1. इि जिजियमों को भारतीय प्रजतभूजत और जिजिमय बोडड (अजभरक्षक) (संिोधि) जिजियम, 2026 कहा िा सकेगा ।

2. य े जिजियम 1 अिूबर, 2026 को लाग ू होंग े।

3. भारतीय प्रजतभूजत और जिजिमय बोडड (अजभरक्षक) जिजियम, 1996 म,ें -

(I) जिजियम 9(घ) म,ें िब्दों तर्ा अक्षरों “यह जद्वतीय अि सूची के भाग क में जिजिर्ददष्ट िार्षिक फीस का संदाय उसके भाग ख म ें जिजिर्ददष्ट रीजत से करेगा” के स्ट्र्ाि पर िब्द, जचह्ि तर्ा अक्षर “िह दसू री अि सूची के भाग-क म ें बताई गई माजसक फीस उसी तरह अदा करेगा, िैसा उस अि सूची के भाग-ख म ें बताया गया ह”ै आ िाएंगे।

(III) दसू री अि सूची म,ें

(i) भाग-क में, खंड (iii) में, िब्दों, अंकों तर्ा जचह्िों “िार्षिक फीस रु.10,00,000/- या अजभरक्षक (कस्ट्टोजडयि) की ‘अजभरक्षा के अधीि आजस्ट्तयों’ का 0.0005%, िो भी उच्चतर हो” के स्ट्र्ाि पर िब्द, अंक तर्ा जचह्ि “माजसक फीस रु.85,000 या कस्ट्टोजडयि की कस्ट्टडी में िो भी असेट्स हों, उिका (‘असेट्स अंडर कस्ट्टडी’ / अजभरक्षा के अधीि आजस्ट्तयों का)

0.0000416%, (इिम ेंसे िो भी ज्यादा हो)” आ िाएंगे ।

(ii) भाग-ख में, खडं (II) में, क) िब्द “िार्षिक फीस का भ गताि” के स्ट्र्ाि पर िब्द “माजसक फीस का भ गताि” आ िाएगा । ख) उप-खंड (1) के स्ट्र्ाि पर जिम्नजलजखत उप-खंड आ िाएगा, अर्ाडत्,- “(1) भारतीय प्रजतभूजत और जिजिमय बोडड (अजभरक्षक) (सिं ोधि) जिजियम, 2026 के लागू होिे की तारीख से ही, हर महीिे की माजसक फीस उस महीिे के समाप्त होिे की तारीख से 15 ददिों के भीतर, अदा करिी होगी ।” ग) उप-खंड (2) के स्ट्र्ाि पर जिम्नजलजखत उप-खंड आ िाएगा, अर्ाडत्,- “(2) जिस कस्ट्टोजडयि (अजभरक्षक) को भारतीय प्रजतभूजत और जिजिमय बोड ड (अजभरक्षक) (संिोधि) जिजियम, 2026 के लाग ू होि े की तारीख को और उसके बाद रजिस्ट्रेिि प्रदाि दकया िाए, िह जिस महीिे में उसे रजिस्ट्रेिि प्रदाि िाए उस महीिे की माजसक फीस आि पाजतक आधार पर अदा करेगा और उसके बाद जिस महीिे तक िह रजिस्ट्टर रह ेउस हर महीि े की परू ी माजसक फीस अदा करता रहगे ा ।” घ) उप-खंड (3) के स्ट्र्ाि पर जिम्नजलजखत उप-खंड आ िाएगा, अर्ाडत्,- “(3) जिस कस्ट्टोजडयि को भारतीय प्रजतभूजत और जिजिमय बोड ड (अजभरक्षक) (संिोधि) जिजियम, 2026 के लाग ू होिे की तारीख से पहले रजिस्ट्रेिि प्रदाि दकया िा च का हो, िह इस जित्तीय ििड की िार्षिक फीस आि पाजतक आधार पर अदा करेगा और उसके बाद जिस महीिे तक िह रजिस्ट्टर रह े उस हर महीिे की पूरी माजसक फीस अदा करता रहगे ा । इस तरह से आि पाजतक आधार पर अदा की िािे िाली िार्षिक फीस भारतीय प्रजतभूजत और जिजिमय बोड ड (अजभरक्षक) (संिोधि) जिजियम, 2026 के लाग ूहोि े की तारीख स े15 ददिों के भीतर अदा करिी होगी:

परंत यह दक यदद दकसी कस्ट्टोजडयि द्वारा भारतीय प्रजतभूजत और जिजिमय बोडड (अजभरक्षक) (संिोधि) जिजियम, 2026 के लागू होिे की तारीख से पहले कोई िार्षिक फीस उस अिजध की अदा कर दी गई हो, जिसके सभी ददि या क छ ददि इि संिोधि जिजियमों के लाग ू होि े की तारीख से बाद िाली अिजध के हों, तो ऐस े म ें इस प्रकार अदा की िा च की फीस की िह रकम इस उप-खंड के तहत अदा की िाि े िाली फीस की रकम में स ेघटा दी िाएगी ।” ³½ उप-खंड (4) में, िब्दों तर्ा जचह्िों “िार्षिक फीस के भ गताि के सार् अजभरक्षा के अधीि आजस्ट्तयों का जििरण संलग्न होगा िो ऐसे फामेट में होगा िो बोडड द्वारा जिजिर्ददष्ट दकया िाए और जिसकी सत्यता तर्ा पणू डता अजभरक्षक (कस्ट्टोजडयि) की अजभरक्षा सेिाओं के कायाडत्मक प्रम ख द्वारा प्रमाजणत की िाएगी” के स्ट्र्ाि पर िब्द तर्ा जचह्ि “माजसक फीस अदा करते समय बोडड द्वारा यर्ा जिधाडररत फॉमेट म ें उि असेट्स का जििरण भी प्रस्ट्त त करिा होगा िो कस्ट्टोजडयि की कस्ट्टडी म ें हों ('असेट्स अंडर कस्ट्टडी' / अजभरक्षक के अधीि आजस्ट्तयों का जििरण प्रस्ट्त त करिा होगा) और कस्ट्टोजडयि के कस्ट्टडी सर्षिसेज़ के फंक्ििल हडे (कस्ट्टडी से ि ड़ी सेिाओं के प्रभारी) द्वारा यह प्रमाजणत दकया िाएगा दक उसम ें दी गई िािकारी सही ह ै और परू ी िािकारी दी गई ह”ै आ िाएगं े । अजमत प्रधाि, कायडपालक जिदेिक [जिज्ञापि-III/4/असा./204/2026-27][भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 रटप्पणी :

NOTIFICATION Mumbai, the 3rd July, 2026 SECURITIES AND EXCHANGE BOARD OF INDIA (CUSTODIAN) (AMENDMENT) REGULATIONS, 2026 No.SEBI/LAD-NRO/GN/2026/308.— In exercise of the powers conferred by section 30 of the Securities and Exchange Board of India Act, 1992 (15 of 1992), the Board hereby makes the following regulations to further amend the Securities and Exchange Board of India (Custodian) Regulations, 1996, namely –

1. These Regulations may be called the Securities and Exchange Board of India (Custodian) (Amendment) Regulations, 2026

2. They shall come into force on October 1, 2026.

3. In the Securities and Exchange Board of India (Custodian) Regulations, 1996, – I. In regulation 9(d), the word “annual” shall be substituted with the word “monthly”.

II. In regulation 26(i), the word “annual” shall be substituted with the word “monthly”.

III. In the Second Schedule,

(i) In Part A, in clause (iii), the words and symbols “Annual fee Rs. 10,00,000 or 0.0005” shall be substituted with the words and symbols “Monthly fee Rs. 85,000 or 0.0000416”.

(ii) In Part B, in clause (II), a) the words and symbol “Payment of annual fee.” shall be substituted with the words “Payment of monthly fee”. b) sub-clause (1) shall be substituted with the following, namely, - “(1) On and from the commencement of the Securities and Exchange Board of India

(Custodian) (Amendment) Regulations, 2026, the monthly fee shall be payable with reference to each month, within 15 days of completion of the month.” c) sub-clause (2) shall be substituted with the following, namely, - “(2) A custodian who is granted registration on and after the commencement of the Securities and Exchange Board of India (Custodian) (Amendment) Regulations, 2026, shall pay proportionate monthly fee in respect of the month in which he was granted4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] registration and full monthly fee for every subsequent month during which the registration subsists.” d) sub-clause (3) shall be substituted with the following, namely, - “(3) A custodian who is granted registration before the commencement of the Securities and Exchange Board of India (Custodian) (Amendment) Regulations, 2026, shall pay proportionate annual fee in respect of the financial year of such commencement and full monthly fee for every subsequent month during which the registration subsists. Such proportionate annual fee shall be payable within 15 days of the commencement of the Securities and Exchange Board of India (Custodian) (Amendment) Regulations, 2026:

Provided that any annual fee paid by a custodian before the commencement of the Securities and Exchange Board of India (Custodian) (Amendment) Regulations, 2026, in respect of a period, the whole or part of which falls after such commencement, shall be proportionately adjusted against the amount payable under this sub-clause.” e) in sub-clause (4), the word “annual” shall be substituted with the word “monthly”.
