141. Dr. T Sumathy Alias Thamizhachi Thangapandian:
Will the Minister of CORPORATE AFFAIRS be pleased to state:
(a) the total corporate tax collected from companies registered or headquartered in Tamil Nadu during each of the last three financial years, despite of Tamil Nadu's rank among States on this metric;
(b) the details of the total CSR expenditure reported as spent within Tamil Nadu during the same period;
(c) whether the Government has benchmarked this return against the State's tax contribution and if so, the details thereof;
(d) the number of Tamil Nadu-based companies found non-compliant with mandatory CSR spending under Section 135 of the Companies Act, 2013, and the penalty action taken in each of case;
(e) whether the Government is likely to consider Tamil Nadu is repeatedly cited by the 16th Finance Commission of the Government as a State whose fiscal contribution outpaces its return under devolution, if so, the details thereof; and
(f) whether the Government is considering a weighted CSR-direction incentive for industrially lagging districts of Tamil Nadu such as Virudhunagar, Ramanathapuram and the Cauvery delta and if so, the details thereof? (a): The details of total corporate tax collected in Tamil Nadu from the Financial Years 2023-24 to 2025-26 is attached at Annexure-I.
(b): On the basis of annual filings made by companies in the MCA21 registry.
District-wise CSR expenditure in Tamil Nadu from FY 2022-23 to 2024-25 is at Annexure II.

(c): No Maโam. As per the Companies Act, 2013, the CSR obligation is linked to its net worth or turnover or net profit of the Company. The above is not related to the Stateโs tax contribution.
(d): Whenever violation of CSR provisions is reported, action against such non-compliant Companies is initiated as per provisions of the Act after due examination of records and following due process of law. In the last three years i.e. 2023-24, 2024-25 and 2025-26, 04 companies in Tamil Nadu have been penalised and penalty amount of Rs.2.36 crore has been imposed.
(e): The Government of India has examined the report of the Sixteenth Finance Commission and the Explanatory Memorandum as to the action taken by the Government of India on the Recommendations made by 16th Finance Commission is presented in the Parliament and also available at
https://www.indiabudget.gov.in/doc/16fc.pdf.
The amount of devolution to States is made as per accepted recommendation of the Finance Commission. The methodology and criteria for, inter-se, distribution of net proceeds of taxes among the States is decided by the Finance Commission for its award period. Also, no State has received tax devolution lesser than their share as recommended by the Finance Commission during the last five financial years.
