102) की धारा 33 और राष्ट्रीय आयुर्विज्ञान आयोग की धारा 61 (2) द्वारा प्रित्त िजियों का इस्ट्तेमाल करते हुए, राष्ट्रीय आयुर्विज्ञान आयोग, ‘मेजडकल कॉलेि की स्ट्थापना जवजनयमन, 1999’ को पनु ः संिोजधत करन े के जलए जनम्नजलजखत जवजनयम बनाता ह,ै नामत:

1. (i) इन जवजनयमों को मेजडकल कॉलेि की स्ट्थापना जवजनयमन (संिोधन), 2022 कहा िाएगा।

(ii) ये रािपत्र में उनके प्रकािन की तारीख स ेप्रवृत्त होंगे।

2. ‘अहकि मापिंड’ िीषिक के अंतगति खंड 2 (5क) में जनम्नजलजखत को िोड़ा िाएगा:- जवश्वजवद्यालय अनुिान आयोग अजधजनयम, 1956 के अथ ि के भीतर जवश्वजवद्यालयों अथवा माजनत जवश्वजवद्यालयों, जिनके पास भारत म ें कहीं भी पूणितः कायाित्मक मान्यताप्राप्त मेजडकल कॉलेिों एवं 1000 या उससे अजधक जबस्ट्तरों वाल े अस्ट्पताल की स्ट्थापना करन े और उन्ह ें कम से कम िो वषों तक चलाने का अनुभव है, के मामल े में कम से कम िो वषों की अवजध के जलए पणू ति ः कायाित्मक अस्ट्पताल की ित ि लागू नहीं होगी, बित े दक :-

(i) अस्ट्पताल और मेजडकल कॉलेि िोनों के भवन का स्ट्वाजमत्व और प्रबंधन उसी संगठन का हो।

(ii) नए मेजडकल कॉलेिों की स्ट्थापना के जलए राष्ट्रीय आयुर्विज्ञान आयोग के ( एनएमसी) जचदकत्सा मूल्यांकन एव ं रेट ंग बोड ि पूव ि स े करन े आवेिन को (एमएआरबी) प्रस्ट्ताजवत मेजडकल कॉलेि के भवन का उपयोग दकसी अन्य प्रयोिन के जलए नहीं दकया गया हो, और 8339 GI/2022 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(iii) आवेिन के समय सगं ठन के पास कम से कम 1000 रोगी जबस्ट्तरों वाला बहु–जविेषज्ञता अस्ट्पताल स्ट्थाजपत हो तथा मेजडकल कॉलेि की स्ट्थापना, जवजनयमन 1999 के अतं गित अन्य सभी मापिडं ों को पूरा करता होना चाजहए। डॉ. सध्ं या भुल्लर, सजचव [जवज्ञापन-III/4/असा./478/2022-23] र प्पणी : प्रधान जवजनयमावली, नामत: ‘मेजडकल कॉलेि की स्ट्थापना जवजनयमन, 1999’, जिस े 28 अगस्ट्त, 1999 को भारत के रािपत्र के भाग III, खंड 4 म ें भारतीय आयुर्विज्ञान पररषि ् की अजधसूचना संख्या 34(41)/98-मडे .

के अंतगित प्रकाजित दकया गया था और इसे दिनांक 22.10.1999, 01.08.2008, 26.08.2009,

22.10.2009, 13.11.2009, 02.02.2010, 26.02.2010, 16.04.2010, 14.10.2011, 04.06.2012,

01.10.2012, 19.03.2014, 22.08.2014, 19.10.2015, 14.01.2016, 01.02.2016, 08.02.2016,

31.01.2017, 01.06.2017, 03.07.2017, 05.02.2019, 14.05.2019, 27.06.2019 और

28.10.2020 की अजधसूचना के अंतगित संिोजधत दकया गया था। NATIONAL MEDICAL COMMISSION AMENDMENT NOTIFICATION New Delhi, the 13th December, 2022 F. No. U-11022/4/2022-UGMEB.—In exercise of the powers conferred by Section 10(A) read with Section 33 of the Indian Medical Council Act, 1956 (102 of 1956), and section 61(2) of the National Medical Commission Act, 2019, the National Medical Commission hereby makes the following Regulations to further amend the “Establishment of Medical College Regulations, 1999” namely: -

1. (i) These Regulations may be called the “Establishment of Medical College Regulations,

(Amendment), 2022.

(ii) They shall come into force from the date of their publication in the Official Gazette.

2. In clause 2(5A), under the heading “QUALIFYING CRITERIA”, the following shall be added:- The condition of ‘fully functional hospital for a minimum period of 2 years’ shall not apply in case of Universities or deemed to be universities within the meaning of University Grants Commission Act, 1956, having experience of establishing and running fully functional recognized medical colleges and hospital of 1000 beds or more, for at least two years, anywhere in India, provided that:-

(i) The building of both the hospital and the medical college is owned and managed by the same organization.

(ii) The building of the proposed medical college has not been used for any other purpose before making an application to the Medical Assessment and Rating Board (MARB) of National Medical Commission (NMC) for establishment of new medical colleges, and

(iii) At the time of application, the said medical college has an established multi-specialty hospital with at least 1000 in-patient beds and fulfilling all other norms under the regulation.
