1. सजं िप्त नाम और प्रारंभ: (1) इन जनयमों का संजिप्त नाम भारतीय रेल स्ट्वास्ट््य सेवा जनयम, 2026 है।

(2) ये रािपत्र म ें उनके प्रकािन की तारीख को प्रवत्तृ होंगे।

2. पररभाषाए:ं इन जनयमों म,ेंिब तक दक सिं भड स े अन्यर्ा अपेजित न हो :- (क) “प्रिासजनक पि” स े समय-समय पर संवगड जनयंत्रण प्राजधकारी द्वारा,यर्ाजवजनर्िडष्ट िसै ा अनुसचू ी-V म ें यर्ाजवजनर्िष्टड कोई भी पि अजभप्रेत ह;ै (ख) "संवगड जनयंत्रण प्राजधकारी" स ेरेल मंत्रालय,भारत सरकार अजभप्रेत ह;ै (ग) "नैिाजनक पि" से अनुसचू ी-V म ें यर्ाजवजनर्िडष्ट प्रिासजनक पिों के अलावा पि अजभप्रेत है। 6869 GI/20262 THEGAZETTEOFINDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (घ) "आयोग" स ेसंघ लोक सेवा आयोग अजभप्रेत ह;ै (ङ) “जवभागीय पजु ष्ट सजमजत” स े दकसी श्रेणी म ें अजधकाररयों की पजु ष्ट पर जवचार करने के जलए गरित सजमजत अजभप्रते है;

(च) "जवभागीय प्रोन्नजत सजमजत" दकसी श्रेणी म ें अजधकाररयों की प्रोन्नजत पर जवचार करने के जलए गरित सजमजत अजभप्रेत ह;ै (छ) "जवभागीय छानबीन सजमजत" से अकृजत्यक उन्नयन प्रिान करन े पर जवचार करने के जलए गरित सजमजत अजभप्रते है;

(ि) "ड्यूटी पि" स ेइन जनयमों की अनुसूची-। म ें वर्णतड दकसी श्रेणी का कोई भी पि अजभप्रेत ह;ै (झ) "परीिा" स ेसंघ लोक सेवा आयोग द्वारा आयोजित संयुि जचदकत्सा सेवा परीिा अजभप्रेत है। (ञ) "सरकार" स े भारत सरकार अजभप्रेत ह;ै (ट) “श्रेणी” स े इन जनयमों की अनुसचू ी-। म ेंजवजनर्िडष्ट ड्यूटी पिों की श्रेजणया ंअजभप्रेत है। (ि) दकसी भी श्रेणी संबंधी “जनयजमत सेवा” स े जनयमों के अधीन उस श्रेणी म ें चयन और जनयजमत जनयुजि के पश्चात् की गई सेवा की अवजध या अवजधया ंअजभप्रेत ह ैंऔर इसम ें कोई भी अवजध या अवजधयां िाजमल ह ै

(i) िो इन सेवा के िुरुआती गिन के समय जनयुि दकए गए व्यजियों की ििा म ें वररष्ठता के प्रयोिन हेत ु इसे ध्यान में रखा गया;

(ii) जिसके िौरान दकसी अजधकारी ने उस श्रेणी में डयूटी पि धारण दकया होता ककंतु उसके छुट्टी पर होने के कारण अर्वा अन्यर्ा ऐसा पि धारण करने के जलए उपलब्ध नहीं र्ा। (ड) "अनुसूची" स ेइन जनयमों के सार् संलग्न अनुसूजचयां अजभप्रते है। (ढ) "सेवा" स े जनयम 3 के अंतगडत गरित भारतीय रेल स्ट्वास्ट््य सेवा अजभप्रेत ह;ै

3. सवे ा का गिन: (1) सेवा म ेंअनुसचू ी-। म ें जवजनर्िडष्ट पि िाजमल होंगे।

(2) सेवा में सभी ड्यूटी पि, िैसा दक अनसु ूची-। म ें जनर्िष्टड ह,ै को समूह ‘क’ के पिों के रूप म ें वगीकृत दकया िाएगा।

4. श्रजे णया,ं पिसख्ं या और इसका पनु र्वलड ोकन: (1) वेतन मैररक्स म ें जवजभन्न श्रेजणयों, पिनाम, संख्या और स्ट्तर के िाजमल ड्यूटी पि वे होंगे िो अनसु ूची-। म ें यर्ा-जवजनर्िडष्ट हैं।

(2) उप-जनयम (1) म ें जनजहत दकसी बात के होते हुए भी, सरकार रािपत्र म ें अजधसूचना द्वारा - (क) अनुसूची-। म ें जवजनर्िडष्ट ड्यूटी पिों अर्वा श्रेजणयों,पिनामों म ें पररवधडन,पररवतडन,प्रजतस्ट्र्ापन या आिोधन और वेतन मैररक्स में स्ट्तरों की संख्या को पररवर्तडत या आिोजधत कर सकती ह;ै (ख) आयोग के परामिड स,ेअनुसचू ी-। म ें जवजनर्िडष्ट सेवा में दकसी भी ड्यूटी पि को िाजमल या सेवा स े दकसी भी ड्यूटी पि को जनकाल सकती ह;ै (ग) आयोग के परामिड से,उजचत श्रेणी म ें उप-खंड (ख) के अधीन सेवा में िाजमल ड्यूटी पि पर अजधकारी को जनयुि कर सकती है।

5. सवे ा के सिस्ट्य: इन जनयमों के प्रारंभ से पहल े सेवा म ें जनयिु सभी अजधकारी और इन जनयमों के प्रारंभ की तारीख को भारतीय रेल स्ट्वास्ट््य सेवा के कजनष्ठ समय मान, वररष्ठ समय-मान,कजनष्ठ प्रिासजनक श्रेणी,अकृजत्यक प्रवरण श्रेणी,ज्येष्ठ[भागII—खण्ड 3(i)] भारत का रािपत्र : असाधारण 3 प्रिासजनक श्रेणी और उच्चतर प्रिासजनक श्रेणी म ें जनयजमत आधार पर ड्यूटी पिों पर कायडरत अजधकारी संबंजधत श्रेजणयों म ें सेवा के सिस्ट्य होंगे।

6. सवे ा का भावी भरणपोषण: (1) अनसु ूची-। म ें उजल्लजखत दकसी भी श्रेणी म ें ररि पिों को इन जनयमों के अधीन उपबंजधत रीजत स े भरा िाएगा।

(2) इस सेवा म ें संबंजधत श्रेणी और जविेषज्ञताओं म ें पिों पर जनयुजि या प्रोन्नजत के जलए भती की जवजध,प्रोन्नजत के जलए चयन िेत्र सजहत तत्काल धाररत जनम्नतर श्रेणी या जनम्नतर श्रेजणयों म ें न्यूनतम अहकड सेवा वही होगी िैसा अनुसूची-।। में यर्ाजवजनर्िष्टड है।

(3) कजनष्ठ कालमान श्रेणी म ें ररि ड्यूटी पिों का सौ प्रजतित अनुसूची-।। यर्ाजवजनर्िष्टड आयोग द्वारा आयोजित सयं ुि जचदकत्सा सेवा परीिा के माध्यम स ेसीधी भती द्वारा भरे िाएगं े।

(4) ज्येष्ठ कालमान श्रेणी म ें ड्यूटी पिों का तीस प्रजतित अनुसचू ी-।। यर्ाजवजनर्िडष्ट आयोग के परामिड स े सीधी भती द्वारा भरा िाएगा।

(5) कजनष्ठ प्रिासजनक श्रेणी म ें ड्यूटी पि का िस प्रजतित अनसु ूची-।। यर्ाजवजनर्िडष्ट आयोग के परामिड स े सीधी भती द्वारा भरे िाएंगे।

(6) ज्येष्ठ प्रिासजनक श्रेणी तक के ड्यूटी पिों की जवभागीय प्रोन्नजतया,ं ररजियों पर ध्यान दिए जबना अनुसचू ी-।। म ें जवजनर्िडष्ट अनुसार की िाएंगी तर्ा जवभागीय पिोन्नजत सजमजत की जसफाररिों पर सेवा के अजधकाररयों म ें स े चयन के आधार पर की िाएंगी, िैसा अनुसचू ी-।।। म ें जवजनर्िडष्ट है।

(7) सीधी भती द्वारा सेवा म ें जवजभन्न ड्यूटी पिों पर जनयुजि के जलए िैजिक एव ं अन्य अहडताएं, अनभु व और आयु सीमा अनुसूची-IV म ेंयर्ा जवजनर्िष्टड अनसु ार होंगी। रटप्पण- कजनष्ठ कालमान, ज्येष्ठ कालमान, कजनष्ठ प्रिासजनक श्रेणी, प्रवरण श्रेणी और ज्येष्ठ प्रिासजनक श्रेणी म ें पिों की संख्या को अनुसचू ी-। के रटप्पण-2 म ें यर्ा जवजनर्िष्टड पिों की संयुि संख्या के भीतर परस्ट्पर जवजनमेय रूप स े संचाजलत दकया िा सकेगा।

7. ज्यष्ठे ता: (1) इन जनयमों के लागू होने की तारीख स े दकसी श्रेणी पर जनयुि सेवा के सिस्ट्यों की सापिे ज्येष्ठता उनकी संबंजधत श्रेणी म ें उनकी सापेि ज्यष्ठे ता द्वारा िाजसत होगी िो इन जनयमों के लागू होने की तारीख स े पहले जनधडररत की गई र्ी;

परंतु, यदि दकसी ऐस े सिस्ट्य की ज्यष्ठे ता इन जनयमों के प्रारंभ होने पर जविेष रूप स े जनधाडररत नहीं की गई हो, तो इस े सरकार के अंतगडत ऐसी समान सेवा के सिस्ट्यों पर लागू होने वाले जनयमों के अनसु ार संवगड जनयंत्रण प्राजधकारी द्वारा जनधाडररत दकया िाएगा।

(2) उपरोि उप जनयम (1) के अंतगडत न आन े वाल े मामलों के जलए ज्येष्ठता का जनधाडरण सरकार द्वारा इस उद्देश्य के जलए समय-समय पर िारी सामान्य अनिु ेिों के अनुसार दकया िाएगा।

8. पररवीिा और स्ट्र्ायीकरण: (1) कजनष्ठ कालमान श्रेणी म ें सीधी भती के माध्यम स े सेवा के जलए जनयुि प्रत्यके अजधकारी िो वषड की अवजध के जलए पररवीिा पर होगा और सीधी भती के माध्यम स े ज्येष्ठ वेतनमान श्रेणी और कजनष्ठ प्रिासजनक श्रेणी म ेंजनयुि प्रत्येक अजधकारी एक वष डकी अवजध के जलए पररवीिा पर होगा;

परंतु संवगड जनयंत्रण प्राजधकारी समय-समय पर सरकार द्वारा िारी अनिु ेिों के अनसु ार पररवीिा की अवजध बढा सकता है। परंतु इसके बाि दकसी भी पररवीिा अवजध के जवस्ट्तार का जनणडय पररवीिा की प्रारंजभक अवजध के समाप्त होने के तुरंत बाि और सामान्यतः जपछली पररवीिा अवजध की समाजप्त के आि सप्ताह के भीतर जलया िाए और उि अवजध के भीतर संबंजधत अजधकारी को इस जनणयड के कारणों सजहत जलजखत रूप म ें सूजचत दकया िाए।4 THEGAZETTEOFINDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(2) पररवीिा अवजध की समाजप्त या इसके जवस्ट्तार पर,अजधकाररयों को,यदि उन्ह ें स्ट्र्ायी जनयजु ि के जलए योग्य माना िाए, जनयजमत आधार पर उनकी जनयुजि म ें रखा िाएगा और यर्ाजस्ट्र्जत उपलब्ध वास्ट्तजवक ररजियों के अनुसार समय रहत े पुजष्ट की िाएगी।

(3) पररवीिा अवजध या उसके जवस्ट्तार के िौरान, यदि सरकार दक यह राय ह ै दक अजधकारी स्ट्र्ायी जनयजु ि के जलए योग्य नहीं ह,ै ऐसे म ें वह अजधकारी को कायडमुि कर सकती ह ै या उसे इस सेवा म ें जनयुजि स े पहल े उसके द्वारा धाररत पि पर वापस भिे सकती ह,ै िैसा भी मामला हो।

(4) पररवीिा अवजध के िौरान या उसके जवस्ट्तार के िौरान पररवीिा के संतोषिनक समापन की ितड के रूप म,ें िसै ा दक सरकार उजचत समझे, अभ्यर्र्डयों को सरकार द्वारा प्रजििण और जनिेिों के ऐसे पाठ्यक्मों म ें भाग लेने और परीिाओं तर्ा िांचों (जिसमें हहंिी म ें परीिा िाजमल ह)ै म ें उत्तीण डहोना अपेजित हो सकता है।

(5) पररवीिा स े संबंजधत दकसी भी अन्य मामलों के संबंध म ें सेवा के सिस्ट्य सरकार द्वारा इस जवषय पर समय-समय पर िारी अनुिेिों द्वारा िाजसत दकए िाएंगे।

(6) उन सभी मामलों में िो इसमें जविेष रूप स े उपबंजधत नहीं दकए गए ह,ैं पररवीिाधीन अजधकारी भारतीय रेल संजहताओं के उपबंधों और समय-समय पर संवगड जनयंत्रण प्राजधकारी द्वारा िारी दकए गए अन्य आिेिों अर्वा अनिु ेिों द्वारा िाजसत होंगे।

9. गजतिील सजु नजश्चत कैररयर प्रगजत योिना: (1) गजतिील सुजनजश्चत कैररयर प्रगजत योिना, संवगड जनयंत्रण प्राजधकारी द्वारा अनुसूची-।। म ें यर्ा जवजनर्िष्टड ररजियों पर ध्यान दिए जबना, सेवा के अजधकाररयों की समयबद्ध प्रोन्नजत के जलए तयै ार की गई योिना ह,ै ऐसे जनबंधन और ितों पर िो समय-समय पर सरकार द्वारा जवजनर्िष्टड की िाएं।

(2) ज्यष्ठे प्रिासजनक श्रेणी तक की प्रोन्नजतयों का ररजियों स े कोई संबंध नहीं होगा।

10. सवे ा म ेंजनयजु ि: सेवा म ेंसभी जनयुजियां सरकार द्वारा की िाएंगी।

11. अजधवर्षतड ा: (1) सेवा के सिस्ट्यों की अजधवर्षडता की आय ुबासि (62) वष डहोगी।

(2) यदि सेवा के सिस्ट्य पसैं ि वषड की आयु तक अपनी सेवा िारी रखने की इच्छा रखते हैं, तो उन्ह ें अपनी जविेषज्ञता और अनुभव के आधार पर, संवग ड जनयंत्रण प्राजधकारी द्वारा समय-समय पर यर्ाजवजनजश्चत अनुसार, दकसी नैिाजनक पि पर तैनाती का जवकल्प चुनना होगा और बासि वष ड की आय ु के पश्चात्, अजधकारी को अनुसचू ी-V म ें जवजनर्िडष्ट पिों के अलावा अन्य पिों पर िोन अर्वा उत्पािन इकाइयों म ें तैनात दकया िाएगा।

(3) बासि वष ड की आयु प्राप्त करने के पश्चात ् नैिाजनक पि पर तैनाती िेत्रीय रेल या उत्पािन इकाई म ें सेवा म ें समग्र स्ट्वीकृत संख्या बनाए रखने और प्रिासजनक सजु वधा के भी अध्यधीन होगी।

(4) सेवा के सेवारत सिस्ट्यों को नैिाजनक पि पर तैनाती के जलए अपना जवकल्प बासि वष ड की आय ु प्राप्त करने स े कम स े कम छह महीने पहल े प्रस्ट्तुत करना होगा और ऐसा जवकल्प सबं ंजधत रेल प्रिासन की कार्मडक िाखा के माध्यम स े प्रस्ट्तुत दकया िाना चाजहए।

(5) सेवा के व े सेवारत सिस्ट्य िो ऊपर जवजनर्िष्टड अवजध के भीतर जवकल्प का प्रयोग करने म ें असफल रहत े ह,ैं वे उस माह के अंजतम दिन की िोपहर को सेवा स े सेवाजनवृत्त हो िाएंगे जिसम ें वे बासि वष डकी आय ुपूरी करते हैं।

12. बासि वष डकी आय ुपरू ी करन ेके पश्चात ्सवे ा के सिस्ट्यों द्वारा धारण दकए िान ेवाल ेपिों के पिनाम: (1) यदि सेवा के सिस्ट्य 62 वषड की आयु पूरी करने स े पहले अपनी जविेषज्ञता और अनुभव के आधार पर दकसी निै ाजनक पि पर तैनाती का जवकल्प चनु ते ह,ैं तो उन्ह ें जनम्नानसु ार पुनपिड नाजमत दकया िाएगा:-[भागII—खण्ड 3(i)] भारत का रािपत्र : असाधारण 5 क्.स.ं बासि वष डकी आय ुपरू ी करन ेस ेपवू ड बासि वष डकी आय ुके पश्चात ्पिनाम धाररत वते नमान

(1) (2) (3)

1. िीषडमान प्रधान परामिी (स्ट्वास्ट््य)

2. उच्च प्रिासजनक श्रेणी वेतनमान मुख्य परामिी (स्ट्वास्ट््य)

3. ज्येष्ठ प्रिासजनक श्रेणी वेतनमान ज्येष्ठ परामिी (स्ट्वास्ट््य)

4. ज्येष्ठ प्रिासजनक श्रेणी वेतनमान स ेनीच े परामिी (स्ट्वास्ट््य)

(2) प्रधान परामिी (स्ट्वास्ट््य), मख्ु य परामिी (स्ट्वास्ट््य), ज्येष्ठ परामिी (स्ट्वास्ट््य) और परामिी (स्ट्वास्ट््य) के ऐसे नैिाजनक पि उसी वेतनमान म ेंसंचाजलत होंगे िो पिधारी को बासि वष डकी आयु प्राप्त करने स े पहल ेजमल रहा र्ा और तब तक िारी रहेगा िब तक दक पिधारी द्वारा अजधवर्षडता या अन्यर्ा ररि नहीं कर दिया िाता।

13. भारत के दकसी भी भाग म ें सवे ा के जलए िाजयत्व: सेवा म ें जनयुि कोई भी अजधकारी भारत या भारत स े बाहर कहीं भी, भूजम या अपतटीय िेत्र म ेंसेवा के जलए िायी होगा।

14. प्राइवटे प्रजे क्ट स पर प्रजतषधे : (1) सेवा म ें जनयुि व्यजियों को दकसी भी प्रकार के प्राइवेट प्रेजक्ट स की अनुमजत नहीं िी िाएगी, जिसम ें परामिड और प्रयोगिाला अभ्यास भी िाजमल है।

(2) तर्ाजप, सेवा म ें जनयुि व्यजि सभी श्रेजणयों अर्वा पिों पर सरकार अर्वा संवगड जनयंत्रण प्राजधकारी द्वारा समय-समय पर जवजनर्िडष्ट िरों पर व्यवसाय जनषेध भत्ते के हकिार होंगे।

15. अकृजत्यक उन्नयन: (1) सेवा की जवजभन्न श्रेजणयों म ें पात्र अजधकाररयों को (उच्चतर प्रिासजनक श्रेणी तक) जवभागीय छानबीन सजमजत की जसफाररि पर अकृजत्यक उन्नयन प्रिान दकया िाएगा, िसै ा दक अनुसचू ी-।।। म ें जवजनर्िष्टड है।

(2) िब भी संयुि संवगड वाले राज्य का कोई भारतीय प्रिासजनक सेवा अजधकारी को केंद्र म ें दकसी ऐसे जविेष श्रेणी में तैनात दकया िाता ह ैजिसमें वेतन मैररक्स म ें एक जवजिष्ट स्ट्तर का वेतन लेता ह,ै तो सेवा की उन बैचों के अजधकारी िो उस अजधकारी स े िो साल या उससे अजधक ज्येष्ठ ह ैं और अब तक उस जविेष श्रेणी म ें प्रोन्नत नहीं हुए ह,ैं उन्ह ें केंद्र म ें उस जवजिष्ट श्रेणी म ें भारतीय प्रिासजनक सेवा अजधकारी के रूप म ें तैनाती की तारीख स े अकृजत्यक आधार पर वही श्रेणी प्रिान की िाएगी।

(3) अकृजत्यक आधार पर उच्च वते न मान िेने के जलए अन्य जनबंधन और ितें समय-समय पर सरकार द्वारा इस मामल े में िारी आिेिों और अनिु ेिों के अनसु ार होंगी।

16. वते न, छुट्टी, पिें न और सवे ा की अन्य ितों का जवजनयमन: (1) जवजभन्न श्रेजणयों के अजधकाररयों का वते न, वेतनवृजद्ध, छुट्टी, पेंिन और सेवा की अन्य ितें भारतीय रेल स्ट्र्ापन संजहता जिल्ि । और जिल्ि ॥ और भारतीय रेल स्ट्र्ापन जनयमावली या सरकार अर्वा संवगड जनयंत्रण प्राजधकारी द्वारा समय-समय पर िारी अन्य सुसंगत अनुिेिों के अनसु ार जवजनयजमत होंगी।6 THEGAZETTEOFINDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(2) इन जनयमों म ें स्ट्पष्ट रूप स े उपबजं धत न दकए गए जवषयों के संबंध म ें सेवा के सिस्ट्यों की सेवा की अन्य ितें, यर्ावश्यक पररवतडन सजहत तर्ा सेवा की बाबत सरकार अर्वा संवगड जनयत्रं ण प्राजधकारी द्वारा िारी दकए गए दकसी जवजिष्ट आिेि के अध्यधीन वही होंगी िो सामान्यतः केन्द्रीय समूह 'क' सेवा के अजधकाररयों पर लाग ूहोती हैं।

17. जनरहडता- वह व्यजि - (क) जिसने ऐस ेव्यजि स े जिसका पजत या जिसकी पत्नी िीजवत ह,ै जववाह दकया ह,ै या जववाह की संजविा की ह;ै अर्वा (ख) जिसने अपन ेपजत या अपनी पत्नी के िीजवत रहत ेहुए दकसी व्यजि स ेजववाह दकया ह,ै या जववाह की संजविा की ह,ै उि पि के जलए जनयजु ि का पात्र नहीं होगा :

परंतु यदि संवगड जनयंत्रण प्राजधकारी का यह समाधान हो िाता ह ै दक ऐसा जववाह ऐसे व्यजि और जववाह के अन्य पिकार को लागू स्ट्वीय जवजध के अधीन अनुज्ञेय है और ऐसे करने के जलए अन्य आधार ह ैं तो वह दकसी व्यजि को इस जनयम के प्रवतडन से छूट ि ेसकेगा।

18. जिजर्ल करन े की िजि: िहां संवगड जनयंत्रण प्राजधकारी की यह राय ह ै दक ऐसा करना आवश्यक या समीचीन ह,ै वहा ं वह उसके जलए िो कारण ह,ैं उन्ह ें लेखबद्ध करके तर्ा आयोग स े परामिड करके इन जनयमों के दकसी भी उपबंध को दकसी वग ड या प्रवगड के व्यजियों की बाबत,आिेि द्वारा जिजर्ल कर सकेगा।

NOTIFICATION New Delhi, the 7th September, 2026 G.S.R. 784(E).— In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Railway Medical Service Recruitment Rules, 1999, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules, namely: –

1. Short title and commencement. –(1)These rules may be called the Indian Railway Health Service Rules, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions. – In these rules, unless the context otherwise requires, –

(a) “Administrative post” means any post as specified by the Cadre Controlling Authority from time to time as16 THEGAZETTEOFINDIA : EXTRAORDINARY [PART II—SEC. 3(i)] specified in Schedule V;

(b) “Cadre Controlling Authority” means the Ministry of Railways, Government of India;

(c)“clinical post” means a post other than the Administrative Posts defined as specified in Schedule V.

(d) “Commission” means the Union Public Service Commission;

(e) “Departmental Confirmation Committee” means a committee constituted to consider confirmation in any grade;

(f) “Departmental Promotion Committee” means a committee constituted to consider promotion, in any grade;

(g) “Departmental Screening Committee” means a committee constituted to consider the grant of Non-Functional Upgradation;

(h) “duty post” means any post included in Schedule I to these rules;

(i) “examination” means the Combined Medical Services Examination conducted by the Commission;

(j) “Government” means the Government of India;

(k) “grade” means grades of duty posts specified in Schedule I to these rules;

(l)“regular service” in relation to any grade means the period or periods of service in that grade rendered after selection and regular basis under the rules and includes any period or periods–

(i) taken into account for the purpose of seniority in the case of those appointed at the initial constitution of the service;

(ii) during which an officer would have held a duty post in that grade but for being on leave or otherwise not being available for holding such post;

(m) “Schedule” means the Schedules appended to these rules;

(n)“service” means the Indian Railway Health Service constituted under rule 3.

3. Constitution of the Service. – (1) The service shall consist of posts specified in Schedule I.

(2) All the duty posts in the service, as specified in the aforesaid Schedule shall be classified as Group ‘A’ posts.

4. Grades, strength and its review. – (1) The duty posts included in the various grades, designations, numbers and level in the pay matrix shall be as specified in Schedule I.

(2) Notwithstanding anything contained in sub-rule (1), the Government may by notification in Official Gazette, –

(a) make additions, alterations, substitutions or modifications to the number of duty posts or grades, designations and alter or modify the level in pay matrix as specified in Schedule I;

(b) in consultation with the Commission, include in the service any duty post or exclude from the service any duty post specified in Schedule I;

(c) in consultation with the Commission, appoint an officer to a duty post included in the service under clause (b) to the appropriate grade.

5. Member of the service. –All officers appointed to the service before the commencement of these rules and holding duty posts on regular basis in Junior Time Scale, Senior Time Scale, Junior Administrative Grade, Non- Functional Selection Grade, Senior Administrative Grade and Higher Administrative Grade of the Indian Railway Health Service as on the date of commencement of these rules shall be members of the service in the respective grades.[भागII—खण्ड 3(i)] भारत का रािपत्र : असाधारण 17

6. Future maintenance of service. – (1) The vacant post in any of the grades referred to in the Schedule I shall be filled in the manner provided under these rules.

(2) The method of recruitment, the field of selection for promotion including the minimum qualifying service in the immediate lower grade or lower grades, as the case may be, for appointment or promotion to the post in the respective grade and specialties concerned, included in the service shall be as specified in Schedule II.

(3) Hundred per cent. of the vacant duty posts in the grade of Junior Time Scale shall be filled by direct recruitment through Combined Medical Service Examination conducted by the Commission, as specified in Schedule II.

(4) Thirty per cent of duty posts in the grade of Senior Time Scale shall be filled by direct recruitment, as specified in Schedule II, in consultation with the commission.

(5) Ten per cent. of duty posts in the grade of Junior Administrative shall be filled by direct recruitment, as specified in Schedule II, in consultation with the Commission.

(6) The departmental promotions of duty post up to the grade of Senior Administrative Grade shall be made as specified in Schedule II without taking into account the vacancies and shall be made on the basis of selection from among the officers of the service on the recommendations of the Departmental Promotion Committee as specified in Schedule III.

(7) The educational and other qualifications, experience and age-limit for appointment to various duty posts in the service by direct recruitment shall be as specified in Schedule IV.

Note. – The number of posts in Junior Time Scale, Senior Time Scale, Junior Administrative Grade, Selection Grade and Senior Administrative Grade may be operated interchangeably within the combined strength of the posts as specified in Note 2 to Schedule I.

7. Seniority. – (1) The relative seniority of members of the service appointed to any grade shall be governed by their relative seniority in their respective grade, as determined before the date of commencement of these rules:

Provided that if the seniority of any such member had not been specifically determined on the commencement of these rules, it shall be determined by the Cadre Controlling Authority in accordance with the rules applicable to members of the similar services under the Government.

(2) The cases that are not covered under sub-rule (1) above, seniority shall be determined by the Government in accordance with the general instructions issued by the Government for the purpose, from time to time.

8. Probation and confirmation. –(1) Every officer appointed to the service in the grade of Junior Time Scale by direct recruitment shall be on probation for a period of two years and every officer appointed to the Senior Time

Scale Grade and Junior Administrative Grade by direct recruitment shall be on probation for a period of one year:

Provided that the Cadre Controlling Authority may extend the period of probation in accordance with the

instructions issued by the Government from time to time in this behalf:

Provided further that any decision for extension of probation period shall be taken immediately after the expiry of initial period of probation and ordinarily within eight weeks and communication in writing to the concerned officer together with the reasons for so doing within the said period.

(2) On completion of the period of probation or any extension thereof, officers shall, if considered fit for permanent appointment, be retained in their regular appointments on regular basis and be confirmed in due course against the available substantive vacancies.18 THEGAZETTEOFINDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(3) If, during the period of probation or any extension thereof, as the case may be, Government is of the opinion that an officer is not fit for permanent appointment, it may discharge or revert the officer, as the case may be, to the post held by him prior to his appointment in the service.

(4) During the period of probation, or any extension thereof, candidates may be required by Government to undergo such courses of training and instructions and to pass examination, and tests (including examination in Hindi) as Government may deem fit, as a condition to satisfactory completion of the probation.

(5) In any other matters relating to probation, the members of the service shall be governed by the instructions issued by the Government in this regard from time to time.

(6) In all matters not specifically provided for herein, the probationers shall be governed by the provisions of the Indian Railway Codes and other orders or instructions in force issued by the Cadre Controlling Authority from time to time.

9. Dynamic assured career progression scheme. – (1) The dynamic assured career progression scheme is the scheme formulated by Cadre Controlling Authority for time bound promotion of the officers of the service without taking into account the vacancies as specified in Schedule II, on such terms and conditions as may be specified by the Government from time to time.

(2) The promotions upto Senior Administrative Grade shall be without linkage to vacancies.

10. Appointment in the service. –All appointments to the service shall be made by the Government.

11. Superannuation. – (1) The age of superannuation of the members of the service shall be sixty-two years.

(2) If the members of the service desire to continue in their service upto the age of sixty-five years they need to exercise the option of posting to a clinical post depending upon their expertise and experience, as decided by the Cadre Controlling Authority and after the age of sixty-two years, the Officer shall be posted in the zones or production units in posts other than those specified in Schedule V.

(3) The posting to clinical post after attaining the age of sixty-two years will be subject to maintaining the overall sanctioned strength in the service in the Zonal Railway or Production Unit and also administrative convenience.

(4) The serving members of the service shall submit their option for posting to a clinical post not less than six months before their attaining the age of sixty-two years and such option shall be furnished through the personnel branch of the respective railway administration.

(5) The serving members of the service who fail to exercise the option within the period specified above, shall stand superannuated from service on the afternoon of the last day of the month in which they attain the age of sixty-two years.

12. Designations of posts to be held by members of the service after attaining the age of sixty-two years. – (1) In case members of the service exercise the option of posting to a clinical post depending upon their expertise and experience before attaining the age of sixty-two years, they will be re-designated as under: -[भागII—खण्ड 3(i)] भारत का रािपत्र : असाधारण 19 Sl. (2)The clinical posts of Principal Consultant (Health), Chief Consultant (Health), Senior Consultant (Health) and Consultant (Health) shall operate in the same scale, the incumbent was getting before attaining the age of sixty-two years and shall continue till the same is vacated by the incumbent on superannuation or otherwise.

13. Liability for service in any part of India. –The officer appointed to the service shall be liable to serve anywhere in India or outside, on land or offshore.

14. Prohibition of private practice. –(1) The persons appointed to the service shall not be allowed private practice of any kind whatsoever including any consultation and laboratory practice.

(2) The persons appointed to the service shall be entitled to a non-practicing allowance in all grades or posts at the rates specified by Government or Cadre Controlling Authority from time to time.

15. Non-Functional upgradation. – (1) The Non-Functional upgradation shall be granted to the eligible officers in various grades (upto Higher Administrative Grade) of the service on the recommendations of the Departmental Screening Committee, as specified in Schedule III.

(2) Whenever any Indian Administrative Service Officer of the State of Joint Cadre is posted at the Centre to a particular grade carrying pay in a specific level in the pay matrix, the officer belonging to batches of the service who are senior by two years or more and have not so far been promoted to that particular grade, shall be granted the same grade on non-functional basis from the date of posting of the Indian Administrative Service Officers in that particular grade at the Centre.

(3) The other terms and conditions for grant of higher pay scale on Non-Functional basis shall be as per orders and instructions issued in the matter by the Government from time to time.

16. Regulation of pay, leave, pension and other conditions of service. – (1) The pay, increments, leave, pension and other conditions of service of officers of the various grades shall be regulated in accordance with the Indian Railway Establishment Code Vol. I and Vol. II and Indian Railway Establishment Manual or other relevant instructions issued by the Government or Cadre Controlling Authority.

(2) The other conditions of service of the members of the service, in respect of matters not expressly provided for in these rules, shall, mutatis mutandis and subject to any special orders issued by the Government or Cadre Controlling Authority in respect of the service, be the same as those applicable to officers of the Central Group ‘A’ Service in general.20 THEGAZETTEOFINDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

17. Disqualification. –No person, –

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living has entered into or contracted marriage with any person,

shall be eligible for appointment to the service:

Provided that the Cadre Controlling Authority may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are grounds for doing so, exempt any person from the operation of this rule.

18. Power to relax. –Where the Cadre Controlling Authority is of the opinion that it is necessary or expedient to do so, it may by order for reasons to be recorded in writing and in consultation with the Commission, relax any of the provisions of these rules in respect of any class or category of persons.

19. Saving. –Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, other backward classes, economically weaker sections, persons with disabilities, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Government from time to time in this regard.

20. Medical Officer thirty-five (i) Degree in Bachelor of Medicine and Bachelor Level-10 in the pay matrix years. # of Surgery (MBBS) recognised by the National ( ₹ 56100-177500). Medical Commission as per the National Medical Commission Act, 2019 (30 of 2019);

(ii) Completion of Compulsory Rotating Internship-Candidates who may not have completed rotating internships shall be eligible to appear for the written examination provided that, if selected, they shall have satisfactorily completed the compulsory Internship before appointment.

# Note1: Relaxable for the Scheduled Caste, the Scheduled Tribes and certain other categories as notified by the Government from time to time.

Note 2: The crucial date for determining the age-limit shall be as advertised by Commission.

Note 3: The age-limit is relaxable for Government servant upto five years in accordance with the instructions or orders issued by the Government of India. @Note 4: The qualification is relaxable at the discretion of the Commission in case of candidates otherwise well qualified.

Note 5: The qualification regarding experience is relaxable at the discretion of the Commission in the case of candidates belonging to the Scheduled Castes or the Scheduled Tribes, if at any stage of selection, the Commission is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the vacancies reserved for them.
