1. जिजियमों का सजं क्षप्त िाम और प्रारंभ:

(1) ये जिजियम भारतीय बीमा जिजियामक और जिकास प्राजधकरण (बीमा सिेक्षक और हाजि जिधाारक) (संिोधि) जिजियम, 2026 कहलाएँगे।

(2) ये जिजियम सरकारी रािपत्र म ेंइिके प्रकािि की तारीख को प्रिृत्त होंगे। 5859 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

2. उद्देश्य: इि जिजियमों का उद्देश्य बीमा सिेक्षकों और हाजि जिधाारकों (एसएलएएस) को जियंजत्रत करिेिाल े जिजियामक ढाँचे को सबका बीमा सबकी रक्षा (बीमा जिजधयों का संिोधि) अजधजियम, 2025 (“एसबीएसआर अजधजियम”) के उपबंधों के साथ सुयोजित करिा और पठरचालिगत दक्षता बढािा ह।ै

3. भारतीय बीमा जिजियामक और जिकास प्राजधकरण (बीमा सिेक्षक और हाजि जिधाारक) जिजियम, 2015 में:

(1) िब्द “लाइसेंस” (license) अथिा “लाइसेंस” (licence) अथिा “लाइसेंसीकरण” को िब्द “पंिीकरण” से प्रजतस्ट्थाजपत दकया िाएगा, उि जस्ट्थजतयों को छोड़कर िहा ँ इि जिजियमों में स्ट्पष्ट रूप से जिजिर्दाष्ट दकया गया हो।

(2) िब्द “लाइसेंसप्राप्त” को “लाइससें प्राप्त/पंिीकृत” स ेप्रजतस्ट्थाजपत दकया िाएगा।

4. जिजियम 2 म ें

(1) उप-जिजियम (2) में, िाक्यांि “उसका ििीकरण” को िाक्यांि “लाइसेंस का पंिीकरण म ें पठरिताि” स े प्रजतस्ट्थाजपत दकया िाएगा।

(2) उप-जिजियम (13) को प्रजतस्ट्थाजपत दकया िाएगा, अथाात्:- “"सिेक्षक और हाजि जिधाारक" से िह व्यजि अजभप्रेत ह ैजिसे सिेक्षक और हाजि जिधारा क, सक्षं ेप में एसएलए, के रूप में काया करिे के जलए प्राजधकार द्वारा लाइसेंसप्राप्त/पंिीकृत दकया गया हो।”

5. जिजियम 3 म ें

(1) उप-जिजियम (9) म,ें िब्द “पंिीकरण प्रदाि करि े के जलए” के बाद िब्द “और जिजियम 5(ख) में जिजिर्दाष्ट िार्षाक िुल्क का भगु ताि दकया ह”ै जिजिष्ट दकये िाएगँ े।

(2) उप-जिजियम (10) को प्रजतस्ट्थाजपत दकया िाएगा, अथाात्:- “प्रदाि दकया गया पंिीकरण, जिजिर्दाष्ट िार्षाक िुल्क का भुगताि करिे के अधीि तब तक प्रचलि में होगा िब तक िह िैयजिक सिेक्षक द्वारा अभ्यर्पता िहीं दकया िाता अथिा प्राजधकरण द्वारा जिलंजबत या जिरस्ट्त िहीं दकया िाता।”

6. जिजियम 4 म ें

(1) उप-जिजियम (13) में, िब्द “पिं ीकरण प्रदाि करिे के जलए” के बाद िब्द “और जिजियम 5(ख) म ें जिजिर्दाष्ट िार्षाक िुल्क का भगु ताि दकया ह”ै जिजिष्ट दकये िाएगँ े।

(2) उप-जिजियम (14) को प्रजतस्ट्थाजपत दकया िाएगा, अथाात्:- “प्रदाि दकया गया पंिीकरण, जिजिर्दाष्ट िार्षाक िुल्क का भुगताि करिे के अधीि तब तक प्रचलि में होगा िब तक कारपोरेट सिेक्षक द्वारा अभ्यर्पात िहीं दकया िाता अथिा प्राजधकरण द्वारा जिलंजबत या जिरस्ट्त िहीं दकया िाता।”

7. जिजियम 5 को प्रजतस्ट्थाजपत दकया िाएगा, अथाात:् - “िल्ु क सरं चिा: क. प्रसस्ट्ं करण िल्ु कः िापस ि करि े योग्य देय प्रसंस्ट्करण िल्ु क िीचे ददया गया ह:ै प्रसस्ट्ं करण िल्ु क ियै जिक पिं ीकरण रु. 5000 + लाग ूकर कारपोरेट पिं ीकरण रु.25000 + लागू कर[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 ख. िार्षका िल्ु कः पंिीकरण प्रदाि करि े स े पहल े और उसके बाद प्रत्येक िष ा प्राजधकरण द्वारा जिजिर्दाष्ट की गई भुगताि की पद्धजत के माध्यम से देय िार्षाक िल्ु क, िीचे ददया गया हःै िार्षका िल्ु क ियै जिक पिं ीकरण रु.1000 + लागू कर कारपोरेट पिं ीकरण रु.5000 + लागू कर

8. जिजियम 6 म ें

(1) िीषाक को “लाइससें धाठरत करि े िाल े ितमा ाि सिक्षे क और हाजि जिधारा क (एसएलए) को पिं ीकरण प्रमाणपत्र के जिगमा के जलए प्रदिया” स ेप्रजतस्ट्थाजपत दकया िाएगा।

(2) उप-जिजियम (1) को प्रजतस्ट्थाजपत दकया िाएगा, अथाात:् - “इि जिजियमों की अजधसूचिा की तारीख से पहले िारी दकया गया कोई भी लाइसेंस ऐस ेलाइसेंस पर उजल्लजखत रूप में समाजप्त की तारीख तक जिजधमान्य रहगे ा। बित े दक कोई लाइसेंसधारक जिसिे इि जिजियमों की अजधसचू िा की तारीख स ेपहल े अपिे लाइसेंस के ििीकरण के जलए प्राजधकरण को पहल े ही आिेदि प्रस्ट्तुत दकया हो, िहाँ ऐसे लाइसेंस को पंिीकरण के रूप म ें लाइसेंस के पठरितिा के जलए आिेदि के रूप म ेंमािा िाएगा। प्राजधकरण इस बात स ेसंतुष्ट होिे पर दक आिेदक ऐसे पठरिताि के जलए पात्र ह ैऔर उसि े जिजियम 5(ख) में जिजिर्दाष्ट िार्षाक िल्ु क का भुगताि दकया ह,ै इि जिजियमों की अिुसूची II म ेंजिजिर्दाष्ट रूप म,ें फामा आईआरडीएआई -2 – एलएफ अथिा फामा आईआरडीएआई – 4- एलएफ, िैसी जस्ट्थजत हो, म ेंपंिीकरण प्रदाि करेगा। परंत ुआग ेयह भी ित ाहोगी दक इि जिजियमों की अजधसूचिा की तारीख के बाद, एक जिजधमान्य लाइसेंस का धारक उस लाइसेंस की समाजप्त की तारीख से 90 ददि पहल,े जिजियम 5(क) म ेंजिजिर्दाष्ट रूप म ें प्रसंस्ट्करण िल्ु क के साथ प्राजधकरण को एक आिलाइि आिेदि प्रस्ट्तुत करेगा। ऐसे आिेदि को उसके लाइसेंस को पंिीकरण म ेंपठरितिा के जलए प्रस्ट्तुत आिेदि के रूप में मािा िाएगा। ऐसे पठरितिा के जलए जिजिर्दाष्ट मािदंडों को परू ा करिे पर तथा जिजियम 5(ख) में जिजिर्दाष्ट िार्षाक िुल्क का भगु ताि करिे के बाद, प्राजधकरण इि जिजियमों की अिुसूची II में यथाजिजिर्दाष्ट फाम ाआईआरडीएआई –2– एलएफ अथिा फामा आईआरडीएआई – 4 – एलएफ, िैसी जस्ट्थजत हो, में पंिीकरण प्रदाि करेगा। परंत ुआग ेयह भी ित ाहोगी दक यदद कोई लाइसेंसधारक ऊपर के दसू रे परंतुक के अिुसार प्राजधकरण से संपका िहीं करता, तो उसके लाइसेंस का प्रचलि में होिा समाप्त हो िाएगा। ऐसी जस्ट्थजतयों म,ें प्राजधकरण यदद संतुष्ट होता ह ैदक अन्यथा अिुजचत कष्ट उत्पन्न होगा, सात सौ पचास रुपये और लाग ूकर के अजतठरि जिलंब िुल्क के साथ ऐसे लाइसेंस की समाजप्त की तारीख के बाद 6 महीिे के अदं र पंिीकरण के रूप में लाइसेंस के पठरिताि के जलए प्रस्ट्तुत आिेदि को स्ट्िीकार कर सकता ह।ै प्राजधकरण, स्ट्ियं संतष्टु होिे पर दक आिेदक जिजिर्दाष्ट पात्रता मािदडं ों को पूरा करता ह ैतथा उसि े जिजियम 5 (ख) म ेंजिजिर्दाष्ट िार्षाक िुल्क का भुगताि दकया ह,ै इि जिजियमों की अिुसूची II म ेंयथाजिजिर्दाष्ट फामा आईआरडीएआई –2– एलएफ अथिा फामा आईआरडीएआई – 4 – एलएफ, िैसी जस्ट्थजत हो, में पंिीकरण प्रदाि करेगा। परंत ुआग ेयह भी ित ाहोगी दक यदद कोई लाइसेंसधारक ऊपर के तीसरे परंतुक के अिुसार प्राजधकरण से संपका िहीं करता, तो उसके लाइसेंस का प्रचलि म ेंहोिा समाप्त हो िाएगा। एसएलए के रूप में काया करि ेके जलए िया पंिीकरण प्राप्त करिे हते ु व्यजि जिजियम 17 के अधीि िय ेजसरे से िाम दि ाकरिाि े के उपरातं तथा उसके अधीि अपेक्षाओं का अिपु ालि करि े के बाद जिजियम 3 के अंतगात आिेदि प्रस्ट्तुत कर सकता ह।ै इसी प्रकार, एक कारपोरेट सिेक्षक, इस जस्ट्थजत में जिजियम 4 के अंतगात िय ेपंिीकरण के जलए सीधे आिेदि प्रस्ट्तुत करेगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(3) उप-जिजियम (2) छोड़ ददया िाएगा।

(4) उप-जिजियम (3), (4) और (5) में, िब्द “ििीकरण”, “लाइसेंस का ििीकरण” और “ििीकरण करिा” को िमिः “पठरिताि”, “लाइसेंस का पठरिताि” और “पठरिताि करिा” से प्रजतस्ट्थाजपत दकये िाएँग।े

(5) उप-जिजियम (5) में, िब्द “फामा-आईआरडीएआई-7-एलएफ” और “फामा-आईआरडीएआई-8-एलएफ” को िमिः िब्द “फामा-आईआरडीएआई-2-एलएफ” और “फामा-आईआरडीएआई-4-एलएफ” से प्रजतस्ट्थाजपत दकये िाएँगे।

(6) उप-जिजियम (6) को प्रजतस्ट्थाजपत दकया िाएगा, अथाात:् - “इस प्रकार एक पंिीकरण के रूप में पठरिर्तात लाइसेंस जिजिर्दाष्ट िार्षाक िल्ु क के भुगताि के अधीि तब तक प्रचलि में रहगे ा िब तक एसएलए द्वारा अभ्यर्पात िहीं दकया िाता अथिा प्राजधकरण द्वारा जिलंजबत या जिरस्ट्त िहीं दकया िाता।”

9. जिजियम 8 म ें

(1) िीषाक को “प्रदिया िहा ँ जिजियम 6 के अिसु ार पिं ीकरण के रूप म ें लाइससें का पठरितिा अस्ट्िीकृत दकया गया ह”ै से प्रजतस्ट्थाजपत दकया िाएगा।

(2) उप-जिजियम (1) म,ें “लाइसेंस के ििीकरण के जलए आिेदि” िब्दों को “पंिीकरण के रूप में लाइसेंस का पठरिताि” से प्रजतस्ट्थाजपत दकया िाएगा।

(3) उप-जिजियम (2) म,ें िब्द “लाइसेंस का” छोड़ ददय ेिाएँगे।

(4) उप-जिजियम (4) म,ें “लाइसेंस ििीकरण” िब्द “लाइसेंस पठरिताि” स ेप्रजतस्ट्थाजपत दकये िाएँगे।

10. जिजियम 9 को प्रजतस्ट्थाजपत दकया िाएगा, अथाात:् - “पिं ीकृत सिक्षे क और हाजि जिधारा क द्वारा िार्षका िल्ु क के भगु ताि तथा सबं जं धत जिषयों के जलए प्रदिया:

(1) प्रत्येक पंिीकृत सिेक्षक और हाजि जिधाारक (एसएलए) प्राजधकरण को जिम्नजलजखत दस्ट्तािेिों के साथ, प्रत्येक जित्तीय िषा के जलए, 1 िििरी और पूिािती जित्तीय िषा के 31 िििरी के बीच, जिजियम 5(ख) के अंतगता जिजिर्दाष्ट रूप म ेंिार्षाक िुल्क का भुगताि करेगा:

i. पूिािती जित्तीय िषा के जलए फामा 11 और फामा 12 ii. पूिािती जित्तीय िषा की लेखा-परीक्षा ठरपोटा और जित्तीय जििरण (केिल कारपोरेट सिेक्षक के जलए) iii. जिजधित् भरा गया योग्य और उपयुि (दफट एण्ड प्रोपर) फामटे iv. प्राजधकरण द्वारा जिजिर्दाष्ट दकया िािेिाला कोई अन्य दस्ट्ताििे । बित ेदक दकसी जित्तीय िषा के 1 िििरी स े31 माचा तक की अिजध के दौराि जिजियम 3 या जिजियम 4 या जिजियम 6 के अतं गता पंिीकरण प्रदत्त आिेदक, चाल ू(आिगोइंग) िषा के जलए पंिीकरण प्रदाि करिे के समय देय िार्षाक िल्ु क के अजतठरि, तत्काल अिुिती जित्तीय िषा के जलए िार्षाक िल्ु क का भगु ताि करेंगे।

(2) िार्षाक िुल्क के भुगताि के समय प्रस्ट्ततु कोई भी गलत जििरण या झूिा दस्ट्तािेि/ घोषणा जिजियामक कारािाई (अथादंड/जिलंबि/ जिरसि, आदद) के जलए माग ाप्रिस्ट्त कर सकता ह।ै

(3) एसएलए िो ऊपर उप-जिजियम (1) में जिजिर्दाष्ट समयािजध के अंदर िार्षाक िल्ु क का भुगताि िहीं करता, उसका भुगताि सात सौ पचास रुपये और लागू कर के अजतठरि िल्ु क और ऊपर उप-जिजियम (1) म ें जिजिर्दाष्ट दस्ट्तािेिों के साथ उस जित्तीय िषा के 31 माच ा तक कर सकता ह।ै 31 माचा तक िार्षाक िुल्क का भुगताि ि करि े की जस्ट्थजत म ें 1 अप्रलै स े अजधजियम की धारा 42डी(6)(v) के अधीि पंिीकरण जिलंजबत दकया िाएगा। एसएलए जिसका पंिीकरण जिलंजबत दकया िाता ह,ै ऐसे जिलंबि की तारीख से िये सिेक्षण[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 काया स्ट्िीकार िहीं करेगा अथिा लंजबत कायों के संबंध में सिेक्षण िारी िहीं रखगे ा अथिा सिेक्षण ठरपोटा िारी िहीं करेगा। ऐस े पंिीकरण का जिलंबि ऐस े जिलंबि की तारीख स े तीि महीि े के अंदर एक हिार पाचँ सौ रुपये और लाग ू कर के अजतठरि िल्ु क का भगु ताि पंिीकरण 5(ख) के अतं गता जिजिर्दाष्ट रूप म ें िार्षाक िुल्क तथा ऊपर उप-जिजियम (1) में जिजिर्दाष्ट दस्ट्तािेिों के साथ करि े पर िापस जलया िा सकता ह,ै तथा ऐसा ि करि े पर पंिीकरण धारा 42डी(6)(v) के अधीि जिरस्ट्त दकया िाएगा। पंिीकरण का इस प्रकार का जिलंबि/जिरसि प्राजधकरण से यह अपक्षे ा िहीं करेगा दक जिजियम 23 और 24 के अतं गात जिजिर्दाष्ट प्रदियाओं का अिुसरण दकया िाए।

11. जिजियम 15 म,ें

(1) उप-जिजियम (1) का खडं (ख) छोड़ ददय ेिाएँगे।

(2) उप-जिजियम (3) में, “ऐसे आिेदि पर जिचार करेगा तथा” िब्दों के बाद, “संस्ट्थाि स े ठटप्पजणयां आमंजत्रत करेगा। आिेदि और संस्ट्थाि से प्राप्त ठटप्पजणयों की समीक्षा करि े के बाद, प्राजधकरण” िब्द जिजिष्ट दकया िाएगा।

12. जिजियम 19 म ें

(1) उप-जिजियम (1) के खंड (ग) में, “लाइसेंस संख्या और जिजधमान्यता की अिजध” िब्दों को “लाइसेंस संख्या उसकी समाजप्त की तारीख सजहत अथिा पंिीकरण संख्या, िैसी जस्ट्थजत हो” से प्रजतस्ट्थाजपत दकया िाएगा।

(2) उप-जिजियम (2) म,ें िब्द “लाइसेंस” को “लाइसेंस/पंिीकरण” से प्रजतस्ट्थाजपत दकया िाएगा।

13. जिजियम 23 म ें

(1) िीषाक को प्रजतस्ट्थाजपत दकया िाएगा, अथाात:् - “िार्षका िल्ु क का भगु ताि ि करि ेको छोड़कर अन्य कारणों स ेलाइससें /पिं ीकरण का जिलबं ि”

(2) उप-जिजियम (1) से (5) तक म ेंिब्द “लाइसेंस” को “लाइसेंस/पंिीकरण” से प्रजतस्ट्थाजपत दकया िाएगा।

(3) उप-जिजियम (1) के खडं (ग) म,ें िब्द “उसका” को िब्द “लाइसेंस का” से प्रजतस्ट्थाजपत दकया िाएगा।

(4) उप-जिजियम (1) के खडं (ग) में, िब्द “ऐस े लाइसेंस का जिगाम या ििीकरण” को िब्द “पंिीकरण की तारीख” से प्रजतस्ट्थाजपत दकया िाएगा।

14. जिजियम 24 म ें

(1) उप-जिजियम (1) और (2) म,ें िब्द “लाइसेंस” को “लाइसेंस/पिं ीकरण” स ेप्रजतस्ट्थाजपत दकया िाएगा।

(2) उप-जिजियम (3) को प्रजतस्ट्थाजपत दकया िाएगा, अथाात:् - “सिेक्षक जिसके लाइसेंस/पंिीकरण को, जिजियम 9 के उप-जिजियम (3) के अतं गता जिरसि को छोड़कर, जिरस्ट्त दकया गया ह ैिह ऐसे जिरसि की तारीख से एक िषा की समाजप्त के बाद, िय ेपंिीकरण के जिगाम के जलए आिेदि प्रस्ट्ततु कर सकता ह।ै िैयजिक सिेक्षक जिजियम 17 के अधीि िये जसरे से िाम दिा करिािे के बाद और उसके अधीि अपेक्षाओं का अिुपालि करि े के उपरांत जिजियम 3 के अधीि आिेदि प्रस्ट्ततु कर सकता ह।ै इसी प्रकार, इस जस्ट्थजत में कारपोरेट सिेक्षक जिजियम 4 के अंतगात सीधे आिेदि प्रस्ट्तुत कर सकता ह।ै ” बित े दक यदद पंिीकरण जिजियम 9 के अधीि जिरस्ट्त दकया िाता ह,ै तो एक िष ा की प्रतीक्षा अिजध की मागं लाग ूिहीं होगी। तथाजप, िय ेपिं ीकरण हते ु दोिों िैयजिक और कारपोरेट सिेक्षकों के जलए लागू की िािेिाली ऊपर जिजिर्दाष्ट प्रदिया अपठरिर्तात रहगे ी।”

15. जिजियम 25 म ें िीषाक में और उप-जिजियम (1) से (5) तक म,ें िब्द “लाइसेंस” (license) या “लाइसेंस” (licence) को “लाइसेंस/पंिीकरण” से प्रजतस्ट्थाजपत दकया िाएगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

16. जिजियम 25क म ें िीषाक में और उप-जिजियम (1) से (5) तक म,ें िब्द “लाइसेंस” को “लाइसेंस/पंिीकरण” स ेप्रजतस्ट्थाजपत दकया िाएगा।

17. जिजियम 28 में, िब्द “और ििीकरण” छोड़ ददये िाएँगे।

NOTIFICATION Hyderabad, the 30th July, 2026 Insurance Regulatory and Development Authority of India (Insurance Surveyor and Loss Assessors)

(Amendment) Regulations, 2026 F. No. IRDAI/Reg/7/221/2026.— In exercise of the powers conferred by clause (x) and (xa) of sub-section 2 of

Section 114A read with Sections 42D, 42E and 64UM of the Insurance Act, 1938 (4 of 1938), and Sections 14 and 26 of the Insurance Regulatory and Development Authority Act, 1999 (41 of 1999), as amended from time to time, the Authority in consultation with the Insurance Advisory Committee, hereby makes the following amendments to Insurance Regulatory and Development Authority of India (Insurance Surveyors and Loss Assessors) Regulations, 2015, namely; -

1. Short Title and Commencement of the Regulations:

(1) These Regulations may be called the Insurance Regulatory and Development Authority of India (Insurance Surveyors and Loss Assessors) (Amendment) Regulations, 2026.

(2) These Regulations shall come into force on the date of their publication in the official Gazette.

2. Objective: The objective of these Regulations is to align the regulatory framework governing Insurance Surveyors and Loss Assessors with the provisions of the Sabka Bima Sabki Raksha (Amendment of Insurance Laws) Act, 2025.and to increase operational efficiency.

3. In the Insurance Regulatory and Development Authority of India (Insurance Surveyors and Loss Assessors) Regulations, 2015:

(1) The words “license” or “licence” or “licensing” shall be substituted with the word “registration” except where expressly specified in these Regulations.

(2) The word “licensed” shall be substituted with the word “licensed/registered”.

4. In Regulation 2

(1) In Sub-Regulation (2), the phrase “renewal thereof “shall be substituted with the phrase “conversion of the licence into registration”.

(2) Sub-Regulation (13) shall be substituted, namely:- ““Surveyor and Loss Assessor”, in short SLA, means a person who is licensed/registered by the Authority to act as Surveyor and Loss Assessor.”

5. In Regulation 3

(1) In Sub-regulation (9), after the words “grant of registration”, the words “and has paid the annual fee specified in Regulation 5(b)” shall be inserted.

(2) Sub-regulation (10) shall be substituted, namely:- “The registration granted shall remain in-force subject to the payment of specified annual fee until surrendered by the individual surveyor or suspended or cancelled by the Authority.”

6. In Regulation 4

(1) In Sub-regulation (13), after the words “grant of registration”, the words “and has paid the annual fee specified in Regulation 5(b)” shall be inserted.

(2) Sub-regulation (14) shall be substituted, namely:- “The registration granted shall remain in-force subject to the payment of specified annual fee until surrendered by the corporate surveyor or suspended or cancelled by the Authority.”

7. Regulation 5 shall be substituted, namely:- “Fee Structure: a. Processing Fee: The non-refundable processing fee payable is given below:

Annual Fee: The annual fee payable through the payment mode as specified by the Authority before grant of registration and every year thereafter, is given below:

8. In Regulation 6

(1) The heading shall be substituted with “Procedure for issuance of certificate of registration to the existing surveyor and loss assessors (SLA) holding a license”

(2) Sub-regulation (1) shall be substituted, namely:- “Any license issued before the date of notification of these Regulations shall remain valid till the date of expiry as mentioned on such license.

Provided that a license holder who has already applied to the Authority for renewal of his license before the date of notification of these Regulations, such application shall be treated as an application for conversion of the license into registration. The Authority on being satisfied that the applicant is eligible for such conversion and has paid the annual fee specified in Regulation 5(b), shall grant the registration in Form IRDAI – 2 – LF or Form IRDAI – 4 – LF, as the case may be, as specified in Schedule II of these Regulations.

Provided further that after the date of notification of these Regulations, the holder of a valid license shall make an online application to the Authority along with the processing fee as specified in Regulation 5(a), within 90 days before the date of expiry of that license. Such application shall be treated as an application for conversion of his license into registration. Upon satisfying the specified criteria for such conversion and has paid the annual fee specified in Regulation 5(b), the Authority shall grant the registration in Form IRDAI – 2 – LF or Form IRDAI – 4 – LF, as the case may be, as specified in Schedule II of these Regulations.

Provided further that if a license holder fails to approach the Authority before the expiry of his license, then his license shall cease to remain in force. In such cases, the Authority may, if satisfied that undue hardship would be caused otherwise, accept an application for conversion of license into registration, submitted within 6 months after the date of expiry of such license along with an additional late fee of seven hundred and fifty rupees plus applicable taxes. The Authority, upon satisfying itself that the applicant meets the specified eligibility criteria and has paid the annual fee as specified in Regulation 5(b), shall grant the registration in Form IRDAI – 2 – LF or Form IRDAI – 4 – LF, as the case may be, as specified in Schedule II of these Regulations.

Provided further that if a license holder fails to approach the Authority as per third proviso above, the license shall cease to exist. To obtain a new registration to act as SLA, an individual may apply under Regulation 3 after enrolling afresh under Regulation 17 and complying with the requirements thereunder. Similarly, a corporate surveyor, in this case, shall apply directly for a new registration under Regulation 4.”

(3) Sub-regulation (2) shall be omitted.

(4) In Sub-regulation (3), (4) and (5), the words “renewal”, “renewal of license” and “renew” shall be substituted with “conversion”, “conversion of license” and “convert” respectively.

(5) In Sub-regulation (5), the words “FORM – IRDAI – 7 – LF” and “FORM – IRDAI – 8 – LF” shall be substituted with the words “FORM – IRDAI – 2 – LF” and “FORM – IRDAI – 4 – LF” respectively.

(6) Sub-regulation (6) shall be substituted, namely:- “The license so converted into a registration shall remain in-force subject to the payment of specified annual fee until surrendered by the SLA or suspended or cancelled by the Authority.”

9. In Regulation 8

(1) The heading shall be substituted with “Procedure where conversion of license into registration in terms of Regulation 6, is refused”

(2) In Sub-regulation (1), the words “application for renewal of license” shall be substituted with “conversion of license into registration”.

(3) In Sub-regulation (2), the words “of license” shall be omitted.

10. Regulation 9 shall be substituted, namely:- “Procedure for payment of annual fee by registered Surveyor and Loss Assessors and related matters:

(1) Every registered Surveyor and Loss Assessor (SLA) shall pay an annual fee as specified under Regulation 5(b), for every financial year, between 1st January and 31st January of the preceding financial year, along with

the following documents to the Authority: i. Form 11 and Form 12 for the preceding financial year ii. Audit report and financial statement of preceding financial year (for corporate surveyor only) iii. Duly filled Fit and proper format iv. Any other document as may be specified by the Authority.

Provided that applicants granted a registration under Regulation 3 or Regulation 4 or Regulation 6 during the period from 1st January to 31st March of any financial year, shall pay the annual fee for the immediately succeeding financial year in addition to the annual fee payable at the time of grant of registration for the ongoing financial year.

(2) Any wrong particulars or false document/declaration furnished at the time of payment of annual fee may lead to regulatory action (penalty/suspension/cancellation, etc.).

(3) An SLA who fails to pay the annual fee within the time period specified in sub-Regulation (1) above may pay the same till 31st March of that financial year, along with an additional fee of seven hundred and fifty rupees plus applicable taxes and documents specified in sub-Regulation (1) above. A registration shall stand suspended under Section 42D(6)(v) of the Act with effect from 1st April in the event of failure to pay the annual fee by 31st March. An SLA whose registration stands suspended shall not accept new survey assignments or continue surveys on pending assignments or issue a survey report from the date of automatic suspension. Suspension of such registration may be revoked within three months from the date of such suspension upon payment of an additional fee of one thousand and five hundred rupees plus applicable taxes along with the annual fee as specified under Regulation 5(b) and documents specified in sub-Regulation (1) above, failing which the registration shall stand cancelled under Section 42D(6)(v). Such suspension/cancellation of registration shall not require the Authority to follow the procedures specified under Regulations 23 and 24.

11. In Regulation 15,

(1) Clause (b) of Sub-regulation (1) shall be omitted.

(2) In Sub-regulation (3), after the words “consider such an application and”, the words “call for comments of the Institute. After reviewing the application and the comments received from the Institute, the Authority shall” shall be inserted.

12. In Regulation 19

(1) In Clause (c) of Sub-regulation (1), the words “license number and period of validity” shall be substituted with “license number with its expiry date OR registration number, as the case may be”.

(2) In Sub-regulation (2), the word “license” shall be substituted with “license/registration”.

13. In Regulation 23

(1) The heading shall be substituted, namely:- “Suspension of license/registration for reasons other than non-payment of annual fee”.

(2) In Sub-regulations (1) to (5), the word “license” shall be substituted with “license/registration”.

(3) In Clause (c) of Sub-regulation (1), the word “thereof” shall be substituted with the words “of license”.

(4) In Clause (c) of Sub-regulation (1), the words “issue or renewal of such license” shall be substituted with the words “date of registration”.

14. In Regulation 24

(1) In Sub-regulations (1) and (2), the word “license” shall be substituted with “license/registration”.

(2) Sub-regulation (3) shall be substituted, namely:- “A surveyor whose license/registration has been cancelled for any reason, except where cancellation is under sub-Regulation (3) of Regulation 9, may submit an application for issuance of new registration, after the expiry of one year from the date of such cancellation. An individual surveyor shall apply under Regulation 3[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 11 after enrolling afresh under Regulation 17 and complying with the requirements thereunder. Similarly, a corporate surveyor, in this case, shall apply directly under Regulation 4.

Provided that if the registration is cancelled under Regulation 9, the requirement of one year waiting period shall not apply. However, the procedure specified above to apply for new registration for both individual and corporate surveyors shall remain the same.”

15. In Regulation 25 In the heading and in Sub-regulations (1) to (5), the word “license” or “licence” shall be substituted with “license/registration”.

16. In Regulation 25A In the heading and in Sub-regulations (1) to (5), the word “license” shall be substituted with “license/registration”.

17. In Regulation 28, the words “and renewal” shall be omitted.
