और केंरीय सरकार की यह राय ह ैदक ईि ऄजधसूचना म ेंसंिोधन करना लोकजहत म ेंअवश्यक और समीचीन ह;ै और पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईप-जनयम (4) यह ईपबंध करता ह ै दक िब भी केंरीय सरकार को यह प्रतीत होता ह ै दक ऐसा करना लोकजहत म ें ह,ै तो आसके जलए पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईप-जनयम (3) के खंड (क) के ऄधीन नोरिस की ऄपेक्षा से ऄजभमुजि दी िा सकती ह;ै और केन्द्रीय सरकार की राय से यह ऄजधसूचना संखयाकं का.अ. 2169 (ऄ) तारीख 27 ऄगस्ट्त, 2014 में संिोधन करने के जलए पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के खंड (क) के ऄधीन नोरिस की ऄपक्षे ा स े ऄजभमजु ि दने ा लोकजहत में ह;ै ऄतः, ऄब, केन्द्रीय सरकार, पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के ईपजनयम (3) के साथ परित पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) की धारा 3 की ईपधारा (1) और ईपधारा (2) के खंड (v) और खंड (xiv) तथा ईपधारा (3) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, भारत सरकार के पयाावरण, वन और िलवाय ु पररवतना मंत्रालय की ऄजधसूचना, िो संखयाकं का.अ. 2169 (ऄ), तारीख 27 ऄगस्ट्त, 2014 द्वारा भारत के रािपत्र, ऄसाधारण, भाग II, खंड 3, ईपखंड (ii) म ें प्रकाजित की गइ थी, में जनम्नजलजखत संिोधन करती ह,ै ऄथाात्:- ईि ऄजधसूचना म-ें 6897 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (क) पैरा 2 के, ईप-पैरा (1) के स्ट्थान पर, जनम्नजलजखत ईपपैरा रखा िाएगा: ऄथाता ्:- “(1) राज्य सरकार, पाररजस्ट्थजतकी संवेदी िोन के प्रयोिनों के जलए, 26 ऄक्िूबर, 2023 स े दो वर्ा की ऄवजध के भीतर, स्ट्थानीय लोगों के परामिा स े और आस ऄजधसूचना के ऄनुसार एक अंचजलक महायोिना तैयार करेगी’। (ख) पैराग्राफ 3 के, ईप-पैरा (10) म,ें "और पयाावरण, वन और िलवायु पररवतना मंत्रालय के ऄनुमोदन के दौरान" िब्दों का लोप दकया िाएगा;” [फा. स.ं 25/09/2013-इएसिडे -अरइ] डॉ. एस. करकेट्टा, वैज्ञाजनक ‘िी’ रिप्पण : मूल ऄजधसूचना भारत के रािपत्र, ऄसाधारण, भाग II, खंड 3, ईपखंड (ii) में ऄजधसूचना सखं या का.अ. 2169 (ऄ), तारीख 27 ऄगस्ट्त, 2014 द्वारा प्रकाजित की गइ थी;

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE

NOTIFICATION New Delhi, the, 27th October, 2023 S.O. 4749(E).—Whereas the Central Government, in exercise of the powers conferred by sub-section (1), clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, issued a notification in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii) vide number S.O. 2169 (E), dated the 27th August, 2014;

And whereas the Central Government is of the opinion that it is necessary and expedient in the public interest to amend the said notification;

And whereas sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986 provides that whenever it appears to the Central Government that it is in the public interest to do so, it may dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986;

And whereas the Central Government is of the opinion that it is in the public interest to dispense with the requirement of notice under clause (a) of sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986 for amending the notification number S.O. 2169 (E), dated the 27th August,2014;

Now, therefore, in exercise of the powers conferred by sub-section (1), clause (v) and clause (xiv) of sub-

section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule

(4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following amendments in the notification of the Government of India in the Ministry of Environment, Forest and Climate Change, published in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (ii), vide notification number S.O. 2169 (E), dated the 27th August, 2014, namely:- In the said notification,-

(a) in paragraph 2, for sub-paragraph (1), the following sub-paragraph shall be substituted, namely:- “(1) The State Government shall, prepare a Zonal Master Plan, for the purposes of the Eco-sensitive Zone, in consultation with local people and in accordance with this notification, within a period of two years from the 26th October, 2023”.

(b) in paragraph 3, in sub-paragraph (10), the words “and approved by the Ministry of Environment, Forests and Climate Change”, shall be omitted. [F. No. 25/09/2013-ESZ-RE] Dr. S. KERKETTA, Scientist „G‟
