(2) के खंड (एफ), (िी), (एच), (आई), (आईए), (आईबी), (िाई), (िेड), (िेडए), (िेडडी) और (िेडएबी), धाराओं 11, 13, 20, 27, 28, धारा 29 की उप-धारा (3) के खंड (ए), 49, 64िी, और 64िीए तथा बीमा जिजियामक और जिकास प्राजधकरण अजधजियम, 1999 (1999 का 41) की धारा 14 और 26 द्वारा प्रदत्त िजियों का प्रयोग करते हुए, प्राजधकरण बीमा सलाहकार सजमजत के साथ परामिच करिे के बाद, आईआरडीएआई (बीमाकताचओं के बीमांककक, जित्त और जििेि कायच) जिजियम, 2024 का संिोधि करिे के जलए इसके द्वारा जिम्नजलजखत जिजियम बिाता ह,ै अथाचत् :

1. सजं िप्त िाम और प्रारंभः

(1) ये जिजियम भारतीय बीमा जिजियामक और जिकास प्राजधकरण (बीमाकताचओं के बीमांककक, जित्त और जििेि कायच) (संिोधि) जिजियम, 2026 कहलाएँगे।

(2) ये जिजियम सरकारी रािपत्र में इिके प्रकािि की तारीख से अथिा 1 अप्रैल 2026 से, िो भी बाद में हो, प्रिृत्त होंगे।

2. उद्देश्यः इि जिजियमों का मुख्य उद्देश्य यह सुजिजित करिा ह ैककः 2280 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(1) जित्तीय जििरण बीमाकताच की पररजस्ट्थजत का एक सही और उजचत अिलोकि उपलब्ध करािे के जलए प्रयोज्य भारतीय लेखांकि मािकों (इंड एएस), जसद्ांतों और िीजतयों के अिुसार तैयार ककये िाएँ और ररपोर्च ककये िाएँ।

3. अध्याय - II म ें भारतीय बीमा जिजियामक और जिकास प्राजधकरण (बीमाकताचओं के बीमाकं कक, जित्त और जििेि कायच) जिजियम, 2024 के जिजियम 6 में उप-जिजियम (2) के बाद, जिम्नजलजखत को जिजिष्ट ककया िाएगा, अथाचत् :- “(2क), अिुसूची – II-क: इंड एएस जित्तीय कायच”

4. अध्याय – II में भारतीय बीमा जिजियामक और जिकास प्राजधकरण (बीमाकताओंच के बीमांककक, जित्त और जििेि कायच) जिजियम, 2024 के जिजियम 6 के बाद, जिम्नजलजखत को जिजिष्ट ककया िाएगा, अथाचत् :- “6क. इंड एएस जित्तीय जििरण तयै ार करि ेके जलए स्ट्थगि (फारबअे रन्स) का प्रयोग करिे की िजि

(1) सिम प्राजधकारी बीमाकताच की तैयारी, पररितचि की िरर्लता और संगत समझे िािेिाले जिचारयोग्य अन्य कारकों को ध्याि में रखते हुए, बीमाकताच के संबंध में भारतीय लेखांकि मािकों का अिुपालि करते हुए जित्तीय जििरण तैयार करिे और प्रस्ट्तुत करिे के जलए असमथच ह,ै स्ट्थगि का प्रयोग कर सकता है। इस प्रकार का स्ट्थगि सिम प्राजधकारी के द्वारा एक िषच के जलए प्रदाि ककया िा सकता ह।ै बिते कक स्ट्थगि के जलए अिुरोध 30 अप्रैल, 2026 को या उसके पहले ककया िाएगा।

(2) सिम प्राजधकारी बीमाकताच की प्रणाजलयों, प्रकियाओं, और अजभिासि ढाँचे का ध्याि रखते हुए, ऐसे बीमाकताच को इंड एएस के कायाचन्ियि के जलए माजसक तैयाररयों के जििरण से युि बोडच-अिुमोकदत कायच योििा के प्रस्ट्तुतीकरण के अधीि, एक िषच के जलए इि जिजियमों की अिुसूची II के अिुसार जित्तीय जििरण तैयार करिा िारी रखिे के जलए ऐसे बीमाकताच को अिुमजत दे सकता ह।ै

(3) बीमाकताच ऐसी कायच योििा के भाग के रूप में समय पर कायाचन्ियि को सुजिजित करिे के जलए मीलपत्थरों, प्रणाली के जलए सामजयकता और डेर्ा की तैयारी, बीमांककत और जित्त कायच तत्परता और अजभिासि ढाँचे की जस्ट्थजत सजहत, इंड एएस के पररितचि के जलए एक जिस्ट्तृत रूपरेखा प्रस्ट्तुत करेगा।

(4) उस अिजध के दौराि जिसके जलए स्ट्थगि प्रदाि ककया िाता ह,ै बीमाकताच एक जतमाही आधार पर इि जिजियमों की अिुसूची-IIक के अिुसार जित्तीय सूचिा भी तैयार करेगा और प्राजधकरण को प्रस्ट्तुत करेगा।

(5) इस जिजियम के अंतगचत स्ट्थगि का प्रदाय इस ितच के अधीि होगा कक बीमाकताच सिम प्राजधकारी द्वारा जिजिर्दचष्ट रूप में समय-सीमा के अंदर इंड एएस का संपूणच अिुपालि प्राप्त करेगा।

5. भारतीय बीमा जिजियामक और जिकास प्राजधकरण (बीमाकताओंच के बीमाकं कक, जित्त और जिििे काय)च जिजियम, 2024 म,ें अिसु चू ी-II के बाद, “अिुसूची-II-क – इंड एएस जित्त कायच” को जिम्नािुसार जिजिष्ट ककया िाएगा - “अिसु चू ी – II: इंड एएस - जित्त सबं ंधी काय च भाग I: सभी बीमाकताओंच के इंड एएस जित्तीय जििरण और प्रबंध ररपोर्च तयै ार करिा

1. प्रयोज्यता

(1) जिजियमों का यह भाग िीिि बीमाकताचओं, साधारण बीमाकताचओं, स्ट्िास्ट््य बीमाकताचओं, पुिबीमाकताचओं सजहत सभी बीमाकताचओं के जलए लागू होगा।

2. पररभाषाएँ

(1) “भारतीय लेखांकि मािक अथिा (इंड एएस)” से समय-समय पर यथासंिोजधत कंपिी (भारतीय लेखांकि मािक) जियम, 2015 के अधीि अजधसूजचत भारतीय लेखांकि मािक अजभप्रेत ह।ैं

3. इंड एएस जित्तीय जििरणों की तयै ारी के जलए लखे ाकं ि जसद्ातं

(1) भारतीय लेखांकि मािकों की प्रयोज्यता.- बीमाकताच का प्रत्येक तुलि-पत्र, ईकिर्ी में पररितचिों का जििरण, लाभ और हाजि का जििरण, प्राजप्त और भुगताि का जििरण बीमा व्यिसाय करिेिाले बीमाकताचओं के जलए लागू सीमा तक, भारतीय लेखांकि मािकों (इंड एएस) के अिुरूप होंगे।

(2) इंड एएस जित्तीय जििरणों में न्यूितम प्रकर्ीकरण अपेिाओं में जिम्नजलजखत होंगेः i. तुलि-पत्र (जित्तीय जस्ट्थजत का जििरण)[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 ii. ईकिर्ी में पररितचिों का जििरण iii. लाभ और हाजि का जििरण, जिसमें जिम्नजलजखत होंगेः क. लाभ अथिा हाजि, तथा ख. अन्य व्यापक आय (ओसीआई) iv. प्राजप्त और भुगताि खाता (िकदी प्रिाहों का जििरण) v. रािस्ट्ि खाता vi. जिम्नजलजखत सजहत इंड एएस जित्तीय जििरणों की रर्प्पजणयाँ :

क. महत्िपूणच लेखांकि िीजतया ँ ख. अन्य व्याख्यात्मक सूचिा

(3) इंड एएस जित्तीय जििरण बीमाकताच की जित्तीय जस्ट्थजत के सही और उजचत जचत्र को प्रजतबबंजबत करेंगे।

(4) इि जिजियमों के अंतगचत अपेजित इंड एएस जित्तीय जििरण फामेर् और प्रकर्ीकरण ऐसे रूप में और ऐसे तरीके से, तथा ऐसे फामेर्ों के अिुसार तैयार ककये िाएँगे िैसा कक जिजिर्दचष्ट ककया िाएगा और समय-समय पर िारी ककये िािेिाले समिुषंगी अिुदेिों के माध्यम से सूजचत ककया िाएगा।

4. मख्ु य िीजतगत जस्ट्थजतया ँ पाजलसीधारकों के जहतों पर प्रजतकूल प्रभाि के जबिा, इंड एएस और बीमा अजधजियम, 1938 के बीच सुयोिि को सुजिजित करिे के जलए जिम्नजलजखत िीजतगत जस्ट्थजतयों को अपिाया िाएगाः

(1) पाजलसीधारक और िये रधारक जिजधयाँ i. इंड एएस जित्तीय जििरण (तुलि-पत्र, ईकिर्ी में पररितचिों का जििरण, लाभ और हाजि का जििरण तथा प्राजप्त और भुगताि खाता) इंड एएस के अिुसार संस्ट्था के स्ट्तर पर तैयार ककये िाएँगे। ii. बीमा अजधजियम, 1938 की धारा 11 का अिुपालि करिे के जलए पाजलसीधारक जिजध हते ु एक अलग रािस्ट्ि लेखा तैयार ककया िाएगा। iii. पाजलसीधारक और िेयरधारक जिजधयों का अलग-अलग प्रकर्ीकरण इंड एएस जििरणों का भाग बििेिाली अिुसूजचयों के माध्यम से प्रस्ट्तुत ककया िाएगा। iv. बीमा अजधजियम, 1938 के अंतगचत अजधदेिात्मक (मैंडेर्री) ककये गये रूप में पाजलसीधारक और िेयरधारक जिजधयों के जलए अलग खातों का अिुरिण।

(2) िार्षकच कोहार्च अपिे ा i. बीमाकताच सहभागी बीमा संजिदाओं के जलए अपेजित सजहत, इंड एएस 117 के अतं गतच िार्षकच कोहार्च अपिे ा का अिुपालि करेंगे। ii. इंड एएस 117 उपबंधों के अिुसार, िहाँ लागू ह ैिहाँ पररितचि राहत लागू की िाएगी।

(3) अजधिषे का जितरण i. पाजलसीधारकों और िेयरधारकों को अजधिेष के जितरण के जलए बीमा अजधजियम, 1938 की धारा 49 के अधीि जिधाचररत बीमाकं कक अजधिषे आधार के रूप में रहगे ा। ii. जित्तीय ररपोर्र्िंग प्रयोििों के जलए इंड एएस 117 के अंतगचत स्ट्िीकृत लाभ लेखांकि लाभ है तथा यह जितरणयोग्य अजधिेष िहीं मािा िाएगा। iii. पारदर्िचता को सुजिजित करिे के जलए बीमांककक अजधिेष और इंड एएस लाभ के बीच समाधाि सजहत, उपयुि प्रकर्ीकरण प्रस्ट्तुत ककये िाएँगे।

5. पररितिच चरण के दौराि समातं र प्रस्ट्ततु ीकरण

(1) कायाचन्ियि की तारीख से दो िषच के दौराि अथिा प्राजधकरण द्वारा जिजिर्दचष्ट की िािेिाली अिजध के दौराि, प्रत्येक बीमाकताच एक ही ररपोर्र्िंग अिजध के जलए जिम्नजलजखत जििरण प्रस्ट्तुत करेगाः i. इस अिुसूची-II में जिजिर्दचष्ट रूप में और जिजिर्दचष्ट तरीके से भारतीय लेखांकि मािकों (इंड एएस) ढाँचे के अिुसार तैयार ककये गये जित्तीय जििरण; तथा ii. इि जिजियमों की अिुसूची-II के अिुसार तैयार की गई जित्तीय सूचिा जिसका प्रकर्ीकरण बीमाकताच की िेबसाइर् पर ककया िाएगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

6. इंड एएस संबधं ी जििषे ज्ञ समहू का गठि

(1) बीमाकताचओं के द्वारा भारतीय लेखांकि मािकों के कायाचन्ियि के दौराि उत्पन्न होिेिाली समस्ट्याओं की िाँच और उिके समाधाि के प्रयोिि के जलए, सिम प्राजधकारी द्वारा एक संयुि जििेषज्ञ समूह का गठि ककया िा सकता ह।ै

(2) उि संयुि जििेषज्ञ समूह में जिम्नजलजखत हो सकते हैं : i. पूणचकाजलक सदस्ट्य (जित्त और जििेि), आईआरडीएआई (अध्यि) ii. भारतीय सिदी लेखाकार संस्ट्थाि द्वारा िाजमत दो प्रजतजिजध; iii. भारतीय बीमांकक संस्ट्थाि द्वारा िाजमत दो प्रजतजिजध;

iv. भारतीय प्रजतभूजत और जिजिमय बोडच द्वारा िाजमत एक प्रजतजिजध; v. राष्ट्रीय जित्तीय ररपोर्र्िंग प्राजधकरण द्वारा िाजमत एक प्रजतजिजध; vi. ऐसा अन्य व्यजि िो आिश्यक हो सकता हो; तथा vii. जिभाग-प्रमुख (जित्त और जििेि), आईआऱडीएआई सदस्ट्य-संयोिक के रूप में कायच करेगा।

(3) उि संयुि जििेषज्ञ समूह की कायचपद्जत और प्रकियागत पहलू समय-समय पर सिम प्राजधकारी द्वारा जिजिर्दचष्ट रूप में होंगे।

(4) उि संयुि जििेषज्ञ समूह दो िषच की अिजध के जलए अथिा सिम प्राजधकारी द्वारा जिजिर्दचष्ट रूप में जिस्ट्ताररत अिजध के जलए प्रचलि में होगा।

7. स्ट्ितत्रं िधै ीकरण

(1) भारतीय लेखांकि मािकों के कायाचन्ियि के प्रथम िषच के दौराि अथिा ऐसी अिजध के जलए िैसा कक सिम प्राजधकारी द्वारा जिजिर्दचष्ट ककया िाएगा, प्रत्येक बीमाकताच इंड एएस के कायाचन्ियि में अपिाई गई प्रकिया का स्ट्ितंत्र िैधीकरण प्राप्त करेगा। ऐसे िैधीकरण का जिस्ट्तार और तरीका सिम प्राजधकारी के द्वारा जिजिर्दचष्ट ककया िा सकता ह।ै

8. जियोजित जिजधयों (सबं द् व्यिसाय) के जलए इंड एएस जित्तीय जििरण तयै ार करिाः

(1) िीिि बीमा व्यिसाय करिेिाले सभी बीमाकताच संबद् व्यिसायों की प्रत्येक जियोजित जिजध के जलए इंड एएस जित्तीय जििरणों का अलग सेर् तैयार करेगा तथा जििके साथ इंड एएस जित्तीय जििरण संलग्न ककये िाएँगे।

(2) जियोजित जिजधयाँ पाजलसीधारकों, िो जििेि िोजखम को िहि करेंगे, के जिजिष्ट जििेि लक्ष्यों को पूरा करिे के जलए खातों में अिुरजित जिजधयों को जिरूजपत करती हैं। जििेि आय/अजभलाभ और हाजियाँ सामान्यतः पाजलसीधारकों के जलए प्रत्यि रूप से उपजचत होत े ह।ैं प्रत्येक खाते की आजस्ट्तयाँ अलग की िाती ह ैं और िे बीमाकताच के ककसी अन्य व्यिसाय से उत्पन्न होिेिाले दािों के अधीि िहीं हैं।

9. इंड एएस जित्तीय जििरणों का भाग बिििे ाले प्रकर्ीकरण क. कायचपद्जतयों और मुख्य पूिाचिमु ािों सजहत, इंड एएस को लागू करिे में महत्िपूणच लेखांकि िीजतयों और जिणचयों के संबंध में, इंड एएस की अपेिाओं के अिुसार लेखों की रर्प्पजणयों में जिम्नजलजखत प्रकर्ीकरण ककये िाएँगेः-

(1) इंड एएस 117 का अजभजिधाचरण और जिस्ट्तार

(2) बीमा संजिदाओं का संयोिि

(3) बीमा संजिदा से घर्कों का पृथक्करण

(4) समूहि का स्ट्तर

(5) स्ट्िीकरण

(6) बीमा संजिदाओं का मापि i. िकदी प्रिाहों की पूर्तच ii. जडस्ट्काउंर् दर iii. िोजखम समायोिि iv. संजिदागत सेिा मार्िचि v. संजिदा की सीमा vi. किरेि यूजिर् vii. अन्य (जिजिर्दचष्ट ककया िािा ह)ै

(7) दिु चह संजिदाएँ

(15) जित्तीय जलखत i. िगीकरण ii. मापि iii. िजत iv. व्युत्पन्नी (डेररिेरर्ि) v. अन्य (जिजिर्दचष्ट ककया िािा ह)ै

(16) पट्टे

(17) बीमा व्यिसाय स े संबंजधत पररचालि व्ययः व्यिसाय के जिजभन्न खंडों को आबंर्ि का आधार और व्यय का प्रभािि

(18) पररितचि का दजृष्टकोण

(19) कराधाि, लेखांकि िीजत में पररितचि/इंड एएस के अंगीकरण के कारण प्रभाि सजहत।

(20) इंड एएस के द्वारा अपेजित लेखांकि िीजतयों से ककसी प्रस्ट्थाि का प्रकर्ीकरण अलग से ककया िाएगा और ऐसे प्रस्ट्थाि के जलए कारण बताये िाएँगे।

(21) पहले के इंड एएस जित्तीय जििरणों से पूिाचिुमािों में कोई भी पररितचि, औजचत्य और उसके जित्तीय प्रभाि के साथ जिजिर्दचष्ट ककया िाएगा।

(22) इंड एएस द्वारा अपेजित रूप में सभी अन्य प्रयोज्य लेखांकि िीजतयाँ और प्रकर्ीकरण प्रकर् ककये िाएँगे। ख. िीिि बीमा व्यिसाय के जलए रर्प्पजणयों के द्वारा जिम्नजलजखत सचू िा का भी प्रकर्ीकरण ककया िाएगाः

(1) आकजस्ट्मक देयताएँ : i. अंित - प्रदत्त जििेि; ii. बकाया िोजखम-अंकि प्रजतबद्ताएँ; iii. पाजलजसयों के अंतगचत दािों को छोड़कर, किों के रूप में ि मािे गये दािे; iv. जििादास्ट्पद सांजिजधक माँगें/देयताएँ, जििके जलए प्रािधाि िहीं ककया गया है;

v. पुिबीमा दाजयत्ि, खातों में प्रािधाि ि करिे की सीमा तक; vi. अन्य (जिजिर्दचष्ट ककया िािा ह)ै ।

(2) भारत के अंदर और बाहर कंपिी की आजस्ट्तयों के जलए ऋणभारग्रस्ट्तताएँ।

(3) ऋणों, जििेिों और अचल आजस्ट्तयों के जलए की गई और बकाया िचिबद्ताएँ।

(4) तुलि-पत्र के कदिांक की जस्ट्थजत के अिुसार जिपर्ाये गये और छह महीिे से अजधक अिजध के जलए अदत्त रह ेदािे।

(5) जिम्नजलजखत के जलए जििेिों के संबंध में संजिदाओं का मूल्यः i. खरीद िहाँ सुपुदचगी लंजबत ह।ै ii. जबिी िहाँ भुगताि अजतदेय ह।ैं6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(6) प्रबंधकीय पाररश्रजमक की गणिा।

(7) उजचत मूल्य आधार पर मूल्यांककत जििेिों की ऐजतहाजसक लागतें।

(8) जििेि आजस्ट्त के पुिमूचल्यि का आधार।

(9) जियुि बीमांकक द्वारा जिजधित् प्रमाजणत रूप में चालू िषच और जपछले िषच में जिःिुल्क अिलोकि अिजध के दौराि पाजलसी जिरसिों के जलए ककये गये प्रािधाि।

(10) प्रकर्ीकरण कक िेयरधारकों के द्वारा पाजलसीधारकों के खाते में ककये गये अंिदाि अप्रत्याितचिीय स्ट्िरूप के ह,ैं तथा भजिष्य में ककसी भी समय िेयरधारकों को िापस िहीं ककये िाएँगे, िो बीमाकताच की आम बैठक के संदभच में हो जिसमें िेयरधारकों का पूि-च अिुमोदि प्राप्त ककया गया हो।

(11) ककसी भी साजं िजधक अपेिा के अिुसार ककये गये जििेिों का प्रकर्ीकरण उिकी राजि, स्ट्िरूप, िमाित तथा भारत के अंदर और बाहर ककन्हीं जििेष अजधकारों सजहत, अलग से ककया िािा चाजहए।

(12) सिम प्राजधकारी द्वारा िारी ककये गये जिदेिों, यकद कोई हों, के अिुसार आय जिधाचरण के प्रयोिि के जलए अिचक/अििचक जििेिों के रूप में पृथक्करण।

(13) भारत के अंदर या बाहर स्ट्थािीय जिजधयों के अंतगचत या अन्य प्रकार से धरोहर रखे िािे के जलए अपेजित सीमा तक आजस्ट्तयाँ।

(14) किच प्रजतभूजतयों के पररिोधि का आधार।

(15) व्यिसाय िेत्र िार प्रजतित।

(16) पाजलसीधारकों के खाते और िेयरधारकों के खाते के बीच जििेिों और उिपर आय के आबंर्ि के आधार।

(17) जियुि बीमांकक के द्वारा जिजधित् प्रमाजणत रूप में पूिाचिुमािों और अिुभि के आधार पर, जिःिुल्क अिलोकि अिजध के दौराि पाजलसी जिरसिों के जलए प्रािधािीकरण हते ु िीजत और जसद्ातं ों का प्रकर्ीकरण।

(18) संबंजधत आय सजहत, अदािी राजि – व्यिहार और प्रस्ट्तुतीकरण।

(19) कोई अन्य सूचिा िो जिजिर्दचष्ट की िाएगी। ग. जिम्नजलजखत सूचिा का प्रकर्ीकरण साधारण बीमा व्यिसाय, स्ट्िास्ट््य बीमा व्यिसाय और पुिबीमा व्यिसाय के जलए रर्प्पजणयों के द्वारा ककया िाएगा –

(2) भारत के अंदर और बाहर कंपिी की आजस्ट्तयों के जलए ऋणभारग्रस्ट्तताएँ।

(3) ऋणों, जििेिों और अचल आजस्ट्तयों के जलए की गई और बकाया प्रजतबद्ताएँ।

(4) पुिबीम को घर्ाकर, भारत के अंदर/बाहर दािेदारों को भुगताि ककये गये दािे।

(5) उि दािों के मामले में दािा देयताओं के जिधाचरण के जलए बीमांककक पूिाचिुमाि िहाँ दािा भुगताि अिजध चार िषच से अजधक है।

(6) दािों की अिजध – छह महीिे से अजधक बकाया दािों और अन्य दािों के बीच भेद दिाचते हुए।

(7) भारत के अंदर/बाहर से अंककत पुिबीमा व्यिसाय को घर्ाकर प्रीजमयम।

(8) जिम्नजलजखत के जलए जििेिों से संबंजधत संजिदाओं का मूल्य – i. खरीद िहाँ जितरण लंजबत हैं ii. जबिी िहाँ भुगताि अजतदेय ह ैं

(9) बीमा व्यिसाय से संबंजधत पररचालि व्ययः व्यिसाय की जिजभन्न श्रेजणयों को व्यय के आबंर्ि और प्रभािि का आधार।

(10) उजचत मूल्य आधार पर मूल्यांककत जििेिों की ऐजतहाजसक लागतें।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7

(11) प्रबंधकीय पाररश्रजमक की गणिा।

(12) किच प्रजतभूजतयों के पररिोधि का आधार।

(13) जििेि आजस्ट्त का उजचत मूल्य और उसके जलए आधार।

(14) तुलि-पत्र के कदिांक की जस्ट्थजत के अिुसार जिपर्ाये गये दािे और छह महीिे से अजधक अिजध के जलए अदत्त िेष दािे।

(15) जियुि बीमांकक द्वारा जिजधित् प्रमाजणत रूप में चालू िषच और जपछले िषच में जिःिुल्क अिलोकि अिजध के दौराि पाजलसी जिरसिों के जलए ककये गये प्रािधाि।

(16) ककसी भी सांजिजधक अपेिा के अिुसार ककये गये जििेिों का प्रकर्ीकरण अलग से उिकी राजि, स्ट्िरूप, िमाित और भारत के अंदर और बाहर ककन्हीं जििेष अजधकारों सजहत ककया िािा चाजहए।

(17) सिम प्राजधकारी द्वारा िारी ककये गये जिदेिों, यकद कोई हों, के अिुसार आय जिधाचरण के प्रयोिि के जलए अिचक/अििचक जििेिों के रूप में पृथक्करण।

(18) व्यिसाय िेत्र-िार प्रजतित।

(19) रािस्ट्ि खाते और लाभ-हाजि खाते के बीच ब्याि, लाभांिों और ककराये के आबंर्ि का आधार।

(20) जियुि बीमांकक द्वारा जिजधित् प्रमाजणत रूप में पूिाचिुमािों और अिुभि के आधार पर, जिःिुल्क अिलोकि अिजध के दौराि पाजलसी जिरसिों के जलए प्रािधािीकरण हते ु िीजत और जसद्ांतों का प्रकर्ीकरण।

(21) कोई अन्य सूचिा िैसा कक जिजिर्दचष्ट ककया िाए।

10. इंड एएस जित्तीय जििरणों की तयै ारी के जलए सामान्य अिदु िे

(1) तुलि-पत्र, रािस्ट्ि खाते, लाभ और हाजि खाते तथा प्राजप्त और भुगताि खाते में दिाचई गई सभी मदों के जलए तत्काल पूिचिती जित्तीय िषच के जलए तदिुरूपी राजियाँ दी िाएँगी।

(2) इंड एएस जित्तीय जििरणों में आंकड़े जिकर्तम लाख तक पूणािंककत ककये िाएँ।

(3) ककसी जििेि के संबंध में प्राप्य ब्याि, लाभांिों और ककराये को सकल राजि पर बताया िािा चाजहए, स्रोत पर कर्ौती ककये गये आय-कर की राजि को “प्रदत्त अजग्रम करों” और स्रोत पर कार्े गये करों के अंतगचत िाजमल ककया िािा चाजहए।

(4) कंपिी ऐसे मुकदमों के अंतगचत हिाचिे के जलए प्रािधाि करेगी िहाँ प्रबंधि की राय में अजधजिणचय बीमाकताच के जिरुद् हो सकता ह।ै

(5) प्रजतधाररत और पुिःबीमाकृत िोजखम की सीमा का प्रकर्ीकरण अलग से ककया िाएगा।

(6) सभी बीमाकताचओं से अपेजित ह ै कक िे िेयरधारकों और पाजलसीधारकों के जलए अलग जििेि खाते रखें तथा उि जििेिों पर आय/उपजचत हाजियों/पूँिीगत अजभलाभों/हाजियों को रािस्ट्ि खाते/लाभ और हाजि खाते में, िैसी जस्ट्थजत हो, िमा ककया िाए/िामे डाला िाए।

(7) इंड एएस जित्तीय जििरणों की प्रत्येक मद के संबंध में लेखों पर रर्प्पजणयों में ककसी संबंजधत सूचिा के साथ प्रजत-संदभच (िास-ररफ्रेंस) ककया िाएगा।

(8) इंड एएस जित्तीय जििरण सभी `महत्िपूणच’ मदों का प्रकर्ीकरण करेंगे, अथाचत् ऐसी मदें िो उि आर्थचक जिणचयों को िैयजिक रूप से या सामूजहक तौर पर प्रभाजित कर सकती ह ैं िो प्रयोगकताच इंड एएस जित्तीय जििरणों के आधार पर लेते हैं।

11. प्रबधं ररपोर्च की जिषय-िस्ट्तःु प्रबंध ररपोर्च इंड एएस जित्तीय जििरणों के साथ संलग्न की िाएगी, िो अन्य बातों के साथ-साथ जिम्नजलजखत से युि, प्रबंधि के द्वारा जिजधित् प्रमाणीकृत एक प्रबंध ररपोर्च होगीः

(1) प्राजधकरण द्वारा प्रदाि ककये गये पंिीकरण की लगातार िारी जिजधमान्यता के संबंध में पुष्टीकरण।

(2) प्रमाणीकरण कक सांजिजधक प्राजधकाररयों को देय सभी राजियों का जिजधित् भुगताि ककया गया है।

(3) इस आिय का पुष्टीकरण कक िषच के दौराि िेयरधाररता का स्ट्िरूप और िेयरों का कोई भी अंतरण सांजिजधक या जिजियामक अपेिाओं के अिुसार ह।ैं

(4) घोषणा कक प्रबंधि िे भारत में िारी की गई पाजलजसयों के धारकों की जिजधयों का भारत के बाहर प्रत्यि या अप्रत्यि रूप से जििेि िहीं ककया है।

(6) इस आिय का प्रमाणीकरण कक तुलि-पत्र की तारीख को सभी आजस्ट्तयों के मूल्यों की समीिा की गई ह ै तथा उिके (बीमाकताच के) जिश्वास के अिुसार तुलि-पत्र में प्रस्ट्तुत आजस्ट्तयों को उिकी समग्र राजियों पर दिाचया गया ह ै िो उिके िसूलीयोग्य अथिा बािार मूल्य से अजधक िहीं हैं।

(7) इस आिय का प्रमाणीकरण कक िीिि बीमा जिजध के ककसी भी भाग का उपयोग बीमा अजधजियम, 1938 (1938 का

4) के, िीिि बीमा जिजधयों के उपयोग और जििेि से संबंजधत उपबंधों का उल्लंघि करते हुए प्रत्यि अथिा अप्रत्यि रूप से उपयोग िहीं ककया गया है।

(8) िोजखमों का न्यूिीकरण करिे के जलए अपिाई गई समग्र िोजखम एक्सपोज़र और कायचिीजत के संबंध में प्रकर्ीकरण।

(9) अन्य देिों में पररचालि, यकद कोई हों, एक अलग जििरण के साथ देि िोजखम और एक्सपोज़र िोजखम के संबंध में प्रबंधक-िगच के अिुमाि तथा अपिाई गई बचाि-व्यिस्ट्था (हबे िंग) की रणिीजत का ब्योरा देते हुए।

(10) पूिचिती पाँच िषों के दौराि औसत दािा जिपर्ाि की प्रिृजत्तयों को जिर्दचष्ट करते हुए दािों के जिपर्ाि की अिजध (एबिंग)।

(11) इस आिय का प्रमाणीकरण कक तुलि-पत्र में दिाचये अिुसार, जििेिों, और स्ट्र्ाकों और िेयरों की गणिा कैसे की गई ह,ै तथा इस प्रकार दिाचये गये मूल्यों के साथ तुलिा के प्रयोिि के जलए उिके बािार मूल्य का पता कैसे लगाया गया ह।ै

(12) संजिभागों के तौर पर, अथाचत् स्ट्थािर संपदा (ररयल एस्ट्र्ेर्), ऋणों, जििेिों, आकद के तौर पर आजस्ट्त गुणित्ता और जििेि के कायचजिष्पादि की समीिा।

(13) जिम्नजलजखत को जिर्दचष्ट करते हुए एक दाजयत्ि जििरण ककः i. इंड एएस जित्तीय जििरणों की तैयारी में प्रयोज्य भारतीय लेखांकि मािक, जसद्ांतों और िीजतयों का पालि ककया गया ह,ै तथा महत्िपूणच जिचलि, यकद कोई हों, तो उिसे संबंजधत उजचत स्ट्पष्टीकरण साथ में कदये गये हैं। ii. प्रबंधि िे लेखांकि िीजतयों को अपिाया ह ै तथा उिका उपयोग सुसंगत रूप में ककया ह ै तथा जिणचय और अिुमाि िो ककये ह ैंिे उजचत और जििेकसम्मत ह ैंजिससे जित्तीय िषच के अंत में कंपिी की पररजस्ट्थजत एिं िषच के जलए कंपिी रािस्ट्ि लेखे और लाभ-हाजि लेखे का एक सही और उजचत जचत्र कदया िा सके। iii. प्रबंधि िे कंपिी की आजस्ट्तयों की सुरिा करिे तथा धोखाधड़ी और अन्य अजियजमतताओं की रोक-थाम और उिकी पहचाि करिे के जलए, बीमा अजधजियम, 1938 (1938 का 4)/कंपिी अजधजियम, 2013 के प्रयोज्य उपबंधों के अिुसार पयाचप्त लेखांकि अजभलेखों के अिुरिण के जलए उजचत और यथेष्ट सािधािी बरती ह।ै iv. प्रबंधि िे इंड एएस जित्तीय जििरण कायचिील संस्ट्था (गोइंग कन्सिच) आधार पर तैयार ककये हैं। v. प्रबंधि िे सुजिजित ककया ह ै कक व्यिसाय के आकार और स्ट्िरूप के अिुरूप एक आंतररक लेखा-परीिा प्रणाली जिद्यमाि ह ैतथा िह प्रभािी ढंग से पररचालि कर रही है।

(14) उि भुगतािों की एक अिुसूची, िो व्यजियों, फमों, कंपजियों और संस्ट्थाओं को ककये गये ह ैंजििमें बीमाकताच के जिदेिक जहतबद् ह।ैं

(15) सहायक संस्ट्थाओं, सहयोगी संस्ट्थाओं, संयुि उद्यमों और अन्य व्यिस्ट्थाओं के संबंध में देिों में घरेलू, सांजिजधक, जिजियामक और अन्य जिजधयों के अिुपालि का पुष्टीकरण।

12. कोई अन्य सूचिा िैसी कक जिजिर्दचष्ट की िाएगी।

13. इंड एएस जित्तीय जििरणों की तयै ारी

(1) बीमाकताच तुलि-पत्र [फाम चइंड एएस - बीएस] और ईकिर्ी में पररितचि का जििरण [फामच इंड एएस - एसओसीई], लाभ और हाजि लेखा [िेयरधारकों का खाता] [फामच इंड एएस – पी&एल] तथा रािस्ट्ि लेखा [पाजलसीधारकों का खाता] [फामच इंड एएस - आरए] इस भाग में जिजिर्दचष्ट रूप में, अथिा पररजस्ट्थजतयों के अिुकूल होिे के तौर पर उसके जिकर्तम रूप में तैयार करेगा।

(2) िीिि बीमा व्यिसाय करिेिाला बीमाकताच इंड एएस जित्तीय जििरण और उिमें जिजहत अिुसजू चयाँ जिम्नजलजखत व्यिसायों के जलए अलग से तैयार करेगाः-

(i) संबद् व्यिसाय – (क) िीिि, (ख) पेंिि, (ग) स्ट्िास्ट््य, (घ) अन्य

(ii) असंबद् व्यिसाय सहभागी – (क) िीिि, (ख) पेंिि, (ग) स्ट्िास्ट््य, (घ) अन्य

(iii) असंबद् व्यिसाय – लाभरजहत – (क) िीिि, (ख) पेंिि, (ग) स्ट्िास्ट््य, (घ) अन्य

(iv) भारत के अंदर व्यिसाय और भारत के बाहर व्यिसाय।

(v) जिजिर्दचष्ट ककया िािेिाला कोई अन्य खंड।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 9

(3) साधारण बीमा व्यिसाय, स्ट्िास्ट््य बीमा व्यिसाय या पुिबीमा व्यिसाय करिेिाला बीमाकताच इंड एएस जित्तीय जििरण और उिमें जिजहत अिुसूजचयाँ जिम्नजलजखत व्यिसायों के जलए अलग से तैयार करेगाः- i. अजग्न (फायर) व्यिसाय ii. मरीि बीमा व्यिसाय iii. जिजिध बीमा व्यिसाय, अलग अिुसूजचयाँ न्यूितम तौर पर जिम्नजलजखत के जलए प्रस्ट्तुत की िाएँगीः (क) मोर्र के अंतगचतः उप-खंड (1) मोर्र स्ट्ियं की िजत और (2) मोर्र र्ीपी, (एकमात्र तौर पर पुिबीमा व्यिसाय में सकिय बीमाकताच उि अिुसूची समग्र मोर्र स्ट्तर पर तैयार करें) (ख) स्ट्िास्ट््य के अंतगचतः उप-खंड (1) स्ट्िास्ट््य, (2) िैयजिक दघु चर्िा और (3) यात्रा, (ग) कमचकार प्रजतकर / जियोिा का दाजयत्ि, (घ) सािचिजिक / उत्पाद दाजयत्ि, (ङ) इंिीजियररंग, (च) जिमािि, (छ) फ़सल, (ि) बीमाकताच के कुल सकल प्रत्यि प्रीजमयम के 10% से अजधक अंिदाि करिेिाला कोई भी अन्य उप-खंड अलग से दिाचया िाएगा। (झ) अन्य। (ञ) कोई अन्य खंड िैसा कक जिजिर्दचष्ट ककया िाएगा।

(4) खंडों की ररपोर्च व्यिसाय की श्रेणी के आधार पर, तथा भारत के अंदर और बाहर व्यिसाय ककये िािे के आधार पर दी िाए। खंड के जििरण में तदिुरूपी जपछले िषच के आंकड़े देते समय, सभी खंडों के जलए आंकड़े भी कदये िाएँ।

1. प्रत्येक बीमाकताच के इंड एएस जित्तीय जििरणों पर लेखा-परीिकों की ररपोर्च इस भाग में जिजिर्दचष्ट जिषयों से संबंजधत होगीः

(1) कक उन्होंिे समस्ट्त सूचिा और स्ट्पष्टीकरण िो उिकी अजधकतम िािकारी और जिश्वास के अिुसार उिकी लेखा-परीिा के प्रयोििों के जलए आिश्यक थे तथा यह कक उन्होंिे उन्ह ेंसंतोषििक पाया है;

2. लेखा-परीिक जिम्नजलजखत के संबंध में अपिा अजभमत व्यि करेंगेः

(6) उपयुचि (1) पर बताये गये इंड एएस जित्तीय जििरण बीमा अजधजियम, 1938 (1938 का 4), बीमा जिजियामक और जिकास प्राजधकरण अजधजियम, 1999 (1999 का 41) तथा कंपिी अजधजियम, 2013 की अपेिाओं के अिुसार प्रयोज्य सीमा तक और इस प्रकार अपेजित तरीके से तैयार ककये गये हैं;

(7) जििेिों का मूल्यांकि उि अजधजियम और इि जिजियमों के उपबंधों के अिुसार ककया गया है;

(8) बीमाकताच के द्वारा चयि की गई लेखांकि िीजतयाँ उपयुि ह ैंतथा प्रयोज्य इंड एएस का तथा इि जिजियमों अथिा इस उद्देश्य से िारी ककये गये ककसी आदेि या जिदेि में यथाजिधाचररत लेखांकि जसद्ांतों का अिुपालि करते ह।ैं

3. लेखा-परीिक यह भी प्रमाजणत करेंगे ककः

(1) उन्होंिे प्रबंधि ररपोर्च की समीिा की है तथा इंड एएस जििरणों में कोई सुस्ट्पष्ट त्रुरर् अथिा महत्िपूणच असंगजतयाँ िहीं ह।ैं

(2) बीमाकताच िे प्राजधकरण द्वारा जिधाचररत पंिीकरण की ितों का अिुपालि ककया है।

4. लेखा-परीिकों के द्वारा हस्ट्तािररत एक प्रमाणपत्र [िो तुलि-पत्र के संबंध में कदये िाि ेके जलए जिजध के द्वारा अपेजित ककसी भी अन्य प्रमाणपत्र या ररपोर्च के अजतररि होगा] यह प्रमाजणत करते हुए कक-

(1) उन्होंिे बीमाकताच के ऋणों, प्रत्याितचिों और िीिि जहतों (िीिि बीमाकताचओं के मामले में) तथा जििेिों से संबंजधत िकदी िेषों और प्रजतभूजतयों का सत्यापि ककया है;

(2) ककस सीमा तक, यकद कोई हो, उन्होंिे एक न्यासी के रूप में बीमाकताच के द्वारा ककये गये ककन्हीं भी न्यासों से संबंजधत जििेिों और लेिदेिों का सत्यापि ककया है; तथा

(3) पाजलसीधारकों की जिजधयों की आजस्ट्तयों के ककसी भी भाग का प्रत्यि या अप्रत्यि रूप से उपयोग पाजलसीधारकों की जिजधयों के उपयोग और जििेिों से संबंजधत बीमा अजधजियम, 1938 (1938 का 4) के उपबंधों का उल्लंघि करते हुए िहीं ककया गया ह।ै “ ए आर जित्यािंथम, कायचकारी जिदेिक [जिज्ञापि-III/4/असा./801/2025-26][भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 59 INSURANCE REGULATORY AND DEVELOPMENT AUTHORITY OF INDIA

NOTIFICATION Hyderabad, the 30th March, 2026 Insurance Regulatory and Development Authority of India (Actuarial, Finance and Investment Functions of Insurers), (Amendment) Regulations, 2026 F. No. IRDAI/Reg/2/216/2026.—In exercise of the powers conferred by clauses (f), (g), (h), (i), (ia), (ib),

(y), (z), (za), (zd) and (zab) of sub-section (2) of section 114A, Sections 11, 13, 20, 27, 28, clause (a) of sub-section

(3) of section 29, 49, 64V, and 64VA of the Insurance Act, 1938, (4 of 1938) and section 14 and 26 of the Insurance Regulatory and Development Authority Act, 1999 (41 of 1999), the Authority, in consultation with the Insurance Advisory Committee, hereby makes the following regulations to amend IRDAI (Actuarial, Finance and Investment Functions of Insurers) Regulations, 2024, namely:

1. Short Title and commencement:

(1) These Regulations may be called the Insurance Regulatory and Development Authority of India (Actuarial, Finance and Investment Functions of Insurers), (Amendment) Regulations, 2026

(2) These Regulations shall come into force from the date of their publication in the official gazette or 1st April, 2026 whichever is later.

2. Objectives: The key objective of these regulations is to ensure that:

(1) The financial statements are prepared and reported in accordance with applicable Indian Accounting standards (Ind AS), principles and policies to provide a true and fair view of state of affairs of the insurer.

3. In Chapter – II after sub regulation (2) in regulation 6 of Insurance Regulatory And Development Authority of India (Actuarial, Finance and Investment Functions of Insurers) Regulations, 2024, the following shall be inserted, namely:- “(2A) Schedule – IIA: Ind AS Finance Functions”

4. In Chapter – II after regulation 6 of Insurance Regulatory And Development Authority of India (Actuarial, Finance and Investment Functions of Insurers) Regulations, 2024, the following shall be inserted, namely:- “6A Power to exercise forbearance for preparation of Ind AS financial statements

(1) The Competent Authority may, having regard to the preparedness of the insurer, the complexity of transition and such other factors as may be considered relevant, exercise forbearance in respect of insurer who is unable to prepare and present financial statements in compliance with Indian Accounting Standards. Such forbearance may be granted for one year by the Competent Authority:

Provided the request for forbearance shall be made on or before 30th April, 2026.

(2) The Competent Authority may, having regard to the readiness of systems, processes, and governance framework of the insurer, permit such insurer to continue to prepare financial statements in accordance with Schedule - II to these regulations for one year, subject to submission of a Board-approved action plan detailing preparations for implementation of Ind AS.60 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(3) The insurer shall furnish, as part of such action plan, a detailed roadmap for transition to Ind AS, including monthly milestones, timelines for system and data readiness, status of actuarial and finance function preparedness and the governance framework to ensure timely implementation.

(4) During the period for which forbearance is granted, the insurer shall also prepare and submit to the Authority financial information in accordance with Schedule - IIA of these regulations on a quarterly basis.

(5) The grant of forbearance under this regulation shall be subject to submission of monthly progress report of the preparation and the condition that the insurer shall achieve full compliance with Ind AS within one year.”

5. In Insurance Regulatory And Development Authority of India (Actuarial, Finance and Investment Functions of Insurers) Regulations, 2024, after Schedule – II, “Schedule – IIA: Ind AS Finance Functions” shall be inserted as

under:- “SCHEDULE – IIA: IND AS FINANCE FUNCTIONS

Part I: Preparation of Ind AS financial statements and management report of all insurers

1. Applicability

(1) This part of regulations shall be applicable to all the insurers including life insurers, general insurers, health insurers and re-insurers.

2. Definitions

(1) “Indian Accounting Standards” or “Ind AS” means the Indian Accounting Standards notified under the Companies (Indian Accounting Standards) Rules, 2015, as amended from time to time;

3. Accounting Principles for Preparation of Ind AS Financial Statements:

(1) Applicability of Indian Accounting Standards - Every Balance Sheet, Statement of Changes in Equity, Statement of Profit and Loss and Receipts and Payments Account of an insurer shall be in conformity with the Indian Accounting Standards to the extent applicable to insurers carrying on insurance business.

(2) The minimum disclosure requirements in the Ind AS Financial Statements comprise of: i. Balance Sheet (Statement of Financial Position) ii. Statement of Changes in Equity iii. Statement of Profit and Loss, comprising:

a. Profit or Loss, and b. Other Comprehensive Income (OCI) iv. Receipts and Payments Account (Statement of Cash Flows)[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 61 v. Revenue Account vi. Notes to the Ind AS Financial Statements including:

a. Material accounting policies b. Other explanatory information

(3) Ind AS Financial Statements shall reflect true and fair picture of the financial condition of the insurer.

(4) The Ind AS Financial Statements formats and disclosures required under these Regulations shall be prepared in such form and manner, and in accordance with such formats, as specified and through subsidiary instructions, issued from time to time.

4. Key Policy Positions Without prejudice to the interests of policyholders, following policy positions shall be adopted to ensure alignment between Ind AS and the Insurance Act, 1938:

(1) Policyholder and Shareholder Funds i. Ind AS Financial Statements (Balance Sheet, Statement of Changes in Equity, Statement of Profit and Loss and Receipts and Payments Account) shall be prepared at the entity level in accordance with Ind AS.

ii. A separate Revenue Account for the Policyholder Fund shall be prepared to comply with Section 11 of the Insurance Act, 1938. iii. Separate disclosure of Policyholder and Shareholder funds shall be provided through schedules forming part of the Ind AS Financial Statements.

iv. Maintenance of separate accounts for Policyholder and Shareholder funds shall continue as mandated under the Insurance Act, 1938.

(2) Annual Cohort Requirement i. Insurers shall comply with the annual cohort requirement under Ind AS 117, including for participating insurance contracts. ii. Transition relief, where applicable, shall be applied in accordance with Ind AS 117 provisions.

(3) Distribution of Surplus i. Actuarial surplus determined under Section 49 of the Insurance Act, 1938 shall remain the basis for distribution of surplus to policyholders and shareholders. ii. Profit recognised under Ind AS 117 is accounting profit for financial reporting purposes and shall not be treated as distributable surplus.

iii. Appropriate disclosures, including reconciliation between actuarial surplus and Ind AS profit, shall be provided to ensure transparency.

5. Parallel Submission during transition phase

(1) During the first two years from the date of implementation or for such period as may be specified by the Competent Authority, every insurer shall furnish for the same reporting period:62 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] i. Financial Statements prepared in accordance with the Indian Accounting Standards (Ind AS) framework in the form and manner specified in this Schedule - IIA; and ii. Financial information prepared in accordance with Schedule - II of these regulations, which shall be disclosed on the website of the insurer.

6. Constitution of Joint Expert Group on Ind AS

(1) For the purpose of examining and addressing issues arising in the course of implementation of the Indian Accounting Standards by insurers, a Joint Expert Group may be constituted by the Competent Authority.

(2) The Joint Expert Group may comprise of: i. Whole time Member (Finance and Investment), IRDAI (Chair) ii. Two representatives nominated by the Institute of Chartered Accountants of India; iii. Two representatives nominated by the Institute of Actuaries of India;

iv. One representative nominated by the Securities and Exchange Board of India; v. One representative nominated by the National Financial Reporting Authority; vi. Such other person as may be necessary; and vii. Head of Department (Finance and Investment), IRDAI shall act as the Member-Convener.

(3) The functioning and procedural aspects of the Joint Expert Group shall be as specified by the Competent Authority from time to time.

(4) The Joint Expert Group shall remain in force for a period of two years or for such extended period as may be specified by the Competent Authority.

7. Independent Validation:

(1) During the first year of implementation of the Indian Accounting Standards, or for such period as may be specified by the Competent Authority, every insurer shall obtain independent validation of process adopted in implementation of Ind AS. The scope and manner of such validation may be specified by the Competent Authority.

8. Preparation of Ind AS Financial Statements for Segregated Funds (Linked Business):

(1) All insurers carrying on life insurance business shall prepare separate set of Ind AS Financial Statements, for each segregated fund of the linked businesses and these shall be annexed with Ind AS Financial Statements.

(2) Segregated funds represent funds maintained in accounts to meet specific investment objectives of policyholders who bear the investment risk. Investment income/gains and losses generally accrue directly to the policyholders. The assets of each account are segregated and are not subject to claims that arise out of any other business of the insurer.

9. Disclosures Forming Part of Ind AS Financial Statements[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 63 A. In respect of material accounting policies and judgements in applying Ind AS including methodologies and key assumptions, the following disclosures shall be made in the notes to accounts in accordance with the

requirements of the Ind AS:

(4) Level of aggregation

(5) Recognition

(22) All other applicable accounting policies and disclosures as required by Ind AS shall be disclosed.

B. The following information shall also be disclosed for Life insurance business by way of notes:

(1) Contingent Liabilities: i. Partly-paid up investments ii. Underwriting commitments outstanding iii. Claims, other than those under policies, not acknowledged as debts iv. Statutory demands/liabilities in dispute, not provided for v. Reinsurance Obligations to the extent not provided for in accounts vi. Others (to be specified).

(2) Encumbrances to assets of the company in and outside India.

(3) Commitments made and outstanding for Loans, Investments and Fixed Assets.

(4) Claims settled and remaining unpaid for a period of more than six months as on the Balance Sheet date.

(5) Value of contracts in relation to investments, for: i. Purchases where deliveries are pending; ii. Sales where payments are overdue.

(6) Computation of managerial remuneration.

(7) Historical costs of those investments valued on fair value basis.

(8) Basis of revaluation of investment property.

(9) Provisions made for policy cancellations during free look period in current year and previous year duly certified by the appointed actuary.

(10) Disclosure that contributions made by the shareholders to the Policyholders’ A/c are irreversible in nature, and shall not be recouped to the shareholders at any point of time in future with reference to[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 65 the general meeting of the insurer at which such prior approval of the shareholders has been obtained.

(11) Investments made in accordance with any statutory requirement should be disclosed separately together with its amount, nature, security and any special rights in and outside India.

(12) Segregation into performing/non-performing investments for purpose of income recognition as per the directions, if any, issued by the Competent Authority.

(13) Assets to the extent required to be deposited under local laws or otherwise encumbered in or outside India.

(14) Basis of amortisation of debt securities.

(15) Percentage of business sector wise.

(16) Bases of allocation of investments and income thereon between Policy-holders' Account and Share- holders' Account.

(17) Disclosure of policy and principles for provisioning for policy cancellations during free look period, based on assumptions and experience, duly certified by the appointed actuary.

(18) Unclaimed amount including related income – treatment and presentation.

(19) Any other information as may be specified.

C. The following information shall be disclosed for General insurance business, Health insurance business and Re-insurance business by way of notes -

(1) Contingent Liabilities: i. Partly-paid up investments ii. Underwriting commitments outstanding iii. Claims, other than those under policies, not acknowledged as debts iv. 10. General Instructions for Preparation of Ind AS Financial Statements

(1) The corresponding amounts for the immediate preceding financial year for all items shown in the Balance Sheet, Revenue Account, Profit and Loss Account and Receipts and Payments Account shall be given.

(2) The figures in the Ind AS Financial Statements may be rounded off to the nearest Lakhs.

(3) Interest, dividends and rentals receivable in connection with an investment should be stated at gross amount, the amount of income tax deducted at source should be included under "advance taxes paid" and taxes deducted at source.

(4) The company shall make provisions for damages under lawsuits where the management is of the opinion that the award may go against the insurer.

(5) Extent of risk retained and re-insured shall be separately disclosed.

(6) All insurers are required to maintain separate investment accounts for the shareholders and the policy holders and the income/ losses accrued / capital gains/losses on the investments is to be credited /debited to the Revenue Account/ Profit & Loss Account, as the case may be.

(7) Each item of the Ind AS Financial Statements shall be cross-referenced to any related information in the notes to accounts.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 67

(8) Ind AS Financial Statements shall disclose all 'material' items, i.e. the items which could, individually or collectively, influence the economic decisions that users make on the basis of the Ind AS Financial Statements.

11. Contents of Management Report:

Management report shall be attached to the Ind AS Financial Statements containing, inter alia, the following duly

authenticated by the management:

(1) Confirmation regarding the continued validity of the registration granted by the Authority.

(2) Certification that all the dues payable to the statutory authorities have been duly paid.

(3) Confirmation to the effect that the shareholding pattern and any transfer of shares during the year are in accordance with the statutory or regulatory requirements.

(4) Declaration that the management has not directly or indirectly invested outside India the funds of the holders of policies issued in India.

(5) Confirmation that the required solvency margins have been maintained.

(6) Certification to the effect that the values of all the assets have been reviewed on the date of the Balance Sheet and that in his (insurer's) belief the assets set forth in the Balance Sheet are shown in the aggregate at amounts not exceeding their realisable or market value.

(7) Certification to the effect that no part of the life insurance fund has been directly or indirectly applied in contravention of the provisions of the Insurance Act, 1938 (4 of 1938) relating to the application and investment of the life insurance funds.

(8) Disclosure with regard to the overall risk exposure and strategy adopted to mitigate the same.

(9) Operations in other countries, if any, with a separate statement giving the management's estimate of country risk and exposure risk and the hedging strategy adopted.

(10) Ageing of claims indicating the trends in average claim settlement time during the preceding five years.

(11) Certification to the effect as to how the values, as shown in the Balance Sheet, of the investments and stocks and shares have been arrived at, and how the market value thereof has been ascertained for the purpose of comparison with the values so shown.

(12) Review of asset quality and performance of investment in terms of portfolios, i.e., separately in terms of real estate, loans, investments, etc.

(13) A responsibility statement indicating therein that: i. in the preparation of Ind AS Financial Statements, the applicable Indian Accounting Standards, principles and policies have been followed along with proper explanations relating to material departures, if any;

ii. the management has adopted accounting policies and applied them consistently and made judgements and estimates that are reasonable and prudent so as to give a true and fair view of the state of affairs of the company at the end of the financial year and of the Profit or Loss under Revenue Account and of the Profit or Loss of the company for the year;

iii. the management has taken proper and sufficient care for the maintenance of adequate accounting records in accordance with the applicable provisions of the Insurance Act 193868 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (4 of 1938)/Companies Act, 2013, for safeguarding the assets of the company and for preventing and detecting fraud and other irregularities;

iv. the management has prepared the Ind AS Financial Statements on a going concern basis; v. the management has ensured that an internal audit system commensurate with the size and nature of the business exists and is operating effectively.

(14) A schedule of payments, which have been made to individuals, firms, companies and organizations in which Directors of the insurer are interested.

(15) Confirmation of compliance with domestic, statutory, regulatory and other laws in the countries in relation to subsidiaries, associates, joint ventures and other arrangements.

(16) Any other information as may be specified.

12. Preparation of Ind AS Financial Statements

(1) An insurer shall prepare the the Balance Sheet [Form Ind AS - BS] and the Statement of Changes in Equity [Form Ind AS - SOCE], Profit and Loss Account [Form Ind AS - P&L] and Revenue Account [Policy-holders' Account] [Form Ind AS - RA] in Forms as specified in this Part, or as near thereto as the circumstances permit.

(2) Insurer carrying on Life insurance business shall prepare the Ind AS Financial Statements and the

schedules therein for the under mentioned businesses separately: - i. Linked Business- (a) Life, (b) Pension, (c) Health, (d) Others ii. Non-Linked Business Participating- (a) Life, (b) Pension, (c) Health, (iv) Others iii. Non-Linked Business -Non-Participating- (a) Life, (b) Pension, (c) Health, (d) Others iv. Business within India and Business outside India.

v. Any other segment as may be specified.

(3) Insurer carrying on General insurance business or Health insurance business or Re-insurance business shall prepare the Ind AS Financial Statements and the schedules therein for the under

mentioned businesses separately:- i. Fire insurance business ii. Marine insurance business iii. Miscellaneous insurance business, separate Schedules shall be furnished for the following at

the minimum:

(a) Under Motor: sub-segments 1) Motor Own Damage and 2) Motor TP, (Insurers engaged exclusively in Reinsurance business may prepare the schedule at overall Motor level)

(b) Under Health: sub-segments 1) Health, 2) Personal Accident and 3) Travel,

(c) Workmen’s Compensation/ Employer’s liability,

(d) Public/ Product Liability,

(e) Engineering,

(h) Any other sub-segment contributing more than 10% of the total gross direct premium of the insurer shall be shown separately.

(4) Segments to be reported on the basis of line of business, and on the basis of business within and outside India. While giving the segment details of corresponding previous year’s figures should also be given for all the segments.

(5) An insurer shall prepare separate Receipts and Payments Account in accordance with the Direct Method provided under Ind AS 7 – “Ind AS Cash Flow Statement”.

Part II: AUDITOR'S REPORT

1. The report of the auditors on the Ind AS Financial Statements of every insurer shall deal with the matters

specified herein:

(1) That they have obtained all the information and explanations which, to the best of their knowledge and belief were necessary for the purposes of their audit and whether they have found them satisfactory;

(2) Whether proper books of account have been maintained by the insurer so far as appears from an examination of those books;

(3) Whether proper returns, audited or unaudited, from branches and other offices have been received and whether they were adequate for the purpose of audit;

(4) Whether the Balance Sheet, Statement of changes in equity, Profit and Loss account, Receipts and Payments account and Revenue account dealt with by the report are in agreement with the books of account and returns;

2. The auditors shall express their opinion on the Ind AS Financial Statements of every insurer:

(1) Whether the Balance Sheet gives a true and fair view of the insurer's affairs as at the end of the financial year/period;

(2) Whether the Statement of changes in equity gives a true and fair view of the insurer's affairs as at the end of the financial year/period

(3) Whether the Profit and Loss account gives a true and fair view of the profit or loss for the financial year/period;

(4) Whether the Receipts and Payments account gives a true and fair view of the receipts and payments for the financial year/period;

(5) Whether the Revenue Account gives a true and fair view of the Profit/Loss under Revenue Account for the financial year/period;

(6) The Ind AS Financial Statements stated at (1) to (5) above are prepared in accordance with the requirements of the Insurance Act, 1938 (4 of 1938), the Insurance Regulatory and Development[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 119 Authority Act, 1999 (41 of 1999) and the Companies Act, 2013, to the extent applicable and in the manner so required.

(7) Investments have been valued in accordance with the provisions of the Act and these regulations.

(8) The accounting policies selected by the insurer are appropriate and are in compliance with the applicable Ind AS and with the accounting principles, as specified in these regulations or any order or direction issued in this behalf.

3. The auditors shall further certify that:

(1) they have reviewed the management report and there is no apparent mistake or material inconsistencies with the Ind AS Financial Statements;

(2) the insurer has complied with the terms and conditions of the registration stipulated by the Authority.

4. A certificate signed by the auditors [which shall be in addition to any other certificate or report which is required by law to be given with respect to the Balance Sheet] certifying that-

(1) they have verified the cash balances and the securities relating to the insurer's loans, reversions and life interests (in the case of life insurers) and investments;

(2) to what extent, if any, they have verified the investments and transactions relating to any trusts undertaken by the insurer as trustee; and

(3) no part of the assets of the policyholders' funds has been directly or indirectly applied in contravention of the provisions of the Insurance Act, 1938 (4 of 1938) relating to the application and investments of the policyholders' funds.” A.
