जैस ेOक शIद(cid:20) “तीन हजार तीन सौ अठ.र” को शIद “तीन हजार पाँच सौ बीस” से ,ितGथािपत Oकया गया ह ै।

(iv) 1मई 2005 को या उसके बाद सेवािनवृ. या मृत कम(cid:24)चा:रय(cid:20) के संबंध म 3 केवल चार हजार सात सौ ितरासी mपए ,ित माह, दोन(cid:20) अिधका:रय(cid:20) और कामगार(cid:20) के िलये;

(v) 1 नव(cid:3)बर 2007 को या उसके बाद सेवािनवृ. या मृत कम(cid:24)चा:रय(cid:20) के संबंध म3 केवल पाँच हजार नौ सौ अrाइस mपए ,ित माह, दोन(cid:20) अिधका:रय(cid:20) और कामगार(cid:20) के िलये;

7. उ0 िविनयम(cid:20) के िविनयम 48 म3,िनCिलिखत िविनयम(cid:20) को ,ितGथािपत Oकया जाएगा, अथा(cid:24)त:- “48. ब(cid:9)क(cid:20) को 2ई आNथ(cid:24)क हािन क$ वसूली.-

(1) यOद प3शनभोगी अपनी सेवा क$ अविध के दौरान Oकसी िवभागीय या >याियक काय(cid:24)वाही म3 घोर कदाचार या लापरवाही या आपरािधक >यासभंग या जालसाजी या कपटपूण(cid:24) काय(cid:24) का दोषी पाया जाता ह ैतो सtम ,ािधकारी प3शन या उसका अंश रोक सकता ह ैया आह:रत कर सकता है, चाह ेGथायी Mप से या िनधा:(cid:24)रत अविध के िलये, और ब(cid:9)क को 2ई Oकसी भी आNथ(cid:24)क हािन के पूरे या अंश को प3शन से वसूल करने के आदेश द ेसकता ह ै। परंतु कोई भी अंितम आदेश जारी करने के पूव(cid:24) बोड (cid:24)से परामश(cid:24) Oकया जायेगा । परंतु जहां प3शन के एक अंश रोक Oदया गया ह ैया आह:रत Oकया गया ह,ै प3शनभोगी +ारा आह:रत प3शन क$ रकम इन िविनयम(cid:20) के तहत दये >यनू तम प3शन से कम नहg होगी:

परंतु यह भी Oक कम(cid:24)चारी क$ सेवािनवृि. के पkात, िवभागीय काय(cid:24)वाही, यOद कम(cid:24)चारी क$ सेवा म3 रहते 2ए आरंभ क$ गई ह,ै इन िविनयम(cid:20) के अधीन काय(cid:24)वाही समझी जायेगी तथा ,ािधकारी +ारा वह आरंभ क$ गई थी वह उसी ,कार से जारी रखी जायेगी तथा समाe क$ जायेगी मानो कम(cid:24)चारी सेवा म3 है ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(2) यOद कम(cid:24)चारी के सेवा म3 रहते 2ए िवभागीय काय(cid:24)वाही आरंभ नहg क$ गई थी, तो ऐसे संGथापन के चार वष(cid:24) पूव(cid:24) 2ई Oकसी भी घटना के मामले म3 कोई िवभागीय काय(cid:24)वाही आरंभ नहg क$ जायेगी । परंतु इस ,कार आरंभ क$ गई अनुशासिनक काय(cid:24)वाही, कम(cid:24)चारी क$ सेवा अविध के दौरान अनुशासिनक काय(cid:24)वाही के िलये लागू ,O(cid:19)या के अनुसार होगी ।

(3) जहाँ सtम ,ािधकारी प3शन से आNथ(cid:24)क हािन क$ वसूली का आदशे दते ा ह ै वहाँ वसूली सामा>यता कम(cid:24)चारी क$ सेवािनवृि. क$ तारीख को Gवीकाय(cid:24) प3शन के एक ितहाई से अिधक क$ दर पर नहg क$ जायेगी ।

8. उ0 िविनयम(cid:20) के िविनयम 52 म3:- (ए) उप-िविनयमन (1) के िलये, िनCिलिखत उपिविनयम ,ितGथािपत Oकया जायेगा, अथा(cid:24)त :- “(1) Oकसी कम(cid:24)चारी के संबंध म3 जहां िविनयम 34 या िविनयम 46 के ,ावधान लागू होते ह(cid:9), प:रवार क$ प3शन के अलावा एक प3शन उस तारीख से दये होगी, िजस पर कम(cid:24)चारी सेवािनवृ. होता ह।ै " (बी) उप-िविनयम (3) म3 िनC ,ावधान को शािमल Oकया जायेगा :- “परंतु 27 अ,ैल 2010 को या उसके बाद ब(cid:9)क कम(cid:24)चारी प3शन योजना म3 शािमल होने वाले को प:रवार प3शन सिहत प3शन 27 नवंबर 2009 से लागू होगी ।“

9. उ0 िविनयम के प:रिशH II म3, िनCिलिखत िविनयम ,ितGथािपत Oकया जायेगा, अथा(cid:24)त :- पपपप(cid:28)(cid:28)(cid:28)(cid:28)ररररििििशशशश(cid:30)(cid:30)(cid:30)(cid:30) II (ििििववववििििननननययययमममम 33337777 ददददखख(cid:2)(cid:2)खख(cid:2)(cid:2) ))(cid:2)(cid:2)))(cid:2)(cid:2) मूल प3शन पर महगं ाई राहत िनCिलिखत अनुसार होगी :-

(1) अधीनGथ vेणी के जो कम(cid:24)चारी, 01 जनवरी 1986 को या उसके पkात,,,, परंतु 01 नवंबर 1992 के पूव(cid:24) सेवािनवृ. 2ए थे,,,, तथा अिधकारी vेणी के जो कम(cid:24)चारी 01 जनवरी 1986 को या उसके पkात परंतु 01 जुलाई 1993 के पूव(cid:24) सेवािनवृ. 2ए थ,,े,, के मामले म3,,,, महगं ाई भ.ा vृंखला 1960=100 म3 औxोिगक कामगार(cid:20) के िलये अिखल भारतीय औसत उपभो0ा मूiय सूचकांक के ितमाही औसत म3 600 अंक(cid:20) के ऊपर,,,, यथािGथित 4 अंक(cid:20) क$ वृिV पर दये होगा तथा ,Sयेक िगरावट पर वसूली योYय होगा । ऐसे ,Sयेक 4 अंक(cid:20) क$ महंगाई राहत म3 वृिV या िगरावट नीचे Oदये गये अनुसार प:रकिलत क$ जायेगी ममममूलूलूलूल पपपप(cid:2)श(cid:2)श(cid:2)श(cid:2)शनननन ककककाााा ववववततेेततेे ननननममममाााानननन ममममूलूलूलूल पपपप(cid:2)श(cid:2)श(cid:2)श(cid:2)शनननन ककककेेेे &&&&ििििततततशशशशतततत ककककेेेे ’’’’पपपप मममम (cid:2)(cid:2) (cid:2)(cid:2) &&&&ििििततततममममााााहहहह ममममहहहहगगंंगगंं ााााईईईई ररररााााहहहहतततत कककक++++ ददददरररर ((((1111)))) ((((2222))))

(i) m. 1250/- तक 0.67 ,ितशत

(ii) m. 1251/- से m.2000/- m. 1250/- का 0.67 ,ितशत तथा + m. 1250/- से अिधक मूल वेतन का 0.55 ,ितशत

(iii) m.2001/- to m.2130/- m. 1250/- का 0.67 ,ितशत तथा + m. 2000/- और m. 1250/- के बीच के अंतर का 0.55 ,ितशत तथा m. 2000/- से अिधक मूल प3शन का 0.33 ,ितशत ।

(iv) m 2130/- से अिधक m 1250/- का 0.67 ,ितशत तथा + m 2000/- और m. 1250/- के बीच के अंतर का 0.55 ,ितशत तथा + m. 2130/- और m.

(2) कामगार vेणी के जो कम(cid:24)चारी 01 नवंबर 1992 को या उसके पkात सेवािनवृ. 2ए ह (cid:9) तथा अिधकारी vेणी के जो कम(cid:24)चारी 01 जुलाई 1993 को या उसके पkात सेवािनवृ. 2ए ह,(cid:9) के मामले म3, महगं ाई भ.ा vृंखला 1960=100 म3 औxोिगक कामगार(cid:20) के िलये अिखल भारतीय औसत उपभो0ा मूiय सूचकांक के ितमाही औसत म3 1148 अंक(cid:20) के ऊपर, यथािGथित, ,Sयेक 4 अंक(cid:20) क$ वृिV पर दये होगा तथा ,Sयेक िगरावट पर वसूली योYय होगा । ऐसे ,Sयेक 4 अंक(cid:20) क$ महंगाई राहत म3 वृिV या िगरावट नीचे Oदये गये अनुसार प:रकिलत क$ जायेगी :

(ii) m. 2401/- सेm.3850/- m. 2400/- का 0.35 ,ितशत तथा + m. 2400/- से अिधक मूल प3शन का 0.29 ,ितशत ।

(iii) m. 3851/- सेm.4100/- m.2400/- का 0.35 ,ितशततथा + m.3850/- और m. 2400/- के बीच के अंतर का 0.29 ,ितशत + m. 3850 से अिधक मूल प3शन का 0.17 ,ितशत ।

(iv) m.4100/- से अिधक m. 2400/- का 0.35 ,ितशत तथा + m. 3850/- और m.

2400/- के बीच के अंतर का 0.29 ,ितशत तथा + m. 4100/- और m. 3850/- के बीच के अंतर का 0.17 ,ितशत तथा + m.

4100/- से अिधक मूल प3शन का 0.09 ,ितशत ।

(5) महगं ाई भ.ा िपछले वष(cid:24) के अlटूबर, नव(cid:3)बर और Oदस(cid:3)बर के महीन(cid:20) म3 ,कािशत सूचकांक(cid:20) के ितमाही औसत पर पहली फरवरी से आरंभ और 31 जुलाई को समाe होने वाली छमाही के िलये और उसी वष(cid:24) अ,ैल, मई और जून के महीन(cid:20) म3 ,कािशत सूचकांक(cid:20) के ितमाही औसत पर और 01 अगGत से आरंभ और 31 जनवरी को समाe होने वाली छमाही के िलये दये होगा ।

(6) प:रवार प3शन, अश0ता प3शन और अनुक(cid:3)पा भ.े के संबंध म3 महगं ाई राहत ऊपर उिiलिखत दर(cid:20) के अनुसार दये होगी ।

(7) पूण(cid:24) मूल प3शन पर महंगाई रािश क$ अनुमित संराशीकरण के बाद भी दी जायेगी ।

NOTIFICATION Mumbai, the 1st September, 2017 F.No. CO:HRD:PEN:444.- In exercise of the powers conferred by clause (f) of sub-section (2) of section 19 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970 ( 5 of 1970), the Board of Directors of the Central Bank of India in consultation with the Reserve Bank of India and with the previous sanction of the Central Government, hereby makes the following regulations further to amend the Central Bank of India (Employees’) Pension Regulations, 1995, namely :-

1. (1) These regulations may be called the Central Bank of India(Employees’) Pension(Amendment) Regulations,

2017.

(2) Save as otherwise expressly provided in these regulations, they shall come into force on the date of their publication in the Official Gazette.

2. In the Central Bank of India (Employees’) Pension Regulations 1995 (hereinafter referred to as the said regulations), - In regulation 2, in clause (s), after sub-clause(c), the following sub-clause shall be inserted, namely:- “(d) in relation to an employee who retired or died while in service on or after the first day of May, 2005 the basic pay including stagnation increments, if any, and Special pay, Graduation Pay, Professional Qualification Pay, increment component of Fixed Personnel Pay and Officiating Pay, if any, drawn by

the employee during the last ten months of his service in the Bank:

Provided that with effect from 1st day of May, 2005 the provisions of this clause shall have effect in relation to an employee who retired or died while in service on or after 1st day of April, 1998 but before 30th day of April, 2005”.

3. In regulation 3 of the said regulations, for sub-regulation (4), the following sub-regulation shall be substituted,

namely:- “(4) (a) join the service of the bank on or after the notified date and on or before the 31st day of March, 2010;”.

(b) after sub-regulation (10), the following sub-regulations shall be inserted, namely:-¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 11 “(11) were in the service of the Bank prior to the 29th September, 1995 and continue in the service of the Bank as on the 27th April, 2010 provided such employee meets the requirement and comply with the conditions laid down in the settlement;

(12) were in the service of the Bank prior to the 29th September, 1995 and retired after that date andprior to 27th April, 2010 provided such employee meets the requirements and comply with the conditions laid down in the settlement;

(13) wherein service of the Bank, prior to the 29th September, 1995 retired after that date and had died in which case their family shall be entitled to the pension or the family pension, as the case may be under these regulations, if the family of the deceased meets the requirement and complies with the conditions laid down in the settlement;

(14) were in the service of the bank prior to the 29th September, 1995 and died while in service of the Bank after that date in which case their family shall be entitled to the pension or the family pension, as the case may be under these regulations, if the family of the deceased meet the requirement and complies with the conditions laid down in the settlement.”.

4. In regulation 28 of the said regulations, after the proviso, the following proviso shall be inserted, namely:- “Provided further that employees who ceased to be in service on or after the 29th September, 1995 on account of voluntary retirement before attaining the age of superannuation but after rendering service for a minimum period of 15 years in accordance with the Scheme framed in this regard by the Board with the approval of the Government, shall be entitled to join the Pension Fund, subject to the compliance of the terms and conditions mentioned in the Scheme.”

5. In regulation 36of the said regulations,-

(a) in clause (c), the followingprovisoshall be inserted, namely:- “Provided that on and from the 1st day of May, 2005 the amount of minimum pension, in respect of an employee, other than a part-time employee, who retired on or after the 1st April, 1998 but before the 31st October, 2002 shall be rupees one thousand and sixty per month and rupees three hundred and fifty five in respect of a part-time employee drawing 1/3 scale wages, rupees five hundred and thirty in respect of a part- time employee drawing ½ scale wages and rupees seven hundred and ninety five in respect of a part-time employee drawing ¾ scale wages, where the part-time employee retired on or after 1st day of April, 1998.”;

(b) after clause (c), the following clause (d) shall be insertednamely:- “(d) rupees one thousand four hundred and thirty fiveper month in respect of an employee, other than a part-time employee, where the employee retired on or after 1st day of May 2005 and rupees four hundred and eightyper month in respect of a part-time employee drawing 1/3 scale of wages, rupees seven hundred and twenty per month in respect of part-time employee drawing ½ scale wages and rupees one thousand and eightyper month in respect of a part-time employee drawing ¾ scale wages, where the part-time employee retired on or after the 1st day of May 2005:

Provided that on and from the 1st day of May 2005 the provisions of this clause shall also apply to an employee including a part-time employee who retired on or after 1st November 2002 but on or before 30th April 2005.;

(e) rupees one thousand seven hundred and seventy nine per month in respect of an employee, other than a part-time employee, where the employee retired on or after 1st day of November 2007 and rupees five hundred and ninety five per month in respect of a part-time employee drawing 1/3 scale of wages, rupees eight hundred and ninety two per month in respect of part-time employee drawing ½ scale of wages and rupees one thousand three hundred and thirty nine per month in respect of a part- time employee drawing ¾ scale wages, where the part-time employee retired on or after the 1st day of November 2007.”.12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(6) In regulation 40, of the said regulations, in sub-regulation (4),-

(i) in clause (a), after sub-clause (iii),the following proviso and clause shall be inserted, namely:- ‘Provided that on and from the 1st day of May 2005 the provisions of this sub-clause shall have effect as if for the words “six thousand seven hundred and fifty six”, the words “seven thousand and forty”, had been substituted.;

(iv) nine thousand five hundred and sixty five rupees per mensem only in respect of employees, both officers and workmen, who retired or died on or after 1st day of May 2005; ’;

(v) Eleven thousand eight hundred and fifty six rupees per mensem only in respect of employees, both officers and workmen, who retired or died on or after 1st day of November 2007.”

(ii) in clause (b), after sub-clause (iii), the following proviso and clause shall be inserted, namely:- ‘Provided that on and from the 1st day of May 2005 the provisions of this sub-clause shall have effect as if for the words “six thousand seven hundred and fifty six”, the words “seven thousand and forty”, had been substituted;

(iv) nine thousand five hundred and sixty five rupees per mensem only in respect of employees, both officers and workmen, who retired or died on or after 1st day of May 2005.’;

(v) Eleven thousand eight hundred and fifty six rupees per mensem only in respect of employees, both officers and workmen, who retired or died on or after 1st day of November 2007.

(iii) in clause (c), after sub-clause (iii), the following proviso and clause shall be inserted, namely:- ‘Provided that on and from the 1st day of May 2005 the provisions of this sub-clause shall have effect as if for the words “three thousand three hundred and seventy eight,” the words “three thousand five hundred and twenty,” had been substituted.;

(iv) four thousand seven hundred and eighty three rupees per mensem only in respect of employees, both officers and workmen, who retired or died on or after 1st day of May 2005.’.

(v) five thousand nine hundred and twenty eight rupees per mensem only in respect of employees, both officers and workmen, who retired or died on or after 1st day of November 2007.

(7) For regulation 48 of the said regulations, the following regulations shall be substituted, namely:- “48. Recovery of pecuniary loss caused to Bank.-

(1) The Competent Authority may withhold or withdraw a pension or a part thereof, whether permanently or for a specified period, and order recovery from pension of the whole or part of any pecuniary loss caused to the Bank if in any departmental or judicial proceedings the pensioner is found guilty of grave misconduct or negligence or criminal breach of trust or forgery or for acts done

fraudulently during the period of his service:

Provided that the Board shall be consulted before any final orders are passed:

Provided further that where a part of pension is withheld or withdrawn the amount of pension drawn by

a pensioner shall not be less than the minimum pension payable under these regulations:

Provided also that the departmental proceedings, if instituted while the employee was in service, shall, after the retirement of the employee, be deemed to be proceedings under these regulations and shall be continued and concluded by the authority by which they were commenced in the same manner as if the employee had continued in service.

(2) No departmental proceedings, if not instituted while the employee was in service, shall be instituted

in respect of an event which took place more than four years before such institutions:

Provided that the disciplinary proceedings so instituted shall be in accordance with the procedure applicable to disciplinary proceedings in relation to the employee during the period of his service.¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 13

(3)Where the Competent Authority orders recovery of pecuniary loss from the pension, the recovery shall not ordinarily be made at a rate exceeding one-third of the pension admissible on the date of retirement of the employee.”.

8. In regulation 52 of the said regulations,-

(a) for sub-regulation (1), the following sub-regulation shall be substituted, namely:- “(1) Except in the case of an employee to whom the provisions of regulation 34 or regulation 46 apply, a pension other than family pension shall become payable from the date following the date on which an employee retires.”.

(b) in sub-regulation (3), the following proviso shall be inserted, namely:- “Provided that pension including family pension to those who opted to join the Bank Employees’ Pension Scheme on or after the 27th April, 2010 shall be payable with effect from the 27th November, 2009.”.

9. For Appendix II to the said regulations, the following Appendix shall be substituted, namely:- “Appendix II (See regulation 37)

Dearness relief on basic pension shall be as under :-

(1) In the case of employees who were in the workmen cadre and who retired on or after the 1st day of January, 1986, but before the 1st day of November, 1992; and in the case of employees who were in the officers’ cadre and who retired on or after the 1st day of January, 1986, but before the 1st day of July, 1993, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 600 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960 = 100. Such increase or decrease in dearness relief for every said four points shall be calculated in

the manner given below:- Scale of basic pension The rate of dearness relief as a per month percentage of basic pension

(1) (2)

(i) UptoRs.1250 0.67 per cent

(ii) Rs.1251 to Rs.2000 0.67 per cent ofRs.1250 plus 0.55 per cent of basic pension in excess of Rs.1250.

(iii) Rs.2001 to Rs.2130 0.67 per cent ofRs.1250 plus 0.55 per cent of the difference between Rs.2000 and Rs.1250 plus 0.33 per cent of basic pension in excess of Rs.2000.

(iv) Above Rs.2130 0.67 percent of Rs.1250 plus 0.55 percent the difference between Rs.2000 and Rs.1250 plus 0.33 per cent of the difference between Rs.2130 and Rs.2000 plus 0.17 per cent of basic pension in excess of Rs.2130.

(2) In the case of employees who are in workmen cadre and who retire on or after the 1st day of November, 1992; and in the case of employees who are in the officers’ cadre and who retire on or after the 1st day of July, 1993, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 1148 points in the quarterly average of All India Average Consumer Price Index for Industrial Workers in the series 1960 = 100. Such increase or decrease in dearness relief for every said four points shall be

(iii) Rs.3851 to Rs.4100 0.35 percent of Rs.2400 plus 0.29 percent of the difference between Rs.3850 and Rs.2400 plus

0.17 percent of basic pension in excess of Rs.3850

(iv) above Rs.4100 0.35 per cent of Rs.2400 plus 0.29 per cent of the difference between Rs.3850 and Rs.2400 plus 0.17 per cent of the difference between Rs.4100 and Rs.3850 plus 0.09 per cent of basic pension in excess of Rs.4100

(3) In the case of employees who retire on or after the 1st day of April, 1998, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 1616 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said four points shall be

calculated in the manner given below :- Scale of basic The rate of dearness relief as a pension per month percentage of basic pension

(i) UptoRs.3380 0.25 per cent

(ii) Rs.3381 to Rs.5420 0.25 per cent of Rs.3380 plus 0.21 percent basic pension in excess of Rs.3380

(iii) Rs.5421 to Rs.5770 0.25 per cent of Rs.3380 plus 0.21 percent of the difference between Rs.5420 and Rs.3380 plus 0.12 per cent of basic pension in excess of Rs.5420.

(iv) Above Rs.5770 0.25 per cent of Rs.3380 plus 0.21 percent of the difference between Rs.5420 and Rs.3380 plus 0.12 per cent of the difference between Rs.5770 andRs.5420 plus 0.06 per cent of basic pension in excess of Rs.5770.

Provided that on or from the 1st day of May 2005 in the case of employees who retire on or after the 1st day of April 1998 but on or before the 31st October 2002, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 1684 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100.

Such increase or decrease in dearness relief for every said 4 points shall be calculated in the manner

given below:

(ii) Rs.3551 to Rs.5650 0.24 per cent of Rs.3550 plus 0.20 per cent basic pension in excess of Rs.3550

(iii) Rs.5651 to Rs.6010 0.24 per cent of Rs.3550 plus 0.20 per cent of the difference between Rs.5650 andRs.3550 plus 0.12 of basic pension in excess of Rs.5650¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 15

(iv) Above Rs.6010 0.24 per cent of Rs.3550 plus 0.20 per cent of the difference between Rs.5650 andRs.3550 plus 0.12 per cent of the difference between Rs.6010 and Rs.5650 plus 0.06 per cent of basic pension in excess of Rs.6010

4) In respect of employees who retire on or after the 1st day of May, 2005, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 2288 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.18 per cent of basic pension:

Provided that on and from the 1st day of May 2005, in respect of employees who retired on or after 1st day of November 2002 but on or before 30th day of April 2005, dearness relief shall be payable in

terms of this clause:

Provided further that in respect of employees who retired on or after the 1st day of November 2007, Dearness Relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 2836 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.15 per cent of basic pension.

(5) Dearness relief shall be payable for the half year commencing from the 1stday of February and ending with the 31st day of July on the quarterly average of the index figures published for the months of October, November and December of the previous year and for the half year commencing from the 1st day of August and ending with the 31st day of January on the quarterly average of the index figures published for the months of April, May and June of the same year.

(6) In the case of family pension, invalid pension and compassionate allowance, dearness relief shall be payable in accordance with the rates mentioned above.

(7) Dearness relief will be allowed on full basic pension even after commutation.

(8) Dearness relief is not payable on additional pension.

(9) Pensioner whose basic pension is less than minimum pension but the aggregate of basic pension and additional pension is more than the minimum pension shall draw dearness relief as applicable to minimum pension.”.

10. For Appendix III to the said regulations, the following Appendix shall be substituted, namely :- “Appendix III (See Regulation 39)

The ordinary rates of family pension shall be as under:-

(a) In respect of employees other than part-time employees, where the employee was in the workmen cadre and retired before the 1st day of November, 1992 or where the employee was in the officers’ cadre and retired before the 1st day of July, 1993:- Scale of pay per month Amount of monthly Family pension

(1) (2) UptoRs.1500 30 per cent of the Pay shall be the basic family pension plus 30 per cent of allowances which are counted for making contributions to Provident Fund but not for dearness allowance shall be the additional family pension. The aggregate of basic and additional family pension shall not be less than Rs.375 per month.

Rs.1501 to Rs.3000 20 per cent of the Pay shall be the basic family pension plus 20 percent of allowances which are counted for making contributions to Provident Fund but not dearness allowance shall be the additional family pension.The aggregate of basic and additional family pension shall not be less than Rs.450 per month.

Above Rs.3000 15 per cent of the Pay shall be the basic family pension plus 15 per cent of allowances which are counted for making contributions to Provident Fund but not for dearness allowance shall be the additional family pension. (b) In respect of employees other than part-time employees, where the employee was in the workmen cadre and retired on or after the 1st day of November, 1992 or where the employee was in the officers’ cadre and retired on or after the 1st day of July 1993:- Scale of pay per month Amount of monthly Family Pension

(1) (2) UptoRs.2870 30 per cent of the Pay shall be the basic family pension plus 30 per cent of allowances which are counted for making contributions to Provident Fund but not for dearness allowance shall be the additional family pension. The aggregate of basic and additional family pension shall be subject to a minimum of Rs.720 per month.

Rs.2871 to Rs.5740 20 per cent of the Pay shall be the basic family pension plus 20 per cent of allowances which are counted for making contributions to Provident Fund but not for dearness allowance shall be the additional family pension. The aggregate of basic and additional family pension shall be subject to a minimum of Rs.860 per month.

Above Rs.5740 15 per cent of the Pay shall be the basic family pension plus 15 per cent of allowances which are counted for making contributions to Provident Fund but not for dearness allowance shall be theadditional family pension. The aggregate of basic and additional family pension shall be subject to a minimum of Rs.1150 per month and a maximum of Rs.2400 per month.

(c) In respect of employees (both officers and workmen) other than part-time employees retiring on or after the 1st day of April, 1998: - Scale of pay per month Amount of monthly Family Pension

(1) (2) UptoRs.4040 30 per cent of the Pay shall be the basic family pension plus 30 per cent of allowances which are counted for making contributions to Provident Fund but not for dearness allowance shall be the additional family pension. The aggregate of basic and additional family pension shall not be less than Rs.1015 per month.

Rs.4041 to Rs.8080 20 per cent of the Pay shall be the basic family pension plus 20 per cent of allowances which are counted for making contributions to Provident Fund but not for dearness allowance shall be the additional family pension. The aggregate of basic and additional family pension shall not be less than Rs.1212 per month.

Above Rs.8080 15 per cent of the Pay shall be the basic family pension plus 15 per cent of allowances which are counted for making contributions to Provident Fund but not for dearness allowance shall be the additional family pension. The aggregate of basic and additional family pension shall not be less than Rs.1616 per month and a maximum ofRs.3378 per month:¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 17

(d) In respect of employees (both officers and workmen) other than part-time employees retiring on or after the 1st day of the May 2005:- Scale of pay per month Amount of monthly Family Pension

(1) (2) UptoRs.5720 30 per cent of the Pay shall be the basic family pension plus 30 per cent of allowance which are counted for making contribution to Provident Fund but not for dearness allowance, shall be the additional family pension. The aggregate of basic and additional family pension shall be subject to a minimum of Rs.1435 p.m.

Rs.5721 to Rs.11440 20 per cent of the Pay shall be basic family pension plus 20 per cent of allowance which are counted for making contributions to Provident Fund but not for dearness allowance, shall be the additional family pension. The aggregate of basic and additional family pension shall be subject to minimum of Rs.1715 p.m.

Above Rs.11440 15 per cent of the Pay shall be the basic family pension plus 15 per cent of allowances which are counted for making contributions to Provident Fund but not for the dearness allowance, shall be the additional family pension. The aggregate of basic and additional family pension shall be subject to a minimum of Rs.2292 p.m. and maximum of Rs.4784 p.m.:

Provided that on and from the 1st day of May 2005, in respect of employees who retired on or after the 1st day of November 2002 but on or before the 30th April 2005, ordinary rates of family pension shall be in terms of this clause.

(e) In respect of employees (both officers and workmen) other than part-time employees retiring on or after the 1st day of November 2007:- Scale of pay per month Amount of monthly Family Pension

(1) (2) UptoRs.7090 30 per cent of the Pay shall be the basic family pension plus 30 per cent of allowance which are counted for making contribution to Provident Fund but not for dearness allowance, shall be the additional family pension. The aggregate of basic and additional family pension shall be subject to a minimum of Rs.1779 p.m.

Rs.7091 to Rs.14180 20 per cent of the Pay shall be basic family pension plus 20 per cent of allowance which are counted for making contributions to Provident Fund but not for dearness allowance, shall be the additional family pension. The aggregate of basic and additional family pension shall be subject to minimum of Rs.2186 p.m.

Above Rs.14180 15 per cent of the Pay shall be the basic family pension plus 15 per cent of allowances which are counted for making contributions to Provident Fund but not for the dearness allowance, shall be the additional family pension. The aggregate of basic and additional family pension shall be subject to a minimum of Rs.2841 p.m. and maximum of Rs.5930 p.m.18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

Notes :-

(1) Dearness relief is not payable on additional family pension.

(2) Scale of pay for the purpose of calculation of family pension as above shall be the aggregate of Pay as defined in clause (s) of regulation 2 and allowances as defined in the Explanation to sub-regulation (3) of regulation 35.

(3) In the case of a part-time employee, the minimum amount of family pension and maximum amount of family pension shall be in proportion to the rate of scale wages drawn by the employee.

(4) In case the aggregate of basic family pension and additional family pension falls short of minimum pension the pensioner may be given minimum family pension and dearness relief may be paid on such minimum family pension. However, no additional family pension shall be payable over and above the minimum family pension.”.

EXPLANATORY MEMORANDUM The Regulations which have been given retrospective effect are as per the agreed terms and conditions of the settlements and Joint Notes signed between the Indian Banks’ Association on behalf of member banks on the basis of specific mandate given by the respective banks in this regard and apex level workmen unions and officers’ associations of the Banks. Therefore, interests of no person shall be adversely affected by such retrospective effect.
