1. सजं क्षप्त िीर्ाक और प्रारंभ - (1) आन जर्वजनयमों को अयुर्वेद जिक्षण और ऄनुसंधान संस्ट्थान जर्वजनयम, 2021 कहा जाएगा।

(2) ये जनयम सरकारी राजपत्र में आनके प्रकािन की तारीख से प्रर्वृत्त होंगे।

2. पररभार्ाएं - आन जर्वजनयमों में जब तक दक संदभा से ऄन्यथा ऄपेजक्षत न हो - (क) "ऄजधजनयम" से अयुर्वेद जिक्षण और ऄनुसंधान संस्ट्थान ऄजधजनयम, 2020 (2020 का 16) ऄजभप्रेत ह;ै (ख) “ईपजनदिे क" से धारा (11) की ईपधारा (4) के ऄधीन जनयुि श्री गुलाबकुंर्वरबा जर्वश्वजर्वद्यालय के ईपजनदिे क (स्नातक पूर्वा), भारतीय अयुर्वेददक और्जध जर्वज्ञान संस्ट्थान के ईपजनदिे क (फामेसी) ऄजभप्रेत ह ै और "ईपजनदिे क (स्नातकोत्तर)" से धारा

(11) की ईपधारा (4) के ऄधीन जनयुि संस्ट्थान के ईपजनदिे क (प्रिासन) ऄजभप्रेत है; (ग) "मौजलक जनयमों (एफअर)" से र्वे मौजलक जनयम ऄजभप्रेत ह ैंजो केंद्र सरकार के कमाचाररयों पर लागू होते हैं; (घ) "सामान्य जर्वत्तीय जनयमों (जीएफअर)" से सामान्य जर्वत्तीय जनयम, 1963 ऄजभप्रेत ह ैं और जो समय-समय पर केंद्र सरकार द्वारा जर्वत्तीय प्रबंधन और जनयंत्रण के जलए जनर्ममत दकए गए हैं;

(ङ) "ऄध्यक्ष" से (8) की ईप-धारा (1) के ऄधीन केंद्र सरकार द्वारा नाजमत संस्ट्थान का ऄध्यक्ष ऄजभप्रेत है; (च) "जनयमों" से धारा 27 के तहत बनाए गए जनयम ऄजभप्रेत हैं;

238 GI/2022 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (छ) "ऄनुसूची" से आन जर्वजनयमों की ऄनुसूची ऄजभप्रेत ह;ै (ज) "धारा" से ऄजधजनयम की कोइ धारा ऄजभप्रेत है; (झ) "स्ट्थायी" और "तदथा" सजमजत से धारा (10) की ईप-धारा (5) के तहत गरठत संबंजधत स्ट्थायी और तदथा सजमजतया ं ऄजभप्रेत ह;ै (ञ) "ऄनुपूरक जनयमों" से ईन सरकारी कमाचाररयों पर लागू ऄनुपूरक जनयम ऄजभप्रेत ह ैं जो मौजलक जनयमों (एफअर) के ऄध्यधीन ह;ैं (ट) "कोर्गार जनयमों" से केंद्र सरकार के कोर्ागार जनयम ऄजभप्रेत हैं;

(ठ) जो िब्द और पद आन जर्वजनयमों में प्रयुि हुए ह ैं और पररभाजर्त नहीं ह ैं ककतु ऄजधजनयम में पररभाजर्त ह ैं ईनका ऄजभप्राय ऄजधजनयम में ईनके जलए जनयत सबं ंजधत ऄथा से ह।ै

3. िासी जनकाय का गठन - िासी जनकाय में जनम्नजलजखत सदस्ट्य होंगे। अयुर्वेद जिक्षण और ऄनुसंधान संस्ट्थान (अइटीअरए) - िासी जनकाय में जनम्नजलजखत सदस्ट्य होंगे, ऄथाात;

1 संस्ट्थान के ऄध्यक्ष पदने - ऄध्यक्ष 2 राज्य मंत्री, अयुर् मंत्रालय पदने - ईपाध्यक्ष 3 सजचर्व, भारत सरकार, अयुर् मंत्रालय पदने - सदस्ट्य ऄपर सजचर्व और जर्वत्तीय सलाहकार, एकीकृत जर्वत्त प्रभाग, भारत सरकार या 4 पदने - सदस्ट्य ईनके प्रजतजनजध, स्ट्र्वास्ट््य एर्वं पररर्वार कल्याण मंत्रालय संस्ट्थान के मामलों को दखे रह े जर्विेर् सजचर्व/ऄपर सजचर्व/संयुि सजचर्व, अयुर् पदने - सदस्ट्य 5 मंत्रालय, भारत सरकार 6 सलाहकार (अयुर्वेद), भारत सरकार, अयुर् मंत्रालय पदने - सदस्ट्य महाजनदिे क, केन्द्रीय अयुर्वेदीय जर्वज्ञान ऄनुसंधान पररर्द, अयुर् मंत्रालय, भारत पदने - सदस्ट्य 7 सरकार जनदिे क, मोरारजी दसे ाइ योग एर्वं प्राकृजतक जचदकत्सा संस्ट्थान, अयुर् मंत्रालय, पदने - सदस्ट्य 8 भारत सरकार 9 ऄध्यक्ष द्वारा संस्ट्थान के डीन्स में से मनोनीत दो सदस्ट्य पदने - सदस्ट्य 10 संस्ट्थान के ऄध्यक्ष द्वारा अयुर्वेद के प्रजतजित जिक्षाजर्वदों में से मनोनीत दो सदस्ट्य सदस्ट्य 11 संस्ट्थान के जनदिे क सदस्ट्य – सजचर्व

4. िासी जनकाय के ऄध्यक्ष की िजिया ंऔर काय-ा िासी जनकाय के ऄध्यक्ष के पास जनम्नजलजखत िजियां और काया होंगे:- (क) दकसी भी समय िासी जनकाय की बैठकें बुलाना और ऐसा जब करेगा यदद बुलाए जाने र्वाली प्रस्ट्ताजर्वत बैठक के जर्वर्य को जनर्ददष्ट करने र्वाले कम से कम 50 प्रजतित सदस्ट्य ईस ईद्देश्य के जलए कोइ मांग जलजखत रूप में ईसके समक्ष प्रस्ट्तुत करेंगे;

(ख) िासी जनकाय की बैठकों की ऄध्यक्षता करना और एजेंडा मदों को ईजचत रूप से प्रस्ट्तुत करना; दकसी मीटटग से पहले या ईसके दौरान दकसी भी समय एजेंडे में जनम्नजलजखत िाजमल कर सकता है–

(i) कारोबार की नइ मदें; और

(ii) एजेंडे में िाजमल मदों के जलए ऄनुपूरक मदें, और ऐसी मदों को बैठक में जर्वचार के जलए जलया जाएगा; (ग) यह सुजनजित करना दक िासी जनकाय के मामलों को कानून के ऄनुसार संचाजलत दकया जाता है; (घ) यह सुजनजित करना दक िासी जनकाय के जनणायों को लागू दकया जाता है;

(ङ) िासी जनकाय द्वारा प्रत्यायोजजत कताव्यों को पूरा करना; (च) संस्ट्थान के जलए पयााप्त जर्वत्तीय संसाधनों की ईपलब्धता सुजनजित करना; (छ) अर्वश्यक मामले में िासी जनकाय की िजियों का प्रयोग करना और िासी जनकाय की ओर से ऐसे मामलों में की गइ दकसी भी कारार्वाइ की ररपोटा िासी जनकाय की ऄगली बैठक में ऄनुमोदन हेतु प्रस्ट्तुत करना।[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 3

5. िासी जनकाय की िजिया ंऔर काय ा- िासी जनकाय के पास जनम्नजलजखत िजियां और काया होंगे:- (क) संस्ट्थान के मामलों पर सामान्य जनयंत्रण रखेगा और संस्ट्थान के ईद्देश्यों के ऄनुरूप आसके कृत्यों और कायों के जनष्पादन म ें समस्ट्त िजियों का प्रयोग करने का ऄजधकार होगा;

(ख) संस्ट्थान के ऄकादजमक, ऄनुसंधान काया और ऄन्य कायों के जलए ऄकादजमक पररर्द की सलाह पर, प्रभागों और जर्वभागों की स्ट्थापना करना और ईन्ह ेंऄध्ययन, जिक्षण और ऄनुसंधान के क्षेत्रों का अर्वंटन करना; (ग) आस तरह की जिक्षा, प्रजिक्षण और ऄनुसंधान के ऄंतरराष्ट्रीय मानकों को बनाए रखने के जलए जचदकत्सा जिक्षा क्षेत्र में नइ जर्वजधयों और प्रौद्योजगदकयों में ऄजभनर्व प्रयोगों का संचालन करना;

(घ) जिक्षण और गैर-जिक्षण पदों का सृजन करना, संबंजधत सांजर्वजधक जनकाय द्वारा ऄनुमोददत ईनकी संख्या, संर्वगों और योग्यताओं का जनधाारण करना तथा जर्वत्त सजमजत के परामिा से और भारत सरकार के ऄनुमोदन से ऐसे पदों की पररलजब्धयों का जनधाारण करना;

(ङ) चयन सजमजत की जसफाररि पर जैसा अर्वश्यक हो प्राध्यापकों, सह प्राध्यापकों, सहायक प्राध्यापकों और ऄन्य ऄकादजमक और गैर- ऄकादजमक कमाचाररयों की जनयुजि करना, और जनयुजि प्राजधकारी की िजि का प्रयोग ऄनुसूची-1 के ऄनुसार दकया जाएगा;

(च) िैक्षजणक पररर्द के परामिा से संस्ट्थान के प्राध्यापकों, सह प्राध्यापकों और सहायक प्राध्यापकों और ऄन्य ऄकादजमक कमाचाररयों के कताव्यों और सेर्वा ितों को जनधााररत करना; (छ) ऄभ्यागत ऄध्येता और ऄभ्यागत प्राध्यापक की जनयुजि के जलए ईपबंध करना;

(ज) जिक्षण, ऄकादजमक, तकनीकी, प्रिासजनक और ऄन्य कमाचाररयों के जहताथा यथोजचत पेंिन, बीमा, भजर्वष्य जनजध और ईपदान संस्ट्थाजपत करना और सघं , संस्ट्थाओं, कोर्ों, न्याजसयों की स्ट्थापना में मदद तथा समथान दने ा तथा संस्ट्थान के कमाचाररयों और छात्रों के लाभाथा हस्ट्तांतरणों की व्यर्वस्ट्था करना;

(झ) संस्ट्थान के कमाचाररयों के बीच ऄनुिासन जर्वजनयजमत और लागू करना और जहां भी अर्वश्यक हो, ईजचत ऄनुिासनात्मक कारार्वाइ करना; (ञ) संस्ट्थान के कमाचाररयों और छात्रों की जिकायतों को प्राप्त करना और ईन पर न्याय जनणाय लेना और ठीक समझे जाने पर ईन्ह ेंदरू करना;

(ट) जनदिे क को ऄनुपजस्ट्थजत ऄर्वकाि प्रदान करना और ऄनुपजस्ट्थजत की ऄर्वजध के दौरान ईसके कायों को करने के जलए अर्वश्यक व्यर्वस्ट्थाएं करना; (ठ) परीक्षाओं और जनरीक्षणों के पररणामों के अधार पर ईपाजधयां, जडप्लोमा और प्रमाण पत्र प्रदान करने की मंजूरी दने ा और ईपाजधया,ं जडप्लोमा, प्रमाण पत्र और ऄन्य ऄकादजमक ईपाजधयां और जर्विेर् योग्ताएं प्रदान करना;

(ड) ऄकादजमक पररर्द और जर्वत्त सजमजत के परामिा से परीक्षकों, मयाादकों, सारणीकारों और परीक्षाओं के जलए जनयुि ऐसे ऄन्य कार्ममकों की पररलजब्धयों और यात्रा तथा ऄन्य भत्तों को जनयत करना; (ढ) आस ईद्देश्य के जलए बनाए जाने र्वाले जनयमों के ऄनुसार यात्रा ऄध्येतार्वृजत्त, जिक्षार्वृजत्त, छात्रर्वृजत्त, र्वजीफे, पदक और पुरस्ट्कार सजहत ऄजतजथर्वृजत्त, मानद प्राध्याजपकी, ऄध्येतार्वृजत्त प्रदान करना;

(ण) संस्ट्थान की ओर से दकसी भी ऄचल संपजत्त के ऄजधग्रहण, प्रबंधन और जनपटान से संबंजधत मामलों पर धृजत न्यासी(यदद कोइ हो) को सलाह दने ा; (त) ऐसी भूजम या भर्वन या काया, जो संस्ट्थान के प्रयोजनाथा अर्वश्यक या सुजर्वधाजनक हो, को ऐसे जनयमों और ितों पर, जजन्ह ें र्वह ठीक और ईजचत समझे, खरीदना, पट्टे पर लेना या ईपहार के रूप में या ऄन्यथा स्ट्र्वीकार करना और ऐसे भर्वन या काया का जनमााण करना या ईसमें बदलार्व करना और ईसका रखरखार्व करना;

(थ) संस्ट्थान की ओर से दकसी भी चल संपजत्त का हस्ट्तांतरण करना या हस्ट्तांतरण को स्ट्र्वीकार करना; (द) धृजत न्याजसयों, यदद कोइ हो, के परामिा से संस्ट्थान से संबंजधत या संस्ट्थान के प्रयोजनों के जलए प्राप्त की जाने र्वाली चल या ऄचल संपजत्त के हस्ट्तांतरण, सरकारी प्रजतभूजतयों के हस्ट्तांतरण, पुनः हस्ट्तांतरण, बंधक, पट्टों, बांडों, ऄनुज्ञजप्तयों और समझौतों का जनष्पादन करना;

(ध) संस्ट्थान के ईद्देश्यों को प्राप्त करने हेतु ईद्देश्यों के प्रार्वधानों के ऄनुरूप जनजधयों के जलए ऄपील जारी करना, ऄनुदान, दान, ऄंिदान, ईपहार, पुरस्ट्कार, छात्रर्वृजत्त, िुल्क और ऄन्य धन प्राप्त करना, ऄनुदान और दान दने ा, पुरस्ट्कार, छात्रर्वृजत्त, अदद प्रदान करना;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (न) धृजत न्याजसयों (यदद कोइ हो) के साथ परामिा करके बांडों, बंधक, र्वचन-पत्रों या ऄन्य दाजयत्र्वों या संस्ट्थान की दकसी भी संपजत्त और पररसंपजत्तयों के अधार पर, या दकसी भी प्रजतभूजत के अधार पर, ऐसे जनयमों और ितों पर, जैसा दक ईजचत समझा जाए, धन जुटाना और ईधार लेना तथा संस्ट्थान के धन से, धन जुटाने से प्रासंजगक समस्ट्त व्यय का भुगतान करना और ईधार जलए गए धन का र्वापस भुगतान और मोचन करना;

(प) छूट अकर्मर्त, स्ट्र्वीकार तथा प्रदान करना और ईसका समथान करेगा तथा भारत सरकार के और ऄन्य के र्वचन-पत्रों, जर्वजनमय जबलों, चेक या ऄन्य परक्राम्य जबलेखों का परक्रामण करना; (फ) एक कोर् बनाना जजसमें जनम्नजलजखत धन जमा दकया जाएगा - i. केंद्र सरकार या राज्य सरकार या संघ राज्य क्षेत्र सरकार द्वारा प्रदान दकया गया समस्ट्त धन;

ii. संस्ट्थान द्वारा प्राप्त सभी िुल्क और ऄन्य प्रभार; iii. ऄनुदान, ईपहार, दान, परोपकार, र्वसीयत या हस्ट्तांतरण के रूप में संस्ट्थान द्वारा प्राप्त समस्ट्त धन; और iv. संस्ट्थान द्वारा दकसी ऄन्य तरीके से या दकसी ऄन्य स्रोत से प्राप्त समस्ट्त धन;

(ब) दकसी एक या ऄजधक ऄनुसूजचत बकैं ों में संस्ट्थान का खाता या खाते खोलना और आसे संचाजलत करने की प्रदक्रया जनधााररत करना; (भ) कोर्ों में जमा समस्ट्त धन ऄनुसूजचत बैंकों में जमा करना या जर्वत्त सजमजत के परामिा से ईसका जनर्वेि करना;

(म) संस्ट्थान के कोर् या संस्ट्थान को सौंपे गए या ऐसी प्रजतभूजतयों के धन को आस तरह से, जैसा दक र्वह ईजचत समझे, जनर्वेि करना और समय-समय पर दकसी भी जनर्वेि का पक्षांतरण करना; (य) ईजचत खाते और ऄन्य प्रासजं गक ऄजभलेख रखना और हर जपछले जर्वत्तीय र्वर्ा के तुलन-पत्र सजहत र्वार्मर्क लेखा जर्वर्वरणों को जनयमों द्वारा जर्वजहत तरीके से तैयार करना;

(यक) संस्ट्थान के राजस्ट्र्व, जर्वत्त, खातों, जनर्वेि, संपजत्तयों, कारोबार और ऄन्य सभी प्रिासजनक मामलों का प्रबंधन, जर्वजनयमन और प्रिासन करना और आस ईद्देश्य के जलए जैसा ईजचत समझे, एजेंट या एजेंटों को जनयुि करना;

(यख) संस्ट्थान के काम को जारी रखने के जलए अर्वश्यक भर्वन या भर्वनों, पररसरों, फनीचर, दफटटग, ईपस्ट्करों, ईपकरणों और ऄन्य सुजर्वधाओं को ईपलब्ध कराना; (यग) संस्ट्थान के संकाय और कमाचाररयों के जलए अर्वासों और छात्रों के जलए छात्रार्वासों की स्ट्थापना करना, ईनका रखरखार्व और प्रबंधन करना;

(यघ) संस्ट्थान के छात्रों के जलए ऄन्य एजेंजसयों के स्ट्र्वाजमत्र्व र्वाले और ईनके द्वारा प्रबंजधत छात्रार्वासों को मान्यता दने ा और ईनका जनयंत्रण और पयार्वेक्षण करना तथा आस मान्यता को रद्द करना; (यड.) ऐसे ईद्देश्य के जलए और ऐसी िजियों के साथ ऐसी सजमजत या खोज सजमजत जनयुि करना जैसा दक बोडा ईजचत समझे और आन सजमजतयों पर ऐसे व्यजियों को सह-योजजत करना जैसा दक ईजचत समझा जाए;

(यच) संस्ट्थान के दकसी जल खत का जनष्पादन या दकसी कारोबार का संचालन करने के जलए दकसी व् यजि को, ऐसी िजियों के साथ, जैसा दक ईजचत समझा जाए, संस्ट्थान के न् यायर्वादी के रूप में जनयु‍त करना; (यछ) अगामी र्वर्ा के जलए लेखा परीक्षक/परीक्षकों की जनयुजि करना;

(यज) संस्ट्थान के जलए एक प्रतीक जचन्ह का चयन करना और संस्ट्थान की एक अम मुहर होगी, और आस तरह की मुहर की ऄजभरक्षा और ईपयोग की व्यर्वस्ट्था करना; (यझ) संस्ट्थान के सभी प्रिासजनक मामलों का संचालन करना यदद ये ऄन्यथा जर्वजनर्ददष्ट नहीं दकए गए हों;

(यञ) संस्ट्थान के ईद्देश्यों की पूर्मत के जलए ईद्योग के साथ संपका जर्वकजसत करना; (यट) कॉपोरेट क्षेत्र और ऄन्यों के ऄन्य केंद्रों या संस्ट्थानों के प्रासंजगक पाठ्यक्रमों को मान्यता दने ा; (यठ) भारत और जर्वदिे में कहीं भी आसके या अयुर् मंत्रालय द्वारा स्ट्थाजपत और संचाजलत दकसी ऄन्य केंद्र या संस्ट्थान को संस्ट्थान के संघटक जनकाय के रूप में स्ट्र्वीकार करना;

(यड) भारत और जर्वदिे में कहीं भी दकसी ऄन्य संस्ट्थान पररसर की स्ट्थापना करना; (यढ) भारत सरकार की अरक्षण नीजत और राजभार्ा का कायाान्र्वयन सुजनजित करना;[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 5 (यण) यह सुजनजित करना दक संस्ट्थान जियों और पुरुर्ों दोनों के जलए खुला है, चाह े र्वे दकसी भी जाजत, पंथ, मत या र्वगा स े संबंजधत हों, और संस्ट्थान में छात्रों के प्रर्वेि या सदस्ट्यों, जिक्षकों और ऄन्य कमाचाररयों की जनयुजि में धार्ममक अस्ट्था या पेिे से कोइ ऄपदिे या िता नहीं थोपी जाएगी;

(यत) संस्ट्थान के सुचारू और कुिल संचालन के जलए ऄन्य सभी अर्वश्यक जनणाय लेना।

6. िासी जनकाय की बैठकें - 1) िासी जनकाय ऄपने कायों के संचालन के जलए ईतनी बार बैठकें कर सकता ह ैजजतनी बार ऄध्यक्ष द्वारा अर्वश्यक समझा जाए, लेदकन अमतौर पर र्वर्ा में कम से कम एक बार बैठक होगी।

2) बैठक ऐसे स्ट्थान, जतजथ और समय पर अयोजजत की जाएगी जैसा दक ऄध्यक्ष द्वारा तय दकया जाता ह।ै

3) िासी जनकाय की साधारण बैठक के जलए, सजचर्व द्वारा बैठक के स्ट्थान, जतजथ और समय को जनर्ददष्ट करने र्वाला एक नोरटस पत्राचार के कानूनी रूप से स्ट्र्वीकाया माध्यम से ऐसी बैठक की तारीख से कम से दो सप्ताह पहले भेजा जाएगा, और बैठक के नोरटस के साथ कायासूची भी भेजी जाएगी और जहां यह संभर्व न हो र्वहां, कायासूची को पत्राचार के कानूनी रूप से स्ट्र्वीकाया माध्यम से बैठक से कम से कम दस ददन पहले भेजा जाएगा।

4) िासी जनकाय के कायों के संचालन के जलए ऄध्यक्ष द्वारा दकसी भी समय िासी जनकाय की ऄसाधारण बैठक बुलाइ जाएगी।

5) िासी जनकाय की ऄसाधारण बैठक के जलए, सजचर्व द्वारा बैठक के स्ट्थान, जतजथ और समय को जनर्ददष्ट करने र्वाला एक नोरटस पत्राचार के कानूनी रूप से स्ट्र्वीकाया माध्यम से ऐसी बैठक की तारीख से कम स ेएक सप्ताह पहले भेजा जाएगा, और बैठक के नोरटस के साथ कायासूची भी भेजी जाएगी और जहां यह संभर्व न हो र्वहां, कायासूची को पत्राचार के कानूनी रूप से स्ट्र्वीकाया माध्यम से बैठक से कम से कम चार ददन पहले भेजा जाएगा।

6) िासी जनकाय की ऄसाधारण बैठक, मांग पत्र प्राप्त होने के एक महीन ेकी ऄर्वजध के भीतर िासी जनकाय के कम से कम नौ सदस्ट्यों के जलजखत ऄनुरोध पर भी बुलाइ जा सकती है, और मांग की गइ बैठक के जलए सदस्ट्यों द्वारा दकए गए ऄनुरोध में बैठक का ईद्देश्य आंजगत होगा।

7) दकसी भी बैठक में ऄध्यक्ष की ऄनुपजस्ट्थजत में ईपाध्यक्ष बैठक की ऄध्यक्षता करेंगे।

8) बैठक का कोरम 50 प्रजतित होगा।

9) ऄध्यक्ष दकसी बैठक से पहले या ईसके दौरान दकसी भी समय कायासूची में कारोबार की नइ मदों और कायासूची में िाजमल मदों की ऄनुपूरक मदों को िाजमल कर सकता है; और ऐसी मदों पर भी जर्वचार दकया जाएगा।

10) कोइ भी सदस्ट्य जो िासी जनकाय की बैठक में कोइ संकल्प पाररत करना चाहता ह ैर्वह, सजचर्व को ईसकी जलजखत में सूचना दगे ा तादक बैठक की तारीख से कम से कम बीस ददन पहले सूचना ईन तक पहुचं जाए और प्रस्ट्ताजर्वत संकल्प को कायासूची में िाजमल दकया जाएगा।

11) दकसी बैठक में िासी जनकाय द्वारा जनपटाए गए दकसी भी जर्वर्य को एक र्वर्ा की समाजप्त के बाद तक जर्वचार के जलए दफर से नहीं लाया जाएगा, जसर्वाय ईस मामले में जहां ऄध्यक्ष या ईच्चाजधकारी यह सूजचत करता हो दक आस जर्वर्य पर संस्ट्थान के जहत में अगे जर्वचार करने की अर्वश्यकता ह।ै

12) दकसी सदस्ट्य द्वारा ईठाए गए व्यर्वस्ट्था के प्रश्न पर बैठक के ऄध्यक्ष द्वारा ददया गया जनणाय ऄंजतम होगा।

13) िासी जनकाय के सभी जनणाय ईपजस्ट्थत सदस्ट्यों के बहुसंख्यक मतों से जलए जाएंगे और बराबरी की जस्ट्थजत में ऄध्यक्ष के पास जनणाायक मत होगा।

14) िासी जनकाय की बैठकों की सभी कायार्वाजहयों को आस प्रयोजन हते ु सजचर्व द्वारा रखी जाने र्वाली कायार्वृत्त पुजस्ट्तका में दजा दकया जाएगा और बैठक के कायार्वृत्त को पत्राचार के कानूनी रूप से स्ट्र्वीकाया तरीके से पररचाजलत दकया जाएगा, और कायार्वृत्त तथा ईस पर की गइ कारार्वाइ को पुजष्ट हते ु ऄगली बैठक के समक्ष रखा जाएगा।

7. िासी जनकाय के सदस्ट्यों की पदार्वजध- (1) िासी जनकाय के पदने सदस्ट्य के ऄलार्वा दकसी ऄन्य सदस्ट्य की पदार्वजध तीन र्वर्ा की होगी र्विते दक र्वह संस्ट्थान के सदस्ट्य के रूप में बना रहता हो।

(2) दकसी मनोनीत सदस्ट्य के जनधन होने पर ऄध्यक्ष नए सदस्ट्यों को मनोनीत कर सकता है, हालांदक, ईनका कायाकाल केर्वल मृतक सदस्ट्य की िेर् ऄर्वजध के जलए ही होगा।

8. सस्ट्ं थान, िासी जनकाय, स्ट्थायी सजमजतयों, तदथा सजमजतयों और ऄन्य सजमजतयों के ऄध्यक्ष और सदस्ट्यों को भत्ता - संस्ट्था जनकाय, िासी जनकाय, स्ट्थायी सजमजतयों, तदथा सजमजतयों और ऄन्य सजमजतयों के ऄध्यक्ष और सदस्ट्य भारत सरकार के जनयमों के ऄनुसार बैठक में भाग लेने के जलए यात्रा भत्ते और दजै नक भत्ते के जलए हकदार होंगे।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

9. स्ट्थायी सजमजतया ं - (1) जनयमों ऄथाात 3 जून, 2021 की ऄजधसूचना संख्या जी.एस.अर.387 (इ) द्वारा भारत के राजपत्र, ऄसाधारण में प्रकाजित अयुर्वेद जिक्षण एर्वं ऄनुसंधान संस्ट्थान जनयम, 2021 के ऄनुसार संस्ट्थान, जैसा जरूरी हो, स्ट्थायी सजमजतयों का गठन करेगा जजनमें जनम्नजलजखत िाजमल होंगी:-

(i) जर्वत्त सजमजत;

(ii) ऄकादमी पररर्द;

(iii) ऄनुसंधान सजमजत;

(iv) संपदा सजमजत;

(v) योजना और जनगरानी सजमजत;

(vi) परीक्षा जनयंत्रण बोडा;

(vii) ऄस्ट्पताल प्रबंधन सजमजत;

(viii) कमाचारी चयन सजमजतयां।

(2) स्ट्थायी सजमजतयों की बैठक हर साल कम से कम एक बार होगी और ऄन्य समय में तब होगी जब ऄध्यक्ष द्वारा स्ट्र्वत: बुलाइ जाएगी।

(3) पदने सदस्ट्यों के ऄलार्वा ऄन्य सदस्ट्यों के जलए कमाचारी चयन सजमजत के ऄलार्वा स्ट्थायी सजमजत के सदस्ट्यों की पदार्वजध तीन र्वर्ा की होगी।

(4) सभी स्ट्थायी सजमजतयों की बैठक के जलए कोरम पचास प्रजतित होगा लेदकन स्ट्थजगत बैठक के जलए कोइ कोरम जरूरी नहीं होगा।

(5) ऄध्यक्ष की ऄनुपजस्ट्थजत म,ें सदस्ट्य ऄध्यक्ष का चुनार्व कर सकते ह ैं और सभी जनणाय ईपजस्ट्थत सदस्ट्यों के बहुसंख्यक मतों से जलए जाएंगे और बराबरी की जस्ट्थजत में ऄध्यक्ष के पास जनणाायक मत होगा।

(6) अपात जस्ट्थजत म,ें स्ट्थायी सजमजत के ऄध्यक्ष प्रत्यािा में जनणाय ले सकते हैं, जजसे ऄनुसमथान के जलए सजमजत के समक्ष रखा जाएगा।

(7) सभी स्ट्थायी सजमजतयों के कायार्वृत्तों को िासी जनकाय के समक्ष सूचना के जलए रखा जाएगा।

10. जर्वत्त सजमजत और ईसकी िजिया ंऔर काय ा- (1) जर्वत्त सजमजत में जनम्नजलजखत सदस्ट्य होंगे:- सस्ट्ं थान की जर्वत्त सजमजत जर्विेर् सजचर्व या ऄपर सजचर्व या संयुि सजचर्व (संस्ट्थान के मामले से ऄध्यक्ष 1 संबंजधत), अयुर् मंत्रालय, भारत सरकार 2 ऄध्यक्ष द्वारा मनोनीत दकया गया िासी जनकाय का सदस्ट्य सदस्ट्य ऄपर सजचर्व और जर्वत्तीय सलाहकार, अयुर् मंत्रालय, भारत सरकार या ईनका सदस्ट्य 3 नाजमती 4 जनदिे क सदस्ट्य 5 सलाहकार (अयुर्वेद), अयुर् मंत्रालय, भारत सरकार सदस्ट्य 6 संस्ट्थान के लेखा प्रमुख सदस्ट्य सजचर्व

(2) जर्वत्त सजमजत के पास जनम्नजलजखत िजियां और काया होंगे:- (क) जनदिे क द्वारा तैयार संस्ट्थान के र्वार्मर्क बजट की जांच और संर्वीक्षा करना और िासी जनकाय को जसफाररिें करना; (ख) संस्ट्थान की अय और व्यय को दिााने र्वाले र्वार्मर्क खातों तथा ईनकी लेखा परीक्षा ररपोटा के की जांच करना;

(ग) संस्ट्थान की ऄनुमाजनत अय और व्यय को दिााने र्वाले बजट ऄनुमानों की जांच करना; (घ) नए पदों के सृजन के सभी प्रस्ट्तार्वों और सभी नए प्रस्ट्तार्वों सजहत संस्ट्थान से संबंजधत सभी जर्वत्तीय मामलों को जनपटाना;

(ड.) संस्ट्थान को प्रभाजर्वत करने र्वाले दकसी भी जर्वत्तीय प्रश्न पर ऄपने जर्वचार और जसफाररिें देना और स्ट्र्वयं के प्रस्ट्तार्व पर िासी जनकाय या जनदेिक को जसफाररि दने ा।[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 7

11. ऄकादजमक पररर्द और आसकी िजिया ंऔर काय ा- (1) ऄकादजमक पररर्द में जनम्नजलजखत सदस्ट्य होंगे:- सस्ट्ं थान की ऄकादजमक पररर्द:

1. जनदिे क ऄध्यक्ष

2. सलाहकार - अयुर्वेद, अयुर् मंत्रालय, भारत सरकार सदस्ट्य ऄध्यक्ष, भारतीय जचदकत्सा पद्धजत राष्ट्रीय अयोग (एनसीअइएम) या अयोग के सदस्ट्यों में से सदस्ट्य

3. ईनका नाजमती राष्ट्रीय अयुर्वेद संस्ट्थानों के जनदेिकों में से एक जजसे सजचर्व, अयुर् मंत्रालय द्वारा मनोनीत सदस्ट्य

4. दकया जाएगा भारत के अयुर् जर्वश्वजर्वद्यालयों के कुलपजतयों में से एक जजसे ऄध्यक्ष द्वारा मनोनीत दकया सदस्ट्य

5. जाएगा

6. संस्ट्थान के सभी जिक्षण जर्वभागों के प्रमुख सदस्ट्य

7. ईपजनदिे क (स्नातकपूर्वा) सदस्ट्य

8. ईपजनदिे क (फामेसी) सदस्ट्य

9. संस्ट्थान के डीन ऄकादजमक सदस्ट्य सजचर्व

(2) ऄकादजमक पररर्द के पास जनम्नजलजखत िजिया ंऔर काय ाहोंगे - (क) जडग्री या जडप्लोमा पाठ्यक्रमों के सृजन या संिोधन, मौजूदा जडग्री या जडप्लोमा पाठ्यक्रमों के नाम और ईनके पैटना म ें बदलार्व, ऄर्वजध, प्रर्वेि मापदडं और िुल्क संरचना के बारे में संस्ट्थान को सलाह दने ा;

(ख) ऄपेजक्षत मानर्व िजि के साथ नए जर्वभागों या केंद्रों या आकाआयों के गठन की जसफाररि करना; (ग) ऄपने काम के जर्वजभन्न पहलुओं को जनपटाने, जैसे पाठ्यजर्वर्वरण या पाठ्यचयाा, जिक्षण पद्धजत अदद के बारे में सलाह दने े के जलए ईप-सजमजतयों का गठन करना और आन सजमजतयों के पास ऐसे व्यजि या व्यजियों से परामिा करने की िजि होगी जो पररर्द के सदस्ट्य नहीं हैं;

(घ) जर्वजभन्न जर्वर्यों में जिक्षण, प्रजिक्षण और ऄनुदिे के बारे में सलाह दने ा और जर्वजभन्न पाठ्यक्रमों के जलए पाठ्यजर्वर्वरण या पाठ्यचयाा ईपलब्ध करना; (ड.) जिक्षण स्ट्टाफ के जलए भती जनयमों, कताव्यों और मानकों की जसफाररि करना।

12. ऄनसु धं ान सजमजत और ईसकी िजिया ंऔर काय।ा - (1) ऄनुसंधान सजमजत में जनम्नजलजखत सदस्ट्य होंगे:- सस्ट्ं थान की ऄनसु धं ान सजमजत (र्वज्ञै ाजनक सलाहकार सजमजत)

4. अयुर्वेद के तीन जर्विेर्ज्ञ जजन्ह ेंऄनुसंधान और स्नातकोत्तर जिक्षण का व्यापक ऄनुभर्व हो सदस्ट्य एक बायोमेजडजसन जर्विेर्ज्ञ जजन्ह ें हबाल और अयुर्वेद ऄनुसंधान का व्यापक ज्ञान हो जजस े सदस्ट्य

5. ऄध्यक्ष द्वारा मनोनीत दकया जाएगा

6. जैर्वसांजख्यकी के क्षेत्र का एक जर्विेर्ज्ञ जजसे ऄध्यक्ष द्वारा मनोनीत दकया जाएगा सदस्ट्य

7. और्जध जर्वज्ञान का एक जर्विेर्ज्ञ जजसे ऄध्यक्ष द्वारा मनोनीत दकया जाएगा सदस्ट्य

8. और्धीय पादप का एक जर्विेर्ज्ञ जजसे ऄध्यक्ष द्वारा मनोनीत दकया जाएगा सदस्ट्य

9. महाजनदिे क, केंद्रीय अयुर्वेददक जर्वज्ञान ऄनुसंधान पररर्द सदस्ट्य राष्ट्रीय अयुर्वेद संस्ट्थानों के जनदिे क में से एक जजसे सजचर्व, अयुर् मंत्रालय द्वारा मनोनीत दकया सदस्ट्य

(ग) सभी स्ट्तरों पर ऄनुसंधान के जलए ददिाजनदिे स्ट्थाजपत करना; (घ) ऄनुसंधान, ऄर्वसंरचना और नइ प्रयोगिालाओं, ईपकरण तथा मिीनों जैसी सुजर्वधाओं के जर्वकास के जलए ददिाजनदिे जनधााररत करना; (ड.) कोइ ऄन्य मामला, जो िासी जनकाय द्वारा जर्विेर्ज्ञ तकनीकी सलाह के जलए आस सजमजत को भेजा गया हो।

(ग) मौजूदा ढांचे ऄथर्वा भर्वन को जगराने ऄथर्वा तोड़ने के जलए प्रस्ट्तार्व की जसफाररि करना; (घ) र्वस्ट्तुओं को ऄनुपयोगी घोजर्त करने और ऄजभलेखों की छंटाइ की प्रदक्रया संभालना; (ङ) पररसर की सुरक्षा, बागर्वानी, प्रकाि की व्यर्वस्ट्था और सौंदयीकरण से संबंजधत सभी मामलों की जसफाररि करना;

(2) जनयोजन और जनगरानी सजमजत, संस्ट्थान के भजर्वष्य में जर्वस्ट्तार और बेहतरी के जलए संस्ट्थान के जर्वभागों और ऄन्य स्ट्थायी ऄथर्वा ऄस्ट्थायी सजमजतयों तथा िासी जनकाय को जसफाररि करेगी।

(2) परीक्षा जनयंत्रण बोडा की जनम्नजलजखत िजियां और काया होंगे: -

(i) संस्ट्थान द्वारा अयोजजत की जाने र्वाली सभी परीक्षाओं के ईजचत संचालन के जलए पूणा िजियां और बोडा आस संबंध में मानदडं तथा प्रदक्रयाएं तैयार करने के जलए सक्षम होगा;

(ii) सभी जर्वभागों के प्रमुखों से परीक्षकों का पैनल प्रस्ट्तुत करने के जलए कहना;

(iii) जर्वर्यों के जलए पैनल में िाजमल दकए गए व्यजियों के बीच से परीक्षकों की सूची तैयार करना और बाहर के परीक्षकों के संबंध में, बोडा पैनल से बाहर जा सकता ह ै और यदद कोइ परीक्षक जनयुजि को स्ट्र्वीकार करने में ऄसमथा ह ै तो जनदिे क ररि पद को भरने के जलए ऄपने जर्वर्वेकानुसार दकसी ऄन्य व्यजि को जनयुि करेगा।

16. ऄस्ट्पताल प्रबधं न सजमजत और आसकी िजिया ंतथा काय-ा (1) ऄस्ट्पताल प्रबंधन सजमजत में जनम्नजलजखत सदस्ट्य िाजमल होंगे: - सस्ट्ं थान की ऄस्ट्पताल प्रबंधन सजमजत

1. संस्ट्थान का जचदकत्सा ऄधीक्षक ऄध्यक्ष

2. संस्ट्थान का ईप जचदकत्सा ऄधीक्षक सदस्ट्य

3. संस्ट्थान के सभी नैदाजनक जर्वभागों के प्रमुख सदस्ट्य

4. संस्ट्थान का पंजीकृत जचदकत्सा ऄजधकारी (अरएमओ) सदस्ट्य सजचर्व

(2) ऄस्ट्पताल प्रबंधन सजमजत की जनम्नजलजखत िजियां और काया होंगे- (क) संस्ट्थान के सभी ऄस्ट्पतालों, ओपीडी, अइपीडी और प्रयोगिालाओं की सही कायाकाररणी के जलए पूणा िजियां और सजमजत आस संबंध में मानदडं ों का जनरूपण करने के जलए सक्षम होगी;

(ख) ऄस्ट्पताल की ऄर्वसंरचना के जर्वकास और रख-रखार्व के जलए जसफाररि करना; (ग) जचदकत्सा बोडा के रूप में भी काया करना और सजमजत अर्वश्यकतानुसार ऄन्य ईप सजमजतयां गरठत कर सकती है; (घ) रोगी पररचयाा और ऄस्ट्पताल स्ट्टॉफ से संबंजधत सभी मामलों को जनपटाना।

18. जनदिे क की िजिया ं और काया- जनदिे क ऄनुपूरक के जनयम 2 के ईप-जनयम (10) के ऄऩुसार जर्वभाग का प्रमुख होगा और जर्वभाग के प्रमुख की िजियों का प्रयोग करेगा तथा नीचे ईजल्लजखत कायों का जनष्पादन करेगा, नामत:- (क) र्वह संस्ट्थान का प्रमुख कायाकारी ऄजधकारी होगा और संस्ट्थान के प्रिासन का प्रभारी होगा तथा संस्ट्थान के ऄजधकाररयों और कमाचाररयों को कायों का अर्वंटन करेगा और ऐसे पयार्वेक्षी और कायाकारी जनयंत्रण का प्रयोग करेगा जो जनयमों और आस जनयमार्वली के ऄधीन अर्वश्यक होगा;

(ङ) जनदिे क के पास संस्ट्थान में ऄध्ययन और जिक्षण के समन्र्वय की व्यर्वस्ट्था करने की िजि होगी और र्वह ईजचत फीस ऄथर्वा मानदये के भुगतान पर तथा भारत सरकार जनयमार्वली के ऄनुसार ऄनुमेय दरों पर यात्रा भत्ता प्रदान करके समय-समय पर संस्ट्थान में व्याख्यान दने े और नैदाजनक कायािालाओं के जलए जर्विेर्ज्ञों को अमंजत्रत कर सकता है;

(च) जनदिे क के पास संस्ट्थान में अयोजजत जर्वजभन्न पाठ्यक्रमों की परीक्षाओं का अयोजन कराने की िजि होगी; (छ) जनदिे क के पास िासी जनकाय के ऄनुमोदन के जलए बजट, जर्वत्तीय ऄनुमान और र्वार्मर्क ररपोटा तैयार करने की िजि होगी;

(ज) ऐसे ऄन्य कायों का जनष्पादन जो समय- समय पर िासी जनकाय द्वारा भेजे गए हों।

19. डीन और ईनकी जनयजु ि की प्रदक्रया - (1) िैक्षजणक ऄथर्वा प्रिासजनक कारणों के जलए, अर्वश्यकतानुसार, डीन हो सकते ह।ैं

(2) जनम्नजलजखत डीन जनयुि दकए जा सकते हैं:- क. डीन िैक्षजणक; ख. डीन ऄनुसंधान; ग. डीन ऄंतरााष्ट्रीय ऄध्ययन; घ. डीन छात्र कल्याण; ङ. डीन संकाय और स्ट्टाफ कल्याण; च. डीन जनयोजन और जर्वकास

(3) संस्ट्थान के जलए डीन की जनयुजि, जनदिे क द्वारा िासी जनकाय को सूजचत करते हुए क्रमार्वती रूप में संस्ट्थान के प्रोफेसरों ऄथर्वा एसोजसएट प्रोफेसरों के बीच से की जाएगी।

(4) डीन का कायाकाल क्रमार्वती में ऄजधकतम तीन र्वर्ों का होगा।

(5) र्वे जनदिे क को ददए गए मामलों के संबंध में ईन्हें सलाह दे सकते ह ैं और जनदिे क द्वारा ईन्ह ें दी गइ िजियों का प्रयोग भी कर सकते ह।ैं

20. जर्वभाग और केंद्र – संस्ट्थान को ऐसे जर्वभागों और केंद्रों में बांटा जाएगा तथा ऐसे नामों से जाना जाएगा जो संस्ट्थान िासी जनकाय की जसफाररि के ऄनुसार समय समय पर िैक्षजणक ऄपेक्षाओं और बजटीय प्रार्वधानों के ऄनुसार ऄनुमोददत करेगा।

21. िल्ु क ऄथर्वा प्रभार - स्ट्टाफ, छात्रों, रोजगयों अदद से ली जाने र्वाली ट्यूिन फीस, परीक्षा िुल्क, ऄनुसंधान और छात्रर्वास िुल्क, ऄजतजथ गृह िुल्क अदद और ऄन्य िुल्क समय समय पर िासी जनकाय द्वारा जनधााररत दकए जाएंगे।

22. ऄध्ययन पाठ्यक्रमों म ेंप्रर्विे – अयुर् मंत्रालय द्वारा प्राजधकृत जनकाय द्वारा अयोजजत प्रर्वेि परीक्षा द्वारा ऄनुमोददत योग्यता के ऄनुसार ऄध्ययन के पाठ्यक्रमों में प्रर्वेि ददया जाएगा और संस्ट्थान के सभी पाठ्यक्रमों में अरक्षण, भारत सरकार के ददिाजनदिे ों के ऄनुसार दकया जाएगा तथा अयुर् मंत्रालय, भारत सरकार के ऄनुदिे ों के ऄनुसार जर्वदिे ी नागररकों के जलए सीटें अरजक्षत की जाएंगी।

23. जडग्री आत्यादद प्रदान करना – संस्ट्थान िैक्षजणक पररर्द की जसफाररिों पर समय समय पर संस्ट्थान द्वारा यथास्ट्र्वीकृत बैचलर ऑफ अयुर्वेद मेजडसीन एंड सजारी, डॉ‍टर ऑफ मेजडसीन (अयुर्वेद) ऄथर्वा मेजडसीन ऑफ सजारी (अयुर्वेद), डॉ‍टर ऑफ दफलासफी (अयुर्वेद), मास्ट्टर ऑफ फामेसी (अयुर्वेद), बैचलर ऑफ फामेसी (अयुर्वेद), जडप्लोमा (और्धालय), बैचलर ऑफ नैचुरोपैथी एंड यौजगक सांआसेंस, बैचलर ऑफ सांआस (नर्ससग) और ऄन्य जडग्री तथा जडप्लोमा प्रदान कर सकता ह ैतथा संस्ट्थान समय समय पर िासी जनकाय द्वारा घोजर्त ऐसे पुरस्ट्कार, स्ट्मृजत जचन््, र्वजीफा और छात्रर्वृजत्त प्रदान कर सकता ह ैतथा मानद ईपाजध भी प्रदान कर सकता है।

24. कमाचारी पणू का ाजलक कमचा ारी होंगे- जब तक दकसी मामले में ऄन्यथा स्ट्पष्ट रूप से ददया नहीं जाता ह,ै संस्ट्थान के सभी कमाचारी का पूरा समय संस्ट्थान के जलए होगा और जबना ऄजतररि भुगतान का दार्वा दकए, ईसे संस्ट्थान के संबंजधत प्राजधकारी द्वारा ऄपेजक्षत दकसी भी प्रकार से जनयुि दकया जा सकता है।[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 13

25. जनयजमत और ऄस्ट्थायी पद- संस्ट्थान में पद या तो जनयजमत पद होगा जजसमें जबना दकसी समय सीमा के जलए संस्ट्र्वीकृत र्वेतन की जनधााररत दर होगी ऄथर्वा ऄस्ट्थायी पद होगा जजसमें एक जनजित समय के जलए संस्ट्र्वीकृत र्वेतन की जनधााररत दर होगी।

26. जनयजु ि के जलए ऄहता ा- संस्ट्थान के ऄधीन दकसी पद पर जनयजु ि के जलए अयु, ऄनुभर्व और ऄन्य ऄहता ाएं जनयजु ि प्राजधकारी द्वारा जर्वजनर्ददष्ट की जाएंगी जो आस िता के ऄधीन होंगी दक जनदिे क के पद पर गैर-अयुर्वेद र्वाले व्यजि को जनयुि नहीं दकया जाएगा।

27. पररर्वीक्षा की ऄर्वजध- जब तक दकसी मामले में जनयुजि प्राजधकारी द्वारा ऄन्यथा जनणाय न जलया जाए, सभी कमाचारी एक र्वर्ा के जलए पररर्वीक्षाधीन रहगें े और पररर्वीक्षाधीन ऄर्वजध के दौरान कमाचारी को संतोर्जनक सेर्वा दने ा अर्वश्यक होगा और ऐसा न करने पर ईनकी सेर्वाएं जबना दकसी नोरटस ऄथर्वा कारण बताएं दकसी भी समय समाप्त की जा सकती ह ैंऔर तथाजप जनयुजि प्राजधकारी पररर्वीक्षा की ऄर्वजध बढा सकता ह।ै

28. र्वररिता – संस्ट्थान में प्रत्येक श्रेणी के कमाचाररयों की र्वररिता योग्यता के क्रम द्वारा जनधााररत की जाएगी जजसमें ईन्ह ेंसंबंजधत ग्रेड में जनयुि के जलए चुना गया था, पूर्वा में चयजनत को बाद में चयजनत से र्वररि स्ट्थान ददया गया।

29. ऄर्वकाि- संस्ट्थान के ऄजनयजमत और जनयजमत कमाचारी ऐसे ऄर्वकाि और ऄर्वकाि र्वेतन के पात्र होंगे जो केंद्रीय जसजर्वल सेर्वा (ऄर्वकाि) जनयमार्वली, 1972 के ऄंतगात केंद्रीय सरकार कमाचारी की तदनुरूपी श्रेजणयों के जलए ऄनुमत ह।ै बितें दक जर्वदिे सेर्वा के रूप में संस्ट्थान में प्रजतजनयुजि पर पदधारी ऄपनी प्रजतजनयजु ि की ितों में जनधााररत ऄर्वकाि जनयमों द्वारा िाजसत हो।

30. पिें न और भजर्वष्य जनजध- पेंिन और भजर्वष्य जनजध भारत सरकार जनयमार्वली के ऄनुसार ऄनुमत होगी।

31. सर्वे ाजनर्वजृ त्त- (1) संस्ट्थान के गैर-जिक्षण कमाचाररयों की सेर्वाजनर्वृजत्त की अयु अयुर् मंत्रालय के ददनांक 27 नर्वम्बर, 2020 के पत्र सं. एल.12015/16/2020-एनअइ के ऄनुसार 60 र्वर्ा ऄथर्वा केंद्र सरकार द्वारा समय समय पर दकए गए संिोधन के ऄनुसार होगी।

(2) संस्ट्थान के िैक्षजणक कमाचाररयों की सेर्वाजनर्वृजत्त की अयु स्ट्र्वास्ट््य एर्वं पररर्वार कल्याण मंत्रालय, भारतीय जचदकत्सा पद्धजत एर्वं होम्योपैथी जर्वभाग के पत्र सं.अर.12015/7/99-एनअइ डेस्ट्क, ददनांक 8 ऄिूबर, 1999 के ऄनुसार 62 र्वर्ा ऄथर्वा केंद्रीय सरकार द्वारा समय समय पर दकए गए संिोधन के ऄनुसार होगी;

(3) संस्ट्थान के अयुर्वेद ऄथर्वा ऄन्य जचदकत्सकों की सेर्वाजनर्वृजत्त की अयु 60 र्वर्ा होगी ऄथर्वा केंद्रीय सरकार द्वारा जैसा समय समय पर संिोधन दकया जाएगा।

32. जनदिे क, ईप जनदिे क (स्नातकपर्वू )ा और ईप जनदिे क (फामसे ी) का कायका ाल - (1) जनदिे क, ईप जनदिे क (स्नातकपूर्वा) और ईप जनदिे क (फामेसी) का कायाकाल, धारा 5 के ऄनुसार ऐसे प्रारंभ से 5 र्वर्ा की ऄर्वजध ऄथर्वा 65 र्वर्ा की अयु, प्राप्त करने जो भी पहले हो, तक होगा।

(2) आन जर्वजनयमों में दकसी बात के होते हुए भी, यदद संस्ट्थान की यह राय ह ैदक ऐसा करना जनजहत में होगा, तो जनदिे क, ईप जनदिे क (स्नातकपूर्वा) और ईप जनदिे क (फामेसी) का कायाकाल समाप्त होने से पूर्वा दकसी भी समय जलजखत में कम से कम तीन माह की सूचना ऄथर्वा आसके बदले में तीन माह का र्वेतन ऄथर्वा भत्ते दके र आनका कायाकाल समाप्त करने का ऄजधकार होगा तथा जनदिे क, ईप जनदिे क (स्नातकपूर्वा) और ईप जनदिे क (फामेसी) को भी संस्ट्थान को जलजखत में कम से कम तीन माह की सूचना दके र कायाकाल समाप्त होने से पूर्वा दकसी भी समय पद छोड़ने का ऄजधकार होगा।

33. अचरण, ऄनिु ासन और दंड- केंद्रीय जसजर्वल सेर्वा (अचरण) जनयमार्वली, 1964 संस्ट्थान के कमाचाररयों पर लागू होगी।

34. जचदकत्सा सजु र्वधाएं- जचदकत्सा सजुर्वधाएं भारत सरकार की जनयमार्वली के ऄनुसार स्ट्र्वीकाया होंगी।

35. सर्वे ा की ऄन्य ित-ें आन जर्वजनयमों में प्रदान नहीं दकए गए मामलों के संबंध में समय समय पर संिोधन सजहत केंद्रीय सरकार जनयमार्वली के ऄनुसार सेर्वा, र्वेतन, र्वेतन अयोग, पेंिन, ग्रेजुआटी और सभी सेर्वाजनर्वृजत्त लाभ, र्वेतन र्वृजद्ध, यात्रा तथा दजैनक भत्तों सजहत भत्ते, बीमा, ऄर्वकाि, ऄर्वकाि र्वेतन, लीन, प्रजतजनयुजि, कायाभार ग्रहण करने का समय, जर्वदिे सेर्वा, ऄर्वकाि यात्रा ररयायत आत्यादद की सामान्य ितों के संबंध में केंद्रीय सरकार के कमाचाररयों के जलए लागू भारत सरकार, केंद्रीय जसजर्वल सेर्वा जनयमार्वली संस्ट्थान के जनयजमत कमाचाररयों के जलए लागू होगी।

36. पदों का र्वते नमान- संस्ट्थान में पदों के जलए र्वेतनमान और भत्ते समय-समय पर भारत सरकार द्वारा की गइ ऄजधसूचना के ऄनुसार होंगे।

37. कमाचाररयों को सस्ट्ं थान के अर्वास का अर्वटं न- संस्ट्थान के कमाचारी संस्ट्थान द्वारा जनधााररत प्रार्वधानों के ऄनुसरण में संस्ट्थान में अर्वास के अर्वंटन के पात्र होंगे।14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

38. प्राजधकाररयों की िजियां- प्राजधकाररयों को ऄनुसूची-I और ऄनुसूची-II सजहत आन जर्वजनयमों के ऄंतगात सौंपी गइ िजियां होंगी।

1. Short title and commencement.- (1) These regulations may be called the Institute of Teaching and Research in Ayurveda Regulations, 2021.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.- In these regulations, unless the context otherwise requires,-

(a) “Act” means the Institute of Teaching And Research in Ayurveda Act, 2020 (16 of 2020);

(b) “Deputy Director” means the Deputy Director (Under Graduate) of Shree Gulabkunverba Ayurved Mahavidyalaya, Deputy Director (Pharmacy) of the Indian Institute of Ayurvedic Pharmaceutical Sciences, appointed under sub-section (4) of section (11) and “Deputy Director (Postgraduate)” means the Deputy Director (Administration) of the Institute appointed under sub-section (4) of section (11);

(c) “Fundamental Rules (FR)” means the fundamental rules as applicable to the Central Government servants;

(d) “General Financial Rules (GFR)” means the General Financial Rules, 1963 and from time to time framed by the Central Government for financial management and controls;

(e) “President” means the President of the Institute nominated by the Central Government under sub-section (1) of

section (8);

(f) “Rules” means the rules framed under section 27;

(g) “Schedule” means a schedule to these regulations;

(h) “Section” means a section of the Act;

(i) “Standing” and “Ad-hoc” Committee means respective Standing and Adhoc Committees constituted under sub-section (5) of section (10);

(j) “Supplementary Rules” means the Supplementary Rules as applicable to the Government servants who are subject to the Fundamental Rules (FR);

(k) “Treasury Rules” means the Treasury Rules of the Central Government;

(l) words and expressions used in these regulations and not defined but defined in the Act shall have the meanings respectively assigned to them in the Act.

3. Constitution of Governing Body.- The Governing Body shall consist of the following members:- ITRA - Governing Body (GB) shall consist of the following members, namely;

4. Powers and functions of Chairperson of Governing Body.- The Chairperson of the Governing Body shall

have the following powers and functions:-

(a) to convene the meetings of the Governing Body at any time and shall do so if a requisition for that purpose is presented to him in writing by not less than fifty per cent of the members specifying the subject of the meeting proposed to be called;

(b) to preside over the Governing Body meetings and introduce the Agenda items properly; may include in the Agenda at any time before or during a meeting –

(i) fresh items of business; and

(ii) items supplementary to those included in the Agenda, and such items shall be taken up for consideration in the meeting;

(c) to ensure that the affairs of Governing Body are conducted in accordance with law;

(d) to ensure that the decisions of Governing Body are implemented;

(e) to carry out the duties delegated by the Governing Body;

(f) to ensure the availability of adequate financial resources for the Institution;

(g) to exercise the powers of Governing Body in case of need and report any action taken in such cases on behalf of Governing Body in its next meeting for approval.

5. Powers and functions of Governing Body.- The Governing Body shall have the following powers and

functions:-

(a) to have general control of the affairs of the Institute and will have authority to exercise and perform all powers, acts and deeds of the Institute consistent with its objects;

(b) to establish, on the advice of the Academic Council, Divisions and Departments for the academic, research work and functions of the Institute and to allocate areas of study, teaching and research to them;

(c) to conduct innovative experiments in new methods and technologies in the field of medical education in order to maintain international standards of such education, training and research;

(d) to create teaching and non-teaching posts, to determine the number, cadres and qualifications thereof as approved by the statutory body concerned and the emoluments of such posts in consultation with the Finance Committee and with the approval of the Government of India;

(e) to appoint such Professors, Associate Professors, Assistant Professors and other academic and non- academic staff as may be necessary on the recommendation of the Selection Committee, and the power of Appointing Authority shall be exercised as per Schedule-I;

(f) to lay down the duties and conditions of service of the Professors, Associate Professors and Assistant Professors and other academic staff of the Institute in consultation with the Academic Council;

(g) to provide for appointment of Visiting Fellows and Visiting Professor;

(h) to constitute for the benefit of the teaching, academic, technical, administrative and other staff, such pension, insurance, provident fund and gratuity, as it may deem fit and aid in the establishment and support of Association, Institutions, Funds, Trusts and conveyances calculated to benefit the staff and the students of the Institute;

(i) to regulate and enforce discipline among the employees of the Institute and to take appropriate disciplinary action, wherever necessary;

(j) to entertain and adjudicate upon and, if thought fit, to redress grievances of the employees and students of the Institute;

(k) to grant leave of absence to the Director and to make necessary arrangements for carrying on his functions during the period of absence;

(l) to approve the award of degrees, diplomas and certificates basedon the results of examinations and tests and to confer, grant or award degrees, diplomas, certificates and other academic titles and distinctions;

(m) to fix the emoluments and traveling and other allowances of examiners, moderators, tabulators and such other personnel appointed for examinations in consultation with the Academic Council and the Finance Committee;24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(n) to award Visitor ship, Honorary Professorship, Fellowships, including Travel Fellowships, Scholarships, Studentships, Stipends, Medals and Prizes in accordance with the rules to be framed for the purpose;

(o) to advise the Holding Trustee (if any) on matters regarding acquisition, management and disposal of any immovable property on behalf of the Institute;

(p) to purchase, take on lease or accept as gift or otherwise any land or buildings or works, which may be necessary or convenient for the purpose of the Institute, on such terms and conditions, as it may deem fit and proper, and to construct or alter and maintain any such building or work;

(q) to transfer or accept transfers of any movable property on behalf of the Institute;

(r) to execute in consultation with the Holding Trustees, if any, conveyance, transfer Government securities, re-conveyances, mortgages, leases, bonds, licenses and agreements in respect of property, movable or immovable, belonging to the Institute or to be acquired for the purposes of the Institute;

(s) to issue appeals for funds for earning out the objects of the Institute and, consistent with the provisions of the objects, to receive grants, donations, contributions, gifts, prizes, scholarship, fees and other moneys, to give grants and donations, to award prizes, scholarships, etc.;

(t) to raise and borrow in consultation with the Holding Trustee (if any) money on bonds, mortgages, promissory notes or other obligations or securities founded or based on any of the properties and assets of the institute, or without any securities, upon such terms and conditions as it may think fit and to pay out of the funds of the institute, all expenses incidental to the raising of money and to repay and redeem the money borrowed;

(u) to draw and accept and make and endorse discount and negotiate Government of India's and other promissory notes, bills of exchange, cheque or other negotiable instruments;

(v) to maintain a fund to which shall be credited- i. all moneys provided by the Central Government or State Government or Union territory Government; ii. all fees and other charges received by the Institute;

iii. all money received by the Institute as grants, gifts, donations, benefactions, bequest or transfers; and iv. all money received by the Institute in any other manner or from any other source;

(w) to open account or accounts of the Institute with anyone or more scheduled Banks and to lay down the procedure for operating the same;

(x) to deposit all moneys credited to the funds in scheduled Banks or to invest them in consultation with the Finance Committee;

(y) to invest the funds of the Institute or money entrusted to the Institute or upon such securities and in such manner, as it may deem fit, and from time to time transpose any investment;

(z) to maintain proper accounts and other relevant records and prepare Annual Statements of Accounts, including the Balance Sheet for every previous financial year, in such form, as may be prescribed by rules;

(za) to manage, regulate and administer the revenue, the finance, accounts, investments, properties, business and all other administrative affairs of the Institute and for that purpose to appoint such agent or agents, as it may deem fit;

(zb) to provide building or buildings, premises, furniture, fittings, equipments, appliances and other facilities required for carrying on the work of the Institute;

(zc) to establish, maintain and manage residences for faculty and staff and hostels for the students of the Institute;

(zd) to recognise and maintain control and supervision on hostels owned and managed by other agencies for the students of the Institute and to rescind such recognition;

(ze) to appoint such committee or search committee for such purpose and with such powers as the Board may think fit and to co-opt such persons on these committees as it thinks fit;

(zf) to appoint in order to execute an instrument or transact any business of the Institute, any person as attorney of the Institute with such powers, as it may deem fit:[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 25

(zg) to appoint Auditor(s) for the ensuing year;

(zh) to select an emblem and to have a common seal for the Institute, and to provide for the custody and use of such seal;

(zi) to conduct all administrative affairs of the Institute not otherwise specifically provided for;

(zj) to develop linkages with the industry for fulfilment of the objects of the Institute;

(zk) to accredit the relevant courses of other centers or institutions of the corporate sector and others;

(zl) to admit any other center or institution established and run by it or the Ministry of AYUSH, anywhere in India and abroad as a constituent body of the Institute;

(zm) to establish any other Institute Campus anywhere in India and abroad;

(zn) to ensure implementation of the reservation policy and official language of the Government of India;

(zo) to ensure that the Institute is open to persons of either gender, and of whatever race, creed, caste or class and no pretexts or conditions shall be imposed as to religious belief or profession in admitting students or appointing members, teachers and other staff of the Institute;

(zp) to take all other necessary decisions for the smooth and efficient functioning of the Institute.

6. Meetings of Governing Body.- (1) The Governing Body may meet as often as may be considered necessary by the Chairperson for transaction of its business but shall ordinarily meet at least once a year.

(2) Meeting shall be held at such place, date and time as may be decided by the Chairperson.

(3) For an ordinary meeting of the Governing Body, a notice specifying the place, date and time of the meeting shall be sent by the Secretary at least two weeks prior to the date of such meeting through legally acceptable mode of communication, and the Agenda shall also be sent along with the notice of the meeting and where it is not possible, the Agenda shall be sent at least ten days before the meeting through legally acceptable mode of communication.

(4) An extraordinary meeting of the Governing Body shall be called by the chairperson at any time, for the transaction of the business of the Governing Body.

(5) For an extraordinary meeting of the Governing Body, a notice specifying the place, date and time of the meeting shall be sent by the Secretary at least one week prior to the date of such meeting through legally acceptable mode of communication, and the Agenda shall also be sent along with the notice of the meeting and where it is not possible, the Agenda shall be sent at least four days before the meeting through legally acceptable mode of communication.

(6) An extraordinary meeting of the Governing Body, may also be called on a written request of not less than nine members of the Governing Body, within a period of one month of the receipt of the requisition, and the request made by the members for a requisitioned meeting shall indicate the purpose of the meeting.

(7) In the absence of the Chairperson at any meeting, the Vice Chairperson will preside over the meeting.

(8) The Quorum of the meeting will be 50 per cent.

(9) The Chairperson may include in the Agenda at any time before or during a meeting, the fresh items of business and items supplementary to those included in the Agenda; and such items shall also be taken up for consideration.

(10) Any member desirous of moving any resolution at a meeting of the Governing Body shall give notice thereof in writing to the Secretary so as to reach him not less than twenty days before the date of the meeting and the proposed resolution shall be included in the Agenda.

(11) No subject disposed of by the Governing Body at a meeting shall be brought up again for consideration until after the expiry of one year except in a case where the Chairperson or higher authority intimates that the subject required further consideration in the interest of the Institute.

(12) A decision given by the Chairperson of the meeting on a point of order raised by a member shall be final.

(13) All decisions of the Governing Body shall be taken by a majority of votes of the members present, and the Chairperson shall have casting vote, in case of tie.

(14) All proceedings of the meetings of the Governing Body shall be entered in a minutes book to be maintained by the Secretary for the purpose and the minutes of the meeting shall be circulated through legally acceptable mode of communication, and the minutes and the action taken thereon shall be placed before the next meeting for confirmation.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

7. Terms of office of members of Governing Body.- (1) The term of office of ab member other than ex-officio member of the Governing Body shall be three years subject to his continuance as a member of the Institute.

(2) On demise of any nominated member, the President may nominate new members, however, their tenure will be only for the remaining period of the deceased member.

8. Allowance to Chairperson and members of Institute, Governing Body, Standing Committees, Ad-hoc committees and other committee.- The Chairman and members of the Institute, Governing Body, Standing Committees, Ad-hoc committees and other committees shall be entitled for travelling allowance and daily allowance for attending meeting as per the Government of India rules.

9. Standing Committees.- (1) As per the rules, namely the Institute of Teaching and Research in Ayurveda Rules, 2021, published in the Gazette of India, Extraordinary vide notification number G.S.R. 387(E), dated 3rd June, 2021, the Institute shall constitute such standing committees as may be necessary including the

following: –

(i) Finance Committee;

(ii) Academic Council;

(iii) Research Committee;

(iv) Estate Committee;

(v) Planning and Monitoring Committee;

(vi) Examination Control Board;

(vii) Hospital Management Committee;

(viii) Staff Selection Committees.

(2) Standing committees shall meet at least once every year and at other times when convened by the Chairperson suo-moto.

(3) The term of office of members of a standing committee other than Staff Selection Committee shall be three years for the members other than ex officio members.

(4) The quorum for a meeting of all standing committees shall be fifty per cent but no quorum shall be necessary for an adjourned meeting.

(5) In absence of the Chairperson, members may elect the Chairperson and all decisions shall be taken by a majority of votes of the members present, and the Chairperson shall have casting vote, in case of tie.

(6) In case of emergency, Chairperson of the standing committee may take decision in anticipation, which shall be placed before the committee for ratification.

(7) Minutes of all the standing committees shall be placed before the Governing Body for information.

10. Finance Committee and its powers and functions.- (1) The Finance Committee shall consist of the following

(2) The Finance Committee shall have the following powers and functions: -

(a) to examine and scrutinise the annual budget of the Institute prepared by the Director and make recommendation to the Governing Body;

(c) to examine budget estimates showing the estimated receipts and expenditure of the Institute;

(d) to deal with all proposals for the creation of new posts, and all financial matters pertaining to the Institute including all new proposals;

(e) to give its views and recommendations on any financial question affecting the Institute and recommendation to the Governing Body or Director or on its own motion.

11. Academic Council and its powers and functions.- (1) The Academic Council shall consist of the following

members: -

(6) The Academic Council shall have the following powers and functions.-

(a) to advise the Institute regarding creation or modification of degree or diploma courses, change names of existing degree or diploma courses and its pattern, duration, admission criteria and fee structure;

(b) to recommend the constitution of new Departments or centres or units along with the required man power;

(c) to constitute sub-committees for dealing with different aspects of its work like advice regarding syllabus or curriculum, teaching methodology, etc. and such committees shall have the power to consult a person or persons who are not members of the Council;

(d) to advise regarding teaching, training and instruction in various subjects and to provide syllabus and curriculum for the various courses;

(e) to recommend recruitment rules, duties and standards for teaching staff.

12. Research Committee and its powers and functions.- (1) The Research Committee shall consist of the following

2. The Research Committee (Scientific Advisory Committee) shall have the following powers and functions:-

(a) to advise on all technical matters relating to research conducted at the Institute;

(b) annual evaluation of technical work and publication of the Institute;

(c) setting up guidelines for research at all levels;

(d) setting up guidelines for the development of research infrastructure and facilities like new laboratories, equipment and machines;

(e) any other matter, which the Governing Body may refer to this Committee for expert technical advice.

13. Estate Committee and its powers and functions.- (1) The Estimate Committee shall consist of the following

(2) The Estate Committee shall have following powers and functions: -

(a) to recommend proposal for new constructions including aspects like planning, designing, location and utility of proposed construction;

(b) to recommend proposal for all necessary maintenance, development, addition or alteration, renovation, etc, for infrastructure excluding hospital or medical equipment or instruments;

(c) to recommend proposal for dismantling or demolition of existing structure or building;

(d) to look after process for condemnation of unserviceable articles and weeding out of records;

(e) to recommend for all matter related to safety, security, horticulture gardening, lighting and beautification of the campus;

(f) to recommend for all matters related to housekeeping of the campus;

(g) to recommend rules for housing accommodation or staff quarter;

(h) to decide allotment of housing accommodation or staff quarter;

(i) to recommend norms for all other resources like auditorium, ground and guest house.

14. Planning and Monitoring Committee and its powers and functions.- (1) The Planning and Monitoring

(2) The Planning and Monitoring Committee shall recommend to the Departments of the Institute and other standing or ad-hoc committees and Governing Body for future scope and betterment of the Institute.

15. Examination Control Board and its powers and functions.- (1) The Examination Control Board shall consist

(2) The Examination Control Board shall have the following powers and functions: -

(a) full powers for the proper conduct of all the examinations conducted by the Institute and shall be competent to frame norms and procedures in this regard;

(b) to ask all the head of the Departments to submit the panel of Examiners;

(c) to draw up the lists of examiners from amongst the persons included in the panels for the subjects, and as regards external examiners, the Board can go outside the panels and if any examiner is unable to accept that appointment, the Director shall use his discretion to appoint another person to fill in the vacancy.

16. Hospital Management Committee and its powers and functions.- (1) The Hospital Management Committee

shall consist of the following members: - HOSPITAL MANAGEMENT COMMITTEE OF INSTITUTE.

(2) The Hospital Management Committee shall have the following powers and functions.-

(a) full powers for the proper functioning of all the hospitals, OPD, IPD, Laboratories of the Institute and shall be competent to frame norms in this regard;

(b) to recommend for development and maintenance of infrastructure of hospital;

(c) to also work as medical board, and the committee may form other sub- committees as per requirement;

(d) to address all matters related to patient care and hospital staff.

17. Staff Selection Committees.- The following shall be the Staff Selection Committees: -

18. Powers and duties of Director. - The Director shall be the Head of the Department in terms of sub-rule (10) of rule 2 of the Supplementary and shall exercise the powers of Head of Department and discharge the duties mentioned below, namely:-

(a) he shall be Chief Executive Officer of the Institute and shall be in charge of the administration of the Institute and he shall allocate duties to the officers and employees of the Institute, and shall exercise such supervision and executive control as may be necessary subject to the rules and these regulations;

(b) the Director shall have the power for the conduct and discipline of the staff working under him;

(c) the Director shall have the power to administer the fund as defined in the Act;

(d) the Director shall have the power to supervise and control the admission, conduct and discipline of the students of Post Graduate, Under Graduate and other studies and to supervise and control their residence and to make arrangements for promoting their health and general welfare;32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(e) the Director shall have the power to arrange for co-ordination of studies and teaching in the Institute and he may invite experts to deliver lectures and clinical workshops in the Institute from time to time, on payment of suitable fees or honoraria and pay them travelling allowance at the rates admissible as per Government of India Rules;

(f) the Director shall have the power to hold and conduct examinations of the various courses conducted by the Institute;

(g) the Director shall have the power to prepare budget, financial estimates and annual report, for approval of the Governing Body;

(h) to perform such other duties as may be assigned by the Governing Body from time to time.

19. Deans and procedure for their appointment.- (1) There may be Deans as may be required for the Academic or administrative reasons.

(2) The following Deans may be appointed:-

(a) Dean Academic;

(b) Dean Research;

(c) Dean International Studies;

(d) Dean Students Welfare;

(e) Dean Faculty and Staff Welfare;

(f) Dean Planning and Development.

(3) The Deans for the Institute shall be appointed from amongst the Professors or Associate Professors of the Institute by rotation by the Director under intimation to the Governing Body.

(4) The tenure of the Deans shall be maximum up-to three years in rotation.

(5) They shall advise the Director regarding matters given to them and may also use the powers assigned to them by the Director.

20. Departments and Centres.- The Institute shall be organised in such Departments and Centres to be known by such names as the Institute may approve as per the academic requirements and budgetary provisions from time to time as per the recommendation of the Governing Body.

21. Fees or charges.- Tuition fee, examination fee, research and hostel fee, guest house charges, etc. and other fees to be charged from the staff, students, patients, etc. may be fixed by the Governing Body from time to time.

22. Admission to courses of studies.- The Admission to courses of study shall be as per the merit approved by entrance examinations conducted by the body authorised by the Ministry of AYUSH, and the reservation in all the courses of the Institute shall be as per the guidelines of the Government of India, and there shall be seats reserved for foreign nationals as per the instructions of the Ministry of AYUSH, Government of India.

23. Award of degree, etc.- The Institute may award Bachelor of Ayurveda Medicine and Surgery, Doctor of Medicine (Ayurveda) or Master of Surgery (Ayurveda), Doctor of Philosophy (Ayurveda), Master of Pharmacy

(Ayurveda), Bachelor of Pharmacy (Ayurveda), Diploma (Pharmacy), Bachelor of Naturopathy and Yogic Sciences, Bachelor of Science (Nursing) and other degrees and diplomas as may be sanctioned by the Institute from time to time on the recommendation of the Academic Council, and the Institute may award such prizes, souvenirs, stipends, and scholarship to its students as may be declared by the Governing Body from time to time, and the Institute may award honorary degrees also.

24. Employees to be whole time servants.- Unless in any case if it be otherwise distinctly provided, the whole time of an employee of the Institute shall be at the disposal of the Institute and he may be employed in any manner required by the concerned authority of the Institute without claim for additional remuneration.

25. Permanent and temporary posts.- The post in the service of the Institute shall be either a permanent post that is a post carrying a defined rate of pay sanctioned without any limit of time or a temporary post that is a post carrying a defined rate of pay sanctioned for a limited time.

26. Qualification for appointment.- Age, Experience and other qualifications for appointment to a post under the Institute shall be specified by the appointing authority subject to the condition that non-ayurveda persons shall not be appointed to the post of the Director.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 33

27. Period of probation.- Unless otherwise decided by the appointing authority in any case, all employees shall be on probation for one year, and during the period of probation, the employee shall be required to put in satisfactory service failing which his services shall be liable to termination at any time without any notice or reason being assigned for the same, and the appointing authority may, however, extend the period of probation.

28. Seniority.- The seniority of employees of the Institute in each category shall be determined by the order of merit in which they were selected for appointment to the grade in question, those selected on earlier occasion being ranked senior to those selected later.

29. Leave.- Temporary and permanent employees of the Institute shall be entitled to such leave and leave salary as are admissible to the corresponding categories of Central Government Servants under the Central Civil Services (Leave) Rules, 1972:

Provided that an incumbent on deputation to the Institute as on foreign service shall be governed by the leave rules as may be stipulated in the conditions of their deputation.

30. Pension and provident fund.- Pension and provident fund shall be admissible as per Government of India rules.

31. Superannuation.- (1) The age of superannuation of non- teaching employees of the Institute shall be sixty years as per Ministry of AYUSH letter No. L.12015/16/2020-Nl, dated the 27th November, 2020 or as amended by the Central Government from time to time.

i. The age of superannuation of teaching employees of the Institute shall be sixty-two years as per Ministry of Health and Family Welfare, Department of Indian Systems of Medicine and Homoeopathy letter No.

R.12015/7/99-Nl Desk, dated the 8th October, 1999 or as amended by the Central Government from time to time; ii. The age of superannuation of Ayurveda or Medical doctors of the Institute shall be sixty years or as amended by the Central Government from time to time.

32. Term of office of Director, Deputy Director (Undergraduate) and Deputy Director (Pharmacy).- (1) The term of office of the Director, Deputy Director (Undergraduate) and Deputy Director (Pharmacy) shall be for a period of five years with effect from such commencement or until they attain the age of sixty-five years, whichever is earlier as per section 5.

(2) Notwithstanding anything contained in these regulations, the Institute shall, if it is of the opinion that it is in the public interest so to do, have the right to terminate the term of office of Director, Deputy Director (Undergraduate) and Deputy Director (Pharmacy) at any time before the expiry of their term by giving a notice of not less than three months in writing or three months‟ salary and allowances in lieu thereof, and the Director, Deputy Director (Undergraduate) and Deputy Director (Pharmacy) shall also have the right to relinquish office at any time before the expiry of the term by giving to the Institute a notice of not less than three months in writing.

33. Conduct, discipline and penalties.- The Central Civil Services (Conduct) Rules, 1964 shall apply to the employees of the Institute.

34. Medical facilities.- The medical facilities shall be as admissible under the Government of India rules.

35. Other conditions of service.- In respect of matters not provided in these regulations, Government of India, Central Civil Service Rules as applicable to the Central Government servants regarding the general condition of service, pay, Pay Commission, pension, gratuity and all retirement benefits, increment, allowances including travelling and daily allowances, insurance, leave, leave salary, lien, deputation, joining time, foreign service, Leave Travel Concession, etc. as per the Central Government rules with amendment therein from time to time shall apply to the regular employees of the Institute.

36. Scales of pay of posts.- The scales of pay and allowances for the posts in the Institute shall be as notified by the Government of India from time to time.

37. Allotment of Institute residence to employees.- The employees of the Institute shall be entitled to the allotment of residences at the Institute in accordance with the provisions laid down by the Institute.

38. Powers of Authorities.- The Authorities shall have the power assigned under these regulations including Schedule-I and Schedule-II.

39.
