1. (i) इन जवजनयमों को ''मेजडकल प्रैजटिसनर का पंिीकरण और जिककत्सा की प्रैजटिस करने के जलए लाइसेंस जवजनयम, 2023" कहा िाएगा।

(ii) ये रािपत्र में प्रकािन की तारीख को प्रवृत्त होंगे। अध्याय I प्रस्ट्तावना

2. पररभाषाएं : िब तक संिभि के तहत अन्यथा आवश्यकता न हो, इन जवजनयमों में जनम्नजलजखत का पररभाजषत अथ ि वही होगा िो नीिे किया गया ह ै - क. "अजतररि योग्यताएं" ऐसी योग्यताएं ह ैं िो एनएमसी अजधजनयम, 2019 के अध्याय VI के तहत जवजधवत 3107 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] मान्यता प्राप्त प्राथजमक जिककत्सा योग्यताओं के अलावा ह ैं और स्नातकोत्तर जिककत्सा जवजनयमों के अनुसार पंिीकृत मेजडकल प्रैजटिसनर द्वारा प्राप्त की गई ह।ैं ख. "जविेिी जिककत्सा स्नातक" ऐसा भारतीय नागररक होगा, जिसके पास राष्ट्रीय आयुर्विज्ञान आयोग द्वारा प्राथजमक जिककत्सा योग्यता के रूप में वतिमान में मान्यता प्राप्त आधुजनक / एलोपैजथक जिककत्सा पद्धजत की प्रैजटिस करन े के जलए जविेि म ें जस्ट्थत ककसीएक जवश्वजवद्यालय / संस्ट्थान से जवजधवत योग्यता ह ै परंत ु ककसी भारतीय जवश्वजवद्यालय या भारतीय मेजडकल कॉलेि या भारतीय सस्ट्ं थान स े प्राथजमक योग्यता (स्नातक जिककत्सा जडग्री) नहीं ह।ै ग. भारतीय आयुर्विज्ञान पररषि अजधजनयम, 1956 के तहत यथा पररभाजषत "भारतीय जिककत्सा रजिस्ट्िर", राष्ट्रीय जिककत्सा रजिस्ट्िर (एनएमआर) के लाग ू होने स े पवू ि राष्ट्रीय आयुर्विज्ञान आयोग के नैजतकता और जिककत्सा पंिीकरण बोड ि(ईएमआरबी) द्वारा अनुरजित ककया गया जिककत्सा रजिस्ट्िर। घ. "प्रायोिक/पयिवेिक" पंिीकृत मेजडकल प्रैजटिसनर होगा और उसके पास वैध जवजिष्ट पहिान (यूआईडी) संख्या होगी और उसके पास भारत म ेंप्रैजटिस करने का लाइसेंस होगा। ङ. "प्रायोजित जविेिी मेजडकल प्रैजटिसनर" का अजभप्राय ककसी जविेिी राष्ट्र के मेजडकल प्रैजटिसनर से होगा जिसे अस्ट्थायी पंिीकरण के जलए प्रायोजित ककया गया ह।ै ि. "अस्ट्थायी पंिीकरण" का अजभप्राय ककसी जविेिी मेजडकल प्रैजटिसनर के पंिीकरण से होगा, जिसे भारत म ें ककसी जवजिष्ट उद्देश्य के जलए और ऐसी ितों या ऐसी अन्य ितों के तहत एक जनर्िष्टि अवजध के जलए अस्ट्थायी पंिीकरण प्रिान ककया गया ह,ै िो इन जवजनयमों के तहत जनर्िष्टि की िा सकती ह।ैं इन जवजनयमों में प्रयुि और यहां पररभाजषत न ककए गए लेककन राष्ट्रीय आयुर्विज्ञान आयोग अजधजनयम में पररभाजषत ककए गए िब्िों और अजभव्यजियों का वही अथ िहोगा िो उन्ह ेंउस अजधजनयम म ेंकिया गया ह।ै अध्याय II

3. इंिनजि िप प्रजििण के जलए अनजं तम पिं ीकरण : i. ऐसा कोई भी व्यजि इंिनिजिप प्रजििण के उद्देश्य से अनंजतम रूप से पंिीकृत होने का हकिार होगा जिसने कोई मान्यता प्राप्त जिककत्सा योग्यता प्रिान करने के जलए भारत में ककसी जवश्वजवद्यालय या जिककत्सा संस्ट्थान की योग्यता परीिा उत्तीण ि की ह ै और अनंजतम पंिीकरण के जलए संबंजधत राज्य जिककत्सा पररषि के पास आवेिन ककया ह।ै ii. ऐसे ककसी व्यजि को भी संबंजधत राज्य जिककत्सा पररषि द्वारा इंिनिजिप करन े के जलए अनंजतम पंिीकरण प्रिान ककया िा सकता ह ै िो कोई जविेिी जिककत्सा योग्यता प्राप्त करता ह ै और अजधजनयम की धारा 15 के तहत आयोजित राष्ट्रीय जनकास परीिा (एनईएटसिी) उत्तीणि करता ह,ै और जविेिी जिककत्सा स्नातक जवजनयम, 2021 में जनर्िष्टि ितों को परू ा करता ह।ै अध्याय III

4. प्रजै टिस करन ेके जलए लाइससें के जलए राष्ट्रीय जिककत्सा रजिस्ट्िर (एनएमआर) म ेंपिं ीकरण : i. ऐसा कोई भी व्यजि एनएमआर में पंिीकरण के जलए पात्र होगा िो राष्ट्रीय आयुर्विज्ञान आयोग अजधजनयम, 2019 के तहत मान्यता प्राप्त कोई प्राथजमक जिककत्सा योग्यता प्राप्त करता ह ै और अजधजनयम की धारा 15 के तहत आयोजित राष्ट्रीय जनकास परीिा उत्तीणि करता ह।ै ii. जविेिी जिककत्सा स्नातक जवजनयम, 2021 म ें जनर्िष्टि ितों को पूरा करन े के अधीन, ऐसा व्यजि भी एनएमआर म ें पंिीकरण के जलए पात्र होगा िो कोई जविेिी जिककत्सा योग्यता प्राप्त करता ह ै और अजधजनयम की धारा 15 के तहत आयोजित राष्ट्रीय जनकास परीिा उत्तीणि करता ह।ै iii. जवजिष्ट पहिान (यआू ईडी) सख्ं या का सृिन : नैजतकता और जिककत्सा पंिीकरण बोडि (ईएमआरबी), राष्ट्रीय आयुर्विज्ञान आयोग (एनएमसी) द्वारा केंद्रीय रूप से यआू ईडी का सृिन ककया िाएगा और इस प्रकार प्रैजटिसनर[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 को एनएमआर म ेंपंिीकरण और भारत में जिककत्सा की प्रैजटिस करने की पात्रता प्रिान की िाएगी। iv. यूआईडी के सृिन के जलए प्रसंस्ट्करण िल्ु क (ईएमआरबी, एनएमसी द्वारा समय-समय पर यथा जनधािररत) सजिव, एनएमसी के पि में िेय होगा। िब तक ये जवजनयम और उपयिु धाराएं लागू रहगें ी, प्रैजटिस करने का लाइसेंस और पंिीकरण की प्रिजलत प्रणाली िारी रहगे ी।

5. राष्ट्रीय जिककत्सा रजिस्ट्िर : i. नैजतकता और जिककत्सा पंिीकरण बोडि मेजडकल प्रैजटिसनर का राष्ट्रीय रजिस्ट्िर अनरु जित करेगा। राष्ट्रीय रजिस्ट्िर में राज्य जिककत्सा पररषिों द्वारा अनुरजित सभी राज्य रजिस्ट्िर के पंिीकृत मेजडकल प्रैजटिसनर की सभी प्रजवजष्टयां होंगी। ii. राष्ट्रीय जिककत्सा रजिस्ट्िर को राष्ट्रीय आयुर्विज्ञान आयोग की वेबसाइि पर डालकर िनता के जलए उपलब्ध कराया िाएगा और यह मेजडकल प्रैजटिसनर के संबंध में जनम्नजलजखत िानकारी प्रिर्िित करेगा :

क) पंिीकरण संख्या ख) नाम ग) जपता का नाम घ) पंिीकरण की तारीख ङ) कायि करने का स्ट्थान (अस्ट्पताल/संस्ट्थान का नाम) ि) अजतररि जिककत्सा योग्यता सजहत जिककत्सा योग्यता छ) स्ट्पेजियजलिी ि) उत्तीणि होने का वष ि झ) जवश्वजवद्यालय ञ) संस्ट्थान (संस्ट्थानों)/जवश्वजवद्यालय (जवश्वजवद्यालयों) का नाम (िहां से योग्यता प्राप्त की गई ह)ै

6. जिककत्सा की प्रैजटिस करने के जलए लाइसेंस प्रिान करना : जिककत्सा की प्रजै टिस करन ेके जलए लाइससें के जलए आविे न करन ेकी प्रकक्रया : क) लाइसेंस प्राप्त करने के उद्देश्य से, कोई व्यजि नैजतकता और जिककत्सा पंिीकरण बोडि के वेब पोििल के माध्यम से ऐसे जववरण के साथ आवेिन कर सकता ह ैिो इलेटरॉजनक प्रारूप म ेंजनर्िष्टि ककए गए ह।ैं ख) पात्र व्यजि जिककत्सा की प्रैजटिस करन े के जलए ककसी भी राज्य/राज्यों को िनु सकता ह ै और वेब पोििल के माध्यम से ककए गए आवेिन को संबंजधत राज्य/राज्य जिककत्सा पररषि के पास भेिा िाएगा। ग) राज्य जिककत्सा पररषि स्ट्वयं को संतुष्ट करेगी और 30 किन की अवजध के भीतर उजित िुल्क लेन े के बाि उस राज्य में जिककत्सा की प्रैजटिस करने के जलए लाइसेंस िने े के आवेिन पर जविार करेगी। घ) लाइसेंस के प्रमाण पत्र में एक पंिीकरण संख्या िाजमल होगी िो इस तरह से बनाई िाएगी कक संबंजधत राज्य/संघ राज्य िेत्र के कोड के साथ एक जवजिष्ट पहिान संख्या िोडी िाएगी। ङ) राज्य जिककत्सा पररषि द्वारा आवेिन के अनुमोिन पर, इसे राष्ट्रीय जिककत्सा रजिस्ट्िर और राज्य जिककत्सा रजिस्ट्िर म ेंभी ििािया िाएगा।

7. अजतररि योग्यता का पिं ीकरण : i. िब भी एक पंिीकृत मेजडकल प्रैजटिसनर राष्ट्रीय आयुर्विज्ञान आयोग अजधजनयम, 2019 के तहत मान्यता प्राप्त अजतररि जिककत्सा योग्यता प्राप्त करेगा, राज्य रजिस्ट्िर/राष्ट्रीय रजिस्ट्िर म ें अपन े नाम के सामन े अजतररि4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] जिककत्सा योग्यता िि िकरन े के जलए संबंजधत राज्य जिककत्सा पररषि के पास आवेिन करेगा। ii. अजतररि योग्यता (योग्यताओं) के जलए आवेिन की िांि के बाि, अजतररि योग्यता (योग्यताओं) और अजतररि योग्यता ििि करन े की जतजथ को िाजमल करत े हुए आवेिक को उसी संख्या के साथ एक नया पंिीकरण प्रमाण पत्र िारी ककया िाएगा। iii. राज्य रजिस्ट्िर में अजतररि जिककत्सा योग्यता के पंिीकरण पर, राष्ट्रीय रजिस्ट्िर में मेजडकल प्रैजटिसनर के नाम के सामने उसकी प्रजवजष्ट स्ट्वतः हो िाएगी। iv. पंिीकृत अजतररि योग्यता वाले लाइसेंस प्राप्त प्रैजटिसनर को अजतररि ज्ञान और कौिल के अनुरूप, इसके सभी जविेषाजधकारों के साथ, िैसा भी मामला हो, भारत में कहीं भी अजतररि योग्यता के जलए यथा लागू जविेषज्ञता / सुपर जविेषज्ञता के िेत्र में प्रैजटिस करने की अनुमजत प्रिान की िाएगी। v. प्रमाण पत्र की वैधता अवजध का जववरण अजतररि योग्यता (योग्यताओं) को िाजमल करन े की तारीख के उल्लेख के साथ उसी रूप म ेंबना रहगे ा िो मूल प्रमाण पत्र में ह।ै vi. िब तक राष्ट्रीय रजिस्ट्िर लाग ूनहीं होता ह,ै अजतररि योग्यता के पंिीकरण की मौिूिा प्रणाली िारी रहगे ी।

8. जिककत्सा की प्रजै टिस करन ेके लाइससें का नवीनीकरण i. जिककत्सा की प्रैजटिस करने के जलए पंिीकृत मेजडकल प्रैजटिसनर को िारी ककया गया लाइसेंस पांि वषि की अवजध के जलए वैध होगा, जिसके बाि मेजडकल प्रैजटिसनर को इन जवजनयमों के खंड 6(ii) के तहत जनर्िष्टि प्रकक्रया के अनुसार राज्य जिककत्सा पररषि के पास आवेिन करके लाइसेंस का नवीनीकरण कराना होगा। ii. लाइसेंस की वैधता समाप्त होन ेसे तीन महीन े पहले लाइसेंस के नवीनीकरण के जलए आवेिन ककया िा सकता ह।ै iii. परंत ु यह कक यकि लाइसेंस की वैधता समाप्त होन े के तीन महीने के भीतर कोई आवेिन प्राप्त नहीं होगा, तो राज्य रजिस्ट्िर म ें मेजडकल प्रैजटिसनर के नाम की प्रजवजष्ट को जनजरक्रय के रूप म ें पररवर्तति कर किया िाएगा और वह व्यजि जिककत्सा की प्रैजटिस करने का हकिार नहीं होगा। राज्य रजिस्ट्िर म ें ककसी मेजडकल प्रजै टिसनर के नाम के सामने जस्ट्थजत - 'जनजरक्रय' की प्रजवजष्ट राष्ट्रीय रजिस्ट्िर में स्ट्वयमेव प्रजतबबंजबत होगी।

9. प्रजै टिस करन ेके लाइससें का स्ट्थानातं रण i. यकि राज्य जिककत्सा पररषि के साथ पंिीकृत कोई मेजडकल प्रैजटिसनर ककसी अन्य राज्य में जिककत्सा की प्रैजटिस करने का इच्छुक ह,ै तो वह इन जवजनयमों के खंड 6(ii) में जनर्िष्टि प्रकक्रया के अनसु ार नैजतकता और जिककत्सा पंिीकरण बोड िके वेब पोििल के माध्यम से संबंजधत राज्य के पास आवेिन कर सकता ह।ै ii. प्रैजटिस करने के लाइसेंस के स्ट्थानांतरण के जलए आवेिन िमा करने पर, उस राज्य जिककत्सा पररषि द्वारा सूिना प्राप्त की िाएगी िहां मजे डकल प्रैजटिसनर प्रैजटिस करन े के जलए पंिीकृत ह ै और राज्य जिककत्सा पररषि 30 किन की अवजध के भीतर प्रजै टिस करने के लाइसेंस के स्ट्थानांतरण के जलए आवेिन को मिं ूरी प्रिान करेगी, अगर उसे इस पर कोई आपजत्त नहीं होगी। iii. यकि पंिीकरण के स्ट्थानांतरण के जलए आवेिन की प्राजप्त से 30 किन के भीतर कोई जनणिय नहीं जलया िाता ह,ै तो उसे अनुमोकित माना िाएगा। iv. जिस राज्य में मेजडकल प्रैजटििनर प्रैजटिस करना िाहता ह,ै उस राज्य की राज्य जिककत्सा पररषि द्वारा प्रैजटिस करने के लाइसेंस के स्ट्थानांतरण के जलए आवेिन प्राप्त होने पर, उपरोि खडं (i) और (ii) की आवश्यकता के अधीन, उस राज्य में जिककत्सा की प्रैजटिस करन े के जलए प्रजै टिस करने का लाइसेंस प्रमाण पत्र िारी ककया िाएगा। परंत ु यह कक पंिीकरण की जवजिष्ट संख्या वही रहगे ी और संबंजधत राज्य/संघ राज्य िेत्र के पूविलग्न कोड को नए राज्य/संघ राज्य िेत्र के कोड से प्रजतस्ट्थाजपत ककया िाएगा। v. राज्य के संबंध म ेंककए गए पररवतिन राष्ट्रीय रजिस्ट्िर म ेंस्ट्वयमवे पररलजित होंगे।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5

10. पिं ीकरण को हिाना और बहाल करना i. यकि ककसी पंिीकृत मेजडकल प्रैजटिसनर का नाम राष्ट्रीय आयुर्विज्ञान आयोग द्वारा बनाए गए जवजनयमों के प्रावधानों के तहत स्ट्थायी या अस्ट्थायी रूप स े राज्य रजिस्ट्िर स े हिाया िाता ह,ै तो संबंजधत राज्य जिककत्सा पररषि राज्य रजिस्ट्िर मेंसंबंजधत मेजडकल प्रैजटिसनर के नाम के सामन ेइस आिय की प्रजवजष्ट करेगी। ii. राष्ट्रीय आयुर्विज्ञान आयोग द्वारा बनाए गए जवजनयमों के प्रावधानों के तहत राज्य रजिस्ट्िर में पंिीकृत ककसी पंिीकृत मेजडकल प्रैजटिसनर के नाम की बहाली पर, संबंजधत राज्य जिककत्सा पररषि राज्य रजिस्ट्िर मेंसंबंजधत मेजडकल प्रैजटिसनर के नाम के सामने इस आिय की प्रजवजष्ट करेगी। iii. नाम को हिान े या बहाल करने के जलए राज्य रजिस्ट्िर म ें की गई प्रजवजष्टयां राष्ट्रीय रजिस्ट्िर म ें स्ट्वयमेव पररलजित िगें ी।

11. अस्ट्थायी प्रावधान भारतीय जिककत्सा रजिस्ट्िर या राज्य जिककत्सा रजिस्ट्िर में नामांककत सभी मौिूिा मेजडकल प्रैजटिसनर, जिनके पास इन जवजनयमों के अनुसार पंिीकरण संख्या नहीं ह,ै एकबारगी उपाय के रूप में इन जवजनयमों के प्रकािन की तारीख से तीन महीने की अवजध के भीतर नैजतकता और जिककत्सा पंिीकरणबोडि के वेब पोििल में लाइसेंस को अद्यतन करेंगे और पंिीकरण संख्या प्राप्त करेंगे और इस प्रकार सृजित लाइसेंस िारी होने की तारीख से पांि साल की अवजध के जलए वैध होगा। ऐस े मेजडकल प्रैजटिसनर के लाइससें को अद्यतन करने के प्रयोिन के जलए, ईएमआरबी, एनएमसी द्वारा कोई िल्ु क नहीं जलया िाएगा।

12. प्रैजटिस करने के लाइसेंस स ेइनकार i. यकि राज्य जिककत्सा पररषि द्वारा प्रैजटिस करन/े नवीनीकरण के जलए लाइसेंस प्रिान करन े के आवेिन को ककसी भी आधार पर अस्ट्वीकार ककया िाता ह,ै तो संबंजधत आवेिक इस तरह के जनणिय की प्राजप्त की तारीख से तीस किन के भीतर राज्य जिककत्सा पररषि के जनणिय के जखलाफ नैजतकता और जिककत्सा पंिीकरण बोड ि के पास अपील िाजखल कर सकता ह।ै ii. ऐसी अपील जनम्नजलजखत के साथ सजिव, राष्ट्रीय आयुर्विज्ञान आयोग को प्रस्ट्ततु की िा सकती ह ै:

क. राज्य जिककत्सा पररषि को प्रस्ट्तुत मलू आवेिन। ख. यकि आवेिन की अस्ट्वीकृजत के जलए राज्य जिककत्सा पररषि से आििे / संिार प्राप्त हुआ ह ै तो उसकी प्रजतजलजप। ग. अस्ट्वीकृजत के आधारों का जवरोध करन े वाला एक जलजखत आविे न। घ. सजिव, एनएमसी के पि म ें िेय प्रसंस्ट्करण िल्ु क (ईएमआरबी, एनएमसी द्वारा समय-समय पर यथा जनधािररत)। iii. नैजतकता और जिककत्सा पंिीकरण बोड ि अपील की िांि करेगा और तीस किन के भीतर जनणिय लगे ा। यकि नैजतकता और जिककत्सा पंिीकरण बोड ि द्वारा अपील स्ट्वीकार की िाती ह,ै तो इसके द्वारा यह आििे पाररत ककया िा सकता ह ै कक राज्य जिककत्सा पररषि आवेिक को प्रैजटिस करन े के जलए लाइसेंस प्रिान करे और ईएमआरबी द्वारा इस तरह स े पाररत ककया गया आिेि राज्य जिककत्सा पररषि पर बाध्यकारी होगा। ऐस े मामल े में, राज्य जिककत्सा पररषि तत्काल और इस तरह के आििे की प्राजप्त की तारीख स ेअजधक स ेअजधक पद्रं ह किन के भीतर आवेिक को प्रैजटिस करन े का लाइसेंस प्रिान करेगी। iv. यकि ईएमआरबी द्वारा पहली अपील खाररि कर िी िाती ह,ै तो आवेिक ईएमआरबी स े संिार की प्राजप्त स े साठ किन की अवजध के भीतर एनएमसी के पास िसू री अपील िायर कर सकता ह।ै यकि एनएमसी द्वारा अपील स्ट्वीकार की िाती ह,ै तो खडं 12 (iii) के तहत जनर्िष्टि प्रकक्रया का पालन ककया िाएगा। एनएमसी का जनणिय अंजतम होगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] अध्याय IV

13. जविेिी मजे डकल प्रजै टिसनर का अस्ट्थायी पिं ीकरण : ऐसे जविेिी नागररक1 को भारत में जिककत्सा की प्रैजटिस करने के जलए प्रायोजित2 होने पर जनम्नजलजखत उद्देश्यों के जलए अस्ट्थायी पंिीकरण3 की अनुमजत4 प्रिान की िा सकती ह ैिो अपने ििे म ेंमेजडकल प्रैजटिसनर के पंिीकरण को जनयंजत्रत करन े वाले काननू के अनुसार मेजडकल प्रैजटिसनर के रूप में अपन ेिेि में नामांककत ह ै:

i. राष्ट्रीय आयुर्विज्ञान आयोग अजधजनयम, 2019 के तहत मान्यता प्राप्त स्नातकोत्तर और सुपर स्ट्पेजियजलिी पाठ्यक्रम करना। ii. फेलोजिप/प्रमाण पत्र पाठ्यक्रम/नैिाजनक अनुसधं ान/निै ाजनक प्रजििण/पयिवेिकता। iii. जविेषज्ञ िौरा - जिककत्सा पेिे के जवजभन्न िेत्रों म ें ऐसी आवश्यक तकनीकों/प्रकक्रयाओं म ें प्रजििण प्रिान करन े के जलए िो ििे म ेंउपलब्ध नहीं ह।ैं iv. स्ट्वैजच्छक नैिाजनक सेवा - सामुिाजयक सेवा करने के जलए डॉटिर के रूप में जवजिि करना।

13.1 आविे न करन ेकी प्रकक्रया :

13.1.1 स्नातकोत्तर और सपु र स्ट्पजे ियजलिी पाठ्यक्रम करन ेके जलए : i. उस िेि में मेजडकल प्रैजटिसनर के पंिीकरण को जवजनयजमत करन े वाले काननू के अनुसार मेजडकल प्रैजटिसनर के रूप म ें अपने ििे म ें नामांककत जवििे ी नागररक5 राष्ट्रीय आयुर्विज्ञान आयोग अजधजनयम, 2019 के तहत मान्यता प्राप्त जिककत्सा योग्यता में प्रवेि के जलए संबंजधत प्रवेि परीिा में बैठ सकता ह।ै ii. प्रवेि परीिा उत्तीण ि करने पर जविेिी नागररक ककसी भी सस्ट्ं थान म ें जिककत्सा पाठ्यक्रम में प्रवेि प्राप्त करता ह,ै नैजतकता और जिककत्सा पंिीकरण बोडि के वेब पोििल के माध्यम से जनम्नजलजखत िस्ट्तावेिों के साथ अस्ट्थायी पंिीकरण प्रिान करने के जलए एनएमसी के पास आवेिन कर सकता ह ै:

क. प्राथजमक जिककत्सा पाठ्यक्रम उत्तीणि करन े के िस्ट्तावेि/प्रमाण पत्र। ख. अपन ेिेि में मेजडकल प्रैजटिसनर के रूप में नामांककत होन े का प्रमाण पत्र। ग. प्रवेि परीिाओं का स्ट्कोर काडि। घ. प्रवेि के जलए संबंजधत परामि िप्राजधकरण द्वारा िारी ककया गया आवंिन पत्र ङ. जिककत्सा संस्ट्थान द्वारा िारी ककया गया प्रवेि पत्र। ि. सजिव, एनएमसी के पि में िेय प्रसंस्ट्करण िल्ु क (ईएमआरबी, एनएमसी द्वारा समय-समय पर यथा जनधािररत)। iii. आवेिन की िांि करन े पर, यकि उसे इन जवजनयमों म ें आवश्यकता के अनुसार सही पाया िाता ह,ै तो नैजतकता और जिककत्सा पंिीकरण बोडि स्नातकोत्तर/सुपर स्ट्पेजियजलिी पाठ्यक्रम की 1िेि में जविेिी नागररकों के अजधकार जविेिी अजधजनयम के प्रावधानों के तहत अजभिाजसत होते ह ैंऔर इसजलए कोई भी अनुमजत इस संबंध में गृह मंत्रालय द्वारा िारी ककए गए कििाजनिेिों/अजधसूिनाओं के अधीन होगी। 2उस िेि में मेजडकल प्रैजटिसनर के रूप में पंिीकृत जविेिी नागररक को आमंजत्रत / प्रायोजित करने से संबंजधत प्राजधकरण प्रायोजित व्यजि के आिरण के जलए जिम्मेिार होगा। 3यकि व्यजि ककसी भी जनयम/जवजनयम का उल्लंघन करता ह ै या जिककत्सा पेिे से बाहर की गजतजवजधयों में िाजमल पाया िाता है, तो अस्ट्थायी पंिीकरण रद्द ककया िा सकता ह।ै 4अस्ट्थायी पंिीकरण की अवजध अस्ट्थायी पंिीकरण की अंजतम जतजथ की समाजप्त पर या रजिस्ट्रैंि द्वारा धाररत वधै भारतीय वीिा की समाजप्त की जतजथ को, िो भी पहले हो, समाप्त हो िाएगी। 5अस्ट्थायी पंिीकरण िाहने वाले आवेिक को भारत सरकार द्वारा जनधािररत उपयुि वीिा प्रिान करना होगा।[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7 अवजध के जलए जविेिी नागररक को अस्ट्थायी पंिीकरण प्रिान कर सकता ह ै िो उस संस्ट्थान / मेजडकल कॉलेि तक सीजमत होगा जिसमें उसे प्रवेि किया गया ह।ै

13.1.2 फेलोजिप/निै ाजनक अनसु धं ान/निै ाजनक प्रजििण/पयवि िे ण आकि i. जविेिी नागररक को भारत में ककसी भी संस्ट्थान में आयोजित प्रजििण या िैिजणक पाठ्यक्रमों के माध्यम से अपने कौिल और िमता को बढाने के जलए फैलोजिप/नैिाजनक अनुसंधान/ नैिाजनक प्रजििण/पयिवेिण करने की अनुमजत प्रिान की िा सकती ह।ै ii. इस उद्देश्य के जलए, संस्ट्थान जनम्नजलजखत जववरण के साथ वेब पोििल के माध्यम स े नैजतकता और जिककत्सा पंिीकरण बोड िके पास आवेिन कर सकता ह ै:

क. जविेिी नागररक का नाम और पंिीकरण प्रमाण पत्र (यकि लागू हो) ख. पाठ्यक्रम सामग्री, अवजध, प्रजििण की सुजवधाओं, जििण और अवसंरिना सुजवधाओं से संबंजधत िानकारी (जववरण संस्ट्थान की वेबसाइि पर उपलब्ध होने िाजहए) ग. संस्ट्थान द्वारा जलए िा रह ेिल्ु क का जववरण। घ. सजिव, एनएमसी के पि म ें िेय प्रसंस्ट्करण िल्ु क (ईएमआरबी, एनएमसी द्वारा समय-समय पर यथा जनधािररत)। iii. आवेिन की िांि करन े पर, यकि उसे इन जवजनयमों म ें आवश्यकता के अनुसार सही पाया िाता ह,ै तो नैजतकता और जिककत्सा पंिीकरण बोड ि जविेिी नागररक के संबंध म ें अस्ट्थायी पंिीकरण प्रिान कर सकता ह ै िो अजधकतम 12 महीने6 की अवजध के जलए प्रिान ककया िाएगा जिसके बाि एक वषि की िीतलन अवजध होगी और यह कायिक्रम प्रायोजित करने वाले मेजडकल कॉलिे / संस्ट्थान/अस्ट्पताल तक सीजमत होगा।

13.1.3 जविषे ज्ञ िौरा : i. संस्ट्थान/मेजडकल कॉलेि/अस्ट्पताल उस िेि म ें मेजडकल प्रैजटिसनर के पंिीकरण को जवजनयजमत करने वाल े कानून के अनुसार अपने ििे म ें नामांककत ऐस े जविेिी नागररकों को आधुजनक जिककत्सा के मेजडकल प्रैजटिसनर के रूप में/या जिककत्सा पेिे के जवजभन्न िेत्रों म ें आवश्यक तकनीकों, प्रकक्रयाओं में प्रजििण प्रिान करने के उद्देश्य से सेजमनार/सम्मेलन/संगोष्ठी/कायििाला में संसाधन व्यजि के रूप म ें आमंजत्रत कर सकता ह ै जिनके पास संबंजधत जवषयों के अनरूु प जिककत्सा ज्ञान, अनुभव और कौिल ह।ै ii. इस उद्देश्य के जलए, संस्ट्थान जनम्नजलजखत जववरण के साथ वेब पोििल के माध्यम स े नैजतकता और जिककत्सा पंिीकरण बोड िके पास आवेिन कर सकता ह ै:

क. जविेिी नागररक का नाम और पंिीकरण प्रमाण पत्र ख. जविेिी नागररक की यात्रा के उद्देश्य स ेसंबंजधत िानकारी ग. संस्ट्थान द्वारा प्रिान ककए िा रह ेिुल्क / पाररश्रजमक का जववरण। घ. सजिव, एनएमसी के पि म ें िये प्रसंस्ट्करण िल्ु क (ईएमआरबी, एनएमसी द्वारा समय-समय पर यथा जनधािररत)। iii. आवेिन की िांि करन े पर, यकि उसे इन जवजनयमों म ें आवश्यकता के अनुसार सही पाया िाता ह,ै तो नैजतकता और जिककत्सा पंिीकरण बोड ि जविेिी नागररक के संबंध म ें अस्ट्थायी पंिीकरण प्रिान कर सकता ह ै िो कायिक्रम/िौरे की अवजध के जलए प्रिान ककया िाएगा और यह उस संस्ट्थान/मेजडकल कॉलेि/अस्ट्पताल तक सीजमत होगा जिससे वह संबद्ध ह।ै 6असाधारण पररजस्ट्थजतयों में ईएमआरबी मामले िर मामले के आधार पर उि अवजध में छूि प्रिान करने पर जविार कर सकता ह।ै8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

13.1.4 स्ट्वजै च्छक निै ाजनक सवे ा - i. संस्ट्थान /मेजडकल कॉलेि/अस्ट्पताल/आरएमपी सामुिाजयक सवे ा संपन्न करन े के उद्देश्य स े उस िेि म ें मेजडकल प्रैजटिसनर के पंिीकरण को जवजनयजमत करन े वाल े कानून के अनुसार मेजडकल प्रैजटिसनर के रूप म ें अपने ििे में नामांककत जविेिी नागररक की यात्रा को प्रायोजित कर सकता ह।ै ii. इस प्रयोिन के जलए, प्रायोिक प्राजधकारी जनम्नजलजखत जववरण के साथ वेब पोििल के माध्यम से नैजतकता और जिककत्सा पंिीकरण बोड िके पास आवेिन कर सकता ह ै:

क. जविेिी नागररक का नाम और पंिीकरण प्रमाण पत्र ख. सामुिाजयक सेवाओं से संबंजधत िानकारी ग. सजिव, एनएमसी के पि म ें िेय प्रसंस्ट्करण िुल्क (ईएमआरबी, एनएमसी द्वारा समय- समय पर यथा जनधािररत)। iii. आवेिन की िांि करन े पर, यकि उसे इन जवजनयमों म ें आवश्यकता के अनुसार सही पाया िाता ह,ै तो नैजतकता और जिककत्सा पंिीकरण बोड ि जविेिी नागररक के संबंध म ें अस्ट्थायी पंिीकरण प्रिान कर सकता ह ै िो अजधकतम 12 महीने की अवजध के जलए प्रिान ककया िाएगा जिसके बाि एक वषि की िीतलन अवजध होगी और यह कायिक्रम प्रायोजित करने वाले मेजडकल कॉलिे / संस्ट्थान / अस्ट्पताल तक सीजमत होगा। पंकि अग्रवाल, सजिव (I/c) [जवज्ञापन-III/4/असा./101/2023-24] NATIONAL MEDICAL COMMISSION (Ethics And Medical Registration Board)

NOTIFICATION New Delhi, the 10th May, 2023 No. R.15021/04/2022-EMRB-Reg.—Inexercise of the powers conferred by clauses (zj), (zk) and (zl) of sub

section (2) of section 57; of the National Medical Commission Act (30 of 2019), the National Medical Commission hereby makes the following Regulations.

1. (i) These Regulations may be called the “Registration of Medical Practitioners and Licence to Practice Medicine Regulations, 2023”.

(ii) They shall come into force from the date of their publication in the Official Gazette.

CHAPTER I Preliminary

2. Definitions:Unless the context demands otherwise, in these Regulations the followingshall have the defined meaning as below - a. “Additional Qualifications” are those qualifications other than the Primary Medical Qualifications duly recognized under Chapter VI of the NMC Act 2019 and obtained by Registered Medical Practitioner as per Post Graduate Medical Regulations.

b. “Foreign Medical Graduate” will be anIndian Citizen who has duly qualified to practice modern / allopathic system of medicine, as currently recognized as a Primary Medical Qualification by the National Medical Commission,from an university / institution overseas but does not have primary medical qualification (undergraduate medical degree), from an Indian university or Indian medical college or an Indian institution.

c. “Indian Medical Register” as defined under Indian Medical Council Act, 1956, the medical register maintained by Ethics & Medical Registration Board (EMRB) of the National Medical Commission before coming into force of the National Medical Register (NMR).[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 9 d. “Sponsor/supervisor” shall be a registered Medical Practitioner and having valid Unique Identification

(UID) Number and have licence to practice in India. e. “Sponsored foreignmedical Practioner” shall mean a medical practitioner of a foreign country who has been sponsored for temporary registration. f. “Temporary Registration” shall mean the registration of a Foreign Medical Practitioner who has been granted Temporary Registration for a specific purpose in India and for a specified period of time under such stipulation or such other conditions that may be specified under these Regulations.

Words and expressions used in these Regulations and not defined herein but defined in the National Medical Commission’s Act, shall have the same meaning assigned to them in that Act.

CHAPTER II

3. Provisional registrationfor Internship training: i. Any person who has passed the qualifying examination of any University or medical institution in India for the grant of a recognized medical qualification shall be entitled to be registered provisionally for the purpose of internship training and on an application made for provisional registration to the concerned State Medical Council.

ii. Any person who obtains a foreign medical qualification and qualifies the National Exit Test (NExT) held under section 15 of the Act, and fulfils conditions specified in the Foreign Medical Graduated Regulations, 2021 may also be granted provisionalregistration for doing internship by the concerned State Medical Council.

CHAPTER III

4. Registration in National Medical Register (NMR) for licence to practice: i. Any person who obtains a primary medical qualification recognized under the National Medical Commission Act, 2019 and qualifies the National Exit Test held under section 15 of the Act, shall be entitled for grant of registration in NMR.

ii. Any person who obtains a foreign medical qualification and qualifies the National Exit Test held under

section 15 of the Act, shall also be entitled for grant of registration in NMR, subject to fulfilment of conditions specified in the Foreign Medical Graduates Regulation, 2021. iii. Generation of Unique Identification (UID) Number: An UID shall be generated centrally by the Ethics & Medical Registration Board (EMRB), National Medical Commission (NMC) and thereby grant the practitioner, Registration in NMR and Eligibility to practice medicine in India.

iv. A processing fee for generation of UID (as prescribed by EMRB, NMC from time to time shall be payable), in favour of the Secretary, NMC.

Until such time that these Regulations and appropriate sections are in force, licence topractice and prevailing system of Registration shall continue.

5. National Medical Register: i. The Ethics and Medical Registration Board shall maintain a National Register of medical practitioner. The National Register shall contain all the entries of the registered medical practitioners of all State Register maintained by the State Medical Councils.

ii. The National Medical Register shall be made available to the public by placing it on the website of the National Medical Commission and shall display the following information in respect of a medical

practitioner: a) Registration No. b) Name: c) Father’s Name d) Date of Registration e) Place of Working (Name of the Hospital/Institute) f) Medical qualification including additional medical qualification g) Specialty h) Year of passing10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] i) University j) Name of the Institute(s)/University(s) (Where qualification obtained)

6. Grant of licence to practice medicine:

Procedure for making application for licence to practice medicine: a) For the purpose of obtaining licence, a person may apply through a web portal of the Ethics & Medical Registration Board containing such details as specified in the electronic format.

b) The eligible person may opt any State/States to practice medicine and the application so made through the web portal shall be referred to the concerned State/ States Medical Council. c) The State Medical Council shall satisfy themselves and consider the application for grantof licence to practice medicine in that state after charging appropriate fee within a period of 30 days.

d) The certificate of licence shall contain a registration number which shall be formed in such a way that a Unique Identification Number shall be suffixed with a Code of the concerned State/Union Territory.

e) On approval of the application by the State Medical Council, the same shall be reflected in the National Medical Register and alsoin the State Medical Register.

7. Registration of Additional Qualifications: i. As and when a Registered Medical practitioner, obtains additional medical qualification recognized under the National Medical Commission Act, 2019 shall apply to the concerned State Medical Council for entering additional medical qualification against his/her name in the State Register/National Register.

ii. After scrutiny of the application for Additional Qualification (s), a new Registration Certificate, with the same number, incorporating the additional qualification (s) and the date of entering the additional qualification, shall be issued to the applicant.

iii. On registration of additional medical qualification in the State Register, the entry thereof shall automatically be made against the name of the medical practitioner in the National Register. iv. A licenced Practitioner with registered Additional Qualifications shall be allowed to practice in the field of specialization/super-specializationcommensurate with additional knowledge and skill obtained, as applicable to the additional qualification anywhere in India with all its privileges as the case may be.

v. The details of the period of validity of the Certificate shall remain as in the original certificate with a mention of date incorporating the additional qualification (s). vi. Before, the National Register comes into force the existing system of the registration of the additional qualification shall continue.

8. Renewalof licence to practice medicine i. The licence to practice medicine issued to a registered medical practitioner shall be valid for a period of Five years after which the medical practitioner shall have to renew the licencing by making an application to the State Medical Council as per the procedure specified under clause 6 (ii) of these Regulations.

ii. The application for renewal of licence may be made before three month of expiration of the validity of licence. iii. Provided that if no application is received within three month of expiration of the validity of licence, the entry of the name of the medical practitioner in the State Register shall be converted as inactive and the person shall not be entitled to practice medicine. The entry of the status – ‘inactive’ made in the State Register against a medical practitioner, shall automatically reflected in the National Register.

9. Transfer of Licence to Practice i. If any medical practitioner registered with the State Medical Council, desirous to practice medicine in another State may apply to the concerned State through the web portal of the Ethics & Medical Registration Board in accordance with the procedure specific in Clause 6(ii) of these Regulations.

ii. On submission of an application for transfer of Licence to Practice, an intimation shall be received by the State Medical Council where the medical practitioner is registered for practice and the State Medical Council within a period of 30 days shall approve the application for transfer of Licence to Practice, if it has no objection thereon.

iii. If no decision is taken within 30 days of receipt of the transfer of registration the same shall be deemed to have been approved.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 11 iv. On receipt of an application for transfer of Licence to Practice by the State Medical Council of the state where the medical practitioner desires to practice, shall subject to the requirement of clause (i) and (ii) above, issue aLicence to Practice certificate to practice medicine in that state.

Provided that the unique number of the registration shall remain the same and the prefixed Code of the concerned State/Union Territory shall be substitute with the Code of the new State/Union Territory.

v. The changes made in respect of the State, shall automatically reflected in the National Register.

10. Removal and Restoration of Registration i. If the name of a registered medical practitioner is removed from the State Register under the provisions of the Regulations framed by the National Medical Commission, permanently or temporarily, the State Medical Council concerned, shall make an entry against the name of the concerned medical practitioner for the effect in the State Register.

ii. On restoration of name of any registered medical practitioner in the State register under the provision of the Regulations framed by the National Medical Commission, the State Medical Council concerned, shall make an entry against the name of the concerned medical practitioner for that effect in the State Register.

iii. The entries made for removal or restoration of name in the State Register, shall automatically reflected in the National Resister.

11. Transitory Provisions All the existing medical practitioner enrolled in the Indian Medical Register or the State Medical Register, not having the registration number as per these Regulation shall update in the web portal of the Ethics & Medical Registration Board within aperiod of three months of publishing of these Regulation and obtain the Registration Number as a onetime measure and the licence so generated shall be valid for periodof five years from the date of issuance. For the purpose of updating of licence of such medical practitioner, no fee shall be charged by EMRB, NMC.

12. Denial of Licence to Practice i. If the application of a candidate for grant of licence to practice /for renewal is rejected by the State Medical Council on any ground, the applicant concerned may file an appeal to the Ethics and Medical Registration Board against the decision of the State medical Council, within thirty days of receipt of such decision.

ii. Such an appeal may be submitted to the Secretary, National Medical Commission along with the following: a. Original application submitted to the State Medical Council. b. Copy if order/communication received from the State Medical Council for rejection of the appeal.

c. A written application contending the grounds of rejection. d. A processing fee (as prescribed by EMRB, NMC from time to time),in favour of the Secretary, NMC. iii. The Ethics and Medical Registration Board shall examine the appeal and take a decision within thirty days. If the appeal is allowed by the Ethics and Medical Registration Board, it may pass an order for the State Medical Council to grant licence to practice to the applicant and the order so passed by the EMRB shall by binding on the State Medical Council. In such case, the State Medical Council shall forthwith and not more than fifteen days of receipt of such order, shall grant licence to practice to the applicant.

iv. In case, the first appeal is rejected by the EMRB, the applicant may file a second appeal to the NMC, within a period of sixty days from receipt of communication form EMRB. If the appeal is allowed by the NMC, the procedure specified under clause 12 (iii) shall be followed. The decision of the NMC shall be final.12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

CHAPTER IV

13. Temporary registration to the foreign medical practitioner:

A foreign citizen1 7who is enrolled in hiscountry as a medical practitioner in accordance with the law regulating the registration of medical practitioners in that country on being sponsored28 to practice medicine in India may be permitted39 temporary registration410for the following purposes:

i. For pursuing Postgraduate and Super-Specialty courses recognized under the NationalMedical Commission Act, 2019. ii. Fellowship/Certificate Courses/Clinical Research/Clinical Training/Observership. iii. Expert Visit- for providing the training in techniques/procedures required in various areas of the medical profession and not available in the country.

iv. Voluntary Clinical Service- Visiting as a doctor for performing community service.

13.1. Procedure for making application:

13.1.1 For Pursuing Postgraduate and Super-Specialty courses: i. A foreign citizen5,11enrolled in his/her country as a medical practitioner in accordance with the law regulating the registration of medical practitioners in that country, may appear in the concerned entrance examinationfor admission to the medical qualification recognized under the National Medical Commission Act, 2019.

ii. The foreign citizen on qualifying the entrance exam gets admission in the medical course in any Institutemay apply to the NMC for grant of temporary registration along with the

following documents through the web portal of the Ethics and Medical Registration Board: a. Documents/ certificate of qualifying primary medical course. b. Certificate of enrolled in his country as a medical practitioner in that country c. Score Card of the entrance examinations d. Allotment Letter issued by the concerned Counselling Authority for admission e. Admission Letter issued by the Medical Institution.

f. A processing fee (as prescribed by EMRB, NMC from time to time), in favour of the Secretary, NMC. iii. On scrutiny of the application, if the same is found to be correct as required in these Regulations, the Ethics and Medical Registration Board may grant a temporary registration to the foreign national for the duration of the Post Graduate/ Super Specialty course limited to the Institute/ Medical College to which he/she is admitted.

13.1.2 Fellowship/Clinical Research/Clinical Training/Observership etc. i. A foreign citizen may be allowed to do Fellowship/Clinical Research/ Clinical training / Observership for enhancing their skill and competence through training or academic courses conducted in any Institute in India.

ii. For the purpose, the Institutemay apply to the Ethics and Medical Registration Board through

the web portal along with the following details: a) Name and registration certification of the foreign citizen (if applicable) 17The right of the Foreign Nationals in the country are governed under the provisions of the Foreigners Act and therefore any permission shall be subject to the Guidelines/Notifications issued by the Ministry of Home Affairs in this regard.

28The authority concerned with inviting/sponsoring a foreign national registered as a medical practitioner in that country shall be responsible for the conduct of the sponsored person.

39The temporary registration may be cancelled, if the person breaches any of the Rules/Regulation or is found to be involved in activities outside of medical profession.

410The duration of the temporary registration shall cease to be in operation on the end of the last date of the temporary registration or on the date of expiry of the valid Indian visa held by the registrant, whichever is earlier.

511The applicant seeking temporary registration shall have granted the appropriate visa prescribe by the Government of India.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 13 b) Information related to course content, duration, training facilities, teaching, and infrastructure facilities (details should be available on the website of the Institute) c) Details of fee being charged by the Institute.

d) A processing fee (as prescribed by EMRB, NMC from time to time), in favour of the Secretary, NMC. iii. On Scrutiny of the application, if the same is found to be correct as required in these regulations, the Ethics and Medical Registration Board may grant a temporary registration in respect of the foreign national which shall be provided for a maximum period of 12 months612followed by a cooling off period of one year and shall be limited to the medical college/institution/hospital sponsoring the programme.

13.1.3 Expert visit: i. A Institute/ Medical College/ Hospital may invite foreign citizen enrolled in his country as a medical practitioner of modern medicine in accordance with the law regulating the registration of medical practitioners in that country, who possess medical knowledge, experience and skills commensurate with the concerned subjects/or as a resource person in seminar/ conference/ symposia/workshop for the purpose of providing training in techniques, procedures required in various areas of medical profession.

ii. For the purpose, the Institute may apply to the Ethics and Medical Registration Board through

the web portal along with the following details: a) Name and registration certification of the foreign nationals b) Information related to the purpose of visit of foreign national c) Details of fee/remuneration being provided by the Institute.

d) A processing fee (as prescribed by EMRB, NMC from time to time), in favour of the Secretary, NMC. iii. On scrutiny of the application, if the same is found to be correct as required in these Regulations, the Ethics and Medical Registration Board may grant a temporary registration in respect of the foreign national which shall be provided for the duration of the programme/visit and shall be limited to the Institution/Medical College/Hospital to which he/she is attached.

13.1.4 Voluntary clinical service- i. A Institute /Medical College/Hospital/RMP may sponsor the visit of a foreign citizenenrolled in his country as a medical practitioner in accordance with the law regulating the registration of medical practitioners in that country, for the purpose of performing community service.

ii. For the purpose, the sponsoring authority may apply to the Ethics and Medical Registration

Board through the web portal along with the following details: a) Name and registration certification of the foreign nationals b) Information related the community services c) A processing fee (as prescribed by EMRB, NMC from time to time), in favour of the Secretary, NMC.

iii. On Scrutiny of the application, if the same is found to be correct as required in theseRegulation, the Ethics and Medical Registration Board may grant a temporary registration in respect of the foreign national which shall be provided for a maximum period of 12 months followed by a cooling period of one year and shall be limited to the medical college/institution/hospital sponsoring the programme.
