1. सजं क्षप्त िीर्का और प्रारंभ - (1) इन जर्वजनयमों को आयुर्वेि जिक्षण एर्वं अनुसंधान संस्ट्थान, बैचलर ऑफ फामेसी-आयुर्वेि [बी. फामा. (आयु.)] जर्वजनयम 2024 कहा िाएगा।

(2) र्व ेरािपत्र म ेंउनके प्रकािन की तारीख से प्रर्वृत्त होंगे।

2. पररभार्ाएँ - (1) इन जर्वजनयमों में, िब तक दक संिभ ासे अन्द्यथा अपेजक्षत न हो, - (क) "अजधजनयम" का आिय आयुर्वेि जिक्षण एर्वं अनुसंधान संस्ट्थान अजधजनयम, 2020 (2020 का 16) से ह;ै (ख) "परीक्षा जनयंत्रक" का आिय संस्ट्थान द्वारा जनयिु परीक्षा जनयंत्रक से है;

(ग) "उप जनििे क" का आिय उप जनिेिक (फामेसी) से ह;ै (घ) "व्याख्यान" का आिय उपिेिात्मक जिक्षण अथाात् कक्षा जिक्षण से है;

2852 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ङ) "गरै -व्याख्यान" में प्रायोजगक और प्रििना ात्मक जिक्षण िाजमल ह ै और प्रििानात्मक जिक्षण में संबंजधत जर्वर्य की आर्वश्यकता के अनुसार छोटे समूह में जिक्षण या टमटू ोररयल या सेजमनार या संगोष्ठी या असाइनमेंट या फामेसी प्रजिक्षण अथर्वा प्रयोगिाला प्रजिक्षण या क्षेत्र का िौरा या कौिल प्रयोगिाला प्रजिक्षण या एकीकृत जिक्षण इत्यादि िाजमल ह।ैं (च) "अडं र ग्रेिुएट प्रोग्राम" का आिय बैचलर ऑफ फामेसी (आयुर्वेि) उपाजध कायाक्रम से ह;ै

(2) यहां प्रयिु और पररभाजर्त नहीं दकए गए लेदकन अजधजनयम में पररभाजर्त िब्िों और अजभव्यजियों का क्रमिः र्वही अथ ाहोगा िो उन्द्ह ेंअजधजनयम में दिया गया ह।ै

3. प्रर्विे के जलए पात्रता मानिडं - (1) बैचलर ऑफ फामेसी (आयुर्वेि) में प्रर्वेि पान े के जलए पात्रता जनम्नानुसार होगी:- (क) अभ्यथी को दकसी भी परीक्षा बोडा से भौजतकी, रसायन जर्वज्ञान, िीर्वजर्वज्ञान और अंग्रेिी के साथ इंटरमीजडएट (10+2) या इसके समकक्ष परीक्षा उत्तीणा होना चाजहए और सामान्द्य श्रेणी के मामले म ें भौजतकी, रसायन जर्वज्ञान और िीर्व जर्वज्ञान को जमलाकर योग्यता परीक्षा में न्द्यूनतम पचास प्रजतित अंक तथा अनुसूजचत िाजत, अनुसूजचत िनिाजत और अन्द्य जपछडा र्वगा के मामल े में चालीस प्रजतित अंक प्राप्त होना चाजहए:

बिते दक दिव्यागं व्यजियों के संबंध में, दिव्यांग व्यजियों के अजधकार अजधजनयम, 2016 (2016 का 49) के तहत जनर्िष्टा अभ्यथी हते ु सामान्द्य र्वग ा के मामल े में, भौजतकी, रसायन जर्वज्ञान और िीर्व जर्वज्ञान म ें उि परीक्षा म ें न्द्यूनतम योग्यता अकं पैंतालीस प्रजतित तथा अनुसूजचत िाजत, अनुसूजचत िनिाजत और अन्द्य जपछडा र्वगा के मामल े में चालीस प्रजतित होंगे। (ख) जडप्लोमा ऑफ फामेसी (आयुर्वेि) कायाक्रम के माध्यम से प्रर्वेि: बैचलर ऑफ फामेसी (आयुर्वेि) कायाक्रम के जलए अनुमत प्रर्वेि सीटों की क्षमता की कुल संख्या म ें से अजधकतम बीस प्रजतित पर दिया िा सकता ह।ै िेर् सीटें जर्वजनयम 3 के उप-जर्वजनयम (1) के अनच्ु छेि (क) में उजल्लजखत पात्रता मानिडं ों का पालन करके भरी िा सकती ह।ैं (ग) दकसी भी अभ्यथी को बैचलर ऑफ फामेसी (आयुर्वेि) उपाजध कायाक्रम में प्रर्वेि तब तक नहीं दिया िाएगा, िब तक दक र्वह उपाजध कायाक्रम के पहल े र्वर्ा म ें प्रर्वेि के र्वर् ा के 31 दिसंबर को या उससे पहल े सत्रह र्वर् ा की आय ु प्राप्त नहीं कर लेता हो।

(2) राष्ट्रीय पात्रता-सह-प्रर्वेि परीक्षा- (क) प्रत्येक िैक्षजणक र्वर् ा में स्ट् नातक कायक्रा म हते ु सभी जचदकत्सा संस्ट्थानों में प्रर्वेि के जलए स्नातक स्ट्तर पर एक समान प्रर्वेि परीक्षा नामत: राष्ट्रीय पात्रता-सह-प्रर्वेि परीक्षा (एनईईटी) होगी और आयुर्वेि जिक्षण एर्व ंअनुसंधान संस्ट्थान द्वारा नाजमत प्राजधकारी द्वारा संचाजलत की िाएगी। (ख) एक िैक्षजणक र्वर् ा के जलए बैचलर ऑफ फामेसी (आयुर्वेि) उपाजध कायाक्रम में प्रर्वेि पर जर्वचार करने हते ु, अभ्यथी को स्ट् नातक कायाक्रम के उि िक्षै जणक र्वर् ा के जलए आयोजित राष्ट्रीय-पात्रता-सह प्रर्वेि परीक्षा में न्द्यनू तम पचास परसेंटाईल अंक प्राप्त करना आर्वश्यक होगा:

बिते दक, इस संबंध म ें–

(i) अनुसूजचत िाजत, अनुसूजचत िनिाजत और अन्द्य जपछडा र्वगा से संबंजधत उम्मीिर्वारों के जलए न्द्यूनतम अंक 40र्व ें परसेंटाईल पर होंग;े

(ii) दिव्यांग व्यजियों के अजधकार अजधजनयम, 2016 (2016 का 49) के तहत जनर्िाष्ट बेंचमाका दिव्यांगता र्वाल े अभ्यथी, सामान्द्य र्वग ा के मामले म ें न्द्यनू तम अंक 45र्वें परसेंटाईल और अनुसूजचत िाजत, अनसु ूजचत िनिाजत और अन्द्य जपछडा र्वग ाके मामल े में 40र्वें परसेंटाईल पर होंग:े बिते दक िहां संबंजधत श्रेणी में पयााप्त संख्या में अभ्यथी स्नातक कायाक्रम में प्रर्वेि के जलए दकसी िैक्षजणक र्वर्ा हते ु आयोजित राष्ट्रीय पात्रता-सह-प्रर्वेि परीक्षा म ें न्द्यूनतम अंक प्राप्त करन े म ें जर्वफल रहते ह,ैं तो आयुर्वेि जिक्षण एर्वं अनुसंधान संस्ट्थान केन्द्र सरकार के परामिा के बाि अपन े जर्वर्वेक स े संबंजधत श्रेणी के अभ्यर्थायों के जलए स्ट्न ातक कायाक्रम में प्रर्वेि हते ु आर्वश्यक न्द्यूनतम अंकों को कम कर सकती ह ै और आयुर्वेि जिक्षण एर्वं अनुसंधान संस्ट्थान द्वारा कम दकए गए अंक केर्वल उस िैक्षजणक र्वर् ा के जलए लाग ूहोंगे।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3

(3) केन्द्र सरकार द्वारा अनुमोदित जर्विेिी नागररक अभ्यर्थायों के जलए िो सीटें आरजक्षत होंगी: बिते दक उप-जर्वजनयम (1) और (2) उक्त जर्विेिी नागररक अभ्यर्थायों के जलए लाग ू नहीं होंगे और इन अभ्यर्थायों के जलए केन्द्र सरकार द्वारा अनमु ोदित दकसी अन्द्य समकक्ष योग्यता की अनुमजत िी िा सकती ह।ै

4. आरक्षण नीजत- प्रर्वेि के समय जर्वजभन्न श्रेजणयों (अथाात ् अनसु ूजचत िाजत, अनुसूजचत िनिाजत, अन्द्य जपछडा र्वगा, आर्थाक रूप से कमिोर र्वगा, बेंचमाका दिव्यांग व्यजि) के जलए आरक्षण केन्द्र सरकार द्वारा िारी आिेिों और जनिेिों के अनुसार होगा।

5. काउंसललगं - (1) जर्वजनयम 3 म ें बताए अनुसार अहका परीक्षा के पररणाम घोजर्त होने पर, संस्ट्थान के स्नातक उपाजध कायाक्रम म ें काउंसललंग और प्रर्वेि मंत्रालय की आयुर् प्रर्वेि केंरीय परामिा सजमजत (एएसीसीसी), आयुर् मंत्रालय, भारत सरकार, नई दिल्ली द्वारा अजखल भारतीय सामान्द्य मेररट सूची के आधार पर आयोजित दकया िाएगा। आर्वंरटत अभ्यर्थायों को अपने िस्ट्तार्वेिों के सत्यापन के जलए िारीररक रूप से उपजस्ट्थत होना होगा तथा पात्र उम्मीिर्वारों को प्रर्वेि दिया िाएगा।

(2) कोई भी अभ्यथी िो इस जर्वजनयमन के तहत न्द्यूनतम पात्रता अंक प्राप्त करने म ेंजर्वफल रहा है, उसे उि िैक्षजणक र्वर् ा में स्नातक कायाक्रम में प्रर्वेि नहीं दिया िाएगा।

6. छात्रों का नामाकं न- (1) छात्र को उसके प्रर्वेि के छह महीने के भीतर संस्ट्थान के छात्र के रूप म ें नामांदकत दकया िाएगा।

(2) नामांकन िुल्क संस्ट्थान द्वारा जनधााररत दकया िाएगा और इसका भुगतान केर्वल एक बार दकया िाएगा, चाह े छात्र संस्ट्थान की परीक्षाओं में दकतनी भी बार िाजमल हो।

(3) परीक्षा जनयंत्रक नामांकन के ररकॉडा का अनरु क्षण करेगा।

(4) नामांकन पर, प्रत्येक छात्र को एक नामांकन संख्या प्राप्त होगी जिसके तहत उसका नाम रजिस्ट्टर में ििा दकया गया ह ै और र्वह संख्या संस्ट्थान के साथ सभी संचारों में छात्र द्वारा उद्धृत की िाएगी।

7. िल्ु क सरं चना- छात्रों को र्वार्र्ाक िुल्क िैसे प्रर्वेि िुल्क, परीक्षा िुल्क, ट्यूिन िल्ु क और सस्ट्ं थान द्वारा अजधसूजचत अन्द्य िुल्कों का भगु तान करना होगा।

8. उपाजध कायक्रा म की अर्वजध- बैचलर ऑफ फामेसी (आयुर्वेि) उपाजध कायाक्रम की अर्वजध 12 सप्ताह की अजनर्वाया इंटनाजिप सजहत चार र्वर् ा की होगी: बिते दक, यदि कोई छात्र दकसी भी कारण से संस्ट्थान के प्राजधकारी की उजचत अनुमजत के साथ उपाजध कायाक्रम बीच में छोड िते ा ह,ै तो उसे प्रर्वेि की तारीख से अजधकतम िस र्वर्ों की अर्वजध के भीतर उपाजध कायाक्रम पणू ा करने की अनुमजत िी िाएगी।

9. प्रिान की िान े र्वाली उपाजध- उपाजध का नाम बैचलर ऑफ फामेसी (आयुर्वेि) होगा। छात्र को सभी परीक्षाओं में उत्तीण ा होने और जनधााररत अर्वजध म ें अध्ययन के जनधााररत कायाक्रम को पणू ा करन े और आर्वश्यक िुल्क के भुगतान पर बारह सप्ताह की अजनर्वाया इंटनाजिप को पूणा करने के बाि, सस्ट्ं थान के आगामी िीक्षांत समारोह में या व्यजिगत रूप से या उनकी अनुपजस्ट्थजत म ेंप्रित्त जर्वकल्प को बैचलर ऑफ फामेसी (आयुर्वेि) की उपाजध से प्रिान की िाएगी।

10. जिक्षण का माध्यम- बैचलर ऑफ फामेसी (आयुर्वेि) उपाजध कायाक्रम के जलए जिक्षा का माध्यम अग्रं ेिी या लहिं ी होगा।

11. अध्ययन पटै न ा और पाठ्यक्रम- (1) स्नातक कायाक्रम चार र्वर्ों म ें आयोजित दकया िाएगा और इन जर्वजनयमों म ें जनर्िाष्ट कुल अर्वजध और जर्वर्यों को ध्यान में रखत े हुए क्षैजति एकीकरण मॉडल म ेंपढाया िाएगा।

(2) पहला र्वर्ा सामान्द्यतः जसतबं र या अक्टूबर महीन े में िुरू होगा।

(3) अगला र्वर्ा जपछल ेर्वर्ा की अंजतम परीक्षाओं के पणू ा होन े के बाि िुरू होगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(4) प्रत्येक एकीकृत जिक्षण मॉड्यूल पाठ्यक्रम के संिभा म ेंसंरजचत दकया िाएगा।

(5) प्रजत दिन न्द्यूनतम चार घटं े की सैद्ांजतक कक्षाएं और न्द्यूनतम तीन घंटे की गैर-व्याख्यान गजतजर्वजधयां आयोजित की िाएंगी।

(6) िैक्षजणक पाठ्यक्रम या जसलेबस, संस्ट्थान की अकािजमक पररर्ि द्वारा अनुमोदित दकया िाएगा और दकसी जर्विेर् र्वर् ा के जलए जर्वर्य के आर्वंटन के साथ-साथ जर्वर्य की सामग्री के संबंध में, संिोधन के अधीन होगा।

12. जर्वर्यों या पाठ्यक्रमों की सख्ं या, जिक्षण घटं े और अकं जर्वतरण- (1) बैचलर ऑफ फामेसी (आयुर्वेि) उपाजध कायाक्रम म ें व्याख्यान कक्षा और गरै -व्याख्यान कक्षा होगी तथा गैर-व्याख्यान म ें प्रायोजगक जनष्पािन, प्रििना , जर्वतरण आदि गजतजर्वजधयाँ िाजमल ह।ैं

(2) प्रत्येक र्वर् ा जिक्षण के जलए कुल 200 दिन ह ै जिसमें िो परीक्षाए,ं िो छुरियां (ग्रीष्म और दिर्वाली) होगी और अन्द्य सरकारी छुरियां िाजमल नहीं ह।ैं

(3) सस्ट्ं थान प्रत्येक सत्र म ेंजिक्षण पैटन ाऔर जर्वर्यों का जनधाारण करेगा।

13. अजनर्वाय ा इंटनजा िप:- (1) भारत म ें कहीं भी सरकार द्वारा मान्द्यता प्राप्त गुड मैन्द्युफैक्चररंग प्रैजक्टस प्रमाजणत फामेसी म ें इंटनाजिप की अर्वजध बारह सप्ताह होगी।

(2) छात्र को फामेसी के सभी जर्वभागों में पयााप्त अनुभर्व प्राप्त करना होगा।

(3) इंटनाजिप कायाक्रम पाठ्यक्रम के कायाकाल के िौरान होगा।

(4) इंटनाजिप ओररएंटेिन कायाक्रम:- (क) संस्ट्थान इंटनाजिप िुरू होन े से पहले एक अजनर्वाया तीन दिर्वसीय ओररएंटेिन कायाक्रम आयोजित करेगा; (ख) ओररएंटेिन कायाक्रम प्रजिक्षु को आयुर्वेदिक िर्वा जनमााण के जनयमों और जर्वजनयमों, कानूनी पहलओंु , बैच जनमााण ररकॉडा और जर्वजभन्न प्रकार के उत्पाि प्रमाणन के बारे म ेंअपेजक्षत ज्ञान प्राप्त करने के उद्देश्य से आयोजित दकया िाएगा। (ग) ओररएंटेिन की अर्वजध जनधााररत इंटनाजिप अर्वजध को छोडकर होगी और जिन छात्रों न े ओररएंटेिन कायाक्रम पूण ा कर जलया ह,ै उन्द्ह ेंही अपनी इंटनाजिप िरूु करन े की अनुमजत िी िाएगी;

(घ) ओररएंटेिन आयोजित करने के जलए मनै ुअल संस्ट्थान द्वारा जनधााररत दकया िाएगा।

(5) इंटनाजिप कायाक्रम का समापन: इंटनाजिप कायाक्रम के सफल समापन पर, संबंजधत फामेसी इंटना को प्रमाण पत्र िारी करेगी और संस्ट्थान के फामाास्ट्युरटकल प्रजिक्षण और प्लेसमेंट सेल के प्रभारी प्रमाण पत्र का सत्यापन करेंगे।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7

(6) सत्यापन के बाि, संस्ट्थान के फामाास्ट्युरटकल प्रजिक्षण और प्लेसमेंट सेल के प्रभारी अनापजत्त प्रमाण पत्र तैयार करेंग े और उप जनििे क (फामेसी) के कायाालय में िमा करेंगे।

(7) अनापजत्त प्रमाण पत्र प्राप्त होने के बाि ही उप जनिेिक (फामेसी) कायाालय अनंजतम प्रमाण पत्र िारी करेगा।

(8) इंटना के जलए छुिी: दकसी इंटना को दकसी भी प्रकार की छुिी या अनपु जस्ट्थजत की अनमु जत नहीं ह ै और असाधारण पररजस्ट्थजतयों म,ें उप जनिेिक (फामेसी) द्वारा छूट िी िा सकती ह।ै

14. सह-पाठ्यचया ा सबं धं ी गजतजर्वजधया-ँ छात्र संस्ट्थान द्वारा आयोजित जर्वजभन्न गजतजर्वजधयों िैसे कायािालाएँ, सेजमनार, योग, खले और सांस्ट्कृजतक गजतजर्वजधयाँ, ड्रग टूर, उद्योग भेंट, राष्ट्रीय सेर्वा योिना आदि में सदक्रय रूप से भाग लगें े।

15. परीक्षाए-ँ (1) नामांदकत छात्र अपने र्वर्ा की अर्वजध की जनधााररत समयार्वजध पूणा होने के बाि परीक्षा में िाजमल होन े के पात्र होंगे।

(2) परीक्षा म ेंबैठन े के जलए पात्र होने के जलए आर्वश्यक न्द्यनू तम उपजस्ट्थजत प्रत्येक जर्वर्य म ेंकुल व्याख्यान और प्रैजक्टकल म ें अलग-अलग पचहत्तर प्रजतित होगी। बिते दक प्रमाजणत बीमारी के कारण, उप जनिेिक (फामेसी) संबंजधत छात्र की उपजस्ट्थजत में प्रत्येक जर्वर्य के जलए पांच प्रजतित तक छूट िे सकते ह ैंऔर यदि दकसी छात्र की उपजस्ट्थजत पांच से िस प्रजतित कम हो िाती है, तो उप जनिेिक (फामेसी) मामले को जनिेिक के पास भेि िगे ा और जनिेिक के पास इसे स्ट्र्वीकृत करने की िजि ह।ै

(3) सभी परीक्षाएं परीक्षा जनयत्रं क द्वारा जनधााररत की गई तारीखों और समय पर आयोजित की िाएंगी।

(4) पात्र छात्रों को जनधााररत परीक्षा िल्ु क का भगु तान करना होगा और संस्ट्थान के परीक्षा जनयंत्रक द्वारा अजधसूजचत जनधााररत समय के भीतर जर्वजधर्वत भरा हुआ परीक्षा फॉमा िमा करना होगा।

16. परीक्षाओं का र्वर्-ा

(1) रचनात्मक और योगात्मक मूल्यांकन होगा। रचनात्मक मूल्यांकन प्रत्येक जिक्षण मॉड्यलू के अंत में दकया िाएगा और योगात्मक मूल्यांकन प्रत्येक जर्वर्य के अंत म ें होगा।

(2) परीक्षा सामान्द्यत: प्रत्येक र्वर्ा के अंत तक आयोजित और पूणा की िाएगी और दकसी भी र्वर्ा के िो जर्वर्यों में अनुत्तीणा छात्र को अगल ेर्वर्ा के सत्र और परीक्षा में बैठने की अनुमजत िी िाएगी, हालांदक अगल ेर्वर्ा छात्र को सत्र को िारी रखन े की तब तक अनुमजत नहीं िी िाएगी िब तक दक छात्र जपछली परीक्षा के सभी जर्वर्यों या पाठ्यक्रमों में उत्तीणा न हो िाए। उन छात्रों के जलए कोई अलग कक्षा नहीं होगी िो कायाकाल परू ा नहीं कर सके और छात्र को जनयजमत छात्र बैच के साथ या िूजनयर बैच के साथ, िो भी लागू हो, कक्षा म ेंभाग लेना होगा।

(3) अंजतम परीक्षा सामान्द्यत: चौथे र्वर्ा के अंत में आयोजित और पणू ा की िाएगी और अंजतम र्वर्ा की अनुपरू क परीक्षा प्रत्येक छह महीन े में आयोजित की िाएगी।

(4) छात्र को अंजतम र्वर्ा की परीक्षा में बैठने की अनुमजत तब तक नहीं िी िाएगी, िब तक दक छात्र जपछली सभी परीक्षाओं के सभी जर्वर्यों या पाठ्यक्रमों में उत्तीणा नहीं हो िाता।

(5) इंटनाजिप को छोडकर पाठ्यक्रम पणू ा करने की अजधकतम अर्वजध प्रर्वेि की तारीख से िस र्वर्ा से अजधक नहीं होगी।

17. परीक्षा पटै न ा एर्व ं पिोन्नजत- (1) सैद्ांजतक परीक्षा के प्रश्न पत्र का पैटन ा संस्ट्थान के परीक्षा जनयंत्रण बोड ा द्वारा तैयार दकया िाएगा।

(2) प्रश्न पत्र जद्वभार्ी, अग्रं ेिी भार्ा और लहिं ी में होगा और उत्तर अग्रं ेिी या लहिं ी भार्ा में जलखे िा सकते ह।ैं

(3) परीक्षा उत्तीणा करने के जलए आर्वश्यक न्द्यूनतम अंक प्रत्यके जर्वर्य में सैद्ांजतक और प्रायोजगक में अलग-अलग पचास प्रजतित होंगे, िैसा दक इन जर्वजनयमों की अंक जर्वतरण ताजलका में उजल्लजखत ह।ै

(4) पैंसठ प्रजतित और उससे अजधक अंक प्राप्त करन े र्वाल े छात्र को प्रथम श्रेणी और पचहत्तर प्रजतित और इससे अजधक अंकों को जर्वजिष्टता प्रिान की िाएगी और य ेअर्वाड ापूरक परीक्षाओं के जलए लाग ूनहीं होंगे।

(5) यदि कोई छात्र संज्ञानात्मक कारणों से जनयजमत परीक्षा में उपजस्ट्थत होन े म ें जर्वफल रहता है, तो र्वह जनयजमत छात्र के रूप में पूरक परीक्षा में उपजस्ट्थत होगा, जिसकी जनयजमत परीक्षा में उपजस्ट्थत न होन े को अर्वसर के रूप म ें नहीं माना िाएगा।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(6) जनधााररत सीमा के भीतर प्रथम तीन र्वर्ों की परीक्षा उत्तीणा करने के बाि ही छात्र अजनर्वाया इंटनाजिप म ें िाजमल होन े के पात्र होंगे।

18. अजं तम मल्ू याकं न– सैद्ांजतक जर्वर्यों का अंजतम मल्ू यांकन पूण ा पाठ्यक्रम के आधार पर जनयजमत परीक्षा म ें दकया िाएगा और संबंजधत प्राजधकारी द्वारा िारी दििाजनििे ों के अनुसार परीक्षा म ें अंजतम प्रायोजगक मूल्यांकन में प्रायोजगक परीक्षा और मौजखक परीक्षा होगी।

19. िोहरी मल्ू याकं न प्रणाली- (1) एक उत्तर पुजस्ट्तका के जलए िो अलग-अलग योग्य परीक्षकों द्वारा िो मल्ू यांकन होंग े तादक एकल मल्ू यांकन म ेंअसंतुजलत प्रकृजत और पररणामी अजप्रय जस्ट्थजत को कम दकया िा सके।

(2) िोहरे मल्ू यांकन के बाि, िोनों स्ट्कोरों म ें कुल अंको के बीस प्रजतित तक जभन्नता होन े पर िोनों अंकों का औसत अंजतम अंक माना िाएगा।

(3) जभन्नात्मक अंकों के मामल े में, यदि जभन्न 0.5 या उससे ऊपर ह,ै तो इसे अगल े उच्चतम अंक मान तक पणू ाांदकत दकया िाएगा और यदि स्ट्कोर 0.5 से नीचे ह ैतो इसे जनचले अंक मान तक पणू ाांदकत दकया िाएगा।

(4) िोहरे मूल्यांकन के अंत म,ें यदि िो स्ट्र्वतंत्र स्ट्कोरों के बीच अंतर कुल अंकों के बीस प्रजतित से अजधक है, तो ऐसी उत्तर पुजस्ट्तकाओं को तीसरे पात्र परीक्षक द्वारा मल्ू यांकन हते ु योग्य माना िाएगा।

20. परीक्षकत्र्व- (1) सैद्ांजतक एर्व ं प्रायोजगक परीक्षा म ें परीक्षक बनन े की पात्रता संबंजधत जर्वर्य म ें न्द्यूनतम तीन र्वर् ा का जिक्षण अनुभर्व होगा।

(2) प्रायोजगक परीक्षा में िो परीक्षक होंग,े एक आंतररक परीक्षक संस्ट्थान से और िसू रा बाहरी परीक्षक दकसी मान्द्यता प्राप्त महाजर्वद्यालय या संस्ट्थान स ेहोगा।

21. अनजु चत साधनों और उच्छृंखल आचरण पर जनयत्रं ण- (1) कोई भी छात्र परीक्षा में या उसके संबंध में अनुजचत साधनों का उपयोग नहीं करेगा या उच्छृंखल आचरण में िाजमल नहीं होगा और ऐसा करना संस्ट्थान के परीक्षा के प्रार्वधान के अनुसार अपराध की प्रकृजत और गंभीरता के आधार पर िडं नीय अपराध माना िाएगा।

(2) दकसी परीक्षा या परीक्षण में दकसी छात्र के किाचार के संबंध में ररपोटा प्राप्त होन े या मामले का पता चलन े पर, जनिेिक द्वारा जनयुि परीक्षा अनुिासनात्मक कारार्वाई सजमजत को उसमें जनधााररत प्रदक्रयाओं का पालन करने के बाि छात्र को िंजडत करने की िजि होगी और िहां दकसी परीक्षा म ें छात्र के जर्वरूद् किाचार का आरोप जसद् हो िाता ह ै तो जनम्नजलजखत में से कोई एक या अजधक िण्ड सजमजत द्वारा छात्र को दिया िा सकता ह,ै अथाात्; - (क) दकसी परीक्षा म ें उसके प्रर्विे को रद्द करना या अस्ट्र्वीकार करना और उसके द्वारा भुगतान दकया गया िल्ु क, यदि कोई हो, को िब्त कर लने ा;

(ख) उस परीक्षा के पररणाम को रद्द करना जिसके साथ आरोप िुडा हुआ है; (ग) उस े एक जर्वजिष्ट अर्वजध के जलए, िो पांच र्वर् ा या उससे अजधक या स्ट्थायी रूप से संस्ट्थान के दकसी भी पाठ्यक्रम म ें िाजमल होने स ेरोक सकता ह;ै (घ) नीचे िी गई अनुसूची म ेंदिए गए िंड के स्ट्तर के अनुसार दकसी भी संस्ट्थागत परीक्षा में उपजस्ट्थत होने से र्वंजचत करना। अनसु चू ी:

(2) परीक्षा हॉल में परीक्षा के जर्वर्य से संबंजधत सामग्री रखना अथाता ्:- िो परीक्षाओं म ें बैठन े से र्वजं चत (क) कागिात, दकताबें या नोट्स; अथर्वा दकया िा सकता ह ै (ख) छात्र द्वारा पहन ेगए कपडों के दकसी भी जहस्ट्से पर या उसके िरीर के[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 9 दकसी भी जहस्ट्से, या टेबल या डस्ट्े क पर जलजखत नोट्स; अथर्वा (ग) फुट-रूल या उपकरण िैस े सेट-स्ट्वायर, प्रोरैक्टर, स्ट्लाइड रूलर आदि जिन पर नोट्स जलख ेहों।

(3) उत्तर-पुजस्ट्तका से नकल करना पाया गया या जसद् दकया गया या अन्द्यथा िो परीक्षाओं म ें बैठन े से र्वजं चत यह स्ट्थाजपत हो िाता ह ैदक छात्र ने, दकया िा सकता ह ै (क) परीक्षा के िौरान या उसके बाि दकसी भी समय दकसी भी तरीके से दकसी भी कागिात, दकताबें, नोट्स, उत्तर-पुजस्ट्तका या दकसी अन्द्य स्रोत से नकल की या मिि ली; या (ख) दकसी अन्द्य छात्र को अपनी उत्तर-पुजस्ट्तका से नकल करन े की अनुमजत िी; या (ग) दकसी अन्द्य छात्र से सहायता प्राप्त की ह ैया सहायता िी है; या (घ) दकसी अन्द्य छात्र के साथ अपनी उत्तर-पुजस्ट्तका या उसके दकसी भाग का आिान-प्रिान दकया।

(4) प्रश्न पत्र (या उसके दकसी भाग) को बाहर भेिनें या बाहर भेिनें का िो परीक्षाओं म ें बैठन े से र्वजं चत प्रयास करने पर दकया िा सकता ह ै

(5) आपजत्तिनक सामग्री को जनगलना, उस े लेकर भाग िाना या उसे गायब तीन परीक्षाओं में बैठने से र्वजं चत दकया िा सकता ह ै कर िेना या दकसी अन्द्य तरीके से नष्ट करना।

(6) दकसी उत्तर-पुजस्ट्तका को अंिर या बाहर ले िाना अथर्वा उसे बिलना या तीन परीक्षाओं में बैठने से र्वजं चत उत्तर जलखन े के बाि उस े बिल िेना (परीक्षा के िौरान या बाि म ें दकसी दकया िा सकता ह ै व्यजि की सहायता या सहायता के बगरै अथर्वा जमलीभगत से)।

(7) उत्तर-पुजस्ट्तका पयार्वेक्षक को न सौंपना या उत्तर-पुजस्ट्तका को नष्ट कर िो परीक्षाओं म ें बैठन े से र्वजं चत िेना। दकया िा सकता ह ै

(8) परीक्षा हॉल म ें गंभीर किाचार या कमाचाररयों के साथ िव्यु ार्वहार या छात्र को संस्ट्थान से स्ट्थायी रूप से परीक्षा हॉल के अंिर अथर्वा बाहर परीक्षा ड्यूटी पर जनयुि कमाचाररयों र्वर्िात दकया िा सकता ह ै के साथ बल प्रयोग।

(9) अर्वज्ञा, सीट पररर्वतना , परीक्षा हॉल म ें या उसके आसपास िव्यु ार्वहार या एक परीक्षा म ें बैठन े स े र्वंजचत दकया िा सकता ह ै उत्तर पुजस्ट्तका पर दकसी अन्द्य छात्र की सीट संख्या जलखना।

(10) अंक बढान े या खाली पन्नों पर उत्तर जलखने या परीक्षा के संचालन म ें तीन परीक्षाओं में बैठने से र्वजं चत बाधा डालन े के जलए परीक्षक के पास िाना। दकया िा सकता ह ै

(11) प्रजतरूपण-प्रजतरूपणकताा (िो दकसी अन्द्य छात्र के जलए जलखता ह)ै , यदि छात्र को संस्ट्थान से स्ट्थायी रूप से र्वर्िात दकया िा सकता ह ै र्वह इस संस्ट्थान का छात्र होने के साथ-साथ प्रजतरूजपत छात्र भी ह।ै

(12) िब उत्तर-पुजस्ट्तका में िाजमल हो, संबंजधत जर्वर्य का पररणाम रद्द दकया िा सकता ह ै (क) अपमानिनक या अश्लील अथर्वा धमकी भरी भार्ा; अथर्वा (ख) परीक्षक स ेअपील; अथर्वा (ग) पहचान प्रकट करन े के जलए जर्वजिष्ट जचह्न या जचह्न।

(13) आर्वेिन पत्र म ें दकसी भी प्रकार की गलत िानकारी के आधार पर परीक्षा एक परीक्षा म ें बैठन े स े र्वंजचत दकया में प्रर्वेि। िा सकता ह ै

(14) यदि छात्र र्वीजडयो फुटेि में बात करत े या कोई अन्द्य किाचार करत े हुए एक परीक्षा म ें बैठन े स े र्वंजचत दकया अथर्वा परीक्षा हॉल में मोबाइल फोन या कोई अन्द्य इलेक्रॉजनक गैिेट िा सकता ह ै रखते हुए पाया िाता ह।ै10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(3) दकसी परीक्षा म ें दकसी अनुजचत साधन या कृत्य को छात्र के जर्वरूद् जसद् दकया िाता ह ै िो उप-जर्वजनयम (3) म ें उजल्लजखत नहीं ह ै तो जनििे क द्वारा जनयुि परीक्षा अनुिासनात्मक कारार्वाई सजमजत को छात्र द्वारा प्रयुि अनुजचत साधन अथर्वा कृत्य के मामले के अनुसार िण्ड जनधााररत करने की िजि होगी।

22. जर्वजर्वध- बैचलर ऑफ फामेसी (आयुर्वेि) उपाजध कायाक्रम के तहत संलग्न स्ट्कॉलरों को दकसी भी र्वैतजनक या अर्वैतजनक जनयुजियों अथर्वा सेर्वा या काम करने या स्ट्र्वय ं को स्ट्र्व-रोज़गार म ें संलग्न करन े की अनुमजत नहीं िी िाएगी और स्ट्कॉलर को दकसी भी नई नौकरी या जनयुजियों के जलए आर्वेिन िमा करते समय संस्ट्थान से 'अनापजत्त प्रमाण पत्र' िमा करने के जलए जनिेजित दकया िाएगा और चकू कताा िुल्क की र्वसूली और प्रर्वेि समाजप्त िैसी अनिु ासनात्मक कारार्वाई हते ु उत्तरिायी होंगे।

23. र्वके ेिन और छुरिया-ँ (1) संस्ट्थान के प्राजधकारी द्वारा जनधााररत दकए गए गमी के तीस दिनों और सर्िायों के पंरह दिनों सजहत िो छुरियां और दकसी भी प्रकार की छुिी को र्वेकेिन के साथ नहीं िोडा िा सकता है; हालाँदक जनििे क के पास असाधारण पररजस्ट्थजतयों में अजतररि छुिी स्ट्र्वीकृत करने की िजि होगी।

(2) ड्यूटी या जर्विेर् छुिी उन छात्रों को िी िाएगी, जिन्द्ह ें खेल, सेजमनार आदि म ें भाग लेने के जलए प्राजधकारी द्वारा प्रजतजनयुि या अनुमजत िी गई ह ै और ऐसी छुिी एक र्वर्ा म ेंपरं ह दिनों से अजधक नहीं होगी; हालाँदक, जनिेिक द्वारा जर्विर्े पररजस्ट्थजत में छुिी को अजधकतम पंरह दिनों तक बढाया िा सकता ह।ै

24. प्राजधकारी की जर्वर्वके ाधीन िजिया:ं संस्ट्थान के जनिेिक के पास इन जर्वजनयमों के प्रार्वधानों की व्याख्या म ें दकसी भी जर्वसंगजत के जलए अंजतम अजधकार ह,ै और जलजखत रूप में ििा दकए िाने र्वाले कारणों के जलए, संस्ट्थान के िासी जनकाय के अनुमोिन या अनुसमथान से इन जर्वजनयमों के दकसी भी प्रार्वधान में छूट िे सकत े ह।ैं डॉ. अनूप ठाकर, जनििे क [जर्वज्ञापन-III/4/असा./077/2024-25] INSTITUTE OF TEACHING AND RESEARCH IN AYURVEDA

NOTIFICATION New Delhi, the 29th April, 2024 F. No. L-12015/25/2021-AS-Pt.1A.—In exercise of the powers conferred by clause (k) of sub-section (1) of

Section 28 of the Institute of Teaching and Research in Ayurveda Act, 2020 (16 of 2020), the Institute of Teaching and Research in Ayurveda, with the prior approval of the Central Government, hereby makes the following regulations, namely: -

1. Short title and commencement. - (1) These regulations may be called the Institute of Teaching and Research in Ayurveda, Bachelor of Pharmacy- Ayurveda [B. Pharm. (Ayu.)] Regulations 2024.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions. - (1) In these regulations, unless the context otherwise requires,-

(a) “Act” means the Institute of Teaching and Research in Ayurveda Act, 2020 (16 of 2020);

(b) "Controller of Examinations" means Controller of Examinations appointed by the Institute;

(c) “Deputy Director” means the Deputy Director (Pharmacy);

(d) “Lectures” means didactic teaching i.e. classroom teaching;

(e) “Non-lectures” includes Practical and demonstrative teaching and the demonstrative teaching includes small group teaching or tutorials or seminars or symposiums or assignments or pharmacy training or laboratory training or field visits or skill lab training or integrated learning, etc. as per the requirement of the concerned subject.

(f) “Under Graduate programme” means the Bachelor of Pharmacy (Ayurveda) degree programme;

(2) Words and expressions used herein and not defined but defined in the Act shall have the same meaning respectively assigned to them in the Act.

3. Eligible criteria for Admission.- (1) The eligibility to seek admission in Bachelor of Pharmacy (Ayurveda)

shall be as under:-

(a) The candidate shall have passed the intermediate (10+2) or its equivalent examination from any examination board with the Physics, Chemistry, Biology and English and have obtained minimum of[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 11 fifty per cent. marks taken together in Physics, Chemistry and Biology at qualifying examination in the case of General category and forty per cent. marks in the case of the Scheduled Castes, Scheduled

Tribes and Other Backward Classes:

Provided that in respect of persons with disability, candidate specified under the Rights of Persons with Disabilities Act, 2016 (49 of 2016), the minimum qualifying marks in the said examination in Physics, Chemistry and Biology shall be forty-five per cent. in the case of General category and forty per cent. in the case of the Scheduled Castes, the Scheduled Tribes and the Other Backward Classes.

(b) Admission through Diploma of Pharmacy (Ayurveda) programme: Admission may be made on maximum of twenty per cent. seats out of the total number of intake capacity permitted for Bachelor of Pharmacy (Ayurveda) programme rest of the seats may be filled up by following the eligibility criteria mentioned in clause (a) of sub-regulation (1) of regulation 3.

(c) No candidate shall be admitted to Bachelor of Pharmacy (Ayurveda) degree programme unless he or she has attained the age of seventeen years on or before the 31st December of the year of admission in the first year of the degree programme.

(2) National Eligibility-cum-Entrance Test.- (a) There shall he a uniform entrance examination for all medical institutions at the under-graduate level namely the National Eligibility-cum- Entrance Test

(NEET) for admission to under-graduate programme in each academic year and shall be conducted by an authority designated by the Institute of Teaching and Research in Ayurveda.

(b) In order to consider for admission to Bachelor of Pharmacy (Ayurveda) degree programme for an academic year, it shall be necessary for a candidate to obtain a minimum of marks at fifty percentile in the National Eligibility cum Entrance Test for Under Graduate programme held for the said academic

year:

Provided that in respect of, -

(i) candidates belonging to the Scheduled Castes, the Scheduled Tribes and the Other Backward Classes, the minimum marks shall be at 40th percentile;

(ii) candidates with benchmark disabilities specified under the Rights of Persons with Disabilities Act, 2016 (49 of 2016), the minimum marks shall be at 45th percentile in the case of General category and 40th percentile in the case of the Scheduled Castes, the

Scheduled Tribes and the Other Backward Classes:

Provided further that where sufficient numbers of candidates in the respective category fail to secure minimum marks in the National Eligibility-cum- Entrance Test held for any academic year for admission to undergraduate programme, the Institute of Teaching and Research in Ayurveda in consultation with the Central Government may at its discretion lower the minimum marks required for admission to undergraduate programme for candidates belonging to respective category and marks so lowered by the Institute of Teaching and Research in Avurveda shall be applicable for that academic year only.

(3) Two seats shall be reserved for foreign national candidates, approved by the Central Government:

Provided that sub-regulation (1) and (2) shall not be applicable for said foreign national candidates and for these candidates any other equivalent qualifications approved by the Central Government may be allowed.

4. Reservation Policy.- The reservation for different categories (i.e. the Scheduled Cast, the Scheduled Tribe, the Other Backward Class, Economically Weaker Section, Person with benchmark disabilities) shall be as per the orders and instructions issued by the Central Government at the time of admission.

5. Counseling.- (1) On declaration of the results of the qualifying examination as stated in regulation 3, the counseling and admission to the Under Graduate degree programme of the Institute shall be conducted by Ayush Admissions Central Counselling Committee (AACCC) of Ministry of Ayush, Government of India, New Delhi on the basis of All India common merit list and the allotted candidates shall present physically for verification of their credentials and the admission shall be granted to the eligible candidates.

(2) No candidate who has failed to obtain the minimum eligibility marks under this regulation shall be admitted to under-graduate programme in the said academic year.

6. Enrolment of the students.- (1) The student shall be enrolled as a student of the Institute within six months of his admission.

(2) The enrolment fee shall be determined by the Institute and shall be paid once only irrespective of the number of times the student appears for examinations of the Institute.12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(3) The Controller of Examinations shall maintain the record of the enrollment.

(4) On enrollment, every student shall receive an enrollment number under which his name has been entered in the register and that number shall be quoted by the student in all communications to the Institute.

7. Fee structure.- The students shall have to pay an annual fee like admission fee, examination fee, tuition fee and other fees notified by the Institute.

8. Duration of degree programme.- The duration of the Bachelor of Pharmacy (Ayurveda) degree programme shall be four years including 12 weeks of compulsory internship:

Provided that, if any student due to any reason leaves the degree programme in between with the due permission of authority of the institute, he shall be allowed to complete the degree programme within maximum duration of ten years from the date of admission.

9. Degree to be awarded.- The nomenclature of degree shall be Bachelor of Pharmacy (Ayurveda). The student shall be awarded Bachelor of Pharmacy (Ayurveda) Degree after passing all the examinations and completion of the laid down programme of study extending over the laid down period and the compulsory internship extending over twelve weeks on payment of necessary fees, either in person or in absentia at his option at the succeeding convocation of the Institute.

10. Medium of Instruction.- The medium of instruction for the Bachelor of Pharmacy (Ayurveda) degree programme shall be English or Hindi.

11. Study pattern and syllabus.- (1) The Under Graduate programme shall be conducted in Four years and taught in horizontal integration model while keeping the total duration and subjects as specified in these regulations.

(2) The first year shall ordinarily start in month of September or October.

(3) The subsequent years shall start after the completion of the final examinations of the preceding year.

(4) Each integrated teaching module shall be structured in terms of curriculum.

(5) Minimum four hours of theory classes and minimum three hours of non-lecture activities per day shall be conducted.

(6) The academic curriculum or syllabus shall be approved by Academic Council of the Institute and subjected to modification with respect to contents of a subject as well as allotment of subject to particular year.

12. Number of subjects or courses, teaching hours and marks distribution.- (1) Bachelor of Pharmacy (Ayurveda) degree programme shall have lecture class and Non-lecture class, and Non-Lectures involves practical performance, demonstration, dispensing, etc. activities.

(2) Total 200 days for teaching during each year which exclude two examinations, two vacations (summer and Diwali) and other Government holidays.

(3) The Institute shall determine the teaching pattern and subjects in each session.

(4) Bachelor of Pharmacy (Ayurveda) degree programme shall comprises of following subjects with their teaching hours and examination shall be held as per subjects taught during each session during the tenure of four years. 13. Compulsory Internship:- (1) The duration of Internship shall be twelve weeks at a Government recognised Good Manufacturing Practice certified pharmacy anywhere in India.

(2) The student shall acquire adequate experience in all the departments of Pharmacy.

(3) Internship program will be during the tenure of course.

(4) Internship orientation programme: -

(a) the institute shall conduct a mandatory three days orientation programme before the commencement of the internship;

(b) the orientation programme shall be conducted with an aim to make the intern to acquire the requisite knowledge about the rules and regulations of the of Ayurvedic drug manufacturing, legal aspects, batch manufacturing records and various types of product certifications.

(c) The period of orientation shall be excluding the prescribed internship period and those students who have completed the orientation programme only shall be allowed to start their internship;

(d) The manual for conducting the orientation shall be determined by the Institute.

(5) Completion of Internship Programme: On successful completion of internship programme, the concerned pharmacy shall issue certificate to the intern and In-charge of Pharmaceutical Training and Placement Cell of the Institute shall verify the certificate.

(6) After verification, the In-charge of Pharmaceutical Training and Placement Cell of Institute shall generate No Objection Certificate and submit to the office of Deputy Director (Pharmacy).

(7) Only after receiving No Objection Certificate, office of Deputy Director (Pharmacy) shall issue provisional certificate.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 15

(8) Leave for an intern: No any kind of leave or absence is permitted to an Intern and in extra ordinary conditions, relaxation may be granted by the Deputy Director (Pharmacy).

14. Co-curricular activities.- The students shall actively participate in various activities viz. workshops, seminars, yoga, sports and cultural activities, drug tour, industry visit, National Service Scheme etc. organised by the Institute.

15. Examinations.- (1) The enrolled students shall be eligible for appearing in the examination after completion of the stipulated time of their year term.

(2) The minimum attendance required to be eligible for appearing in the examination shall be seventy-five per cent. of the total lectures and practical in each subject separately.

Provided that on account of bonafide illness, the Deputy Director (Pharmacy) may condone the attendance of the concerned student up to five per cent. in each subject and if a student falls short in attendance by five to ten per cent., then the Deputy Director (Pharmacy) shall refer the case to the Director and the Director has power to sanction the same.

(3) All the examinations shall be held on such dates and time as decided by the Controller of Examinations.

(4) The eligible students shall have to pay stipulated examination fee and submit the examination form duly filled within the prescribed time as notified by the Controller of Examinations of the Institute.

16. Year of examinations.-

(1) There shall be formative and summative assessment. The formative assessment shall be carried out at the end of every teaching module and the summative assessment shall be at the end of every subject.

(2) The examination shall ordinarily be held and completed by the end of each year and the student failed in two subjects of any year shall be allowed to keep the term and examination of the next year, however the student shall not be allowed to keep term of subsequent year unless the student passes all the subjects or courses of previous examination. There shall be no separate class for the students who could not keep the term and student has to attend the class along with regular student batch or with junior batch as applicable.

(3) The final examination shall be ordinarily held and completed by the end of fourth year and the subsequent supplementary examination of final year shall be held in every six months.

(4) The student shall not be allowed to appear in final year examination, unless the student passes all the subjects or courses of previous all examinations.

(5) The maximum duration of completion of course excluding internship shall not exceed ten years from the date of admission.

17. Examination pattern and promotion.- (1) The pattern of theory examination question paper will be designed by the examination control board of the institute.

(2) The question paper shall be bilingual, in English language and Hindi and the answers may be written in English or Hindi languages.

(3) The minimum marks required for passing the examination shall be fifty per cent. in theory and in practical separately in each subject as mentioned in marks distribution table of these regulations.

(4) A student obtaining sixty-five per cent. and above marks shall be awarded first class and seventy-five per cent. and above marks shall be awarded distinction and these award shall not be applicable for supplementary examinations.

(5) In case a student fails to appear in regular examination for cognitive reasons, he or she shall appear in supplementary examination as regular student, whose non-appearance in regular examination shall not be treated as a trial.

(6) Students shall be eligible for joining the compulsory internship only after passing all first three years examinations within the prescribed limit.

18. Final Assessment.- The final assessment of theory shall be done in the regular examination based on full syllabus, and final practical assessment in examination shall be Practical and Viva voce as per the guidelines issued by the concern authority.

19. Double evaluation system.- (1) There shall be two evaluations for an answer book by two different eligible examiners so that lopsided nature in single evaluation and consequent unpleasant situation is mitigated.

(2) After double evaluation, in case of variation of both the scores up to twenty per cent. of the total marks then the average of both the scores shall be considered as final score.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(3) In case of fractional scores, if the fraction is 0.5 or above, it shall be rounded up to next highest digit and if the score is below 0.5 it shall be rounded up to the lower digit value.

(4) At the end of double evaluation, if the variation between two independent scores is more than twenty percent of the total marks, then such answer books shall be considered for evaluation by third eligible examiner.

20. Examinership.- (1) The eligibility to be an examiner in the theory and practical examination shall be a minimum of three years of teaching experience in the concerned subject.

(2) There shall be two examiners in the practical, one internal examiner from the Institute and the other external examiner from any recognized college or Institute.

21. Control of unfair means and disorderly conduct.- (1) No student shall use unfair means or indulge in disorderly conduct at, or in connection with the examination and doing so shall be considered as on punishable offence depending upon the nature and gravity of the offence as per the provision of Examination of the Institute.

(2) On receipt of a report or on detection of a case regarding the misconduct of any student at any examination or tests, the Examination Disciplinary Action Committee appointed by the Director shall have the power to punish the student after following the procedures as laid down therein and any one or more of the following punishment may be awarded by the committee to the student where a charge of misconduct at an examination is held proved against the student, namely; -

(a) cancelling or rejecting his admission to an examination and forfeiting fees if any, paid by him;

(b) cancelling his result of the examination with which the charge is connected;

(c) debarring him for a specific period which may be five years or more or permanently from joining any course of the institute;

(d) appearing in any of the Institutional examination as per the level of punishment given in schedule below.

(a) copied or taken help from any papers, books, notes, answer-book or any other sources in any manner during the examination or at any time thereafter; or

(b) allowed another student to copy from his or her answer-book; or

(c) received help from or has helped another student; or

(d) exchanged his or her answer-book or apart thereof with another student.

(4) On passing or attempting to pass on the question paper (or part Disqualification from appearing thereof) outside in examinations for two exams

(6) Smuggling in or out of an answer-book or replacing or getting it Disqualification from appearing replaced after attempting answers (during or after the examination in examinations for three exams with or without the help or connivance of any person).

(7) Non delivery of answer-book to the supervisor or destroying the Disqualification from appearing answer book. in examinations for two exams

(8) Serious misconduct in the examination hall or misbehavior with staff Permanently debarring the or using force with the staff appointed on exam duty inside or outside student from Institute the examination hall.

(9) Disobedience, change of seat, misbehavior in or around examination Disqualification from appearing hall or writing another student’s seat number on the answer-book. in examinations for one exam

(10) Approaching examiner for raising marks or for writing the answer on Disqualification from appearing blank pages or obstructing the conduct of an examination. in examinations for three exams

(11) Impersonation–impersonator (who writes for another student), if is a Permanently debarring the student of this institute as well as impersonated student. student from Institute.

(12) When answer-book contains, Cancelling the result of respective

(a) abusive or obscene or threatening language; or subject

(b) appeal to the examiner; or

(c) distinctive mark or sign to disclose the identity.

(13) Admission to the examination on any kind of false representation in Disqualification from appearing the application form. in examinations for one exam

(14) If the student is found talking or doing any other malpractice in the Disqualification from appearing video footage or keeping mobile phone or any other electronic gadgets in examinations for one exams in the examination hall.

(3) Any unfair means or acts in any examinations is held proved against student which are not mentioned in Sub- regulations (3), the Examination Disciplinary Action Committee appointed by the Director shall have power to decide the punishment as per the case of unfair means or acts by the student.

22. Miscellaneous.- The scholars undergoing Bachelor of Pharmacy (Ayurveda) degree programme shall not be permitted to undertake any paid or unpaid appointments or service or work or engage himself or herself in self-employment and the scholar shall be directed to obtain ‘No Objection Certificate’ from the Institute while, submitting an application for any new job or appointments and the defaulters are liable for disciplinary action such as recovery of fees and termination of admission.

23. Vacations and Leaves.- (1) Two vacations including thirty days of summer and fifteen days of winter seasons as decided by the authority of the institute and no any kind of leave can be attached with vacation; however the Director shall have power to sanction extra leave in extra ordinary circumstances.

(2) The duty or special leave shall be granted to the students, who are deputed or allowed by the authority to take part in the sports, seminar, etc., and such leave shall not exceed fifteen days in a year; however, the leave may be extended maximum up to fifteen days in special case by the Director.

24. Discretionary powers of authority: The Director of the Institute has the final authority for any discrepancy in the interpretation of provisions of these regulations, and for reasons to be recorded in writing, may relax any provisions of these regulations with the approval or ratification of the Governing Body of Institute.
