Order Maharashtra Protection of interest of DePositors (in financial establishMents) act, 1999.

No. MPID 1121/C.R.652/POL-11 .— Whereas, M/s. the Dream Nirman Developers and M/s. Prathvi Builders and Developers (hereinafter respected to as the said financial Establishment) and its Chairman, Directors, Managers, Promoters, Partners and its employees responsible for its management have received deposits from depositors under the scheme to repay the deposits on maturity along with benefits promised thereof to the depositors ;

And whereas an offence has been registered against the said financial establishments and its Chairman, Directors, Managers, Promoters, Partners and its employees at Nalasopara Police Station, Commissioner of Police Mira-Bhayander Vasai-Virar vide Complaint Register No. 104/2020, under sections 406, 409, 420 and 34 of the Indian Penal Code (45 of 1860) and under sections 3 and 4 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000) and sections 3, 4 and 13 of the Maharashtra Ownership Flats (Regulation of the promotion of construction, sale, management and transfer) Act, 1963 (Mah. XIV of 1963) that they have collected the deposits and failed to repay the deposits after maturity ;

And whereas, the Government of Maharashtra is satisfied that the said Financial Establishments and its Chairman, Directors, Managers, Promoters, Partners and its employees has failed to repay the deposits and the said Financial Establishments is not likely to return the deposits to the depositors ;

And whereas, the Government of Maharashtra considers it expedient to attach the monies or other properties believed to have been acquired by said Financial Establishments and its Chairman, Directors, Managers, Promoters, Partners and its employees or any other person, either in their own name or in the name of any other person from out of the deposits collected by the said Financial Establishments, in order to protect the interest of the depositors of the said Financial Establishments and to appoint the Sub-Divisional Officer, Vasai as the Competent Authority to exercise control over the monies and the other properties attached.

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 4 and sub-section

(1) of section 5 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (Mah. XVI of 2000), the Government of Maharashtra hereby,-

(a) attaches the monies or other properties in the name of M/s. Dream Nirman Developers, Office Adress Shop No.1, 2, 3, Punam Empire, near Funfista Cinema, Nalasopara (East) and M/s. Prathvi Builders and Developers Office Address, Shop No.1, Sneha Nagar Building, Nilemore Goan, Opp. Gav Devi, Nalasopara (West) and its Chairman, Directors, Managers, Promoters, Partners and its employees or any other person, as specified in the Schedule appended hereto; and

(b) appoints the Sub-Divisional Officer, Vasai to be the Competent Authority to exercise control over the monies and other properties attached.
