1. िीर्का और प्रारंभ- (1) इन जर्वजनयमों को आयुर्वेद जिक्षण एर्व ं अनुसंधान संस्ट्थान (जडप्लोमा इन फामेसी-आयुर्वेद) जर्वजनयम 2024 कहा िाएगा।

(2) र्व ेरािपत्र म ेंउनके प्रकािन की तारीख से प्रर्वृत्त होंगे।

2. पररभार्ाएँ- (1) इन जर्वजनयमों में, िब तक दक संदभ ासे अन्द्यथा अपेजक्षत न हो, - (क) "उप जनदेिक" से आिय उप जनदेिक (फामेसी) से ह;ै (ख) "जडप्लोमा" से आिय "जडप्लोमा इन फामेसी-आयुर्वेद" से होगा; (ग) "परीक्षा जनयंत्रक (सीओई)" से आिय संस्ट्थान द्वारा जनयुि परीक्षा जनयंत्रक से होगा। 2853 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(2) यहा ं प्रयुि और पररभाजर्त नहीं दकए गए लेदकन अजधजनयम में पररभाजर्त िब्दों और अजभव्यजियों का क्रमिः र्वही अथ ाहोगा िो उन्द्ह ें अजधजनयम में ददया गया ह।ै

3. जडप्लोमा इन फामसे ी- आयर्वु दे पाठ्यक्रम जडप्लोमा इन फामसे ी - आयुर्वेद जिक्षण एर्व ं अनुसंधान संस्ट्थान म ें आयुर्वेद जिक्षा गहन जर्वद्वत्ता के गणु र्वत्ता र्वाले फामााजसस्ट्ट तैयार करेगी, जिनके पास आयुर्वेद के मौजलक जसद्ांतों के अनुसार र्वैज्ञाजनक ज्ञान के साथ आयुर्वेद फामेसी का जर्वलेजखत आधार होगा और िो समाि की फामाास्ट्युरटकल और स्ट्र्वास्ट््य सेर्वाओं संबंधी काया करने म ेंसक्षम योग्य आयुर्वेददक फामााजसस्ट्ट तथा कंपाउंडर या दर्वासाि होंगे।

4. प्रर्विे के जलए न्द्यनू तम योग्यता- (1) अभ्यथी को इंटरमीजडएट (10+2) या इसके समकक्ष परीक्षा भौजतकी, रसायन जर्वज्ञान, िीर्व जर्वज्ञान और अग्रं िे ी जर्वर्यों के साथ उत्तीण ा होना चाजहए और सामान्द्य श्रणे ी, आर्थाक रूप से कमिोर र्वगाके मामले में भौजतकी, रसायन जर्वज्ञान और िीर्व जर्वज्ञान को जमलाकर उि योग्यता परीक्षा म ें न्द्यूनतम पचास प्रजतित अंक तथा अनुसूजचत िाजत, अनुसूजचत िनिाजत और अन्द्य जपछडा र्वगाके मामले में चालीस प्रजतित अंक प्राप्त होन े चाजहए।

(2) ददव्यांग व्यजियों के अजधकार अजधजनयम, 2016 (2016 का 49) के तहत जनर्दाष्ट ददव्यागं व्यजियों के संबंध में, भौजतकी, रसायन जर्वज्ञान और िीर्वजर्वज्ञान में उि योग्यता परीक्षा में न्द्यूनतम योग्यता अकं सामान्द्य र्वगा के मामले म ें पैंतालीस प्रजतित होंगे और अनुसूजचत िाजत, अनुसूजचत िनिाजत और अन्द्य जपछडा र्वगा के मामले में चालीस प्रजतित होंगे।

(3) दकसी भी अभ्यथी को जडप्लोमा पाठ्यक्रम म ेंतब तक प्रर्विे नहीं ददया िाएगा िब तक दक र्वह पाठ्यक्रम के प्रथम र्वर्ा में प्रर्वेि के र्वर् ा के 31 ददसंबर को या उससे पहले सत्रह र्वर्ा की आय ुप्राप्त न कर ले।

(4) केन्द्र सरकार द्वारा अनुमोददत जर्वदेिी नागररक अभ्यर्थायोंके जलए दो सीटें आरजक्षत होंगी। खंड 4(1) उि जर्वदेिी नागररक अभ्यथी पर लाग ू नहीं होगा। इन अभ्यर्थायों के जलए केन्द्र सरकार द्वारा अनुमोददत दकसी अन्द्य समकक्ष योग्यता की अनुमजत दी िा सकती ह।ै

(5) आरक्षण नीजत: संस्ट्थान भारत सरकार के मानदंडों के अनसु ार प्रर्वेि म ेंआरक्षण नीजत लागू करेगा।

(6) अभ्यर्थायों के दस्ट्तार्वेिों का सत्यापन: योग्यता परीक्षा के पररणाम घोजर्त होन े पर, संस्ट्थान के जडप्लोमा पाठ्यक्रम म ें प्रर्वेि मेररट सूची के आधार पर ददया िाएगा। आर्वंरटत अभ्यर्थायों को अपने दस्ट्तार्वेिों के सत्यापन के जलए िारीररक रूप से उपजस्ट्थत रहना होगा और पात्र अभ्यर्थायों को प्रर्वेि ददया िाएगा।

5. छात्रों का नामाकं न- (1) छात्र को उसके प्रर्वेि के छह महीने के भीतर संस्ट्थान के छात्र के रूप म ें नामांदकत दकया िाएगा।

(2) नामांकन िुल्क सस्ट्ं थान द्वारा जनधााररत दकया िाएगा और इसका भुगतान केर्वल एक बार दकया िाएगा, चाह े छात्र संस्ट्थान की परीक्षाओं म ेंदकतनी भी बार िाजमल हो।

(3) परीक्षा जनयंत्रक नामांकन के ररकॉडा का अनरु क्षण करेगा।

(4) नामांकन पर, प्रत्येक छात्र को एक नामांकन संख्या प्राप्त होगी जिसके तहत उसका नाम रजिस्ट्टर में दि ा दकया गया ह ैऔर र्वह संख्या संस्ट्थान के साथ सभी संचारों में छात्र द्वारा उद्धृत की िाएगी।

6. िल्ु क सरं चना- छात्रों को र्वार्र्ाक िुल्क िैसे प्रर्वेि िल्ु क, महाजर्वद्यालय िुल्क, परीक्षा िल्ु क, ट्यूिन िुल्क और संस्ट्थान द्वारा अजधसूजचत अन्द्य िल्ु कों का भुगतान करना होगा।

7. पाठ्यक्रम की अर्वजध- जडप्लोमा दो िक्षै जणक र्वर्ों की अर्वजध का होगा। कायाक्रम के जलए पाठ्यक्रम और पाठ्यचया ा संस्ट्थान द्वारा जनधााररत की िाएगी।

8. प्रदान दकया िान े र्वाला जडप्लोमा- छात्र को सभी परीक्षाओं में उत्तीणा होन े और जनधााररत अर्वजध म ें अध्ययन के जनधााररत पाठ्यक्रम को पणू ा करने के बाद जडप्लोमा प्रदान दकया िाएगा।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3

9. जिक्षण का माध्यम- पाठ्यक्रम के जलए जिक्षण का माध्यम अंग्रेिी या हहदं ी में होगा।

11. सह-पाठ्यचया ा सबं धं ी गजतजर्वजधयाँ- छात्र संस्ट्थान द्वारा आयोजित मुख्य पाठ्यक्रम के दौरान कायािालाओं, सेजमनारों, योग जिजर्वरों, खेल और सांस्ट्कृजतक गजतजर्वजधयों और ड्रग टूर सजहत जर्वजभन्न गजतजर्वजधयों में सदक्रय रूप से भाग लगें े।

12. परीक्षाएँ- (1) नामांदकत छात्र अपने र्वर् ा की जनधााररत समयार्वजध पूणा होन े के बाद परीक्षा में बैठन े के पात्र होंगे।

(2) परीक्षा में बैठने हते ु पात्र होने के जलए आर्वश्यक न्द्यूनतम उपजस्ट्थजत प्रत्येक जर्वर्य म ें कुल व्याख्यान और प्रैजक्टकल का अलग-अलग पचहत्तर प्रजतित होगी।

(3) नीचे जनर्दष्टा सीमा तक उपजस्ट्थजत म ेंकमी में जनम्नानुसार छूट दी िा सकती ह:ै क) प्रमाजणत बीमारी के कारण, फामेसी पाठ्यक्रम के उप जनदिे क संबंजधत छात्र की उपजस्ट्थजत म ें मौिूदा उपजस्ट्थजत के अलार्वा पांच प्रजतित की छूट दे सकत े ह।ै ख) यदद दकसी छात्र की उपजस्ट्थजत पाँच स े दस प्रजतित कम हो िाती ह ै तो उप जनदिे क उपजस्ट्थजत म ें छूट पर अंजतम जनणाय के जलए मामले को जनदेिक के पास भेि दगे ा।

(4) परीक्षा का संचालन- (क) सभी परीक्षाएं परीक्षा जनयंत्रक द्वारा जनधााररत की गई तारीखों और समय पर आयोजित की िाएंगी। (ख) पात्र छात्रों को जनधााररत परीक्षा िुल्क का भुगतान करना होगा और संस्ट्थान के परीक्षा जनयंत्रक द्वारा अजधसूजचत जनधााररत समय सीमा के भीतर जर्वजधर्वत भरा हुआ परीक्षा फॉम ािमा करना होगा।

(5) परीक्षा का र्वर्ा- (क) प्रथम र्वर्ा की परीक्षा सामान्द्यत: र्वर्ा के सत्रांत तक आयोजित और पूणा की िाएगी। प्रथम र्वर्ा के दो जर्वर्यों तक में अनुत्तीणा होन े र्वाले छात्र को दसू रे र्वर्ा के सत्र में जर्वर्यों को िारी रखने और दसू रे र्वर्ा की परीक्षा में बैठने की अनुमजत दी िाएगी। प्रथम र्वर्ा की अगली परू क परीक्षा प्रत्येक छह महीने में आयोजित की िाएगी और अजधकतम चार र्वर्ों की अर्वजध के भीतर प्रथम र्वर् ा की परीक्षा उत्तीण ा करन े के जलए अजधकतम चार अर्वसर (मुख्य परीक्षा सजहत) ददए िाएंगे। अजधकतम सीमा के भीतर उत्तीणा न हो पाने की जस्ट्थजत म ें छात्र को आगे पाठ्यक्रम िारी रखन े की अनुमजत नहीं दी िाएगी। (ख) दो से अजधक जर्वर्यों म ेंअनुत्तीणा होन े र्वाल ेछात्र को सत्र पूरा करने की अनुमजत नहीं दी िाएगी। ऐसे छात्र को दसू रे र्वर् ा में पदोन्नत होन े से पहल े सभी जर्वर्यों को उत्तीणा करना होगा। प्रथम र्वर् ा की परीक्षा उत्तीण ा करने के जलए अजधकतम चार र्वर्ों की अर्वजध के भीतर अजधकतम चार अर्वसर (मुख्य परीक्षा सजहत) ददए िाएंगे। (ग) जडप्लोमा पाठ्यक्रम पूरा करन ेकी अजधकतम अर्वजध प्रर्वेि की तारीख से छह र्वर् ासे अजधक नहीं होगी।

(6) परीक्षा पैटना और पदोन्नजत- (क) सैद्ांजतक परीक्षा के प्रश्न पत्र का पैटना संस्ट्थान के परीक्षा जनयंत्रण बोडा द्वारा तैयार दकया िाएगा। (ख) प्रश्नपत्र जद्वभार्ी, अग्रं ेिी भार्ा और हहदं ी में होगा और उत्तर अग्रं ेिी या हहदं ी भार्ाओं में जलखे िा सकत े ह।ैं (ग) परीक्षा उत्तीण ा करन े के जलए आर्वश्यक न्द्यूनतम अंक प्रत्येक जर्वर्य में सैद्ांजतक और प्रायोजगक परीक्षा म ें अलग-अलग, पचास प्रजतित होंगे, िैसा दक इन जर्वजनयमों की अंक जर्वतरण ताजलका में उजल्लजखत ह।ै (घ) पैंसठ प्रजतित और उससे अजधक अंक प्रथम श्रणे ी तथा पचहत्तर प्रजतित और इससे अजधक अंक प्राप्त करन े र्वाले छात्र को जर्वजिष्टता प्रदान की िाएगी और य ेपरु स्ट्कार पूरक परीक्षाओं के जलए लागू नहीं होंगे। (ङ) यदद कोई छात्र संज्ञानात्मक कारणों स े जनयजमत परीक्षा में उपजस्ट्थत होन े म ें जर्वफल रहता है, तो र्वह जनयजमत छात्र के रूप में परू क परीक्षा म ें उपजस्ट्थत होगा, जिसकी जनयजमत परीक्षा में उपजस्ट्थत न होन े को अर्वसर के रूप म ेंनहीं माना िाएगा।

(7) परीक्षकत्र्व- (क) सैद्ांजतक और प्रायोजगक परीक्षा म ें परीक्षक बनन े की पात्रता संबंजधत जर्वर्य म ें न्द्यूनतम तीन र्वर्ा का जिक्षण अनुभर्व होगा। (ख) प्रायोजगक परीक्षा में दो परीक्षक होंगे, एक संस्ट्थान का आतं ररक और दसू रा दकसी भी संस्ट्थान से होगा।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5

13. अनजु चत साधनों और उच्छृंखल आचरण पर जनयत्रं ण- (1) कोई भी छात्र परीक्षा में या उसके संबंध में अनुजचत साधनों का उपयोग नहीं करेगा या उच्छृंखल आचरण में िाजमल नहीं होगा, क्योंदक ऐसा करना संस्ट्थान के परीक्षा के प्रार्वधानों के अनुसार अपराध की प्रकृजत और गंभीरता के आधार पर दडं नीय अपराध माना िाएगा।

(2) दकसी परीक्षा या परीक्षण में दकसी छात्र के कदाचार के संबंध में ररपोटा प्राप्त होन े या मामले का पता चलन े पर जनदेिक द्वारा जनयिु परीक्षा अनुिासनात्मक कारार्वाई सजमजत को उसमें जनधााररत प्रदक्रया का पालन करने के बाद छात्र को दंजडत करने की िजि होगी। . यदद दकसी परीक्षा में कदाचार का आरोप छात्र के जर्वरुद् जसद् हो िाता ह ै तो सजमजत द्वारा छात्र को जनम्नजलजखत म ेंसे कोई एक या अजधक दण्ड ददया िा सकता ह:ै (क) दकसी परीक्षा में उसके प्रर्वेि को रद्द करना या अस्ट्र्वीकार करना और छात्र द्वारा भुगतान दकया गया िल्ु क, यदद कोई हो, को िब्त कर लेना। (ख) छात्र के उस परीक्षा का परीक्षा पररणाम रद्द करना जिससे आरोप िुडा ह।ै (ग) उसे एक जर्वजिष्ट अर्वजध के जलए र्वंजचत करना िो पांच र्वर् ा या उससे अजधक या स्ट्थायी हो सकता है

(i) संस्ट्थान के दकसी भी पाठ्यक्रम में िाजमल होना और/या

(ii) नीचे दी गई अनुसूची में ददए गए दंड के स्ट्तर के अनुसार दकसी भी संस्ट्थागत परीक्षा में उपजस्ट्थत होना। अनसु चू ी नीचे दी गई अनुसूची उि अनसु ूची के कॉलम (2) म ें उजल्लजखत अनुजचत साधनों या कृत्यों के जलए कॉलम (3) म ें दंड का प्रार्वधान करती ह ै क्र. स.ं अनजु चत साधन या कृत्य दण्ड

(1) परीक्षा हॉल के अंदर उत्तर पुजस्ट्तका के अलार्वा दकसी भी सामग्री पर प्रश्न या उत्तर या संबंजधत जर्वर्य का पररणाम कुछ भी जलखना। रद्द दकया िा सकता है

(2) परीक्षा हॉल में परीक्षा के जर्वर्य से संबंजधत सामग्री रखना अथाात्: दो परीक्षाओं म ें बैठने से र्वंजचत दकया िा सकता ह ै (क) कागिात, दकताबें या नोट्स; अथर्वा (ख) छात्र द्वारा पहने गए कपडों के दकसी भी जहस्ट्से पर या उसके िरीर के दकसी भी जहस्ट्से, या टेबल या डेस्ट्क पर जलजखत नोट्स; अथर्वा (ग) फुट-रूल और/या उपकरण िैसे सेट-स्ट्वायर, प्रोरैक्टर, स्ट्लाइड रूलर आदद जिन पर नोट्स जलखे हों।

(3) उत्तर-पुजस्ट्तका से नकल करना पाया गया या जसद् दकया गया या अन्द्यथा यह स्ट्थाजपत दो परीक्षाओं म ें बैठने स े हो िाता ह ैदक छात्र ने: र्वंजचत दकया िा सकता है (क) परीक्षा के दौरान या उसके बाद दकसी भी समय दकसी भी तरीके से दकसी भी कागिात, दकताबें, नोट्स, उत्तर-पुजस्ट्तका या दकसी अन्द्य स्रोत से नकल की या मदद ली;

या (ख) दकसी अन्द्य छात्र को अपनी उत्तर-पुजस्ट्तका से नकल करने की अनुमजत दी; या (ग) दकसी अन्द्य छात्र से सहायता प्राप्त की ह ैया सहायता दी है; या (घ) दकसी अन्द्य छात्र के साथ अपनी उत्तर-पुजस्ट्तका या उसके दकसी भाग का आदान-प्रदान दकया।

(4) प्रश्न पत्र (या उसके दकसी भाग) को परीक्षा हॉल से बाहर भेिने या बाहर भेिने का दो परीक्षाओं म ें बैठने स े प्रयास करने पर र्वंजचत दकया िा सकता है

(5) आपजत्तिनक सामग्री को जनगलना, उसे लेकर भाग िाना या उसे गायब कर देना या तीन परीक्षाओं में बैठने से र्वंजचत दकया िा सकता है दकसी अन्द्य तरीके से नष्ट करना।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(6) दकसी उत्तर-पुजस्ट्तका को अंदर या बाहर ले िाना अथर्वा उसे बदलना या उत्तर जलखने के तीन परीक्षाओं में बैठने से बाद उसे बदल देना (परीक्षा के दौरान या बाद में दकसी व्यजि की सहायता या सहायता र्वंजचत दकया िा सकता है के बगैर या जमलीभगत से)।

(7) उत्तर-पुजस्ट्तका पयार्वेक्षक को न सौंपना या उत्तर-पुजस्ट्तका को नष्ट कर देना। दो परीक्षाओं म ें बैठने स े र्वंजचत दकया िा सकता है

(8) िीर्वन, परीक्षा से िुडे व्यजियों की स्ट्र्वतंत्रता को खतरा या कमाचाररयों के साथ छात्र को संस्ट्थान से स्ट्थायी रूप से र्वर्िात दकया िा दव्यु ार्वहार सजहत परीक्षा हॉल में गंभीर कदाचार या परीक्षा हॉल के अंदर या बाहर सकता ह ै परीक्षा ड्यूटी पर जनयुि कमाचाररयों के साथ बल प्रयोग या उपरर्व करना।

(9) अर्वज्ञा, सीट पररर्वतान, परीक्षा हॉल में या उसके आसपास दव्यु ार्वहार या उत्तर पुजस्ट्तका एक परीक्षा में बैठने स े र्वंजचत दकया िा सकता है पर दकसी अन्द्य छात्र की सीट संख्या जलखना।

(10) अंक बढाने या खाली पन्नों पर उत्तर जलखने या परीक्षा के संचालन में बाधा डालने के तीन परीक्षाओं में बैठने से जलए परीक्षक के पास िाना। र्वंजचत दकया िा सकता है

(11) प्रजतरूपण-प्रजतरूपणकताा (िो दकसी अन्द्य छात्र के जलए जलखता ह)ै , यदद र्वह इस छात्र को संस्ट्थान से स्ट्थायी रूप से र्वर्िात दकया िा संस्ट्थान का छात्र होने के साथ-साथ प्रजतरूजपत छात्र भी ह।ै सकता ह।ै

NOTIFICATION New Delhi, the 29th April, 2024 NO. L-12015/25/2021-AS-Pt.1B.—In exercise of the powers conferred by clause (k) of sub-section [1] of

section 28 of the Institute of Teaching and Research in Ayurveda Act, 2020 (16 of 2020), the Institute of Teaching and Research in Ayurveda with the prior approval of the Central Government, hereby makes the following regulations,

namely: -

1. Title and Commencement.- (1) These regulations shall be called as the Institute of Teaching and Research in Ayurveda (Diploma in Pharmacy – Ayurveda) Regulations 2024.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.- (1) In these Regulations, unless the context otherwise require,-

(a) “Deputy Director” means the Deputy Director (Pharmacy);

(b) "Diploma" shall mean the “Diploma in Pharmacy - Ayurveda”;

(c) "Controller of Examinations (COE)" shall mean Controller of Examinations appointed by the Institute.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7

(2) Words and expressions used herein and not defined but defined in the Act shall have the same meaning respectively assigned to them in the Act.

3. Diploma in Pharmacy - Ayurveda course.- Diploma in Pharmacy - Ayurveda education at the Institute of Teaching and Research in Ayurveda shall produce quality pharmacists of profound scholarship having deed basis of Ayurveda Pharmacy with scientific knowledge in accordance with Ayurvedic fundamentals who would be able and efficient in good Ayurvedic pharmacists and compounders or dispensers competent to serve in the Pharmaceutical and Health Services of the society.

4. Minimum qualification for admission.- (1) The candidate must have passed intermediate (10+2) or its equivalent examination with the subjects of Physics, Chemistry, Biology and English and must have obtained minimum of fifty per cent. marks taken together in Physics, Chemistry and Biology at the aforesaid qualifying examination in the case of the General category, Economically Weaker Section and forty per cent. marks in the case of the Scheduled Castes, the Scheduled Tribes and the Other Backward Classes.

(2) In respect of persons with disability specified under the Rights of Persons with Disabilities Act, 2016 (49 of

2016), the minimum qualifying marks in the said qualifying examination in Physics, Chemistry and Biology shall be forty-five per cent. in the case of the General category and forty per cent. in the case of the Scheduled Castes, the Scheduled Tribes and the Other Backward Classes.

(3) No candidate shall be admitted to Diploma Course unless he or she has attained the age of seventeen years on or before the 31stDecember of the year of admission in the first year of the course.

(4) There will be two seats reserved for foreign national candidates, approved by the Central Government. The

Section 4 (1) shall not be applicable for said foreign national candidate. For these candidates any other equivalent qualification approved by the Central Government may be allowed.

(5) Reservation Policy: The Institute shall implement the reservation policy in admissions, in accordance with norms of Government of India.

(6) Verification of their credentials: On declaration of the results of the qualifying examination, the admission to the Diploma course of the Institute shall be granted on the basis of merit list. The allotted candidates shall have to remain physically present for verification of their credentials and the admission shall be granted to the eligible candidates.

5. Enrolment of students.- (1) Student shall be enrolled as a student of the Institute within six months of his admission.

(2) The enrolment fee shall be determined by the Institute and shall be paid once only irrespective of the number of times the student appears for examinations of the Institute.

(3) The Controller of Examinations shall maintain the record of the enrollment.

(4) On enrollment, every student shall receive an enrollment number under which his name has been entered in the register and that number shall be quoted by the student in all communications to the Institute.

6. Fees structure.- Students shall have to pay an annual fee like admission fee, college fee, examination fee, tuition fee and other fees notified by the Institute.

7. Duration of course.- The Diploma shall extend over a period of two academic years. The curricula and syllabi for the programme shall be determined by the Institute.

8. Diploma to be awarded.- The student shall be awarded Diploma after passing all the examinations and completion of the prescribed course of study extending over the prescribed period.

9. Medium of instruction.- The medium of instruction for the course shall be in English or Hindi.

11. Co-Curricular Activities.- Students shall actively participate in various activities including Workshops, Seminars, Yoga Shibira, Sports and Cultural activities and Drug tour during the main course organised by the Institute.

12. Examinations.- (1) Enrolled Students shall be eligible for appearing in the examination after completion of the stipulated time of their year.

(2) The minimum attendance required to be eligible for appearing in the examination shall be Seventy-five per cent. of the total lectures and practical in each subject separately.

(3) The shortage of attendance up to the limit specified below may be condoned as below: a) on account of bonafide illness, the Deputy Director of the Pharmacy course may condone the attendance of the concerned student upto five per cent. in addition to obtained attendance.

b) if a student falls short in attendance by five to ten per. cent, then the Deputy Director shall refer the case to the Director for final decision on condoning the attendance.

(4) Conduct of Examination.- (a) All the examinations shall be held on such dates and time as decided by the Controller of Examinations.

(b) The eligible students shall have to pay stipulated exam fee and submit the examination form duly filled within the prescribed time frame as notified by the Controller of Examinations of the Institute.

(5) Year of Examinations.- (a) The first year examination shall be ordinarily held and completed by the end of year session. The student failing in upto two subjects of first year shall be allowed to keep the terms of the second year session and to appear in second year examination. The subsequent supplementary examination of First year shall be held every six months and maximum four trials (including the main examination) shall be given to pass first year examination within a period of maximum of four years. The student shall not be allowed to continue the course further in case of his inability to pass within the maximum limit.

(b) The student failing in more than two subjects shall not be allowed to keep the term. Such student has to clear all the subjects before being promoted to the second year. Maximum four trials (including the main examination) shall be given to pass first year examination within a period of maximum of four years.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 9

(c) The maximum duration of completion of Diploma course shall not exceed six years from the date of admission.

(6) Examination pattern and promotion.- (a) The pattern of theory examination question paper will be designed by the examination control board of the institute.

(b) The question paper shall be bilingual, in English language and Hindi and the answers may be written in English or Hindi languages.

(c) The minimum marks required for passing the examination shall be fifty per cent. in theory and in practical separately in each subject as mentioned in marks distribution table of these regulations.

(d) A student obtaining sixty-five per cent. and above marks shall be awarded first class and seventy-five per cent. and above marks shall be awarded distinction and these award shall not be applicable for supplementary examinations.

(e) In case a student fails to appear in regular examination for cognitive reasons, he or she shall appear in supplementary examination as regular student, whose non-appearance in regular examination shall not be treated as a trial.

(7) Examinership.- (a) The eligibility to be an examiner in the theory and practical examination shall be a minimum of three years of teaching experience in the concerned subject.

(b) There shall be two examiners in the practical, one internal from the Institute and the other from any Institute.

13. Control of Unfair Means and Disorderly Conduct.- (1) No student shall use unfair means or indulge in disorderly conduct at, or in connection with the examination, as doing so shall be considered punishable offence depending upon the nature and gravity of the offence as provision of Examination of Institute.

(2) On receipt of a report or on detection of a case regarding the misconduct of any student at any examination or tests the Examination Disciplinary Action Committee appointed by the Director shall have the power to punish the student after following the procedure as laid down therein. Any one or more of the following punishment may be awarded by the committee to the student where a charge of misconduct at an examination

is held proved against the student:

(a) cancelling or rejecting his admission to an examination and forfeiting fees if any, paid by the student.

(b) cancelling students result of the examination with which the charge is connected.

(c) debarring him for a specific period which may be five years or more or permanently from

(i) joining any course of the institute and/or

(ii) appearing in any of the Institutional examination as per level of punishment given in Schedule below.

(b) Written notes on any part of the clothes worn by the student or on any part of his/her body, or table or desk, or

(3) Copying is found or established from answer-book or it is Disqualification from

otherwise established that the student has: appearing in examinations for two exams

(a) Copied or taken help from any papers, books, note, answer- book or any other source in any manner during the examination or at any time thereafter; or

(b) Allowed another student to copy from his/ her answer-book; or

(c) Received help from or has helped another student ;or

(d) Exchanged his/her answer-book or a part thereof with another student.

(4) On passing or attempting to pass on the question paper (or part Disqualification from appearing thereof) outside in examinations for two exams

(5) Destruction of incriminating material by swallowing, running away Disqualification from appearing with it or causing its disappearance or by any other means. in examinations for three exams

(6) Smuggling in or out of an answer-book or replacing or getting it Disqualification from appearing replaced after attempting answers (during or after the examination in examinations for three exams with or without the help or connivance of any person).

(7) Non delivery of answer-book to the supervisor or destroying the Disqualification from appearing answer book. in examinations for two exams

(8) Serious misconduct in the examination hall including threatening Permanently debarring the the life, liberty of persons associated with examination or student from institute. misbehavior with staff or using force or rowdyism with the staff appointed on exam duty inside or outside the examination hall.

(9) Disobedience, change of seat, misbehavior in or around examination Disqualification from appearing hall or writing another student’s seat number on the answer-book. in examinations for one exam

(10) Approaching examiner for raising marks or for writing the answer Disqualification from appearing on blank pages or obstructing the conduct of an examination. in examinations for three exams

(11) Impersonation–impersonator (who writes for another student) if is a Permanently debarring the student of this institute as well as impersonated student. student from institute.

(12) When answer-book contains Cancelling the result of respective subject

(a) abusive or obscene or threatening language

(b) appeal to the examiner and

(c) distinctive mark to disclose the identity.

(13) Admission to the examination on any kind of false representation in Disqualification from appearing the application form. in examinations for one exam

(14) If the student is found talking or doing any other malpractice in the Disqualification from appearing video footage/or keeping mobile phone/s or any other electronic in examinations upto two exams gadgets in examination hall.

14. Conferment of Diploma.- An eligible student passing the final year examinations shall be conferred with the Diploma.
