01.10.2007 से 31.10.2008 (सेवा-जनवृजत्त की जतजथ) तक तकनीकी सलािकार के उच्च पि के पूण ण अजतररक्त प्रभार को जनयजमत करने का आिेि िारी दकया िा रिा ि।ै इसके तित, उन्ि ें मौजलक जनयम 49(i) के प्रावधानों के अनुसार तकनीकी 8097 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 2] सलािकार के पूणण वेतनमान (जबना दकसी कटौती के) पाने का अजधकार िोगा, और इस पर मौजलक जनयम 35 के अतं गतण वेतन की कोई अजधकतम सीमा या प्रजतबंध लाग ू निीं िोगा। डॉ. िय ससंि के मामले में माननीय न्यायालयों/न्यायाजधकरण के जवजिष्ट जनिेिों के कायाणन्वयन म,ें उन्ि ें 'संयक्तु तकनीकी सलािकार' के पि पर पूवण प्रभावी तारीख स ेजनयजमत पिोन्नजत िी िाती ि ैऔर 'तकनीकी सलािकार' का अजतररक्त प्रभार संभालने के जलए एफआर 49(i) के तित जवत्तीय लाभ प्रिान दकए िाते ि।ैं ये लाभ इस मामले के जवजिष्ट तथ्यों को ध्यान में रखत े हुए केवल डॉ. िय ससंि को व्यजक्तगत रूप से दिए िाते ि ैं और इन्ि ें दकसी अन्य अजधकारी या मामले के जलए न तो जमसाल के रूप म ेंपेि दकया िा सकता ि ैऔर न िी इनका कोई व्यापक अनुप्रयोग िोगा। वेतन का औपचाररक पनु : जनधाणरण, पेंिन भगु तान आिेि (पीपीओ) में संिोधन, संिोजधत मत्ृ यु-सि-सेवाजनवृजत्त उपिान (डीसीआरिी), संिोजधत अवकाि नकिीकरण और न्यायालय के आिेिानुसार ब्लयाि सजित सभी बकाया राजियों का भुगतान, इस संबंध में िारी दकए िाने वाल ेअलग-अलग प्रिासजनक आिेिों के अनुसार से दकया िाएगा। करजलन खोंगवार ििे मुख, अपर सजचव MINISTRY OF WOMEN AND CHILD DEVELOPMENT (Nutrition Administration Division)

NOTIFICATION New Delhi, the 22nd October, 2026 F. No. NA-29/26/2015-NUTRITION ADMN.—In pursuance of the judgment dated 29.01.2025 passed by the Hon’ble Central Administrative Tribunal, Principal Bench, New Delhi in O.A. No. 4230/2016, upheld by the Hon’ble High Court of Delhi vide judgment dated 03.07.2026 in W.P.(C) No. 7435/2026, and following the dismissal of Special Leave Petition (Civil) No. 31483/2026 by the Hon’ble Supreme Court of India on 18.09.2026, and in compliance with the above orders, this order is being issued to appoint Dr. Jai Singh (retired), substantive Deputy Technical Advisor, on a regular promotion to the post of Joint Technical Advisor (JTA) (Group 'A', Gazetted) in the Food and Nutrition Board, Ministry of Women and Child Development, retrospectively with effect from 10.01.2007 (forenoon).

Consequent upon his retrospective regular promotion to the grade of Joint Technical Advisor, the order is being issued to regularize the full additional charge of the higher post of Technical Advisor (TA) held by Dr. Jai Singh for the period from 01.10.2007 to 31.10.2008 (date of superannuation) with entitlement to the unreduced pay scale of Technical Advisor under the provisions of Fundamental Rule 49(i), without the application of any pay ceiling or restriction under Fundamental Rule 35.

The retrospective regular promotion to the grade of Joint Technical Advisor and the financial benefits under FR 49(i) for the additional charge of Technical Advisor are granted strictly in implementation of the specific directions of the Hon’ble Courts/Tribunal in the case of Dr. Jai Singh. These benefits are granted strictly in personam to Dr. Jai Singh, having regard to the specific facts of this case, and shall not be cited as a precedent or have any wider application in respect of any other officer or case.

The formal pay re-fixation, revision of Pension Payment Order (PPO), revised Death-cum-Retirement Gratuity

(DCRG), revised Leave Encashment, and release of all consequential arrears along with the court-mandated interest shall be regulated through separate administrative orders issued in this behalf.
