(xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े हुए, अजधसूचना स.ं का.आ. 2145 (अ), तारीख 6 िुलाई, 2017 के अजधक्रमण म,ें दकए गए र्ा दकए िाने वाले छोड़ े गए कार्ों को छोड़कर, कनााटक राज्र् म ेंगुडेकोटे एक्सटेंिन रीछ अभर्ारण्र् की सीमा तक के क्षत्रे को गुडेकोटे एक्सटेंिन रीछ अभर्ारण्र् पाररजस्ट्थ जतकी संवेिी िोन (जिसे इसम ें इसके पश् चात ् पाररजस्ट्थजतकी संवेिी िोन कहा गर्ा ह)ै के रूप म ें अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह,ै अथाात् :--4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

1. पाररजस्ट्थजतकी सवं िे ी िोन का जवस्ट्तार और उसकी सीमाएं--(1) पाररजस्ट्थजतकी संवेिी िोन 234.54 वग ा दकलोमीटर के क्षत्रे म ें फैला हुआ ह,ै जिसकी सीमा गुडेकोटे एक्सटेंिन रीछ अभर्ारण्र् की सीमा के आसपास 1 दकलोमीटर स े 5.70 दकलोमीटर तक ह।ै

(2) पाररजस्ट्थजतकी संवेिी ़िोन के अक्षािं और ििे ांतर की सीमा का जववरण उपाबधं -I म ें दिर्ा गर्ा ह।ै

(3) प्रमुख बबंिओंु के जनिेिांकों के साथ पाररजस्ट्थजतकी संवेिी िोन के अंतगात आन े वाल े अड़तालीस (48) ग्रमों की सूची उपाबधं -II म ें सलं ग्न ह।ै

(4) पाररजस्ट्थजतकी संवेिी िोन का मानजचत्र सूची उपाबधं –III म ें संलग्न ह।ै

(5) पाररजस्ट्थजतकी संवेिी िोन म ें आन े वाल े संरजक्षत वनों की सूची उपाबधं -IV म ें सलं ग्न ह।ै

(6) पाररजस्ट्थजतकी संवेिी िोन म ें आन े वाल े आरजक्षत वनों की सूची उपाबधं -V म ेंसंलग्न ह।ै

(7) पाररजस्ट्थजतकी संवेिी िोन म ें पाए िान े वाले वृक्षों, सरीसपृ ों, पजक्षर्ों और स्ट्तनधाररर्ों की सूची उपाबधं -VI स ेX के रूप म ेंसंलग्न ह।ै

(8) पाररजस्ट्थजतकी संवेिी िोन म ें आन े वाल े भूजम की जवजधक श्रेजणर्ों की सूची उपाबधं -XI के रूप म ें सलं ग्न ह।ै

2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना.– (1) राज्र् सरकार, पाररजस्ट्थजतकी सवं ेिी िोन के प्रभावी प्रबंधन के जलए रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख स े िो विा की अवजध के भीतर स्ट्थानीर् व्यजिर्ों के परामि ा स े तथा इस अजधसूचना म ें दिए गए अनुबंधों का पालन करते हुए सुसंगत केंद्रीर् और राज्र् जवजध, और केंद्रीर् सरकार द्वारा िारी दििाजनिेि, र्दि कोई हो, आंचजलक महार्ोिना तैर्ार करेगी।

(2) आंचजलक महार्ोिना को राज्र् सरकार म ेंसक्षम प्राजधकारी द्वारा अनुमोदित दकर्ा िाएगा।

(3) आंचजलक महार्ोिना, स्ट्थानीर् जनवाजसर्ों और सभी संबंजधत राज्र् जवभागों के परामिा स े तैर्ार दकर्ा िाएगा, अथाात:् -

(i) पर्ाावरण;

(ii) वन;

(iii) िहरी जवकास;

(iv) पर्ाटन;

(v) नगरपाजलका;

(vi) रािस्ट्व;

(vii) कृजि;

(viii) कनााटक राज्र् प्रििू ण जनर्ंत्रण बोडा;

(ix) बसंचाई;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5

(x) लोक जनमााण जवभाग; और

(xi) राज्र् सरकार की कोई अन्र् सबं ंजधत एिेंसी इसम ें पर्ाावरणीर् और पाररजस्ट्थजतकी जवचारों को एकीकृत करने के जलए।

(4) िब तक इस अजधसूचना म ें जवजनर्िष्टा न हो, आंचजलक महार्ोिना म ें वतामान म ें अनमु ोदित भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबंध नहीं लगार्ा िाएगा तथा आचंजलक महार्ोिना म ें सभी अवसंरचनाओं और दक्रर्ाकलापों म ें सुधार करके उन्ह े अजधक िक्ष और पाररजस्ट्थजतकी-अनुकूल बनान े की व्यवस्ट्था की िाएगी।

(5) आंचजलक महार्ोिना म ें वनरजहत और अवक्रजमत क्षेत्रों के सुधार, जवद्यमान िल जनकार्ों के सरं क्षण, िलग्रहण क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भ-ू िल के प्रबंधन, मृिा और नमी के संरक्षण, स्ट्थानीर् िनता की आवश्र्कताओं तथा पाररजस्ट्थजतकी एव ं पर्ाावरण के ऐसे अन्र् पहलओंु की व्यवस्ट्था की िाएगी जिन पर ध्र्ान दिर्ा िाना आवश्र्क ह।ै

(6) आंचजलक महार्ोिना म ें सभी जवद्यमान पूिा स्ट्थलों, ग्रामों एव ं िहरी बजस्ट्तर्ों, वनों की श्रेजणर्ों एव ं दकस्ट्मों िनिातीर् क्षेत्रों, कृजि क्षेत्रों, उपिाऊ भूजम क्षेत्रों, उद्यानों एव ं उद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और अन्र् िल जनकार्ों की सीमा का अभ्र्कंन दकर्ा िाएगा।

(7) आंचजलक महार्ोिना म ें पाररजस्ट्थजतकी संवेिी िोन में होने वाले जवकास का जवजनर्मन दकर्ा िाएगा और सारणी म ें र्थासूचीबि पैरा 17 म ेंप्रजतजिि, जवजनर्जमत एव ं संवर्धात दक्रर्ाकलापों का पालन दकर्ा िाएगा।

(8) पाररजस्ट्थजतकी संवेिी िोन के जलए आंचजलक महार्ोिना तैर्ार होन े तक, सभी नए जनमााण और अन्र् जवकासात्मक दक्रर्ाकलापों को पैरा 19 के अधीन उपर्ुि कारावाई के जलए पैरा 18 के अधीन गरठत जनगरानी सजमजत को भेिा िाएगा।

(9) अनमु ोदित आंचजलक महार्ोिना छूट पर जवचार करन े सजहत कोई भी जनणार् लेन े के जलए जनगरानी सजमजत के जलए एक संिभा िस्ट्तावेि होगा ।

3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्-- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करने के जलए उपार् करेगी।

4. भ-ू उपर्ोग सबं धं ी उपार्.- (1) पाररजस्ट्थजतकी संवेिी िोन म ें आमोि-प्रमोि के प्रर्ोिनों के जलए जनधााररत वनों, बागवानी क्षेत्रों, िनिातीर् क्षत्रे ों, कृजि क्षेत्रों, पाकों और खलु े स्ट्थानों का उपर्ोग वाजणजज्र्क र्ा औद्योजगक संबंजधत जवकास दक्रर्ाकलापों के जलए क्षत्रे ों म ें नहीं दकर्ा िाएगा र्ा सपं ररवतान नहीं होगा:

परंत ु राज्र् सरकार स्ट्थानीर् जनवाजसर्ों की आवासीर् िरूरतों को पूरा करन े और जनम्नजलजखत दक्रर्ाकलापों के जलए जनगरानी सजमजत की जसफाररि पर पाररजस्ट्थजतकी संवेिी िोन के भीतर कृजि भूजम के रूपांतरण को परू ा करन े के जलए अनुज्ञात होंग,े अथाात:् -

(i) पर्ावा रण के अनुकूल पर्ाटन दक्रर्ाकलापों के जलए पर्ाटकों के अस्ट्थार्ी आवास के जलए पर्ाावरण के अनुकूल कॉटेि, िैसे तंब,ू लकड़ी के घर आदि की स्ट्थापना,

(ii) जवद्यमान सड़कों का चौड़ीकरण और सुिढृ ीकरण और नई सड़कों का जनमााण,

(iii) प्रििू ण उत्पन्न न करन े वाल े लघु उद्योग की स्ट्थापना,

(iv) विा ा िल संभरण, और

(v) ग्राम उद्योगों सजहत कॉटेि उद्योग, सुजवधा भण्डार और स्ट्थानीर् सुजवधाएं की स्ट्थापना। परंतु र्ह और दक राज्र् सरकार वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए आदिवासी क्षत्रे में भूजम के उपर्ोग र्ा भारत के संजवधान के अनच्ु छेि 244 के उपबंधों और उस समर् लागू जवजधर्ों के अनुपालन की अनुमजत6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] िे सकती ह,ै जिसम ें अनुसूजचत िनिाजत और अन्र् पारंपररक वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) िाजमल ह।ैं

(2) राज्र् सरकार पाररजस्ट्थजतकी संवेिी िोन के भीतर भू-अजभलेखों म ें उपसंिात कोई त्रुरट को प्रत्र्ेक मामले म ें केवल एक बार जनगरानी सजमजत के परामिा पर संिोजधत होगी, और ऐस े सुधार के बारे म ें पररवतना के जलए केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को सूचना िेनी होगी:

परंतु र्ह और दक त्रुरट के संिोधन म ें इस उप पैरा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा म ें भू- उपर्ोग का पररवतान सजम्मजलत नहीं होगा: परंतु र्ह और भी दक जिससे हररत क्षत्रे म ें िैसे वन क्षत्रे , कृजि क्षत्रे आदि म ें कोई पाररणाजमक कटौती नहीं होगी और अनप्रर्ुक् त र्ा अनुत्प ािक कृजि क्षेत्रों म ें पनु : वनीकरण करने के प्रर्ास दकए िाएंग े ।

5. प्राकृजतक िल स्रोत सबं धं ी उपार्.- राज्र् सरकार जनम्नजलजखत उपार् करेगी, अथाात.् -

(i) सभी प्राकृजतक िलमागों के िलग्रहण क्षेत्रों की पहचान की िाएगी;

(ii) आंचजलक महार्ोिना म ें उनके संरक्षण और बहाली की र्ोिना सजम्मजलत की िाएगी; और

(iii) िलग्रहण क्षेत्रों म ें र्ा उसके पास जवकास दक्रर्ाकलापों को प्रजतजिि और जनबंजधत दकर्ा िा सके िो ऐस े क्षेत्रों के जलए हाजनकारक हों।

6. पर्टा न महार्ोिना.- (1) पाररजस्ट्थजतकी संवेिी िोन के अंतगता राज्र् सरकार का पर्टा न जवभाग, राज्र् सरकार के रािस्ट्व और वन जवभाग के परामिा स,े पर्ाटन दक्रर्ाकलापों के प्रभावी प्रबंधन के उद्दश्े र् स े पर्ाटन महार्ोिना तैर्ार करेगी।

(2) पर्ाटन महार्ोिना को आचं जलक महार्ोिना म ेंिाजमल दकर्ा िाएगा।

7. पर्टा न सबं धं ी उपार्.– (1) पाररजस्ट्थजतकी संवेिी िोन के अंतगता सभी नए पर्ाटन दक्रर्ा-कलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा िारी दििाजनिेिों तथा पाररजस्ट्थजतकी पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेन े वाले राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पाररजस्ट्थजतकी पर्ाटन संबंधी दििाजनिेिों के अनुसार होगा।

(2) पाररजस्ट्थजतकी अनुकूल पर्टा न दक्रर्ाकलाप स े संबंजधत पर्ाटकों के अस्ट्थार्ी अजधभोग के जलए वास सुजवधा के जसवार् गुडेकोटे एक्सटेंिन रीछ अभर्ारण्र् की सीमा स े एक दकलोमीटर तक नर् े वाजणजज्र्क होटल और ररसोटा अनुज्ञात नहीं होंगे।

(3) गडु ेकोटे एक्सटेंिन रीछ अभर्ारण्र् की सीमा स े एक दकलोमीटर की िरू ी स े परे पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, नए होटल और ररसॉटा की स्ट्थापना की अनुमजत केवल पाररजस्ट्थजतकी-पर्ाटन सुजवधाओं के जलए पूव-ा जनधााररत और नाजमत क्षेत्रों म ेंिी िाएगी और पर्ाटन महार्ोिना के अनुसार होगा।

(4) इस अजधसूचना के अधीन आंचजलक महार्ोिना का अनुमोिन होने तक, पर्ाटन के जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा जनगरानी सजमजत की जसफाररि के आधार पर संबंजधत जवजनर्ामक प्राजधकरणों द्वारा अनुमत दकर्ा िाएगा।

8. प्राकृजतक जवरासत सबं धं ी उपार्.– (1) राज्र् सरकार छह महीने के भीतर प्राकृजतक जवरासत संरक्षण और सरं क्षण र्ोिना तैर्ार करेगी और ऐसी र्ोिना को आंचजलक महार्ोिना म ें िाजमल दकर्ा िाएगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7

(2) राज्र् सरकार पाररजस्ट्थजतकी संवेिी िोन के अंतगात आन े वाले बहुमूल्र् प्राकृजतक जवरासत के सभी स्ट्थलों िैसे दक िीन पूल ररिवा क्षत्रे , िलै संरचना, िल प्रपात, झरन,े िरे, उपवन, गुफा, स्ट्थलों, वनपथ, रोहण मागा और उत्प्रपात की पहचान की िाएगी और उनकी सुरक्षा और संरक्षण की र्ोिना बनाएगी।

9. मानव जनर्मता जवरासत सरु क्षा और सरं क्षण र्ोिना.– (1) राज्र् सरकार छह महीने के भीतर मानव जनर्मता जवरासत स्ट् थल सुरक्षा और सरं क्षण र्ोिना तैर्ार करेगी और ऐसी र्ोिना को आंचजलक महार्ोिना म ेंिाजमल दकर्ा िाएगा।

(2) राज्र् सरकार पाररजस्ट्थजतकी संवेिी िोन के अंतगात आन े वाल े भवनों, संरचनाओं, कलाकृजतर्ों, क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की िाएगी और उनकी सुरक्षा और संरक्षण की र्ोिना बनाएगी।

10. ध्व जन प्रििू ण सबं धं ी उपार्.– राज्र् सरकार का पर्ाावरण जवभाग ध्वजन प्रििू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 के उपबंधों के अनुसार पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रििू ण के जनर्ंत्रण के जलए दििाजनिेि तैर्ार करेगा।

11. वार् ु प्रििू ण सबं धं ी उपार्.– राज्र् सरकार का पर्ाावरण जवभाग वार् ु (प्रििू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14), और पर्ाावरण (संरक्षण) अजधजनर्म, 1986, और इसके अधीन बनाए गए जनर्मों के अनुसार पाररजस्ट्थजतकी संवेिी क्षत्रे म ें वार् ु प्रििू ण के जनर्ंत्रण के जलए मागाििाक जसिांत तैर्ार करेगा।

12. बजहस्राव का जनस्ट्सरण सबं धं ी उपार्.– पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत अपजिष्टों का जनवाहन िल (प्रििू ण जनवारण तथा जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार होगा।

13. ठोस अपजिष्ट, जनपटान सबं धं ी उपार्.– (1) पाररजस्ट्थजतकी संवेिी िोन म ें ठोस अपजिष्ट जनपटान ठोस अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(2) स्ट्थानीर् प्राजधकरण ठोस अपजिष्ट को बार्ोजडग्रडे ेबल और नॉन-बार्ोजडग्रेडेबल घटकों म ें अलग करने के जलए र्ोिनाएं तैर्ार करेंग;े

(3) बार्ोजडग्रेडेबल घटकों को अजधमानतः कंपोबस्ट्टंग र्ा वमीकल्चर र्ा बार्ोगैस संर्ंत्रों के माध्र्म स े पुननावीनीकरण दकर्ा िाएगा।

(4) नॉन-बार्ोजडग्रडे ेबल घटकों को पर्ाावरण की िजृ ष्ट स ेस्ट्वीकार् ा तरीके स े पाररजस्ट्थजतकी संविे ी िोन के बाहर पहचाने गए स्ट्थान पर जनपटार्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन म ें ठोस अपजिष्ट को िलाने र्ा िलाने की अनुमजत नहीं िी िाएगी।

14. िैव जचदकत्सा अपजिष्ट जनपटान सबं धं ी उपार्.– पाररजस्ट्थजतकी संवेिी िोन म ें िैव-जचदकत्सा अपजिष्ट जनपटान िैव- जचदकत्सा अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

15. वाहन-र्ातार्ात सबं धं ी उपार्.– राज्र् सरकार द्वारा वाहन-र्ातार्ात को पर्ाावास-अनुकूल तरीके स े जवजनर्जमत दकर्ा िाएगा और इस संबंध म ें आंचजलक महार्ोिना म ें जवििे उपबंध िाजमल दकए िाएगं े और आंचजलक महार्ोिना के तैर्ार होने और अजधसूचना के अधीन अनुमोदित, जनगरानी सजमजत केंद्रीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् के प्रासंजगक दििाजनिेिों के अधीन वाहनों की आवािाही के अनपु ालन की जनगरानी करेगी।

16. औद्योजगक ईकाईर्ा ं सबं धं ी उपार्.– (1) पाररजस्ट्थजतकी-संवेिी िोन म ें काष्ठ आधाररत नर् े उद्योगों की स्ट्थापना की अनुमजत नहीं िी िार्गे ी िब तक दक जवजध के अनुसार जवद्यमान काष्ठ पर आधाररत न हो ।

(2) पाररजस्ट्थजतकी-संवेिी िोन के भीतर िल, मृिा र्ा ध्वजन प्रििु ण काररत करने वाले कोई नर्ा उद्योग स्ट्थाजपत नहीं दकर्ा िाएगा।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

17. पाररजस्ट्थजतकी सवं िे ी िोन म ें प्रजतजिि, जवजनर्जमत र्ा सवं र्धता दकए िान े वाल े दक्रर्ाकलापों की सचू ी.- पाररजस्ट्थजतकी संवेिी िोन म ें सभी दक्रर्ाकलाप पर्ाावरण (संरक्षण) अजधजनर्म 1986 (1986 का 29) और उसके अधीन बन े जनर्मों के अनुसार िाजसत होंगे और नीचे िी गई सारणी म ें जवजनर्िाष्ट रीजत स ेजवजनर्जमत होंगे, अथाात:् - सारणी क्रम स.ं दक्रर्ाकलाप रटप्पणी

(1) क. प्रजतजिि दक्रर्ाकलाप

1. वाजणजज्र्क खनन, पत्थर उत्खनन (क) पाररजस्ट्थजतकी संवेिी िोन के अंतगात वास्ट्तजवक स्ट्थानीर् और अपघिाण इकाइर्ा ं । जनवाजसर्ों की घरेल ू आवश्र्कताओं जिसम ें मकानों के संजनमााण र्ा मरम्मत के जलए धरती को खोिना व्यजिगत उपभोग के जलए आवास के जलए िेिी टाइलों र्ा ईटों का जनमााण सजम्मजलत ह,ै के जसवार् सभी प्रकार के नए और जवद्यमान खनन (लघ ु और वृहत खजनि), पत्थर उत्खनन और अपघिाण इकाइर्ां तत्काल प्रभाव स े प्रजतजिि होंगी;

(ख) खनन प्रचालन, 1995 की ररट र्ाजचका (जसजवल) स.ं 202 म ें टी.एन. गौडाबमान जथरुमूलपाि बनाम भारत संघ के मामले म ें माननीर् उच्चतम न्र्ार्ालर् के आिेि 4 अगस्ट्त, 2006 और 2012 की ररट र्ाजचका (जसजवल) स.ं 435 म ें गोवा फाउंडिे न बनाम भारत संघ के मामल े म ें तारीख 21 अप्रैल, 2014 के आिेि के अनुसरण म ें होगा ।

2. आरा मीलों की स्ट्थापना । पाररजस्ट्थजतकी संवेिी िोन के भीतर नई और जवद्यमान आरा मीलों का जवस्ट् तार अनुज्ञात नहीं होगा ।

3. िल, वार्,ु मृिा र्ा ध् वजन प्रििू ण पाररजस्ट्थजतकी संवेिी िोन म ें कोई नर्ा उद्योग लगान े और वतामान प्रििू णकारी उद्योगों का जवस्ट्तार करने की अनुमजत नहीं होगी। काररत करन े वाल े उद्योगों की स्ट् थापना ।

4. िलावन लकड़ी का वाजणजज्र्क लाग ू जवजधर्ों के अनुसार प्रजतजिि होंगे। उपर्ोग ।

5. नए बृहत तापीर् और िल जवद्युत लाग ू जवजधर्ों के अनुसार प्रजतजिि (अन्र्था उपबंजधत के जसवार्) पररर्ोिना की स्ट्थापना । होंगे।

6. नािकिीवमार और कीटनािी लाग ू जवजधर्ों के अनुसार प्रजतजिि (अन्र्था उपबंजधत के जसवार्) सजहत दकसी पररसंकटमर् पिाथ ा का होंगे। प्रर्ोग र्ा उत्पािन ।

7. प्राकृजतक िल जनकार्ों र्ा सतही लाग ू जवजधर्ों के अनुसार प्रजतजिि (अन्र्था उपबंजधत के जसवार्) क्षत्रे म ें अनपु चाररत बजहस्रााव और होंगे। ठोस अपजिष्टों का जनस्ट्सारण ।

8. पर्ाटन स े संबंजधत दक्रर्ाकलाप िैस े लाग ू जवजधर्ों के अनुसार प्रजतजिि (अन्र्था उपबंजधत के जसवार्) गम ा वार् ु गब्ु बारों, जवमान, आदि होंगे। द्वारा राष्ट्रीर् उद्यान क्षत्रे के ऊपर स े उड़ना िैसे दक्रर्ाकलाप करना।

9. नए काष्ठ आधाररत उद्योग। पाररजस्ट्थजतकी संवेिी िोन की सीमाओं के भीतर नए काष्ठ आधाररत उद्योग की स्ट्थापना को अनुज्ञात नहीं दकर्ा िाएगा :[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9 परंतु जवद्यमान काष्ठ आधाररत उद्योग जवजध के अनुसार िारी रह सकता ह ै।

10. ईंट भट्ठों की स्ट्थापना। लाग ू जवजधर्ों के अनुसार प्रजतजिि होंगे। ख.जवजनर्जमत दक्रर्ाकलाप

11. प्लाजस्ट्टक कैरी बगै , लैजमनेट और प्लाजस्ट्टक की वस्ट्तओंु के लेजमनेट्स और टेरा पैक के जनपटान को सख्ती स े जवजनर्जमत और जनगरानी की िाएगी और लाग ू जवजधर्ों के टेरा पैक का उपर्ोग। अधीन जवजनर्जमत दकर्ा िाएगा।

12. होटलों और ररसोटों की स्ट्थापना । पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों हते ु लघ ु अस्ट्थार्ी संरचनाओं के जनमााण के जसवार्, संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर नए वाजणजज्र्क होटलों और ररसोटों की स्ट्थापना अनुज्ञात नहीं होगी:

तथाजप, संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के बाहर और पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, पर्ाटन महार्ोिना सभी नए पर्ाटन दक्रर्ाकलाप करन े र्ा जवद्यमान दक्रर्ाकलापों का जवस्ट्तार करने की अनुज्ञा होगी।

13. संजनमााण दक्रर्ाकलाप । (क) संरजक्षत क्षत्रे की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक िो भी जनकट हो, दकसी भी प्रकार का वाजणजज्र्क संजनमााण अनुज्ञात नहीं दकर्ा िाएगा:

(ख) परंतु स्ट्थ ानीर् लोगों को पैरा 3 के उप पैरा (1) म ें सचू ीबि दक्रर्ाकलापों सजहत उनके उपर्ोग के जलए उनकी भूजम म ें स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करने जलए संजनमााण करने की अनुमजत भवन उपजवजधर्ों के अनुसार िी िाएगी।

(i) मौिूिा सड़कों का चौड़ीकरण और सुिढृ ीकरण और नई सड़कों का जनमााण;

(ii) बुजनर्ािी ढांच े और नागररक सुजवधाओं का जनमााण और नवीनीकरण;

(iii) केंद्रीर् प्रििू ण जनर्ंत्रण बोडा द्वारा फरवरी 2016 म ें दकए गए वगीकरण के अनुसार प्रििू ण का कारण नहीं माने गए लघ ु उद्योग;

(iv) ग्रामीण उद्योगों सजहत कुटीर उद्योग; पारर-पर्ाटन को सपोटा करन े वाल े सुजवधा स्ट्टोर और होम स्ट्टे सजहत स्ट्थानीर् सुजवधाएं; और

(v) इस अजधसूचना म ें सूचीबि प्रोत्साजहत गजतजवजधर्ााँ। (ग) ऐस े लघ ु उद्योगों िो प्रििू ण उत् पन्न नहीं करत े ह,ैं स े सबं ंजधत संजनमााण दक्रर्ाकलाप जवजनर्जमत दकए िाएंगे और लागू जनर्मों और जवजनर्मों, र्दि कोई हों, के अनुसार सक्षम प्राजधकारी की पूवा अनुमजत स ेही न्र्ूनतम पर रखे िाएंगे । (घ) एक दकलोमीटर स े आग े आंचजलक महार्ोिना के अनुसार10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] जवजनर्जमत होंगे ।

14. वृक्षों की कटाई । (क) राज्र् सरकार के सक्षम प्राजधकारी की पूवा अनुमजत के जबना वन भूजम र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं होगी । (ख) वृक्षों की कटाई केंद्रीर् र्ा संबंजधत राज्र् के अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत होगी । (ग) आरजक्षत वनों और संरजक्षत वनों के मामले म ें कार् ा र्ोिना के जनिेिों का पालन दकर्ा िाएगा।

15. वाजणजज्र्क िल संसाधन जिसके लाग ू जवजधर्ों के अधीन जवजनर्जमत होंग े । अंतगता भ-ू िल संचर्न भी ह।ै

16. जवद्युत केबलों, पारेिण लाइनों और जवजनर्जमत और भूजमगत केबल जबछाने को बढावा िेना। िरू संचार टावरों और ऑजप्टकल फाइबर केबलों, पाइपलाइनों आदि का जनमााण।

17. होटल और लॉि के मौिूिा पररसर लाग ू जवजधर्ों के अधीन जवजनर्जमत होंग े । की बाड़ लगाना।

18. जवद्यमान सड़कों को चौड़ा करना उजचत पर्ाावरण समाघात जनधाारण और न् र्नू ीकरण उपार् र्था और उन्ह ें सुिढृ करना। लाग ू के अनुसार होंगे ।

19. राजत्र म ें र्ाजनक र्ातार्ात का लाग ू जवजधर्ों के अधीन वाजणजज्र्क प्रर्ोिन के जलए जवजनर्जमत संचलन । होंगे ।

20. जविेिी प्रिाजतर्ों को लाना । लाग ू जवजधर्ों के अधीन जवजनर्जमत होंग े ।

21. पहाड़ी ढालों और निी तटों का लाग ू जवजधर्ों के अधीन जवजनर्जमत होंग े । संरक्षण ।

22. प्राकृजतक िल जनकार्ों र्ा सतही उपचाररत अपजिष्ट िल/बजहष्कार को िल जनकार्ों म ें प्रवेि करने स े क्षत्रे म ें उपचाररत बजहस्रााव का रोका िाएगा। उपचाररत अपजिष्ट िल के पनु चाक्रण और पनु : जनस्ट्सारण और ठोस अपजिष्ट का उपर्ोग के जलए दकए िाने वाले प्रर्ास अन्र्था उपचाररत अपजिष्ट जनपटान । िल/बजहष्कार के जनवाहन को लागू जवजध के अनुसार जवजनर्जमत दकर्ा िाएगा।

23. वाजणजज्र्क साइन होर्डंग्स और लाग ू जवजधर्ों के अधीन जवजनर्जमत होंग े । होर्डंग्स।

24. फमों, कॉरपोरेट और कंपजनर्ों द्वारा स्ट्थानीर् िरूरतों को परू ा करने के अजतररि लागू जवजधर्ों के बड़े पैमान े पर वाजणजज्र्क पिुधन अनुसार जवजनर्जमत होगा। और पोल्री फामों की स्ट्थापना।

25. प्रििू ण उत्पन्न न करने वाल े लघ ु पाररजस्ट्थजतकी संवेिी िोन स े गरै प्रििू ण, गरै पररसंकटमर्, लघु और उद्योग । सेवा उद्योग, कृजि, कृजि उद्यान, पुष्पकृजि, कृजि आधाररत िेिीर् माल स े औद्योजगक उत्पािों का उत्पािन उद्योग और िो पर्ाावरण पर कोई जवपरीत प्रभाव नहीं डालते ह,ैं अनुज्ञात दकए िाएंग े ।

26. वन उत्पािों और गरै काष्ठ वन लाग ू जवजधर्ों के अधीन जवजनर्जमत होंग े । उत्पािों का संग्रहण ।

27. वार् ु और र्ाजनक प्रििू ण । लाग ू जवजधर्ों के अधीन जवजनर्जमत होंग े ।

28. कृजि प्रणाजलर्ों म ें आमूल लाग ू जवजधर्ों के अधीन जवजनर्जमत होंग े । पररवतान ।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 ग.सवं र्धता दक्रर्ाकलाप

29. स्ट्थानीर् समुिार्ों द्वारा चल रही लाग ू जवजधर्ों के अधीन अनुज्ञात होंग े । कृजि और बागवानी प्रथाओं के साथ पिुपालन, पिुपालन कृजि, िल कृजि और मछली पालन ।

30. कृजि वाजनकी, कौिल जवकास, सदक्रर् रूप स े बढावा दिर्ा िाएगा । पर्ाावरण िागरूकता।

31. विा ा िल संचर् । सदक्रर् रूप स े बढावा दिर्ा िाएगा ।

32. िैजवक खेती। सदक्रर् रूप स े बढावा दिर्ा िाएगा ।

33. सभी गजतजवजधर्ों के जलए हररत सदक्रर् रूप स े बढावा दिर्ा िाएगा । प्रौद्योजगकी का अंगीकरण ।

34. ग्रामीण कारीगरों सजहत कुटीर सदक्रर् रूप स े बढावा दिर्ा िाएगा । उद्योग आदि।

35. नवीकरणीर् ऊिाा और ईंधन का बार्ोगैस, सौर प्रकाि इत्र्ादि को सदक्रर् बढावा दिर्ा िाएगा। प्रर्ोग ।

18. जनगरानी सजमजत.- जनगरानी सजमजत के रूप म ें िानी िाने वाली एक सजमजत होगी जिसम ें जनम्नजलजखत व्यजि िाजमल होंग,े अथाात:् - क्र. स.ं जनगरानी सजमजत का गठन पि i. क्षेत्रीर् आर्ुि, गलु बगा ा अध्र्क्ष, पिेन;

ii. पर्ाावरण जवभाग, कनााटक सरकार के प्रजतजनजध पिेन, सिस्ट्र्; iii. िहरी जवकास जवभाग, कनााटक सरकार के प्रजतजनजध पिेन, सिस्ट्र्; iv. प्राकृजतक संरक्षण के क्षत्रे म ें कार्ारत (जवरासत संरक्षण सजहत) गरै सरकारी सिस्ट्र्;

संस्ट्थाओं के प्रजतजनजध जिन्ह ें कनााटक सरकार द्वारा समर्-समर् पर तीन साल की अवजध के जलए नाजमत दकर्ा िाएगा। v. क्षेत्रीर् अजधकारी, कनााटक राज्र् प्रििू ण जनर्ंत्रण बोड ा पिेन, सिस्ट्र्; vi. प्रजतजष्ठत संस्ट्थान र्ा जवश्वजवद्यालर् स े पाररजस्ट्थजतकी म ें एक जविेिज्ञ समर्-समर् सिस्ट्र्;

पर तीन साल की अवजध के जलए कनााटक राज्र् सरकार द्वारा नाजमत दकर्ा िाएगा vii. उपार्ुि र्ा उनके प्रजतजनजध, - जविर्नगर जिला पिेन, सिस्ट्र्; viii. उपार्ुि र्ा उनके प्रजतजनजध, बल्लारी जिला पिेन, सिस्ट्र्; ix. उपार्ुि र्ा उनके प्रजतजनजध, जचत्रिगु ा जिला पिेन, सिस्ट्र्;

x. उप वन संरक्षक, जविर्नगर सभं ाग, जविर्नगर पिेन, सिस्ट्र् सजचव।

19. जनगरानी सजमजत के कार्.ा- (1) जनगरानी सजमजत वास्ट्तजवक स्ट्थल-जवजिष्ट जस्ट्थजतर्ों के आधार पर छानबीन करेगी, भारत सरकार के तत्क ालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना स.ं का.आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अनुसूची म ें सजम्मजलत और पाररजस्ट्थजतकी संवेिी िोन म ें आने वाल े दक्रर्ाकलापों और इस अजधसूचना के परै ा 17 के12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अधीन सारणी म ें र्था जवजनर्िाष्ट प्रजतजिि गजतजवजधर्ों के जसवार् आने वाल े ऐसे दक्रर्ाकलापों की वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर जनगरानी सजमजत द्वारा संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूव ा पर्ाावरण अनापजत्त लेने के जलए केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतना मंत्रालर् को जनर्िष्टा की िाएगं ी।

(2) इस अजधसूचना के परै ा 17 के अधीन सारणी म ें र्था जवजनर्िाष्ट प्रजतजिि दक्रर्ाकलापों के जसवार्, भारत सरकार के तत्क ालीन पर्ाावरण और वन मत्रं ालर् की अजधसूचना संख्र्ा का.आ. 1533(अ), तारीख 14 जसतंबर, 2006 की अजधसूचना की अनुसूची के अधीन ऐसे दक्रर्ाकलापों, जिन्ह ें सजम्मजलत नहीं दकर्ा गर्ा ह,ै परंतु िो पाररजस्ट्थजतकी संवेिी िोन में आत े ह,ैं ऐस े दक्रर्ाकलापों की वास्ट्तजवक जवजनर्िाष्ट स्ट्थलीर् ििाओं के आधार पर जनगरानी सजमजत द्वारा संवीक्षा की िाएगी और उसे संबि जवजनर्ामक प्राजधकरणों को जनर्िाष्ट दकर्ा िाएगा । जनगरानी सजमजत संबंजधत जवभागों के प्रजतजनजधर्ों र्ा जवििे ज्ञों, औद्योजगक संघों के प्रजतजनजधर्ों र्ा संबंजधत पक्षों को, प्रत्र्ेक मामले म ेआवश्र्कता के अनुसार, अपन े जवचार-जवमिा म ें सहार्ता के जलए आमंजत्रत कर सकेगी ।

(4) जनगरानी सजमजत प्रत्र्ेक विा 31 माच ा की जस्ट्थजत के अनसु ार अपनी वार्िाक कारावाई ररपोटा, राज्र् के मख्ु र् वन्र्िीव वाडान को, उपाबंध-XII म ेंदिए गए जनििान पत्र के अनुसार, उस विा की 30 िनू तक प्रस्ट्तुत करेगी ।

(5) केन्द्रीर् सरकार अपने कार्ों के प्रभावी जनवाहन के जलए जनगरानी सजमजत को जलजखत रूप म ें ऐस े जनिेि िे सकती ह,ै िैसा वह उजचत समझे।

20. अनपु ालन न करन े की जिकार्त.ें- जनगरानी सजमजत का सिस्ट्र्-सजचव र्ा सबं ंजधत उपार्ुि ऐसे व्यजि के जवरूि, िो इस अजधसूचना के दकसी उपबंध का उल्लंघन करता ह,ै पर्ावा रण (संरक्षण) अजधजनर्म,1986 की धारा NOTIFICATION New Delhi, the 27th October, 2023 S.O. 4747(E).—WHEREAS, in supersession of the notification of the Government of India in the Ministry of Environment, Forest and Climate Change number S.O. 2145(E), dated 6th July, 2017, a draft notification was published in the Gazette of India, Extraordinary, vide number S.O. 1226 (E), dated the 14th March, 2023, inviting objections and suggestions from all persons likely to be affected thereby within the period of sixty days from the date on which copies of the Gazette containing the said notification were made available to the public;

AND WHEREAS, copies of the said Gazette notification were made available to the public on the 14th March, 2023;

AND WHEREAS, objections and suggestions received from persons and stakeholders in respect of the said draft notification have been considered by the Central Government;

AND WHEREAS, the Gudekote Extension Sloth Bear Sanctuary situated in the Kudligi taluk of Vijayanagara District and Sandur talukas of Ballari District, and Molakalmuru taluk of Chitradurga District,

Karnataka lies between East: 14°52' 05.59’’, 76° 43’ 54.43’’, West: 14°47' 17.23’’, 76° 28’ 45.79’’, North 14°57'

13.49’’, 76° 39’ 45.76’’, and South: 14°45' 38.41’’, 76° 34’ 18.67’’, covering a total Protected area of 167.66 square kilometer.

AND WHEREAS, the Sanctuary was notified as “Gudekote Extension Sloth Bear Sanctuary” with details as follows;

AND WHEREAS, a total of 16759.79 hectares or 167.59 Sq. km is declared as a Protected Area.

AND WHEREAS, it is necessary to conserve and protect the geographical area around the protected area of Gudekote Extension Sloth Bear Sanctuary from ecological and environmental aspects, to conserve and protect the Sloth Bear, Leopard and other endangered faunal biodiversity and wildlife therein and its environment, and to prohibit industries or class of industries and their operations and processes in this geographical area;

NOW THEREFORE, in exercise of the power conferred by sub section (l), clauses (v) and (xiv) of section

(2), and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of

rule 5 of the Environment (Protection) Rules, 1986, and in supersession of notification number S.O. 2145(E), dated 6th July, 2017, except as respects things done or omitted to be done, the Central Government hereby notifies an area from the boundary of Gudekote Extension Sloth Bear Sanctuary, in the State of Karnataka as the Gudekote Extension Sloth Bear Sanctuary Eco-sensitive Zone (herein after referred to as the Eco-Sensitive Zone) details of which are as under,

namely:-

1. Extent and boundaries of Eco-sensitive Zone.- (1) The Eco-sensitive Zone shall cover an area of 234.54 square kilometers with an extent varying from 1 kilometer to 5.70 kilometers from the boundary of Gudekote Extension Sloth Bear Sanctuary.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 41

(2) The boundary details, latitudes and longitudes of the Eco-sensitive Zone are in Annexure - I.

(3) The list of forty eight (48) villages falling within Eco-sensitive Zone along with co-ordinates of prominent points is in Annexure-II.

(4) The map of the Eco-sensitive Zone in Annexure-III.

(5) The list of Protected Forests falling within the Eco-sensitive Zone is in Annexure -IV.

(6) The list of Reserve Forests falling within the Eco-sensitive Zone is in Annexure-V.

(7) The list of trees, reptiles, birds and mammals found within the Eco-sensitive Zone is in Annexures-VI to X.

(8) The list of legal categories of land falling within the Eco-sensitive Zone is in Annexure-XI.

2. Zonal Master Plan for the Eco-sensitive Zone .– (1) The State Government shall for the purpose of effective management of the Eco-sensitive Zone, prepare a Zonal Master Plan, within a period of two years from the date of the publication of this notification in the Official Gazette, in accordance with the provisions of this

notification, the relevant Central and State laws, and the guidelines issued by the Central Government, if any.

(2) The Zonal Master Plan shall be approved by the Competent Authority in the State Government.

(3) The Zonal Master Plan shall be prepared in consultation with the local residents and, with all State Departments concerned, namely:-

(i) Environment;

(ii) Forest;

(iii) Urban Development;

(iv) Tourism;

(v) Municipality;

(vi) Revenue;

(vii) Agriculture;

(viii) Karnataka State Pollution Control Board;

(ix) Irrigation;

(x) Public Works Department; and

(xi) any other concerned agency in the State, for integrating environmental and ecological considerations.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that needs attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, village and urban settlements, types and kinds of forests, tribal areas, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated and promoted activities listed in the Table in paragraph 17 and shall ensure eco-friendly development for security of local communities’ livelihood.

(8) Pending the preparation of the Zonal Master Plan for the Eco-sensitive Zone, all new construction and other developmental activities shall be referred to the Monitoring Committee constituted under paragraph 18 for appropriate action under paragraph 19.

(9) The Zonal Master Plan shall be a reference document for the Monitoring Committee for any decision to be taken including consideration for relaxation.

3. Measures to be taken by State Government. - The State Government shall take the measures for giving effect to the provisions of this notification-42 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

4. Land use related measures.- (1) Forests, horticulture areas, tribal areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or convened into areas for commercial

or industrial related development activities:

Provided that the State Government may permit the conversion of agricultural lands within the Eco-sensitive Zone on the recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of local residents, and for the following activities namely:-

(i) Establishment of eco-friendly cottages for temporary occupation of tourists, such as tents, wooden houses, etc. for eco-friendly tourism activities,

(ii) Widening and strengthening of existing roads and construction of new roads,

(iii) Setting up of small scale industries not causing pollution,

(iv) Rainwater harvesting, and

(v) Setting up of cottage industries including village industries, convenience stores and local amenities.

Provided further that the State Government may permit the use of land in tribal area for commercial and industrial development activities or prior approval of the State Government, and or compliance of article 244 of the Constitution of India and the laws for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

(2) The State Government shall correct any error appearing in the records of the land within the Eco-sensitive Zone only once in each case, on consultation with the Monitoring Committee and intimate the Central Government in the Ministry of Environment, Forest and Climate Change about such correction:

Provided that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph:

Provided also that there shall be no consequential reduction in green area, such as forest area and agricultural area and efforts shall be made to reforest the unused or unproductive agricultural areas.

5. Natural springs related measures.- The State Government shall take the following measures, namely.-

(i) Identification of the catchment area of all natural springs and natural springs;

(ii) Planning for conversion and rejuvenation of the catchment area and incorporation of such plans in the Zonal Master Plan; and

(iii) Prohibit development activities at or near the catchment area which are detrimental to such areas.

6. Tourism Master Plan.- (1) The Department of Tourism of the State Government, in consultation with the Department of Forests and Environment of the State Government, shall prepare a Tourism Master Plan for the purpose of effective management of the tourism activities within the Eco-sensitive Zone.

(2) The Tourism Master Plan shall be incorporated in the Zonal Master Plan.

7. Tourism related measures.- (1) All new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by the National Tiger Conservation Authority, with emphasis on eco-tourism, eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone.

(2) Establishment of hotels and resorts shall not be permitted within one kilometer from the boundary of the Gudekote Extension Sloth Bear Sanctuary except for temporary accommodation for tourists related to eco-friendly tourism activities.

(3) Establishment of new hotel and resorts may be permitted by the State Government only in pre-defined and designated areas for eco-tourism beyond the distance of one kilometer from the boundary of the Gudekote Extension Sloth Bear Sanctuary till the extent of the Eco-sensitive Zone, as per the Tourism Master Plan.

(4) The development for tourism and expansion of existing tourism activities may be permitted by the regulatory authorities concerned based on the actual site specific scrutiny and on the recommendations of the Monitoring Committee until the Zonal Master Plan is approved under this notification .

8. Natural heritage Protection and Conservation Plan.- (1) The State Government shall prepare a Natural Heritage Protection and Conservation Plan within six months and such plan shall be incorporated in the Zonal Master Plan.

(2) The State Government shall identify and, plan to protect and conserve the valuable natural heritage sites in the Eco-sensitive Zone, including the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides and cliffs.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 43

9. Man-made heritage Protection and Conservation Plan.- (1) The State Government shall prepare a Man-made Heritage Protection and Conservation Plan within six months and such plan shall be incorporated in the Zonal Master Plan.

(2) The State Government shall identify and, plan to protect and conserve the valuable Man-made heritage sites in the Eco-sensitive Zone, including the buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic and cultural significance.

10. Noise pollution related measures.- The Environment Department of the State Government in consultation with the State Pollution Control Board shall make guidelines for the control of noise pollution in the Eco-sensitive Zone in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000.

11. Air pollution related measures.- The Environment Department of the State Government in consultation with the State Pollution Control Board shall make guidelines for the control of air pollution in the Eco-sensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981), Environment

(Protection) Act, 1986, and the rules made thereunder.

12. Discharge of effluents related measures:- The discharge of treated effluents in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974), the environment (Protection) Act, 1986 and rules made thereunder.

13. Solid wastes, disposal related measures.- (1) The solid waste disposal in Eco-sensitive Zone shall be in accordance with the provisions of the Solid Waste Management Rules, 2016.

(2) The local authorities shall draw up plans for the segregation of solid waste into biodegradable and non- biodegradable components.

(3) The biodegradable components shall be recycled preferably through composting or vermiculture.

(4) The non-biodegradable components may be disposed of in an environmentally acceptable manner at a site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall be permitted in the Eco- sensitive Zone.

14. Bio-medical waste disposal related measures.- The bio-medical waste disposal in the Eco-sensitive Zone shall be in accordance with the provisions of the Bio-Medical Waste Management Rules, 2016.

15. Vehicular traffic related measures.- The State Government shall regulate the vehicular movement of traffic in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master Plan is prepared and approved under this notification, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant guidelines of the Central Government in the Ministry of Environment, Forest and Climate Change.

16. Industrial units related measures.- (1) No establishment of new wood based industries within the Eco-sensitive Zone shall be permitted except the existing wood based industries set up as per the law.

(2) No establishment of any new industry causing water, air, soil or noise pollution within the Eco-sensitive zone shall be permitted.

17. List of prohibited, regulated and promoted activities within the Eco-sensitive Zone.- All activities in the Eco-sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made thereunder, and be regulated in the manner specified in the table below, namely:- TABLE Sl.No. Activity Remarks

Union of India in Writ Petition (Civil) No.202 of 1995 and order of the Hon'ble Supreme Court dated the 21st April, 2014 in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No.435 of 2012.

2 Setting up of sawmills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.

3 Setting up of industries causing water, air, soil No new or expansion of polluting industries in the or noise pollution. Eco-sensitive Zone shall be permitted 4 Commercial use of firewood. Prohibited as per applicable laws.

5 Establishment of new thermal and major Prohibited (except as otherwise provided) as per hydroelectric projects. applicable laws.

9 New wood based industry. No establishment of new wood based industry may be permitted within the limits of Eco-sensitive Zone.

The existing wood-based industry may continue as per applicable laws.

10. Setting up of brick kilns. Prohibited as per applicable law.

Regulated activities

11. Use of plastic carry bags, laminates and tetra Disposal of plastic articles, laminates and tetra packs packs. shall be regulated and monitored as per applicable laws.

12. Establishment of hotels and resorts. No new commercial hotels and resorts may be permitted within one kilometer of the boundary of the protected area except for accommodation for temporary occupation of tourists related to eco- friendly tourism activities.

However, beyond one kilometer and upto the extent of the Eco-sensitive Zone, all new tourism activities or expansion of existing activities would in conformity with the Tourism Master Plan.

13. Construction activities. (a) No new commercial construction of any kind may be permitted within one kilometre from the boundary of the Protected Area or up to extent of the Eco- sensitive Zone, whichever is nearer:

(b) The local residents may be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 3 as per building byelaws to meet the residential needs of

the local residents such as:

(i) Widening and strengthening of existing roads and construction of new roads;

(ii) Construction and renovation of infrastructure and civic amenities;

(iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 45

(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including home stays; and

(v) Promoted activities listed in this Notification.

(c) The construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(d) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.

14. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government;

(b)The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Acts and the rules made there under.

(c) In case of Reserve Forests and Protected Forests, the Working Plan prescriptions shall be followed.

15. Commercial water resources including ground Regulated under applicable law. water harvesting.

16. Erection of electrical cables, transmission lines Regulated and to promote underground cabling. and telecommunication towers and Optical fiber cables, pipelines etc.

17. Fencing of existing premises of hotels and Regulated under applicable laws. lodges.

18. Widening and strengthening of existing roads. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable.

19. Movement of vehicular traffic at night. Regulated for commercial purpose, under applicable laws.

20. Introduction of exotic species. Regulated under applicable laws.

21. Protection of hill slopes and river banks. Regulated under applicable laws.

22. Discharge of treated effluents in natural water The discharge of treated waste water/effluents shall be bodies or land area and disposal of solid waste. avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water.

Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.

25. Small scale industries not causing pollution. Non polluting, non-hazardous, small -scale and service industry, agriculture, floriculture, horticulture or agro- based industry producing products from indigenous goods from the Eco-sensitive Zone, and which do not cause any adverse impact on environment shall be permitted.

26. Collection of Forest produce or Non-Timber Regulated under applicable laws.

27. Air and vehicular pollution. Regulated as per applicable laws.

35 Use of renewable energy sources. Bio gas, solar light, etc. to be promoted.

18. Monitoring Committee. - There shall be a committee to be known as Monitoring Committee consisting of the following persons, namely:- Designation Sl.No. Constituent of the Monitoring Committee i. Regional Commissioner, Gulbarga Chairman, Ex- officio;

ii. Representative of the Department of Environment, Government of Member, Ex- officio;

Karnataka iii. Representative of the Department of Urban Development, M ember, Ex- officio;

Government of Karnataka iv. Representative of Non-Governmental Organisations working in the Member; field of natural conservation (including heritage conservation) to be nominated by the Government of Karnataka for a term of three years from time to time.

v. Regional Officer, Karnataka State Pollution Control Board Member, Ex- officio; vi. One expert in the area of ecology and environment from reputed Member;

Institution or University of the State of Karnataka to be nominated by the Government of Karnataka for a term of three years from time to time. vii. The Deputy Commissioner or his representative, Vijayanagara Member, Ex- officio;

District viii. The Deputy Commissioner or his representative, Ballari District Member, Ex- officio; ix. The Deputy Commissioner or his representative, Chitradurga District Member, Ex- officio; x. The Deputy Conservator of Forests, Vijayanagara Division Member Secretary, Ex- officio.

19. Functions of the Monitoring Committee.–(1)The Monitoring Committee shall, based on the actual site-specific conditions, scrutinise the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities specified in the Table under paragraph 17 thereof, and refer to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case may be, for prior environmental clearances under the provisions of the said notification.

(2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities specified in the Table under paragraph 17 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and refer to the regulatory authorities concerned.

(3) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case to case basis.

(4) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro- forma specified in Annexure-XII.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 47

(5) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

20. Complaints for non-compliance.- The Member-Secretary of the Monitoring Committee or the Collector or the Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment
