138. Shri Vijay Baghel:

Will the Minister of CORPORATE AFFAIRS be pleased to state:

(a) the details of the projects for which funds have been released under Corporate Social Responsibility (CSR) in the State of Chhattisgarh during the last five years, indicating the amount released for each project and the details of all such works, company-wise and district-wise, including Durg Parliamentary Constituency and Bemetara district;

(b) whether all the projects have been completed within the stipulated time, if so, the details thereof and if not, the reasons therefor; and

(c) whether any action has been taken against the persons responsible and the nodal agencies concerned for the incomplete projects and if so, the details thereof? (a) & (b). All data related to CSR filed by companies in MCA21 registry is available in public domain and can be accessed at www.csr.gov.in. On the basis of annual filings made by companies in the MCA21 registry, district-wise CSR expenditure in Chhattisgarh during the last five financial years from 2020-21 to FY 2024-25, are attached at Annexure. The Ministry does not maintain parliamentary constituency-wise CSR data and the completion status of CSR project separately.

(c): The legal framework for Corporate Social Responsibility (CSR) has been provided under

Section 135 of the Companies Act, 2013 (‘Act’), Schedule VII of the Act and Companies (CSR Policy) Rules, 2014. Under the Act, CSR is a Board driven process and the Board of the company is empowered to plan, decide, execute and monitor CSR activities of the company based on the recommendation of its CSR Committee. The CSR framework is disclosure based and CSR mandated companies are required to file details of CSR activities annually in the MCA21 registry. The Board has to ensure that the approved amount has been spent on the assigned activity(ies). In case any amount remains unspent then such amount shall be transferred in the designated fund(s) in Schedule VII in the prescribed time limit.
