1. संजिप् त नाम और प्रारंभ ।

(1) इन जवजनयमों का संजिप् त नाम भारतीय प्रजतस्ट् पधा ा आयोग (धनीय िाजस्ट्त की वसूली की रीजत) जवजनयम, 2025 ह।ै

(2) ये रािपत्र म ेंइनके प्रकािन की तारीख स े प्रवृत् त होंगे ।

2. पठरभाषाए ं ।

(1) इन जवजनयमों म,ें िब तक दक संिभा स े अन् यथा अपेजित न हो,— 1422 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (क) “अजधजनयम” से प्रजतस्ट् पधा ाअजधजनयम, 2002 (2003 का 12) अजभप्रेत ह;ै (ख) “आयोग” स े अजधजनयम की धारा 7 की उपधारा (1) के अधीन स्ट्थ ाजपत भारतीय प्रजतस्ट् पधा ा आयोग अजभप्रेत ह;ै (ग) “मांग सूचना-पत्र” स े आयोग द्वारा दकसी ऐसे उद्यम को िारी कोई सूचना-पत्र अजभप्रेत ह ैजिससे अजधजनयम के अधीन कोई िाजस्ट्त वसूलनीय ह;ै (घ) “उद्यम” स ेअजधजनयम की धारा 2 के खडं (ि) म ें यथापठरभाजषत उद्यम अजभप्रते ह;ै (ङ) “व् यजतक्रमी उद्यम” स े कोई ऐसा उद्यम अजभप्रेत ह ै जिसन े अपने ऊपर सम् यक रूप स े मांग सूचना-पत्र तामील दकए िाने के बाविूि जनयत समय के अिं र अपने ऊपर अजधरोजपत िाजस्ट्त का संिाय नहीं दकया ह;ै (च) “आय-कर प्राजधकारी” स े आय-कर अजधजनयम, 1961 (1961 का 43) की धारा 116 म ें यथापठरभाजषत कोई अजधकारी अजभप्रेत ह;ै (छ) “जवजधक वाठरस” स े नागठरक प्रदक्रया संजहता, 1908 की धारा 2 की उपधारा (11) म ें यथापठरभाजषत कोई जवजधक प्रजतजनजध अजभप्रेत ह;ै (ज) “िाजस्ट्त” स े आयोग द्वारा अजधरोजपत और अजधजनयम के अधीन वसूली योग् य कोई धनीय िाजस्ट्त या िुमााना या कोई अन् य राजि अजभप्रेत ह;ै (झ) “िाजस्ट्त वसूली रजिस्ट् टर” स े इन जवजनयमों के संलग् न संलग्न प्ररूप IV म ेंयथाअजधकजथत रजिस्ट् टर अजभप्रेत ह ै जिसम ें आयोग द्वारा अजधरोजपत िाजस्ट्तयों के सभी ब् यौरे अंतर्वष्ा ट ह;ै (ञ) “व् यजि” स ेअजधजनयम की धारा 2 के खडं (1) म ें यथापठरभाजषत कोई व् यजि अजभप्रेत ह;ै (ट) “व् यजतक्रमी व् यजि” स े कोई ऐसा व् यजि अजभप्रेत ह ैजिसन े अपने ऊपर सम् यक रूप स े मांग सूचना-पत्र तामील दकए िाने के बाविूि जनयत समय के अिं र अपने ऊपर अजधरोजपत िाजस्ट्त का संिाय नहीं दकया ह;ै (ठ) “वसूली प्रमाणपत्र” स े आयोग द्वारा िारी दकया गया और उसके आिेिों के जनबंधनों के अनुसार वसलू ी अजधकारी द्वारा जनष्प ादित दकए िाने वाला प्रमाणपत्र अजभप्रते ह;ै (ड) “वसूली अजधकारी” स,े यथाजस्ट्थजत, उद्यम या व् यजि या ‘व् यजतक्रमी उद्यम’ या ‘व् यजतक्रमी व् यजि’ स े िाजस्ट्त की वसूली के जलए आयोग द्वारा प्राजधकृत, इन जवजनयमों म ें यथाजपभाजषत कोई अजधकारी अजभप्रेत ह;ै (ढ) “सजचव” स े अजधजनयम की धारा 17 की उपधारा (1) के अधीन जनयुक्त सजचव अजभप्रते ह ै और जिसके अंतगता आयोग द्वारा सजचव के रूप म ेंकाय ा करन े के जलए प्राजधकृत उसका कोई अजधकारी भी ह;ै (ण) “कर वसूली अजधकारी” स े अजधजनयम की धारा 39 के स्ट् पष्ट ीकरण म ें यथाजनर्िाष् ट और आय-कर अजधजनयम, 1961 (1961 का 43) की धारा के खंड (44) म ेंपठरभाजषत कर वसूली अजधकारी अजभप्रेत ह;ै

(2) इन जवजनयमों म ें प्रयुक्त ऐस े िब् िों और पिों का, िो पठरभाजषत ह,ैं क्रमि: वही अथ ा होगा िो उनका यथाजस्ट्थजत, अजधजनयम या कंपनी अजधजनयम, 1956 (1956 का 1) या आय-कर अजधजनयम, 1961 (1961 का

43) म ेंह ै।

3. मांग सूचना-पत्र का िारी दकया िाना ।

(1) िहां आयोग द्वारा दकसी उद्यम या व् यजि पर कोई िाजस्ट्त अजधरोजपत की गई ह,ै वहा ं सजचव आयोग को ज्ञात उसके अंजतम पते पर, िाजस्ट्त अजधरोजपत करन े वाले आयोग द्वारा पाठरत दकए गए आिेि की प्रजत सजहत, वसूली अजधकारी की प्रजत के साथ इन जवजनयमों के संलग्न प्ररूप I म ें यथाअजधकजथत मांग सूचना-पत्र िारी करेगा।

(2) उपजवजनयम (1) के अधीन िारी दकया गया मांग सूचना-पत्र संबद्ध उद्यम या व् यजि को उक् त मांग सूचना-पत्र म ें जवजनर्िाष् ट रीजत म ें िाजस्ट्त का जनिेप करने के जलए आयोग के आिेि की प्राजि की तारीख स े 60 (साि) दिन स े अनजधक का समय िगे ा ।

(3) मांग सूचना-पत्र की प्राजि पर, यथाजस्ट्थजत, उद्यम या व् यजि इन जवजनयमों म ें सलं ग् न प्ररूप II म ें यथाअजधकजथत चालान के माध्य म स े वेतन और लेखा अजधकारी (पीएओ), कारपोरेट काय ा मत्रं ालय, िीष ा स.ं[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3

1475.00.105.05, [उपिीषा – 00] – ‘भारतीय प्रजतस्ट् पधा ा आयोग द्वारा अजधरोजपत िांजस्ट्तयां’ के पि म ें िाजस्ट्त का संिाय करेगा ।

(4) यथाजस्ट्थजत, उद्यम या व् यजि द्वारा चालान की एक प्रजत तत्क ाल, परंतु संिाय के 07 (सात) दिन के अपश् चात,् वसूली अजधकारी को प्रस्ट् तुत की िाएगी और वसूली अजधकारी िाजस्ट्त वसूली रजिस्ट् टर म ें इस आिय की प्रजवजि करेगा।

(5) आयोग दकसी भी समय मांग सचू ना-पत्र म ेंहुई दकसी जलजपकीय या गजणतीय भलू को सुधार सकेगा ।

4. समय का जवस्ट् तार और दकस्ट् तों की मंिूरी ।

(1) मांग सूचना-पत्र म ें जवजनर्िाष् ट संिाय की सम् यक तारीख के अवसान स े पूवा संबद्ध उद्यम या व् यजि द्वारा दकए गए आवेिन पर, आयोग ऐसी ितों के अध् ययीन जिन् ह ें आयोग मामल े की पठरजस्ट्थजतयों म ें अजधरोजपत करना उजचत समझे, संिाय के समय को जवस्ट् ताठरत कर सकेगा या दकस्ट्त ों द्वारा संिाय को अनुज्ञात कर सकेगा।

(2) उस ििा म ें िहा ं कोई जवस्ट् तारण मंिरू दकया गया ह ै और संबद्ध उद्यम या व् यजि इस प्रकार जवस्ट् ताठरत समय के भीतर संिाय करन े म ें असफल रहता ह ै वहां संबद्ध उद्यम या व् यजि को, यथाजस्ट्थजत व् यजतक्रमी उद्यम या व् यजतक्रमी व् यजि समझा िाएगा ।

(3) उस ििा म ें िहां दकस्ट् तों का संिाय को अनज्ञु ात दकया गया ह ै और संबद्ध उद्यम या व् यजि जनयत समय के भीतर दकसी ज्ञी एक दकस्ट् त के संिाय म ें व् यजतक्रम करता ह,ै वहा ं संबद्ध उद्यम या व् यजि को तत्स मय पणू ा बकाया िाजस्ट्त के संबंध म,ें यथाजस्ट्थजत, व् यजतक्रमी उद्यम या व् यजतक्रमी व् यजि समझा िाएगा और अन् य दकस्ट्त या दकस्ट् तों को भी उसी तारीख को िये हुआ समझा िाएगा जिसको दकस्ट् त के संिाय म ें वस्ट् ततु : व् यजतक्रम हुआ था ।

5. िाजस्ट्त पर ब् याि । यदि दकसी मांग सूचना-पत्र म ें जवजनर्िाष् ट रकम का आयोग द्वारा जवजनर्िाष् ट अवजध के भीतर संिाय नहीं दकया गया ह,ै तो यथाजस्ट्थजत, संबद्ध उद्यम या व् यजि, मागं सूचना-पत्र म ें वर्णात अवजध के अवसान के िीक पश् चात् वाले दिन स े प्रारंभ होने वाली और उस दिन के साथ जिसको िाजस्ट्त का संिाय दकया गया ह,ै समाप् त होने वाली अवजध म ें समाजवष्ट प्रत् यके मास या मास के भाग के जलए एक प्रजतित की िर स ेसाधारण ब् याि का संिाय का िायी होगा:

परंत ु आयोग संबद्ध उद्यम या व्य जि द्वारा संिेय ब् याि की रकम को घटा सकेगा या अजधत् यक्त कर सकेगा यदि उसका यह समाधान हो िाता ह ै दक ऐसी रकम के संिाय म ें व् यजतक्रम ऐसी पठरजस्ट्थजतयों के कारण था िो यथाजस्ट्थजत, संबद्ध उद्यम या व् यजि के जनयंत्रण स े बाहर थी:

परंत ु यह और दक िहां, यथाजस्ट्थजत, राष्र ीय कंपनी जवजध अपील अजधकरण या उच् च न् यायालय या भारत के उच् च न् यायालय के दकसी आििे के पठरणामस्ट् व्रू प, संिेय िाजस्ट्त की रकम को घटा दिया गया था, वहा ं ब् याि को तिनुसार घटा दिया िाएगा और अजतठरक्त संित् त ब् याि का, यदि कोई हो, जवजनयम 14 के अनुसार प्रजतिाय दकया िाएगा।

6. वसूली प्रमाणपत्र िारी करना ।

(1) िहां कोई उद्यम व् यजतक्रमी उद्यम ह,ै या िहां उस े जवजनयम 4 के उपजवजनयम (2) और/या (3) के अनुसार व् यजतक्रमी उद्यम समझा िाता ह,ै वहा ं आयोग इन जवजनयमों के साथ सलं ग् न प्ररूप III म ें यथाअजधकजथत वसूली अजधकारी द्वारा जनष्प ाजपत दकए िान े वाल े वसूली प्रमाणपत्र को सजचव के माध् यम स े िारी करेगा जिसम ें वसूली की रीजतयों के साथ िाजस्ट्त की रकम और उस पर ब् याि वर्णता होगा और िाजस्ट्त का जनिपे करने के जलए 15 (पंद्रह) दिन का समय दिया िाएगा।

(2) िहां कोई व् यजि व् यजतक्रमी व्य जि ह,ै या िहां उसे जवजनयम 4 के उपजवजनयम (2) और/या (3) के अनुसार व् यजतक्रमी व् यजि समझा िाता ह,ै वहा ं आयोग इन जवजनयमों के साथ संलग् न प्ररूप III म ें यथाअजधकजथत वसूली अजधकारी द्वारा जनष्प ाजपत दकए िान े वाल े वसूली प्रमाणपत्र को सजचव के माध् यम स े िारी करेगा जिसम ें वसूली की रीजतयों के साथ िाजस्ट्त की रकम और उस पर ब् याि वर्णता होगा और िाजस्ट्त का जनिपे करने के जलए 15 (पंद्रह) दिन का समय दिया िाएगा ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(3) आयोग, दकसी भी समय िारी दकए गए वसूली प्रमाणपत्र म ें हुई दकसी जलजपकीय या गजणतीय भूल को िीक कर सकेगा या ऐसे वसूली प्रमाणपत्र के अनुसरण म ें दकए गए िान े वाले दकसी संिाय के जलए समय का जवस्ट् तार कर सकेगा।

7. वसूली अजधकारी के काया ।

(1) आयोग इन जवजनयमों के प्रयोिनों के जलए समय-समय पर अपने दकसी भी अजधकारी को इन जवजनयमों के अधीन जवजनर्िाष् ट रीजत म ें िाजस्ट्तयों को वसलू करन े के जलए वसूली अजधकारी के रूप म ें काय ा करन े के जलए प्राजधकृत कर सकेगा।

(2) वसूली अजधकारी यह सुजनजित करेगा दक मांग सूचना-पत्र सम्य क रूप स,े यथाजस्ट्थजत, संबद्ध उद्यम या व् यजि पर तामील दकया गया ह।ै मांग सूचना-पत्र के तामील नहीं दकए िाने की ििा म ें वसूली अजधकारी तुरंत सजचव को सूजचत करेगा।

(3) संबद्ध उद्यम या व् यजि द्वारा िांजत का संिाय कर दिए िाने के पश् चात ् वसूली अजधकारी सजचव को इसकी सूचना िगे ा। संबद्ध उद्यम या व् यजि द्वारा व् यजतक्रम की ििा म ें वह सजचव को संसूजचत करेगा और उसके पश् चात्, यथाजस्ट्थजत, ऐसे व् यजतक्रमी उद्यम या व् यजि को वसूली प्रमाणपत्र िारी करना सुजनजित करेगा।

(4) वसूली अजधकारी, यथाजस्ट्थजत, व् यजतक्रमी उद्यम या व् यजतक्रमी व् यजि के ऊपर अजधरोजपत िाजस्ट्त की रकम को वसूल करन े के जलए इन जवजनयमों म ें जवजनर्िाष् ट रीजत म ेंवसूली प्रमाणपत्र जनष्प ादित करेगा।

(5) वसूली प्रमाणपत्र जनयत अवजध के समाजि के पश् चात् वसलू ी अजधकारी, इन जवजनयमों के अधीन जवजनर्िाष् ट रीजत के अनुसार अजधरोजपत िाजस्ट्त की वसूली के जलए कायावाही करेगा।

8. िाजस्ट्त वसूली रजिस्ट् टर का रखा िाना । वसूली अजधकारी इन जवजनयमों म ें संलग्न प्ररूप IV में यथाअजधकजथत िाजस्ट्त वसूली रजिस्ट् टर संधाठरत करेगा और जनयजमत रूप स े िाजस्ट्त वसूली रजिस्ट् टर का अद्यतन करेगा।

9. वसूली की रीजतयां । िहा ं व् यजतक्रमी उद्यम या व् यजतक्रमी उद्यम व् यजि वसूली प्रमाणपत्र म ें यथावर्णात जनयत समय के भीतर िाजस्ट्त के संिाय म ें असफल रहता ह,ै तो वसूली अजधकारी िाजस्ट्त को वसूल करन े के जलए जनम्न जलजखत रीजत म ें कायावाही करेगा,– (क) वसूली अजधकारी वसलू ी प्रमाणपत्र के िारी दकए िाने के पश्च ात ् दकसी भी समय दकसी ऐसे व् यजतक्रमी उद्यम या व् यजतक्रमी उद्यम व् यजि, जिससे िाजस्ट्त िये ह ै या िये हो सकेगी या दकसी ऐसे अन् य उद्यम िो व् यजतक्रमी उद्यम के जलए या उसके लेख े धन रखता ह ै या तत्प श् चात् रख सकेगा या व् यजतक्रमी व् यजि की मृत् य ु हो िान े की ििा म ें व् यजतक्रमी व् यजि का जवजधक वाठरस से आयोग को तत्क ाल िाजस्ट्त के िये हो िाने पर या वसूली प्रमाणपत्र म ें जवजनर्िाष् ट समय के भीतर उतन े धन के संिाय की अपेिा कर सकेगा जितना िाजस्ट्त के संबंध म,ें यथाजस्ट्थजत, व् यजतक्रमी उद्यम या व् यजतक्रमी उद्यम व् यजि स े िये िाजस्ट्त के संिाय के जलए पयााप् त ह।ै यदि ऐसा अन् य उद्यम या जवजधक वाठरस(वाठरसगण) िाजस्ट्त के बिल े म ें उक्त रकम के संिाय म ें असफल रहता ह/ैरहत े ह ैं तब ऐसे उद्यम के साथ भी उसी रीजत म ें व् यवहार दकया िाएगा िैसा यथाजस्ट्थजत, व् यजतक्रमी उद्यम या व् यजतक्रमी उद्यम व् यजि के साथ दकया िाता ह;ै (ख) वसूली प्रमाणपत्र दकसी भी ऐसे उद्यम को िारी दकया िाएगा िो व् यजतक्रमी उद्यम के जलए या उसके लखे े दकसी अन् य उद्यम के साथ संयुक् त रूप स े कोई धन रखता ह ै या तत्पश् चात् रख सकेगा और इस जवजनयम के प्रयोिनों के जलए ऐस े खाते म ें संयुक् त धारकों के अिं ों को, िब तक इसके प्रजतकूल साजबत नहीं हो िाता ह,ै बराबर माना िाएगा;

(ग) व् यजतक्रमी व् यजि की मृत् य ु हो िाने की ििा म ें वसूली प्रमाणपत्र, व् यजतक्रमी व् यजि के जवजधक वाठरस को िारी दकया िाएगा और इस जवजनयम के प्रयोिनों के जलए ऐसी रकम के जलए सभी जवजधक वाठरसों के अंिों को, िब तक ‘इसके प्रजतकूल साजबत नहीं हो िाता ह’ै, बराबर माना िाएगा;

परंतु यह दक इस जवजनयम के अधीन जवजधक वाठरस का िाजयत् व, उस सीमा तक सीजमत होगा िहां मृतक की संपिा, ऐसे जवजधक वाठरस को प्रित् त की गई ह,ै िो िाजयत्व की पूर्ता करने म ें सिम ह।ै[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 (घ) प्रत् यके उद्यम या व् यजि जिसे वसूली प्रमाणपत्र िारी दकया िाता ह,ै ऐस े प्रमाणपत्र का अनुपालन करन े को आबद्ध होगा और, जवजिष्ट या, िहां ऐसी कोई सूचना दकसी डाकघर, बैंककंग कंपनी या दकसी बीमाकता ा को िारी की िाती ह,ै तो दकसी प्रजतकूल जनयम, प्रथा या अपिे ा के होते हुए भी, दकसी प्रजवजि, पृष्ि ाकं न या संिाय दकए िान े के पूवा वैसी ही चीिों के जलए दकसी पास बुक, जनिेप रसीि, पॉजलसी या दकसी अन् य िस्ट् तावेि को प्रस्ट्त ुत करन े की आवश् यकता नहीं होगी;

(ङ) दकसी ऐसी संपजि के जवषय म,ें जिसके संबंध में वसूली प्रमाणपत्र िारी दकया गया िाता ह,ै मांग सूचना-पत्र की तारीख के पश् चात ् उद्भूत होने वाला कोई िावा वसूली प्रमाणत्र म ें अतं र्वाष्ट दकसी मांग के जवरुद्ध िून् य होगा;

(च) िहां कोई ऐसा उद्यम या व् यजि जिस े वसूली प्रमाणपत्र िारी दकया िाता ह,ै िपथ पर कथन द्वारा उस पर आिेप करता ह ैदक मांगी गई राजि या उसका कोई भाग व् यजतक्रमी उद्यम या व् यजतक्रमी व् यजि पर िये नहीं या वह व् यजतक्रमी उद्यम या व् यजतक्रमी व् यजि के जलए उसके लेख े कोई धन नहीं रखता ह,ै तब, यथाजस्ट्थजत, इन जवजनयमों म ें अंतर्वाष्ट दकसी बात स े यह नहीं समझा िाएगा दक ऐसे उद्यम या व् यजि स,े यथाजस्ट्थजत, ऐसी दकसी राजि या उसके भाग का संिाय अपेजित ह:ै परंत ु यह दक उद्यम या व् यजि का ऐसा िावा आयोग के जवचाराथा उसके संज्ञान म ेंलाया िाएगा;

(छ) वसूली अजधकारी उस न् यायालय को, जिसकी अजभरिा म ें व्य जतक्रमी उद्यम या व् यजतक्रमी व् यजि का धन ह,ै ऐसे उद्यम या व् यजि स े िये िाजस्ट्त के उन् मोचन के जलए पयााप् त रकम के संिाय के जलए आवेिन कर सकेगा;

(ज) िहां दकसी व् यजतक्रमी उद्यम या व् यजतक्रमी व् यजि के पास भारत स े बाहर दकसी ििे (िो ऐसा ििे ह ै जिसके साथ भारत सरकार ने अजधजनयम के अधीन और उस ििे म ें तत्स मय प्रवृत् त जवजध के अधीन िाजस्ट्त की वसूली के जलए करार दकया ह)ै म ें संपजि ह,ै वहा ं आयोग उस ििे म ें उस पर ऐसी कारावाई करन े का प्रस्ट् ताव करेगा िो आयोग, उस ििे के साथ उक्त करार की ितों को ध् यान म ें रखते हुए, समुजचत समझ े और इस प्रकार वसूल की गई दकसी राजि को आयोग को जवप्रेजषत करेगा और उसके पश्च ात् सजचव उस रकम को इस प्रयोिन के जलए जनजित खाते म ेंिमा करने के जलए समुजचत उपाय करेगा;

(झ) िहां दकसी कायावाही के लंजबत रहने के िौरान या अजधजनयम के अधीन जवजनश् चय के पश् चात ्परंतु जवजनयम 3 के अधीन सूचना-पत्र को तामील दकए िाने स े पूवा, कोई व् यजतक्रमी उद्यम या व् यजतक्रमी व् यजि दकसी प्रभार का सृिन करता ह ै या जवक्रय, बंधक, िान, जवजनयम के िरा या अंतरण दकसी भी अन् य रीजत स े अपनी दकन् हीं आजस्ट्तयों को दकसी अन् य व् यजि या उद्यम के पि म ेंअपने कब् ि े स े अलग करता ह,ै वहा ं ऐसा प्रभार या अतं रण, उक्त काय्रवाही के जवजनश् चय के पठरणामस्ट् वरूप या अन् यथा ऐस े व् यजतक्रमी उद्यम या व् यजतक्रमी व् यजि द्वारा संिेय दकसी िाजस्ट्त के संबंध म ेंदकसी िाव े के जवरुद्ध िून् य होगा:

परंत ु यह दक ऐसा प्रभार या अतं रण िून् य नहीं होगा यदि उस,े–

(i) पयााप् त प्रजतफल के जलए और ऐसी कायावाही के लंजबत होने की सूचना के जबना, या;

(ii) आयोग की पूवा अनुज्ञा स ेदकया गया है ।

10. वसूली की अन् य रीजतयां । िहा ं व् यजतक्रमी उद्यम या व् यजतक्रमी व् यजि वसूली प्रमाणपत्र म ें यथावर्णात जनयत समय के भीतर िाजस्ट्त के संिाय म ें असफल रहता ह,ै वहा ं वसूली अजधकारी, आय-कर अजधजनयम, 1961 (1961 का 43) की िसू री अनुसूची म ें अजधकजथत जनयमों के अनुसार िाजस्ट्त की राजि को वसूल करने के जलए जनम्न वर्णात रीजतयों के माध् यम स े भी साथ- साथ कायावाही कर सकेगा, अथाात्:–

(a) संबद्ध उद्यम या व् यजि की िगं म संपजि की कुकी और जवक्रय द्वारा; और

(b) संबद्ध उद्यम या व् यजि की स्ट् थावर संपजि की कुकी और जवक्रय द्वारा।

11. आयोग द्वारा आय-कर प्राजधकारी को प्रजतजनििे ।

(1) िहां आयोग की, लेखबद्ध दकए िाने वाल े कारणों स े यह राय ह ै दक इस अजधजनयम के अधीन अजधरोजपत िाजस्ट्त को, आय-कर अजधजनयम, 1961 (1961 का 43) के उपबंधों के अनुसरण म,ें वसलू करना समीचीन होगा, तब वह, आय-कर अजधजनयम, 1961 (1961 का 43) के अधीन ‘िये कर’ के रूप म ेंिाजस्ट्त की वसूली के6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] जलए इन जवजनयमों के संलग्न प्ररूप V म ें यथाअजधकजथत अनुसार, संबंजधत आय-कर प्राजधकारी को अजधजनयम की धारा 39 की उपधारा (2) के अधीन प्रजतजनििे करेगा ।

(2) िहां आय-कर प्राजधकारी, जिसको उपजवजनयम (1) के अधीन आयोग द्वारा प्रजतजनिेि दकया गया ह,ै वसूली कायावाही संजस्ट्थत करता ह,ै वहा ं आयोग द्वारा संजस्ट्थत की गई वसूली कायावाही अजनजित काल के जलए आस्ट्थ जगत हो िाएगी ।

12. आय-कर प्राजधकारी द्वारा वसूली की संसूचना ।

(1) िहां सजचव को कर वसूली अजधकारी स े िाजस्ट्त की वसूली की संसूचना प्राप् त हो गई ह,ै वहा ं वह सुजनजित करगा दक वसूली अजधकारी को तुरंत, परंतुत ऐसी सूचना प्राप् त हो िाने की तारीख स े 05 (पांच) दिन के अपश् चात, िाजस्ट्त वसूली रजिस्ट्ट र म ेंलेखबद्ध करे।

(2) सजचव, कर वसूली अजधकारी स े तीन मास म ें न् यनू तम एक बार कर वसूली अजधकारी को जनर्िाष् ट मांगों की वसूली की प्रगजत का पुनर्वालोकन और प्रजगत ठरपोटा अजभप्राप् त सकेगा और िाजस्ट्त की वसूली की प्रजगत को हर माह आयोग के समि रखेगा ।

13. िाजस्ट्त की वसूली की कायावाजहयों का अनुश्रवण और पयावेिण । सजचव उन सभी मामलों को, िहां िाजस्ट्त की वसूली नहीं की गई ह,ै प्रत् यके मामल े म ें ही गई कारावाई के ब् यौरों, जिसकें अंतगता अजधजनयम की धारा 39 की उपधारा (2) के अधीन दिए गए प्रजतजनििे भी ह,ैं के साथ आयोग के समि कम स े कम एक मास म ेंएक बार रखगे ा ।

14. िाजस्ट्त आजधक् य का प्रजतिाय.

(1) िहां, यथाजस्ट्थजत, राष्र ीय कंपनी जवजध अपील अजधकरण या उच् च न् यायालय या भारत के उच् चतम न् यायालय के दकसी आििे के पठरणामस्ट् वरूप, यह अजभजनधााठरत दकया गया ह ै दक उद्यम या व् यजि दकसी िाजस्ट्त के संिाय के जलए िायी नहीं ह ै या दकसी आिेि या सूचना म ें उजल्लजखत रकम स े कम िाजस्ट्त के संिाय के जलए िायी ह,ै वहा ं मागं सूचना-पत्र या वसूली प्रमाणपत्र को, यथाजस्ट्थजत, वापस जलया िाएगा या पठरवर्तता दकया िाएगा और अजधक संित् त की गई िाजस्ट्त की रकम का, यदि संिाय दकया गया ह ैतो प्रजतिाय दकया िाएगा ।

(2) प्रजतिाय की ििा म,ें सजचव अपन े हस्ट्त ािर और मुद्रा के अधीन ऐसी रकम के जलए प्रजतिाय आिेि िारी करेगा ।

15. कजतपय पठरजस्ट्थजतयों में प्रदक्रया अवधाठरत करन े की िजि । ऐसी जस्ट्थजत म,ें जिसका उपबंध इन जवजनयमों या भारतीय प्रजतस्ट् पधा ा आयोग (साधारण) जवजनयम, 2024 म ें नहीं दकया गया ह,ै आयोग जवजनर्िाष्ट मामलों म,ें यदि ऐसा अपेजित हो, प्रदक्रया अवधाठरत कर सकेगा।

16. कठिनाईयों को िरू करना । इन जवजनयमों के दक्रयान् वयन के मामले म ें यदि कोई िंका या कठिनाई उिभूत होती ह,ै तो उस पर आयोग का जवजनश् चय बाध् यकरी होगा ।

17. जनरसन और व् यावृजियां ।

(1) भारतीय प्रजतस्ट्प धाा आयोग (धनीय िाजस्ट्त की वसलू ी की रीजत) जवजनयम, 2011, उस तारीख स े जनरस्ट्त हो िाएंगे जिस तारीख को ये जवजनयम प्रवृत् त होंगे ।

(2) ऐसे जनरसन म ें दकसी बात के होते हुए भी, – (क) ऐस े जनरसन स े पूवा, जनरजसत दकए गए जवजनयमों के अधीन, दकया गया कुछ भी या की गई या दकया िाना या की गई तात् पर्यात कोई कारावाई, या िारी की गई कोई सूचना या प्रमाणपत्र, आरंभ की गई कायावाजहयां, इन जवजनयमों के तत्स्ट् थानी उपबंधों के अधीन दकया गया या जलया गया समझा िाएगा;

No. CCI/Reg.-R.R./2024-25.— In exercise of the powers conferred by clause (g) of the sub-section (2) of section 64 read with section 36 and sub-section (1) of section 39 of the Competition Act, 2002 (12 of 2003), the Competition Commission of India hereby makes the following regulations to specify the manner of recovery of monetary penalty, namely:–

1. Short title and commencement.

(1) These regulations may be called the Competition Commission of India (Manner of Recovery of Monetary Penalty) Regulations, 2025.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.

(1) In these regulations, unless the context otherwise requires,–

(a) “Act” means the Competition Act, 2002 (12 of 2003);

(b) “Commission” means the Competition Commission of India established under sub-section (1) of section 7 of the Act;

(c) “demand notice” means a notice issued by the Commission to an enterprise or a person from whom any penalty is recoverable under the Act;

(d) “enterprise” means enterprise as defined in clause (h) of section 2 of the Act;

(e) “enterprise in default” means an enterprise which has not paid the penalty imposed on it within the stipulated time despite the demand notice duly served upon;

(f) “Income-tax authority” means an authority as defined in section 116 of the Income-tax Act, 1961 (43 of

1961);

(g) “legal heir” means a legal representative as defined in sub-section (11) to section 2 of the Code of Civil Procedure, 1908;

(h) “penalty” means a monetary penalty or fine or any other sum imposed by the Commission and realisable under the Act;

(i) “penalty recovery register” means the register as set out in Form IV appended to these regulations containing all the details of the penalties imposed by the Commission;

(j) “person” means a person as defined in clause (l) of section 2 of the Act;

(k) “person in default” means a person who has not paid the penalty imposed upon it within the stipulated time despite the demand notice duly served upon;

(l) “recovery certificate” means a certificate issued by the Commission and to be executed by the recovery officer in terms of the Commission’s orders;

(m) “recovery officer” means an officer authorised by the Commission to recover the penalty from an enterprise or person or ‘enterprise in default’ or ‘person in default’, as the case may be, as defined under these regulations;

(n) “Secretary” means the Secretary appointed under sub-section (1) of section 17 of the Act and includes an officer of the Commission authorised by it to function as Secretary;

(o) “Tax Recovery Officer” means the Tax Recovery Officer as referred to in Explanation 2 to section 39 of the Act and defined in clause (44) of section 2 of the Income-tax Act, 1961 (43 of 1961).[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 13

(2) Words and expressions used but not defined in these regulations shall have the same meanings respectively assigned to them in the Act or in the Companies Act, 2013 (18 of 2013) or in the Income-tax Act, 1961 (43 of 1961), as the case may be.

3. Issuance of demand notice.

(1) Where a penalty has been imposed upon an enterprise or person by the Commission, the Secretary shall issue to it, a demand notice as set out in Form I appended to these regulations with a copy to the recovery officer, along with copy of the order passed by the Commission imposing the penalty, at its last address known to the Commission.

(2) A demand notice issued under sub-regulation (1) shall provide a time period of not less than 60 (sixty) days from the date of receipt of order of the Commission to the enterprise or person concerned, to deposit the penalty in the manner specified in the said notice.

(3) Upon receipt of the demand notice, the enterprise or the person, as the case may be, shall pay the penalty, through challan as set out in Form II appended to these regulations, in favour of the Pay & Accounts Officer (PAO), Ministry of Corporate Affairs, Head No. 1475.00.105.05, [Sub-Head – 00] – ‘Penalties imposed by Competition Commission of India’.

(4) One copy of the challan shall be submitted by the enterprise or the person, as the case may be, to the recovery officer immediately but not later than 07 (seven) days of the payment and the recovery officer shall make an entry in the penalty recovery register to the same effect.

(5) The Commission may, at any time, rectify any clerical or arithmetical mistake made in the demand notice.

4. Extension of time and grant of instalments.

(1) On an application made by the enterprise or the person concerned, before the expiry of the due date of the payment specified in the demand notice, the Commission may extend the time for payment or allow payment by instalments, subject to such conditions as the Commission may think fit to impose in the circumstances of the case.

(2) In a case where an extension has been granted and the enterprise or the person concerned fails to make the payment within the time so extended, the enterprise or the person concerned shall be deemed to be an enterprise in default or a person in default, as the case may be.

(3) In a case where payment by instalments has been allowed and the enterprise or the person concerned commits default in paying any one of the instalments within the time fixed, the enterprise or the person concerned shall be deemed to be enterprise in default or a person in default, as the case may be, as to the whole of the penalty then outstanding, and the other instalment or instalments shall also be deemed to have been due on the same date as the instalment actually in default.

5. Interest on penalty.

If the amount specified in the demand notice is not paid within the period specified in the said notice, the enterprise or the person concerned, as the case may be, shall be liable to pay simple interest at one per cent, on the amount outstanding, for every month or part of a month comprised in the period commencing from the day immediately after the expiry of the period mentioned in demand notice and ending with the day on which the

penalty is paid:

Provided that the Commission may reduce or waive the amount of interest payable by the enterprise or the person concerned if it is satisfied that default in the payment of such amount was due to circumstances beyond the control of the enterprise or the person concerned, as the case may be:

Provided further that where as a result of an order of the National Company Law Appellate Tribunal or a High Court or the Supreme Court of India, as the case may be, the amount of penalty payable has been reduced, the interest shall be reduced accordingly and the excess interest paid, if any, shall be refunded in accordance with regulation 14.

6. Issuance of recovery certificate.

(1) Where an enterprise is an enterprise in default or deemed to be an enterprise in default as per sub- regulation (2) and/ or (3) of regulation 4, the Commission shall issue recovery certificate through the Secretary to be executed by the recovery officer, as set out in Form III appended to these regulations, mentioning the amount of penalty and interest thereon along with modes of recovery therein, giving 15

(fifteen) days’ time to deposit the penalty.

(2) Where a person is a person in default or deemed to be a person in default as per sub-regulation (2) and/ or

(3) of regulation 4, the Commission shall issue recovery certificate through the Secretary to be executed14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] by the recovery officer, as set out in Form III appended to these regulations, mentioning the amount of penalty and interest thereon along with modes of recovery therein, giving 15 (fifteen) days’ time to deposit the penalty.

(3) The Commission may, at any time, rectify any clerical or arithmetical mistake made in the recovery certificate issued or extend the time for making any payment in pursuance of such recovery certificate.

7. Functions of Recovery Officer.

(1) The Commission may, from time to time, authorise any of its officers to function as the recovery officer for the purposes of these regulations, to recover the penalties in the manner specified under these regulations.

(2) The recovery officer shall ensure that the demand notice is duly served on the enterprise or the person concerned, as the case may be. In the case of non-service of the demand notice, the recovery officer shall immediately inform the Secretary.

(3) When the payment of penalty is made by the enterprise or the person concerned, the recovery officer shall bring it to the notice of the Secretary. In the case of default by the enterprise or the person concerned, the recovery officer shall intimate to the Secretary and ensure thereafter issuance of recovery certificate to such an enterprise in default or a person in default, as the case may be.

(4) The recovery officer shall execute the recovery certificate to realise the amount of penalty imposed upon the enterprise in default or the person in default, as the case may be, in the manner specified in these regulations.

(5) The recovery officer shall, after expiry of the period stipulated in the recovery certificate, proceed in accordance with the modes specified under these regulations for recovery of the penalty imposed.

8. Maintenance of Penalty Recovery Register.

The recovery officer shall maintain the penalty recovery register as set out in Form IV appended to these regulations and update the same regularly.

9. Modes of Recovery.

Where an enterprise in default or a person in default fails to pay the penalty within the stipulated time as mentioned in the recovery certificate, the recovery officer shall proceed to recover the penalty in the following manner,–

(a) the recovery officer shall, at any time after expiry of the period stipulated in the recovery certificate, require the enterprise in default or the person in default, from whom the penalty is due or may become due, or any other enterprise who holds or may subsequently hold money for or on account of the enterprise in default, or the legal heirs of the person in default in case the person in default is deceased, to pay to the Commission either forthwith upon the penalty becoming due or within the time specified in the recovery certificate, so much of the money as is sufficient to pay the penalty due to the enterprise in default or the person in default, as the case may be. If such other enterprise or legal heir(s) fail to pay the said amount in lieu of the penalty, then such other enterprise or person shall also be treated in the same manner as an enterprise in default, or a person in default, as the case may be;

(b) a recovery certificate may be issued to any enterprise who holds or may subsequently hold any money for or on account of the enterprise in default jointly with any other enterprise and for the purposes of this regulation, the shares of the joint holders in such account shall be presumed, until the contrary is proved, to be equal;

(c) a recovery certificate may be issued to the legal heirs of the person in default in case the person in default is deceased and for the purposes of this regulation, the shares of all legal heirs for such amount shall be presumed, until the ‘contrary is proved’, to be equal;

Provided that the liability of a legal heir under this regulation shall be limited to the extent to which the estate of the deceased bestowed upon such legal heir, is capable of meeting the liability.

(d) every enterprise or person to whom a recovery certificate is issued shall be bound to comply with such certificate, and, in particular, where any such notice is issued to a post office, banking company or an insurer, it shall not be necessary to produce any pass book, deposit receipt, policy, or any other document for the purpose of any entry, endorsement or the like being made before payment is made, notwithstanding any rule, practice or requirement to the contrary;

(e) any claim respecting any property, in relation to which a recovery certificate has been issued, arising after the date of the demand notice, shall be void as against any demand contained in the recovery certificate;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 15

(f) where an enterprise or a person to whom a recovery certificate has been issued objects to it by a statement on oath that the sum demanded or any part thereof is not due to the enterprise in default or the person in default, or that it does not hold any money for or on account of the enterprise in default or the person in default, then, nothing contained in these regulations shall be deemed to require such enterprise or person to pay any such sum or part thereof, as the case may be:

Provided that such assertion of the enterprise or the person is to be brought to the notice of the Commission for its consideration;

(g) the recovery officer may apply, for payment of the amount sufficient to discharge the penalty due to enterprise in default or person in default, to the court in whose custody there is money belonging to such enterprise or person;

(h) where an enterprise in default or person in default has property in a country outside India (being a country with which the Central Government has entered into an agreement for the recovery of penalty under the Act and the corresponding law in force in that country), the Commission may propose to that country to take such action thereon as the Commission may deem appropriate having regard to the terms of the said agreement with such country and to remit any sum so recovered to the Commission, and thereafter the Secretary shall take appropriate steps to deposit the same in the account earmarked for the purpose;

(i) where during the pendency of any proceeding or after the decision under the Act but before the service of the notice under regulation 3, any enterprise in default or person in default creates a charge or parts with the possession by way of sale, mortgage, gift, exchange or any other mode of transfer whatsoever of any of its assets in favour of any other person or enterprise, such charge or transfer shall be void as against any claim in respect of any penalty payable by such enterprise in default or person in default as a result of

the decision of the said proceeding or otherwise:

Provided that such charge or transfer shall not be void if it is made,–

(iii) for adequate consideration and without notice of the pendency of such proceeding; or

(iv) with the previous permission of the Commission.

10. Other modes of Recovery.

Where an enterprise in default or a person in default fails to pay the penalty within the stipulated time as mentioned in the recovery certificate, the recovery officer may also simultaneously proceed to recover the amount of penalty through the modes mentioned below, in accordance with the rules laid down in the Second Schedule of Income-tax Act, 1961 (43 of 1961), namely:–

(a) by attachment and sale of movable property of the enterprise or the person concerned; and

(b) by attachment and sale of immovable property of the enterprise or the person concerned.

11. Reference by the Commission to the Income-tax authority.

(1) Where the Commission is of the opinion, for reasons to be recorded in writing, that it would be expedient to recover the penalty imposed under the Act in accordance with the provisions of the Income-tax Act, 1961 (43 of 1961), it shall make reference under sub-section (2) of section 39 of the Act to the concerned Income-tax authority as set out in Form V appended to these regulations for recovery of the penalty as ‘tax due’ under the Income-tax Act, 1961 (43 of 1961).

(2) Where the income-tax authority to which a reference under sub-regulation (1) has been made by the Commission initiates recovery proceedings, the recovery proceedings initiated by the Commission shall stand sine die deferred.

12. Intimation of recovery by Income-tax authority.

(1) Where an intimation of recovery of penalty has been received by the Secretary from the Tax Recovery Officer, he shall ensure that the recovery officer records it in the penalty recovery register immediately but not later than 05 (five) days from the date of having received such intimation.

(2) The Secretary shall review and obtain a progress report, at least once in three months, from the Tax Recovery Officer, of the progress made in the recovery of demands referred to the Tax Recovery Officer and shall place the progress of recovery of penalty before the Commission every month.

13. Monitoring and supervision in proceedings of recovery of penalty.

The Secretary shall place before the Commission all the cases where the recovery of penalty has not been made, along with details of action taken in each case including the details of references made under sub-section

(2) of section 39 of the Act, at least once in a month.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

14. Refund of excess penalty.

(1) Where by any order of the National Company Law Appellate Tribunal or a High Court or the Supreme Court of India, as the case may be, it has been held that an enterprise or a person is not liable to pay any penalty or is liable to pay a penalty less than the amount mentioned in any order or notice of the Commission, the demand notice or the recovery certificate shall be withdrawn or modified, as the case may be, and the amount of any excess penalty, if paid, shall be refunded.

(2) In case of a refund, the Secretary shall issue a refund order for such amount, under his signature and seal.

15. Power to determine procedure in certain circumstances.

In a situation not provided for in these regulations or the Competition Commission of India (General) Regulations, 2024, the Commission may determine the procedure for specific matters, if so required.

16. Removal of difficulties.

In the matter of implementation of these regulations, if any doubt or difficulty arises, the decision of the Commission thereon shall be binding.

17. Repeal and Savings.

(1) The Competition Commission of India (Manner of Recovery of Monetary Penalty) Regulations, 2011, stand repealed from the date on which these regulations come into force.

(2) Notwithstanding such repeal, –

(a) anything done or any action taken or purported to have been done or taken, or any notice or certificate issued or proceedings commenced, under the repealed regulations, prior to such repeal, shall be deemed to have been done or taken under the corresponding provisions of these regulations;

(b) the operation of the repealed regulations or anything duly done or suffered thereunder, any right, privilege, obligation or liability acquired, accrued or incurred thereunder, or any legal proceeding or remedy ensued thereunder, shall remain unaffected as if the repealed regulations have never been repealed;

(c) after the repeal of the Competition Commission of India (Manner of Recovery of Monetary Penalty) Regulations, 2011, any reference thereto including in any regulations, direction or decision issued by the Commission, shall be deemed to be a reference to the corresponding provisions of these regulations.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 17 THE COMPETITION COMMISSION OF INDIA FORM I (See regulation 3) DEMAND NOTICE [Under The Competition Act, 2002 (12 of 2003)] To ______________________ ______________________ ______________________
