1310. Shri Sanjay Dina Patil:
Will the Minister of CORPORATE AFFAIRS be pleased to state:
(a) whether the Government has undertaken any assessment of the Corporate Social Responsibility (CSR) expenditure by companies headquartered in Mumbai during the last three years and the current year, if so, the details thereof;
(b) the details of CSR funds allocated and utilized for projects relating to public healthcare, Government schools, environmental conservation, waste management, women empowerment and skill development in the Mumbai Metropolitan Region;
(c) whether the Government has observed any imbalance in CSR investments across different municipal wards of Mumbai, particularly in densely populated and economically weaker areas, if so, the details thereof; and
(d) whether the Government proposes to introduce any mechanism for improved coordination among companies, local bodies and implementing agencies to ensure equitable distribution, transparency and effective monitoring of CSR projects in Mumbai and if so, the details thereof? (a): No Sir.
(b) & (c): There is no provision of allocation of CSR funds in CSR legal framework and the Ministry does not maintain metropolitan region wise CSR data centrally. On the basis of annual filings made by the companies in the MCA21 registry, Development sector-wise and district wise CSR expenditure in Maharashtra for the last Financial Years i.e. 2022-23 to 2024-25 is at Annexure-I and Annexure-II respectively.
Under the Companies Act, 2013, CSR is a Board driven process and the Board of the company is empowered to plan, decide, execute and monitor CSR activities of the company undertaken in the areas or subjects specified in Schedule VII of the Act, based on the recommendation of its CSR committee. The first proviso to Section 135 (5) of the Act provides that the company shall give preference to the local area and areas around it where it operates. However, the emphasis on local area is only directory and not mandatory in nature. The Government does not issue any directions to Corporates to spend in any particular area or activity.
