Order in the matter of IndusInd Bank Limited (Corporate Agent) भारतीय बीमा विवियामक और विकास प्राविकरण (आईआरडीएआई) िे जूि 2023 के दौराि संचावित एक आिसाइट विरीक्षण तथा अिुिती प्रितति कायतिाही के अिुसरण में मेससत इंडसइंड बैंक विवमटेड (कारपोरेट एजेंट) के विरुद्ध एक आदेश पाररत वकया। विरीक्षण के विष्कर्षों, उक्त कारपोरेट एजेंट द्वारा वकये गये प्रस्तुतीकरणो.ं और दो पूणतकाविक सदस्ो ं के पैिि के समक्ष संचावित िैयक्तक्तक सुििाई के आिार पर, ििीकरण सूचिाओ,ं बीमा पाविसीिारको ं के विए वशकायत वििारण व्यिस्था, प्राविकरण को प्रकटीकरणो,ं तथा कारपोरेट एजेंट की िेबसाइट पर प्रकटीकरणो ंसे संबंवित कु छ उल्लंघि प्रमावणत हुए। कारपोरेट एजेंट िे बीमा-विवशष्ट आईिीआर अथिा िेबसाइट चैिि उपिब्ध करािे के बजाय, सामान्य बैंवकं ग व्यिस्थाओ ंपर अिुवचत रूप से विभतर रहते हुए, एक समवपतत, पाविसीिारक-अवभमुख वशकायत वििारण ढााँचे की स्थापिा िही ं की। इसके अवतररक्त, विवियामक कायतिाही के दौराि अिुपािि का िचि देिे के उपरांत, कारपोरेट एजेंट िे अभ्यािेदि और एक वशकायत पोटति के स्क्रीिशाट प्रस्तुत वकये वक प्राविकरण के द्वारा जााँच-सत्यापि के बाद, वसद्ध हुआ वक उसिे उक्त कायत िही ंवकया और वशकायतो ं की प्राक्ति-सूचिाएाँ जारी िही ंकी।ं तथ्ो ं और प्रस्तुतीकरणो ं पर उवचत विचार करिे के उपरांत, सक्षम प्राविकारी िे आईआरडीएआई (कारपोरेट एजेंटो ं का पंजीकरण) विवियम, 2015 के विवियम 20(1) के उल्लंघि के विए, बीमा अविवियम, 1938 की िारा 102 के अिीि रु. 1 करोड़ (के िि एक करोड़ रुपये) का अथतदंड िगाया। कारपोरेट एजेंट को अपिी वशकायत वििारण व्यिस्था को मजबूत करिे के विए विदेश वदया गया है। कारपोरेट एजेंट को यह भी विदेश वदया गया है वक िह इस आदेश को अपिे बोडत के समक्ष प्रस्तुत करे और की गई कारतिाई की ररपोटत (एटीआर) प्राविकरण को इस आदेश की तारीख से 90 वदि के अंदर प्रस्तुत करे। प्राविकरण िे ििीकरण सूचिाओ ंमें कवमयो,ं प्राविकरण को विवियामक कारतिाइयो ंके प्रकटीकरण, तथा उसके पंजीकरण और एक बीमा मध्यिती के रूप मे उसकी भूवमका के संबंि में कारपोरेट एजेंट की िेबसाइट के संबंि में वििातररत प्रकटीकरणो ं सवहत, कु छ अन्य अिुपािि संबंिी कवमयो ं के संबंि में चेतािवियााँ और परामशत भी जारी वकये हैं। विस्तृत आदेश आईआरडीएआई िेबसाइट पर Document Detail - IRDAI पर उपिब्ध है। आईआरडीएआई पाविसीिारक संरक्षण, पारदवशतता, उत्तरदावयत्व तथा समूचे बीमा क्षेत्र में विवियामक ढााँचे के अिुपािि को सुविवित करिे के विए विरंतर प्रवतबद्ध है। प्राविकरण जहााँ भी विवियामक उल्लंघि पाये जाते हैं िहााँ उपयुक्त पयतिेक्षी और प्रितति कारतिाई करिा जारी रखेगा।The Insurance Regulatory and Development Authority of India (IRDAI) passed an Order against M/s IndusInd Bank Limited (‘Corporate Agent’), pursuant to an onsite inspection conducted during June 2023 and subsequent enforcement proceedings.

Based on the findings of the inspection, submissions made by the Corporate Agent, and the personal hearing conducted before a panel of two Whole-time Members, certain violations relating to renewal notices, grievance redressal mechanism for insurance policyholders, disclosures to the Authority, and disclosures on the Corporate Agent’s website were established.

The Corporate Agent failed to establish a dedicated, policyholder-facing grievance redressal framework, improperly relying on generic banking mechanisms rather than providing insurance-specific IVR or website channels. Furthermore, after promising compliance during regulatory proceedings, the Corporate Agent submitted representations and screenshots of a grievance portal that, upon test verification by the Authority, proved non-functional and failed to generate complaint acknowledgments.

After due consideration of the facts and submissions, the Competent Authority imposed a penalty of Rs. 1 crore (Rupees One Crore only) under Section 102 of the Insurance Act, 1938, for violation of Regulation 20(1) of the IRDAI (Registration of Corporate Agents) Regulations,

2015. The Corporate Agent has been directed to strengthen its grievance redressal mechanism. The Corporate Agent has also been directed to place the Order before its Board and submit an Action Taken Report (ATR) to the Authority within 90 days from the date of the

Order.

The Authority also issued cautions and advisories in respect of certain other compliance deficiencies, including deficiencies in renewal notices, disclosure of regulatory actions to the Authority, and prescribed disclosures on the Corporate Agent’s website regarding its registration and role as an insurance intermediary.

IRDAI remains committed to ensuring policyholder protection, transparency, accountability and compliance with the regulatory framework across the insurance sector. The Authority will continue to take appropriate supervisory and enforcement action wherever regulatory violations are observed.
