2. प्राजधकरण का मुख्र्ालर् मोती दमण, दमण और दीव में होगा।

3. प्राजधकरण की बैठक के जलए गणपूर्ता इसके सदस्ट्र्ों की कुल संख्र्ा का एक जतहाई होगी।

4. पदेन सदस्ट्र् के अजतररि सदस्ट्र् को इस संबंध में केन्‍द रीर् सरकार द्वारा जवजनजश्चत जनबंधनों और ितों के अनुसार भत्ते संदत्त दकए िाएंगे।

5. जहतों के टकराव से बचने के जलए सदस्ट्र्, दकसी भी पररर्ोिना के मूल्र्ांकन की प्रदिर्ा में, जिसके जलए उन्‍दहोंने परामिा सेवाएं प्रदान की ह,ै प्राजधकरण की बैठक से स्ट्वर्ं को अलग रखेगा ।

6. प्राजधकारी दमण और दीव संघ राज्र्क्षेत्र के तटीर् जवजनर्मन िोन क्षेत्र में पर्ाावरण की क्वाजलटी की सुरक्षा और सुधार करने और पर्ाावरण प्रदर्ू ण का जनवारण, उपिमन और जनर्ंजत्रत करने के जलए जनम्नजलजखत उपार् करेगा, अर्ाात् :-

(i) तटीर् िोन प्रबंधन र्ोिना के अनुसार और भारत सरकार द्वारा का0आ0 संख्र्ाक 19(अ), तारीख 6 िनवरी, 2011 र्ा सा0का0जन0 संख्र्ाक 37(अ), तारीख 18 िनवरी, 2019 (जिसे इसमें इसके पश्चात् उि अजधसूचना कहा गर्ा ह)ै द्वारा िारी अजधसूचना की अपेक्षाओं के भीतर, अनुमोददत पररर्ोिना प्रस्ट्ताव के अनुमोदन के जलए पररर्ोिना प्रस्ट्तावकों से प्राप्त प्रस्ट्तावों की समीक्षा करना और आवेदन की प्राजप्त से साठ ददनों की अवजध के भीतर उि अजधसूचना में र्र्ाजवजनर्दाष्ट संबद्ध प्राजधकारी के पररर्ोिना के अनुमोदन के जलए जसफाररि करना;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3

(ii) उि अजधसूचना में र्र्ाजवजनर्दाष्ट तटीर् जवजनमर् िोन क्षेत्र में सभी जवकासात्मक दिर्ाकलापों को जवजनर्जमत करना;

(iii) भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड (ii) में का0आ0 संख्र्ाक 4650(अ), तारीख 30 जसतंबर, 2022 द्वारा प्रकाजित भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना में र्र्ाजनर्दाष्ट जनदेि उि अजधजनर्म की धारा 5 के अधीन िारी करना;

(iv) भारत के रािपत्र, असाधारण, भाग II, खंड 3, उप-खंड (ii) में का.आ. सं04648(अ), तारीख 30 जसतंबर, 2022 द्वारा प्रकाजित भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की अजधसूचना के अनुसार दकसी व्यजि के जवरूद्ध कारावाई करना ;

(v) उि अजधजनर्म की धारा 19 के अधीन जिकार्त दिा करना;

(vi) तटीर् जवजनर्मन िोन क्षेत्र र्ा तटीर् िोन प्रबंध र्ोिना के वगीकरण में पररवतान र्ा उपांतरण के जलए दमण और दीव संघ राज्र्क्षेत्र से प्राप्त प्रस्ट्तावों की परीक्षा करना और उस पर राष्ट्रीर् तटीर् क्षेत्र प्रबंधन प्राजधकरण के जलए जवजनर्दाष्ट जसफाररिें करना;

(vii) उि अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अजधकजर्त अजतिमण के मामलें की िांच करना और उि अजधजनर्म और उसके अधीन बनाए गए जनर्मों के उपबंधों में अंतवाजलत अजतिमण र्ा उल्लंघन के मामले में पुनर्वालोकन करना ; और

(viii) दकसी व्यजि र्ा जनकार् र्ा दकसी संगठन द्वारा उसके समक्ष की गई जिकार्त के आधार पर र्ा स्ट्वमेव उि अजधसूचना के अजतिमण र्ा उल्लंघन के मामले का पुनर्वालोकन करना;

7. प्राजधकरण, उि अजधसूचना के उपबंधों के प्रवृतन और दिर्ान्‍दवर्न की मानीटरी के जलए उत्तरदार्ी होगा ;

8. प्राजधकरण, अपने दिर्ाकलापों के संबंध में पारदर्िाता बनाए रखने के प्रर्ोिन से एक समर्पात वेबसाइट बनाएगा और अपने कृत्र्ों, जिसके अंतगात इसकी बैठक की कार्ासूची, बैठक के कार्ावृत्त, बैठक में जलए गए जवजनश्चर्, उि अजधसूचना के अजतिमण और उल्लंघन के मामले में जसफाररिें और ऐसे अजतिमण तर्ा न्‍दर्ार्ालर् मामलों पर जिसके अंतगात न्‍दर्ार्ालर् का आदेि भी ह,ै की गई कारावाई सजम्मजलत है, से संबंजधत िानकारी पोस्ट्ट करेगा ;

ORDER New Delhi, the 31st October, 2023 S.O. 4751(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment

(Protection) Act, 1986 (29 of 1986) (hereinafter referred to as the said Act), the Central Government hereby constitutes the Daman and Diu Coastal Zone Management Authority (hereinafter referred to as the Authority) consisting of the following persons, for a period of three years with effect from the date of publication of this Order in the Official Gazette, namely:-

2. The Headquarter of the Authority shall be at Moti Daman, Daman and Diu.

3. The quorum for the meeting of the Authority shall be one third of the total number of its members of the Authority.

4. The member, other than an ex officio member, shall be paid allowances as per the terms and conditions decided by the Central Government in this behalf.

5. In order to avoid any conflict of interest, the member shall recuse himself from the meeting of the Authority, in the process of appraisal of any project, for which they have rendered consultancy service.

6. The Authority shall take following measures for protecting and improving the quality of the coastal environment and preventing, abating and controlling environmental pollution in the Coastal Regulation Zone areas in the Union territory of Daman and Diu, namely: -

(i) examine the proposals received from the project proponent for approval of project proposal, in accordance with the approved Coastal Zone Management Plan and within the requirements of the notification issued by the Government of India vide number S.O.19(E), dated the 6 th January, 2011 or notification issued vide number[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 G.S.R. 37(E), dated the 18th January, 2019 (hereinafter referred to as the said notification), and make recommendation for approval of project to the concerned authority, as specified in the said notification, within a period of sixty days from the date of receipt of application;

(ii) regulate all developmental activities in the Coastal Regulation Zone areas as specified in the said

notification;

(iii) issue directions under section 5 of the said Act, as specified in the notification of the Government of India in the Ministry of Environment, Forest and Climate Change published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O. 4650(E), dated the 30 September, 2022;

(iv) take action against the persons as per the notification of the Government of India in the Ministry of Environment, Forest and Climate Change published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), vide number S.O. 4648(E), dated the 30 September, 2022;

(v) file complaint under section 19 of the said Act;

(vi) examine the proposals received from the Union territory of Daman and Diu for changes or modifications in the classification of Coastal Regulation Zone areas and in the Coastal Zone Management Plan and make specific recommendations thereon, to the National Coastal Zone Management Authority;

(vii) inquire into cases of alleged violation of the provisions of the said Act or the rules made thereunder, and review the cases involving violation or contravention of the provisions of the said Act and the rules made thereunder; and

(viii) inquire and review cases of violation or contravention of the said notification suo-moto or on the basis of a complaint made by any individual or body or organisation before it;

7. The Authority shall be responsible for enforcement and monitoring of the implementation of the provisions of the said notification.

8. The Authority shall, for the purposes of maintaining transparency in its functioning, create a dedicated website and post the information relating to its functions, including the agenda in its meeting, minutes of the meeting, decision taken in the meeting, recommendation for matters on violation and contravention of the said notification and action taken on such violation and court matter including the order of the court and the approved Coastal Zone Management Plan of the Union territory of Daman and Diu.
