Parliament Question: Pendency of Cases before NCLT

(a) the total number of cases instituted, disposed of and pending before the National Company Law Tribunal (NCLT) since 2017, year-wise;

(b) the total number of cases pending currently beyond the timelines prescribed under the Insolvency and Bankruptcy Code, 2016 (IBC);

(c) the value of stressed assets involved in cases pending under IBC, including the value of assets locked in insolvency proceedings pending beyond the prescribed timelines, year-wise since 2017;

(d) whether the Government has assessed the extent of value erosion of assets due to delays in insolvency resolution proceedings before NCLT, if so, the details thereof; and

(e) the measures taken or proposed to be taken by the Government to reduce pendency, prevent value erosion of stressed assets and ensure timely resolution of cases before NCLT? (a) The total number of cases instituted, disposed of and pending before the National Company Law Tribunal (NCLT) since 2017, year-wise, is as follows:

(b) As on 31 March 2026, 1885 Corporate Insolvency Resolution Processes (CIRPs) were ongoing under the Insolvency and Bankruptcy Code, 2016 (IBC). Out of these, 1367 CIRPs have exceeded the statutory timeline of 330 days.(c) The data for the value of stressed assets involved in ongoing cases under IBC is not maintained. Insolvency and Bankruptcy Board of India (IBBI) maintains such data of closed CIRP cases only.

(d) The IBBI had undertaken a study to examine the impact of the time taken for resolution and creditor recoveries. The study indicate that recoveries decline as the resolution timeline increases.

(e) Necessary steps are taken to reduce pendency and facilitate timely resolution of cases on an ongoing basis including inter alia filling up of vacancies, implementation of e-court and hybrid court project, regular colloquiums for capacity building of members, provision of infrastructure facilities etc. The Government has undertaken seven legislative amendments to the IBC and IBBI has introduced over 100 changes to the regulations since its inception, to strengthen the insolvency resolution framework and enhance procedural efficiency.
