30) की धारा 27(1)(ख) के साथ पठित धारा 10(1)(ख) और (ि), 16(2), 57(2) (यघ), (यि) द्वारा प्रित्त िजियों का प्रयोग करत े हुए, राष्ट्रीय आयुर्विज्ञान आयोग "राष्ट्रीय आयुर्वज्ञि ान आयोग एति द्वारा पंिीकृत मेजडकल प्रैजटििनर (पिे ेवर आिरण) जवजनयम, 2023" को और संिोजधत करने के जलए जनम्नजलजखत जवजनयम बनाता ह:ै -

1. इन जवजनयमों को "राष्ट्रीय आयर्ु विज्ञान आयोग पंिीकृत मेजडकल प्रैजटििनर (पेिेवर आिरण) (संिोधन) जवजनयम, 2023" कहा िाएगा।

2. ये जवजनयम आजधकाठरक रािपत्र म ें उनके प्रकािन की तारीख से प्रवृत होंगे।

3. राष्ट्रीय आयुर्विज्ञान आयोग पिं ीकृत मेजडकल प्रैजटििनर (पिे ेवर आिरण) जवजनयम, 2023 को तत्काल प्रभाव स े स्ट्थजगत रखा िाता ह।ै 5451 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

4. िंका को िरू करने के जलए, यह स्ट्पष्ट ककया िाता ह ै कक राष्ट्रीय आयुर्विज्ञान आयोग पंिीकृत मेजडकल प्रैजटििनर (पेिेवर आिरण) जवजनयम, 2023, राष्ट्रीय आयुर्विज्ञान आयोग द्वारा इस जवषय पर अगली रािपत्र अजधसूिना िारी होने तक प्रिालनात्मक और प्रभावी नहीं होगा।

5. कक राष्ट्रीय आयुर्विज्ञान आयोग इसके द्वारा "भारतीय जिककत्सा पठरषि (पेिेवर आिरण, जिष्टािार और नैजतकता) जवजनयम, 2002" को तत्काल प्रभाव स े अगं ीकर करता ह ै और प्रभावी बनाता ह,ै िैसे कक राष्ट्रीय आयुर्विज्ञान आयोग अजधजनयम,2019 (2019 का अजधजनयम संख्या 30) के अधीन जनजहत िजियों के अनरूु प इसे बनाया गया हो।

6. कक िंकाओं को िरू करने के जलए यह स्ट्पष्ट ककया िाता ह ै कक भारतीय जिककत्सा पठरषि (पेिेवर आिरण, जिष्टािार और नैजतकता) जवजनयम,2002 तत्काल प्रभाव स े प्रवृत होंगे। डॉ. जवपलु अग्रवाल, सजिव [जवज्ञापन III/4/असा./378/2023-24] ठिप्पणी : ये जवजनयम अग्रं ेिी और हहिं ी म ें प्रकाजित ककय े िा रह े ह,ैं इन जवजनयम की व्याख्या के मामले म ें कोई िंका होन े की जस्ट्थजत म ेंअग्रं ेिी संकरण मान्य होगा । NATIONAL MEDICAL COMMISSION (Ethics and Medical Registration Board)

NOTIFICATION New Delhi, the 23rd August, 2023 No. R-12013/01/2022/Ethics.— In exercise of the powers conferred by Section 27(1)(b), read with Sections 10(1)(b) & (f), 16(2), 57(2) (zd), (zh), (zi) and (zl), of the National Medical Commission Act, 2019, (Act No. 30 of

2019), the National Medical Commission hereby makes the following Regulations to further amend the “National Medical Commission Registered Medical Practitioner (Professional Conduct) Regulations, 2023” namely:

1. These Regulations may be called the “National Medical Commission Registered Medical Practitioners (Professional Conduct) (Amendment) Regulations, 2023”.

2. These Regulations shall come into force from the date of their publication in the Official Gazette.

3. That National Medical Commission Registered Medical Practitioner (Professional Conduct) Regulations, 2023, are hereby held in abeyance with immediate effect.

4. That for removal of doubts, it is clarified that the National Medical Commission Registered Medical Practitioner (Professional Conduct) Regulations, 2023, shall not be operative and effective till further Gazette

Notification on the subject by the National Medical Commission.

5. That the National Medical Commission hereby adopts and makes effective with immediate effect the “Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002”, as if the same have been made by the Commission by virtue of the powers vested under the National Medical Commission Act, 2019 (Act No. 30 of 2019).

6. That for removal of doubts, it is clarified that Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002, shall come into force with immediate effect.
