1. संजक्षप्त िीर्का और प्रारंभ - (1) इन जर्वजनयमों को आयुर्वेद जिक्षण एर्व ं अनुसंधान संस्ट्थान(संिोधन)जर्वजनयम, 2023 कहा िाएगा।

(2) य ेजनयम सरकारी रािपत्र में इनके प्रकािन की तारीख से प्रर्वृत्त होंगे।

2. आयुर्वेद जिक्षण एर्वं अनुसंधान संस्ट्थान जर्वजनयम, 2021 (इसम ें इसके बाद इसे उक् त जर्वजनयम कहा िाएगा) म,ें जर्वजनयम 2 म,ें -

(i) खंड (ख) के स्ट्थान पर जनम्नजलजखत खंड प्रजतस्ट्थ ाजपत यकया िाएगा, अथाात्:- ‘(ख) “उप जनदेिक” से अजभप्राय अजधजनयम की धारा 11 की उप-धारा (4) के तहत जनयुि उप जनदेिक (स्नातकीय), उप जनदेिक (स्नातकोत्तर) और उप जनदिे क (फामसे ी) ह;ै’;

3. उि जर्वजनयमों म,ें जर्वजनयम 3 म,ें ताजलका म,ें क्रम संख्या 8 और उससे संबंजधत प्रजर्वजियों को जर्वलोजपत यकया िाएगा।

4. उि जर्वजनयमों म,ें जर्वजनयम 10 म,ें उप-जर्वजनयम (1) के जलए, जनम्नजलजखत उप-जर्वजनयम प्रजतस्ट्थाजपत यकया िाएगा, अथाात:्- “(1) जर्वत्तीय सजमजत में जनम्नजलजखत सदस्ट्य होंग,े अथाात्:- सस्ट्ं थान की जर्वत्त सजमजत

1. जनदेिक अध् यक्ष

2. जनदेिक/उप सजचर्व सदस्ट्य (संस्ट्थान के मामलों को देखन े र्वाले), आयुर् मंत्रालय, भारत सरकार

3. संस्ट्थान के अध्यक्ष द्वारा नाजमत िासी जनकाय का एक सदस्ट्य सदस्ट्य

4. जनदेिक/उप सजचर्व;एकीकृत जर्वत्त प्रभाग(संस्ट्थान के मामलों को देखने र्वाले), सदस्ट्य आयुर् मंत्रालय, भारत सरकार

5. सलाहकार (आयुर्वेद), आयुर् मत्रं ालय, भारत सरकार सदस्ट्य

6. संस्ट्थान के लेखा प्रमुख सदस्ट्य सजचर्व”।

5. उि जर्वजनयमों म,ें जर्वजनयम 11 म,ें -

(i) उप-जर्वजनयम (1) म,ें "संस्ट्थान की अकादजमक पररर्द"िीर्का के तहत”,- (क) क्रम संख्या 5 के सामने, "अध् यक्ष" ि्द के जलए, "अध्यक्ष" ि्द ही रखा िाएगा।; (ख) क्रम संख् या 9 और उससे संबंजधत प्रजर्वजियों के जलए, जनम्नजलजखत क्रम संख् या और प्रजर्वजियों को प्रजतस्ट्थाजपत यकया िाएगा, अथाात्:- “9. तीन प्रख् यात जिक्षाजर्वद जि‍ ह ेंअध्यक्ष द्वारा नाजमत यकया िाएगा सदस्ट्य

10. उप जनदेिक (स्नातकोत्तर) सदस्ट्य

11. संस्ट्थान के डीन अकादजमक सदस्ट्य –सजचर्व”;

(ii) उप-जर्वजनयम (6) को उप-जर्वजनयम (2) के रूप म ेंपुन: क्रमांयकत यकया िाएगा।

6. उि जर्वजनयमों म,ें जर्वजनयम 12 म,ें उप-जर्वजनयम (1) म,ें"संस्ट्थान कीअनुसंधान सजमजत (र्वज्ञै ाजनक सलाहकार)", िीर्ाक के तहत, क्रम संख्या 3 के सामन,े "अध् यक्ष" ि्द के स्ट्थान पर "जनदिे क" ि्द प्रजतस्ट्थ ाजपत यकया िाएगा।

7. उि जर्वजनयमों म,ें जर्वजनयम 14 म,ें उप-जर्वजनयम (1) म,ें 'संस्ट्थान की आयोिन और जनगरानी सजमजत'िीर्ाक के तहत, - (क) क्रम संख् या (2) और उससे सबं ंजधत प्रजर्वजियों के जलए, जनम्नजलजखत क्रम संख् या और प्रजर्वजियों को प्रजतस्ट्थाजपत यकया िाएगा, अथाात्:- “2. संस्ट्थान के पांच व्यजि जि‍ ह ें जनदेिक द्वारा नाजमत यकया िाएगा सदस्ट् य”;

8. उि जर्वजनयमों म,ें जर्वजनयम 15 म,ें उप-जर्वजनयम (1) के जलए, जनम्नजलजखत उप-जर्वजनयम प्रजतस्ट्थाजपत यकया िाएगा, अथाात:्- “(1) परीक्षा जनयंत्रण बोडा म ें जनम्नजलजखत सदस्ट्य होंग,े अथाात:्- सस्ट्ं थान का परीक्षा जनयत्रं ण बोडा

1. जनदेिक अध् यक्ष

2. डीन अकादजमक सदस्ट् य

3. चार जर्वभागाध् यक्ष जि‍ ह ेंअध् यक्ष द्वारा नाजमत यकया िाएगा सदस्ट् य

4. उप जनदेिक (स्नातकीय) सदस्ट् य

5. उप जनदेिक (फामेसी) सदस् य

6. उप जनदेिक (स्नातकोत्तर) सदस्ट् य

7. परीक्षा जनयंत्रक सदस्ट् य सजचर्व”।

9. उि जर्वजनयमों म,ें जर्वजनयम 16 म,ें उप-जर्वजनयम (1) के जलए, जनम्नजलजखत उप-जर्वजनयम प्रजतस्ट्थाजपत यकया िाएगा, अथाात:्- “(1) अस्ट्पताल प्रबंधन सजमजत म ें जनम्नजलजखत सदस्ट्य होंग,े अथाात:् - सस्ट्ं थान की अस्ट्पताल प्रबधं न सजमजत

1. जनदेिक अध् यक्ष

2. संस्ट्थान के जचयकत्सा अधीक्षक सदस्ट् य

3. संस्ट्थान के उप जचयकत्सा अधीक्षक सदस्ट् य

4. संस्ट्थान के प्रत्येक नैदाजनक जर्वभाग के प्रमुख सदस्ट् य

5. संस्ट्थान के रेजिडेंट मेजडकल ऑयफसर सदस्ट् य सजचर्व”।

10. उि जर्वजनयमों म,ें जर्वजनयम 17 के जलए,जनम्नजलजखत जर्वजनयम प्रजतस्ट्थाजपत यकया िाएगा, अथाात्:- “17. िाचं -सह-चयन सजमजत और कमचा ारी चयन सजमजतया.ं -(1)आयर्वु दे जिक्षण और अनसु धं ान सस्ट्ं थान के जनदेिक पद के जलए िाचं -सह-चयन सजमजत म ेंजनम्नजलजखत व्यजि होंग,े अथाता :्-

1. सजचर्व, आयुर् मंत्रालय, भारत सरकार अध् यक्ष

2. संस्ट्थान को देख रह े जर्विेर् सजचर्व या अजतररि सजचर्व या सदस्ट् य संयुि सजचर्व, आयुर् मंत्रालय, भारत सरकार

3. दो जर्वर्य जर्विेर्ज्ञ जि‍ हसें जचर्व, आयुर् मंत्रालय, भारत सरकार सदस्ट् य द्वारा नाजमत यकया िाएगा

(2) समूह -'क', प्रोफेसर और उप जनदेिक के पदों के जलए कमाचारी चयन सजमजत (सीधी भती और कैररयर प्रो‍ नयन स्ट् कीम पदोनतिजत पर जर्वचार करन े के जलए), में जनम्नजलजखत व्यजि होंग,े अथाात:् -

1. सजचर्व, आयुर् मंत्रालय, भारत सरकार अध् यक्ष संबंजधत जर्वर्य के जर्वख् यात जिक्षाजर्वदों में से दो जर्विेर्ज्ञ जि‍ह ें सजचर्व,

2. सदस्ट् य आयुर् मंत्रालय, भारत सरकार द्वारा नाजमत यकया िाएगा4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] अनसु ूजचत िाजत/अनुसूजचत िनिाजत/अ‍य जपछडा र्वगा पयार्वेक्षक जिसे

3. सदस्ट् य भारत सरकार द्वारा नाजमत यकया िाएगा

4. जनदेिक, आयुर्वेद जिक्षण एर्वं अनुसंधान संस्ट्थान सदस्ट् य सजचर्व

(3) उप-जर्वजनयम (2) में जर्वजनर्दिा पद के अलार्वा समूह-क, जिक्षण एर्वं गरै -जिक्षण पद की पदोनतिजत के जलए कमाचारी चयन सजमजत (सीधी भती और कैररयर प्रो‍ नयन स्ट् कीम पर जर्वचार करने के जलए) म ें जनम्नजलजखत व्यजि होंगे, अथाात:् - “1. जनदेिक, आयुर्वेद जिक्षण एर्वं अनुसंधान संस्ट्थान अध् यक्ष सबं ंजधत जर्वर्य के प्रख् यात जिक्षाजर्वदों में से एक जर्विेर्ज्ञ जिसे

2. सजचर्व, आयुर् मंत्रालय, भारत सरकार द्वारा नाजमत यकया सदस्ट् य िाएगा

3. सलाहकार (आयुर्वेद), आयुर् मत्रं ालय, भारत सरकार सदस्ट् य भारत सरकार द्वारा नाजमत अनुसूजचत िाजतयों, अनुसूजचत सदस्ट् य

4. िनिाजतयों और अ‍य जपछडे र्वगों से संबंजधत पयार्वेक्षक

5. उप जनदेिक (स्नातकोत्तर) सदस्ट् य सजचर्व”.

11. उि जर्वजनयमों में, जर्वजनयम 18 म,ें आरंजभक भाग के जलए, जनम्नजलजखत आरंजभक भाग प्रजतस्ट्थाजपत यकया िाएगा, अथाात:्- “जनदेिक, जर्वभागाध् यक्ष होगा और िजियों का प्रयोग करेगा और जनम्नजलजखत कताव्यों का जनर्वाहन करेगा, अथाात:्-”.

12. उि जर्वजनयमों म,ें जर्वजनयम 30 के जलए,जनम्नजलजखत जर्वजनयम प्रजतस्ट्थाजपत यकया िाएगा, अथाात्:- “30.पेंिन और भजर्वष्य जनजध - केंद्रीय जसजर्वल सेर्वा (पेंिन) जनयम, 1972 लागू होगा.”।

13. उि जर्वजनयमों म,ें जर्वजनयम 34 के जलए,जनम्नजलजखत जर्वजनयम प्रजतस्ट्थाजपत यकया िाएगा, अथाात्:- “34.जचयकत्सा सुजर्वधाएं - केंद्रीय सेर्वा (जचयकत्सा पररचर) जनयम, 1944 लागू होगा।.”. प्रोफे. (डॉ.) अनूप ठाकर, जनदेिक [जर्वज्ञापन-III/4/असा./520/2023-24] रटप्प णी – मूल जर्वजनयमों को यदनांक 10 यदसंबर, 2021 की अजधसूचना सं. एल-12015/18/2021-एएस द्वारा यदनांक 12 िनर्वरी, 2022 के भारत के रािपत्र, असाधारण, भाग III, धारा 4 म ें प्रकाजित यकए गए थे। INSTITUTE OF TEACHING AND RESEARCH IN AYURVEDA

NOTIFICATION Jamnagar, the 6th October, 2023 No. L-12015/18/2021-AS.—In exercise of the powers conferred by sub-section (1) of section 28 of the Institute of Teaching and Research in Ayurveda Act, 2020 (16 of 2020), the Institute of Teaching and Research in Ayurveda, with the previous approval of the Central Government, hereby makes the following regulations to amend the Institute of Teaching and Research in Ayurveda Regulations, 2021, namely:-

1. Short title and commencement.-(1) These regulations may be called the Institute of Teaching and Research in Ayurveda (Amendment) Regulations, 2023.

(2) They shall come into force on the date of their publication in the Official Gazette.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5

2. In the Institute of Teaching and Research in Ayurveda Regulations, 2021 (hereinafter referred to as the said regulations), in regulation 2,-

(i) for clause (b), the following clause shall be substituted, namely:- ‘(b) “Deputy Director” means the Deputy Director (Under graduate),Deputy Director (Post graduate) and Deputy Director (Pharmacy) appointed under sub-section (4) of section 11 of the Act;’;

(ii) clause (k)shall be omitted.

3. In the said regulations, in regulation 3,in the Table,serial number 8 and the entries relating thereto shall be omitted.

4. In the said regulations, in regulation 10, for sub-regulation (1), the following sub-regulation shall be substituted, namely:- “(1) The Financial Committee shall consist of the following members, namely:- FINANCE COMMITTEE OF INSTITUTE

1. Director Chairperson

2. Director/Deputy Secretary Member (dealing with the matter of Institute), Ministry of Ayush, Government of India

3. A Member of the Governing Body nominated by the President of the Member Institute

4. Director/Deputy Secretary; Integrated Finance Division, (dealing with the Member matter of Institute), Ministry of Ayush, Government of India

5. Adviser (Ayurveda), Ministry of Ayush, Government of India Member

6. Head of Accounts of the Institute Member Secretary”.

5. In the said regulations, in regulation 11,-

(i) in sub-regulation (1),under heading, “THE ACADEMIC COUNCIL OF INSTITUTE”,-

(a) against serial number 5, for the word, “President”, the word, “Chairperson”, shall be substituted;

(b) for serial number 9 and the entries relating thereto, the following serial numbers and entries shall be substituted, namely:- “9. Three renowned educationists to be nominated by Chairperson. Member

10. Deputy Director (Post Graduate). Member

11. The Dean Academic of Institute Member –Secretary”;

(ii) sub-regulation (6) shall be re-numbered as sub-regulation (2).

6. In the said regulations, in regulation 12, in sub-regulation (1), under heading, “RESEARCH COMMITTEE (SCIENTIFIC ADVISORY OF INSTITUTE”, against serial number 3, for the word, “President”, the word, ‘Director’ shall be substituted.

7. In the said regulations, in regulation 14, in sub-regulation (1), under heading, ‘PLANNING AND MONITORING COMMITTEE OF THE INSTITUTE’,-

(a) for serial number (2) and the entries relating thereto, the following serial number and entries shall be substituted, namely:- “2. Five persons from the Institute to be nominated by the Director Member”;

(b) against serial number 3, for the word, “President”, the word “Director” shall be substituted.

8. In the said regulations, in regulation 15, for sub-regulation (1), the following sub-regulation shall be substituted, namely:- “(1) The Examination Control Board shall consist of the following members, namely:- EXAMINATION CONTROL BOARD OF THE INSTITUTE

1. The Director Chairperson

2. The Dean Academic Member

3. Four Heads of the Department to be nominated by the President Members

4. Deputy Director (Under-Graduate) Member

5. Deputy Director (Pharmacy) Member

6. Deputy Director (Post-Graduate) Member

7. Controller of Examination Member Secretary”.

9. In the said regulations, in regulation 16,for sub-regulation (1), the following sub-regulation shall be substituted, namely:-6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] “(1) The Hospital Management Committee shall be consist of the following members, namely:- HOSPITAL MANAGEMENT COMMITTEE OF INSTITUTE

1. Director Chairperson

2. Medical Superintendent of the Institute Member

3. Deputy Medical Superintendent of the Institute Member

4. Head of every Clinical Department of the Institute Member

5. Resident Medical Officer of the Institute Member Secretary”.

10. In the said regulations, for regulation 17, the following regulation shall be substituted, namely:- “17. Search-cum-Selection Committeeand Staff Selection Committees.-(1)Search-cum-Selection Committee for the post of Director, Institute of Teaching and Research in Ayurveda shall consist of the following persons, namely:-

1. S ecretary, Ministry of Ayush, Government of India Chairperson

2. S pecial Secretary or Additional Secretary or Joint Secretary dealing with the Member Institute, Ministry of Ayush, Government of India

3. T wo subject experts to be nominated by Secretary, Ministry of Ayush, Member Government of India

(2) Staff Selection Committee (for considering direct recruitment and Career Advancement Scheme promotion) for Group–‘A’, posts of Professor and Deputy Director shall consist of the following persons, namely:-

1. S ecretary, Ministry of Ayush, Government of India Chairperson Two experts to be nominated by Secretary, Ministry of Ayush,

2. Member Government of India from renowned academicians of concerned subject Scheduled Caste/Scheduled Tribe/Other Backward Class observer to be

3. Member nominated by Government of India

4. D irector, Institute of Teaching and Research in Ayurveda Member Secretary

(3) Staff Selection Committee (for considering direct recruitment and Career Advancement Scheme) for promotion of Group –‘A’, teaching and non-teaching post other than post specified in sub- regulation (2) shall consist of the following persons, namely:-

1. Director, Institute of Teaching and Research in Ayurveda. Chairperson One expert to be nominated by Secretary, Ministry of Ayush,

2. Government of India from renowned academicians of concerned Member subject

3. Advisor (Ayurveda), Ministry of Ayush, Government of India Member Observer belonging to the Scheduled Castes, the Scheduled Tribes

4. Member and Other Backward Classes nominated by the Government of India

5. Deputy Director (Post Graduate) Member Secretary”.

11. In the said regulations, in regulation 18, for the opening portion, the following opening portion shall be substituted, namely:- “The Director shall be the Head of the Department and shall exercise the powers and discharge the following duties, namely:-”.

12. In the said regulations, for regulation 30, the following regulation shall be substituted, namely:- “30. Pension and Provident Fund.-Central Civil Services (Pension) Rules, 1972 would be applicable.”.

13. In the said regulations, for regulation 34, the following regulation shall be substituted, namely:- “34. Medical Facilities.-Central Services (Medical Attendance) Rules, 1944 would be applicable.”.
