3376. DR. BYREDDY SHABARI:
Will the Minister of LAW AND JUSTICE be pleased to state:
(a) the number of Exclusive Special Courts notified and operational under the Protection of Civil Rights Act, 1955 and the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 since 2018, year-wise and State/UT-wise;
(b) the pendency, conviction rate and average disposal time of cases during the last five years, district-wise;
(c) the number of charge sheets filed and average time taken from FIR registration to filing of charge sheets during the same period, State/UT-wise;
(d) the sanctioned strength and vacancies of judicial officers, Special Public Prosecutors and court staff, State/UT-wise;
(e) the funds allocated, released and utilised for judicial infrastructure since 2018, year-wise and State/UT-wise; and
(f) whether the Government proposes to issue guidelines for time-bound trials, witness protection and victim compensation and, if so, the details thereof? ANSWER MINISTER OF STATE (INDEPENDENT CHARGE) OF THE MINISTRY OF LAW AND JUSTICE; AND MINISTER OF STATE IN THE MINISTRY OF PARLIAMENTARY AFFAIRS (SHRI ARJUN RAM MEGHWAL)
(a): Section 14 of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities){PoA} Act, 1989 as amended by the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015 specifies that for the purpose of providing for speedy trial, the State Government shall, with the concurrence of the Chief Justice of the High Court, establish an Exclusive Special Court for one or more districts, provided that in Districts where less number of cases under this Act is recorded, the State Government shall, with the concurrence of the Chief Justice of the High 1Court, specifies for such Districts, the Court of sessions to be a Special Court to try the offences under the Act.
As per the information received from the States/UTs, the details of Exclusive Special Courts established under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, from the financial year 2018-19 to 2024-25 are given at Annexure-I.
(b) & (c): As per the data received from National Crime Record Bureau (NCRB), the details of Cases Chargesheeted (CCS), Cases in which Trials Completed (CTC), Conviction Rate (CVR) and Cases Pending at the end of the year (CPTEY) from 2019 to 2023 under the Protection of Civil Rights (PCR) Act, 1955 and the Scheduled Castes (SC) and the Scheduled Tribes (ST) (Prevention of Atrocities) {PoA} Act, 1989 for Schedule Castes are given at Annexure-II and corresponding details for the Schedule Tribes is given at the Annexure -III.
The State/UT-wise details of time taken for submitting the chargesheet under the Protection of Civil Rights (PCR) Act, 1955 and the Scheduled Castes (SC) and the Scheduled Tribes (ST) (Prevention of Atrocities) {PoA} Act, 1989 from 2019 to 2023 for Schedule Castes are given at Annexure-IV (A-E) and corresponding details for the Schedule Tribes is given at the Annexure-V (A-E).
(d): As regards the recruitment of judges/prosecutors and staff in courts, filling up of vacant positions of the judicial officers in District and Subordinate courts, is the responsibility of the State Governments and the concerned High Courts. Under Section 14 of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) [PoA] Act, 1989, the States/UTs are responsible for establishing Exclusive Special Courts with the concurrence of the Chief Justice of the concerned High Court.
(e): The Department of Social Justice and Empowerment runs a Centrally Sponsored Scheme (CSS) for the implementation of the Protection of Civil Rights (PCR) Act, 1955 and the Scheduled Castes
(SC) and the Scheduled Tribes (ST) (Prevention of Atrocities) {PoA} Act, 1989, under which Central Assistance is provided to the States/UTs mainly for five components including Setting up and Functioning of Exclusive Special Courts.
As per the Scheme guidelines, central assistance is provided as per the actual requirement proposed by the State/UT Governments towards salary, office expenses etc. However, there is no provision for providing central assistance for procurement of land, construction of buildings and judicial infrastructure relating to these courts.
(f): The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 as amended from time to time provides for time bound trial under Section 14(2), witness protection under Section 215 A-Rights of victims and witnesses and Relief and rehabilitation of atrocity victims as per Rule 12
(4) of the PoA Rules, 1995 and as amended from time to time.
Further, as per Section 398 of BNSS, the State Governments are required to prepare and notify a Witness Protection Scheme with a view to ensure protection of the witness. Victim compensation is provided by the States and Union Territories through schemes framed under section 396 of Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) (earlier 357A of the Code of Criminal Procedure,
1973), in addition to the relief and rehabilitation measures prescribed under the SC/ST (Prevention of Atrocities) Rules, 1995.
Moreover, the Government of India issues advisories to the State Governments/UT Administrations from time to time for effective implementation of the SC/ST (PoA) Act and Rules. **** 3Annexure-I Details of Exclusive Special Courts established by States/UTs under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 from the financial year 2018-19 to 2024-25 Sl.
