1. सजं िप्त नाम और प्रारंभ — (1) इन जनयमों का संजिप्त नाम वाजणज्य पोत पररवहन (पत्तन सुरिा ब्यूरो) जनयम, 2026 ह।ै

(2) य ेरािपत्र में उनके प्रकािन की तारीख को लागू होंगे।

2. लाग ू होना — ये जनयम जनम्नजलजखत की सरु िा के संबंध में ‘पत्तन सुरिा ब्यूरो ' के कायगकलाप और प्रचालन पर लाग ू होंगे: – (क) पत्तन सुजवधाएं; और (ख) पत्तन सुजवधाओं में तनै ात वे िलयान िो िलयान-पत्तन इंटरफेस के काम म ेंलगे ह।ैं 7896 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

3. पररभाषाएं — (1) इन जनयमों में, िब तक दक संिभ गसे अन्यर्ा अपेजित न हो — (क) “अजधजनयम” स ेवाजणज्य पोत पररवहन अजधजनयम, 2025 (2025 का 24) अजभप्रेत ह;ै (ख) “प्रिासन” से अजधजनयम की धारा 7 के अधीन जनयिु समद्रु ी प्रिासन महाजनिेिक अजभप्रते ह;ै (ग) “ब्यूरो” से अजधजनयम की धारा 13 की उपधारा (1) के अधीन गरित पत्तन सुरिा ब्यूरो अजभप्रेत ह;ै (घ) “कंपनी” स ेअजधजनयम की धारा 115 की उपधारा (क) के अधीन यर्ापररभाजषत कंपनी अजभप्रेत ह;ै (ड.) “समुद्री जवजध प्रवतगन अजभकरण” स े भारतीय कोस्ट्ट गाडग, भारतीय नौसेना, सीमा िुल्क, तटीय पुजलस या कोई अन्य अजभकरण जिसे केंद्रीय सरकार द्वारा अजधसूजचत दकया िाए अजभप्रेत ह।ै ;

(च) “पत्तन सुजवधा सुरिा योिना” स ेएक ऐसी योिना अजभप्रेत ह ैजिससे यह सुजनजित दकया िा सके दक पत्तन सुजवधा और पत्तन सुजवधा के अतं गगत आन ेवाल ेपोतों, व्यजियों, कागो, कागो पररवहन ईकाईं और पोत के सामान को सुरिा घटनाओं की िोजखमों से संरजित रखन े हते ु बनाए गए उपायों को लागू दकया िाए;

(छ) “सुरिा घटना” से कोई भी ऐसी संदिग्ध कृत्य या पररजस्ट्र्जत जिससे दकसी पोत जिसमें मोबाइल ऑफिोर जिललंग यूजनट और तेज़ रफ़्तार वाला क्राफ़्ट भी िाजमल है, अर्वा पत्तन सुजवधा, या दकसी भी पोत और पत्तन के बीच के इंटरफेस, या पोत-स-े पोत के बीच होन े वाली दकसी दक्रयाकलाप की सुरिा को ख़तरा हो अजभप्रेत ह;ै (ि) “प्रजििण सुजवधा” से इन जनयमों के अधीन पत्तन सुरिा प्रजििण प्रिान करने के जलए ब्यरू ो द्वारा अनुमोदित कोई भी संस्ट्र्ान अजभप्रेत ह;ै और (झ) “िलयान-पत्तन इंटरफेस” ऐसी अंत: दक्रया से अजभप्रेत ह ैिो तब घरटत होती ह ैंिब कोई िलयान सीधे और तुरंत उन कायों से प्रभाजवत होता ह ै जिनम ें व्यजियों, माल या िलयान तक/से पत्तन सेवाओं की आवा-िाही िाजमल होती ह।ै

(2) इन जनयमों म ें प्रयुि िब्ि और अजभव्यजि, जिन्ह ें अजधजनयम म ें पररभाजषत नहीं दकया गया ह,ै उनका वही अर्ग होगा िो अजधजनयम म ें या सुरिा अजभसमय के अधीन 'इंटरनेिनल जिप एडं पोटग फैजसजलटी जसक्योररटी कोड' म ेंबताया गया ह।ै .

4. ब्यरू ो के काय ग–– ब्यूरो, पत्तन सुजवधाओं और िलयान-पत्तन इंटरफेस की सुरिा स ेिुड ेइन जनयमों के प्रावधानों के कायगन्वयन और प्रवतगन सुजनजित करन े के जलए उत्तरिायी होगा। इस प्रयोिन के जलए, वह पत्तन सुजवधाओं और िलयान-पत्तन इंटरफेस की सुरिा स ेिुडे ज़रूरी जवजनयामक, सुपरवाइज़री और जनगरानी वाले काय गकरेगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3

5. पत्तन सजु वधाओं और िलयानों-पत्तन इंटरफेस की सरु िा के जलए जनयामक ढाचं ा — ब्यूरो, पत्तन सुजवधाओं और िलयान- पत्तन इंटरफेस की सुरिा के जलए जनयामक ढांचा स्ट्र्ाजपत, लाग ू और बनाए रखगे ा, जिसम ें अन्य बातों के सार्-सार् जनम्नजलजखत उपबंध होगा — (क) पत्तन सुजवधाओं और िलयान-पत्तन इंटरफेस की सुरिा से संबंजधत मानक, दििाजनिेि और प्रदक्रयाएं;

(ख) पत्तन सुजवधाओं के वगीकरण के जलए िोजखम-आधाररत व्यवस्ट्र्ा, जिसमें पयागवरण को होने वाले खतरे, पररचालन संबंधी जविेषताओं और पत्तन सुजवधा की सुरिा स ेसंगत िलयानों की आवािाही की रीजत को ध्यान म ें रखा िाता ह;ै (ग) पत्तन सुजवधा सुरिा योिनाओं की समीिा, अनुमोिन और जनगरानी की प्रदक्रयाएं, और िलयान-पत्तन इंटरफेस के पत्तन-संबंधी पहलओंु से िडु ेमामलों पर केंद्रीय सरकार द्वारा प्राजधकृत व्यजि के सार् समन्वय की प्रदक्रयाएं;

(घ) पत्तन सुजवधाओं और िलयान-पत्तन इंटरफेस के जलए सरु िा उपायों को प्रभावी ढंग से लागू करने हते ु ज़रूरी सुरिा उपकरणों, कमगचाररयों और बुजनयािी ढांचे से िडु ी न्यनू तम आव‍यकताएं; (ड.) पत्तन सुजवधाओं और िलयान-पत्तन इंटरफेस के जलए सरु िा सेवाए ँ िेन े वाली जनिी सरु िा अजभकरणों को िाजमल करने की प्रदक्रया; और (च) इन जनयमों के अधीन स्ट्र्ाजपत जवजनयामक ढांच ेके अनुपालन की पुजि के प्रयोिन स ेपत्तन सुजवधाओं के जनरीिण, ऑजडट और पररचालन जनगरानी के जलए प्रोटोकॉल।

6. सरु िा सबं धं ी सचू ना का सग्रं हण, रखरखाव और आिान-प्रिान — (1) ब्यूरो, पत् तन सुजवधाओं और िलयान-पत्तन इंटरफेस से संबंजधत सुरिा संबंधी सूचना के समय पर संग्रहण, संकलन, रखरखाव और आिान-प्रिान के जलए तंत्र स्ट्र्ाजपत करेगा और इसका अनुरिण करेगा।

(2) उप-जनयम (1) की व्यापकता से पूवागग्रह के जबना, ब्यूरो— (क) सरु िा संबंधी सूचनाओं के आिान-प्रिान के जलए केंद्रीय सरकार, राज्य सरकारों, प्रिासन, पत्तन प्राजधकरणों और समुद्री जवजध प्रवतगन अजभकरणों के सार् संचार तंत्र स्ट्र्ाजपत करेगा और इसका अनुरिण करेगा;

(ख) पत्त न सुजवधाओं और िलयान- पत् तन इंटरफेस की सुरिा को प्रभाजवत करन ेवाले खतरों, सुरिा घटनाओं और कमिोररयों से संबंजधत ररकॉडग, ररपोटग और आकलन एकत्र करेगा, इनका अनुरिण करेगा और समय-समय पर इनका पुनर्वगलोकन करेगा;

(ग) सुरिा खतरों की रोकर्ाम, तैयारी, प्रिमन और प्रजतदक्रया को सुजवधािनक बनाने के जलए उजचत अजधकाररयों को सुसंगत सुरिा संबंधी सूचना समय पर प्रसाररत करना; (घ) सुजनजित करेगा दक सुरिा-संबंधी िानकारी का सग्रं हण, भंडारण, प्रसंस्ट्करण, प्रबंधन और प्रसार गोपनीयता, डाटा सुरिा और पररचालन सरु िा से संबंजधत लाग ूजवजधयों के अनुसार दकया िाता है; और (ङ) सुरिा खतरों, िोजखमों और संवेिनिीलता से संबंजधत िानकारी प्राप्त, साझा और अद्यतन करन े के जलए प्राजधकृत खुदफया और समुद्री सरु िा अजभकरणों के सार् समन्वय करेगा।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

7. सरकार, प्राजधकरणों और अन्य जहतधारकों के सार् समन्वय — (1) ब्यरू ो, पत् तन सुजवधाओं और िलयान- पत् तन इंटरफेस स े संबंजधत सुरिा उपायों के प्रभावी कायागन्वयन के जलए आव‍यकतानुसार केंद्रीय सरकार, राज्य सरकारों, प्रिासन, पत् तन प्राजधकरणों, समुद्री जवजध प्रवतनग अजभकरणों, पत् तन सुजवधा सुरिा अजधकाररयों, कंपजनयों और अन्य जहतधारकों के सार् समन्वय करेगा।

(2) उप-जनयम (1) की व्यापकता से पूवागग्रह के जबना, ब्यूरो— (क) इन जनयमों के अधीन जनर्ििग सुरिा मानकों, प्रदक्रयाओं और उपायों के एकसमान कायागन्वयन को बढावा िेने के जलए राज्य समुद्री बोडों, पत् तन प्राजधकरणों और पत् तन सुजवधा सुरिा के जलए गरित अन्य सजमजतयों के सार् जमलकर काम करेगा;

(ख) पत्त न सुजवधाओं और िलयान-पत्तन इंटरफेस पर सुरिा उपायों के संबंध में पत् तन सुजवधा सुरिा योिनाओं की समीिा, कायागन्वयन और जनगरानी के जलए पत् तन सुजवधा सुरिा अजधकाररयों के सार् और, िहां आव‍यक हो, कंपनी सुरिा अजधकाररयों के सार् समन्वय करेगा;

(ग) सुरिा-संबंधी िानकारी, खतरे के आकलन और घटना ररपोटों के आिान-प्रिान सजहत पत् तन सुजवधा सुरिा स े संबंजधत मामलों पर अंतर-अजभकरण समन्वय के जलए नोडल लबंि ुके रूप म ेंकायग करेगा; (घ) संबंजधत प्राजधकरणों के सार् समन्वय में पत् तन सुजवधाओं और िलयान-पत् तन इंटरफेस की सुरिा से संबंजधत संयुि जनरीिण, सुरिा मल्ू यांकन, लेखापरीिा, अभ्यास और समीिा सुजवधा प्रिान करेगा; और (ङ) सुसंगत प्राजधकाररयों और जहतधारकों को सुरिा तत्परता को मिबूत करने और इन जनयमों के अनुपालन के जलए तकनीकी और परामिी सहायता प्रिान करना।

8. सरु िा मानकों और दििा-जनिेिों का जनमाणग और िारी करना — (1) ब्यरू ो, अजधजनयम और इन जनयमों के उपबंधों के अनुरूप, पत् तन सुजवधाओं और िलयान-पत् तन इंटरफेस की सुरिा स े संबंजधत सुरिा मानकों, दििा-जनिेि और प्रदक्रयाए ं तैयार करेगा, उन् ह ें िारी करेगा और समय-समय पर उनकी समीिा करेगा और अद्यतन करेगा।

(2) िलयानों और िलयान-पत्त न इंटरफेस की सुरिा के जलए मानकों, दििा-जनिेिों और प्रदक्रयाओं में जनम्न जलजखत िाजमल हो सकत े ह—ैं (क) पत् तन सुजवधाओं और िलयान-पत् तन इंटरफेस की सुरिा के जलए यर्ाआव‍यक पहुचँ जनयंत्रण, जनगरानी, मॉनीटररंग, स्ट्क्रीलनंग, ग‍त और अन्य सुरिा उपायों से संबंजधत मानक और जवजििताएँ;

(ख) सुरिा प्रौद्योजगदकयों, साइबर सुरिा, संचार प्रणाजलयों और आपातकालीन प्रजतदक्रया व्यवस्ट्र्ाओं की तैनाती और उपयोग से संबंजधत उपाय; (ग) सुरिा िोजखम मल्ू यांकन, सुरिा जिल और अभ्यास, लेखापरीिा, जनरीिण, पनु र्वगलोकन और प्रििगन मूल्यांकन के जलए पद्धजतयाँ और प्रदक्रयाएँ;

(घ) सुरिा खतरों और सुरिा घटनाओं के प्रजत समन्वय, तैयारी और प्रजतदक्रया के सुिढृ ीकरण के उपाय; और[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (ङ) पत् तन सुजवधाओं और िलयान-पत् तन इंटरफेस की सुरिा के जलए आव‍यक अन्य ऐसे सुरिा उपाय, िो राष्ट्रीय सुरिा आव‍यकताओं और केंद्रीय सरकार द्वारा िारी दकसी भी जनिेि के अनुरूप हों।

(3) ब्यरू ो इस जनयम के अधीन िारी सुरिा मानकों, दििाजनििे ों और प्रदक्रयाओं स ेसंबंजधत प्राजधकरणों और जहतधारकों को उस तरीके से सूजचत, इन् ह ें प्रकाजित या अन्यर्ा संप्रेजषत करेगा, िैसा वह उजचत समझे।

9. सरु िा प्रजििण और िमता जनमाणग — (1) ब्यरू ो, पत्तन सुजवधाओं और िलयान-पत्तन इंटरफेस की सुरिा में लगे कार्मगकों के कौिल और सुरिा संबंधी िागरूकता को बढाने के जलए प्रजििण और िमता जनमाणग कायगक्रम तैयार करेगा, उनका कायागन्वयन करेगा तर्ा उनकी जनगरानी करेगा।

(2) उपजनयम (1) की व्यापकता पर प्रजतकूल प्रभाव डाले जबना, ब्यरू ो— (क) पत्तन सुजवधाओं और िलयान-पत्तन इंटरफेस की सुरिा से संबंजधत प्रजििण प्रिान करने के जलए प्रजििण सुजवधाएं स्ट्र्ाजपत करेगा या उन्ह ेंअनुमोदित करेगा;

(ख) पत्तन प्राजधकरणों, पत्तन सजु वधा सुरिा अजधकाररयों, कंपनी सुरिा अजधकाररयों, पोत सरु िा अजधकाररयों तर्ा ऐसे अन्य कार्मगकों, जिन्ह ेंआव‍यक समझा िाए, के जलए प्रजििण कायगक्रमों, कायगिालाओं, संगोजियों, अभ्यासों और कवायिों का आयोिन और संचालन करेगा;

(ग) राष्ट्रीय सरु िा संबंधी अपेिाओं, उभरत ेखतरों, प्रौद्योजगकीय जवकास और अतं रराष्ट्रीय सवोत्तम पद्धजतयों को ध्यान में रखत े हुए प्रजििण पाठ्यक्रमों, मॉड्यलू ों और सामजग्रयों का जवकास और पुनरीिण करेगा तर्ा उन्ह ें समय- समय पर अद्यतन करेगा;

(घ) कार्मगकों की सिमता और जनरंतर सुधार सुजनजित करन े के जलए उनके प्रजििण, प्रमाणन और मल्ू यांकन स े संबंजधत अजभलेख रखेगा; (ङ) पररचालनगत तत्परता और सुरिा अनुपालन को सुिढृ करने के जलए पत्तन प्राजधकरणों, समुद्री जवजध प्रवतगन अजभकरणों और अन्य संबंजधत प्राजधकरणों को तकनीकी मागगििगन और परामिी सहायता प्रिान करेगा; और (च) प्रजििण और िमता जनमागण कायगक्रमों की प्रभाविीलता की जनगरानी और मूल्यांकन करेगा तर्ा उनके जनरंतर सुधार के जलए ऐसे उपाय करेगा, िो आव‍यक हों।

(3) ब्यूरो, प्रजििण मानकों के जवकास, उनके कायागन्वयन और जनरंतर सुधार के जलए राष्ट्रीय और अंतरराष्ट्रीय सगं िनों, िैिजणक एवं प्रजििण संस्ट्र्ानों, व्यावसाजयक जनकायों तर्ा अन्य संबंजधत अजभकरणों के सार् सहयोग कर सकेगा, तादक उि मानक अद्यतन, प्रभावी और उभरते समुद्री सुरिा खतरों के अनरूु प बन े रह।ें

10. सरु िा जनयम-पजु स्ट्तकाओं, मानक प्रचालन प्रदक्रयाओं और प्रोटोकॉलों को तयै ार करना और उनका रखरखाव — (1) ब्यूरो, इन जनयमों के अनुसार पत्तन सुजवधाओं और िलयान-पत्तन इंटरफेस की सरु िा के जलए सुरिा जनयम पुजस्ट्तकाएं, मानक प्रचालन प्रदक्रयाएं और पररचालनगत प्रोटोकॉल तैयार करेगा, उनका रखरखाव करेगा तर्ा उन्ह ें समय-समय पर अद्यतन करेगा।

(2) पूवगगामी उपबंध की व्यापकता पर प्रजतकूल प्रभाव डाल ेजबना, ब्यरू ो—6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (क) पत्तन सुजवधाओं और िलयान-पत्तन इंटरफेस के जलए प्रवेि जनयंत्रण, जनगरानी, िांच, ग‍त और आपातकालीन प्रजतदक्रया से संबंजधत सुरिा जनयम-पुजस्ट्तकाएं और मानक प्रचालन प्रदक्रयाएं जवकजसत करेगा;

(ख) पत्तन प्राजधकरणों, पत्तन सुजवधा सुरिा अजधकाररयों, समुद्री जवजध प्रवतगन अजभकरणों और अन्य संबंजधत जहतधारकों के बीच समन्वय, ररपोर्टिंग और संचार के जलए प्रोटोकॉल िारी करेगा; (ग) सरु िा उपायों की पररचालनगत तत्परता और प्रभाविीलता सुजनजित करन े के जलए पत्तन सुजवधाओं और िलयान-पत्तन इंटरफेस के संबंध में सुरिा संपरीिाओं, जिल्स और अभ्यासों के संचालन तर्ा घटनाओं की ररपोर्टिंग के जलए प्रदक्रयाएं स्ट्र्ाजपत करेगा; और (घ) सभी सुरिा जनयम-पुजस्ट्तकाओं, मानक प्रचालन प्रदक्रयाओं और पररचालनगत प्रोटोकॉलों के अजभलेख रखेगा तर्ा उनका समय-समय पर पनु रीिण करेगा।

(3) इस जनयम के अधीन तैयार की गई सरु िा जनयम- पुजस्ट्तकाएं, मानक प्रचालन प्रदक्रयाएं और पररचालनगत प्रोटोकॉल— (क) अजधजनयम, इन जनयमों और लाग ूअंतरराष्ट्रीय समुद्री अजभसमयों के उपबधं ों के अनुरूप होंग ेतर्ा राष्ट्रीय समुद्री सुरिा उद्दे‍यों के सार् सरं ेजखत होंगे;

(ख) कायागन्वयन के जलए संबंजधत प्राजधकरणों और अन्य संबंजधत जहतधारकों को पररचाजलत दकए िाएंगे; और (ग) पत्तन सुजवधाओं और िलयान-पत्तन इंटरफेस के जलए िोजखम न्यूनीकरण, घटना प्रबंधन और सुरिा उपायों के कायागन्वयन के संबंध में मागगििनग प्रिान करेंगे।

(4) ब्यूरो, इस जनयम के अधीन तैयार की गई दकसी सुरिा जनयम-पुजस्ट्तका, मानक प्रचालन प्रदक्रया और पररचालनगत प्रोटोकॉल का ऐस ेअंतरालों पर, जिन्ह ेंवह आव‍यक समझे, अर्वा िब भी जनम्नजलजखत को ध्यान म ें रखत े हुए अपेजित हो, पुनर्वगलोकन और पुनरीिण कर सकेगा— (क) उभरते या जवकजसत होते सुरिा खतरे;

(ख) प्रौद्योजगकीय जवकास; (ग) लाग ूजवजधयों, जनयमों या अंतरराष्ट्रीय िाजयत्वों में पररवतनग ; अर्वा (घ) सुरिा संपरीिाओं, जिल्स, अभ्यासों या सुरिा घटनाओं से प्राप्त अनुभव।

11. सपं रीिा, पनु र्वलग ोकन और ररपोर्टिंग— (1) ब्यूरो, अजधजनयम और इन जनयमों के अनपु ालन की जनगरानी करन ेके जलए पत्तन सुजवधाओं और िलयान-पत्तन इंटरफेस पर कायागजन्वत सुरिा उपायों की संपरीिा और पुनर्वगलोकन हते ु तंत्र स्ट्र्ाजपत करेगा तर्ा उनका रखरखाव करेगा।

(2) पूवगगामी उपबंध की व्यापकता पर प्रजतकूल प्रभाव डाल ेजबना, ब्यरू ो—[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 (क) सुरिा मानकों, मानक प्रचालन प्रदक्रयाओं, सुरिा योिनाओं और ब्यूरो द्वारा िारी जनििे ों के अनपु ालन की पुजि करने के जलए पत्तन सुजवधाओं की आवजधक संपरीिाएं और जनरीिण करेगा। स्ट्पिीकरण— इस खंड के प्रयोिनों के जलए, “आवजधक संपरीिा” से ब्यरू ो द्वारा आििे के माध्यम से जवजनर्ििग अंतरालों पर अर्वा केंद्रीय सरकार द्वारा अनुमोदित मानक प्रचालन प्रदक्रयाओं के अनुसार की गई संपरीिाए ं अजभप्रेत ह;ैं (ख) पत्तन प्राजधकरणों और पत्तन सुजवधा सुरिा अजधकाररयों द्वारा प्रस्ट्तुत पत्तन सुजवधाओं तर्ा िलयान-पत्तन इंटरफेस से संबंजधत सरु िा योिनाओं, प्रचालन प्रदक्रयाओं और घटना ररपोटों का पुनर्वगलोकन करेगा;

(ग) कायागजन्वत सुरिा उपायों की प्रभाविीलता का आकलन करेगा और सुधारात्मक या जनवारक कारगवाई अपेजित करने वाली कजमयों की पहचान करेगा; और (घ) ररपोर्टिंग, जनगरानी और अनुवती कारगवाई के प्रयोिनों के जलए सभी संपरीिाओं, पुनर्वगलोकनों, जनष्कषों, जसफाररिों और सुधारात्मक कारगवाइयों के अजभलेख रखगे ा।

(3) ब्यूरो, संपरीिा जनष्कषों, आकलनों और जसफाररिों की समयबद्ध ररपोर्टिंग के जलए प्रदक्रयाएं स्ट्र्ाजपत करेगा— (क) केंद्रीय सरकार को; (ख) प्रिासन को; और (ग) िहा ंसमन्वय के प्रयोिनों के जलए अपेजित हो, वहां पत्तन सुजवधाओं और िलयान-पत्तन इंटरफेस की सरु िा स े संबंजधत समुद्री जवजध प्रवतगन अजभकरणों को।

(4) इस जनयम के अधीन की गई संपरीिाओं और पुनर्वगलोकनों से प्राप्त जनष्कषों और जसफाररिों का उपयोग जनम्नजलजखत के जलए दकया िाएगा— (क) सुरिा िोजखम आकलनों को अद्यतन करने तर्ा सुरिा उपायों और प्रचालन प्रदक्रयाओं को सुिढृ करन ेके जलए;

(ख) प्रजििण, िमता जनमागण और तैयारी संबंधी अपेिाओं की पहचान करने के जलए; और (ग) जचजननत सरु िा कजमयों या असुरजितताओं के जनवारण के जलए इन जनयमों के अधीन जनिेि िारी करने म ें सहायता प्रिान करने के जलए।

12. सरु िा स्ट्तरों के जलए प्रजतदक्रया उपाय- (1) ब्यरू ो, पत्तन सुजवधाओं और िलयान-पत्तन इंटरफेस के संबंध म ें अजधजनयम की धारा 129 की उपधारा (3) के अधीन जनधागररत सुरिा स्ट्तरों स े संबंजधत प्रजतदक्रया तंत्र स्ट्र्ाजपत और उसका रखरखाव करेगा।

(2) उप-जनयम (1) की व्यापकता पर प्रजतकूल प्रभाव डाल ेजबना, ब्यरू ो- (क) अजधजनयम की धारा 129 की उप-धारा (3) के अधीन जवजनर्िगि प्रत्येक सरु िा स्ट्तर के जलए, खतरे के आकलन और प्रचालनात्मक आवियकताओं को ध्यान म ें रखत े हुए, पत्तन सुजवधाओं और िलयान-पत्तन इंटरफेस पर लाग ू दकए िाने वाले सरु िा उपायों को जवजनर्िगि करें;8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) आसूचना इनपुट्स, सुरिा जनिेिों या सुरिा घटनाओं की प्रजतदक्रया म ें सरु िा उपायों म ें वृजद्ध और जनयंजत्रत करने संबंधी प्रदक्रया जवजनर्िगि करे;

(ग) प्रजतदक्रया उपायों के प्रभावी कायगनवायन के जलए पत्तन प्राजधकाररयों, पत्तन सुजवधा सुरिा अजधकाररयों, समुद्रीय प्रिासन महाजनिेिालय और समुद्रीय जवजध प्रवतगन अजभकरणों के सार् समन्वय; (घ) प्रजतदक्रया उपायों की प्रभाविीलता की जनगरानी करें और उनके जनरंतर सुधार के जलए यर्ाआव‍यक मागगििगन या जनिेि िारी करें; और (ङ) प्रत्येक सुरिा स्ट्तर के जलए उपयुि अजतररि सरु िा उपायों के कायागन्वयन पर पत्तन प्राजधकरणों और पत्तन सुजवधा सुरिा अजधकाररयों को मागगििगन प्रिान करेगा।

(3) ब्यूरो, पत्तन सुजवधाओं और िलयान-पत्तन इंटरफेस की तैयारी और प्रजतदक्रया िमताओं का आकलन करन ेके जलए सुरिा जिल, अभ्यास और जसमलु ेिन आयोजित कर सकता ह ैया इनके आयोिन की आव‍यकता रख सकता ह।ै ।

(4) ब्यूरो जनम्नजलजखत का ररकॉडग रखगे ा - (क) अजधजनयम की धारा 129 की उप-धारा (3) के अधीन जनधागररत सुरिा स्ट्तर; (ख) प्रत्येक ऐसे सरु िा स्ट्तर के संबंध में पत्तन सुजवधाओं और िलयान-पत्तन इंटरफेस पर कायागजन्वत प्रजतदक्रया उपाय; और (ग) सुरिा से िडु ी घटनाओं, जिल और अभ्यास से जमली िानकारी, नतीिों और सीख का उपयोग;

और ऐस ेररकॉडग का उपयोग िोजखम का आकलन करने, सरु िा ऑजडट करने, प्रचालनात्मक योिना और सुरिा से िडु े जनिेि िारी करन े के जलए दकया िाएगा।

13. प्रिासजनक जनयत्रं ण और िासी ढाचं ा - (1) ब्यरू ो, केंद्रीय सरकार के प्रिासजनक जनयंत्रण के अधीन काय ग करेगा और समय-समय पर इसके द्वारा िारी दकए गए जनििे ों का अनुपालन करेगा।

(2) ब्यूरो, इस अजधजनयम और इन जनयमों के अधीन अपन ेकायों का जनवगहन करते हुए, ' अंतरागष्ट्रीय समुद्र म ेंिीवन की सुरिा अजभसमय, 1974, 'अंतरागष्ट्रीय पोत और पत्तन सुजवधा सुरिा संजहता' और ऐसे अन्य प्रयोज्य अंतराष्ट्रग ीय समुद्री अजभसमयों के अनुसार काम करेगा, जिन्ह ेंइस अजधजनयम या इसके अधीन बने जनयमों के अतं गगत लागू दकया गया ह।ै ।

NOTIFICATION New Delhi, the 14th October, 2026.

G.S.R. 883(E).– In exercise of the powers conferred by sub-section (1) and clauses (c) and (d) of sub-section (2) of section 319 of the Merchant Shipping Act, 2025 (24 of 2025), the Central Government hereby makes the following rules, namely: –

1. Short title and commencement. — (1) These rules may be called the Merchant Shipping (Bureau of Port Security) Rules, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application. — These rules shall apply to the functioning and operations of the Bureau of Port Security in relation to the security of the following, namely: –

(a) port facilities; and

(b) vessels in port facilities engaged in vessel-port interface.

3. Definitions. — (1) In these rules, unless the context otherwise requires—

(a) “Act” means the Merchant Shipping Act, 2025 (24 of 2025);

(b) “Administration” means the Director-General of Maritime Administration appointed under section 7 of the Act;

(c) “Bureau” means the Bureau of Port Security, constituted under sub-section (1) of

section 13 of the Act;

(d) “company” means as defined under sub-section (a) of section 115 of the Act;

(e) “maritime law enforcement agencies” means the Indian Coast Guard, Indian Navy, Customs, Coastal Police or any other agency as may be notified by the Central Government;

(f) “port facility security plan” means a plan to ensure the application of measures designed to protect the port facility and ships, persons, cargo, cargo transport units and stores of ship within the port facility from the risks of a security incident;

(g) “security incident” means any suspicious act or circumstance threatening the security of a ship, including a mobile offshore drilling unit and a high-speed craft, or of a port facility or of any ship and port interface, or any ship-to-ship activity;

(h) “training facility” means any institution approved by the Bureau for imparting port security training under these rules; and10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(i) “vessel-port interface” means the interactions that occur when a vessel is directly and immediately affected by actions involving the movement of persons, goods or the provisions of port services to or from the vessel.

(2) The words and expressions used in these rules but not defined in the Act shall have the meanings respectively assigned to them in the Act or the International Ship and Port Facility Security Code under the Safety Convention.

4. Functions of Bureau. –– The Bureau shall be responsible for ensuring the implementation and enforcement of the provisions of these rules in relation to the security of port facilities and the vessel-port interface and for the said purpose, exercise such regulatory, supervisory and oversight functions as may be necessary in relation to the security of port facilities and vessel-port interface.

5. Regulatory framework for security of port facilities and vessels-port interface. — The Bureau shall establish, implement and maintain the regulatory framework for the security of port facilities and the vessel-port interface, which shall, inter alia, provide for—

(a) standards, guidelines and procedures relating to the security of port facilities and the vessel-port interface;

(b) a risk-based mechanism for the categorisation of port facilities, having regard to the threat to environment, operational characteristics and vessel movement patterns relevant to port facility security;

(c) procedures for the review, approval and monitoring of port facility security plans, and for coordination with the person authorised by the Central Government on matters relating to the port- side aspects of the vessel-port interface;

(d) minimum requirements relating to security equipment, personnel and infrastructure necessary for the effective implementation of security measures for port facilities and the vessel-port interface;

(e) mechanism for engagement of the private security agencies engaged in providing security services for port facilities and vessel-port interface; and

(f) protocols for inspections, audits and operational monitoring of port facilities for the purpose of verifying compliance with the regulatory framework established under these rules.

6. Collection, maintenance and exchange of security information. — (1) The Bureau shall establish and maintain mechanisms for the timely collection, collation, maintenance and exchange of security related information relating to port facilities and vessel-port interface.

(2) Without prejudice to the generality of sub-rule (1), the Bureau shall—

(a) establish and maintain communication mechanisms with the Central Government, State Governments, the Administration, port authorities and maritime law enforcement agencies for the exchange of security-related information;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 11

(b) collect, maintain and periodically review records, reports and assessments relating to threats, security incidents and vulnerabilities affecting the security of port facilities and the vessel-port interface;

(c) disseminate relevant security-related information to the appropriate authorities in a timely manner to facilitate the prevention of, or preparedness for, mitigation of and response to security threats;

(d) ensure that the collection, storage, processing, handling and dissemination of security-related information are carried out in accordance with the applicable laws relating to confidentiality, data protection and operational security; and

(e) coordinate with authorised intelligence and maritime security agencies for obtaining, sharing and updating information relating to security threats, risks and vulnerabilities.

7. Coordination with Government, authorities and other stakeholders. — (1) The Bureau shall coordinate with the Central Government, State Governments, the Administration, Port authorities, maritime law enforcement agencies, port facility security officers, companies, and other stakeholders as may be necessary for the effective implementation of security measures relating to port facilities and the vessel-port interface.

(2) Without prejudice to the generality of sub-rule (1), the Bureau shall—

(a) engage with State Maritime Boards, port authorities and other committees constituted for port facility security to promote the uniform implementation of the security standards, procedures and measures specified under these rules;

(b) coordinate with port facility security officers for the review, implementation and monitoring of port facility security plans and, where necessary, with company security officers in relation to security measures at port facilities and the vessel-port interface;

(c) serve as the nodal point for inter-agency coordination on matters relating to port facility security, including the exchange of security-related information, threat assessments and incident reports;

(d) facilitate joint inspections, security assessments, audits, exercises and reviews relating to the security of port facilities and the vessel-port interface in coordination with the relevant authorities;

and

(e) provide technical and advisory support to the relevant authorities and stakeholders for strengthening security preparedness, and compliance with these rules.

8. Formulation and issuance of security standards and guidelines. — (1) The Bureau shall formulate, issue and periodically review and update security standards, guidelines and procedures relating to the security of port facilities and the vessel-port interface, consistent with the provisions of the Act and these rules.

(2) The standards, guidelines and procedures for the security of vessels and the vessel-port interface may include—

(a) standards and specifications relating to access control, surveillance, monitoring, screening, patrolling and such other security measures as may be necessary for the security of port facilities and the vessel-port interface;12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(b) measures relating to the deployment and use of security technologies, cybersecurity, communication systems and emergency response arrangements;

(c) methodologies and procedures for security risk assessment, security drills and exercises, audits, inspections, reviews and performance evaluation;

(d) measures for strengthening coordination, preparedness and response to security threats and security incidents; and

(e) such other security measures as may be necessary for the protection of port facilities and the vessel-port interface, consistent with national security requirements and any directions issued by the Central Government.

(3) The Bureau shall notify, publish or otherwise communicate the security standards, guidelines and procedures issued under this rule to the relevant authorities and stakeholders, in such manner as it considers appropriate.

9. Security Training and Capacity Building. — (1) Security training and capacity building. — (1) The Bureau shall formulate, implement and oversee training and capacity-building programmes for enhancing the skills and security awareness of personnel engaged in the security of port facilities and the vessel-port interface.

(2) Without prejudice to the generality of sub-rule (1), the Bureau shall—

(a) establish or approve training facilities for imparting training relating to the security of port facilities and the vessel-port interface;

(b) organise and conduct training programmes, workshops, seminars, drills and exercises for port authorities, port facility security officers, company security officers, ship security officers and such other personnel as may be considered necessary;

(c) develop, review and periodically update training curricula, modules, and materials having regard to national security requirements, emerging threats, technological developments and international best practices;

(d) maintain records relating to training, certification and evaluation of personnel for ensuring competence and continuous improvement;

(e) provide technical guidance and advisory support to port authorities, maritime law enforcement agencies and other relevant authorities for strengthening operational preparedness and security compliance; and

(f) monitor and evaluate the effectiveness of training and capacity-building programmes and take such measures as may be necessary for their continuous improvement.

(3) The Bureau may collaborate with national and international organisations, educational and training institutions, professional bodies and other relevant agencies for the development, delivery and continuous improvement of training standards that remain current, effective and responsive to evolving maritime security threats.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 13

10. Preparation and maintenance of security manuals, standard operating procedures and protocols. — (1) The Bureau shall prepare, maintain, and periodically update security manuals, standard operating procedures and operational protocols for the security of port facilities and the vessel-port interface, in accordance with these rules.

(2) Without prejudice to the generality of the foregoing, the Bureau shall—

(a) develop security manuals and standard operating procedures relating to access control, surveillance, screening, patrolling and emergency response for port facilities and the vessel-port interface;

(b) issue protocols for coordination, reporting and communication among port authorities, port facility security officers, maritime law enforcement agencies and other relevant stakeholders;

(c) establish procedures for the conduct of security audits, drills, exercises and incident reporting in respect of port facilities and the vessel-port interface to ensure the operational readiness and effectiveness of security measures; and

(d) maintain and periodically review records of all security manuals, standard operating procedures and operational protocols.

(3) The security manuals, standard operating procedures and operational protocols prepared under this rule shall—

(a) be consistent with the provisions of the Act, these rules and applicable international maritime conventions, and aligned with national maritime security objectives;

(b) be disseminated to the concerned authorities and other relevant stakeholders for implementation; and

(c) provide guidance on risk mitigation, incident management and the implementation of security measures for port facilities and the vessel-port interface.

(4) The Bureau may review and revise any security manual, standard operating procedure and operational protocol prepared under this rule at such intervals as it considers necessary or whenever required having regard to—

(a) emerging or evolving security threats;

(b) technological developments;

(c) changes in applicable laws, rules or international obligations; or

(d) lessons learnt from security audits, drills, exercises or security incidents.

11. Audit, review and reporting. — (1) The Bureau shall establish and maintain mechanisms for the audit and review of security measures implemented at port facilities and the vessel-port interface to monitor compliance with the Act and these rules.

(2) Without prejudice to the foregoing, the Bureau shall—14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(a) conduct periodic audits and inspections of port facilities to verify compliance with the security standards, standard operating procedures, security plans and directions issued by the Bureau.

Explanation.— For the purposes of this clause, "periodic audits" means audits conducted at such intervals as may be specified by the Bureau by order or in the standard operating procedures approved by the Central Government;

(b) review the security plans, operational procedures and incident reports relating to port facilities and the vessel-port interface submitted by the port authorities and port facility security officers;

(c) assess the effectiveness of the security measures implemented and identify deficiencies requiring corrective or preventive action; and

(d) maintain records of all audits, reviews, findings, recommendations and corrective actions for the purposes of reporting, monitoring and follow-up.

(3) The Bureau shall establish procedures for the timely reporting of audit findings, assessments and recommendations to—

(a) the Central government;

(b) the Administration; and

(c) the maritime law enforcement agencies, where necessary for the purposes of coordination relating to the security of port facilities and the vessel-port interface.

(4) The findings and recommendations arising from audits and reviews conducted under this rule shall be utilised to—

(a) update security risk assessments and strengthen security measures and operational procedures;

(b) identify training, capacity-building and preparedness requirements; and

(c) support the issuance of directions under these rules for addressing identified security deficiencies or vulnerabilities.

12. Response measures for security levels. — (1) The Bureau shall establish and maintain response mechanisms corresponding to security levels set under sub-section (3) of section 129 of the Act, in respect of port facilities and vessel-port interface.

(2) Without prejudice to the generality of sub-rule (1), the Bureau shall—

(a) specify the security measures to be implemented at port facilities and the vessel-port interface for each security level set under sub-section (3) of section 129 of the Act, having regard to threat assessments and operational requirements;

(b) specify procedures for the escalation and de-escalation of security measures in response to intelligence inputs, security directives or security incidents;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 15

(c) coordinate with the port authorities, port facility security officers, the Directorate General of Maritime Administration and the maritime law enforcement agencies for the effective implementation of the response measures;

(d) monitor the effectiveness of the response measures and issue such guidance or directions as may be necessary for their continual improvement; and

(e) provide guidance to the port authorities and port facility security officers on the implementation of additional security measures appropriate to each security level.

(3) The Bureau may conduct or require the conduct of security drills, exercises and simulations to assess the preparedness and response capabilities of port facilities and the vessel-port interface.

(4) The Bureau shall maintain records of—

(a) the security levels set under sub-section (3) of section 129 of the Act;

(b) the response measures implemented at port facilities and the vessel-port interface in respect of each such security level; and

(c) the observations, findings and lessons learnt from security incidents, drills and exercises, and shall utilise such records for the purposes of risk assessment, security audits, operational planning and the issuance of security directives.

13. Administrative control and governing framework. — (1) The Bureau shall function under the administrative control of the Central Government and shall comply with such directions as may be issued by it from time to time.

(2) In the discharge of its functions under the Act and these rules, the Bureau shall act in accordance with the International Convention for the Safety of Life at Sea, 1974, the International Ship and Port Facility Security Code and such other applicable international maritime conventions as are implemented under the Act or the rules made thereunder.

14. Directions for resolving inconsistencies between safety and security requirements. — (1) The Central Government may issue such directions as it considers necessary for resolving, or preventing, any inconsistencies between safety and security requirements applicable to maritime operations.
