2. (1) इन पररजनयमों का संजक्षप्त नाम राष्ट्रीय औषध-जिक्षा और अनुसंधान संस्ट्थान (संिोधन) पररजनयम, 2023 ह ै।

(2) यह इनके रािपत्र म ें प्रकािन की तारीख को प्रर्ृत्त होंग े ।

3. राष्ट्रीय औषध-जिक्षा और अनुसंधान संस्ट्थान पररजनयमों में,- (क) पररजनयम 9 के स्ट्थान पर जनम्नजलजखत पररजनयम रखा िाएगा, अथातव ्:- “9. जनििे क की जनयजु क्त.- (i) संस्ट्थान का जनििे क, पांच र्ष व स े अनजधक की अर्जध के जलए, िो पांच र्षव की एक और अर्जध के जलए नर्ीकरणीय होगी, परंत ु ऊपरी आय ु सीमा सत्तर र्षव स े अजधक नहीं होगी, संजर्िा आधार पर कुलाध्यक्ष के पूर्व अनुमोिन स ेराष्ट्रीय औषध-जिक्षा और अनुसंधान संस्ट्थान पररषि ्द्वारा जनयुक्त दकया िाएगा । 6130 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(ii) संस्ट्थान का जनिेिक, संस्ट्थान और जनिेिक के मध्य की गई सेर्ा संजर्िा, िो अनुसूची के अनुसार िी गई ह,ै के जनबंधनों और ितों स ेिाजसत होगा ।”; (ख) पररजनयम 23 के पश्चात ् जनम्नजलजखत अनुसूची अंत:स्ट्थाजपत की िाएगी, अथावत:् - “अनसु चू ी कुलाध्यक्ष द्वारा जनयुक्त व्यजक्त की पांच र्षव के जलए संजर्िा पर संस्ट्थान के जनिेिक के रूप म ेंजनयुजक्त का अनुमोिन दकया िाता ह ै और जनयक्तु व्यजक्त, ऐसी जनयुजक्त को इसके पश्चात ् आने र्ाली जनबंधनों और ितों पर स्ट्र्ीकार करता ह ै । अत:, अब, उपजस्ट्थत साक्षी और इसके पक्षकार क्रमि: जनम्नजलजखत के जलए सहमत ह:ैं-

(1) सेर्ा का करार, हर समय इस अजधजनयम के उपबंधों के अधीन दकया गया समझा िाएगा, िो स्ट्थायी पष्टु दकए गए कमवचाररयों पर समय-समय पर यथा लाग ू के रूप म ें संस्ट्थानों को समाजर्ष्ट करते हुए प्रर्ृत्त होते ह ैं।

(2) जनयक्तु व्यजक्त, संजर्िा के अधीन पि धारण करने की तारीख स े पांच र्षव की अर्जध के जलए या सत्तर र्षव की आय ु प्राप्त करने तक, इनम ें स ेिो भी पहल े हो, सेर्ा पर रहगे ा ।

(3) जनयक्तु व्यजक्त, सस्ट्ं थान का प्रधान िैजक्षक और कायवकारी अजधकारी होगा और उक्त अजधजनयम म ें उपबंजधत िजक्तयों और कतवव्यों के साथ संस्ट्थान के पूणवकाजलक जनििे क के रूप में संस्ट्थान की सेर्ा करेगा ।

(4) जनयुक्त व्यजक्त, अपना परू ा समय संस्ट्थान की सेर्ा म ें समर्पवत करेगा और आचार जनयमों तथा उक्त जनयमों के अन्‍दय उपबंधों के अधीन होगा । जनयक्तु व्यजक्त द्वारा अपनी सेर्ा के िौरान या उसके संबंध म ें प्राप्त की गई कोई सूचना और र्ह काय व जिसके जलए र्ह जनयोजित ह,ै गुप्त और गोपनीय माना िाएगा और जनयक्तु व्यजक्त सभी पहलुओं म ें समय-समय पर यथा संिोजधत भारतीय िासकीय गुप्त बात अजधजनयम, 1923 (1923 का 19) के अधीन समझा िाएगा ।

(5) अपनी सेर्ा अर्जध के िौरान जनलंबन की दकसी भी अर्जध और जबना र्ेतन छुट्टी की दकसी अर्जध के भी जसर्ाय, जनयुक्त व्यजक्त भारतीय आयकर के अधीन िो लाख पच्चीस हिार (जनयत) के र्ेतनमान का हकिार होगा: परंत ु यदि दकसी भी समय जनयुक्त व्यजक्त भारत के बाहर प्रजतजनयुजक्त पर िाता ह,ै तो उसकी प्रजतजनयुजक्त के िौरान उसका र्ेतन और भत्त े ऐसे होंगे िो िासी बोड व द्वारा जर्जनजश्चत दकए िाए,ं इसके अजतररक्त जनयक्तु व्यजक्त महगं ाई भत्त,े नगर प्रजतकरात्मक भत्त,े आदि, िो संस्ट्थान के जनयमों के अनुसार समय-समय पर अनुज्ञये हों, आहररत करेगा ।

(6) इसम ें इसके पूर् व अंतर्र्वष्ट दकसी बात के होत े हुए भी जनयक्तु व्यजक्त, संस्ट्थान द्वारा िब तक अन्‍दयथा जर्जनजश्चत नहीं दकया िाए र्ेतनमान के पनु रीक्षण और सेर्ाजनर्ृजत्त फायिों म ें दकसी भी सुधार के फायिों को पणू वत: या भागत:, िो संस्ट्थान द्वारा अर्धाररत दकए िाए,ं प्राप्त करने का हकिार होगा, िो संस्ट्थान की उस िाखा के सेर्ा सिस्ट्यों के जनबंधनों और ितों म ें इन जर्लेखों की तारीख के अधीन रहत े हुए संस्ट्थान द्वारा प्रभार्ी हो सकेगा, जिस सेर्ा स े र्ह तत्समय संबंजधत हो, जनयुक्त व्यजक्त की सेर्ा के जनबंधनों और ितों म ें ऐसे सुधार की बाबत संस्ट्थान का जर्जनश्चय प्रचाजलत होगा, जिससे इन जर्लेखों के उपबंधों को उस जर्स्ट्तार तक उपांतररत दकया िा सके ।

(7) जनयुक्त व्यजक्त पररजनयमों के अधीन संस्ट्थान के स्ट्थायी गैर-प्रार्काि कमवचाररयों को अनज्ञु ेय छुट्टी के हकिार होंग े ।

(8) जनयक्तु व्यजक्त, संस्ट्थान के पररसर म ें अनुज्ञजप्त फीस स े मुक्त कायावलय-सह-आर्ासीय आर्ास सुजर्धा प्राप्त करने का हकिार होगा, िैसा संस्ट्थान के िासी बोडव द्वारा स्ट्र्ीकृत दकया िाए ।

(9) जनयुक्त व्यजक्त, जर्द्यमान जनयमों के अनसु ार जचदकत्सा सहायता और उपचार के संबंध म ें जर्िेषाजधकार का पात्र होगा ।

(10) जनयुक्त व्यजक्त को संस्ट्थान म ें पिग्रहण करन े के जलए केन्‍दरीय सरकार के स्ट्थानांतरण यात्रा भत्त े जनयमों के अधीन जनयुक्त व्यजक्त की जनयुजक्त को लोकजहत म ें स्ट्थानातं रण के रूप म ें मानते हुए केन्‍दरीय सरकार के समतुल्य पंजक्त के दकसी अजधकारी को अनुज्ञेय यात्रा भत्ते संित्त दकए िाएंगे । यदि जनयुक्त व्यजक्त स े संस्ट्थान के कायव के जहत म ें यात्रा दकया िाना[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 अपेजक्षत ह,ै तो र्ह संस्ट्थान के समय-समय पर प्रर्ृत्त यात्रा भत्ता जनयमों म ें उपबंजधत यात्रा भत्त े और र्ते नमान का हकिार होगा ।

(11) जनयुक्त व्यजक्त द्वारा अपने खचव पर प्रकाजित की गई पस्ट्ु तकों और लेखों स े प्राप्त कोई रकम उस क्षत्रे म ें अपना काम िारी रखने के जलए प्रोत्साहन के रूप म ेंउसके पास छोड़ िी िाएगी । उसे, बोड व द्वारा समय-समय पर अजधकजथत जनयमों के अनुसार परामि विेने और उसके लाभों को बनाए रखन े की अनमु जत भी िी िाएगी ।

(12) इस संजर्िा के अधीन सर्े ा के िौरान दकसी भी समय जनयुक्त व्यजक्त को कोई कारण बताए जबना तीन कैलेंडर मास उसकी जलजखत सूचना िेकर दकसी भी समय संस्ट्थान द्वारा संजर्िा की अर्जध के िौरान की सेर्ा का पयवर्सान दकया िा सकेगा:

परंत ु संस्ट्थान, यहा ं प्रित्त की गई सूचना के बिल े म ें जनयक्तु व्यजक्त को तीन महीन े के उसके मलू र्ेतन की रकम के समतुल्य राजि िे सकता ह ै । जनयुक्त व्यजक्त संस्ट्थान को तीन कैलडें र मास की जलजखत सूचना िेकर अपनी सेर्ाओं का पयवर्सान कर सकेगा ।

(13) जनयुक्त व्यजक्त को अपनी जर्िेषज्ञता के जर्भाग म ें प्राचायव की प्राजस्ट्थजत अनज्ञु ात की िाएगी और र्ह अपनी सुजर्धा के अधीन रहत े हुए उक्त जर्भाग म ें अध्यापन और अनुसंधान म ेंभाग लगे ा ।

(14) दकसी अन्‍दय जर्षय की बाबत, जिसके जलए इस करार म ें कोई उपबंध नहीं दकया गया ह,ै जनयुक्त व्यजक्त उक्त राष्ट्रीय औषध-जिक्षा और अनुसंधान संस्ट्थान अजधजनयम, 1998(1998 का 13) या तत्समय प्रर्ृत्त उसके दकसी उपांतरण और उसके अधीन बनाए गए पररजनयमों द्वारा िाजसत होगा । उपरोक्त जलजखत के साक्षी के रूप म ें संस्ट्थान के िासी बोडव के अध्यक्ष और जनयुक्त व्यजक्त न ेइसम ें पहले तारीख और र्षव जलखकर हस्ट्ताक्षर दकए ह ैं। हस्ट्ताक्षर और संस्ट्थान के िासी बोडव के द्वारा राष्ट्रीय औषध-जिक्षा और अनुसंधान सस्ट्ं थान के जलए पररित्त हस्ट्ताक्षररत पतों के साथ साजक्षयों के हस्ट्ताक्षर की उपजस्ट्थजत म ें और उक्त जनयक्तु व्यजक्त द्वारा---- साक्षी, पता-------------- की उपजस्ट्थजत म ें---------------------जनिेिक राष्ट्रीय औषध-जिक्षा और अनुसंधान संस्ट्थान को पररित्त दकया गया।” [स.ं 50013/3/2023-एनआईपीईआर] रिनीि ट ंगल, संयक्तु सजचर् र प्पण: राष्ट्रीय औषध-जिक्षा और अनुसंधान संस्ट्थान पररजनयम, भारत के रािपत्र, असाधारण, भाग 2, खंड 3, उपखंड (i) में सा.का.जन. स.ं 391, तारीख 30 अक्तूबर, 2003 द्वारा प्रकाजित दकए गए थ े और सा.का.जन. 113, तारीख 24 अगस्ट्त, 2022 द्वारा अंजतम संिोधन दकया गया था । MINISTRY OF CHEMICALS AND FERTILIZERS (Department of Pharmaceuticals)

NOTIFICATION New Delhi, the 25th September, 2023 G.S.R. 692(E) .— In pursuance of sub-section (I) of section 36 of the National Institute of Pharmaceutical Education and Research Act, 1998 (13 of 1998), the Central Government hereby makes the following amendments further to amend the first statutes of the National Institute of Pharmaceutical Education and Research made under

section 27 of the said Act by the Board of Governors of the Institutes with the previous approval of the Visitor,

2. (1) These Statutes may be called the National Institute of Pharmaceutical Education and Research (Amendment) Statutes, 2023.

(2) They shall come into force on the date of their publication in the Official Gazette.

3. In the National Institute of Pharmaceutical Education and Research Statutes,- (a) for statute 9, the following statute shall be substituted, namely:- “9. APPOINTMENT OF DIRECTOR.- (i) The Director of the Institute shall be appointed by the National Institute of Pharmaceutical Education and Research Council with the prior approval of the Visitor on a contract basis for a period not exceeding five years, renewable for one more term of five years provided that the upper-age limit does not exceed seventy years.

(ii) The Director of the Institute shall be governed by the terms and conditions of the contract of service entered into between the Institute and the Director which is given as per Schedule.’’;

(b) after statute 23, the following Schedule shall be inserted, namely:- “SCHEDULE The Visitor has been pleased to approve the appointment of the appointee as the Director of the Institute on contract for five years and the appointee has accepted such appointment upon the terms and conditions hereinafter appearing.

NOW THESE PRESENTS WITNESSTH and the parties hereto respectively agree as follows:-

[1] This agreement of service shall be deemed to have been entered into subject at all times to the provisions of the Act, covering the Institutes as in force from time to time as applicable to permanent confirmed employees.

[2] The appointee shall be on service under the agreement for a period of five years with effect from date of joining the post or till he attains the age of 70, whichever is earlier.

[3] The appointee shall be the Principal academic and Executive Officer of the Institute and serve the Institute as the whole time Director of the Institute with powers and duties provided in the said Act.

[4] The appointee shall devote his whole time to the service of the Institute and will be subject to the Conduct Rules and other provisions of the said Act. Any information obtained by appointee during or in connection with his service and the work upon which he is engaged shall be treated as secret and confidential and appointee shall be deemed in all respects to be subject to the Indian Officials Secrets Act, 1923 (19 of 1923), as amended from time to time.

[5] During the period of his service except in respect of any period of suspension and also of any period of leave without pay, the appointee shall be entitled subject to the Indian Income Tax to the Pay Scale of Rs. 2,25,000 (fixed)

provided that if any time the appointee proceeds on deputation out of India, his pay and allowances during the period his deputation will be such as may be decided by the Board of Governors in addition, the appointee shall draw allowances like Dearness Allowance, City Compensatory Allowance etc. as may be admissible from time to time as per rules of the Institute.

[6] Notwithstanding anything hereinbefore contained, the appointee shall unless otherwise decided by the Institute be entitled to receive the whole or in part as may be determined by the Institute the benefits of any improvements in the revision of scale of pay and in retirement benefits that may be affected by the Institute subject to the date of these presents in the terms and conditions of the service of members of the branch of Institute, service to which he may for the time being belong, the decision of the Institute in respect of such improvement in the terms and conditions of their service of appointee shall operate so as to modify to that extent the provisions of these presents.

[7] The appointee shall be entitled to leave as admissible to permanent non-vacation employees of the Institute under the Statues.

[8] The appointee shall be entitled to furnished free of license fee office cum residential accommodation in the campus of the Institute as may be sanctioned by the Board of Governors of the Institute.

[9] The appointee shall be eligible for privilege in relation to medical attendance and treatment as per existing rules.

[10] The appointee shall be paid travelling expenses for joining the Institute as admissible to an officer of the Central Government of equivalent rank under the Transfer Travelling Allowances Rules of the Central Government deeming the appointment of the appointee as on transfer in the public interest. If the appointee is required to travel in the interest of Institute work, he shall be entitled to travelling allowance and the scale provided for in the Travelling Allowances Rules of the Institute in force from time to time. Similarly the appointee shall be entitled to leave travel concession for visiting his hometown as per the Rules of the Institute.

[11] Any amount received by the appointee from books and articles published by him at his cost shall be left to him as an encouragement for continuing his work in that line. He would also be allowed to do consultancy and retain benefits of the same as per rules laid down by the Board from time to time.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5

[12] The service of appointee may during the period of contract, be terminated by the Institute at any time by three calendar months notice in writing given at any time during service under this contract without any cause assigned.

Provided always the Institute may in lieu of the notice herein provided to give the appointee a sum equivalent to the amount of his basic pay for three months. The appointee may terminate his service by giving to the Institute three calendar months notice in writing.

[13] The appointee will be allowed the status of Professor of the Department of his specialty and take part in teaching and research in the said Department subject to his Convenience.

[14] In respect of any matter for which no provision has been made in his agreement the appointee will be governed by the said National Institutes of pharmaceuticals Education and Research Act, 1998 (13 of 1998) or any modification thereof for the time being in force and the Statutes to be made thereunder.
