1. सजं क्षप्त िीर्का और प्रारंभ- (1) इन जनयमों का संजक्षप्त नाम आयुर्वेद जिक्षण और अनसु ंधान संस्ट्थान, डॉक्टर ऑफ दफलोसॉफी जनयम, 2024 ह।ै

(2) र्वे आजधकाररक रािपत्र म ेंउनके प्रकािन की तारीख स ेलागू होंगे।

2. पररभार्ाए-ँ (1) इन जर्वजनयमों में, िब तक दक संदभ ासे अन्यथा अपेजक्षत न हो,- (क) "अजधजनयम" का अथ ाह ैआयुर्वेद जिक्षण एर्वं अनुसंधान संस्ट्थान अजधजनयम, 2020 (2020 का 16); (ख) "संबद्ध जर्वर्य" का अथ ा सामान्य रूप स े स्ट्र्वास्ट््य जर्वज्ञान से ह ै और आयुर्वेद को जर्विेर् रूप से एक संबद्ध जर्वर्य माना िाएगा;

(ग) "आर्वेदक" का अथा एक व्यजि ह ै िो जनधााररत आर्वेदन पत्र में संस्ट्थान के डॉक्टरेट जडग्री कायाक्रम में प्रर्वेि के जलए आर्वेदन करता ह;ै 1667 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (घ) "सह-गाइड " या "सह-पयर्वा ेक्षक" का अथ ा ह ै एक अजतररि गाइड या पयार्वेक्षक, िहां भी आर्वश्यक हो, जिसे स्ट्कॉलर के िोध काया का मागादिान या पयार्वेक्षण करने के जलए जर्वभागीय अनुसंधान सजमजत द्वारा अनमु ोददत दकया गया हो और सह- गाइड या सह-पयार्वेक्षक संस्ट्थान का पूणाकाजलक सदस्ट्य हो भी सकता है;

(ङ) "परीक्षा जनयंत्रक" का अथ ासंस्ट्थान के सक्षम प्राजधकारी द्वारा जनयुि परीक्षा जनयंत्रक से है; (च) "सह-प्रधान अन्र्वेर्क" का अथ ा ह ै एक अजतररि अन्र्वेर्क, िहां भी आर्वश्यक हो, जिसे संस्ट्थागत अनुसंधान सजमजत द्वारा अनुसंधान पररयोिना के जलए प्रधान अन्र्वेर्क की सहायता के जलए अनुमोददत दकया गया हो और र्वह संस्ट्थान का पूणाकाजलक सदस्ट्य हो भी सकता ह ैऔर नहीं भी;

(छ) "पाठ्यक्रम काया" का अथा ह ै जर्वभागीय अनुसंधान सजमजत के माध्यम से जर्वभाग द्वारा डॉक्टरेट जडग्री कायाक्रम के जलए पंिीकृत स्ट्कॉलरों के जलए अध्ययन के पाठ्यक्रम; (ि) "डॉक्टोरल जडग्री" का अथ ा जनम्नजलजखत जर्वर्यों में इन जनयमों के प्रार्वधानों के अनुसार संस्ट्थान द्वारा प्रदान की िान े र्वाली जडग्री ह,ै अथाात्: -

(i) डॉक्टर ऑफ दफलॉसफी-पीएचडी (आयुर्वेद) (आयुर्र्वाद्यार्वाररजध);

(ii) डॉक्टर ऑफ दफलॉसफी-पीएचडी (आयुर्वेद फामेसी); या

(iii) डॉक्टर ऑफ दफलॉसफी-पीएचडी (मडे ीजसनल पलांट); या

(iv) डॉक्टर ऑफ दफलॉसफी-पीएचडी (संबद्ध जर्वज्ञान); या

(v) डॉक्टर ऑफ दफलॉसफी-पीएचडी (रांसजडजसजपलनरी) (झ) "गाइड" या "पयार्वेक्षक" का अथ ा संस्ट्थान का एक पूणाकाजलक जनयजमत फैकल्टी स े ह ै जिसे अकादजमक पररर्द द्वारा दकसी िोध स्ट्कॉलर के डॉक्टरेट जडग्री अनुसंधान काय ा का मागादिान या पयार्वेक्षण करन े के जलए अनुमोददत दकया गया ह;ै (ञ) "संस्ट्थागत आचार सजमजत" का अथा भारतीय जचदकत्सा अनुसंधान पररर्द द्वारा ददए गए संजर्वधान के अनुसार तीन र्वर् ा की अर्वजध के जलए ह,ै जिसमें अध्यक्ष (संस्ट्थान के बाहर से), सदस्ट्य सजचर्व (आयुर्वेददक जचदकत्सक), दािाजनक/नीजतिास्त्री, जचदकत्सा जर्विेर्ज्ञ, बुजनयादी जचदकत्सा र्वैज्ञाजनक (फामााकोलॉजिस्ट्ट), िाजमल ह।ैं संस्ट्थान के बाहर स े जचदकत्सक, जचदकत्सा जर्विेर्ज्ञ-आयुर्वेददक जर्वज्ञान, समुदाय के सामान्य व्यजि-मजहला और पुरुर्, समाि र्वैज्ञाजनक और काननू ी सलाहकार िाजमल ह;ैं (ट) "संस्ट्थागत पिु आचार सजमजत" का अथा पांच र्वर् ा की अर्वजध के जलए िानर्वरों पर प्रयोगों के जनयंत्रण और पयार्वेक्षण के जलए सजमजत स े ह,ै जिसम ें िैर्व र्वैज्ञाजनक, पिु गृह सुजर्वधा के प्रभारी र्वैज्ञाजनक, जर्वजभन्न िैजर्वक अनुिासन के दो र्वैज्ञाजनक, एक पिुजचदकत्सक, मुख्य नामांदकत व्यजि, ललंक नामांदकत व्यजि, बाहरी संस्ट्थान के र्वैज्ञाजनक और सामाजिक िागरूक नामांदकत व्यजि िाजमल ह;ैं (ठ) "सस्ट्ं थान जनकाय" का अथ ा ह ै अजधजनयम के तहत एक जनगजमत जनकाय के रूप म ें एकजत्रत और स्ट्थाजपत पूर्वार्वती संस्ट्थान। (ड) "संयुि या दोहरी डॉक्टरेट जडग्री कायाक्रम" का अथ ा एक स्ट्कॉलर द्वारा दकए गए अनसु ंधान और प्रजिक्षण का एक कॉट्यूटेल कायाक्रम ह ै िो दकसी भी जर्वर्य या अंतःजर्वर्य क्षेत्रों म ें एक साथ दो अलग-अलग संस्ट्थानों म ें पयार्वेक्षकों द्वारा समर्वती रूप स े नामांदकत और पयार्वेक्षण दकया िाता ह,ै और दोनों संस्ट्थानों की जडग्री आर्वश्यकताओं के अनुसार सफलतापूर्वाक पूरा होने पर, संस्ट्थानों द्वारा दो अलग-अलग जडग्री प्रमाणपत्र (टेस्ट्टामस)ा िारी दकए िाएंगे।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 (ढ) “पीएच.डी. ओपन जडफेंस" का अथा ह ै िोध प्रबंध के मल्ू यांकन और परीक्षकों और जर्वभागीय अनुसंधान सजमजत की जसफाररि के बाद अनुसधं ान स्ट्कॉलरों द्वारा अनुसंधान जडग्री सजमजत के समक्ष अनुसंधान जनष्कर्ों की प्रस्ट्तुजत;

(ण) "पीएचडी प्रपोिल जडफेंस" का अथ ा ह ै िोध स्ट्कॉलर द्वारा संस्ट्थागत अनुसंधान सजमजत के समक्ष िोध प्रबंध के संक्षेप सार की प्रस्ट्तुजत; (त) "प्री-पीएचडी जडफेंस" का अथा ह ै जनर्दष्टा अर्वजध के भीतर िोध स्ट्कॉलर द्वारा िोध काय ा पूरा करने के बाद संस्ट्थागत अनुसंधान सजमजत के समक्ष िोध जनष्कर्ों की प्रस्ट्तुजत;

(थ) "प्रधान अन्र्वेर्क" का अथ ा ह ै पररयोिना के जनष्पादन के दौरान पररयोिना स े संबंजधत मामलों और बौजद्धक संपदा के सृिन के संबंध म ें संस्ट्थागत अनुसंधान सजमजत के साथ संर्वाद करने के जलए अनुसंधान पररयोिना के जलए संस्ट्थान द्वारा नाजमत व्यजि। (द) "पंिीकरण अर्वजध" का अथ ा ह ैपंिीकरण की तारीख स े लेकर िोध काय ा के पीएचडी ओपन जडफेंस तक की अर्वजध;

(ध) "िोध स्ट्कॉलर" का अथ ा इन जर्वजनयमों के प्रार्वधानों के अनुपालन म ें संस्ट्थान के डॉक्टरेट जडग्री कायाक्रम के जलए अनुसंधान के जलए पंिीकृत व्यजि; (न) "जनर्वास अर्वजध" का अथ ा र्वह अर्वजध ह ैजिसके जलए िोध स्ट्कॉलर पणू ाकाजलक आधार पर संस्ट्थान म ेंउपजस्ट्थत रहगें ;े (य) "उद्देश्य का जर्वर्वरण" का अथा र्वह दस्ट्तार्वेज़ ह ै िो योग्य आर्वेदक द्वारा संबंजधत जर्वभागीय अनुसंधान सजमजत को प्रस्ट्तुत दकया िाएगा;

(र) "जिक्षक" का अथा ह ैएक व्यजि जिसे जनयजमत आधार पर संस्ट्थान म ें व्याख्याता या सहायक प्राध्यापक, प्रपाठक या सह- प्राध्यापक, प्राध्यापक के रूप म ें जनयुि दकया िाता ह ै और बुजनयादी जर्वज्ञान जर्वभाग में फामााकोलॉजिस्ट्ट, फामाास्ट्युरटकल केजमस्ट्ट, फामााकोग्नोजसस्ट्ट, बायोकेजमस्ट्ट, माइक्रोबायोलॉजिस्ट्ट, पैथोलॉजिस्ट्ट और रेजडयोलॉजिस्ट्ट के रूप म ें जनयुि दकया िाता ह;ै (ल) "रांसजडजसजपलनरी जर्वर्य" का अथ ा स्ट्र्वास्ट््य जर्वज्ञान के अलार्वा अन्य जर्वर्य स े ह,ै और (र्व) "र्वैध पंिीकरण" का अथा ह ै दक र्वह स्ट्कॉलर िो पणू ा दये राजि का भगु तान करने के बाद डॉक्टरेट कायाक्रम के जलए पंिीकृत हुआ ह।ै

(2) यहां उपयोग दकए गए और पररभाजर्त नहीं दकए गए लदे कन अजधजनयम म ें पररभाजर्त िब्दों और अजभव्यजियों का र्वही अथ ा होगा िो उि अजधजनयम म ें उन्ह ेंददया गया ह।ै

3. अनसु धं ान सजमजतया ँ - संस्ट्थान के डॉक्टरेट जडग्री कायाक्रम स े िुडे सभी मामल े अनुसंधान सजमजतयों द्वारा इन जनयमों के अनुसार संस्ट्थान के िासी जनकाय के सामान्य पयार्वेक्षण के अधीन जनपटाए िाएगं े।

4. सस्ट्ं थागत अनसु धं ान सजमजत- (1) एक संस्ट्थागत अनुसंधान सजमजत होगी जिसम ें जनम्नजलजखत सदस्ट्य िाजमल होंग,े अथाात:्- सस्ट्ं थान की सस्ट्ं थागत अनसु धं ान सजमजत

1. जनदेिक अध्यक्ष;

2. उपजनदेिक (स्नातकोत्तर) सदस्ट्य;

3. उपजनदेिक (फामेसी) सदस्ट्य;

4. डीन(िक्षै जणक) सदस्ट्य;

5. सदस्ट्य सजचर्व, संस्ट्थागत आचार सजमजत सदस्ट्य;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

6. सदस्ट्य सजचर्व, संस्ट्थागत पि ुआचार सजमजत सदस्ट्य;

7. िैर्वसांजख्यकीजर्वद ् सदस्ट्य;

8. अध्यक्ष द्वारा अजधमानत: रोटेिन के आधार पर नाजमत बायोकेजमस्ट्री या सदस्ट्य; पैथोलॉिी या माइक्रोबायोलॉिी प्रमुख, जिसे अध्यक्ष द्वारा अंजतम रूप ददया िा सकता ह।ै

9. अध्यक्ष द्वारा अजधमानत: रोटेिन के आधार पर नाजमत फामााकोलॉिी सदस्ट्य; या फामाास्ट्युरटकल केजमस्ट्री या फामााकोग्नॉसी प्रमुख,जिसे अध्यक्ष द्वारा अंजतम रूप ददया िा सकता ह।ै

10. अध्यक्ष द्वारा अजधमानत: रोटेिन के आधार पर नाजमत स्नातकोत्तर सदस्ट्य; जिक्षण जर्वभागों के तीन प्रमुख, जिसे अध्यक्ष द्वारा अंजतम रूप ददया िा सकता ह।ै

11. संस्ट्थान के लेखा अनुभाग का प्रमुख, सदस्ट्य;

12. अध्यक्ष द्वारा नाजमत तीन आमंजत्रत बाहरी जर्विेर्ज्ञ सदस्ट्य; और

13. डीन (अनुसंधान) सदस्ट्य सजचर्व

(2) संस्ट्थागत अनुसंधान सजमजत का गठन तीन र्वर् ा की अर्वजध के जलए डीन (अनुसंधान) की जसफाररिों पर जनदिे क द्वारा दकया िाएगा।

(3) जसफाररिें करते समय, संस्ट्थागत अनुसंधान सजमजत यह सजु नजित करेगी दक जसफाररिें इन जनयमों के अनुरूप की गई ह ैं और उसके पास जनम्नजलजखत िजियां और काय ा होंग,े अथाात्: - (क) संस्ट्थान की अनुसंधान गजतजर्वजधयों की समीक्षा और जनगरानी करना;

(ख) अनुसंधान प्रस्ट्तार्वों और अन्य अनुसंधान पररयोिना से सबं ंजधत मामलों की समीक्षा और अनमु ोदन करना; (ग) जर्वभागीय अनुसंधान सजमजत की जसफाररिों की िांच करना और उजचत जनणाय लने ा; (घ) प्रस्ट्ताजर्वत प्रायोजित अनुसधं ान काय ा या पररयोिना की प्रकृजत, उद्देश्य, गुणर्वत्ता और व्यर्वहायाता जनधााररत करने के जलए प्रायोिक एिेंजसयों के आर्वेदनों की िांच करना और यदद कोई हो तो उसे मंिूरी देना और आर्वश्यक जसफाररिें करना;

(ड.) प्रस्ट्ताजर्वत प्रायोजित िोधकाया या पररयोिना के जलए प्रधान अन्र्वेर्क की जनयुजि करना; (च) सह-प्रधान अन्र्वेर्क, यदद कोई हो, को प्राथजमकता देकर जर्विेर् पररजस्ट्थजतयों म ें अनुसधं ान पररयोिनाओं के प्रधान अन्र्वेर्क को बदलना;

(छ) दकसी भी प्रजतजित सगं ठन या एिेंजसयों के साथ समझौता ज्ञापन की समीक्षा और अनिु ंसा करना।

(4) संस्ट्थागत अनुसधं ान सजमजत र्वर् ा म ें त्रैमाजसक या कम से कम दो बार बैठक करेगी, तथाजप, संस्ट्थागत अनुसंधान सजमजत के अध्यक्ष अनुसंधान संबंधी गजतजर्वजधयों संबंधी चचा ा करन े के जलए दकसी भी समय बैठक बलु ाएंगे।

(5) प्रत्येक संस्ट्थागत अनुसंधान सजमजत की बैठक के बाद, सदस्ट्य-सजचर्व बैठक का कायार्वृत्त तैयार करेगा और सदस्ट्यों के बीच जर्वतरण के बाद अध्यक्ष के अनुमोदन स े सदस्ट्य-सजचर्व द्वारा हस्ट्ताक्षररत दकया िाएगा और कायार्वृत्त की प्रजत जनदेिक और परीक्षा जनयंत्रक और अन्य संबंजधतों को सूजचत की िाएगी।

(6) बैठक का कोरम पूरा करन ेके जलए न्यूनतम पचास प्रजतित सदस्ट्यों का होना आर्वश्यक ह।ै

5. जर्वभागीय अनसु धं ान सजमजत- (1) जनदेिक द्वारा संस्ट्थान के प्रत्येक जिक्षण जर्वभाग के जलए तीन र्वर् ा की अर्वजध हते ु संबंजधत जर्वभागाध्यक्ष की जसफाररिों पर एक जर्वभागीय अनसु ंधान सजमजत का गठन दकया िाएगा और प्रत्येक जर्वभागीय अनुसंधान सजमजत म ेंन्यनू तम पांच सदस्ट्य होंगे।

(2) कोरम परू ा करन े के जलए न्यूनतम पचास प्रजतित की आर्वश्यकता ह ै और पीएच.डी. जडग्री धारक एक जनयजमत जिक्षक जर्वभागीय अनुसंधान सजमजत का सदस्ट्य होगा।

(3) जर्वभागीय अनुसंधान सजमजत म ें जनम्नजलजखत सदस्ट्य िाजमल होंग,े अथाात्: -[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 सस्ट्ं थान की जर्वभागीय अनसु धं ान सजमजत

1. जर्वभागाध्यक्ष अध्यक्ष;

2. जर्वभाग के सभी प्राध्यापक सदस्ट्य;

3. रोटेिन के आधार पर र्वररिता के अनुसार जर्वभाग के जिक्षण स्ट्टाफ म ें स े सदस्ट्य; एक सह-प्राध्यापक

4. जर्वभागीय अनुसंधान सजमजत के अध्यक्ष द्वारा नाजमत अन्य जर्वभाग का एक सदस्ट्य; जिक्षक

5. अध्यक्ष द्वारा नाजमत मलू जर्वज्ञान जर्वभाग का एक प्रमुख सदस्ट्य;

6. रोटेिन के आधार पर र्वररिता के अनुसार जर्वभाग के जिक्षण स्ट्टाफ स े एक सदस्ट्य सजचर्व; और सहायक प्राध्यापक

7. संबंजधत जर्वर्य म ेंअध्यक्ष द्वारा नाजमत एक बाहरी जर्विेर्ज्ञ सदस्ट्य

(4) डीन (िक्षै जणक), डीन (अनुसंधान) और उप जनदिे क (स्नातकोत्तर) प्री-पीएचडी और पीएचडी ओपन जडफेंस और मौजखक परीक्षा के समय सदस्ट्य होंगे।

(5) डीन (अनुसंधान) को दकसी भी जर्वभागीय अनुसंधान सजमजत की बैठक म ें भाग लेन े का अजधकार ददया गया ह ै और उसे संबंजधत बैठक का सदस्ट्य माना िाएगा।

(6) अध्यक्ष प्राध्यापक के श्रेणी का होगा और यदद अध्यक्ष प्राध्यापक के श्रेणी का नहीं ह,ै तो जनदेिक उसी जर्वभाग के सह- प्राध्यापक या उपयुि व्यजि को अध्यक्ष के रूप म ें जनयिु कर सकता ह।ै

(7) अध्यक्ष को संस्ट्थान के कमाचाररयों के ऐस े सदस्ट्यों को सह-चयजनत करने की िजि होगी िो अस्ट्थायी सदस्ट्य के रूप म ें उनके जर्वचार-जर्वमि ा म ें सहायक हो सकते ह।ैं

(8) संबंजधत गाइड या पयार्वेक्षकों और सह-गाइड या सह-पयर्वा ेक्षकों को केर्वल उनके पयार्वेक्षण के तहत पीएचडी स्ट्कॉलरों की प्रस्ट्तुजतयों के दौरान जर्वभागीय अनुसंधान सजमजत की बैठक म ें भाग लेन े के जलए आमंजत्रत दकया िाएगा।

(9) फामेसी कायाक्रम के प्रत्येक जर्वभाग के जलए, जिक्षण और अनुसंधान संस्ट्थान, स्नातकोत्तर-फामेसी जर्वजनयमन 2023 के अनुसार एक सामान्य जर्वभागीय अनुसंधान सजमजत का गठन दकया िाएगा।

(10) जर्वभागीय अनुसंधान सजमजत कम स े कम छह महीने म ें बठै क करेगी।

(11) जसफाररिें करते समय, जर्वभागीय अनुसंधान सजमजत यह सुजनजित करेगी दक जसफाररिें इन जनयमों के अनरूु प की गई ह ैंऔर इसम ेंजनम्नजलजखत िजियां और काय ा होंग,े अथाात:्- (क) योग्य आर्वेदकों के पंिीकरण के जलए या अन्यथा पात्रता जनधााररत करने के उद्देश्य के जर्वर्वरण की िांच करना और आर्वश्यक जसफाररिें करना;

(ख) अनुसंधान के क्षत्रे को अनमु ोदन देन े के जलए जिसम ें आर्वदे कों को अनुसंधान िारी रखन े की जसफाररि की िाएगी और अनुसंधान काय ाका मागादिना करने के जलए गाइड या पयार्वेक्षक और सह-गाइड या सह-पयार्वेक्षक जनयुि दकया िाएगा;

(ग) यदद आर्वश्यक हो तो औजचत्य के साथ गाइड या पयार्वेक्षक के पररर्वतान की जसफाररि करना; (घ) पीएच.डी. जनयमन के अनसु ार अर्वजध को बढ़ाना; और (ड.) िोध कायों की प्रगजत ररपोटा का मूल्यांकन करना और िोध काय ा स े संबंजधत अन्य सभी मुद्दों पर चचा ा करना।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(12) प्रत्येक जर्वभागीय अनुसंधान सजमजत की बैठक के बाद, जर्वभागीय अनुसंधान सजमजत के सदस्ट्य-सजचर्व को बैठक का कायार्वृत्त तैयार करना होगा और सदस्ट्यों के बीच पररचाजलत करने के बाद सजमजत के अध्यक्ष के अनुमोदन के साथ सदस्ट्य- सजचर्व द्वारा हस्ट्ताक्षर दकए िाएंगे।

(13) कायार्वृत्त की एक प्रजत परीक्षा जनयंत्रक को भेिी िाएगी।

(14) जर्वभागीय अनुसंधान सजमजत म ें दकसी भी जर्वर्वाद की जस्ट्थजत म,ें मामला संस्ट्थागत अनुसंधान सजमजत को भेिा िाएगा, जिसका जनणाय अंजतम होगा।

6. अनसु धं ान जडग्री सजमजत- (1) जनदेिक द्वारा गरठत अनसु ंधान जडग्री सजमजत म ें जनम्नजलजखत सदस्ट्य िाजमल होंग,े अथाात:्- अनसु धं ान जडग्री सजमजत

1. जनदेिक अध्यक्ष

2. डीन(अनुसंधान) सदस्ट्य;

5. संबंजधत पीएच.डी. स्ट्कॉलर के गाइड या पयार्वेक्षक सदस्ट्य;

6. उस जर्विेर् स्ट्कॉलर के जलए बाह्य परीक्षक सदस्ट्य; और

7. परीक्षा जनयंत्रक (सीओई) सदस्ट्य-सजचर्व

(2) जसफाररिें करत े समय, अनसु ंधान जडग्री सजमजत यह सुजनजित करेगी दक जसफाररिें इन जर्वजनयमों के अनुरूप की गई ह ैं और उसके पास जनम्नजलजखत िजियां और काय ा होंग,े अथाात्: - (क) पीएचडी स्ट्कॉलर की ओपन जडफेंस और मौजखक परीक्षा आयोजित करना; और (ख) सफल स्ट्कॉलर को पीएच.डी. जडग्री अर्वाड ा करने के जलए अनुिंसा करना।

7. आर्वदे कों का र्वगीकरण- डॉक्टरेट जडग्री कायाक्रम म ें प्रर्वेि के जलए आर्वेदकों को जनम्नजलजखत श्रेजणयों म ें स े दकसी एक के तहत र्वगीकृत दकया िाएगा, अथाात्: - (क) आयुर् मंत्रालय द्वारा जर्वत्त पोजर्त;

(ख) केंद्रीय आयर्वु ेदीय जर्वज्ञान अनुसंधान पररर्द, र्वैज्ञाजनक और औद्योजगक अनुसंधान पररर्द, जर्वश्वजर्वद्यालय अनदु ान आयोग, भारतीय जचदकत्सा अनुसंधान पररर्द, अजखल भारतीय तकनीकी जिक्षा पररर्द, दकसी भी अनुसंधान योिना के तहत अन्य सरकारी संगठनों द्वारा जर्वत्त पोजर्त;

(ग) सांस्ट्कृजतक आदान-प्रदान छात्रर्वृजत्त कायाक्रम के तहत केंद्र सरकार द्वारा जर्वत्त पोजर्त, स्ट्र्व-जर्वत्तपोजर्त जर्वदेिी छात्र या स्ट्कॉलर जिन्ह ें समझौता ज्ञापन के तहत प्रर्वेि ददया िाता ह;ै (घ) िैक्षजणक जनकायों, िैक्षजणक संस्ट्थानों, पेिेर्वर जनकायों, गरै -सरकारी संगठनों द्वारा जर्वत्त पोजर्त;

(ड.) स्ट्र्व-जर्वत्तपोजर्त; (च) ररसचा एसोजसएट या सीजनयर ररसचा फेलो या िूजनयर ररसचा फेलो; (छ) कैंपस के जिक्षक या स्ट्टॉफ (जनयजमत या संजर्वदात्मक); (ि) रजिस्ट्टड ाड्र्वेल डॉक्टोरल जडग्री कायाक्रम के जलए नामांदकत।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7

8. प्रर्विे - (1) डॉक्टरेट जडग्री कायाक्रम म ें प्रर्वेि संबंजधत जर्वभाग के उन सभी जर्वर्यों म ें होगा िहां संस्ट्थान द्वारा स्नातकोत्तर कायाक्रम पेि दकए िा रह े ह।ैं

(2) संबद्ध या रांसजडजसजपलनरी अनुसंधान के जलए, प्रर्वेि स्ट्कॉलर द्वारा चयजनत जर्वर्य-जर्वजिष्ट गाइड की उपलब्धता पर दकया िाएगा।

(3) पीएचडी कायाक्रम म ेंप्रर्वेि के जलए आर्वेदकों के पास जनम्नजलजखत योग्यताए ंहोनी चाजहए, अथाात्: - (क) दकसी मान्यता प्राप्त जर्वश्वजर्वद्यालय या जर्वजध द्वारा स्ट्थाजपत संस्ट्थान स ेआयुर्वेद म ेंस्नातकोत्तर जडग्री; या (ख) आयुर्वेद फामेसी म ें स्नातकोत्तर जडग्री [एम.फामा ा (आयुर्वेद)] या मेजडजसनल पलांट्स [एम.एससी. (मेजडजसनल पलांट्स)] या दकसी मान्यता प्राप्त जर्वश्वजर्वद्यालय या जर्वजध द्वारा स्ट्थाजपत संस्ट्थान स े जर्विेर्ज्ञता के अनुसार संबंजधत क्षत्रे ; या (ग) जर्वजध द्वारा स्ट्थाजपत दकसी भी मान्यता प्राप्त जर्वश्वजर्वद्यालय या संस्ट्थान स े संबद्ध या रांसजडजसजपलनरी जर्वर्य म ें स्नातकोत्तर जडग्री।

(4) जर्वदेिी नागररकों के जलए पात्रता योग्यताए ं र्वही ह ैं िो भारतीय नागररकों के जलए इन जनयमों म ें जनर्दष्टा ह ैं और इसके अलार्वा, उन्ह ें भारतीय सांस्ट्कृजतक संबंध पररर्द के माध्यम स ेअपन े आर्वेदन प्रस्ट्तुत करन े होंग।े

(5) पीएच.डी. कायाक्रम म ें प्रर्विे र्वर्ा म ें एक बार ददया िाएगा और प्रर्वेि की प्रदक्रया प्रत्येक र्वर्ा अगस्ट्त-जसतंबर के महीन े स े िुरू की िाएगी और प्रर्वेि परीक्षा आम तौर पर प्रत्येक र्वर् ाअक्टूबर-नर्वंबर के महीन े म ेंआयोजित की िाएगी।

(6) प्रर्वेि की प्रदक्रया के जलए सभी महत्र्वपूणा जतजथयां िैस े जर्वज्ञापन की जतजथ, आर्वेदन पत्र िारी करना, प्रर्वेि परीक्षा तथा परीक्षा पररणाम की जतजथ, प्रयोिन जर्वर्वरण प्रस्ट्तुत करन े की जतजथ आदद प्राजधकरण द्वारा पहले स े जनधााररत की िाएगी और संस्ट्थान के िक्षै जणक कैलेंडर म ेंउजल्लजखत की िाएंगी।

(7) प्रर्वेि के जलए जर्वज्ञापन के साथ-साथ योग्य उपलब्ध गाइडों की सूची, उनके जर्वजिष्ट अनसु ंधान क्षत्रे और उनके अतं गता ररजियां संस्ट्थान की आजधकाररक र्वेबसाइट पर डाली िाएगं ी।

(8) सभी आर्वेदकों को प्रर्वेि परीक्षा के जलए जनर्दष्टा प्रारूप (अनुलग्नक-क) म ें समय-समय पर प्राजधकरण द्वारा जनधााररत की गई फीस के साथ आर्वेदन करना होगा।

(9) अपन े संबंजधत स्नातकोत्तर जडग्री के अंजतम र्वर् ा की परीक्षा म ें भाग लेन े र्वाल े आर्वेदक भी प्रर्वेि परीक्षा के जलए आर्वेदन कर सकते ह,ैं हालांदक उनका पिं ीकरण, पंिीकरण के समय उन परीक्षाओं म ेंउत्तीणा होन े के अधीन होगा।

(10) पात्रता परीक्षा आयुर्वेद के ज्ञान पर आधाररत होगी जिसम ें जचदकत्सा जर्वज्ञान, अनुसंधान पद्धजत, िैर्व सांजख्यकी म ें जर्विेर् र्वतामान प्रगजत के संबंजधत जर्वर्य पर जर्विेर् ध्यान ददया िाएगा और बहुजर्वकल्पीय प्रश्न प्रारूप के दो प्रश्न पत्र होंग,े अथाात ् पेपर I और पेपर II प्रत्येक का अजधभार बराबर पचास अंको का होंगा।

(11) पेपर I म ें स्ट्र्वास्ट््य जर्वज्ञान म ें र्वतामान प्रगजत के साथ-साथ अनुसंधान पद्धजत और िैर्व सांजख्यकी पर प्रश्न िाजमल होंग े और यह सभी आर्वेदकों के जलए सामान्य होगा और पपे र II जर्वर्य जर्वजिष्ट होगा। प्रत्येक िैक्षजणक क्षत्रे के जलए अलग-अलग प्रश्नपत्र होंगे।

(12) प्रर्वेि परीक्षा की अर्वजध नब्बे जमनट होगी।

(13) एक आर्वेदक को न्यूनतम पचास प्रजतित प्राप्त करने होंगें। सामान्य या अन्य जपछडा र्वगा या सामाजिक और आर्थाक रूप स े जपछडा र्वग ा श्रेजणयों के जलए परीक्षा उत्तीण ा करन े के जलए संचयी अंक पचास प्रजतित और अनुसूजचत िाजत, अनुसूजचत िनिाजत श्रेजणयों के जलए पैंतालीस प्रजतित ह।ै8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(14) यदद एक ही श्रेणी और एक ही जर्विेर्ज्ञता के आर्वेदक प्रर्वेि परीक्षा म ें संचयी समान अकं प्राप्त करत े ह,ैं तो पेपर I म ें प्राप्त अंकों पर मेररट के जलए जर्वचार दकया िाएगा और पपे र I म ें समान अंक प्राप्त करन े की जस्ट्थजत म,ें अंजतम र्वर्ा म ें स्नातक सैद्धांजतक परीक्षा के अंको पर मरे रट स्ट्थान के जलए जर्वचार दकया िाएगा।

(15) अनुसंधान छात्र का चयन संबंजधत जर्वभागीय अनुसंधान सजमजत द्वारा योग्यताओं, जपछल े अनुसंधान अनुभर्व के साथ- साथ प्रकािनों और प्रस्ट्तुत उद्देश्यों के जर्वर्वरण तथा साक्षात्कार म ें संतोर्िनक प्रदिना एर्व ं प्रस्ट्तुत अनुसंधान प्रस्ट्तार्व की व्यर्वहायाता पर जर्वचार करन े के बाद दकया िाएगा।

(16) स्ट्कॉलर संबंजधत जर्वभाग म ें िाजमल होंगे और पंिीकरण की प्रदक्रया पूरी करेंगे।

(17) संबद्ध या रांसजडजसजपलनरी स्ट्कॉलरों का चयन जर्वश्वजर्वद्यालय अनुदान आयोग के ददिाजनदेिों पर आधाररत होगा।

(18) केंद्र सरकार द्वारा प्रायोजित अतं रााष्ट्रीय स्ट्कॉलरों को प्रर्विे परीक्षा स ेछूट दी िाएगी: बिते उन्ह ेंसंस्ट्थान द्वारा जनधााररत दकया गया पाठ्यक्रम परू ा करना होगा।

9. गाइड का चयन- मागादिकों के जलए अनुसंधान स्ट्कॉलरों का आर्वंटन जर्वभागीय अनुसंधान सजमजत द्वारा योग्यता के आधार पर और जर्वभाग के अनसु ंधान के क्षत्रे और िोध स्ट्कॉलरों की प्राथजमकता और पयार्वेिको की स्ट्र्वीकृजत को ध्यान म ें रखते हुए दकया िाएगा।

10. स्ट्टाइपडें री और नॉन-जस्ट्टपडें री सीटों का आर्वटं न- (1) स्ट्टाइपेंडरी सीटों के मामले म,ें उपलब्ध सीटें सभी जर्वभागों के बीच समान रूप स े आर्वंरटत की िाएंगी और यदद संबंजधत जर्वभागों म ें पयााप्त स्ट्कॉलर उपलब्ध नहीं ह,ैं तो िेर् सीटें संबंजधत जर्वभाग के ददिाजनदेिों के तहत सीटों की उपलब्धता के अधीन प्रर्वेि परीक्षा की मेररट सचू ी के अनुसार अन्य जर्वभागीय स्ट्कॉलरों को आर्वंरटत की िाएगं ी।

(2) गैर-स्ट्टाइपेंडरी सीटों के मामले म,ें योग्य अभ्यथी सीटों का चयन जर्वर्य की उपलब्धता और गाइड के पास सीटों की उपलब्धता के आधार पर कर सकते ह।ैं

11. पाठ्यक्रम काय-ा (1) सभी िोध स्ट्कॉलरों को संस्ट्थान द्वारा आयोजित छह माह की अर्वजध का िोध पद्धजत और र्वैज्ञाजनक लेखन पाठ्यक्रम काय ाअजनर्वाय ा रूप स े परू ा करना होगा।

(2) पाठ्यक्रम काय ा का जसलेबस संबंजधत जर्वभाग द्वारा जनधााररत दकया िाएगा और समय-समय पर अकादजमक पररर्द द्वारा अनुमोददत दकया िाएगा;

(3) स्ट्कॉलर को अहता ा प्राप्त करने के जलए पचपन प्रजतित अंक प्राप्त करन े होंगे।

12. िोधप्रबधं का सार सक्षं पे - (1) पाठ्यक्रम काय ा को संतोर्िनक ढंग स े पूरा करने के बाद, स्ट्कॉलर गाइड या पयार्वेक्षक के अधीन अनुसंधान पररयोिना का अपना सार संक्षेप अनुमोदन के जलए जर्वभागीय अनसु ंधान सजमजत को प्रस्ट्ततु करेगा।

(2) जर्वभागीय अनुसंधान सजमजत अनुमोददत सार संक्षेप को जर्वभागाध्यक्ष के माध्यम से संस्ट्थान के डीन (अनुसंधान) को संस्ट्थागत अनुसंधान सजमजत के समक्ष प्रपोिल जडफेंस के जलए अग्रेजर्त करेगी और संस्ट्थागत अनुसंधान सजमजत पंद्रह ददनों की अर्वजध के भीतर प्रस्ट्तार्व को अनुमोदन दे सकती ह।ै

(3) प्रपोिल जडफेंस के समय, स्ट्कॉलर संस्ट्थान के सभी जिक्षकों को सार संक्षेप का मूल्यांकन करने और प्रस्ट्ताजर्वत िोध काय ा म ें सुधार के जलए सुझार्व प्राप्त करने के जलए आमंजत्रत करेगा।

(4) डीन (अनुसंधान) इन सार संक्षेप को संस्ट्थागत आचार सजमजत या संस्ट्थागत पिु आचार सजमजत को, िैसा लागू हो, अनुमोदन के जलए अग्रेजर्त करेगा।

(5) डीन (अनुसंधान) अनुमोददत सार संक्षेप को पंद्रह ददनों की अर्वजध के भीतर िीर्ाक के पंिीकरण के जलए परीक्षा जनयंत्रक को अग्रेजर्त करेगा।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 9

(6) पीएचडी िोध पररयोिना के िीर्ाक सजहत पीएचडी सार संक्षेप म ें कोई भी बदलार्व, स्ट्कॉलर के पंिीकरण के छह महीने के भीतर संबंजधत जर्वभागीय अनुसंधान सजमजत की जसफाररि के आधार पर संस्ट्थागत अनुसंधान सजमजत और संस्ट्थागत नैजतकता सजमजत या संस्ट्थागत पि ु आचार सजमजत द्वारा अनुमोददत दकया िाएगा।

13. पीएच.डी.कायका ाल- (1) डॉक्टरेट जडग्री कायाक्रम के जलए अर्वजध ज्र्वाइन होने की तारीख स े तीन र्वर्ा की होगी।

(2) जनधााररत अर्वजध म ें अनसु ंधान काय ा परू ा नहीं होने पर संबंजधत पयार्वेक्षक या गाइड की अनुिंसा पर जर्वभागीय अनुसंधान सजमजत दो र्वर्ा तक का पाठ्य-जर्वस्ट्तार द ेसकती ह।ै

(3) पांच र्वर्ा की समयार्वजध के भीतर िोध काय ा परू ा न होन े की जस्ट्थजत म ें जर्वभागीय अनुसधं ान सजमजत की अनिु ंसा पर जनदेिक द्वारा अजधकतम एक र्वर्ा का जर्वस्ट्तार ददया िा सकता ह।ै

(4) यदद आर्वश्यक या जलया गया कुल समय प्रारंजभक पंिीकरण की तारीख स े छह र्वर्ा स े अजधक ह,ै तो स्ट्कॉलर को दो र्वर् ा की आग े की अर्वजध के जलए पीएचडी के जलए पनु ःपंिीकरण कराना होगा।

(5) मजहला अनुसंधान स्ट्कॉलर और ददव्यांग व्यजि (चालीस प्रजतित स े अजधक ददव्यांगता र्वाले) को अजतररि दो र्वर् ा की अनुमजत दी िा सकती ह,ै हालांदक, ऐस े मामलों म ें पीएचडी कायाक्रम को पूरा करन े की कुल अर्वजध पीएचडी कायाक्रम म ें प्रर्वेि की तारीख स े दस र्वर् ा से अजधक नहीं होनी चाजहए।

(6) स्ट्टाइपेंडरी सीटों के जलए, पीएच.डी. की अर्वजध स्ट्टाइपडें री पीएचडी कायाक्रम म ें िाजमल होन े की तारीख स े छत्तीस महीने का होगा।

(7) एक र्वर्ा म ें दो पीएच.डी. सत्र होंगे, िो प्रत्येक र्वर्ा िनर्वरी स े िुरू होगा अथाात िनर्वरी स े िून और िलु ाई स े ददसंबर तक।

14. पिं ीकरण- (1) प्रत्येक िोध स्ट्कॉलर को संस्ट्थान द्वारा समय-समय पर अजधसूजचत फीस का भुगतान करना होगा (अनलु ग्नक-ख)।

(2) प्रत्येक िोध स्ट्कॉलर का िोध प्रबंध िमा करने के समय र्वैध पंिीकरण होना चाजहए।

(3) जनम्नजलजखत म ें स े दकसी भी घटना म,ें संस्ट्थागत अनुसंधान सजमजत के अनुमोदन के बाद, स्ट्कॉलरों का पंिीकरण रद्द कर ददया िाएगा: - (क) यदद स्ट्कॉलर पूर्वा सूचना और छुट्टी की मंिूरी के जबना एक महीने की लगातार अर्वजध के जलए अनुपजस्ट्थत रहता ह;ै (ख) यदद स्ट्कॉलर पीएचडी कायाक्रम स े हट िाता ह ै और जनकासी को संस्ट्थागत अनुसंधान सजमजत द्वारा जर्वजधर्वत स्ट्र्वीकार कर जलया िाता ह;ै (ग) यदद कोई स्ट्कॉलर इन जर्वजनयमों म ें जनजहत प्रार्वधानों के अधीन दकसी िैक्षजणक र्वर्ा के िुल्क का भुगतान करने म ेंजर्वफल रहता ह;ै (घ) यदद अनुसंधान काय ा की प्रगजत लगातार तीन सत्रों म ेंअसतं ोर्िनक पाई िाती ह;ै और (ङ) यदद स्ट्कॉलर कदाचार या अनुिासनहीनता या दोनों म ें िाजमल पाया िाता ह।ै

15. गाइड या पयर्वा क्षे क और सह-गाइड या सह-पयर्वा क्षे क- (1) पीएच.डी. गाइड या पयार्वक्षे क के रूप म ें मान्यता के जलए, संस्ट्थान के स्ट्थायी सदस्ट्य को समय-समय पर प्राजधकरण द्वारा जनधााररत की गई फीस (अनलु ग्नक-ग) के साथ जनर्दष्टा प्रोफामा ा म ें आर्वेदन करना होगा।

(2) एक जिक्षक के पास संबंजधत या संबद्ध जर्वर्य म ें पीएच.डी. जडग्री हो, कुल पांच र्वर्ा का जिक्षण या अनुसधं ान का अनुभर्व होने पर पीएचडी गाइड या पयार्वेक्षक के रूप म ेंजनयिु दकया िा सकता ह।ै10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(3) उप-जनयम (2) म ें उजल्लजखत योग्य गाइड की अनुपलब्धता के मामल े म,ें जनदेिक को अंतररम उपाय के रूप म ें जर्वर्य के दकसी भी सक्षम जिक्षक को गाइडजिप आर्वंरटत करने का अजधकार होगा।

(4) सामान्यतः, एक समय पर दकसी संबंजधत जर्वभाग में एक प्राध्यापक के अधीन आठ स े अजधक स्ट्कॉलर, एक सह- प्राध्यापक के अधीन छह स्ट्कॉलर और एक सहायक प्राध्यापक के अधीन चार स ेअजधक स्ट्कॉलर नहीं होंगे।

(5) पीएच.डी. कायाक्रम के मामले म,ें बुजनयादी जर्वज्ञान जर्वभाग के प्रमुख या जिक्षक एक समय म ें अजधकतम चार िोध स्ट्कॉलरों (पांच र्वर् ा का अनुभर्व), छह स्ट्कॉलरों (दस र्वर् ा का अनुभर्व) और आठ िोध स्ट्कॉलरों (पंद्रह र्वर् ा का अनुभर्व) का मागादिान कर सकते ह।ैं

(6) स्ट्कॉलर की प्रीपीएचडी जडफेंस की जतजथ स े उप-जनयम (4) और (5) म ें उजल्लजखत कोटा की गणना करते समय अनुसंधान गाइड या पयार्वेक्षक के अधीन सीट ररि मानी िायगे ी।

(7) एक जिक्षक को अपनी सेर्वाजनर्वृजत्त स े तीन र्वर् ा पहल े िोध स्ट्कॉलरों को पंिीकृत करन े की अनुमजत नहीं दी िाएगी और यदद संस्ट्थान द्वारा स्ट्कॉलर के िोध काय ा का मागादिना करने के जलए जनयिु गाइड या पयार्वेक्षक सेर्वाजनर्वृत्त हो िाता ह ै या नौकरी छोड देता ह ै और इस अर्वजध के दौरान, यदद स्ट्कॉलर न े पयार्वेक्षण के तहत जनयोजित अनुसंधान काय ा पहल े स े ही जनर्दष्टा अजनर्वाय ा कायाकाल म ें पूरा कर जलया ह ै तो स्ट्कॉलर को अपने मलू गाइड या पयार्वक्षे क के नाम पर िारी रखन े की अनुमजत दी िाएगी।

(8) यदद संस्ट्थान द्वारा स्ट्कॉलर के अनुसंधान काय ा का मागादिान करन े के जलए जनयिु गाइड या पयार्वेक्षक सेर्वाजनर्वृजत्त के आधार पर अन्यथा स्ट्कॉलर के दो र्वर्ा के कायाकाल के परू ा होने स े पहल े गाइड या पयार्वेक्षक नहीं रह िाता ह ै और यदद उसके बाद कोई सह-गाइड या सह-पयार्वेक्षक गाइड के जलए योग्य होता ह,ै तो र्वह स्ट्र्वचाजलत रूप स े अनुसंधान स्ट्कॉलर का गाइड हो िाएगा और यदद सह-गाइड गाइड-जिप के जलए पात्र नहीं ह,ै तो अगले गाइड या पयार्वेक्षक को कायाभार सौंपने के संबंध म ें संबंजधत स्ट्कॉलर के जर्वचारों पर उजचत जर्वचार करने के बाद जर्वभागीय अनुसंधान सजमजत द्वारा जनधााररत दकया िाएगा।

16. स्ट्टाइपडें या फैलोजिप- (1) संस्ट्थान पात्र अनुसंधान स्ट्कॉलरों को संस्ट्थान द्वारा जनधााररत मानदंडों के अनुसार स्ट्टाइपेंड या फैलोजिप प्रदान करेगा।

(2) अनुसंधान स्ट्कॉलरों को संबंजधत गाइड या पयार्वेक्षक या जर्वभागाध्यक्ष द्वारा सौंपी गई जिक्षण सहायता म ें िाजमल होन े की आर्वश्यकता होगी।

(3) सभी अनुसंधान स्ट्कॉलर जिन्ह ें संस्ट्थान द्वारा स्ट्टाइपेंड या फेलोजिप या आकजस्ट्मक अनुदान स े ददया गया ह,ै र्वे अपना पूरा समय डॉक्टरेट अनुसंधान के जलए समर्पात करेंगे और स्ट्र्वय ं को पणू ाकाजलक या अिं काजलक पिे ेर्वर प्रैजक्टस अथर्वा सार्वािजनक या जनिी संस्ट्थानों या संगठनों के साथ रोिगार म ें संलग्न नहीं करेंग े और इस उद्देश्य के जलए प्रर्वेि के समय स्ट्कॉलरों द्वारा इस संबंध म ें एक िपथ पत्र प्रस्ट्ततु दकया िाएगा।

(4) पीएच.डी. कायाक्रम म ें प्रर्विे और स्ट्टाइपडें या फेलोजिप प्रदान करन े को संबद्ध नहीं दकया िाएगा और कायाक्रम म ें प्रर्वेि स े फेलोजिप की गारंटी नहीं दी िाएगी और जिन लोगों को फेलोजिप नहीं दी गई ह ै र्व े स्ट्र्व-जर्वत्तपोर्ण स्ट्कॉलर के रूप म ें कायाक्रम िारी रख सकते ह।ैं

(5) स्ट्टाइपेंड या फेलोजिप, यदद प्रदान की िाती ह,ै तो जनयमों के अनुसार अजधकतम छत्तीस महीने के जलए ही उपलब्ध होगी।

(6) सर्वैतजनक अर्वकाि को छोडकर अर्वकाि अर्वजध के जलए फेलोजिप या स्ट्टाइपेंड नहीं दी िाएगी।

17. छुट्टी - (1) स्ट्कॉलरों को प्रत्येक र्वर्ा दस ददनों तक आकजस्ट्मक छुट्टी की अनुमजत दी िाएगी और इस छुट्टी को अर्वकाि या रजर्वर्वार के साथ िोडा िा सकता ह ै और स्ट्कॉलर छुरट्टयों तथा अर्वकाि सजहत एक समय म ें अजधकतम छह ददनों तक ऐसी छुट्टी का लाभ उठा सकते ह ैं तथा बीच के अर्वकाि को छुरट्टयां माना िाएगा एर्व ं आकजस्ट्मक छुट्टी को मेजडकल छुट्टी के साथ नहीं िोडा िाएगा तथा इस छुट्टी को आग े नहीं बढ़ाया िा सकता ह।ै[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 11

(2) स्ट्कॉलरों को एक पंिीकृत जचदकत्सा व्यर्वसायी का जचदकत्सा प्रमाण पत्र प्रस्ट्तुत करन े पर एक र्वर् ा म ें पद्रं ह ददनों के जचदकत्सा अर्वकाि की अनुमजत दी िाएगी और यह छुट्टी आग ेनहीं बढ़ाई िाएगी।

(3) िहां भी पात्रता हों, मातृत्र्व लाभ अजधजनयम, 1961 (1961 का 53) के अनुसार स्ट्कॉलरों को मातृत्र्व या बाल देखभाल अर्वकाि ददया िाएगा, हालांदक, ज्र्वाइन करने के बाद, ऐसे स्ट्कॉलरों को जनयम 13 के उप-जर्वजनयम (1) म ें उजल्लजखत अध्ययन अर्वजध परू ी करनी होगी और इसके अलार्वा, ऐसी छुट्टी अध्ययन की अर्वजध के दौरान एक बार पयााप्त दस्ट्तार्वेज़ प्रस्ट्तुत करन े पर दी िाएगी और इस छुट्टी के साथ दकसी भी प्रकार की कोई छुट्टी िोडी नहीं िाएगी।

(4) जनदेिक के पास असाधारण पररजस्ट्थजतयों म ें तीस ददन तक की छुट्टी स्ट्र्वीकृत करन े की िजि ह ै और असाधारण पररजस्ट्थजतयों म ेंस्ट्र्वीकृत ऐसी छुट्टी के जलए कोई स्ट्टाइपेंड नहीं दी िाएगी।

(5) खेल, सेजमनार म ें भाग लने े के जलए प्राजधकारी द्वारा प्रजतजनयुि या अनुमजत प्राप्त अनसु ंधान स्ट्कॉलरों को ड्यूटी या जर्विेर् छुट्टी दी िाएगी और ऐसी छुरट्टयां एक र्वर् ा म ें पद्रं ह ददनों स े अजधक नहीं होंगी।

(6) जनदेिक द्वारा जर्विेर् मामले म ेंछुट्टी को अजधकतम पंद्रह ददन तक बढ़ाया िा सकता ह।ै

(7) स्ट्कॉलरों को पंिीकृत जचदकत्सक द्वारा िारी र्वैध जचदकत्सा प्रमाण पत्र के साथ जचदकत्सा आधार के तहत दकसी भी जर्विेर् पररजस्ट्थजत म ें जबना स्ट्टाइपेंड के अजधकतम साठ ददनों तक जचदकत्सा अर्वकाि का लाभ उठाने की अनुमजत दी िाएगी।

(8) डॉक्टरेट जडग्री के जलए जनर्दष्टा न्यूनतम कायाकाल को परू ा करने के जलए अर्वजध की गणना नहीं की िाएगी।

(9) सक्षम प्राजधकारी की पूर्वा मंिूरी के जबना या उप-जर्वजनयम (1) स े (5) के अनुसार ऊपर उजल्लजखत सीमा स े अजधक स्ट्टाइपेंडरी या नॉन-स्ट्टाइपेंडरी स्ट्कॉलरों द्वारा ली गई दकसी भी अनुजचत छुट्टी या अनुपजस्ट्थजत को िानबूझकर की गई अनुपजस्ट्थजत माना िाएगा और इस अर्वजध के जलए कोई स्ट्टाइपेंड नहीं दीया िाएगा और ऐसा होने पर अनुिासनात्मक कारार्वाई भी की िा सकती ह ै जिसम ें स्ट्कॉलर को बखाास्ट्त दकया िा सकता ह ै और संस्ट्थान द्वारा भुगतान दकए गए स्ट्टाइपडें की र्वसूली िाजमल ह।ै

(10) स्ट्कॉलरों को जर्वभागीय अनुसंधान सजमजत के पूर्वा अनुमोदन स,े अनुमोददत सार संक्षेप के अनुसार, सक्षम प्राजधकारी द्वारा अनुमोददत अनुसंधान केंद्रों म ें यह िोध काय ा करने की अनुमजत दी िा सकती ह ै और संबंजधत केंद्रों स े प्रमाण पत्र प्रस्ट्तुत करन े पर उसकी छुट्टी की अर्वजध को ड्यूटी पर माना िाएगा और ऐसी अर्वजध की कुल अर्वजध पूरे पीएचडी कायाकाल के दौरान कुल नब्बे ददनों स े अजधक नहीं होगी।

(11) जर्वजिष्ट अनुसधं ान काया पर जर्वचार करके, अध्यक्ष, संस्ट्थागत अनुसंधान सजमजत या जनदेिक, जर्वभागीय अनुसंधान सजमजत की जसफाररि पर अजधक ददनों की मंिरू ी द े सकते ह ैंऔर ड्यूटी अर्वजध के दौरान यात्रा, भोिन और आर्वास के जलए कोई भत्ता नहीं ददया िाएगा।

(12) उपरोि अर्वकाि जनयम नॉन-स्ट्टाइपेंडरी सीटों पर भती दकए गए स्ट्कॉलरों पर भी लाग ूहोंगे।

(13) छुट्टी को अजधकार के रूप म ें दार्वा नहीं दकया िाएगा और प्राजधकारी जबना दकसी स्ट्पष्टीकरण के छुट्टी रद्द करन े का अजधकार सुरजक्षत रखता ह।ै

18. रेिीडेंसी - अनुसंधान स्ट्कॉलरों को पंिीकरण के बाद जनर्दष्टा अजनर्वाय ा कायाकाल के दौरान डॉक्टरेट जडग्री कायाक्रम के जलए अपना परू ा समय समर्पात करन े की आर्वश्यकता होगी और इस कायाकाल के दौरान, एक स्नातकोत्तर (आयुर्वेद) स्ट्कॉलर को जक्लजनकल रजिस्ट्रार माना िाएगा।

19. अनसु धं ान की प्रगजत- (1) प्रत्येक स्ट्कॉलर प्रत्येक छह महीने के अंत म ें गाइड या पयार्वेक्षक को जनर्दष्टा प्रपत्रों म ें समय- सारणी सजहत अनुसंधान काय ा की प्रगजत ररपोट ा प्रस्ट्ततु करेगा और गाइड या पयार्वेक्षक जर्वभागीय अनुसंधान सजमजत के जर्वचार के जलए रटपपजणयों के साथ प्रगजत ररपोट ा को आगे बढ़ाएगा तथा ररपोट ा की समीक्षा करने के बाद, जर्वभागीय अनुसंधान सजमजत, संस्ट्थागत अनुसंधान सजमजत को उजचत कारार्वाई की जसफाररि कर सकती ह।ै12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(2) यदद जर्वभागीय अनुसंधान सजमजत द्वारा समीक्षा की गई स्ट्कॉलरों की प्रगजत पर लगातार तीन असंतोर्िनक ररपोट ा (या जर्वभागीय अनुसंधान सजमजत की बैठकों स े अनुपजस्ट्थजत) प्राप्त होती ह,ैं तो संस्ट्थागत अनुसंधान सजमजत जर्वभागीय अनुसंधान सजमजत की जसफाररि पर स्ट्कॉलर के पंिीकरण को रद्द करन ेकी जसफाररि कर सकती ह।ै

20. प्री-पीएचडी जडफेंस- (1) िोध प्रबंध प्रस्ट्तुत करन े से पहल,े जनयोजित अनसु ंधान काय ा के पूरा होने पर, स्ट्कॉलर को जर्वभागीय अनुसंधान सजमजत की जसफाररिों पर, संस्ट्थागत अनुसंधान सजमजत द्वारा आयोजित प्री-पीएचडी जडफेंस में िोध प्रबंध का सारांि प्रस्ट्ततु करना होगा।

(2) स्ट्कॉलर को अपन े काम का मूल्यांकन करन े और िोध प्रबधं के काम को अंजतम रूप देन े के जलए अपने िोध काय ा म ें सुधार के जलए सुझार्व प्राप्त करने हते ु संस्ट्थान के सभी जिक्षकों और अन्य अनुसंधान कायाकताओंा को आमंजत्रत करना होगा।

21. मल्ू याकं न के जलए िोध प्रबधं प्रस्ट्ततु करना- (1) िोध प्रबंध एक मौजलक काय ा होगा िो नए त्यों की खोि का संकेत देगा या नई तकनीकों या पहले स े ज्ञात त्यों के नए अतं र-संबंधों या अर्वधारणाओं की नई व्याख्याओं को इंजगत करेगा और सामग्री की अजभव्यजि पाठ्य और ग्रादफक प्रस्ट्तुजत दोनों म ें सतं ोर्िनक होनी चाजहए।

(2) संबंजधत गाइड या पयार्वेक्षक यह सुजनजित करेगा दक िोध प्रबंध की साजहजत्यक नकल की िांच की िाए और यह संस्ट्थागत अनुसंधान सजमजत द्वारा समय-समय पर जनधााररत दकए गए मानदंडों को परू ा करता ह ै और दकसी भी मामल े म ें साजहजत्यक नकल दस प्रजतित स े अजधक नहीं होगी और इस संबंध म ें िोध प्रबंध के साथ इस आिय का प्रमाण पत्र संलग्न करना होगा।

(3) स्ट्कॉलर को प्री-पीएचडी जडफेंस की तारीख स े छह महीने की अर्वजध के भीतर िोध प्रबंध िमा करनी होगी और असाधारण पररजस्ट्थजतयों म,ें यदद कोई स्ट्कॉलर उपयुाि समय सीमा के भीतर िोध प्रबंध िमा नहीं कर पाता ह,ै तो जर्वभागीय अनुसंधान सजमजत, संस्ट्थागत अनुसंधान सजमजत को उजचत औजचत्य के साथ अजधकतम एक सत्र (छह महीन)े बढ़ाने की जसफाररि कर सकती ह ै और यदद स्ट्कॉलर उपरोि जर्वस्ट्ताररत समय अर्वजध म ें भी िोध प्रबंध िमा करन े म ें जर्वफल रहता ह,ै तो उसका पंिीकरण रद्द कर ददया िाएगा।

(4) यह र्वांछनीय ह ै दक प्रत्येक स्ट्कॉलर अपने र्वतामान िोध प्रबंध काय ा के आधार पर कम स े कम एक िोध पत्र जर्वश्वजर्वद्यालय अनुदान आयोग-िैक्षजणक अनुसंधान और नैजतकता संघ (यूिीसी-सीएआरई) म ें अनुक्रजमत, समीक्षा र्वाली पजत्रका म ें प्रकाजित करें।

(5) ऐसे प्रकाजित िोध पत्रों की प्रजतयां अंजतम िोध प्रबंध के साथ संलग्न की िाएगं ी।

(6) िोध प्रबंध, अनुमोददत होने पर, संस्ट्थान की संपजत्त बन िाएगा और स्ट्कॉलर द्वारा दकए गए िोध काय ा स े संबंजधत दकसी भी प्रकािन और बौजद्धक संपदा अजधकारों म ें लेखक के रूप म ें गाइड या पयार्वेक्षक के नाम का उल्लेख होना चाजहए और संबद्धता इस संस्ट्थान को प्रदान की िाएगी और यदद दकसी भी मामल े म ें इस े लाग ू नहीं दकया िाता ह,ै तो संस्ट्थान कानूनी कारार्वाई िुरू कर सकता ह।ै

(7) िोध स्ट्कॉलरों को िोध प्रबधं के साथ जनम्नजलजखत दस्ट्तार्विे िमा करन े होंग,े िो भी लाग ू हो, अथाात:् - (क) साजहजत्यक नकल संबंधी प्रमाणपत्र; (ख) जक्लजनकल रायल्स रजिस्ट्री-इंजडया कंपलीिन सर्टादफकेट; (ग) संस्ट्थागत आचार सजमजत और या संस्ट्थागत पि ु आचार सजमजत प्रमाणपत्र या दोनों; और (घ) आधार काडा या पासपोटा की प्रजत।

(8) इससे पहल े दक कोई स्ट्कॉलर पीएच.डी. के जलए िोध प्रबधं िमा करे, उसे गाइड या पयर्वा ेक्षक और जर्वभागाध्यक्ष से एक प्रमाण पत्र प्रस्ट्ततु करना होगा जिसम ें कहा गया हो दक-[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 13 (क) उन्होंन े पूण ा जनधााररत पीएच.डी. कायाकाल के जलए िोध काय ा पूरा कर जलया ह ै और िोध प्रबंध म ें पीएच.डी. स्ट्कॉलर के रूप म ें काम करने की अर्वजध के दौरान की गई िांच के पररणाम िाजमल ह;ैं (ख) िोध प्रबंध को स्ट्कॉलर द्वारा हस्ट्ताक्षररत घोर्णा के साथ िोडा गया ह ैदक "िोध प्रबंध मौजलक और स्ट्र्वतंत्र काय ा ह"ै ;

(ग) दक अन्य स्रोतों स ेप्राप्त सामग्री को जर्वजधर्वत मान्यता दी गई ह;ै (घ) िोध प्रबंध गाइड और सह-गाइड द्वारा प्रमाजणत ह;ै (ड.) स्ट्कोलर न ेआर्वश्यक रेसीडेंसी, पाठ्यक्रम काय ा पूरा कर जलया ह ैऔर कोई दये नहीं ह ै ऐसा प्रमाणपत्र िमा दकया ह;ै

(9) पीएचडी कायाक्रम पूरा करने पर, िोधाथी को जनम्नजलजखत दस्ट्तार्वेि उजचत माध्यम स ेडीन (िैक्षजणक) को प्रस्ट्तुत करन े होंगे, अथाात:् - (क) संस्ट्कृत, लहदं ी या अंग्रेिी म ेंमुदद्रत िोध प्रबंध की चार प्रजतयां;

(ख) जनर्दष्टा परीक्षा और अन्य िुल्क की रसीदें; और (ग) काय ा के मुख्य लबंदओंु को बताते हुए हिार िब्दों म ें दकए गए िोध काय ा का सार।

(10) डीन (िक्षै जणक) उजल्लजखत दस्ट्तार्वेिों को परीक्षा जनयंत्रक को अग्रेजर्त करेगा।

(11) स्ट्कॉलर अपना िोध प्रबधं काय ा जिस े जर्वश्वजर्वद्यालय या दकसी अन्य जर्वश्वजर्वद्यालय या संस्ट्थान म ें दकसी जडग्री या दकसी अन्य जर्वजिष्टता के जलए स्ट्र्वीकार या अस्ट्र्वीकृत कर ददया गया हो, प्रस्ट्तुत नहीं करेगा लेदकन स्ट्कॉलर अपन े िोध प्रबंध म ें दकसी भी काय ा की सामग्री को िाजमल कर सकता ह ै िो उसने इस जर्वर्य पर पहले दकया हो। बित े दक ऐसे मामलों म ें स्ट्कॉलर अपने आर्वेदन म ेंऔर अपने िोध प्रबंध के पररचय म ेंउसके द्वारा पहले दकए गए काय ाका उल्लेख करेगा।

(12) मुदद्रत िोध प्रबंध जनम्नजलजखत जर्वजिष्टताओं के अनुसार प्रस्ट्तुत दकया िाएगा, अथाात्: - (क) मुद्रण के जलए उपयोग दकया िाने र्वाला कागि ए4 आकार का होगा; (ख) मुद्रण कागि के दोनों तरफ और 1.5 अंतर पर मानकीकृत दकया िाएगा;

(ग) दोनों तरफ 1.25 इंच का मार्िान होगा; (घ) अग्रं ेिी के जलए टाइम्स न्य ू रोमन फॉन्ट का आकार बारह और देर्वनागरी जस्ट्क्रपट के जलए आकार चौदह के दकसी भी यूजनकोड फॉन्ट का उपयोग करना होगा; (ङ) िोध प्रबंध के कर्वर पेि पर; िोध प्रबधं का िीर्ाक, संस्ट्थान का नाम, जडग्री, इसकी जर्विेर्ज्ञता और जर्वभाग, स्ट्कॉलर का पूरा नाम, गाइड और सह-गाइड (यदद कोई हो) का नाम, िमा करन े का महीना तथा र्वर् ा और पंिीकरण संख्या प्रदर्िात करनी होगी।

(13) स्ट्कॉलर को िरूु म ें परीक्षकों के मल्ू यांकन के जलए िोध प्रबंध की चार अस्ट्थायी जिल्द र्वाली प्रजतया ं िमा करनी होंगी और एक बार िोध प्रबंध को सभी परीक्षकों द्वारा अनुमोददत कर ददया िाता ह,ै तो स्ट्कॉलर को अनुमोदन के बारे म ें सूजचत दकया िाएगा तथा परीक्षक, जर्वभागीय अनुसंधान सजमजत और अनुसंधान जडग्री सजमजत द्वारा उसे ददए गए सुझार्वों (यदद कोई हो तो) को िाजमल करन े के जलए (पीएचडी ओपन जडफेंस और र्वाइर्वा र्वॉयस के समय) कहा िाएगा। अंजतम िोध प्रबंध म ें दो हाड ा बाउंड प्रजतयां और सॉफ्ट कॉपी प्रारूप संस्ट्थान को िमा करना होगा एर्व ं साथ ही अध्यक्ष, जर्वभागीय अनुसंधान सजमजत द्वारा अग्रेजर्त गाइड या पयार्वेक्षक द्वारा प्रजतहस्ट्ताक्षररत घोर्णा के साथ भेि ें दक परीक्षकों के सुझार्वों को िोध प्रबंध म ें जर्वजधर्वत िाजमल दकया गया ह।ै14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

22. परीक्षा- (1) संबंजधत या संबध्द जर्वर्यों म ें पीएच.डी. जडग्री र्वाला जिक्षक या अनसु ंधानकता ा जिसे पांच र्वर् ा का स्नातकोत्तर जिक्षण अनुभर्व या दस र्वर्ा का स्नातकोत्तर और स्नातक संयुि जिक्षण अनुभर्व अथर्वा संबंजधत जर्वर्य या क्षत्रे या दायरे म ें दस र्वर्ा का िोध अनभु र्व होने पर पीएचडी परीक्षा, िोध प्रबंध और मौजखक परीक्षा के जलए परीक्षक के रूप म ें जनयुि दकया िा सकता ह।ै

(2) िोध प्रबंध के जनणाय के जलए संस्ट्थान द्वारा चार जनणाायक जनयुि दकए िाएगं े और िोध प्रबंध िमा करन े के समय, संबंजधत जर्वभागीय अनुसधं ान सजमजत आम तौर पर छह परीक्षकों के एक पैनल की जसफाररि करेगी जिसम ें प्रत्येक परीक्षक का संजक्षप्त बायोडाटा, उनके अनुसंधान के क्षत्रे और जर्विेर्ज्ञता सजहत परीक्षा जनयंत्रक को प्रस्ट्ततु करेगी और जर्वभागीय अनुसंधान सजमजत द्वारा प्रस्ट्तुत पैनल स े जनदेिक तीन परीक्षकों की जनयुजि करेगा और अनुसंधान स्ट्कॉलर के गाइड या पयार्वेक्षक आंतररक परीक्षक होंग।े

(3) आमतौर पर संस्ट्थान द्वारा पेि की गई जनयुजि, परीक्षकों को दस ददनों के भीतर स्ट्र्वीकार करनी होगी।

(4) परीक्षकों को िोध प्रबंध की प्राजप्त के एक महीन े की अर्वजध के भीतर अपनी व्यजिगत ररपोट ा िमा करनी होगी और जर्विेर् मामलों म ें परीक्षकों के अनुरोध पर ररपोट ा िमा करने का समय संस्ट्थान द्वारा अजधकतम एक महीन े तक बढ़ाया िा सकता ह ैऔर यदद संबंजधत परीक्षक जर्वस्ट्ताररत अर्वजध म ें ररपोटा िमा करने म ें जर्वफल रहता ह,ै तो िोध प्रबंध का मल्ू यांकन करने के जलए पैनल स ेएक अन्य परीक्षक को जनयुि दकया िाएगा।

(5) ररपोट ा प्रस्ट्तुत करते समय, परीक्षक यह बताएगा दक क्या िोध प्रबंध जडग्री प्रदान करन े के जलए जनम्नजलजखत ितों का अनुपालन करता ह,ै अथाात:् -

(i) यह अनुसंधान काय ा का एक खंड होगा, िो या तो नए त्यों की खोि या त्यों और जसद्धांतों की व्याख्या के प्रजत नए दजृ ष्टकोण की जर्विेर्ता होगी;

(ii) यह आलोचनात्मक परीक्षण और जनणाय के जलए स्ट्कॉलर की क्षमता का सबूत दगे ा; और

(iii) िहां तक इसकी साजहजत्यक प्रस्ट्तुजत का संबंध ह,ै यह भी सतं ोर्िनक होगा।

(6) परीक्षकों द्वारा िोध प्रबंध का मल्ू यांकन करन े के बाद, र्वे जसफाररि कर सकत े ह ैं दक िोध प्रबंध को पीएचडी जडग्री अर्वाडा के जलए स्ट्र्वीकार दकया िाए या जडग्री या िोध प्रबंध को संिोजधत रूप म ें प्रस्ट्तुत दकया िाए अथर्वा िोध प्रबंध को खाररि कर ददया िाए।

(7) परीक्षक अपनी जर्वस्ट्तृत मूल्यांकन रटपपजणयाँ देंगे और परीक्षक की अंजतम अनुिंसा उसकी मूल्यांकन रटपपजणयों के ति ा पर और अनुरूप होगी।

(8) िोध स्ट्कॉलर की पीएच.डी. ओपन जडफेंस परीक्षा की अनुिंसा करत े समय, परीक्षक प्रश्नों की प्रकृजत और पीएच.डी. ओपन जडफेंस म ेंस्ट्पष्ट दकए िान े र्वाले मद्दु ों का संकेत दे सकता ह।ै

(9) ररपोट ा जर्वजिष्ट होगी और उस आधार को बताएगी जिस पर जसफाररि आधाररत ह ै और यदद दो परीक्षक पीएच.डी. जडग्री अर्वाडा करने की जसफाररि करते ह ैं और अन्य दो परीक्षक असहमत ह,ैं तो जसफाररिों और िोध प्रबंध के साथ परीक्षकों की ररपोट ा को उन परीक्षकों के नाम का उल्लेख दकए जबना पांचर्वें परीक्षक को भिे ा िाएगा िो ऊपर जनर्दष्टा तरीकों स े जसफाररि कर सकते ह;ैं और उनकी जसफाररिों को अंजतम रूप ददया िाएगा अथाात यदद र्वह िोध प्रबंध को अस्ट्र्वीकार करता ह ैतो िोध प्रबंध को रद्द कर ददया िाएगा।

(11) यदद िोध प्रबंध सभी परीक्षकों द्वारा अनुमोददत ह ै और पीएच.डी ओपन जडफेंस आयोजित दकया िाता ह ै तो ऐसी पररजस्ट्थजतयों म,ें ररपोट ा पीएच.डी. जडफेंस स ेकम स े कम पंद्रह ददन पहल े परीक्षकों के नाम का उल्लेख दकए जबना अनुसंधान स्ट्कॉलर, िोध गाइड और जर्वभागीय अनुसंधान सजमजत के अध्यक्ष को उपलब्ध कराई िाएगी।

23. पीएच.डी. ओपन जडफेंस और मौजखक परीक्षा:- (1) परीक्षा जनयंत्रक स े डीन (िैक्षजणक) कायाालय के माध्यम स े ररपोट ा प्राप्त करने के बाद, जर्वभागीय अनुसंधान सजमजत ररपोट ा पर चचा ा करेगी और परीक्षकों के सुझार्वों के बारे म ें स्ट्कॉलर को सूजचत करेगी।

(2) स्ट्कॉलर परीक्षकों द्वारा सझु ाए गए पुनरीक्षण या संिोधन के बारे म ें ररपोट ा प्रस्ट्तुत करेगा और ऐसे सभी प्रश्नों का उत्तर प्रस्ट्तुत करेगा िो परीक्षकों द्वारा उनकी ररपोट ा म ेंउठाए गए ह।ैं

(3) जर्वभागीय अनुसंधान सजमजत प्रस्ट्ततु मामले का मल्ू यांकन करेगी और संतोर्िनक पाए िाने पर मौजखक परीक्षा की अनुिंसा करेगी।

(4) सभी परीक्षकों द्वारा िोध प्रबंध के अनुमोदन पर, जर्वभागीय अनुसंधान सजमजत पीएच.डी. जडफेंस और मौजखक परीक्षा के जलए अनुिंसा करेगी और अनुसंधान जडग्री सजमजत द्वारा सचं ाजलत पीएच.डी. ओपन जडफेंस और मौजखक परीक्षा संस्ट्थान म ें आयोजित की िाएगी।

(5) पीएच.डी. ओपन जडफेंस और मौजखक परीक्षा के जलए तारीख, समय और स्ट्थान को परीक्षा जनयंत्रक द्वारा आंतररक परीक्षक के परामि ास े कम स े कम पंद्रह ददन पहल े सूजचत दकया िाएगा।

(6) यदद कोई भी बाहरी परीक्षक पीएच.डी. ओपन जडफेंस और मौजखक परीक्षा के समय उपजस्ट्थत नहीं हो पाता ह,ै तो जर्वभागीय अनुसंधान सजमजत की अनुिंसा पर जनदेिक पीएचडी के जलए परीक्षक के रूप म ें काय ा करने हते ु उस जर्वर्य में एक र्वररि अनुसंधान गाइड जनयिु करेगा और यदद आतं ररक परीक्षक उपलब्ध नहीं ह,ै तो जनदेिक संबंजधत जर्वर्य म ें र्वररि अनुसंधान गाइड म ेंस े एक को आंतररक परीक्षक के रूप म ेंजनयुि करेगा।

(7) समग्र पररणाम आजधकाररक तौर पर पीएचडी ओपन जडफेंस और मौजखक परीक्षा की तारीख स े सात काय ा ददर्वसों की अर्वजध के भीतर परीक्षा जनयंत्रक द्वारा घोजर्त दकया िाएगा और घोर्णा के बाद संस्ट्थान की परीक्षा िाखा द्वारा पररणाम का अनंजतम जडग्री प्रमाण पत्र िारी दकया िायेगा।

(8) यदद पीएच.डी. ओपन जडफेंस और मौजखक परीक्षा सतं ोर्िनक नहीं ह ै तो अनुसंधान जडग्री सजमजत नए जसरे स े पीएचडी ओपन जडफेंस और मौजखक परीक्षा की जसफाररि कर सकती ह।ै इस े छह महीने के बाद आयोजित दकया िाएगा और ऐस े नए पीएच.डी. ओपन जडफेंस और मौजखक परीक्षा के जलए, सक्षम प्राजधकारी द्वारा जनधााररत दकया गया नया िल्ु क जलया िाएगा और स्ट्कॉलरों को पीएचडी ओपन जडफेंस और और मौजखक परीक्षा म ें पुन: िाजमल होन े के जलए अजधकतम एक ही मौका ददया िाएगा।

24. पीएच.डी. ओपन जडफेंस और मौजखक परीक्षा का सचं ालन- (1) यदद जर्वजनयमन 22 के उप-जर्वजनयम (11) के अनुसार सभी परीक्षकों की जसफाररि ह,ै तो अनुसंधान जडग्री सजमजत द्वारा पीएचडी ओपन जडफेंस और मौजखक परीक्षा आयोजित की िाएगी।

(2) यदद कोई परीक्षक अनुिंसा करता ह,ै तो रटपपजणयों को िाजमल करने के बाद िोध प्रबंध की, उसी परीक्षक द्वारा िांच की िाएगी और इस परीक्षक द्वारा अंजतम अनुिंसा के बाद, पीएच.डी. ओपन जडफेंस और मौजखक मौजखक परीक्षा आयोजित की िा सकती ह।ै

(3) परीक्षकों के बीच मतभेद की जस्ट्थजत म ेंबहुमत के जर्वचार मान्य होंगे।

(4) यदद परीक्षक िोध प्रबंध म ें बडे संिोधन की जसफाररि करता ह,ै तो अनुसंधान स्ट्कॉलर को परीक्षक की जसफाररिों के अनुसार संिोजधत िोध प्रबंध प्रस्ट्तुत करने के जलए संस्ट्थान के जनणाय स े छह महीन े का समय ददया िाएगा और संिोजधत िोध प्रबंध का परीक्षक द्वारा पनु मूाल्यांकन दकया िाएगा और यदद परीक्षक िोध प्रबंध का मल्ू यांकन करन े म ें असमथ ा ह ै तो जनदेिक जर्वभागीय अनुसंधान सजमजत के परामि ास े मौिूदा परीक्षक पैनल म ें स े एक अन्य परीक्षक की जनयुजि करेगा।16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(5) यदद दो या दो स े अजधक परीक्षक िोध प्रबधं के प्रमुख सिं ोधन और पनु लेखन की जसफाररि करत े ह,ैं तो संस्ट्थान के जनणाय स े एक कैलेंडर र्वर् ा की अर्वजध के भीतर िोध प्रबंध को संिोजधत, पुनर्लाजखत स्ट्र्वरूप म ें पुनः प्रस्ट्तुत दकया िाने के संबंध म ें स्ट्कॉलर को सूजचत दकया िाएगा और ऐसे मामले म ें पुन: प्रस्ट्तुत करन े के जलए अर्वजध िल्ु क और परीक्षा िल्ु क का भुगतान स्ट्कॉलर द्वारा दकया िाएगा और यदद एक र्वर् ा से अजधक समय की आर्वश्यकता ह,ै लेदकन प्रारंजभक पंिीकरण स े पूरा होने तक कुल समय छह र्वर्ा स े कम ह,ै तो स्ट्कॉलर के जलए उस अर्वजध को बढ़ा ददया िाएगा।

(6) यदद कुल आर्वश्यक समय या जलया गया कुल समय प्रारंजभक पंिीकरण की तारीख स े छह र्वर्ा स े अजधक ह,ै तो स्ट्कॉलरों को दो र्वर्ा की आग े की अर्वजध के जलए पीएचडी के जलए पुन: पंिीकरण कराना होगा।

(7) संस्ट्थान के बाहर स ेकम से कम एक परीक्षक पीएचडी ओपन जडफेंस और मौजखक परीक्षा म ें उपजस्ट्थत रहगे ा।

(8) अपनी ररपोट ा म ें परीक्षकों द्वारा उठाए गए लबंदओंु का सतं ोर्िनक स्ट्पष्टीकरण प्राप्त करने के अलार्वा, अनुसंधान जडग्री सजमजत स्ट्र्वय ं को संतुष्ट करेगी दक उसके अध्ययन के व्यापक क्षत्रे म ें स्ट्कॉलर का ज्ञान संतोर्िनक ह।ै

(9) अनुसंधान जडग्री सजमजत के प्रजतर्वेदन पर जर्वचार करत े हुए, अध्यक्ष अंततः यह जनणाय लगें े दक, - (क) डॉक्टर ऑफ दफलॉसफी (पीएचडी) की जडग्री प्रदान की िाए; या (ख) स्ट्कॉलर की आगामी जतजथयों म ें पुनपारीक्षा की िानी आर्वश्यक ह;ै या (ग) डॉक्टर ऑफ दफलॉसफी (पीएचडी) की जडग्री प्रदान नहीं की िा सकती ह।ै

25. जडग्री प्रदान करना- (1) जडग्री के अनुमोदन के जलए अनसु ंधान जडग्री सजमजत की अनुिसं ा को संस्ट्थान के इंस्ट्टीट्यूट जनकाय के समक्ष रखा िाएगा।

(2) स्ट्कॉलर जिसन े डॉक्टरेट जडग्री कायाक्रम पूरा कर जलया ह ै और पीएचडी ओपन जडफेंस और मौजखक परीक्षा म ें सफल घोजर्त दकए गए ह,ैं को जनम्नानसु ार जडग्री प्रदान की िाएगी- (क) डॉक्टर ऑफ दफलॉसफी-पीएचडी (आयुर्वेद) (आयुर्र्वाद्यार्वाररजध);

(ख) डॉक्टर ऑफ दफलॉसफी-पीएचडी (आयुर्वेद फामेसी); (ग) डॉक्टर ऑफ दफलॉसफी-पीएचडी (मेजडजसनल पलांटस); (घ) डॉक्टर ऑफ दफलॉसफी-पीएचडी (संबजद्धत अन्य जर्वज्ञान); (ङ) डॉक्टर ऑफ दफलॉसफी-पीएचडी (रांसजडजसजपलनरी) जडग्री, आर्वश्यक िुल्क के भुगतान पर, संस्ट्थान के आगामी दीक्षांत समारोह म ें या तो व्यजिगत रूप स े या अनुपजस्ट्थजत म ें उसके द्वारा प्रदत्त जर्वकल्प को दी िाएगी।

26. िल्ु क- संस्ट्थान के िासी जनकाय द्वारा समय-समय पर जनधााररत की गई फीस अनुसंधान स्ट्कॉलरों स े ली िाएगी िो उन पर लाग ू हो सकती ह।ै

27. स्ट्टाइपडें री सीटों के जलए बाडं - (1) प्रत्येक चयजनत अनुसंधान स्ट्कॉलर को अनलु ग्नक-घ के अनुसार जनर्दष्टा प्रपत्र म ें डॉक्टरेट जडग्री कायाक्रम म ेंिाजमल होन े स े पहले संस्ट्थान के साथ बांड जनष्पाददत करना होगा।

(2) यदद स्ट्कॉलर डॉक्टरेट जडग्री कायाक्रम को बीच म ें छोड देता ह,ै तो स्ट्कॉलर को संस्ट्थान स े मुि होने के जलए मआु र्विे के रूप म ें सस्ट्ं थान को अजग्रम भगु तान दकए गए स्ट्टाइपेंड के साथ-साथ अजग्रम रूप स े प्राप्त अनुसधं ान बिट के साथ तीन लाख रुपय े का भगु तान करना होगा।

28. सयं िु या दोहरी डॉक्टरेट जडग्री कायक्रा म- (1) संस्ट्थान प्रजतजित राष्ट्रीय और अंतरााष्ट्रीय जर्वश्वजर्वद्यालयों या संगठनों या संस्ट्थानों के सहयोग स े संयुि र्वार्र्ाक डॉक्टरेट जडग्री कायाक्रम चलाएगा।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 17

(2) स्ट्कॉलरों को दोनों सहयोगी संस्ट्थानों म ेंअलग-अलग पंिीकरण कराना होगा।

(3) स्ट्कॉलर को अपन े पीएचडी जर्वजनयमन के अनुसार संबंजधत संस्ट्थान द्वारा जनर्दष्टा न्यूनतम कायाकाल जबताना होगा।

(4) स्ट्कॉलरों को संबंजधत संस्ट्थान के अपन े कायाकाल के दौरान संबंजधत संस्ट्थान के पीएचडी जर्वजनयमन का पालन करना होगा।

(5) संयुि या दोहरी डॉक्टरेट जडग्री कायाक्रम के जलए जर्वस्ट्ततृ मोड्याजलटी, समझौता ज्ञापन के समय सहयोगी सस्ट्ं थानों द्वारा पारस्ट्पररक रूप स ेतैयार दकए िाएंगे।

29. जर्वजर्वध- (1) पूणाकाजलक डॉक्टरेट जडग्री कायाक्रम म ें भाग लेन े र्वाल े िोधार्थायों को कोई भी र्वैतजनक या अर्वतै जनक जनयुजि या सेर्वा या स्ट्र्वयं-रोज़गार पर काम करने की अनुमजत नहीं दी िाएगी और दकसी भी नई नौकरी या जनयुजि के जलए आर्वेदन िमा करत े समय स्ट्कॉलर को संस्ट्थान स े 'अनापजत्त प्रमाण पत्र' प्राप्त करन े के जलए जनदेजित दकया िाएगा और चूककता ा अनिु ासनात्मक कारार्वाई िैसे दक स्ट्टाइपडें , लाभ ल े चुके िोध बिट की र्वसूली और प्रर्वेि समाजप्त के जलए उत्तरदायी होंगे।

(2) यदद स्ट्कॉलर को डॉक्टरेट जडग्री कायाक्रम के कायाकाल के दौरान दकसी सरकारी जनकाय म ें स्ट्थायी जनयुजि के जलए चुना िाता ह,ै तो स्ट्कॉलर सेर्वाओं म ें िाजमल हो सकता ह ै और संस्ट्थान म ें पंिीकरण की तारीख स े छह र्वर् ा की अर्वजध के भीतर जनयोिा स े उजचत अनुमजत प्राप्त करन े के बाद डॉक्टरेट जडग्री कायाक्रम पूरा कर सकता ह।ै

NOTIFICATION New Delhi, the 27th February, 2024 F. No. L-12015/25/2021-AS (I).—In exercise of the powers conferred by clause (k), sub-section (1) of

section 28 and clause (f) of section 13 of the Institute of Teaching and Research in Ayurveda Act, 2020 (16 of 2020), the Institute of Teaching and Research in Ayurveda, with the previous approval of the Central Government, hereby makes the following regulations, namely:-

1. Short title and commencement.- (1) These regulations may be called the Institute of Teaching and Research in Ayurveda, Doctor of Philosophy Regulations 2024.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.- (1) In these regulations, unless the context otherwise requires,-

(a) “Act” means the Institute of Teaching and Research in Ayurveda Act, 2020 (16 of 2020);

(b) “allied subjects” means the subjects related to health science in general and Ayurveda in particular shall be considered as allied subject;

(c) "applicant" means an individual who applies for admission to the Doctoral degree programme of the Institute in a prescribed application form;

(d) “Co-Guide” or "Co-Supervisor" means an additional Guide or Supervisor, wherever needed, as approved by the Departmental Research Committee to guide or supervise the research work of the scholar and the Co-guide or Co- Supervisor may or may not be a fulltime faculty of the Institute;

(e) "Controller of Examinations" means Controller of Examinations appointed by the competent authority of the Institute;

(f) “Co-Principal Investigator” means an additional investigator, wherever needed, as approved by the Institutional Research Committee to help the Principal Investigator for research project and he may or may not be a fulltime faculty of the Institute;

(g) "course work" means courses of study specified by the Department through the Departmental Research Committee to be undertaken by a scholar registered for the Doctoral degree programme;24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(h) "Doctoral Degree" means the Degree awarded by the Institute in accordance with the provisions of these regulations in the following disciplines, namely:-

(i) Doctor of Philosophy- Ph.D. (Ayurveda) (Ayurvidyavaridhi); or

(ii) Doctor of Philosophy- Ph.D. (Ayurveda Pharmacy); or

(iii) Doctor of Philosophy- Ph.D. (Medicinal Plants); or

(iv) Doctor of Philosophy- Ph.D. (Allied Science) ; or

(v) Doctor of Philosophy- Ph.D. (Trans disciplinary).

(i) “Guide” or "Supervisor" means a full time regular faculty of the Institute who has been approved by the Academic Council to guide or supervise the Doctoral degree research work of the research scholar;

(j) “Institutional Ethics Committee” means as per constitution given by Indian Council of Medical Research for a period of three years, comprising Chairperson (from outside Institute), Member Secretary (Ayurvedic Physician), Philosopher/Ethicist, Medical expert, Basic Medical Scientist

(Pharmacologist), Clinician from outside of the Institute, Medical expert-Ayurvedic Science, Lay persons from the community- Female & Male, Social Scientist and Legal Advisor;

(k) “Institutional Animal Ethics Committee” means committee for control and supervision of experiments on animals for a period of five years, comprising Biological Scientist, Scientist in-charge of Animal House facility, Two scientists from different biological discipline, A Veterinarian, Main Nominee, Link Nominee, Scientist from outside institute and social aware nominee;

(l) “Institute Body” means the anteceding institutions conglomerated and established as a body corporate under the Act.

(m) “Joint or dual doctoral degree programme” means a cotutelle programme of research and training carried out by a scholar who is concurrently enrolled in and jointly supervised by supervisors at two different Institutes simultaneously in any discipline or interdisciplinary areas, and on successful completion of degree requirements of both Institutes, two separate degree certificate (testamurs) shall be issued by the Institutes.

(n) “Ph.D. Open defense” means the presentation of research findings before the Research Degree Committee by the research scholar after evaluation of the thesis and recommendation of the examiners and Departmental Research Committee;

(o) “Ph.D. proposal defense” means draft synopsis presentation before the Institutional Research Committee by the research scholar;

(p) “Pre-Ph.D. defense” means presentation of research findings before the Institutional Research Committee after completion of research work by the research scholar within the specified tenure;

(q) “Principal Investigator” means person nominated by the Institute for research project to communicate with Institutional Research Committee in relation to project related matters and generation of intellectual property during execution of project.

(r) "registration period" means the period from the date of registration to the Ph.D. Open defense of the research work;

(s) "Research Scholar" means a person registered for research for the Doctoral degree programme of the Institute in compliance with the provisions of these regulations;

(t) "residency period" means the period for which a research scholar shall attend the Institute on a full-time basis;

(u) “Statement of Purpose” means the document which shall be submitted to the concerned Departmental Research Committee by the qualified applicant;

(v) “Teacher” means a person appointed as Lecturer or Assistant Professor, Reader or Associate Professor, Professor and a person appointed in concerned basic science department as Pharmacologist, Pharmaceutical Chemist, Pharmacognosist, Biochemist, Microbiologist, Pathologist and Radiologist in the Institute on a regular basis;

(w) “Trans disciplinary subjects” means the subjects other than health sciences, and

(x) "valid registration” means that the scholar who has been registered for the Doctoral programme after paying full dues.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 25

(2) Words and expressions used herein and not defined but defined in the Act shall have the same meaning as assigned to them in the said Act.

3. Research Committees.- All matters connected with the Doctoral degree programme of the Institute shall be dealt in accordance with these regulations by the Research Committees subject to the general supervision of the Governing body of the Institute.

4. Institutional Research Committee.- (1) There shall be an Institutional Research Committee consisting of the following members, namely:- Institutional Research Committee of the Institute.

1. Director Chairperson;

2. Deputy Director (Post Graduate) Member;

3. Deputy Director (Pharmacy) Member;

4. Dean (Academic) Member;

5. Member Secretary, Institutional Ethics Committee Member;

6. Member Secretary, Institutional Animal Ethics Committee Member;

7. Biostatistician Member;

8. Head Biochemistry or Pathology or Microbiology to be nominated Member; by Chairperson preferably on a rotation basis which can be finalised by the Chairperson

9. Head Pharmacology or Pharmaceutical Chemistry or Pharmacognosy, to be Member; nominated by Chairperson preferably on a rotation basis which can be finalised by the Chairperson

10. Three head(s) of the post graduate teaching departments to be Members; nominated by the Chairperson preferably on a rotation basis which can be finalised by the Chairperson

11. Head, Account section of the institute Member;

12. Three invitee External experts to be nominated by Chairperson Member(s); and

13.

15. Dean (Research) Member Secretary.

(2) The Institutional Research Committee shall be constituted by the Director on the recommendations of the Dean (Research) for a period of three years.

(3) While making the recommendations, the Institutional Research Committee shall ensure that the recommendations are made in conformity with these regulations and it shall have the following powers and functions, namely:-

(a) to review and monitor the research activities of the Institute;

(b) to review and approve the research proposals and other research project related matters;

(c) to examine the recommendations of the Departmental Research Committee and make appropriate decisions;

(d) to scrutinise the applications of the sponsoring agencies for determining the nature, purpose, quality and feasibility of the proposed sponsored research work or project and to approve and make necessary recommendations, if any;

(e) to appoint the Principal Investigator for the proposed sponsored research work or project;

(f) to change the Principal Investigator of research projects under special circumstances by giving preference to the Co‐ Principal Investigator, if any;

(g) to review and recommend the Memorandum of Understanding with the any reputed organisation or agencies.

(4) Institutional Research Committee shall meet quarterly or at least twice in year, however, the Chairperson of the Institutional Research Committee shall call the meeting at any time to address the research related activities.

(5) After each Institutional Research Committee meeting, Member-Secretary shall prepare the minutes of the meeting and after circulation among members shall be signed by Member-Secretary with the approval of Chairperson and copy of the minutes shall be communicated to the Director and Controller of Examinations and other concerned.

(6) Minimum fifty per cent. members are required to fulfill the quorum of the meeting.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

5. Departmental Research Committee.- (1) A Departmental Research Committee shall be constituted for each teaching department of the Institute by the Director on the recommendations of the concerned Head of the Department for a period of three years and each Departmental Research Committee shall consist of minimum five members.

(2) Minimum fifty per cent are required to fulfill the quorum and a regular teacher with Ph.D. degree shall be members of the Departmental Research Committee.

(3) The Departmental Research Committee shall consist of the following members, namely:- Departmental Research Committee of the Institute.

1. Head of the Department Chairperson;

2. All Professors in the Department Members;

3. One Associate Professor from the teaching staff of the Member;

Department by rotation, according to seniority

4. One teacher from the other department to be nominated by Chairperson of Member;

Departmental Research Committee

5. One Head of the basic science department nominated by Chairperson Member;

6. One Assistant Professor from the teaching staff of the Department by Member Secretary; rotation, according to seniority. and

7. One external expert to be nominated by the Chairperson in the concerned Member. subject.

(4) Dean (Academic), Dean (Research) and Deputy Director (Post Graduate) shall be the member at the time of Pre-Ph.D. and Ph.D. Open defense and viva voce.

(5) The Dean (Research) is empowered to attend any Departmental Research Committee meeting and shall be considered as member of the particular meeting.

(6) The Chairperson shall be in the rank of Professor and in case Head of the Department is not in the rank of Professor, the Director may appoint Associate Professor of same department or suitable person as Chairperson.

(7) The Chairperson shall have power to co-opt such members of the staff of the Institute as may be helpful to them in their deliberation as temporary member.

(8) The concerned Guide or Supervisors and Co-guide or Co-supervisors shall be invited to participate in the Departmental Research Committee meeting only during the presentations of Ph.D. Scholars under their supervision.

(9) For each department of Pharmacy programme, a common Departmental Research Committee shall be constituted as per the Institute of Teaching and Research, Post Graduate- Pharmacy Regulation 2023.

(10) The Departmental Research Committee shall meet at least once in six months.

(11) While making the recommendations, the Departmental Research Committee shall ensure that the recommendations are made in conformity with these regulations and it shall have the following powers and functions, namely:-.

(a) to scrutinise the statement of purpose of qualified applicants for determining the eligibility or otherwise for the registration and make necessary recommendations;

(b) to approve the field of research in which the applicants shall be recommended to carry on research and shall assign Guide or Supervisor and Co-guide(s) or Co-supervisor(s) or to guide the research work;

(c) to recommend the change of the Guide or Supervisor with justification, if necessary;

(d) to grant extension of term as per Ph.D. regulation; and

(e) to evaluate the progress reports of the research works and to discuss all other issues related to research work.

(12) After each Departmental Research Committee meeting, Member-Secretary of the Departmental Research Committee should prepare the minutes of the meeting and after circulation among members shall be signed by Member-Secretary with the approval of Chairperson of the committee.

(13) A copy of the minutes shall be communicated to the Controller of Examinations.

(14) In case of any dispute in Departmental Research Committee, the matter shall be referred to the Institutional[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 27 Research Committee, whose decision shall be final and abiding.

6. The Research Degree Committee .- (1) The Research Degree Committee constituted by the Director consist of the following members, namely:- The Research Degree Committee.

1. Director Chairperson;

2. Dean (Research) Members;

3. Dean (Academic) Member;

4. All the members of concerned Departmental Research Members;

Committee

5. Guide or Supervisor of the concerned Ph.D. Scholar Member;

6. External Examiner for that particular scholar Member; and

7. The Controller of Examination (CoE) Member Secretary.

(2) While making the recommendations, the Research Degree Committee shall ensure that the recommendations are made in conformity with these regulations and it shall have the following powers and functions,

namely:-

(a) to conduct Ph.D. Open defense and viva voce of the Ph.D. scholar; and

(b) to recommend for award of the Ph.D. Degree to the successful scholar.

7. Classifications of applicants.- The applicants for admission to the Doctoral degree programme shall be classified under any one of the following categories, namely:-

(a) financed by the Ministry of Ayush;

(b) financed by other Government Organisations like Central Council for Research in Ayurvedic Sciences, Council of Scientific and Industrial Research, University Grants Commission, Indian Council of Medical Research, All India Council for Technical Education, under any research scheme;

(c) financed by the Central Government under a Cultural Exchange Scholarship Programme, self- financing foreign student or a scholar admitted under a Memorandum of Understanding;

(d) financed by the Academic bodies, Educational institutions, professional bodies, Non-Governmental Organisations;

(e) self-financed;

(f) Research Associate or Senior Research Fellow or Junior Research Fellow;

(g) in campus teachers or staff (regular or contractual);

(h) registered for dual doctoral degree programme.

8. Admission.- (1) The admission to the Doctoral degree programme shall be in all the subjects in concerned department where Post Graduation programmes are being offered by the Institute.

(2) For Allied or trans disciplinary research, the admission shall be made on the availability of subject specific guide selected by the scholar.

(3) The applicants for admission to the Ph.D. programme shall possess any of the following qualifications,

namely:-

(a) Post Graduate degree in Ayurveda from a recognised University or Institute established by law; or

(b) Post Graduate degree in Ayurveda Pharmacy [M.Pharm (Ayurveda)] or Medicinal Plants [M.Sc. (Medicinal Plants)] or concerned field as per specialty from a recognised University or Institute established by law; or

(c) Post Graduate degree in Allied or Trans disciplinary subject from any recognised University or Institute established by law.

(4) The eligibility qualifications for Foreign Nationals are the same as specified in these regulations for Indian Nationals and further, they are required to submit their applications through Indian Council for Cultural Relations.

(5) Admission in Ph.D. programme shall be held once in a year and the process of admission shall be started from the month of August-September each year and the entrance test shall be conducted generally in the28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] month of October-November every year.

(6) All the important dates for the procedure of admission like date of advertisement, issue of application form, entrance test, date of result of test, date of submission of Statement of Purposes etc. shall be decided in advance by the authority and shall be mentioned in academic calendar of the Institute.

(7) Along with the advertisement for admission, list of qualified available guides, their specific research area and vacancies under them shall be put on official website of the Institute.

(8) All applicants have to apply for the entrance test in specified format (Annexure –A) along with fees decided by the authority from time to time.

(9) The applicants appearing in the final year examination of their respective Post Graduate degrees may also apply for entrance test, however, their registration shall be subject to their passing in those examinations at the time of registration.

(10) The eligibility test shall be based on knowledge of Ayurveda with special focus on the concerned subject of specialty current advances in Medical Science, Research Methodology, Biostatistics and there shall be two question papers of multiple choice questions format, namely, Paper I and Paper II bearing equal weightage of fifty marks each.

(11) Paper I shall comprise the questions on Research Methodology and Biostatistics along with the current advances in Health Sciences and it shall be common for all the applicants and Paper II shall be subject specific.

There shall be separate question papers for each discipline.

(12) The duration of the entrance test shall be ninety minutes.

(13) An applicant has to secure a minimum of fifty per cent. cumulative marks for qualifying the examination for the General or the Other Backward Classes or the Social and Economically Backward Classes categories and forty-five per cent. for the Scheduled Cast or Scheduled Tribes categories.

(14) If applicants of the same category and of the same specialty, score cumulative equal marks in entrance test, the marks obtained in Paper I shall be considered for the merit and in the condition of scoring equal marks in Paper I, the marks secured in the final year graduation theory exam shall be considered for merit place.

(15) Selection of the research scholar shall be made by the respective Departmental Research Committee after due consideration to the qualifications, previous research experience along with publications and submitted statement of purposes and satisfactory performance in the interview and feasibility of the submitted research proposal.

(16) The research scholars shall join the respective department and shall complete the procedure for registration.

(17) The selection of the Allied or Trans disciplinary scholars shall be based upon the University Grants Commission guidelines.

(18) The Central Government sponsored international scholars shall be exempted from entrance test:

Provided that they have to complete the course work decided by the Institute.

9. Choice of Guide.- The allotment of the research scholars to the Guides shall be made by the Departmental Research Committee on the basis of merit and taking into consideration the area of research of the department and preference of the research scholars and acceptance of the Guides.

10. Allotment of Stipendiary and Non-stipendiary seats.- (1) In case of stipendiary seats, the available seats shall be allotted equally among all the departments and in case when sufficient scholars are not available in concerned departments, the remaining seats shall be allotted to other departmental scholars as per the merit list of the entrance test, subject to the availability of seats under the Guides of concerned department.

(2) In case of non-stipendiary seats, the qualified candidates may opt for seat as per subject availability and availability of seats under guide.

11. Course Work. - (1) All research scholars shall compulsorily complete Research Methodology and Scientific writing course work of six months duration organised by the Institute.

(2) The syllabus of course work shall be decided by the concerned department and approved by the Academic Council from time to time;

(3) The research scholar has to secure fifty-five per cent. marks to qualify.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 29

12. Synopsis.- (1) After satisfactorily completion of course work, the research scholar shall submit their synopsis of research project under the guide or supervisor to the Departmental Research Committee for approval.

(2) The Departmental Research Committee shall forward the approved synopsis through the Head of the Department to the Dean (Research) of the Institute for proposal defense before Institutional Research Committee and the Institutional Research Committee may approve the proposal within period of fifteen days.

(3) At the time of proposal defense, the research scholar shall invite all the teachers of the institution to appraise the synopsis and to receive suggestions for improvement of the proposed research work.

(4) The Dean (Research) shall forward these synopsis to the Institutional Ethics Committee or Institutional Animal Ethics Committee for approval, as applicable.

(5) The Dean (Research) shall forward the approved synopsis, to the Controller of Examination for registration of the title within a period of fifteen days.

(6) Any alteration in the Ph.D synopsis including title of the Ph.D. research project shall be approved by the Institutional Research Committee and Institutional Ethics Committee or Institutional Animal Ethics Committee on the basis of the recommendation of concerned Departmental Research Committee within six months of the registration of the scholar.

13. Ph.D. Tenure.- (1) The tenure for the Doctoral degree programme shall be three years from the date of joining.

(2) In case of research work is not completed within stipulated period, on the recommendation of the concerned supervisor or guide, the Departmental Research Committee may grant extension up to two years.

(3) In case of incompletion of the research work within the time period of five years maximum extension of one year may be granted by the Director on the recommendation of the Departmental Research Committee.

(4) In case the total time required or taken exceeds six years from the date of initial registration, the research scholar shall have to re-register for Ph.D for further period of two years.

(5) The female research scholar and person with disability (having more than forty per cent. disability) may be allowed an additional two years, however, the total period for completion of a Ph.D. programme in such cases should not exceed ten years from the date of admission in the Ph.D. programme.

(6) For stipendiary seats, term of Ph.D. stipend shall be of thirty-six months from the date of joining the Ph.D. programme.

(7) There shall be two Ph.D. terms in a year, which shall start from January of each year i.e. January to June and July to December.

14. Registration. - (1) Every research scholar shall pay the fees as notified by the Institute from time to time (Annexure –B).

(2) Each research scholar shall have a valid registration at the time of submission of thesis.

(3) The registration of a scholar shall be cancelled, after due approval of the Institutional Research Committee,

in any one of the following eventualities namely:-

(a) if the research scholar remains absent for a continuous period of one month without prior intimation and sanction of leave;

(b) if the research scholar withdraws from the Ph.D. Programme and the withdrawal is duly accepted by the Institutional Research Committee;

(c) if the research scholar fails to pay the fees in any academic year subject to the provisions contained in these regulations;

(d) if progress of research work is found unsatisfactory in three consecutive terms; and

(e) if research scholar is found involved in an act of misconduct or indiscipline or both.

15. Guide or Supervisor and Co-Guides or Co-Supervisors.- (1) For recognition as Ph.D. Guide or Supervisor, permanent faculty of the Institute shall apply on specified proforma along with fees (Annexure- C) as decided by the authority from time to time.

(2) A teacher, with Ph.D. degree in concerned or allied subject, having total five years teaching or research experience may be appointed as Ph.D. Guide or Supervisor.30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(3) In case of unavailability of eligible guide as mentioned in sub-regulation (2), the Director shall be empowered to allot the guide ship to any competent teacher of the subject as an interim measure.

(4) Ordinarily, there shall not be more than eight research scholars under a Professor, six scholars under an Associate Professor and four research scholars under an Assistant Professor in a concerned department at a point of time.

(5) In case of Ph.D. programme, the heads or teacher of basic science department can guide maximum four research scholars (having five-year experience), six scholars (having ten year experience) and eight research scholars (having fifteen year experience) at a point of time.

(6) The seat shall be considered vacant under Guide or Supervisor from the date of pre Ph.D. defense of research scholar while calculating the quota mentioned in sub-regulations (4) and (5).

(7) A teacher shall not be allowed to register the research scholars three years prior to his retirement and in case the Guide or Supervisor appointed by the Institute to guide the research work of the scholar, retires or leaves the job and during these period, if the scholar has already completed specified compulsory tenure, the planned research work under supervision, the scholar shall be allowed to continue in the name of his or her original Guide or Supervisor in his thesis.

(8) In case the Guide or Supervisor appointed by the Institute to guide the research work of the scholar ceases to be the Guide or Supervisor by virtue of retirement or otherwise before the completion of two years tenure of the scholar and if there after a Co-guide or Co-supervisor is qualified for the guide-ship, he shall automatically be the Guide of the research scholar and if co-guide is not eligible for guide- ship, the assignment of the next Guide or Supervisor shall be decided by the Departmental Research Committee after giving due consideration to the views of the concerned scholar in this regard.

16. Stipend or Fellowship. - (1) The Institute shall award Stipend or Fellowship to the eligible research scholars in accordance with the norms as laid down by the Institute.

(2) The research scholars shall require to be involved in teaching assistance as assigned by the respective Guide or Supervisor or Head of the Department.

(3) All research scholars who have been awarded stipend or fellowship or contingency grant by the Institute shall devote their entire time to Doctoral research and shall not engage him or herself in full-time or part- time professional practice or employment with public or private institutions or organisations and for the purpose an undertaking about the same shall be submitted by the scholar at the time of admission.

(4) The admission to the Ph.D. programme and award of stipend or fellowship shall not be linked and admission to the programme shall not guarantee fellowship and those who are not awarded fellowships can continue with the programme as self- financing scholar.

(5) The stipend or fellowship, if awarded, shall be available only for maximum of thirty-six months as per rules.

(6) No stipend or fellowship shall be given for leave period except for paid leave.

17. Leave.- (1) The scholars shall be allowed casual leave up to ten days each year and this leave can be joined with the holidays or Sundays and the research scholars can avail such leave maximum up to six days at a time including holidays and in between holidays shall be considered as holidays and the casual leave shall not be joined with medical leave and this leave can’t be carry forwarded.

(2) The research scholars shall be allowed fifteen days medical leave in a year on submission of medical certificate of a registered medical practitioner and this leave shall not be carry forwarded.

(3) Wherever eligible, maternity or child care leave shall be given to the research scholars as per the Maternity Benefit Act, 1961(53 of 1961) however, after joining, such scholars have to complete the study period as mentioned at sub-regulation (1) of regulation 13 and further, such leave shall be allowed once during the period of study on production of substantial document and no any kind of leave shall be attached with this leave.

(4) The Director has power to sanction up to thirty days leave in extra ordinary circumstances and no stipend shall be paid for such kind of leave which is sanctioned in extra ordinary circumstances.

(5) The duty or special leave shall be granted to the research scholars who are deputed or allowed by the authority to take part in the sports, seminar and such leave shall not exceed fifteen days in a year.

(6) The leave may be extended maximum up to further fifteen days in special case by the Director.

(7) The research scholar shall be allowed to avail medical leave under any special circumstances up to maximum sixty days without stipend under medical ground with the valid medical certificate issued by the[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 31 registered practitioner.

(8) The period shall not be counted to fulfill the minimum specified tenure for Doctorate degree.

(9) Any unreasonable leave or absence availed by stipendiary or non-stipendiary scholars without the previous approval of the competent authority or in excess of limit mentioned above as per sub-regulation (1) to (5) shall be treated as willful absence and no stipend shall be granted for such period and it may also invite disciplinary action which includes termination of the candidature and recovery of the stipend paid by the Institute.

(10) The research scholar may be allowed to carry out his research work in the approved research centers approved by the competent authority, as per the approved research synopsis, with prior approval from the Departmental Research Committee and his leave period shall be considered as on duty, on submission of certificate from the concerned centers and the total duration of such period shall not exceed total ninety days during the entire Ph.D. tenure.

(11) By considering specific research work the Chairperson, Institutional Research Committee or Director may approve more days on recommendation of the Departmental Research Committee and no allowances in term of travel, food and accommodation shall be paid during the on duty period.

(12) The above leave regulations shall also apply to research scholars admitted on non-stipendiary seats.

(13) The leave shall not be claimed as of right and the authority reserves the right to cancel the leave without any

explanation.

18. Residency.- The research scholar shall require to devote his entire time to Doctoral degree programme during specified compulsory tenure after registration and during this tenure, a Post Graduate (Ayurveda), Scholars shall be considered as Clinical Registrar

19. Progress of Research.- (1) Every research scholar shall submit a progress report of research work including time schedule in the specified forms to the Guide or Supervisor at the end of every six months and the Guide or Supervisor shall forward progress reports with remarks for the consideration of the Departmental Research Committee and after reviewing the report, the Departmental Research Committee may recommend appropriate action to be taken by Institutional Research Committee.

(2) If there are three successive unsatisfactory reports (or absents from the meetings of the Departmental Research Committee) on the progress of a scholar as reviewed by Departmental Research Committee, the Institutional Research Committee may recommend cancellation of the registration of the scholar on the recommendation of the Departmental Research Committee.

20. Pre-Ph.D. Defense.- (1) On completion of the planned research work, prior to the submission of the thesis, the scholar shall be required to present a summary of thesis in a pre-Ph.D. defense to be conducted by the Institutional Research Committee on the recommendations of the Departmental Research Committee.

(2) The scholar shall have to invite all the teachers and other Research workers of the Institute to appraise his work and to receive suggestions for the improvement in the research work so as to finalize the work of thesis.

21. Submission of thesis for evaluation.- (1) The thesis shall be an original work which shall signify discovery of new facts or indicate new techniques or new inter-relations of facts already known or newer interpretations of the concepts and the articulation of the contents shall be satisfactory, both in text and graphic presentation.

(2) The respective Guide or Supervisor shall ensure that the thesis has been put to plagiarism check and it meets the norms as decided by the Institutional Research Committee from time to time and plagiarism in any case shall not be more than ten per cent. and a certificate to this effect shall be enclosed along with the thesis.

(3) The research scholar shall have to submit thesis within a period of six months from the date of Pre-Ph.D.

Defense and in extra ordinary circumstances, if a scholar cannot submit the thesis within above mentioned time limit, the Departmental Research Committee may recommend to Institutional Research Committee to extend the time period maximum up to one term (six months) with proper justification and if the scholar fails to submit the thesis even in the above said extended time period, his registration shall be cancelled.

(4) It is desirable that every research scholar publish two research papers based on his current Doctoral research work in a peer reviewed journal at least indexed at University Grants Commission– Consortium for Academic Research and Ethics listed research journal.

(5) The copies of such published research papers shall be attached with the final thesis.32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(6) The dissertation, when approved, shall become the property of the Institute and any publication and Intellectual property rights relating to research work carried by the scholar must mention the name of the Supervisor or Guide as a author and affiliation shall provide to this Institution and if is not implemented in any case, the Institute may initiate the legal actions.

(7) The research scholar shall submit following documents along with thesis, whichever applicable, namely:-

(a) Plagiarism certificate;

(b) Clinical Trials Registry- India completion certificate;

(c) Institutional Ethics Committee and or Institutional Animal Ethics Committee certificate or both; and

(d) Copy of Aadhar Card or Passport.

(8) Before a research scholar submits thesis for the Ph.D. work, he shall submit a certificate from the Guide or Supervisor and the Head of the Department stating that –

(a) he has completed the Research work for the full prescribed Ph.D. tenure and that the thesis embodied the result of investigation conducted during the period he worked as a Ph.D. Research scholar;

(b) the thesis has been accompanied by a declaration signed by the scholar to the effect that “the thesis is his original and independent work”;

(c) that the material from other sources, if any, is duly acknowledged;

(d) the thesis is authenticated by the Guide and Co-guide;

(e) he has completed the required residency, course works and submit the no dues certificate;

(9) On completing Ph.D. programme, the research scholar shall submit the following documents to Dean

(Academic) through proper channel, namely:-

(a) four copies of the printed thesis in Sanskrit or Hindi or English;

(b) the receipts of specified examination and other fees; and

(c) an abstract of the research work done within thousand words giving the salient points of work.

(10) The Dean (Academic) shall forward the mentioned documents to the Controller of Examinations.

(11) The research scholar shall not submit his thesis work which has been accepted or rejected for a degree or any other distinction in the University or in any other University or Institute, but scholar may incorporate in his thesis the contents of any work which he may have previously done on the subject, provided that in such a case scholar shall indicate the work previously done by him in his application and in the introduction of his thesis.

(12) Printed thesis shall be presented in accordance with the following specifications, namely:-

(a) the paper used for printing shall be of A4 size;

(b) printing shall be in a standardised form on both side of the paper, and in one and half spacing;

(c) a margin of 1.25 inches shall be in both sides;

(d) times New Roman Font size twelve for English and any Unicode font of size fourteen for Devnagari script shall be used;

(e) the cover page of the thesis shall display; the title of the thesis, name of the Institute, degree, its specialty and department, full name of the scholar, name of the Guide and Co-Guide (if any), month and year of the submission and registration number.

(13) The research scholar shall initially submit four temporary bound copies of the thesis for the evaluation of examiners and once the thesis is approved by all the examiners, scholar shall be informed about the approval and shall be asked to incorporate, the suggestions made by the examiners, Departmental Research Committee and Research Degree Committee (at the time of Ph.D. Open defense and viva voce), if any, in the final thesis and submit two hard bound copies and soft copy format to the Institute and along with a declaration countersigned by the Guide or Supervisor forwarded by the Chairperson, Departmental Research Committee, to the effect that the suggestions of the examiners have been duly incorporated in the thesis.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 33

22. Examination.- (1) A teacher or researcher with a Ph.D. Degree in concerned or allied subjects having five years Post Graduate teaching experience or ten years Post Graduate and Undergraduate combined teaching experience or ten years of research experience in concerned subject or field or area may be appointed as Examiner for the Ph.D. examinations of thesis and viva-voce.

(2) There shall be four adjudicators to be appointed by the Institute for adjudication of the thesis and at the time of submission of the thesis, the concerned Departmental Research Committee shall ordinarily recommend a panel of six examiners with brief bio-data of each of the examiners, including their area of research and expertise to the Controller of Examination and the Director shall appoint three examiners from the panel submitted by the Departmental Research Committee and the Guide or Supervisor of the research scholar shall be the internal examiner.

(3) The examiners shall ordinarily accept appointment offered by the Institute within ten days.

(4) The examiners shall submit their individual reports within a period of one month of the receipt of the thesis and in special cases on the request of the examiners the time of submission of the reports may be further extended maximum up to one month by the Institute and if the examiner concerned fails to submit the report in extended period, another examiner shall be appointed from the panel to evaluate the thesis.

(5) While, submitting the report, the examiner shall state whether the thesis complies with the following conditions to merit the award of the degree, namely:-

(i) it shall be a piece of research work, characterised either by the discovery of new facts or by fresh approach towards interpretation of facts and theories;

(ii) it shall evidence the scholar’s capacity for critical examination and judgment; and

(iii) it shall also be satisfactory so far as its literary presentation is concerned.

(6) After the examiners have evaluated the thesis, they may recommend that the thesis be accepted for the award of the Ph.D. degree or the thesis be represented in a revised form or the thesis be rejected.

(7) The examiners shall give their detailed evaluating comments and the final recommendation of the examiner shall be in line with and commensuration with his evaluating comments.

(8) While recommending Ph.D. Open defense examination of the research scholar, the examiner may indicate the nature of questions and the issues to be clarified at the Ph.D. Open defense

(9) The report shall be specific and shall state the grounds on which the recommendation is based and in case two examiners recommend the award of the Ph.D. degree and the other two examiner differ, the reports of the examiners with the recommendations and the thesis shall be referred to a fifth examiner without mentioning the names of the examiners who may make a recommendation in the manner specified above;

and his recommendation shall be final i.e. if he disapproves the thesis the thesis shall be rejected.

(10) Non approval of the thesis by two or more examiners shall lead to rejection of the thesis and in such circumstances, no viva voce shall be held and research scholar shall be declared as failed.

(11) If the thesis is approved by all the examiners and Ph.D. Open defense is to be held in such circumstances, the reports shall be made available to the research scholar, the research Guide and the Chairperson of the Departmental Research Committee without mentioning the name of examiners at least fifteen days before the Ph.D. Open defense.

23. Ph.D. Open defense and Viva voce:- (1) After receiving the reports from the Controller of Examination through the office of Dean (Aacdemic) the Departmental Research Committee shall discuss the reports and shall inform the scholar regarding suggestions of the examiners.

(2) The research scholar shall submit the report about revision or modification as suggested by the examiners and shall submit answer of all such queries which are raised by the examiners in their reports.

(3) Departmental Research Committee shall evaluate the submitted matter, and if found satisfactory, shall recommend for viva voce.

(4) On approval of the thesis by all the examiners, the Departmental Research Committee shall recommend for Ph.D. Open defense and viva voce and Ph.D. Open defense and viva voce shall be held at the Institute conducted by the Research Degree Committee.

(5) The date, time and the place for the Ph.D. Open defense and viva voce shall be notified by the Controller of Examination in consultation with the internal examiner, at least fifteen days in advance.

(6) If neither of the external examiners is able to be present at the time of the Ph.D. Open defense and viva voce, the Director on the recommendation of the Departmental Research Committee shall appoint a senior34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] research Guide in the subject to act as an examiner for the Ph.D. Open defense and viva voce and if the internal examiner is not available, the Director shall appoint one of the senior research Guide in the subject concerned as one of the internal examiner.

(7) The overall result shall be officially declared by the Controller of Examination within a period of seven working days from the date of the Ph.D. Open defense and viva voce and provisional degree certificate may be issued by the examination branch of the Institute after the declaration of the result.

(8) In case the Ph.D. Open defense and viva voce is not satisfactory, the Research Degree Committee may recommend a fresh Ph.D. Open defense and vive voce and it shall be organized after six months and for such fresh Ph.D. Open defense and viva voce, fresh fee as decided by the competent authority shall be charged and scholar shall be given maximum one chance to re-appear for the Ph.D. Open defense and viva voce.

24. Conduct of Ph.D. Open defense and viva voce.- (1) If there is recommendation from all examiners as per sub-regulation (11) of regulation 22, the Ph.D. Open defense and viva voce shall be conducted by the Research Degree Committee.

(2) If any examiner gives recommendation, thesis, after incorporating the comments, shall be examined by the same examiner and after final recommendation by this examiner, the P.D. Open Defense and viva voce examinations may be conducted.

(3) In case of differences of opinion between the examiners, views of majority shall prevail.

(4) If examiner recommends the major revision in the thesis, research scholar shall be given six months from decision of Institute to submit the revised thesis as per the recommendations and revised thesis shall be re- evaluated by the examiner and if the examiner is unable to re-evaluate the thesis, the Director, in consultation with the Departmental Research Committee shall appoint another examiner from the submitted examiner panel.

(5) In case two or more than two examiners recommends for major revision and rewriting of the thesis, the thesis shall be so revised, rewritten and resubmitted within a period of one calendar year from the decision of the Institute are communicated to the research scholar and in such a case term fee and the examination fee shall be paid for resubmission and if more than one year time is required but total time for completion is less than six years from initial registration, the research scholar shall be granted extension of time to that extent.

(6) In case the total time required or taken exceeds six years from the date of initial registration, the research scholar shall have to re-register for Ph.D for further period of two years.

(7) At least one of the examiners from outside the Institute shall be present in the Ph.D. Open defense and viva voce.

(8) In addition to obtaining satisfactory clarification of the points raised by the examiners in their reports, the Research Degree Committee shall satisfy itself that the knowledge of the scholar in the broad area of his study is satisfactory.

(9) On the consideration of the report of the Research Degree Committee, the Chairperson shall finally decide whether,-

(a) the degree of Doctor of Philosophy (Ph.D.) be awarded; or

(b) the scholar is required to be re-examined on a later date; or

(c) the degree of Doctor of Philosophy (Ph.D.) may not be awarded.

25. Award of the Degree.- (1) The recommendation of the Research Degree Committee shall be placed before the Institute Body of the Institute for approval of the degree.

(2) The Scholar who have completed the Doctoral Degree programme and have been declared successful in Ph.D. Open defense and viva voce shall be awarded the degree of-

(a) Doctor of Philosophy- Ph.D. (Ayurveda) (Ayurvidyavaridhi);

(b) Doctor of Philosophy- Ph.D. (Ayurveda Pharmacy);

(c) Doctor of Philosophy- Ph.D. (Medicinal Plants);

(d) Doctor of Philosophy- Ph.D. (Allied Science);

(e) Doctor of Philosophy- Ph.D. (Trans disciplinary)[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 35 on payment of necessary fees, either in person or in absentia at his option at the succeeding convocation of the Institute.

26. Fees.- The fees as decided by the Governing Body of the Institute from time to time shall be charged from the research scholars as may be applicable to them.

27. Bond for Stipendiary seats.- (1) Every selected research scholar shall have to execute a bond with the Institute before joining the Doctoral degree programme in the specified form as per Annexure D.

(2) If the scholar leaves the Doctoral degree programme in between, the scholar shall have to pay rupees three lakhs to the Institute as compensation in advance to get relieved from the Institute along with the stipend paid in advance along with availed research budget in advance.

28. Joint or Dual doctoral degree programme.- (1) The Institute shall run Joint or dual Doctoral degree programme in collaboration with the reputed National and International Universities or organisations or Institutes.

(2) The scholar shall register separately at both the collaborative Institutes.

(3) The scholar shall have to spend minimum tenure specified by the respective Institute as per their Ph.D. regulation.

(4) The scholar shall abide to the Ph.D. regulation of the respective Institute during his tenure at respective Institute.

(5) The detailed modalities for Joint or Dual Doctoral degree programme shall be framed mutually by the collaborative Institutes at the time of Memorandum of Understanding.

29. Miscellaneous.- (1) The research scholars undergoing full time Doctoral degree programme shall not be permitted to undertake any paid or unpaid appointments or service or work or engage himself in self- employment and the scholar shall be directed to obtain ‘No Objection Certificate’ from the Institute while, submitting an application for any new job or appointments and the defaulters are liable for disciplinary action such as recovery of stipend, availed research budget and termination of admission.

(2) If the scholar gets selected for a permanent appointment in any Government body during the tenure of Doctoral degree programme, the scholar may join the services and may complete the doctoral degree programme after getting due permission from the employer within period of six year from date of registration in the Institute.

30. The Director of the Institute has the final authority for any discrepancy in the interpretation of provisions of these regulations, and for reasons to be recorded in writing, may relax any provisions of these regulations with the approval or ratification of the Governing body of the Institute.

Whereas the scholar when admitted to the Doctor of Philosophy in Ayurveda will be getting a fellowship of ₹……………… per month during first year of course and ₹…………… during the second and third year of course in this institution, and whereas the Institute of Teaching & Research in Ayurveda has agreed to award the same on terms here in after security for due performance by the scholar for the said terms.

Now this bond witnesses as follows:-

1. In pursuance of the said agreement and in consideration of Institute of Teaching & Research in Ayurveda giving to the Research fellow, fellowship during the course of the training as aforesaid, the scholar hereby convenience with the Institute of Teaching & Research in Ayurveda that he / she shall carry on with his / her Research work in Ph.D. course in Ayurveda and complete the course after appearing at all the examinations as required under the rules.

2. After commencement of the said course for its complete tenure (successfully) that, I hereby agree and abide by that I will serve the institution or any other institutions ordered and directed to me by Institute of Teaching & Research in Ayurveda for a period of tenure of course and if I breach of this condition on committing default in serving the Institution than I hereby agree and undertake that in case of a default on my part I shall be liable to refund in total emoluments of the said Ph.D. Course drawn by me for the tenure and I shall liable to pay all expenses incurred for me by the institution.

3. In the pursuance of the said agreement, that if the said scholar while in institution shall duly and faithfully devote to and execute, perform and discharge all the duties without causing and inquiry loss or damage by reason of any act, default, negligence, or error in judgments to the Institution.

4. Within a period of 10 days from the date of his / her completing the period of the said course he / she give to a notice University by registered post, in writing intimation for the completion his / her period of the said course.

5. In pursuance of the said agreement and for consideration aforesaid the scholar and sureties hereby agree that if the scholar would fail to complete the course in accordance with the covenant in that behalf contain or in clause (1) above or shall discontinue his / her research work for any reason what so ever the scholar and sureties shall jointly and separately liable to pay to the Institute of Teaching & Research in Ayurveda, the total amount of fellowship paid by the Institute of Teaching & Research in Ayurveda and received by the scholar as aforesaid.

Scholar and sureties are hereby further agree that if the scholar leaves the institute without any sufficient reason within 2 (two) months of the Admission or due to any reason after 2 months of the Admission, then he / she has to pay Rs.

3,00,000/- (Rs. Three Lakhs) to the Institute of Teaching & Research in Ayurveda, in advance to get back his / her original certificates / mark sheets.
